Illinois AG joining federal lawsuit against USPS Case challenges recent spending cuts, equipment removal as illegal By Rebecca Anzel

SPRINGFIELD — Operational shifts undertaken by the United States Postal Service in recent weeks, including spending cuts and equipment removal, are illegal, Illinois’ top lawyer and 13 other attorneys general argued in a federal lawsuit filed Tuesday. By terminating workers’ overtime, eliminating a number of mail sorting machines, removing several mailboxes and rescheduling the delivery of some late-day mail, Postmaster General Louis DeJoy is subverting the national election this year, the officials added. Several states, including Illinois, are promoting expanded vote-by-mail programs as a safety precaution amid the novel coronavirus pandemic. “Voting by mail must be a reliable option that allows Americans to safely exercise their right to vote this fall during the ongoing pandemic,” a spokesperson for Attorney General Kwame Raoul said in an email. “Americans should not have to risk their lives to participate in our democracy.” Before the Postal Service is allowed to implement procedural changes that affect all Americans, officials must submit them for approval to the Postal Regulatory Commission, according to the lawsuit. That panel then accepts public feedback and makes a determination.

DeJoy did not do that, the attorneys general assert, thus operating outside the scope of his power. The lawyers are asking a federal judge to prevent the nation’s mail delivery agency from reducing services and to force DeJoy to undo all other recent changes. But in a statement Tuesday, DeJoy announced he is “suspending” Postal Service initiatives until after the Nov. 3 election to “avoid even the appearance of any impact on election mail.” “I came to the Postal Service to make changes to secure the success of this organization and its long-term stability. I believe significant reforms are essential to that objective, and work toward those reforms will commence after the election,” he said. “In the meantime, there are some longstanding operational initiatives — efforts that predate my arrival at the Postal Service — that have been raised as areas of concern as the nation prepares to hold an election in the midst of a devastating pandemic.” In addition to potentially affecting states’ abilities to conduct “free and fair elections” this cycle, a decline in mail services will impact seniors, those with disabilities, citizens who live in rural communities and others who use the mail to receive medicine and Social Security benefits, a spokesperson for Raoul said. Illinois’ attorney general is “absolutely committed to protecting residents throughout Illinois,” the spokesperson added. “The Postal Service is ready today to handle whatever volume of election mail it receives this fall,” DeJoy said in a state-

ment. “Even with the challenges of keeping our employees and customers safe and healthy as they operate amid a pandemic, we will deliver the nation’s election mail on time and within our well-established service standards.” “The American public should know that this is our number one priority between now and Election Day,” he continued. Washington state’s attorney general is leading this lawsuit, filed Tuesday afternoon. In addition to Illinois, other states signing on include Colorado, Connecticut, Maryland, Michigan, Minnesota, Nevada, New Mexico, Oregon, Rhode Island, Vermont, Virginia and Wisconsin. Also Tuesday, Pennsylvania’s attorney general announced a related lawsuit it plans to file Wednesday with his colleagues in California, Delaware, Maine, Massachusetts and North Carolina. T he r e a s on for d i st i nc t c a s e s, Pennsylvania Attorney General Josh Shapiro said in a conference call with reporters Tuesday, is because of the difference in vote-by-mail statutes in various states. Some that recently instituted permissions for voters to cast their ballot by mail have to challenge the Postal Service policy changes in a way separate from states that had existing systems. PHOENIX (AP) – With the Trump administration openly trying to undermine mailin voting this fall, some election o�cials around the country are hoping to bypass the Postal Service by installing lots of ballot drop boxes in libraries, community centers and other public places. Such boxes have been used with success for several years in states like Oregon, Washington and Colorado that rely largely or entirely on ballots that must be sent in. But their use is being expanded because of the coronavirus outbreak and, more recently, concerns about the post o�ce’s ability to do its job. State or local authorities in places such as Arizona, Wisconsin and Pennsylvania are pressing for more boxes or drop-o� sites that would enable ballots to reach election o�cials without going through the mail. “Donald Trump continues to undermine the legitimacy of mail-in absentee ballots by attacking the U.S. Postal Service,” said New York state Sen. Brad Hoylman, a Democratic who is sponsoring legislation to set up drop boxes beyond the usual confines of voting sites and local election o�ces. “New York can hit back on this anti-democratic fearmongering by establishing absentee ballot drop boxes across the state to help ensure the integrity of these ballots.” In the potential battleground state of Wisconsin, the five biggest cities won a $6.3 million grant from the nonprofit Center for Tech and Civic Life to help administer the November election, including installation of drop boxes. Milwaukee Mayor Tom Barrett said his city will use some of its $2.1 million share to buy more than a dozen to install at libraries and other locations. Arizona’s secretary of state is ordering about 70 more for the mostly rural areas that have requested them, and a spokeswoman said some counties are also purchasing extra ones. Washington state election o�cials said that there are 450 drop boxes statewide, and there are discussions about adding more. Last week, the Postal Service, having cut overtime and late deliveries, began warning states that it can’t guarantee all mail ballots will be received in time to be counted. President Donald Trump, who has been sowing unfounded fears of vote-bymail fraud for months, last week admitted blocking Postal Service funding so it would be harder to process the expected surge of millions of ballots. Election o�cials in some states – mainly Republican-led ones – have come out

against adding drop boxes, saying doing so would be too costly, raises security concerns or would violate state laws. In a tweet Monday, Trump sought to cast doubt on the security of such boxes, saying: “So who is going to ‘collect’ the Ballots, and what might be done to them prior to tabulation? A Rigged Election? So bad for our Country.” Typical security measures for drop boxes include video surveillance, locks, tamper-resistant seals and chain-of-custody logs that are completed each time ballots are collected. Local o�cials, at a minimum, should have a drop box at their main county or city o�ce building, and it is recommended that they have one box for every 15,000 to 20,000 registered voters, according to a memo issued by federal authorities in response to the viral outbreak. The Brennan Center for Justice, a public policy institute at New York University Law School, has estimated that nearly 11,700 ballot drop-o� boxes will be needed for November, at a cost of $82 million to $117 million for purchase and installation. Washington state has boxes in churches, fire stations, libraries, colleges, city halls, shopping centers and courthouses. In Oregon, they are not only inside libraries and government buildings but on the street outside high-tra�c businesses such as Starbucks, McDonald’s and movie theaters. “The whole idea really is to meet people where they are in their everyday lives,” Amber McReynolds, CEO of the National Vote at Home Institute and a former elections o�cial. In Pennsylvania, a federal lawsuit by the Trump campaign and Republican National Committee has cast drop boxes into a legal gray area. That was after Philadelphia and its suburbs used them – to great success, according to o�cials there – in the June

2 primary, when a record-smashing 1.4 million ballots arrived by mail. Democratic state lawmakers are countersuing to get a judge to clarify that drop boxes are legal. In the meantime, Philadelphia and several suburban counties plan to create satellite election o�ces where people can register to vote, apply for a ballot and submit it. Philadelphia wants to establish as many as 17. Suburban Delaware County is plowing ahead with its plans for drop boxes without waiting for the outcome of the legal dispute, said County Council member Christine Reuther, a Democrat. With the help of grant money, the county will buy 50 boxes and have them installed by Oct. 1. The goal of the Trump campaign’s lawsuit, said Reuther, was to “scare people away from doing this.” “We are gambling a little bit,” she said. “I think our lawyers feel pretty confident about the lawsuit.” Louisiana isn’t debating adding drop boxes, but the state’s elections chief, GOP Secretary of State Kyle Ardoin, is proposing to allow parishes to set up curbside dropo� stations where people can hand their absentee ballots to someone in person rather than put them in the mail. North Carolina has no plans to install boxes, and Oklahoma doesn’t use them either, though voters can drop o� ballots at one location in each county. But the state plans on printing green return envelopes to help postal workers more easily identify mail-in ballots and give them priority. Ohio will have a single drop box in each of its 88 counties. Secretary of State Frank LaRose, a Republican, said he would need legislative authority or clearance from the attorney general to add more. State Sen. Nickie Antonio, a Democrat from suburban Cleveland, said LaRose’s stand “reeks of partisan politics.”

S&P 500 closes at a record, erasing last of pandemic losses By Stan Choe, Alex Veiga and Damian J. Troise Associated Press

Stock indexes were drifting mostly higher on Wall Street Tuesday, placing the S&P 500 once again on track to eclipse its record closing high after falling short of doing so several times in recent days. The benchmark index was up 0.3% at 3,392 in afternoon trading, above its all-time closing high of 3,386.15, which was set in February before the pandemic pancaked the economy. It’s the fourth time in the last week that’s happened, and each past time, the index faded back below that record level during the afternoon. Earlier, the S&P 500 crested above 3,393.52 for the first time, which had stood since Feb. 19 as the highest level it ever touched within a day’s trading. The Dow Jones Industrial Average was down 31 points, or 0.1%, at 27,813, as of 2:52 p.m. Eastern time, and the Nasdaq composite was up 0.8%. “It just seems like the path of least resistance for the market is higher,” said Brian Price, head of investment management for Commonwealth Financial Network. “We’re seeing this slow grind up for the past few weeks.” Trading has been very quiet in recent days, after a tremendous rally since March wiped out virtually all of the nearly 34% drop the S&P 500 suffered earlier from its all-time high. Tremendous amounts of aid from the Federal Reserve and Congress helped launch the rally, which built higher on signs of budding growth in the economy. More recently, corporate profit reports that weren’t as bad as expected have helped boost stock prices. Now, analysts say markets are taking a pause with less news flowing in amid a seasonally slow period of trading. Big U.S.

companies are mostly finished reporting their earnings for the spring, while investors are waiting to see if Congress and the White House can get past their partisan differences and agree on more aid for the economy. It’s mostly just retailers left in the S&P 500 to report their second-quarter results, and several continued the strong recent trend of delivering better results than expected. Walmart and Home Depot reported better results than analysts expected. Walmart benefited from surging sales for its online business, as customers looked to buy necessities without having to go to a store. Home Depot, meanwhile, saw more people picking up do-it-yourself projects as the pandemic kept many working from home. Their stocks, though, were muted. Walmart was down 0.3% after waffling between small gains and losses. Home Depot slid 1.2%. Home Depot’s report coincided with data from the Commerce Department showing a recovery is continuing for home construction. Builders broke ground on more new homes in July than economists expected, and at a faster pace than June. The report helped push homebuilder shares broadly higher. KB Home was up 1.6% The housing report echoes other data that have shown budding improvements across the economy since the spring, as widespread shutdowns have eased. The worry, though, is that conditions could backtrack if coronavirus counts worsen or if Washington can’t broker a deal on more aid for an economy that investors say absolutely needs it. over the market. The world’s two largest economies keep ratcheting up their tensions, and China on Tuesday accused Washington of damaging global trade with sanctions that threaten to cripple tech giant Huawei. China added that it will protect Chinese companies, though it gave no indication of possible retaliation. The yield on the 10-year Treasury dipped to 0.67% from 0.69% late Monday. “It’s important to recognize that the bond market doesn’t seem to trust this rally,” Price said. “You look at 10-year Treasury and it has not advanced to the point where the bond market is optimistic about the recovery.” In Asia, South Korea’s Kospi led regional losses, slumping 2.5% amid worries over surging coronavirus cases. Hong Kong’s Hang Seng index lost 0.2%, Japan’s Nikkei 225 slipped 0.2% and stocks in Shanghai added 0.4%. In Europe, Germany’s DAX slipped 0.3%.

The French CAC 40 lost 0.7%, and the FTSE 100 in London dropped 0.8%. Benchmark U.S. crude oil fell 0.3% to $42.77 per barrel. Brent crude, the international standard, gained 0.2% to $45.45 per barrel. Gold added 0.8% to $2,014.30 per ounce. End up trading update: Wall Street clawed back the last of the historic, frenzied losses unleashed by the coronavirus, as the S&P 500 closed at an all-time high Tuesday. The benchmark index notched a modest 0.2% gain to beat its previous record high set on Feb. 19, before the pandemic shut down businesses around the world and knocked economies into their worst recessions in decades. The S&P 500’s milestone caps a furious 51.5% rally that began in late March. Tremendous amounts of aid from the Federal Reserve and Congress helped launch the rally, which built momentum on signs of budding growth in the economy.

WASHINGTON (AP) – The Trump campaign’s interactions with Russian intelligence services during the 2016 presidential election posed a “grave” counterintelligence threat, a Senate panel concluded Tuesday as it detailed how associates of Donald Trump had regular contact with Russians and expected to benefit from the Kremlin’s help. The panel’s almost 1,000 page report, the fifth and final one from the Republicanled Senate intelligence committee on the Russia investigation, describes in detail how Russia launched an aggressive, wide-ranging effort to interfere in the election on Trump’s behalf. It says Trump associates were eager to exploit the Kremlin’s aid, particularly by maximizing the impact of the disclosure of Democratic emails that were hacked by Russian military intelligence officers. The findings released Tuesday mark the culmination of a bipartisan probe that produced what the committee called “the most comprehensive description to date of Russia’s activities and the threat they posed.” The investigation spanned more than three years as the panel’s leaders said they wanted to be as thorough as possible

in documenting the unprecedented attack on U.S. elections. The findings echo to a large degree those of special counsel Robert Mueller’s Russia investigation, with the report’s unflinching characterization of furtive interactions between Trump associates and Russian operatives contradicting the Republican president’s claims that the FBI had no basis to investigate whether his campaign was conspiring with Russia. Trump has called the Russia investigations a “hoax.” While Mueller’s was a criminal probe, the Senate investigation was a counterintelligence effort with the aim of ensuring that such interference wouldn’t happen again. The report was released as two other Senate committees, the Judiciary and Homeland Security panels, conduct their own reviews of the Russia probe with an eye toward uncovering what they say was FBI misconduct during the early days of the investigation. A prosecutor appointed by Attorney General William Barr, who regards the Russia investigation with skepticism, disclosed his first criminal charge on Friday against a former FBI lawyer who plans to plead guilty to altering a government email. Among the more striking sections of the report is the committee’s description of the close professional relationship between former Trump campaign chairman Paul Manafort and Konstantin Kilimnik, whom the committee describes as a Russian intelligence officer. “Taken as a whole, Manafort’s high-level access and willingness to share information with individuals closely affiliated with the Russian intelligence services, particularly Kilimnik, represented a grave counterintelligence threat,” the report says. The report notes how Manafort shared internal Trump campaign polling data with Kilimnik and says there is “some evidence” that Kilimnik may have been connected to the Kremlin’s operation to hack and leak Democratic emails, though it does not describe that evidence. In addition, the report says that “two pieces of information” raise the possibility of Manafort’s potential connection to those operations, but what follows next in the document is blacked out. Both men were charged in Mueller’s investigation, but neither was accused of any tie to the hacking. A Manafort lawyer, Kevin Downing, said Tuesday that there is information that was sealed at the request of Mueller’s team “that completely refutes whatever

the intelligence committee is trying to surmise.” He added: “It just looks like complete conjecture.” Like Mueller, the committee reviewed a meeting that Trump’s oldest son, Donald Trump Jr., took in June 2016 with a Russian lawyer he believed to have connections with the Russian government with the goal of receiving information that he expected would be harmful to Clinton. The Senate panel said that it assessed that the lawyer, Natalia Veselnitskaya, has “significant connections to the Russian government, including the Russian intelligence services,” as did another participant in the meeting, Rinat Akhmetshin. The panel said it uncovered connections that were “far more extensive and concerning than what had been publicly known,” particularly regarding Veselnitskaya. The report also found no reliable evidence for Trump’s longstanding supposition that Ukraine had interfered in the election, but did trace some of the earliest messaging of that theory to Kilimnik. It said Russiangovernment proxies were “consistently spreading overlapping false narratives which sought to discredit investigations into Russian interference in the 2016 U.S. elections.” The committee said that messaging campaign lasted from to “at least January 2020” — after the House had impeached Trump for pressuring Ukrainian officials to investigate the family of Democrat Joe Biden, who is now Trump’s general election opponent. During that effort, some Republicans, including Trump, argued that Ukraine was meddling, not Russia. The report purposely does not come to a final conclusion, as Mueller did and as the House intelligence committee’s 2018 report did, about whether there is enough evidence that Trump’s campaign coordinated or colluded with Russia to sway the election to him and away from Democrat Hillary Clinton, leaving its findings open to partisan interpretation. A group of Republicans on the panel submitted “additional views” to the report saying that it should state more explicitly that Trump’s campaign did not coordinate with Russia. They say the report is an “important contribution to the historical record” that shows “the Russian government inappropriately meddled in our 2016 general election in many ways but then-candidate Trump was not complicit.” The acting GOP chairman of the panel, Florida Sen. Marco Rubio, signed on to that statement but the chairman who led the investigation, North Carolina Sen. Richard Burr, did not. Burr stepped aside

earlier this year as the FBI was examining his stock sales. Burr, who submitted the report before he stepped aside, often faced criticism from his GOP colleagues for working with Democrats on the probe and for calling in sensitive witnesses, such as Trump Jr. Another Republican member of the panel, Maine Sen. Susan Collins, also did not sign on to the GOP statement. Democrats on the panel submitted their own views, saying the report “unambiguously shows that members of the Trump campaign cooperated with Russian efforts to get Trump elected.” Maine Sen. Angus King, an Independent who caucuses with Democrats, did not sign on to that statement, saying he believed the report should be bipartisan. But he said in an interview that he believes the report is a “warning.” The report is “not a hoax,” King said. “It’s just one more set of facts that’s hard to ignore.” Mueller concluded in his report issued last year that Russia interfered in the election through hacking and a covert social media campaign and that the Trump campaign embraced the help and expected to benefit from it. But Mueller did not charge any Trump associates with conspiring with Russians. The Senate investigation also delved into areas of great interest to Trump that were not explored by Mueller. Those include the FBI’s reliance on a dossier of opposition research compiled by a former British spy whose work was financed by Democrats. The committee did find faults with aspects of the FBI’s investigation, particularly with regard to its handling of opposition research on Trump’s ties to Russia that was compiled by a former British spy, Christopher Steele, whose work was funded by Democrats. The committee found that the dossier “joined a stream of intelligence and investigative reporting” about Russian election interference even though the FBI never fully explored the credibility of its allegations. A separate investigation by the Justice Department’s inspector general also faulted the FBI for errors and omissions related to the Steele dossier as it applied for court permissions to secretly wiretap a former Trump campaign adviser named Carter Page Rubio said in a statement that the committee was troubled that the FBI had been willing to use the dossier “without verifying its methodology or sourcing” as it applied for secret surveillance warrants against a former Trump campaign adviser.

Controlling cucumber beetles in the garden BY GRANT MCCARTY CONTRIBUTOR

One of the main insect pests I have seen this summer in squash is cucumber beetles. While given the name cucumber beetle, they will target almost all members of the squash family. I have encountered them on pumpkin, zucchini, winter squash, and cucumbers this season. These beetles are yellow and green in color with either black spots or strips on them. They tend to be around the size of ladybird beetles. Cucumber beetles are heavily destructive and their numbers can increase substantially during the growing season. When

you are looking for these in your garden, look into the flowers, under leaves, and near the base of the plant. These beetles are very good flyers and will move pretty quickly if they are disturbed. Some growers I know will apply a sticky adhesive like craft glue spray to yellow/ orange colored plastic plates near the plant. As it’s the same color as flowers, it may attract beetles away from your cucurbits. Others have used trap crops like blue hubbard squash to attract the cucumber beetles away. Intercropping with corn and broccoli has also been shown to address cucumber beetles. Straw may provide

relief for the plantings as well. Of course, there are a number of insecticides that can manage them. One of the main actions you can take is to collect and destroy the male flowers of your squash plants. Each squash plant produces male and female flowers that are needed for pollination and the development of your squash. A female flower will have a swollen base right behind the flower compared to a male flower that does not have this. Male flowers bloom for usually a single day. As cucumber beetles hide in these male flowers, a easy step is to remove these flowers and throw them away. As you can

imagine, if you do remove the male flowers this may lessen the squash that develops on your vines. However, you most likely have enough pumpkins, winter squash, and watermelon already forming and the removal of these male flowers will not make a di�erence. If you are growing zucchini, cucumbers, and others that continually are yielding, you might be cautious of removing these male flowers at least until they have shriveled up. With all the stress placed on society from covid-19 and the collapsing economy, the arrival of the latest storm only adds problems. With downed trees and power lines ComEd responded quickly to the loss of power. Even though they have fortified the lines to make them more resilient the projected increase in storm frequency and intensity remain a costly challenge. An area of Wisconsin with which we are familiar has benefitted from an upgrading of the electrical grid by providing four di�erent routes by which electrical service can be brought to an area if a storm disrupts it. In addition they have placed some home service underground to reduce the potential of falling tree limbs disrupting service. These improvements are seen as a means to increase the resilience of electrical service and provide additional voltage stability. They also signify the anticipation of additional economic growth. Similar improvements are being applied to the electric grid in many areas of the country but are increasing the cost of service. With the installation of smart meters an Illinois neighbor reported that ComEd was able to quickly know he had lost service. A transformer had failed and they were able to identify the problem via a computer program, bring a new transformer to the site and restore service. Unfortunately with widespread damage

it takes time to identify all the problems and make the needed repairs. Upgrading the electrical grid is one way to improve the reliability of electrical service. The more widespread use of distributed electrical service in homes, businesses or communities can also increase the reliability of electrical service. As technological progress continuous to lower costs and improve battery life, battery backup is gaining acceptance. A few summers ago we lost grid service and our small battery bank maintained a dedicated circuit until the sun rose the next morning and service was restored. With the latest storm we lost grid service for a relatively short time as our smart meter alerted ComEd that we were without service. Later we saw a tree had fallen across our drive blocking its use. As we started cutting up the tree the neighbor arrived with his tractor to push the branches o� the drive. We spent the next couple of days disposing of the limbs and branches. The neighbor mentioned his son, who operates a tree service, had a long week of work as there were many downed trees and branches in the area. One tree fell on the roof of a home and required a crane to stabilize it as the branches were being cut up and lowered o� the roof. Competition for such equipment intensifies and they are not always readily available. When storms are widespread, the demand for corrective action is intense

with multiple needs to address and only limited resources to meet the demand. Unfortunately, such a dramatic increase in demand can only be met on a priority basis so some areas have a slower recovery time. As a society we have been slow responding to the covid-19 crisis and slower yet responding to climate change. The delays are proving costly to human health and the economy. The situation is further complicated by the weak financial condition of state and local governments which are hard pressed to deal with the accumulated

burden on the public sector. For now helping neighbors is appropriate and could stimulate a broader community spirit of helping one another based on a system in which people swap services. Historically sharing services and equipment has been the basis of neighborhoods and small farm communities. Financial necessity could rekindle cooperative endeavors. Such e�orts are essential and inspiring but insu�cient to address the challenges of a changing climate.
