Restaurant asks Illinois Supreme Court to throw out indoor dining ban By Sarah Mansur

SPRINGFIELD — Lawyers for a Kane County restaurant are asking the Illinois Supreme Court to overturn an appellate court decision that found the governor’s indoor dining ban was lawfully imposed. FoxFire Tavern is one of dozens of restaurants that sued Gov. JB Pritzker and his administration after he issued an executive order imposing stricter restrictions on businesses, including a ban on indoor dining and bar service, in response to rising COVID-19 cases and hospitalizations throughout the state. The state’s highest court has not yet weighed in on the legal arguments challenging Pritzker’s power to impose the indoor dining ban, or any other restrictions implemented in his numerous executive orders. The 2nd District Appellate Court’s decision last month that upheld Pritzker’s order prohibiting restaurants from allowing indoor dining cannot stand because it “leaves the restaurant industry out in the cold and without legal redress,” Kevin Nelson, one of FoxFire’s attorneys, wrote in the legal brief to the Illinois Supreme Court submitted on Friday. The brief asks the court to accept the case and reverse the appellate court’s ruling on the governor’s executive order. However, since the court is not obligated to hear the case, the justices could reject that request and decline to rule on it.

The restaurant won an early victory after suing Pritzker in October when a Kane County judge granted the restaurant’s request for a temporary restraining order that allowed FoxFire to ignore the new indoor dining restrictions contained in the executive order. The 2nd District Appellate Court’s decision last month overruled the Kane County judge’s decision. The appellate court rejected the arguments from FoxFire’s legal team that Pritzker is limited, under state law, to issue one 30-day disaster proclamation, and also does not have the power to order businesses closed. Instead, the appellate court found that state law empowers the governor to issue multiple disaster declarations. The appellate court also ruled that Pritzker’s executive order did not amount to a “closure” for businesses, and therefore, Illinois Department of Public Health Act regulations governing business closures did not apply in this case. Since that appellate court decision, the FoxFire case has been consolidated in Sangamon County court with 18 other cases filed by businesses operating as restaurants that are challenging the indoor dining ban. The consolidated cases in Sangamon County are ongoing, and no final decision has been issued. FoxFire’s appeal to the Illinois Supreme Court is known as an “interlocutory appeal” because it asks a higher court to review a decision while the case is pending in a lower court.

The governor, IDPH and the Kane County Health Department, which are named in FoxFire’s appeal, have 21 days from Friday, Dec. 18, to file a response but they are not required to do so. A spokesperson for the Illinois Attorney General’s Office, which represents the governor and state agencies, said its lawyers are reviewing the legal filing. FoxFire, a steak and seafood restaurant in Geneva, continues to allow seating indoors, in defiance of the governor’s executive order, as its legal case remains pending. KC Gulbro, co-owner of the restaurant, did not respond to requests for comment Monday. A call to the restaurant Monday confirmed it is still serving customers indoors. Pritzker has said his administration is relying on county health departments and local law enforcement to issue citations and fines to restaurants and bars that violate the ban on indoor dining and bar service. A misdemeanor citation and fine are a last resort only after attempts to ensure voluntary compliance are unsuccessful. A Kane County Health Department spokesperson declined to comment, citing pending litigation. SPRINGFIELD – Four weeks after the Thanksgiving Day weekend, the so-called “surge upon a surge” in COVID-19 cases has not materialized and, in fact, infection rates and hospitalizations from the disease have continued to decline. The Illinois Department of Public Health reported Monday that 4,699 new confirmed and probable cases of the disease had been recorded over the previous 24 hours out of 86,454 tests performed. That brought the seven-day rolling average case positivity rate down to 7.5 percent, the lowest it has been since Oct. 31 and the second consecutive day that number has been below 8 percent.

As of Sunday night, 4,460 people in Illinois were being hospitalized with the disease, including 981 patients in intensive care units, with 546 of those patients on ventilators. For the seven-day period that ended Sunday, the average number of people being hospitalized was 4,675 per day, an 8 percent decline from the previous week. The average daily ICU count, at 1,023, was down 17 percent from the prior week, while average daily ventilator use, at 575, was down 8 percent. IDPH also reported Monday that 98 individuals had died of the disease over the previous 24 hours, bringing the total number of fatalities in Illinois since the pandemic began to 15,299 out of 905,069 recorded cases and 12.5 million tests

performed. For the seven-day period that ended Sunday, the disease claimed an average 130 lives per day, down from the previous week’s average of 149. Data for each of the state’s 11 mitigation regions lag behind the statewide data. As of Friday, Dec. 18, Region 3, which includes Springfield and several surrounding counties, had the lowest case positivity rate at 8 percent. Region 5, which includes 20 counties in southern Illinois, had the highest rate, at 12.2 percent. Case positivity rates in other regions ranged from 9.1 percent in Region 6, in east-central Illinois, to 11.9 percent in Region 7, which includes Will and Kankakee counties.

Lost in the U.S. launch of the coronavirus vaccine is a fact most don’t know when they roll up their sleeves: In rare cases of serious illness from the shots, the injured are blocked from suing and steered instead to an obscure federal bureaucracy with a record of seldom paying claims. Housed in a nondescript building in a Washington, D.C., suburb, the Countermeasures Injury Compensation Program has just four employees and few hallmarks of an ordinary court. Decisions are made in secret by government o�cials, claimants can’t appeal to a judge and payments in most death cases are capped at $370,376. George Washington University law professor Peter Meyers has followed the program for years and bluntly calls it a “black hole,” obtaining federal documents this summer showing it has paid fewer than 1 in 10 claims in its 15-year history. Vaccines historically provide broad protection with little risk but come with side e�ects just as any other drugs. Few unexpected adverse e�ects have been reported in the early days of Pfizer’s COVID-19 vaccine distribution in the U.S., though an Alaska health worker su�ered a severe allergic reaction that included shortness of breath. But experts are concerned that with the sheer volume of people expected to get coronavirus vaccines in the U.S. — more than 200 million — even a successful rollout with relatively few ill e�ects could be enough to swamp the program. “It would need to be ramped up for sure,” said Dr. Vito Caserta, who oversaw the countermeasures program from its creation until his retirement in 2014. “They may get overwhelmed very, very quickly.” Asked about that possibility, David Bowman, a spokesman for the Health Resources and Services Administration that oversees the program, said it is “planning to process the potential influx of COVID-19 claims. ... Additional sta� and contractors will be hired as needed.” Unlike the more established federal vaccine court, which decides cases of injury from most childhood vaccines and other common inoculations, the Countermeasures Injury Compensation Program was created by a 2005 law specifically to deal with vaccines developed under emergency authorization. The idea was to allow pharmaceutical companies and government entities the freedom to develop and distribute vaccines to meet urgent public health needs without the threat of being overrun with expensive liability

lawsuits. Under the program, drug makers can only be sued for “willful misconduct.” Several senators objected at the time, with the late Massachusetts Democrat Edward M. Kennedy calling it a “Christmas present to the drug industry and a bag of coal to everyday Americans.” The vast majority of the claims under the program have stemmed from the H1N1 swine flu vaccine a decade ago. And the low number of people awarded money – 29 out of 499 – reflects its design. Most claims have to be filed within a year of getting a vaccine, regardless of when side e�ects show up, and the program does not pay fees for lawyers or expert witnesses. It provides little opportunity for those filing claims to participate. And the awards do not pay for su�ering or damages. “It’s illusory,” said Sarasota, Floridabased vaccine lawyer Anne Carrion Toale. “No one is going to actually get compensation in that program.” By contrast, vaccine court allows for claims within three years, pays for lawyers and witnesses, grants awards for pain and su�ering, and permits appeals all the way to the Supreme Court. The di�erence is reflected not only in the number of awards but their size. The countermeasures program has paid out $6 million, for an average award of about $200,000 a claim. The vaccine court has not only paid out in 7 of 10 cases in recent years, but its average per claim – $570,000 – is more than two and half times larger, totaling $4.4 billion in its three-decade history. Law professor Meyers, who obtained the data on the compensation court though a Freedom of Information Act request, described the 29 awards so far as “shockingly low” and called for the program to be overhauled. He also expressed concern that it could discourage people from taking vaccines in the midst of a pandemic that has so far infected more than 75 million and killed nearly 1.7 million people worldwide. “It is a great argument for the antivaxxers to say, ‘Oh, my God, this is dangerous and if something happens to you, the program is … going to turn their back to you,’” said Meyers, former chair of a government advisory group for the vaccine court. Meyers said it would be helpful to know specifically why each claim was approved or rejected in the compensation program but it doesn’t release even the most basic details such as the kinds of sicknesses people claim they got from vaccines. Vaccine lawyer Toale believes one of the biggest reasons for rejection is the one-year filing deadline. She recalled receiving dozens of calls from people saying they

had been sickened by H1N1 vaccines a decade ago, some complaining of possible symptoms from Guillain-Barre syndrome, a rare immune system disorder that can result in paralysis or death. “They were all way too late,” she said. “There was nothing we could do.” That was the case for Christina Grim of Littlestown, Pennsylvania, who said she filed a claim about a year after learning from her mother’s doctor that an H1N1 vaccination had likely triggered the Guillain-Barre syndrome that killed the 76-year-old day-care worker. “The clock started ticking but she didn’t show any symptoms. I didn’t know what was happening to her,” said Grim, whose mom, Verl, racked up $25,000 in hospital bills after she was found crawling down a hallway at home, her legs limp, a few days before she died in 2010. “I didn’t know the vaccine could do this to her.” No one is sure just how many of the more than 200 million Americans expected to receive coronavirus vaccines are likely to develop severe side e�ects and not everyone who does will file a claim. Only one in a million people who got the measles, mumps and rubella vaccines first administered a half century ago su�ered severe reactions, but other vaccines had higher ratios. Using the 25-per-million who su�ered severe side e�ects from the H1N1 vaccine, for example, would put the number of such cases from the coronavirus vaccines at more than 5,000. That’s more than 10 times what the countermeasures program has received in its entire history. Meyers said one solution is to shift coronavirus claims to vaccine court, formally known as the National Vaccine Injury Compensation Program, but that court itself is trying to work through a backlog of its own cases, with its eight judges currently taking more than five years to resolve claims. Another problem is funding. Unlike claims in vaccine court, which is financed from a 75-cent excise tax on every vaccine shot, the countermeasures program relies on Congress for its budget. A $30 billion allocation by Congress to buy vaccines and finance other e�orts to fight the coronavirus allows some of that money to be transferred to a fund to pay claims, but none has been transferred yet. HRSA spokesman Bowman said those requests will be made as the need for funding arises. Former Justice Department vaccine lawyer Richard Topping, now chief legal o�cer for health insurer CareSource, said that’s not good enough. “We’ve essentially got no plan, no coverage,” he said.

Consumer relief: COVID bill to end ‘surprise’ medical bills By Ricardo Alonso-Zaldivar Associated Press

WASHINGTON (AP) — People with private health insurance will see the nasty shock of “surprise” medical bills virtually gone, thanks to the coronavirus compromise passed by Congress. The charges that can run from hundreds to tens of thousands of dollars come from doctors and hospitals that are outside the network of a patient’s health insurance plan. It’s estimated that about 1 in 5 emergency visits and 1 in 6 inpatient admissions will trigger a surprise bill. Although lawmakers of both parties long agreed that the practice amounted to abusive billing, a lobbying war between doctors and insurers had thwarted a compromise, allowing the impasse to become a symbol of dysfunction in Washington. “This has been a profoundly distressing pocketbook issue for families for years,” said Karen Pollitz, a health insurance expert with the nonpartisan Kaiser Family Foundation. “Some of these bills are onerous, and they all strike people as completely unfair.” The compromise would take patients and their families out of the financial crosshairs by limiting what they can be billed for out-of-network services to a fee that’s based on in-network charges. The amount consumers pay would get counted toward their in-network annual deductible. Insurers and service providers would submit their billing disputes to an independent dispute resolution process, which will follow certain guidelines. The main provisions of the legislation would take effect Jan. 1, 2022. “Generally speaking, keeping the consumer out of it and forcing the providers to be the ones to settle is a positive,” said Eagan Kemp, a policy expert with Public Citizen, a liberal advocacy group. Although states have been moving to curb surprise billing, federal action was needed because states do not have jurisdiction over large employer plans that cover tens of millions of workers and their families. Key elements of the legislation would: — Hold patients harmless from surprise bills stemming from emergency medical care. That would apply if the patient is seen at an out-of-network facility, or if they are treated by an out-of-network clinician at an in-network hospital. In either case, the patient could only be billed based on their plan’s in-network rate. — Protect patients admitted to an in-network hospital for a planned proce-

dure when an out-of-network clinician gets involved. This can happen when a surgeon is called in to assist in the operating room, or if the anesthesiologist on duty is not part of the patient’s plan. — Generally require out-of-network service providers to give patients 72-hour notice of their estimated charges. Patients would have to agree to receive out-of-network care for the hospital or doctor to then bill them. — Bar air ambulance services from sending patients surprise bills for more than the in-network cost sharing amount. Air ambulance charges have become a bigger problem in states where patients have to travel long distances to get to the best hospitals. However, ground ambulance services will not face the same restrictions, and the legislation only calls for more study of their billing practices. The compromise legislation involved two years of work from dozens of lawmakers of both parties and key committees, including Energy and Commerce and Ways and Means in the House, and Health, Education, Labor and Pensions in the Senate. Surprise bills hit patients and their families when they are most vulnerable — after a medical emergency or following a complex surgical procedure. Often patients are able to negotiate lower charges by working with their insurers and the medical provider. But the process usually takes months, adding stress and anxiety. Sometimes it doesn’t work out and the bills are sent to collection agencies. “Our constituents have done everything right at the doctor’s office or hospital yet still found themselves stuck with surprise medical bills, sometimes to the tune of tens of thousands of dollars,” said Sens. Maggie Hassan, D-N.H., and Bill Cassidy, R-La. “And frequently, they have to fight these bills at the same time they are facing a medical crisis.” According to the Kaiser Foundation, 18% of emergency visits lead to at least one out-of-network charge for people covered by large employers, as do 16% of in-network inpatient admissions. New York and Texas have among the highest rates. The problem is a direct of result of high health care costs. To try to keep premiums in check, insurers set up networks of hospitals and doctors who agree in advance on payment levels. But some high-demand clinicians, such as emergency room doctors and anesthesiologists, have an incentive to stay out of at least some networks, trying to maximize their earning power. That dynamic has grown more complicated as

profit-seeking investors buy out medical practices that have greater billing leverage. Insurers were cool to the compromise, saying the structure of the dispute resolution process could lead to higher payouts that then feed premium increases. Some Democrats had advocated using a predetermined price list to resolve billing disputes, but that struck Republicans and other Democrats as too close to government rate setting.

“Our for-profit health care system really allows companies to make money in the different gaps of the system,” said Kemp, the health care advocate from Public Citizen. “This is a hopeful day. I thought between the insurers and the providers, there wasn’t going to be surprise billing legislation passed.” Public programs like Medicare and Medicaid prohibit or restrict such billing practices.

As if 2020 weren’t already difficult enough, Alex Trebek died from complications of pancreatic cancer on November 8, less than two weeks after taping what would be his final episodes of Jeopardy!, the syndicated quiz show he hosted for over 35 years. I remember watching Jeopardy! almost every day when I was supposed to be studying. I asked for, and got, the board game for Christmas one year, but can only recall playing it once or twice. Shouting the answers from the comfort of your own home is far easier than it must be when standing under the lights, in front of a studio audience, trying to remember not to call out the answer in case someone else buzzes in first. I never would have passed the tryouts. Intelligent. Soft spoken. Erudite. Those words come to mind when you think of Alex Trebek. But he could be funny too. His sense of humor was subtle, but strong. Several years ago, while working on an article about some of TV’s top game show hosts for Emmy, I was lucky enough to do a phone interview with Trebek. I usually don’t get nervous before interviewing celebrities, but he was one of the handful that I really hoped would not disappoint me by being rude or dismissive. Thankfully, he was just as friendly as he was on the show, just a bit more relaxed – probably because he didn’t have to keep a game on track. At one point during the call, a FedEx truck

stopped in front of the house and my dog Lily – who was a very vocal husky mix – began howling. Lily didn’t just howl. She had special “songs” for different people and situations. For letter carriers and delivery people, she had a fairly operatic ditty that showcased her range with both high and low notes. I apologized to Trebek for the musical interruption, and without missing a beat he said, “She’s probably not a soprano. More of a mezzo-soprano.” A music joke! He then told me about his own dogs and some of the things they’d done. That was the moment I realize Trebek was even cooler off-camera than on. (In 2016, that anecdote was incorporated into a video display for opening of Television Academy’s Media Center.) Trebek’s final Jeopardy! episode was initially supposed to air on Christmas Day, but since holidays have a way of pre-empting programming producers decided to repeat ten “best of” episodes from Trebek’s tenure and save his final episodes until the first week of January. His final appearance as host of Jeopardy! will air January 8, 2021. Alex Trebek’s passing truly is the end of an era, but Jeopardy! will continue, albeit with a heavy heart. Starting January 11, Jeopardy’s “GOAT” (Greatest of All Time) champion, Ken Jennings, will be the first in a line of interim hosts.

In Latin, the word ‘excelsior’ is translated as ‘ever upward’ or ‘even higher’. Those words encapsulate the spirit of our organization and the motivation behind our work. During last week’s virtual Rockford Register Star Excalibur/Excelsior Awards, the Rockford Area Convention & Visitors Bureau was named the 2020 recipient of the Excelsior Award, a prestigious annual honor presented to an organization that delivers positive impact to life in the Rock River Valley. As I reflect on the organizations that were also finalists this year – Rockford P rom i se a nd Ro c k ford Sy mphony Orchestra – and those honored in prior years, I am truly humbled RACVB is in such good company. This year has been trying for our community. These times have been tougher than we have seen in decades. And yet, the Rockford region knows how to take on the tough stuff. Deciphering seed catalogs: Part 2 BY GRANT MCCARTY CONTRIBUTOR

In selecting seeds from a catalog, you may find unfamiliar terminology. These terms are used to help you make the right decision in selecting plants for your growing area while also setting you up for a successful vegetable garden. In describing varieties, most seed catalogs will discuss how it grows, potentially it’s history, and productivity. One of the main terms you will see is “Maturity”’. For instance, a cucumber may list 50-60 days. This means that by planting directly into the soil in your garden, you should

have cucumbers within 50-60 days. That of course is based on planting it at the right time, soil temperatures, and how your season goes. However, it is a great estimate for you. Seeds that need to be started as transplants will say “____ days from transplant”. For example, the ‘Purple Pickling’ eggplant would yield in 90 days from transplants, meaning that you started the ‘Purple Pickling’ eggplant 5-6 weeks indoors from seed and plant June 1st. As you can see, that is a very long growth period of almost end of August for eggplants to be harvested.

If you do not have the equipment or time to start your seeds indoors for a vegetable variety that will need that, then plan to purchase your transplants in the spring and/or just purchase direct seeded types. Many of the varieties you will find in seed catalogs will be available as transplants this spring at home and garden centers. Certain seed catalogs specialize in “heirloom” and “open-pollinated” varieties. These two words are very similar and mean that these varieties’ seeds can be saved. Many of them have unique features, colors, and flavors but can also have disease issues. For tomatoes, you’ll

see the term “Indeterminate” and that will usually denote an heirloom type of tomato. These indeterminate tomatoes will continue to keep growing and can be very big footprints in your garden spaces. The “Determinate” type of tomatoes are much smaller plants and usually have disease resistance. Use this information to make the right decisions in selecting your varieties. By taking the time to consider all that vegetable variety’s features, it can ensure that your growing season is o� to a good start. Solutions: renewable energy and climate BY DRS. ROBERT & SONIA VOGL CONTRIBUTORS

It is important to keep in mind that “energy is the economy” and “debt is a lien on future energy” (Art Berman: Stop expecting oil and the economy to recover). The expanded consumption of energy along with dramatic increases in debt leaves the question of what the economy will be like if e�orts to control the coronavirus are successful. The need to address climate change remains. The initial strategy has focused on how renewable energy can replace fossil fuels to keep the global temperature from increasing 2°C. An 80% reduction in global greenhouse gas emissions by 2050 is needed to stay within that goal. Renewable energy advocates and their supporters believe the economy can increasingly be powered by renewable energy sources and seek a rapid transition to them to avoid the worst impacts of climate change. While supportive of renewable energy, in 2018 Lew Blank developed a paper addressing “renewable energy and its obstacles.” The two biggest hurdles to the extensive use of renewable energy are electrification and the cost of

the transition. Blank created four categories each representing about 25% of total greenhouse gas emissions which would need to be replaced by renewable energy. The first category includes all the electricity used in homes, factories, places of work and electric high speed rail. He sees this category as technologically and economically feasible. The second category includes sectors which could be powered by electricity which in 2018 was not a�ordable including cargo ships, freight trains, cars, trucks and heating and cooling. It appears electricity for cars, trucks and heating and cooling of buildings are becoming more cost e�ective. He believes the last two categories present the biggest obstacles. The third category includes plane travel, cement, steel and petrochemicals. They are currently without technologies to replace those they use. A fourth category includes practices which he sees as unable to be powered by electricity. They include enteric fermentation, rice cultivation, landfi lls, waste water treatment and deforestation.

While he still expects renewable energy sources to play a major role in our energy future, his categories provide a potential sequencing of priorities in implementing renewable energy even if it is not the complete solution to a cleaner energy future. In the face of these and other obstacles renewable energy continues to expand its presence in the marketplace. A new report developed by Vibrant Energy stresses the role rooftop and community solar can contribute to the US energy transition by 2050 in a cost e�ective manner. Those approaches could provide enough power to serve roughly 25% of US homes with solar power while saving money, reducing the need for peaker plants and electrical grid expansion. Solar energy expansion should include local power storage which would improve local energy security by improving local economies while providing increased job opportunities. As solar systems continue to increase, interest in stand-alone storage capacity to absorb the growing production is growing. Progress in reducing battery costs continues with Musk promising to cut their costs in half within a few

years through ongoing research and development. Another promising breakthrough is the decision of the Roanoke Electric Cooperative to pilot the first electric vehicle charging station providing two way current to enable a vehicle-to-grid electrical exchange. Using electricity from batteries in the electric car provides income to the car owner while helping the utility make more e�cient use of its grid. Several green hydrogen projects under development in Europe using wind energy to release hydrogen from water are targeted at providing energy for the most carbon intensive industries which constitute the third category listed by Blank for which there were no economical replacements for existing technologies. While innovations can contribute to the transition to renewable energy issues remain regarding whether the transition will occur quickly enough to avoid the worst impacts of climate change. Uncertainties exist as well with the environmental impacts of the transition. The ultimate question rests with the capacity of the earth to support an ever increasing global population and economic growth.

Voices from the Grave

Ghost ship on Lake Michigan Kathi Kresol Contributor

Today putting up a Christmas tree means either opening a box and hoping all the pieces are still there or purchasing a live tree. Some families have decided on a more old-fashioned approach and visit a local tree farm to find the perfect tree for their festivities. Families that lived at the end of the 1800s and early 1900s used different methods, of course. Some in this area would just walk to the back of their property and cut down a tree they thought would fit. The folks that lived in the bigger cities had a little more of a challenge acquiring a tree. There were stores that sold the trees but during that time period, the trees had to be transported quite a distance and that could mean a hefty price tag. One family that made their livelihood transporting and selling Christmas trees for decades were the Schuenemanns. August and Hermann Schuenemann were brothers that had been bringing Christmas trees to the larger cities on Lake Michigan for years. During the rest of the year they made their money carrying lumber from the mills to the ports along Lake Michigan. It could be dangerous work and in 1898, August had been lost at sea during a bad storm. Herman carried on the business and by 1910 was able to purchase a share in a boat, the Rouse Simmons. Herman had earned quite a reputation

selling trees in Chicago. Instead of selling to the grocery stores in the city, he sold the trees directly to the buyers right off the boat. By cutting out the middleman, he was able to keep his prices lower than his competitors. Herman drew in the crowds by decorating his boat with lights and mounting a tree on top of the mast. Folks started to call him Captain Santa when the word spread that he was giving trees away to the needy families in the city. By 1912, families thought that the arrival of the Rouse Simmons was the true start of the holiday season. As Herman prepared to make the trip in November of 1912, he watched the weather. Any experienced sailor knew the weather in November is unpredictable. The Rouse Simmons was an older schooner that had run into trouble in the past during the stormy season but Herman felt confident in the ship’s capabilities. The ship was over loaded with a cargo of 5,500 trees aboard as she pulled away from the dock in Manistique, Michigan. The trip would take a week if all went well and from all accounts Herman and his crew were in high spirits as they began their journey. Somewhere along their route the weather turned foul and when the Rouse Simmons was spotted by the Kewaunee Life Saving Station, it was obvious she was in distress. Tug boats in the area were alerted but by the time they reached the spot the Rouse Simmons was gone. It would be the last

confirmed sighting of the ship. There were a few clues to her fate, however. In December a few trees washed ashore and a bottle washed up on the shore in Sheboygan. It contained a note that stated, “Friday…everybody goodbye. I guess we are all through. During the night the small boat washed overboard. Leaking bad. Invald and Steve lost too. God help us.” The bottle’s cork was made from a small cut of a pine tree which led some to believe that it was from the missing ship. In 1924, a wallet was brought up in a fishing trawler’s nets. It was wrapped in oilskin for protection and contained identification for Herman. Herman’s wife Barbara and their two daughters carried on their family tradition for years after the sinking of the Rouse Simmons. Mrs. Schuenemann arranged for the trees to be transported by train and sold them from the ship. In 1971, the Rouse Simmons wreck was located off the coast of Milwaukee by a scuba diver, Gordon Kent Bellrichard. Bellrichard was actually looking for another wreck, the Vernon which sunk in 1887. Local fishermen told Bellrichard of an area where their nets would get caught. He used sonar to locate what he thought was the wreck of the Vernon but was in fact the Rouse Simmons. The shipwreck was investigated and the holds were found to contain many of the trees that were packed on that fateful

day so long ago. The needles have fallen off many of the trees leaving only their skeletons. Some other artifacts, including the ship’s wheel were salvaged and are now on display in Two Rivers, Wisconsin. The anchor was also retrieved and is on display at the entrance to the Milwaukee Yacht Club. The legend of the Christmas Tree Ship didn’t end there though. Stories of sightings of the ship still continue even today. Many witnesses have told of sighting the ship with her riggings and sails all crusted with ice. The ship is often seen battling her way through the November storms. Those that see her believe that the captain and crew are still trying to finish their final journey to deliver the load of Christmas Trees to the families of Chicago. The legacy that the Schuenemann family began also continues. Every year the U.S. Coast Guard Cutter Mackinaw traces the Rouse Simmons route from Michigan to carry a load of Christmas trees to give to needy families. One can only hope that this tradition gives Herman and the rest of the Rouse Simmons crew some peace. Kathi Kresol has been researching Rockford’s past for over a decade.
