Honoring Our Fathers and Mentors In May we honor our mothers and in June it is Father's Day! I can't begin to express what a great man my father is, and the influence that he has had in my life, in our family's life, and also in our community. It started with my grandfather who was born in South Dakota into a family of 10. They didn't have a lot of money and had to work hard for what they had. Of course, the winters were hard in the Dakotas (-30ÂşF). It was so cold that the dog would not go out when my grandpa had to deliver papers! To make a long story short, through hard work, Grandpa George started a bus company before the Second World War. The company flourished when he landed a contract from the US Navy to bus workers throughout Wisconsin to the submarine building sites in Manitowoc, Wis. Grandpa George sold the bus company and started multiple businesses that were all successful. He was a great role model and I worked for him at the cattle ranch, punching cows and bulls. I trimmed orange trees in his groves and dug graves in his cemetery. What a great and generous man. He would take the whole family on cruises to Europe. I have been lucky to have such a great dad and grandfather, and also lucky to have had many mentors; some have passed and some are still with us. You will probably recognize some of them:

ICE Raids – What Should an Employer Do If ICE Shows Up at Its Place of Business? Paul Messina, Cotney Construction Law, LLP The US Immigration and Customs Enforcement, commonly referred to as “ICE,” is a law enforcement agency under the Department of Homeland Security and is responsible for the enforcement of immigration laws in the United States. As part of the enforcement responsibilities, ICE prosecutes those who are in violation of the US immigration laws. If these individuals are found to have violated the US immigration laws, ICE ensures that these individuals depart the United States. One tactic used by ICE to locate and detain illegal immigrants is to conduct raids at places of businesses suspected to employ illegal immigrants or raids at a location where ICE believes an illegal immigrant will be (e.g. the workplace). Another tactic is to conduct a Form I-9 audit at a place of business and use the audit to confirm a worker’s identity and authorization to work in the US.

What are the Employer’s Rights During an Immigration Raid or a Form I-9 Audit?

For a Form I-9 audit, ICE must give the employer notice of the planned inspection of the Form I-9s prior to visiting the place of business. ICE sends a Notice of Inspection letter to the employer, giving them at least three days, as required by law, to prepare for the visit. Without previously receiving a Notice of Inspection or other court order, the employer does not have to provide ICE with the opportunity to inspect the Form I-9s. If provided with a Notice of Inspection, it is best to comply with ICE’s request and provide the documents requested in the Notice of Inspection. When conducting a raid, ICE does not need to provide the employer with any prior notice. However, the same rules for any other criminal investigation of private property apply. In order for ICE to enter the private areas of a business, it is required to have a warrant signed by a US District Court judge or State Court judge. Without a warrant, ICE needs consent to enter the private areas of the business. It is the employer’s right to refuse consent in those situations where it is required and the employer can instruct its employees not to provide consent as well. The best thing to do in an ICE raid is to be prepared and to make sure all employees are prepared for one as well.

How Does an Employer Prepare for an ICE Raid?

First, it is important for the employer to put a written plan in place that outlines what needs to be done and what can legally be done when ICE shows up. Once the plan is in place, it is important to practice the plan, making sure that everyone knows exactly what they are supposed to do

during a raid. Second, the employer should conduct training sessions with its employees to educate them on how they should not interact with ICE agents.

Helpful Tips for Before, During and After an ICE Raid ■■ Keep the doors to the private areas of the business closed or, preferably, locked. ■■ Post “Private” signs on doors and walls to clearly mark the private areas of the business as private. ■■ ICE will always have the ability to enter the public areas of your business, such as a parking lot, lobby, or waiting area. ■■ A job site is generally not considered a public area. ■■ Post a clear policy in the public areas of the business right outside the pathways to the private areas that visitors and the public cannot enter without permission. ■■ Always ask for a judicial warrant before letting ICE into the private areas of the business and make sure to read it to confirm that it is signed by a US District Court judge or a State Court judge. ■■ If ICE has a judicial warrant, make sure they follow the terms of the warrant (e.g. the warrant may specify only a certain location in which they may conduct their search) and note any deviations. ■■ If ICE has only an administrative warrant looking for an employee, the employer does not have to say if that employee is working and it does not have to take ICE to that employee. ■■ Make sure workers know that they have the right to remain silent and can and should ask for an attorney if questioned by ICE. Additionally, the workers should not sign anything given to them by ICE without first consulting with an attorney. ■■ Train the employees to refer all ICE inquiries to the person designated by the employer to handle ICE.

Industry Updates NRCA Announces Partnership with SkillsUSA

It provides educational programs, events, and competitions that support career and technical education in US classrooms. NRCA looks forward to engaging with SkillsUSA and expanding NRCA’s outreach and footprint in the career and technical fields to establish roofing as a core curriculum in schools and help NRCA members address workforce shortages. NRCA will attend the annual National Leadership & Skills Conference the week of June 24 in Louisville, Ky., and participate in the Meet the Employer event June 28. It also will serve as a co-sponsor of SkillsUSA’s State Directors Leadership Conference in Washington, D.C., August 12-17. In the spirit of celebrating high school seniors who are pursuing a career in the skilled trades, SkillsUSA National Signing Day 2019 was held on May 8. Similar to National Signing Day events for high school student athletes, seniors were applauded as they announced their career plans and signed letters of intent for a job offer, apprenticeship, or advanced technical training. This inaugural nationwide program recognized students in hundreds of SkillsUSA chapters in high schools throughout the US; 300 schools and 3,000 students participated.

Shameless: Trial Lawyers Solicit “Last Call” for AOB Lawsuits While Blatantly Promising New Tactics to Thwart Just-Passed AOB Reform Legislation

Even before the ink on the just-passed legislation has dried and Governor Ron DeSantis has had a chance to sign the bill into law, a new video by Orlando trial lawyer Harvey Cohen calls on vendors to send in as many AOBs as possible for litigation before the new AOB reform law takes effect July 1. And Cohen, the self-proclaimed inventor of Florida’s current AOB phenomenon, promises he has some “new tactics” to share to thwart the good, commonsense consumer protection bill passed recently by the Florida Legislature and sent to Governor DeSantis for signing. These types of litigation-for-profit schemes by billboard trial attorneys cost all Florida insurance consumers in the form of higher rates. “It is precisely this type of gaming of the system that has hurt Florida’s hardworking families and fueled out-ofcontrol AOB litigation, fraud, and abuse in both property and auto insurance,” the Consumer Protection Coalition said in a statement. “Florida’s legislators and other senior elected leaders should be aware that there are already blatant efforts underway to erode the good reforms 14

ASHRAE Publishes New Guideline on Energy Efficiency for Historic Buildings ASHRAE published a new guideline for increasing energy efficiency in historic buildings while minimizing the disturbance of the building’s historic character and significantly historic characteristics and materials. ASHRAE Guideline 34-2019, Energy Guideline for Historic Buildings, provides comprehensive and detailed descriptions of the processes and procedures for the retrofitting of historic buildings to achieve greater measured efficiency. The guideline is particularly aimed at providing guidance for “listed” historic buildings; i.e., those formally designated or eligible to be designated as historically

Building envelope improvements, environmental control strategies, energy system analysis, HVAC selection, and lighting design considerations are all addressed in the guideline. All recommendations are made in consideration of preserving the integrity of the historically valuable building character, materials, and associated artifacts. Many historic buildings were constructed without insulation and designed without active air conditioning systems—especially for mechanical cooling. Retrofitting such buildings requires specialized techniques during construction and operation, as well as sensitivity to respecting and preserving historical significance. The roofing industry, and FRSA in particular, were very well represented. FRSA President-Elect and FBC Commissioner Brian Swope, CPRC (Tampa Roofing Co Inc) continued to do an excellent job as Chairman of the Roofing TAC. FRSA Immediate Past President Charlie Kennedy (Gainesville Roofing & Co Inc) and Tyler Allwood (Director of Business Development, Eagle Roofing Products) were gracious enough to serve as alternates for TAC members and Past Presidents Burt Logan and George Ebersold. The building code is the law of the construction land. If we don’t work to influence its contents, the results will be left to those who have other than roofing industry interests. Most of the modifications submitted by FRSA were approved by the TACs as submitted. For the most part, our preferred positions on other modifications prevailed. However, keep in mind that this is just the first step of the code renewal cycle. Another set of TAC meetings is scheduled for the week of July 9 in Gainesville. Garnering participation may be difficult because it will be the week before FRSA’s Convention and Expo, but this is no time to let our guard down; we still have several rounds to go. FRM Michael J. FRSA Purchased Land for New Building Lisa Pate, FRSA Executive Director

For the past three years, FRSA has been actively looking to purchase a piece of property to build permanent offices for the Association and Credit Union. Last September, we finally found a location in an existing office park that suits our needs and submitted an offer. In late December 2018, we closed on the property and began developing plans for a new 8,000 square-foot building, which will include ample office space for both the Association and Credit Union, a classroom training center, and two conference rooms. The plan is to selffund the building so that it will be owned free and clear upon completion. In April, the Executive and Building Committees and the Board of Directors signed off on the floor plan, along with the building elevation seen above. The new building will be energy efficient and include Low-E windows, LED lighting, and solar if approved by the office park’s Architectural Review Board. The building will include a generator so FRSA staff can be ready when inclement weather hits the area.

As many of you may remember, FRSA’s old location had a walkway leading into the building made up of bricks purchased by members. Some bricks had company logos, others were memorial tributes, and some were names of FRSA leadership. Those bricks will be relocated and installed at the new location; depending on the amount needed, there may be an opportunity to purchase additional bricks. The architect, builder, and civil engineer are finalizing drawings, engineering, and permitting and we’re expecting to break ground in June. The builder is estimating approximately eight months for completion, but we are planning on 12 months. Our current lease expires at the end of July 2020, so we have plenty of time to complete the new building and make the transition. Pictures and mementos of FRSA’s rich history will be on display throughout the building, reflecting almost 100 years of service to the industry. FRM


Robotics in Construction Karen L. Edwards, Director of Communications and Member Engagement, RT3 Collective robotic construction (CRC) specifically concerns embodied, autonomous, multirobot systems that modify a shared environment according to high-level, user-specified goals. A Science Robotics study published this March states that “the increasing need for safe, inexpensive, and sustainable construction, combined with novel technological enablers, has made large-scale construction by robot teams an active research area.” The study notes that 54 percent of the human population currently live in cities and that number is expected to grow to 66 percent by 2050. The researchers feel that collective robotics can help meet the construction demand in the midst of an ongoing labor shortage. CRC could also make construction safer for workers, with the Department of Labor citing that 20 percent of all worker injuries occur in construction. The researchers were inspired by the extensive use of collective construction in nature for building nests, protection barriers, traps, and mobility scaffolds. Where animal construction relies on reactive behaviors and “low-bandwidth communication,” robots can rely on high-resolution sensors, high-speed communication, and GPS to communicate their exact location for completing specific tasks. Construction materials used in CRC are divided into two categories – discrete and continuous. Discrete materials would be square, rectangular or homogeneous bricks, struts, and sandbags. Continuous materials would be things like two-component foam, concrete, and fibers. The study says that “challenges pertain to CRC hardware, especially in relation to coordination, communication, and multimodal sensing.” The robots need to be able to adequately communicate and coordinate with nearby robots for success. “As more advanced sensors such as radar, depth cameras, laser imaging and ranging systems, and GPS become cheaper and more readily accessible, they may play a bigger role in the field.” The researchers reference two published systems, UAVs and climbing robots, that can be used to develop a metric that measures constructed volume relative to time, the number of robots used, and the volumetric size of each robot. “A flying robot [UAV] has higher energy expenditure and lower payload than a climbing robot

but may fly directly between material cache and deposition sites. Reversely, climbing robots can carry more but have to traverse through previous construction.” The study is the first step in determining how robotics can make an impact in construction. Further study is needed to develop performance metrics, evaluate the reliability of CRC and its ability to adapt to changes in movement and expected behaviors of the other robots. There also needs to be more research in order to determine where humans fit into the CRC picture to oversee work, make adjustments and corrections when there is an error, and in the support and maintenance of the robots. FRSA’s 2019 Golf Tournament returns to Celebration Golf Club, a beautiful course designed as the final collaboration between Robert Trent Jones Senior and Junior. Using their joint design strategies and the natural lay of the land, they crafted an upscale golf course that takes full advantage of the natural pine forests and Florida wetlands. Registration for the tournament includes green fees, cart, range balls, refreshments, continental breakfast, prizes, and lunch. Check-in begins at 7 am, with the tournament beginning at 8 am. Teams are 4-person scramble format and individual registrants will be paired. Get your registrations in early!

FRSA’s Educational and Research Foundation, CILB Provider #0000910, Florida Board of Architecture #0000910 (select courses), and BCAIB Provider #0000910 (select courses), is offering a total of 21 hours of continuing education credit during the 2019 Convention. All courses are designed specifically for contractors. Our goal is to provide you with the educational tools you need to make your business successful.

Construction Contractors

Note: Licensed construction contractors are required to earn 14 hours of continuing education credit per renewal cycle (two years). Within the 14 hours, they must meet six specific training requirements: (ADV) Course meets Advanced Florida Building Code requirements; (BSP) Course meets Business Practice requirements; (L&R) Course meets Laws and Rules requirements; (WPS) Course meets Workplace Safety requirements; (WC) Course meets Workers’ Compensation requirements; (WMM) Course meets Wind Mitigation Methods requirements. Business Continuity Insurance Furman Insurance Many business owners fail to consider how they would manage if a fire or natural disaster rendered their business premises temporarily unusable. According to the Federal Emergency Management Agency (FEMA), almost 40 percent of all businesses that close down following a disaster never open again. With advanced planning, there are measures you can take to protect your company’s bottom line. To safeguard your business, consider business continuity coverage, an insurance coverage added to your property package that funds the restoration of your business operations after a loss.

Types of Coverage

There are three types of business continuity coverage and specific items to consider for each:

Business Income

This is designed to replace income your business would have incurred had no loss occurred. Business income is generally defined as the net profit or loss before taxes, plus continuing normal operating expenses, including ordinary payroll (payroll for employees other than officers, executives, department managers, or employees under contract). Coverage is generally limited to the loss of income sustained until the property is restored or a specific timeframe following the loss. Specific Items to Consider It is important to review ordinary payroll annually. In the past, manufacturers chose not to insure their direct labor costs—unskilled labor was easily replaced. Consider if that’s still true in your marketplace today. Review your projected timeframe for resuming business. After a major loss, getting up and running may take much longer than you anticipate and can cost much more too. You may be back in business but your customers are still going to your competitor. An extended period of indemnity may be necessary to give you more time to restore your business to pre-loss level.

Extra Expense

This is designed to pay for necessary expenses incurred during the period of restoration of the property. Extra

expenses include those necessary to continue operating the business at its original location or at a temporary replacement location until the original location is repaired. Specific Items to Consider Not all businesses would lose customers after a major loss. For example, a law firm would retain its clients and there would still be a flow of revenue; however, the costs involved in renting new office space, moving, and hooking up new phones and computers is considerable. Transitions are more expensive than you think. Increased rent, employee overtime, and moving costs are examples of extra expenses that service organizations should consider insuring.

Contingent Business Continuity

This is an extension of coverage designed to cover loss of income your business incurs due to a property loss at a key supplier or customer location. For example, if a key supplier experiences a fire at its plant and is unable to deliver parts or goods necessary for the continuation of your business, you may have a claim for a contingent business continuity loss. Specific Items to Consider Contingent business continuity is the most overlooked area of exposure to loss. Your interdependency on your suppliers (under contract or not) or one large customer could put your business in jeopardy when that party suffers a major loss. Contingent business continuity coverage can fill this gap. Finally, complete a business income worksheet every year to review all your exposures. The business income worksheet requires financial information for the current year, as well as projection into the next year. The projection portion is often skipped but trying to see into the future is important for setting proper overall limits. TAMKO Case Study: TAMKO Heritage Woodgate Keeps History Alive at Jasper County Courthouse The Jasper County Courthouse is more than an impressive historic building at the heart of Carthage, Missouri; it is a revered symbol of the historic pride of the region, a nationally recognized landmark, and the second-most photographed building in the state, placing it squarely in the public eye. The three-story building with distinctive medieval features is also one of the most unique and challenging projects ever tackled by local roofing veteran Phillip Camerer of Phillip Camerer Roofing. Camerer and his team’s charge was significant. They were tasked with preserving the critical historic design integrity of the building while simultaneously delivering a thoroughly modern roof system that would withstand the wear of intense weather. Camerer met the challenge with strategic planning, four months of strenuous labor, and a roofing shingle that fulfilled both the historically-correct aesthetic and the contemporary demands for this unique job: TAMKO Heritage Woodgate.

Consumer Ed: Is Your Roof Hurricane Ready? Mike Silvers, CPRC, Silvers Systems Inc & FRSA Director of Technical Services FRSA was recently contacted by Mike DeForest of Channel 6 News television station in Orlando. They requested our help with their annual pre-hurricane season report. In preparing for the interview, I put together some suggestions for consumers. We thought it might be helpful to share some of our suggestions with our readers. If you are a member, feel free to share this with your customers. If you live in the Orlando area, keep an eye out for the interview.

Preparing Your Roof for the Hurricane Season ■■ Inspect your roof if you are physically able and have the proper equipment (ladder, etc.). Be careful, you don’t want to create a man-made disaster while trying to prepare for a natural one. ■■ If your roof covering is tile and you don’t know how to walk on it, you shouldn’t. You can do serious damage to the tile. This also applies to metal products that imitate tile. ■■ Metal roofs can be very slick, particularly where they are shaded. This can also be true for other roof coverings as well. ■■ If you are in doubt, you should strongly consider hiring a professional. Ask yourself this question: even if I successfully climb up to, traverse, and climb down from my roof, will I know what to look for? ■■ Missing, displaced or cracked tile or shingles should be identified and addressed. ■■ Drainage systems such as drains, scuppers, and gutters should be cleaned out and inspected. ■■ Flashings at valleys, walls, change of slope, or roof types should be inspected and addressed if needed.

missing, damaged, or loose caps. ■■ Penetrations like vents, electrical risers, pipe and conduit penetrations, and plumbing stacks should be addressed as needed. In particular, if you have lead boots on your plumbing stacks, you should look for squirrel damage. They chew the top off the boots and during heavy sustained rains these will leak. A new lead sleeve can be installed over the existing boot as long as the damage is not too close to the roof surface. A little sealant on the top edge may discourage the squirrels. ■■ If it has been a while since your roof was installed, give some consideration to when it should be replaced. Different roof types have varying serviceable life cycles. A licensed roofing contractor can give you some idea based on the roof type and its age, but there is no substitute for getting a knowledgeable professional to assess your roof covering’s overall condition. ■■ If reroofing is needed, make sure your sheathing is renailed if required to meet the current building code. ■■ Consider upgrading the roof-to-wall connections and gable end bracing if they are deficient. ■■ Inspect porch or carport columns. Also inspect metal canopies and screen enclosures both for attachment at columns and walls, as well as how they attach to the main structure. Roofing Apprenticeship Program Highlights Lisa Pate, FRSA Executive Director Our roofing rock stars have been extremely busy over the last eight weeks and have finally completed their first semester. They’ll take the summer off and will begin their second semester in September. During this time, they take what they’ve learned during their first year of an accelerated version of the ABC Roofing Apprenticeship Program and apply it as they continue working. In addition to 144 hours of classroom training, the apprentices will need to complete 2,000 hours of on-the-job training per year. Since the last update in the March issue of Florida Roofing, the apprentices have completed the fastener and adhesive section and spent many additional hours of training on roofing flashing and learning the principles of weather sealing of architectural sheet metal. In addition, they’ve learned the procedures for fabrication and installation of selected flashing components. Thanks to OMG for providing assistance to the Building Materials, Fasteners and Adhesives module with demonstrations of RhinoBond and low-rise foam adhesive. The module also provided a review of general building materials (concrete, steel, and wood), fastener types and uses, and adhesives common to the construction industry. The flashing module included information on flashing

Next, the apprentices began training on sheet metal processes, which included an introduction to the skills, equipment, and procedures involved with metal cutting, bending, forming, and joining. Hands-on training included activities for hand tools and machine operations. This training took place at Tecta America in Sanford, Fla. with Mike Winant and Dave Parker. Special thanks to Dave and Mike for the hands-on demonstration of coping cap corner miters and inside and outside gutter corners, as well as general installation details. Tecta also provided the participants with two pairs of snips and bending tools.

The final class for the first semester focused on solar roofing, and soldering, and covered the selection and application of materials and tools for soldering sheet metal parts and sealing seams. For the solar portion, Quick Mount PV assisted in the presentation as subject matter experts. The class covered the history of solar power, solar power generation, recent code changes, and installation procedures. “We had an awesome wrap up to the semester on Friday,” said instructor Clay Thomas, Advanced Roofing. “The day started with a great lesson on solar power and mounting installation techniques with the team from Quick Mount

The men really enjoyed the soldering exercise and newly acquired skills. Jack Manson, my father, has volunteered for Our Daily Bread of Bradenton for over 40 years and, at 91 years of age, is still actively involved. Our Daily Bread of Bradenton is a community-driven organization devoted to feeding the hungry. They are supported by churches, individuals like you, Visit us in Booth 921 support foundations, and numerous other community-oriented organizations. Organized in 1984, Our Daily Bread is a response to our community’s need to feed the hungry regardless of race, color, or belief. Since then, with extremely limited resources and space, Our Daily Bread has served over 2,000,000 meals to needy men, women, and children from a storefront on 14th Street West in Bradenton, Fla., seven days a week including holidays. Our Daily Bread serves an average of 250 men, women, and children daily. They also have a grocery store, “Loaves and Fishes,” where families We know how. can shop free once a month for


food items and fresh produce. The store has items not available from other food sources, such as peanut butter, jelly, and produce. They served over 20,000 people through this program last year. No one is turned away, but in many instances, relief is only partial. Many need more than food.

How Can You Help?

As you travel, we encourage you to collect hotel toiletries such as shampoo, lotion and soap. FRSA staff will use these donations to create personal care kits for those in need. Donations will be collected at the annual Convention. Donations can also be shipped to FRSA at 7071 University Blvd., Winter Park, FL 32792. How did you get started in the roofing industry? Aside from being born into it, I started visiting job sites with my dad and learned how to be a dashboard superintendent at a very young age! I also worked on roofing projects during summers in high school and college to learn about systems and installation methods. What’s your favorite part of the job? That every job is different and has unique challenges, details, and intricacies. It's also cool that we get to work on a lot of interesting facilities and see things that a lot of folks won't get to experience.

How long have you been involved with FRSA? 21 Years What do you personally find most rewarding about being involved with FRSA? I've seen so many instances of members helping one another through the years and have always been impressed with the lengths they will go to in order to help each other professionally or personally.

What’s the most unusual roofing project that you’ve been a part of? That's a really tough question. There have been a lot of difficult weird ones, and sometimes it's the wackos we had to deal with on the projects that made them unusual. Overall, I would say that doing the retrofit conversion of the roofs on the O'Connell Center at the University of Florida and the Sun Dome at USF were the most complex. After it had the new structure and deck in place, we roofed the O'Connell Center in 29 days.

What advice would you give to someone interested in joining the roofing industry? Take the time to listen to what people are trying to explain to you about technical aspects and business. More often than not, they are right and the advice or guidance they give you comes from experience and will come back tenfold over the years.

What do you consider a waste of time? Complaining about labor issues in our industry without taking steps to help change it, starting with training your own employees. People that complain about things without offering any solutions.

What would be your ideal place to live and why? I already live there! We live where they come to vacation.

What’s your favorite vacation? I love to travel, but if I had to pick one place, I could walk around Rome and all over Italy for months and never tire of looking at its history. What is your dream job? Holding it together as the drummer in a rock-n-roll band. They'd have to throw Matt Cameron out of Pearl Jam for me, but I'd do my best to fill in! 90

If you could spend time with three people (living or not), who would they be and why? Both of my grandfathers on each side of my family because I never had a chance to know either of them. I'd also like to have a long chat with John Lennon and see if he ever found that peace he was looking for and if it was as cool being one of The Beatles as it looked.

What’s your favorite pastime activity? I enjoy boating and fishing with my family and friends. Being out on the water is a great release and stress buster.

What other activities and organizations are you involved with? I was recently appointed to a two-year term on the NRCA Executive Committee. I'm excited to represent us as the first Executive Committee member from Florida in many years. What would surprise others to learn about you?
