Faith-based child welfare controversy may be reignited in Illinois U.S. Supreme Court limits scope of anti-discrimination rules By Peter Hancock

SPRINGFIELD – A recent U.S. Supreme Court decision could reignite a 10-yearold controversy in Illinois over whether faith-based charities can be prohibited from contracting with the state for foster care and adoption services on the grounds that they refuse to work with unmarried or same-sex couples. In a 9-0 decision Thursday, the nation’s high court ruled against the city of Philadelphia, which had refused to renew a contract for foster care services with Catholic Social Services, arguing that the church-based agency’s refusal to place children in the homes of unmarried and same-sex couples violated a non-discrimination clause in the agency’s contract with the city. Illinois went through a similar controversy in 2011, shortly after the state

legalized civil unions among same-sex couples, when the Department of Children and Family Services refused to renew a contract with Catholic Charities of Illinois over a similar policy. At that time, however, a circuit court judge in Sangamon County sided with the state and dismissed a lawsuit brought by Catholic Charities. “For us here in Illinois, had this decision been on the books when the state of Illinois did what it did back in 2011, the Catholic Charities would have been continuing in foster care,” said Peter Breen, vice president and general counsel for the Chicago-based Thomas More Society, which intervened in the case. “And we wouldn’t have had to suffer through the last 10 years of DCFS incompetence, which has harmed so many children, because you would have had your best performing foster care providers continuing the work they had been doing for a century or more,” he added. In last week’s Supreme Court case, Fulton v. Philadelphia, the court faced an almost identical question – whether the non-discrimination clause in the contract violated Catholic Social Services’ First Amendment right to the free exercise of religion. In this case, the court ruled that it did, but the justices decided that issue on narrow grounds that some legal experts say only applies to the city of Philadelphia. Normally, the court would uphold the right of a state or local government to enact a requirement that might burden the free exercise of religion as long as the rule is both neutral and generally applicable to all individuals and groups, regardless of religious affiliation. That standard comes from a 1990 Supreme Court case involving the Oregon Division of Employment Security. But in Philadelphia’s case, the justices said, the rule is not generally applicable because the contract contains a clause allowing for exceptions to be made “at the sole discretion of the Commissioner” of the Philadelphia Department of Human Services. “No matter the level of deference we extend to the City, the inclusion of a formal system of entirely discretionary exceptions ... renders the contractual non-discrimination requirement not generally applicable,” the court wrote. Ed Yohnka, director of communications and public policy for the ACLU of Illinois, said that distinction makes the Philadelphia case markedly different from the 2011 case in Illinois. “The way in which it differs is that DCFS required every agency who provided care and adoption and foster care services through contracts with the agency to comply with all of Illinois’ non-discrimi-

nation laws,” he said. “They didn’t pick and choose on the basis of what the objection was on the part of a particular service provider.” Although the Supreme Court’s decision last week was unanimous, four of the justices – Amy Coney Barrett, Brett Kavanaugh, Neil Gorsuch and Clarence Thomas – signed on to concurring opinions saying they would have gone even further by agreeing to review, if not strike down, the standard set in the 1990 Oregon case. A fifth justice, Stephen Breyer, who is often seen as a swing vote on the court, also signed on to one of the concurring opinions, except for a paragraph saying the Oregon standard likely should be overturned. “This decision is the latest in a string of decisions that have come out from the Supreme Court in the last few years respecting the rights of people of faith to participate in public life,” Breen said. “And the trend is clearly in favor of construing the Constitution to protect religious individuals and entities from the heavy hand of government.” But Breen said it is unlikely that Catholic Charities in Illinois – which are operated by the four archdiocese of the Catholic Church in the state – will try to reestablish itself with state contracts for child welfare services anytime soon because, when the Sangamon County court ruled against them in 2011, they essentially dismantled their services while their staff went to other outside agencies. “Restarting foster care would not be a small task for any entity, starting from scratch,” he said. Yohnka, at the ACLU of Illinois, meanwhile, said he couldn’t predict whether the Philadelphia case would reopen another chapter of litigation in Illinois. But he said he thinks it would be wrong for the state to revisit the issue. “I think what’s interesting, or what’s lost in this is that there was just that recent report by the auditor general, that found DCFS and its partner agencies were failing to serve LGBTQ kids across the state, really, to the point of just not having any kind of capacity to really even identify, provide services, provide spaces and homes for them to live in where they could be affirmed,” he said. “And I think the idea of going backward in terms of allowing for gay or lesbian couples to be discriminated against in foster care or adoption really feels like a gigantic mistake in the context of what we already know.” Capitol News Illinois is a nonprofit, nonpartisan news service covering state government and distributed to more than 400 newspapers statewide. Iran’s election unsettles Biden’s hope for a nuclear deal BY MATTHEW LEE ASSOCIATED PRESS

WASHINGTON (AP) — Biden administration o�cials are insisting that the election of a hard-liner as Iran’s president won’t a�ect prospects for reviving the faltering 2015 nuclear deal with Tehran. But there are already signs that their goal of locking in a deal just got tougher. Optimism that a deal was imminent faded as the latest talks ended Sunday without tangible indications of significant progress. And on Monday, in his first public comments since the vote, incoming Iranian President Ebrahim Raisi rejected a key Biden goal of expanding on the nuclear deal if negotiators are able to salvage the old one. At the same time, Raisi is likely to raise Iran’s demands for sanctions relief in return for Iranian compliance with the deal, as he himself is already subject to U.S. human rights penalties. “I don’t envy the Biden team,” said Karim Sadjapour, a senior fellow at the Carnegie Endowment for International Peace who has advised multiple U.S. administrations on Iran. “I think the administration now has a heightened sense of urgency to revise the deal before Raisi and a new hard-line team is inaugurated.” President Joe Biden and his team have made a U.S. return to the deal one of their top foreign policy priorities. The deal was one of President Barack Obama’s signature achievements, one that aides now serving in the Biden administration had helped negotiate and that Donald Trump repudiated and tried to dismantle as president. Despite Raisi’s impending presidency, Biden administration officials insist prospects for reaching an agreement are unaltered. They argue that Iran’s Supreme Leader Ayatollah Ali Khamenei, who signed o� on the 2015 deal known as the Joint Comprehensive Plan of Action, or JCPOA, will make any final decisions regardless of who is president. “The president’s view and our view is that the decision leader is the supreme leader,” White House press secretary Jen Psaki said Monday. “That was the case before the election; it’s the case today; it will be the case probably moving forward.” “Iran will have, we expect, the same supreme leader in August as it will have today, as it had before the elections, as it had in 2015 when the JCPOA was consummated for the first time,” State Department spokesman Ned Price said. But hopes for substantial progress fizzled last week ahead of the Iranian election amid a flurry of speculation about the impact of the vote on the indirect talks between Iran and the U.S. in Vienna.

Diplomats and others familiar with the talks had thought the last round, the sixth, could produce at least a tangible result even if it fell short of a full deal. Now, that round has ended and a seventh round has yet to be scheduled as Raisi, Iran’s conservative judiciary chief, brandished an absolute rejection of anything more than Iran’s bare minimum compliance with the 2015 agreement in exchange for a lifting all of U.S. sanctions. In his public comments Monday, Raisi brushed aside U.S. calls for Iran to agree to follow-on discussions on expanding the initial nuclear deal to include its ballistic missile program and its support for regional groups that the U.S. designates terrorist organizations. “It’s nonnegotiable,” Raisi said’ Iran experts agree it will be a tough, if not impossible, for Biden to get Iran to go beyond the nuclear agreement. “I’m very skeptical that once we’ve lifted the sanctions to get them to return they’ll feel any incentive to come back and negotiate more concessions,” Sadjapour said. “And, if we coerce them with sanctions to come back to the table, they’ll argue that we’ve abrogated our end of the nuclear deal. Again.” Critics of the nuclear deal maintain that the administration has already given away too much in exchange for too little by signaling its desire to repudiate Trump’s repudiation of the nuclear deal. And, they say that even if Iran agrees to some sort of additional talks, the pledge will be meaningless. “It was pretty obvious that the Iranians were never gong to negotiate in good faith beyond the JCPOA,” said Rich Goldberg, a

Trump administration National Security Council o�cial who has espoused a hard line on Iran. “But now, even if the administration gets some sort of face-saving language from the Iranians about future talks, Raisi has already said they’re not interested. The jig is up,” he said. “You can’t come back to a skeptical Congress, allies and deal opponents and say the promise means anything it means when Raisi has already said it doesn’t.” But administration o�cials are adamant that as good as the nuclear deal is, it is insu�cient and must be improved on. “We do see a return to compliance as necessary but insu�cient, but we also do see a return to compliance as enabling us to take on those other issues diplomatically,” Price said, adding that the point had been made clear to the the Iranians “in no uncertain terms.” An additional complication is that Raisi will become the first serving Iranian president sanctioned by the U.S. government even before entering o�ce, in part over his time as the head of Iran’s internationally criticized judiciary — a situation that could complicate state visits and speeches at international forums such as the United Nations. Psaki and Price both said that the U.S. will continue to hold Raisi accountable for human rights violations for which he was sanctioned by the Trump administration. Trump withdrew from the nuclear deal in 2018 and set about a “maximum pressure” campaign on Iran that included re-instating all the sanctions eased under the agreement along with adding a host of new ones.

How Big Tech created a data ‘treasure trove’ for police BY MATT O’BRIEN AND MICHAEL LIEDTKE ASSOCIATED PRESS

PROVIDENCE, R.I. (AP) — When U.S. law enforcement o�cials need to cast a wide net for information, they’re increasingly turning to the vast digital ponds of personal data created by Big Tech companies via the devices and online services that have hooked billions of people around the world. Data compiled by four of the biggest tech companies shows that law enforcement requests for user information — phone calls, emails, texts, photos, shopping histories, driving routes and more — have more than tripled in the U.S. since 2015. Police are also increasingly savvy about covering their tracks so as not to alert suspects of their interest. That’s the backdrop for recent revelations that the Trump-era U.S. Justice Department sought data from Apple, Microsoft and Google about members of Congress, their aides and news reporters in leak investigations -- then pursued court orders that blocked those companies from informing their targets. In just the first half of 2020 -- the most recent data available -- Apple, Google, Facebook and Microsoft together fielded more than 112,000 data requests from local, state and federal officials. The companies agreed to hand over some data in 85% of those cases. Facebook, including its Instagram service, accounted for the largest number of disclosures. Consider Newport, Rhode Island, a coastal city of 24,000 residents that attracts a flood of summer tourists. Fewer than 100 o�cers patrol the city -- but they make multiple requests a week for online data from tech companies. That’s because most crimes – from larceny and financial scams to a recent fatal house party stabbing at a vacation rental booked online – can be at least partly traced on the internet. Tech providers, especially social media platforms, o�er a “treasure trove of information” that can help solve them, said Lt. Robert Salter, a supervising police detective in Newport. “Everything happens on Facebook,” Salter said. “The amount of information you can get from people’s conversations online -- it’s insane.” As ordinary people have become increasingly dependent on Big Tech services to help manage their lives, American law enforcement o�cials have grown far more savvy about technology than they were five or six years ago, said Cindy Cohn, executive director of the Electronic Frontier Foundation, a digital rights group. That’s created what Cohn calls “the

golden age of government surveillance.” Not only has it become far easier for police to trace the online trails left by suspects, they can also frequently hide their requests by obtaining gag orders from judges and magistrates. Those orders block Big Tech companies from notifying the target of a subpoena or warrant of law enforcement’s interest in their information — contrary to the companies’ stated policies. Of course, there’s often a reason for such secrecy, said Andrew Pak, a former federal prosecutor. It helps prevent investigations getting sidetracked because someone learns about it, he said —”the target, perhaps, or someone close to it.” Longstanding opposition to such gag orders has recently resurfaced in the wake of the Trump-era orders. Apple in 2018 shared phone and account data generated by two Democratic members of the House Intelligence Committee, but the politicians didn’t find out until May, once a series of gag orders expired. Microsoft also shared data about a congressional aide and had to wait more than two years before telling that person. Brad Smith, Microsoft’s president, last week called for an end to the overuse of secret gag orders, arguing in a Washington Post opinion piece that “prosecutors too often are exploiting technology to abuse our fundamental freedoms.” Critics like Cohn have called for revision of U.S. surveillance laws drawn up years ago when the police and prosecutors typically had to deliver warrants to the home of the person being targeted for searches. Now that most personal information is now kept in the equivalent of vast digital storehouses controlled by Big Tech companies, such searches can proceed in secret. “Our surveillance laws are really based on the idea that if something is really important, we store it at home, and that doesn’t pass the giggle test these days,” Cohn said. “It’s just not true.” Many tech companies are quick to point out that the majority of the information they are forced to share is considered “non-content” data. But that can include useful details such as the basic personal details you supply when you register for an account, or the metadata that shows if and when you called or messaged someone, though not what you said to them. Law enforcement can also ask tech companies to preserve any data generated by a particular user, which prevents the target from deleting it. Doing so doesn’t require a search warrant or any judicial oversight, said Armin Tadayon, a cybersecurity associate at advisory firm the

Brunswick Group. If police later find reasonable grounds for conducting a search, they can return with a warrant and seize the preserved data. If not, the provider deletes the copies and “the user likely never finds out,” Tadayon said. In Newport, getting a search warrant for richer online data isn’t that di�cult. Salter said it requires a quick trip to a nearby courthouse to seek a judge’s approval; some judges are also available after hours for emergency requests. And if a judge finds there is probable cause to search through online data, tech companies almost always comply. “Most of the companies do play ball,” Salter said. “We can speak with people, get questions answered. They’re usually pretty helpful.” Nearly all big tech companies — from Amazon to rental sites like Airbnb, ride-hailing services like Uber and Lyft and service providers like Verizon — now have teams to respond to such requests and regularly publish reports about how much they disclosed. Some of the most dramatic increases in requests have been to tech companies that cater to younger people. As the messaging app Snapchat has

grown in popularity, so have government requests for its data. Snap, the company behind the app, fielded nearly 17,000 data requests in the first six months of 2020, compared to 762 in the same period of 2015. Salter said the fact that we’re all doing so much online means police detectives need to stay tech-savvy. But training courses for how to file such requests aren’t hard to find. For those worried about the growing volume of online data sought by law enforcement, Salter said: “Don’t commit crimes and don’t use your computer and phones to do it.” “Judges are not going to sign o� on something if we don’t have probable cause to go forward,” he said. “We’re not going to look at people’s information without having something to go on.” But Cohn said more tech companies should be using encryption technology to make all personal information, including metadata, virtually impossible to decipher without a user key to unlock it. Until then, she said, police can short circuit constitutional protections against unreasonable searches “by just going to the company instead of coming directly to us.”

Exploding stereotypes By Paula Hendrickson Contributor

Like it or not, most people have preconceived ideas about – or flat out prejudices against – punk rock, Muslims, and even non-traditional women. The new comedy, We Are Lady Parts, challenges all of those stereotypes. The entire six-episode first season premiered earlier this month on Peacock, and I watched every episode in one evening. I rarely binge shows, but I could not stop myself. Set in London, We Are Lady Parts is told mostly through the eyes of Amina (Anjana Vasan), a science nerd PhD student who is also a gifted guitar player. We quickly learn that Amina teaches guitar but never performs, since her extreme stage fright leads to unfortunate bodily reactions. Despite her parents’ more worldly attitudes – including her mom’s (Shobu Kapoor) tendency to overshare personal details – Amina strives to be a good girl

who adheres to Muslim traditions and is mindful of propriety. Her ideas of what “proper” is begin to broaden once she’s pulled into a punk band comprised of a unique mix of Muslim women. The band’s founder and lead singer is Saira (Sarah Kameela Impey), an intenseyet-aloof butcher’s assistant. Despite her very punk rock vibe and numerous tattoos, she prays with, and without, her fellow band members. Bass player Bisma (Faith Omole), considered the “earth mother” of the band, is a wife and mother who writes and illustrates feminist graphic novels on the side. Emphasis on graphic. Drummer Ayesah (Juliette Motamed) is a somewhat anti-social Uber-driver an attitude. She’s also the sister of Amina’s crush Ahsan (Zaqi Ismail). B a n d m a n a g e r, M o mt a z (L u c i e Shorthouse), is literally shrouded in mystery. The only member to fully cover

her face, she’s intense, may have committed arson and vapes through her veil. Not until the final episode of the season do we get a glimpse at her face, and even then, only part of it. Amina quickly realizes she enjoys practicing with the band – while dreading the thought of performing – yet decides to hide her new activity from her newly-engaged, lifelong best friend, Noor (Aiysha Hart), who has very conservative ideas about what’s “appropriate,” and what isn’t. While it’s fun watching Amina negotiate her dual lives – prim and proper student versus aspiring punk rock musician – the real joy of We Are Lady Parts is getting to know each band member and learning why their musical family is so important to them. The original music – with the exception of punk covers of Dolly Parton’s “9 to 5” and Queen’s “We Are the Champions” – is performed by the actual cast members.

Yes, a soundtrack is available, too. Series creator and writer, Nida Manzoor, had a hand in writing original ditties like “Bashir with the Good Beard,” “Ain’t No One Gonna Honour Kill My Sister But Me,” and “Voldemort Under My Head Scarf” that play off and rebuke common stereotypes Muslim women face every day. While the full season of We Are Lady Parts can be streamed on the streamer’s paid tiers (and the one included at no extra charge to Comcast/Xfinity cable subscribers), the free, ad-supported version of Peacock only allows you to watch the first episode, hoping it will entice you to subscribe. (Tip: You could easily watch the whole season, and plenty of other shows, during Peacock’s 7-day free trial.) We Are Lady Parts is a fun comedy with plenty of depth. While the characters are all Muslim women, their stories are universal – embarrassment, hurt, grief, even peer pressure are feelings that beset people of all cultures, genders, and religions.

NEW YORK (AP) — Fifteen months after shuttering for the pandemic, New York’s Radio City Music Hall reopened its doors Saturday for the Tribeca Festival premiere of a new Dave Chappelle documentary for a full-capacity, fully-vaccinated audience. The debut of “Dave Chappelle: This Time This Place,” which chronicles Chappelle’s pandemic stand-up series held in rural Ohio cornfields, marked the first time the hallowed midtown hall was yet again packed since closing in March 2020 — a shutdown that put a year-plus’s worth of concerts, including Radio City’s famous Rockettes, on ice for easily the longest spell since the Art Deco venue first opened in 1932. The premiere Saturday evening, the closing night gala for the 20th Tribeca Festival, was seen as a symbolic reawakening of the arts in New York, where many of the world’s most famous stages — Carnegie Hall, Lincoln Center, Broadway theaters — remain dark. But after so many pandemic months of silence, that’s quickly changing. On Sunday,

Madison Square Garden will host its first full-capacity concert with the Foo Fighters. “Springsteen on Broadway” is set to resume performances on June 26. After the screening, Chappelle dramatically took the stage to a thumping beat from DJ Clark Kent and a raucous standing ovation. The comedian paused for a moment to apologize for those who lost someone during the pandemic before signaling a note of revival. “But, man, let’s get up,” said Chappelle. He soon after introduced a New York feast of hip-hop acts who performed according to their native borough, including Q-Tip, Talib Kweli, Fat Joe, A$AP Ferg, Redman, Ghostface Killah and De La Soul. Masks weren’t required inside Radio City but proof of vaccination was. In announcing the event in May, New York Gov. Andrew Cuomo said it would “go a long way towards bringing back this state, overall.” Directed by Julia Reichert and Steven Bognar, makers of the Oscar-winning “American Factory” (and fellow Ohioans whom Chappelle called his neighbors), “This Time This Place” shows Chappelle realizing his quixotic vision for keeping stand-up and

live performance going through the summer of 2020 and beyond. In the rural town of Yellow Springs (population 3,700), Chappelle mounted a stage on a friend’s farm and flew in a parade of comics, some of whom showed up dying for an audience, others who were rusty from months of quarantine. Among them: Chris Rock (who was in attendance Saturday), Jon Stewart and Tiffany Haddish — along with regulars Michelle Wolf, Donnell Rawlings and Mo Amer. The film captures an uncharacteristically nervous Chappelle before his first appearance, the considerable safety precautions taken (including Chappelle and others wincing at a swab up their nose), their battles with the local zoning board, the protest and pain that followed the death of George Floyd, and, ultimately, the profound benefits of comedy and community. “Look at what we did,” Chappelle said on stage at Radio City. “lmagine what we can do together.” The Tribeca Festival, mostly canceled last year, held its 20th edition largely in-person by relying mainly on outdoor screenings. It

opened last week with the New York premiere of “In the Heights,” the acclaimed adaptation of Lin-Manuel Miranda’s Broadway musical and an ode to the north Manhattan neighborhood of Washington Heights. It debuted with screenings held in all five boroughs of New York. On Saturday, some entered Radio City a little hesitantly. But most seemed invigorated by being back in Radio City for a much-anticipated movie. Joel and Abby Ralph, who wed a handful of months before the pandemic began, were excited to be out together and not in their Upper West Side apartment. “It feels normal-ish,” said Abby. Kyra Houston, a regular festivalgoer, came with her more reticent friend, Renee Cassell. “I feel happy. I was going through a funk,” said Houston, gazing around. It was her second movie of the day. “I feel like a haze is being lifted.” Before the elbow-to-elbow audience, Tribeca co-founder Jane Rosenthal celebrated the occasion. “We’re fully vaxed and socially squeezed together,” said Rosenthal, introducing the film. “Isn’t that great?” The crowd roared.

Watering the vegetable garden BY GRANT MCCARTY CONTRIBUTOR

Since May, we’ve entered a drought period and while we did receive some rain to start this week it is not enough to fully address your vegetable garden’s needs. You may find that you are watering your vegetable plants every day. This may be more common if you are growing in a raised bed or containers as these tend to dry out much more quickly. Between flowering and fruiting, a vegetable plant needs 1-1.5 inches of water each week. It can receive more than this and be okay,

but too much all at once may not be the best for the plant. Wilting symptoms may also show up if the plant has received too much water. These symptoms should dissipate in a matter of days. Let’s recall what water does for the plant. When water is combined with soil, this allows for the plant to take up all of those vital soil nutrients that it needs to produce a crop for you. Without water, the plant would be unable to take these up. Even if the soil looks very dry, there is still water in the soil. This right there should tell you why you should not water all over your plant.

Wet leaves and plant material will do more harm than good. Diseases can be spread by wet conditions. You may also have a weed problem if too much water is being applied. Always water at the root zone. Try to water in the morning. By watering in the morning, this allows wet foliage to dry out whereas by watering over night, any fungi and bacteria present can spread which may mean disease problems. To determine how much water you are receiving, purchase a rain gauge. This small device can be set on the edge of your planting area and provide you with

an accurate picture of how much rain your crops have gotten. It can then allow you to water your plants more if they do not have enough water for the week. If you do need to water your plants, you will want to figure out how long you need to water them based on your watering device. Use an empty tuna can and see how fast it takes to fill up. That estimate will give you a rough idea on how long you’ll need to water your plants to get to the amount of water you need for the week. Bob’s family lived the simple life in summer during the depression and WW II. Their mother felt that if their father lost his job they could survive in a small summer cottage on a lake lot she had purchased with some money she had saved before marriage. It was a 600-square-foot building on wooden posts and featured an outhouse. Water was pumped from a neighbor’s well into a milk can and brought home via a child’s wagon. Kerosene served as fuel for cooking, lighting and on occasion heating. During the summer the family stayed at the cottage while their dad stayed and worked in Milwaukee and came to the lake on weekends and fished. Fish and food were keep in an icebox with ice cut from the lake in winter and stored in an icehouse insulated with sawdust. A small town of 300 people was five miles away. It had a hardware store, grocery and butcher shop all open on Saturdays. Lake life was simple. Rowboats were in wide use and a few had small outboard motors. Fishing and swimming were the common activities. The local dance hall had Saturday night dances and wedding receptions. With the end of WW II things began to change. People had saved money during

the war and were eager to spend on new luxuries. Powerful motors on bigger boats began pulling surfboard riders. They were soon followed by water skiers. Both served as exercise and required skills. There is far less water skiing now as youth prefer the thrill of sitting in an inner tube being pulled by a powerful boat to the exercise and skill needed to water ski. Fishing interests were upset with their presence and rules were created to limit the use of power boats. As fish populations dwindled, cottage owners accepted the installation of a public boat landing in exchange for the release of fish by state o�cials. The county opened a public beach which also increased lake use. Things also changed in the cottages. The arrival of electric power meant reliance on ice and kerosene use ended. Outhouses disappeared and septic tanks took their place. Showers, bathtubs, washing machines and dishwashers increased water consumption. Some shallow wells became polluted so deeper wells were drilled. Of course septic tanks need service to function properly. Even when working properly there are risks of polluting the water table surrounding the lake. Green and weed free lawns came into vogue and many property owners adopted chemical treatments to achieve

their desired appearance. Some property owners cherish their chemically treated lawns and defend them as a minor concern regarding their contribution to lake pollution. The economic boom based on intensified consumption and modernization has taken its toll on the environmental quality of the lake. The arrival of confinement animal feeding operations or CAFOs has added a dramatic increase in pollution of surrounding lakes and streams. Algal blooms have increased, particularly following a rainstorm soon after manure is applied on the lands surrounding the lake. There are odor problems for a few days when the manure is applied. There is also the increased presence of small fly populations associated with spreading the manure. A recent storm with strong winds led to an increased presence of small flies in lake cabins and homes. Since no manure was on land adjacent to the lake the flies are likely to have been blown in from more distant facilities. In our youth the conventional wisdom of the day required that we wait an hour after eating before swimming. Now we wait for the all clear from public health o�cials. During our early years at the lake, an informal network of adults set the rules for lake behavior and the safety

of its users. For a while conflicts over times for boating or fishing included the willingness of one property owner being authorized to contact violators and remind them to follow the rules. But with the arrival of new property owners and the general public the informal approach to rules have broken down. In their place are more county restrictions controlling new buildings, septic tank maintenance and pier construction. As the rules and regulations increase lake quality has deteriorated. As public access has increased at little cost to new users, the taxes on property owners continue to rise forcing some owners to sell. The majority of taxes go to support the schools while few property owners have children in the schools. More funds need to be directed at protecting water quality of the lake. The lake tends to be heavily used on weekends as friends and relatives of property owners come to enjoy the lake. They and members of the public also seeking enjoyment in and around the lake are adding to the environmental burden on the resource. Each of the temporary pleasure seeking arrivals carries their own expectations of what they are seeking, greatly influenced by the cultural in which we live. Nearly all of us are deeply enmeshed in the consumerism which has multiple adverse environmental impacts.

‘Protected them to death’: Elder-care COVID rules under fire By Michael Rubinkam Associated Press

Barbara and Christine Colucci long to remove their masks and kiss their 102-year-old mother, who has dementia and is in a nursing home in Rochester, New York. They would love to have more than two people in her room at a time so that relatives can be there too. “We don’t know how much longer she’s going to be alive,” Christine Colucci said, “so it’s like, please, give us this last chance with her in her final months on this earth to have that interaction.” Pandemic restrictions are falling away almost everywhere — except inside many of America’s nursing homes. Rules designed to protect the nation’s most vulnerable from COVID-19 are still being enforced even though 75% of nursing home residents are now vaccinated and infections and deaths have plummeted. Frustration has set in as families around the country visit their moms and, this Father’s Day weekend, their dads. Hugs and kisses are still discouraged or banned in some nursing homes. Residents are dining in relative isolation and playing bingo and doing crafts at a distance. Visits are limited and must be kept short, and are cut off entirely if someone tests positive for the coronavirus. Family members and advocates question the need for such restrictions at this stage of the pandemic, when the risk is comparatively low. They say the measures are now just prolonging older people’s isolation and accelerating their mental and physical decline. “They have protected them to death,” said Denise Gracely, whose 80-year-old mother, Marian Rauenzahn, lives in a nursing home in Topton, Pennsylvania. Rauenzahn had COVID-19 and then lost part of a leg to gangrene, but Gracely said what she struggled with the most was enforced solitude, going from six-day-aweek visits to none at all. Rauenzahn’s daughters eventually won the right to see her once a week, and the nursing home now says it plans to relax the rules on visits for all residents in late June. But it has not been not enough, as far as Gracely is concerned. “I believe it’s progressed her dementia,” Gracely said. “She’s very lonely. She wants out of there so bad.” Pennsylvania’s long-term care ombudsman has received hundreds of complaints about visiting rules this year. Kim Shetler, a data specialist in the ombudman’s office, said some nursing homes’ COVID-19 restrictions go beyond what state and federal guidelines require. Administrators

have been doing what they feel is necessary to keep people safe, she said, but families are understandably upset. “We’ve done our darndest to advocate for folks to get those visitation rights,” she said. “It’s their home. They should have that right to come and go and have the visitors that they choose.” A recent survey by National Consumer Voice for Quality Long-Term Care, an advocacy group, found time limits on visits remain commonplace, ranging from 15 minutes to two hours. Some facilities limit visiting hours to weekdays, making it difficult for people who work during the day, or restrict visits to once or twice a week. Rauenzahn’s Pennsylvania nursing home has been limiting most residents to a single, 30-minute visit every two weeks. Federal authorities should “restore full visitation rights to nursing home residents without delay,” Consumer Voice and several other advocacy groups said in a June 11 letter to the Centers for Medicare & Medicaid Services. Residents are “continuing to suffer from isolation and decline because of the limited visitation permitted in the current guidance,” the letter said. Advocates also take issue with federal guidance on how nursing homes deal with new COVID-19 cases. The guidance says most visits should be suspended for at least 14 days. Some family members, administrators and advocates complain that the recommendation has led to frequent lockdowns because of one or two cases. “We’ve never had a real long, lengthy period of time where we’re able to have visitors,” said Jason Santiago, chief operating officer at The Manor at Seneca Hill in Oswego, New York. He said continued isolation is inflicting a heavy toll. “We’ve got to do things that make more sense for these residents, make more sense for these families.” While the federal government recently eased restrictions for vaccinated nursing home residents, New York state has not gone along. Those who eat together in communal spaces must remain socially distanced, for example, and they have to be masked and 6 feet apart during activities, no matter their vaccination status. That makes crafts, bingo, music — “a lot of what nursing home life is about” — more difficult, said Elizabeth Weingast, vice president for clinical excellence at The New Jewish Home, which runs elder-care facilities in and around New York City. “We prioritized vaccinating nursing home residents and that’s wonderful, but they’re not getting the same liberties that you or I have now,” said Weingast, who recently published an opinion piece calling

for a loosening of restrictions. Her co-author, Karen Lipson of LeadingAge New York, which represents nonprofit nursing homes, said the rules “force this kind of policing of love that is really, really challenging.” With the virus infecting more than 650,000 long-term-care residents and killing more than 130,000 across the U.S., nursing homes had a duty to take precautions when COVID-19 was out of control, said Nancy Kass, a public health expert at Johns Hopkins University. But she said she is baffled by the continued heavy emphasis on safety at the expense of residents’ quality of life, given “we’re not in that state of affairs anymore.” In Ohio, Bob Greve was desperate for a change of scenery after being cooped up in his Cincinnati-area nursing home for most of the last year. But the administrator wouldn’t permit a visit to his son’s house because of COVID-19 concerns — even though both men are fully vaccinated. The policy led Greve to a “breaking

point,” according to his son, Mike Greve, who said his 89-year-old father called six, eight, even 10 times a day out of boredom and frustration and talked constantly about getting out. Mike Greve said he pressed the nursing home administrator for outside forays, only to be told: “If I let you take your father out, I have to let everybody else.” Greve said the administrator was worried about residents bringing COVID-19 back with them. The administrator did not return phone and email messages from The Associated Press. A day after AP sought comment, Greve said, the administrator called him into the office, offered to allow his father out for a visit and said the policy would be changed for everyone else, too. Father and son spent a glorious afternoon soaking in the sunshine at Greve’s house, where his dad spotted a deer. “He said, ‘Hallelujah’ I don’t know how many times,” Greve said. “He said, ‘I don’t know how you got me out, but I’m so happy I could cry.’”
