Four Ways to Combat Increased Prices and Material Delays Trent Cotney, CEO, Cotney Attorneys & Consultants From coast to coast, the construction industry is feeling the squeeze from inflated material costs. These increased prices can be traced to continuing effects of the COVID-19 pandemic, as some manufacturers periodically had to close down, production slowed and transportation restrictions hobbled distribution. But in recent months, prices are continuing to climb higher, due in large part to a scarcity of materials, an increase in diesel fuel costs and a shortage of truck drivers. Diesel fuel prices are on the rise as the cost of crude oil continues to jump (now $60 a barrel, up from $37 a year ago). The per-gallon diesel price in March was $3.07, up 22 cents from last spring. These elevated prices are bad news for the trucking industry since fuel accounts for 39 percent of its total operating expenditures. The trucking industry, which moves and delivers more than 70 percent of the freight in the United States, is facing further bad news. It relies on more than 3.5 million drivers to keep the process running, but it is experiencing a driver shortage. This year, that shortfall is estimated to be about 60,800 and some expect that driver deficit to escalate to 160,000 by 2028. This combination of higher fuel costs and fewer truck drivers is contributing to increased freight costs, which results in pumped-up price tags for all kinds of materials. To protect yourself and your company, here are some steps to take:

You should also review your contract for language regarding delays. Many kinds of delays, such as those caused by extreme weather, are regarded as excusable and warrant extensions. However, in some cases, material delays may not fall into this category. So, if you experience a delay in receiving materials, you may be expected to accelerate work to make up the time. Those additional hours can really impact your bottom line so, if possible, add a material delay clause that will allow for an extension. Another beneficial option is a material substitution clause. This provision will allow you to make a reasonable substitution to a specified material if you find that the material is not available due to factors outside your control.

Now more than ever, it is critical that you review your contracts and understand their provisions. One essential element to consider adding is a price acceleration clause. If you see material prices going up after you have signed your agreement, this provision permits you to increase your price accordingly. Language in a standard price acceleration clause will usually state that if material costs rise by more than five percent, your price will also increase but without the need for a change order. You will likely be required to provide the owner with evidence of the applicable price increase. Here is an example of the provision: If there is an increase in the actual cost of the labor or materials charged to the Subcontractor in excess of 5 percent subsequent to making this Subcontract, the price set forth in this Subcontract shall be increased without the need for a written change order or amendment to the

contract to reflect the price increase and additional direct cost to the Subcontractor. Subcontractor will submit written documentation of the increased charges to the Contractor upon request.

While those contractual elements can provide significant protection for contractors and subcontractors, many owners may not agree to them. They may insist on seeing fixed prices in the contract and they may not allow for extensions or materials substitutions. In that case, you can explore building up an inventory of materials that you commonly use. To complete such an inventory, have a conversation with your key suppliers and let them know what your needs and priorities are. Develop a strong relationship with them and ask for their knowledge regarding shortages and other trends. When you create a genuine partnership with your vendors, you have a more solid chance of getting the materials that you and your customers require.

SB 76 – Prohibited Property Insurance Practices by Contractors Lisa Pate, FRSA Executive Director One of the most contentious bills in the 2021 legislative session for the roofing industry was Senate Bill 76 (SB 76). Among other items, original versions of both the Senate bill (SB 76) and its House counterpart (HB 305) contained a reimbursement schedule for roof replacement after a 10-year life span, favoring one roofing system over another. FRSA’s opposition to the bill was multifaceted. We opposed an arbitrary 10-year roof lifespan and feel that the lifespan of most roofs exceeds 10 years (if properly installed) and that one roof system is not inherently better than others. We also opposed any language that provides for prorated roof claim reimbursement without some type of hurricane damage exclusion. Should a hurricane or severe weather event occur, the reimbursement schedule would have left properties unprotected and jeopardized the safety of those unable to afford necessary repairs. As mentioned, the original bill language in both the House and the Senate included a sliding scale for replacement value of various roofing systems beginning at 70 percent and declining to as low as 25 percent. FRSA Legislative Counsel, Chris Dawson, reached out to both bill sponsors, Senator Jim Boyd and Representative Bob Rommel and offered to work with them to revise language, making it more user-friendly for roofing contractors. FRSA also engaged House leadership and Senator Keith Perry to request changes to the bills. Mike Silvers, CPRC, FRSA Technical Director, assisted Chris with technical and code language and offered an alternative to the reimbursement schedule by proposing a material-neutral option or a yearly depreciation option that would have extended the roof life reimbursement in the schedule to 20 years. Chris successfully lobbied the House to eliminate the reimbursement schedule completely. Thereafter, an FRSA-led coalition including the Associated Builders and Contractors of Florida, the Florida Homebuilders Association and the Florida Realtors advocated within both the House and the Senate for support of the House bill as amended in FRSA’s favor. Mike reached out to industry associations: Tile Roofing Industry Alliance (TRI), Asphalt Roofing Manufacturers Association (ARMA), EPDM Roofing Association (ERA), National Roofing Contractors Association (NRCA) and the Cedar Shake and Shingle Bureau (CSSB) for support. They immediately came to our aid and wrote letters to Florida legislators supporting our position and an industry coalition was born. Over a few short weeks, leaders from each group 16

participated on calls and group emails, contacting Representatives to support House Bill 305. It was truly amazing how quickly the industry banded together to oppose bad insurance industry language. Our thanks to our industry partners for their support and to Craig Brightup, The Brightup Group, for assisting Chris and drafting language to support our position. After several amendments, most notably the removal of the reimbursement schedule, SB 76 passed in a form largely identical to HB 305 as earlier amended in FRSA’s favor during the final hours of session. If Governor DeSantis signs the bill, it will go into effect on July 1. There are other provisions in the bill upon which contractors should exercise caution. Offering a residential property owner a rebate gift, gift card, cash, coupon, waiver of any insurance deductible or any other thing of value in exchange for allowing the contractor to conduct an inspection of the roof is prohibited. So it’s not banning a roofer from doing an inspection, it’s outlawing a roofer from providing an incentive or a gift to the homeowner in exchange for permission to perform a roof inspection. The bill prohibits contractors and persons acting on behalf of contractors, from: ■ Soliciting residential property owners through prohibited advertisements, which are communications to a consumer that encourage, instruct or induce a consumer to file an insurance claim for roof damage; ■ Offering the residential property owner consideration to perform a roof inspection or to file an insurance claim; ■ Offering or receiving consideration for referrals when property insurance proceeds are payable; ■ Unlicensed public adjusting, and ■ Providing an authorization agreement to the insured without providing a good faith estimate. The above acts are subject to license discipline by the Department of Business and Professional Regulation (DBPR) and a $10,000 fine per violation. The bill provides that the residential property owner may void the contract with the contractor within 10 days of its execution if the contractor fails to provide notice to the residential property owner of these contractor prohibited practices. The bill prohibits licensed contractors and subcontractors from advertising, soliciting, offering to handle, handling or performing public adjuster (PA)

services without a license. The bill does not prohibit the contractor from recommending that the consumer consider contacting his or her insurer to determine if the proposed repair is covered by insurance. The bill prohibits a PA, PA apprentice or person acting on behalf of a PA or PA apprentice, from offering financial inducements for allowing a roof inspection of residential property or making an insurance claim for roof damage. The bill also prohibits them from offering or accepting consideration for referring services related to a roof claim. Each violation subjects the PA or PA licensee to up to a $10,000 fine. Unlicensed persons not otherwise exempted from PA licensure commit the unlicensed practice of public adjusting when they do these prohibited acts and are subject to a $10,000 fine per act and the criminal penalty for unlicensed activity.

Citizens Property Insurance Corporation

The bill provides that a personal lines residential risk seeking to be newly insured by Citizens Property Insurance Corporation (Citizens) is ineligible for coverage if it receives an offer of comparable coverage from an authorized insurer that is not more than 20 percent higher than the Citizens premium, rather than the current 15 percent eligibility threshold for new policyholders. The bill increases the 10 percent cap (the “glide path”) on Citizens’ rate increases by one percent annually beginning in 2022, until the cap reaches 15 percent in 2026. The bill specifies that Citizens’ rate calculations must include the cost of reinsurance to cover its projected 100-year probable maximum loss, even when Citizens does not purchase reinsurance. The bill requires that Citizens’ budget allocations for employee compensation and all proposed raises for an employee exceeding 10 percent of their current salary must be approved by the Citizens Board of Governors, along with an overall employee compensation plan.

Notice of Property Insurance Claims

The bill specifies a property insurance claim or reopened claim must be provided to the authorized or surplus lines insurer within two years of the date of loss. A supplemental claim is barred unless notice is provided to the insurer within three years after the date of loss. The bill clarifies that the date of loss for claims resulting from hurricanes, tornadoes, windstorms, severe rain or weather-related events is the date a hurricane makes landfall or when the tornado, windstorm, severe rain or another type of weather-related event is verified by the National Oceanic and Atmospheric Administration (NOAA).

Lawsuits Arising Under Property Insurance Policies The bill creates a framework for all suits not brought 18

by an assignee arising under a residential or commercial property insurance policy, including surplus lines policies. A claimant must provide the Department of Financial Services (DFS) with written notice of intent to initiate litigation at least 10 business days before filing suit. The notification must be made on a form provided by DFS and may not be given before the earlier of the insurer’s denial of coverage or the expiration of the 90-day period to adjust a claim under section 627.70131, F.S. The notice must detail the alleged acts or omissions of the insurer giving rise to the suit. If the insurer denied coverage, the notice must include an estimate of damages. If the insurer did not deny coverage, notice must include a presuit settlement demand that itemizes damages, attorney fees, costs and the disputed amount. The notice may include supporting documents. The notice and supporting documents are admissible only in a proceeding regarding attorney fees. A court must dismiss without prejudice any claimant’s suit if the claimant has not complied with the requirement to provide 10 business days’ notice of intent to initiate litigation. The insurer must respond in writing within 10 business days after receiving notice of intent to initiate litigation. If the insurer denied coverage, the insurer must either accept coverage, deny coverage or assert the right to re-inspect the property within 14 business days. If the notice alleges the insurer did an act other than denying coverage, the insurer must respond by making a settlement offer or requiring the claimant to participate in an appraisal or another method of alternative dispute resolution (ADR). If appraisal or ADR is not concluded within 90 days after the 10-day notice of intent to initiate litigation, the claimant may immediately file suit. The bill provides that, for lawsuits under surplus lines and authorized residential and commercial property insurance policies not brought by an assignee, attorney fees may only be awarded using the methodology created by the bill or when the court imposes sanctions under section 57.105, F.S. Accordingly, claimants may no longer obtain attorney fees under section 627.428, F.S., or section 626.9373, F.S., nor may insurers recover attorney fees using an offer of judgment under s. 768.79, F.S. Attorney fees and costs are awarded based on a formula that compares the amount obtained by the claimant in excess of the insurer’s presuit settlement offer (exclusive of attorney fees and costs) with the disputed amount between the two parties (the difference between the claimant’s presuit settlement demand and the insurer’s presuit settlement offer, also exclusive of attorney fees and costs). If the amount obtained by the claimant in excess of the insurer’s presuit settlement offer is: ■ Less than 20 percent of the disputed amount, each party pays its own attorney fees and costs.

FRSA Helps Clarify the 25% Rule Mike Silvers, CPRC, Owner of Silvers Systems Inc. and FRSA Technical Director At the beginning of the year, after the adoption of the Florida Building Code (FBC) 7th Edition (2020), a fellow codes professional called me to voice a concern about an inadvertent deletion during a renumbering of Chapters 4, 5 and 6 in the FBC 7th Edition (2020) Existing Building might cause major changes in the way that Section 706.1.1, the 25 percent rule, was interpreted. I wasn’t surprised that something might go awry when someone decides to reorganize a section of the code. On a slide created a year ago in our “Roofing Related Changes to the FBC” seminar, I noted: “These major renumbering type changes usually have unforeseen consequences!” The section that was left out was from Chapter 5, Related Work in the FBC Existing Building 6th Edition (2017) Section 502.3 which stated: Work on non-damaged components that is necessary for the required repair of damaged components shall be considered part of the repair and shall not be subject to the provisions of Chapter 7, 8, 9, 10 or 11. Since the 25 percent rule was in Chapter 7 and because of Section 502.3, the 25 percent rule, previously did not apply to non-damaged components, the concern was that without the language in Section 502.3, it would be left up to whoever was doing the work to decide how much work to do – by including non-damaged components, they could push the work beyond 25 percent of the roof area which would prompt complete roof replacement. This has been a common approach when pushing insurers to approve a complete roof replacement instead of a proper repair even when the actual damage was minimal. Section 706.1.1 states: Not more than 25 percent of the total roof area or roof section of any existing building or structure shall be repaired, replaced or recovered in any 12-month period unless the entire existing roofing system or roof section is replaced to conform to requirements of this code. This language uses the term “roof area or roof section” and a “roof area” is not defined in the FBC but a roof section is defined in Chapter 2 as follows: ROOF SECTION. A separating or division of a roof area by existing expansion joints, parapet walls, flashing (excluding valley), difference of elevation (excluding hips and ridges), roof type or legal description; not including the roof area 22

required for a proper tie-off with an existing system. The section of the definition that says “not including the roof area required for a proper tie-off with an existing system” clearly states that the tie-off (typically referred to as tie-in) would not be included in the roof section. This position was shared with the aforementioned professional and the issue was discussed with the FRSA Codes Committee chairs and with members of the Codes Subcommittee. It was unlikely this was the last time concerns about this deletion would arise. In February, a petitioner asked the Florida Building Commission, through a Petition for Declaratory Statement (DS 2021-007), the following question: When determining if a roof repair exceeds the 25 percent threshold specified in Section 706.1.1 of the 7th Edition of the FBC – Existing Building, should work on non-damaged components still be omitted from the repair area calculation? FRSA reviewed the request and felt that the answer to this question would be critical. We shared our opinion about the roof area definition with several key stakeholders. After sharing our view and further consultation with FRSA Legal Counsel, Trent Cotney, we requested that Trent’s office file a Motion to Intervene on behalf of FRSA. Trent assigned the drafting and filing of the motion to Travis McConnell who did a great job stating our position and expanding on it. Our thanks to them. The FBC staff analysis issued later also agreed with our conclusions. When the petition came before the Roofing Technical Advisory Committee (TAC), FRSA offered testimony restating our position. We also requested that the answer be as simple and straightforward as possible. After much discussion and a few amendments, a motion was made by Roofing TAC member and FRSA Past President, George Ebersold, which was unanimously approved by the TAC and later by the Florida Building Commission and answered the question as follows: The answer is yes. In accordance with the definition of ‘‘Roof Section” in Section 202, Florida Building Code, Existing Building 7th Edition (2020) related work which involves removal and installation of components for the purpose of connecting repaired areas to unrepaired areas (roof areas required for a proper tie-off) shall not be considered part of

Trustees Set to Award Highest Scholarship Amount in Foundation History Last year, as COVID-19 began to close in on us, the FRSA Educational & Research Foundation Trustees voted to award $30,000 in industry scholarships to 15 recipients. The amount significantly surpassed any previous amount, including the 2019 amount of $19,000. This year, the Trustees are pleased to further strengthen the Foundation’s scholarship funding to $31,500. At FRSA’s Spring meetings in Bonita Springs, each of the Trustees received a packet of 31 scholarship applications submitted to the Foundation by the end-of-March deadline. After independently reviewing and scoring each application, the scores were averaged. The Trustees then met at the end of May to award scholarships based on the scoring. Scholarship recipients will be announced in the July issue of Florida Roofing. Funding for the annual scholarship awards is derived from revenue from the Foundation Endowment as well as from donations to the Foundation specifbe98gz ically designated for scholarships. this excess moisture over a much longer period of time. Use of adhesives sensitive to moisture. Increased restrictions on VOC content in products in some regions of the country have resulted in the elimination of many solvent-based adhesives that perform successfully as single-ply-membrane adhesives. Water-based adhesives are much more susceptible to re-emulsification when exposed to moisture, depending on the adhesive formulation. Use of a vented or non-vented steel pan deck beneath concrete. Concrete placed over a steel pan deck provides diaphragm resistance against lateral load due to wind and seismic forces and is a common application on many commercial and institutional buildings. However, steel pan decks, whether vented or non-vented, function essentially as a vapor retarder located beneath the concrete, which significantly reduces the amount of drying that can occur from the bottom side of the concrete. Therefore, moisture from the concrete can only dry through the top surface, at perimeter edges, at side/end laps of pan deck and at penetrations through the slab. This type of construction is more problematic when lightweight aggregate concrete is used. Ventilated decks may allow for some drying of the deck; however, they still provide very little net venting of moisture and provide minimal value with respect to downward drying.

Accelerated construction schedules. The standard 28 days at which concrete is evaluated is often misconstrued as a suitable “drying” period for the concrete prior to roofing application. The 28-day curing period, however, is commonly what is required to obtain acceptable structural strength and has no significance or correlation to the moisture content of the concrete. Accelerated construction schedules often do not allow for adequate drying of concrete – even with optimal climatic and construction conditions. Additional Items. Items such as the mixture proportions, admixtures, curing methods, finishing methods and curing compounds for the concrete can also affect its moisture content and drying rate. In addition, climatic conditions and the amount of precipitation that occurs after initial concrete placement can significantly impact the moisture content and drying rate of the concrete.

Moisture Testing for Concrete Decks

Moisture testing of concrete roof decks has historically included the placement of hot asphalt on the top surface of the concrete deck, plastic mat tests or the use of non-destructive capacitance moisture meters. The following are test standards for evaluation of moisture in concrete slabs in use today, followed by commentary on each:

ASTM D4263, Standard Test Method for Indicating Moisture in Concrete by the Plastic Sheet Method. This test method was developed for indicating the presence of capillary moisture in concrete prior to the application of coating systems. This test includes sealing the perimeter of a small, transparent plastic sheet or glass pane to the concrete surface, monitoring it over the required time and visually inspecting the underside of the sheet for the presence of moisture. Commentary: This test method is unreliable due to the difficulty of creating an airtight seal and will often result in a false dry reading. Lightweight aggregate concrete roof decks release moisture over an extended period of time and a “dry” observation with this test method is not indicative of long-term moisture release that can occur after the roof is installed. As such, this test is of little value for determining acceptable moisture levels in concrete roof decks prior to roof installations. ASTM F1869, Standard Test Method for Measuring Moisture Vapor Emission Rate of Concrete Subfloor Using Anhydrous Calcium Chloride. This test method measures the rate of moisture vapor emitted from concrete and has been commonly used prior to the application of flooring systems. This test method utilizes a cylindrical plastic dish with a transparent cover that contains

calcium chloride and that is sealed to the concrete slab at strategic locations. Each dish is weighed prior to placement and after being in place for a pre-determined time to calculate the moisture vapor emission rate. Commentary: This test method is not intended for use on exterior roof decks and may be misleading because it is primarily limited to measuring the moisture content in the top 1/2 inch to 3/4 inch of the concrete. In addition, this test method cannot be used to evaluate moisture vapor emitted by lightweight aggregate concrete because the release of its excess moisture is often delayed. ASTM F2170, Standard Test Method for Determining Relative Humidity in Concrete Floor Slabs Using in-situ Probes. This test method was originally developed for the flooring industry to measure the moisture in concrete floor slabs prior to the application of flooring systems and coatings. It utilizes small humidity probes that are installed into pre-drilled holes in the concrete and allowed to equilibrate for a minimum of 24 hours. Each probe measures the internal temperature and relative humidity of the concrete. This method is based on testing in an interior conditioned environment. Commentary: This method has had great success in the flooring industry and shows the most promise for use in determining the moisture content

of concrete roof decks. The test method, however, will yield varying results on a roof deck due to exposure to sunlight and differing climatic conditions (e.g., temperature and humidity). The current test standard requires a controlled conditioned interior space. Additionally, there are no guidelines for this test to adapt it to uncontrolled environments such as roof decks. NRCA has suggested a maximum relative humidity of 75 percent for both normal-weight aggregate concrete and lightweight structural concrete prior to roof application, but this number is not validated by research. This amount of moisture, however, may impact moisture sensitive roof system components such as organic materials, paper-faced polyisocyanurate, wood fiberboard and water-based adhesives. Further research is necessary to determine ASTM F2170’s effective use on new concrete roof decks and to determine the maximum relative humidity of the concrete prior to roof application. Capacitance and Pin Probe Moisture Meters. This type of test is non-destructive because it involves setting a unit directly on the concrete. The meters have both a transmitting and receiving pad that send radio waves into the substrate to measure the capacitance, which is related to the moisture content of the substrate. Commentary: This type of test only measures moisture in the concrete in a very small area (all of these tests are performed in “small” areas or spot locations on a deck) near the approximate top 1-1/2 inches of the concrete slab and does not provide information on the amount of moisture in the lower portion of the concrete slab. Because the moisture content of concrete slab surface is often dependent on ambient temperature and humidity conditions, these meters do not provide a reliable measure of concrete slab moisture content. In addition, these types of meters can provide false readings in concrete if there are large pieces of aggregate or reinforcing steel near the surface that impact the capacitance.

Wind Uplift Resistance

Wind uplift resistance of low-slope roofs often relies on adhesion of roof system components to the roof structure. On concrete roof decks, adhesion is more commonly used for system component securement than mechanical fastening, because the installation of fasteners into concrete is more difficult than into steel or wood decks. As such, adhesives are often used and they must be able to perform in moist and alkaline conditions. Elevated moisture levels in concrete can negatively impact the adhesion of adhesives, asphalts and vapor retarders/membranes and must be considered prior to installation.

IIBEC Recommendations

Designers and installers of insulated roofing assemblies over concrete roof decks should consider the following: ■ Concrete Mixture Proportions and Placement □ Limit the water-to-cementitious materials ratio (w/c) (for normal-weight concrete, the w/c should be less than or equal to 0.40; for lightweight structural concrete, the w/c should be less than or equal to 0.45) □ Avoid hard troweling the slab, which densifies the newly placed concrete surface □ Use a cover to cure the concrete and avoid film-forming curing compounds

Precipitation on exposed concrete roof decks during and after the initial concrete curing will significantly increase the required drying time, which must also be taken into consideration. Roofing-Manufacturer-Specific Assemblies Over New Concrete. Some manufacturers have developed roof assemblies specifically for installation over new concrete decks. Such assemblies are designed to allow the release of excess moisture through venting to the exterior. These systems, however, are new to the market and without widespread long-term performance history. As such, it is recommended that designers carefully review the roof performance requirements with the roofing manufacturer and any system performance history prior to selection of a new proprietary system. Roof Replacement – Existing Concrete Roof Decks. Existing concrete decks are typically in place for many years prior to a roof replacement. As such, excess moisture from initial concrete placement is often not an issue. However, moisture from roof leaks can result in rewetting of the cured concrete and result in a large quantity of excess moisture in the concrete. Designers of roof replacement systems over existing concrete decks should analyze and consider the moisture content of concrete roof decks at and around leak locations at a minimum and should consider the impacts of modern methods and systems detailed above for the roof as a whole. Moisture Content and Testing of Concrete Roof Decks. Currently there are no roofing industry standard criteria for an acceptable moisture content in concrete roof decks and no accepted standard field testing for measurement of the moisture content. Results from ASTM D4263 and ASTM F1869 are only reflective of surface moisture and are not effective in detecting moisture levels in lower portions of the concrete slab. Field measurement of concrete relative humidity using in-situ probes using ASTM F2170, as currently used in the flooring industry, has possibilities in the future but needs further refinement and standardization for field use on concrete roof decks. Use of a Vapor Retarder. Designers should consider installing a Class I vapor retarder with a perm rating of 0.1 or less over both lightweight aggregate and normal-weight aggregate concrete roof decks.

The installation of a vapor retarder will mitigate the latent release of excess moisture concrete over time and still require that the moisture content of concrete be low enough to achieve proper adhesion. Field-verify adhesion per manufacturer recommendations and review manufacturer requirements for vapor retarder installation. Roof Assembly Wind Uplift. Roof assembly wind uplift resistance with adhered systems (i.e., those that are adhered directly to the roof deck) is dependent on the adhesion of the vapor retarder to the concrete deck and all subsequent layers that are adhered to it. Designers should consider the adhesion performance and installation requirements of vapor retarders over concrete roof decks when designing a roof assembly over a concrete roof deck that relies on the adhesion for wind uplift resistance. WIP GRIP Technology

S.T.A.R. Award Recipients – The Spotlight Trophy for the Advancement of Roofing S.T.A.R. Awards – the Spotlight Trophy for the Advancement of Roofing – is an awards program designed by FRSA to recognize members’ unique and outstanding projects. A panel evaluates the entries for inclusion and outstanding performance in each category. This year, there were 31 submissions for placement in one of four categories: Low Slope, Steep Slope, Community Service and Craftsmanship. Three industry judges – Jim Brauner, Brauner Safety Services, Pompano Beach, Joe Williams, RRC, AIA, A/R/C Associates Inc., Orlando and Mike Silvers, CPRC, Silvers Systems Inc. and FRSA Technical Director, St. Petersburg – spent the better part of a day reviewing the projects. Judging criteria includes, but not limited to aesthetics, special circumstances, unique project design, complexity of project, workmanship, teamwork, testimonials and creative problem solving. The judges use before, in-progress and completed pictures and videos to assist in the process. Below is a list of the top 11 projects in alphabetical order by company. Next month we’ll announce the winners in each category and highlight the Shining Star Award – the best of the best from this year’s project submissions.

FRSA Headquarters Building, Steep Slope

The FRSA New Headquarters project was an interesting project, primarily because the roof was comprised of all donated materials. The first hurdle to completing this project was meeting with multiple manufacturers to find those who would be willing to donate their products. While these meetings were ongoing, ASMI was also responsible for coordinating with a committee of member volunteers on the project to confirm all details for the building. Multiple approaches were presented to the committee prior to the final decisions. As the only contractor on the project not working under the General Contractor but, instead, working directly for the owner, ASMI had to coordinate time on the jobsite with all parties, instead of just the GC. This included deliveries of all the donated materials from participating manufacturers.

Bob Hilson and Co. Holes in the roof of 87-year-old Gloria Mugford’s Pompano Beach home caused a flood in her house following torrential rains that resulted in the elderly woman suffering a serious shoulder injury after she slipped and fell alone in her home last year. But the home’s deteriorating condition extended far beyond the roof. After learning the extent of his neighbor’s living conditions following her fall, Dick Spalding called Advanced Roofing Inc. President and CEO, Rob Kornahrens, to ask for a tarp to cover the roof. That call was the start of a domino effect of giving that resulted in a completely renovated and safe home for Gloria, a surprise gift just in time for Christmas. 80

Marathon Library and Adult Education Center, Steep Slope This project consisted of Petersen Aluminum 16” Snap Lock panels and wall panels in “Cityscape” color with white gutters and downspouts and white trim at the tower sections. Multiple decks and details made this a challenging project. The custom sheet metal work at the towers was especially challenging due to minimum access and keeping the building watertight. There

were several flashing details where the wall panel, metal roof and tower all came together and it took some real craftsmanship to make it look good. The roof was installed with stainless steel continuous clips to meet the enhanced pressure for which the building was designed.

Chase Roofing and Contracting Inc. Private Estate, Steep Slope

Completing this roof project was one of the 2020 highlights for Chase Roofing. The project started in May of 2020 and was completed in September 2020 in Harbor Isles, Ft. Lauderdale. All of the details involved for a project of this size were complex. The prep work, meetings, material and equipment coordination, maintaining the work quality, the inspections and the follow up are all built around timing and communication. The end result is an absolutely stunning roof.

The main tower, measuring 32,000 square feet, was capped with a premium multi-ply SBS polyester reinforced modified bitumen roof system. The roof manufacturer’s proprietary polyester reinforced base sheet and specialty fastening system were installed over tapered lightweight insulating concrete (LWIC) with polystyrene insulation. The LWIC was poured over a secondary roof/ vapor barrier consisting of a heavy SBS polyester reinforced membrane, heat-applied to a structural concrete deck. In recent years, moisture levels in newly poured structural concrete decks have become a concern for owner representatives, architects, specialty consultants, manufacturers and contractors. Therefore, McEnany Roofing had to address these concerns during application of the torch-applied SBS membrane, which also involved testing and thorough visual inspections by McEnany Roofing, Wiss, Janney, Elstner Associates, Inc (WJE), Robins & Morton, HOK Architects and SOPREMA.

High-Tech Ranch, Craftsmanship in Roofing

The High-Tech Ranch is located in a gated polo community on Florida’s west coast and features many of the latest building components and technology. The architect’s vision for this project included combining traditional standing seam metal roofing panels on the main home with a “seamless standing seam metal wall-to-roof transition” at the entry to create a dramatic and defining point of reference for guests. Mullet’s Aluminum worked very closely with the architect and engineer of record for several months and created numerous prototype samples for review and consideration. The mandate by the architect was simple: no seams at the transition and one continuous piece of metal roofing from the top of the roof line and extending down to the ground. This standing seam metal roofing project presented a challenge to fabricate, transport and install. Everything had to be perfect and the “transition lines” had to be precise.

Quality Roofing Inc.

Sparkman Wharf, Low Slope Named as one of the finest roofs installed in the City of Tampa by Strategic Property Partners, LLC, this project was unique due to the approved application to pour lightweight concrete over the existing roof with no tear-off involved thanks to Siplast’s RT pellets and Paradiene TS system. The RT pellets were broadcast into the lightweight insulating concrete then activated by the torch-applied Siplast Paradiene 20TS membrane resulting in an approved mechanical bond with no need for base-ply fasteners. The wind uplift resistance was increased to more than double the industry standard for recovery board type insulating methods with this system. Extensive base flashing consisted of Siplast foil-faced Veral membrane and accompanying Siplast Parapro PMMA fluid-applied flashing details at drains and penetrations. The curved eave reveal of the upper roof called for great attention to detail in applying all layers of this Siplast modified bitumen system. Shop fabricated stainless steel conduit boxes and curbs were also implemented.

Wish Farms Treehouse, Craftsmanship in Roofing Barr and Barr awarded Quality Roofing, Inc. the Wish Farms, Inc. headquarters roof project located in Plant City, Fla. Quality Roofing, Inc. was assigned a change order to the project to roof the new tree house. The acclaimed tree house builder for this project, The Tree House Guys, LLC, have been featured on their own DIY Network series, “Tree House Guys,” for their unique and extraordinary tree house designs. Initially this project called for a copper standing seam panel; however, the undulating wood deck made this installation application unachievable. The tree house “Roof Guys” at Quality Roofing, Inc. designed and created an approved zero right angle in-house shop fabricated copper shingle. The installation was still quite the challenge when it came to shingle alignment and angles to ensure proper waterflow. Polyglass Polystick MTS was the modified membrane underlayment of choice for this project. A picture is worth a thousand words with this “once in a roofer’s lifetime” project for everyone involved.

The Publix Corporate headquarters consisted of 1,250 squares of existing tapered insulation and modified roofing plies that was to be a complete tear-off down to the concrete deck. The team from SpringerPeterson had to install a stair scaffold on a rear single story to gain access to the main roof. They were not allowed to use the crane at all during times when the building was occupied, so tear-off had to be completed at night, along with all material lifts. Once people started to enter the building in the mornings around 6:30 am, all lifts had to stop. They could work during the day on the installation of the new roof insulation and membrane. The crew would start around midnight and tear-off until daylight and then begin the installation. There were many long 12 to 14-hour days during this project. There was also 3,800 feet of flashing to install. Set up was limited to just two locations, so travel with the material and debris was troublesome because there were also expansion joints approximately two foot high that had to be negotiated. Ramps were built over those and lawn tractors were used (no blades, of course) to tow four-wheel carts. The new tapered insulation was set in adhesive and the new membrane was also totally adhered. Change Orders and Managing Your Business It is easy and stress-free when you start your business by working for friends, making verbal agreements, doing great work and getting paid for it. But in the real world of construction, you better get a signed contract and be prepared to handle change orders – in writing. There will always be “those customers” who will expect more than what they contracted for. You must clearly define the scope of work in the contract and include detailed pricing for any change orders. This protects you, your business and its reputation. Without a contract, there can be no change orders. Contracts are of the utmost importance to hold both you and your customer accountable. If a client does not want to work with a contract, your best bet is to move on. Those are the same customers who will claim you promised extra work, even when you did no such thing.

Using a software system to manage change orders is a worthwhile investment for contractors. “Tim Kanak at Perkins Roofing called me to tell me Polyglass and Perkins Roofing Donate to Pet about the project. He informed me that the roof was Rescue Reroofing Project in South Florida Polyglass U.S.A. Inc. worked alongside contractor Perkins Roofing and other partners to refurbish the damaged roof of Abandoned Pet Rescue in Ft. Lauderdale, Fla. One of South Florida’s biggest no-kill animal shelters, Abandoned Pet Rescue (APR) had been in dire need of a new roof. The not-for-profit organization had been fundraising for the project when Perkins Roofing donated to the charity. Volunteer Larry Wallenstein then approached the contractor about estimating the cost of the new roof. Perkins Roofing worked with John Massengill, one of Polyglass’ sales agents of Building Envelope Associates, to coordinate the various donations.

leaking badly and desperately needed to be replaced,” Massengill said. “He asked if I could rally some of the manufacturers for participation in the project and I told him that I would.” As a premier manufacturer of roofing membranes, Polyglass was happy to donate more than 100 rolls of Elastoflex SA V FR elastomeric SBS membranes and Polyflex SA P granulated APP cap sheets. Both of these products feature Polyglass’s patented ADESO Self-Adhered Technology, which eliminated the need for hot torch application. This allowed Perkins Roofing to install the new roof with minimal disturbance to hundreds of the shelter’s animal residents. Polyglass also donated buckets of PG 500 flashing cement for use during the project. Other donors provided adhesives, insulation and logistical assistance. The shelter’s leaking roof covered 6,200 square feet. A combination of old gypsum and metal panels made up 5,000 square feet of the surface. The remaining 1,200 square feet was made from wood that had been infested with termites. The project took two weeks and involved extensive work. Perkins Roofing removed the damaged layers and installed Polyglass’ Elastoflex membranes and Polyflex cap sheets. APR now has a stunning new roof protected by Polyglass’s durable membranes. SOPREMA Donates $5,000 to Arbor Day Foundation

SOPREMA, Inc. announced on Arbor Day, the donation of $5,000 to the Arbor Day Foundation in honor of Chamberlin Roofing and Waterproofing of Texas. Chamberlin used SOPREMA’s innovative smog reducing ECO3 granule surfaced roofing membranes to surface a Dallas Ft. Worth International Airport Terminal. Inspired by the power of the trees, SOPREMA’s ECO3 granule surfaced membranes are a unique collaborative effort between 3M and SOPREMA for low-slope roofing. This roofing granule is designed with a specialized photo-catalyst coating applied to the mineral that absorbs nitrogen oxide (NOx) gases in the atmosphere that are then cleaned and washed away by rainwater. This process reduces the amount of ground-level pollutants, decreasing the greenhouse effect and creating healthier communities. “At SOPREMA, it’s our mission to protect people’s property, possessions and health,” said Matt Davis, SOPREMA’s Marketing Content and Brand Manager. “Making a product like ECO3 that helps contribute to all three, plus has a positive impact on the environment, is a big win for everyone involved. Donating to the Arbor Day Foundation to recognize Chamberlin’s work with our ECO3 product line is two-fold. We are fighting smog with the power of trees and we are helping plant more trees through the foundation!” Each 3,000 sq/ft2 of ECO3 membrane has the approximate smog fighting capacity of 18 trees,

with the smog fighting ability of the granule being maintained over the life of the membrane. The Chamberlin Roofing and Waterproofing project covered approximately 73,000 sq/ft2, meaning it has the smog fighting ability of about 438 trees. “But think about it: A 20,000 sq/ft2 commercial roof surfaced with our ECO3 granule surfaced membrane can offset approximately 8,000 miles worth of car emissions yearly,” Davis said. “That is the power of 120 trees.” According to the Arbor Day Foundation, “natural climate solutions are moving to the forefront of sustainability discussions. Trees can help you offset carbon emissions while offering a long list of additional environmental benefits, including cleaner air and water, soil stabilization and wildlife habitat.” FRM

3. Document Everything

If you do not have the protective contractual clauses in place and you realize over the course of a project that you may have trouble getting materials, your crew needs more time or prices have increased, do not hesitate to submit a change order. If your customer does not answer your request, follow-up with emails or other documentation, so you have a paper trail. Often, there are provisions within your contract that you may be able to use to give you a colorable argument in support of a contract adjustment. Also, keep thorough records from your suppliers regarding delays and price increases. Your careful documentation will help support any legal claims you may need to make later.
