Welcome to FRSA’s 96th Annual Convention and Expo This edition of FRSA’s magazine, Florida Roofing, is our Convention and Expo issue and contains valuable information on the events planned for next month. I encourage you to set aside time to attend the Convention and visit the Expo, speak with vendors and find out what’s new in the industry, not only where products and services are concerned, but with new information found in FRSA Educational Foundation seminars. You’ve worked hard this year and deserve a wellearned break to relax while benefiting your business at the same time. In the center of the magazine, you’ll find information on the 96th Annual Convention and the Florida Roofing and Sheet Metal Expo. The Convention brochure contains all the information you’ll need for attending these events – the schedule, registration and hotel information and details on all the events taking place. You’ll also notice that there are 17 continuing education (CE) courses, with a total of 25 hours available. Since this is a license renewal year, you’ll want to make sure you can obtain all of your credit hours. If you don’t need CE credit, seminars are free to attend. Make the most of your time at the Convention and attend as many seminars as possible. This year we’re offering NRCA’s ProCertification course, For Foremen Only, a day-long program focusing on communication, leadership and management skills for field managers. The roofing industry is filled with foremen and superintendents who are incredibly adept at expertly installing roof systems and who were promoted because of that expertise. Unfortunately, these individuals often do not possess necessary levels of leadership, communication and management skills needed to effectively run their crews. This program introduces the concept that managing, leading and communicating are tools needed to be a truly successful middle manager. It also uses interactive exercises to practice using these new “tools” to become effective crew leaders. FRSA Members will be able to register for this course at half the normal price – a real value for you and your employee – but you’ll need to register soon, as the course is limited to 30 people. As a reminder, rates for full Convention registrations and the sports tournaments increase after May 27, so if you’re planning on attending, please be sure to register prior to that day. The host hotel, the Gaylord Palms Resort and Convention Center, will also close our room block on May 27 or when sold out – whichever comes first. If you’d like to stay at the Gaylord Palms Resort, please make your reservations soon. FRSA’s Convention and Expo has changed days this year and all activities are planned for Wednesday, June 27 through Friday, June 29. Construction Industry Often Invisible in Tallahassee The 2018 legislative session is over, and it has been an unusual one for a number of reasons. The start of session in early January (rather than early March) seems to throw us all off a little. This may be most difficult for those who do not live in Tallahassee (which is the majority of legislators and staff) because, right after the holidays, they have to make arrangements to be away for most of the next two months. This is an election year that includes election of our governor and cabinet. The impact of this on legislation and the legislative process should not be underestimated. This is a Florida Constitution revision year which also tends to have an impact on the legislative session. The most tragic unusual circumstance of this year’s session was the horrible Parkland shooting. This had a real time impact on legislative proceedings. From our perspective, the most problematic unusual aspect of this session is the fact that almost nothing relating to construction was accomplished. It almost feels like construction is invisible to our elected officials. Before we say that is disappointing, we should consider that it is not always a good thing to be noticed by the Legislature (especially if you have money). But what we should find troubling is the apparent unwillingness to address one of our most important needs that is also an important need for the whole state of Florida: workforce shortages. There has been some attention paid to workforce and training, but very little of it is related to or with input from construction groups. I don’t know whether that stems from ignorance or audacity. A quick glance indicates the perception of our elected officials is: ■■ preference for training tied to college (such as IT or nursing) ■■ disinterest (or worse) in training for good but non-traditional college education ■■ willingness to accept whatever Florida’s education bureaucracy says (apprenticeship) This perception is an error. The Legislature needs to understand that construction drives progress in Florida, that construction is a fantastic career path for those who are not interested in a desk or hospital job, and that Florida’s Department of Education (DOE) is a state bureaucracy stuck in the past and more interested in preserving its lazy but lucrative collection of state and federal dollars. If DOE were doing its job, there would be fewer high school graduates sitting on couches playing video games. If DOE were doing its job, it would look to be a partner with the construction industry to support a 10

FLORIDA ROOFING | May 2018

broad range of construction training. If DOE were doing its job, it would provide us and the Legislature with a solid report on construction education programs currently in place. Instead, DOE seems to have spent all of the 2018 legislative session stonewalling and avoiding the subject. That’s the bad news. Here is the good news: we don’t have to depend on DOE to get something done or to succeed. We can focus our attention on the Legislature which needs to pay better attention to individuals, organizations, and other state agencies that are actually interested in results, rather than DOE’s desire to maintain the status quo. One of the things we need to do over the summer and into the fall is tell our local candidates and sitting legislators that the need for construction workers cannot be ignored and we need help and we need to be a part of the solution. We need to let them know that, at best, DOE is resisting change (as is human nature) and that cannot rule the day. Candidates and legislators need to understand that the way to fix the problem is not merely throwing more money at apprenticeship. We need more outreach to bring in potential employees. We need better coordination of types of construction training. Last, we need to make sure they understand that failure to address construction workforce shortages will be Florida’s failure. Succession Planning for Your Business David Kronenfeld, Attorney, Cotney Construction Law, LLP What happens if I get hit by a bus? Will my spouse or child get my business? What happens to my employees? What if my business partner gets a divorce? These are questions my clients ask all too often in the course of business succession planning. As an attorney who has also worked as an investment banker and in a small business, I know well the angst caused by these nagging questions. I also know that too often a plan to address them isn’t put in place until it’s either too late or it’s incredibly expensive to create the plan. I tell my clients that my goal as a corporate attorney is to walk alongside them at every stage in the life of their company – from forming a company using their back of the napkin idea to drafting and reviewing contracts with their customers to managing day to day governance issues to growing it through acquisitions to the sale, gifting or merging of the company they’ve spent years nurturing. My job is to help business owners anticipate issues before they arise so they can focus on what they do best – building and operating their business. I aim to help protect them from the known issues as well as the unknown unknowns. That’s why a good business succession plan finds its roots in a solid operating or shareholder agreement. Establishing baseline rules for who has voting interests, who can transfer their interests in the company, what happens if a partner dies, etc. all occur in the foundational documents of a company. In addition to a solid operating or shareholder agreement, some of the common components of business succession planning include buy-sell agreements, gifting, an M&A transaction, employee stock option plans, management buy-outs and key-man life insurance. Buysell agreements are especially useful in a multi-partner business to ensure there is an agreed upon formula in the event a partner dies or there is a dispute. If your estate is above the $5.6 million ($11.2 million for couples) estate and gift tax exclusion, then gifting is an incredibly powerful tool. Gifting minority shares in your company lowers the taxable value of your estate by applying minority discounts to the gift. A merger or acquisition transaction with a competitor or company or individual is another method of maximizing the value of your company and retirement as you look to transition away from your business. An employee stock option plan or management buy-out are also excellent methods for monetizing your business outside of its traditional cash flow and often give you time to transition out of the business over the course of several years. Finally, company paid key-man life insurance can be a good tool to ensure that the company can afford to redeem your share of the company upon your death. This provides cash to your heirs while helping you sleep better at night. Too often I see business owners afflicted by the 12

unknown unknowns – the business owner whose partner gets a divorce and now the exwife has a say in the business, the son who takes over management, goes to Vegas and gambles away “his inheritance,” and father needs to step back into the business. This is why a good business succession plan won’t rest on any single document, but rather is a holistic approach to providing “rules of the road” for any of those unknown unknowns whether they crop up in the first month of the business or one month away from the sale of the company you’ve spent much of your adult life building. Reliant Roofing Announces Second Annual Every Shingle Heart Initiative

Reliant Roofing is pleased to announce its second annual Every Shingle Heart Initiative. This program was created in 2017 as a way for the Jacksonville-based company to give back to the community by providing families in need with new roofs. In its inaugural year, Every Shingle Heart Initiative provided three deserving families with brand new roofs installed by Reliant Roofing. This year, they will select three more local families to receive free roofs. The company plans to continue to grow its Every Shingle Heart Initiative well into the future. "Chet the Vet" Now Has a New Home

It was a big day for Polk County veteran, Chet LeBrun. The 97-year old was facing eviction from his home because of hurricane damage he couldn’t fix. Thanks to two local businessmen and a lot of good friends, Chet now has a good home. Chet’s home was in shambles, thanks to Hurricane Irma. The mobile home park where Chet lived, Cypress Shores, wanted Chet to fix his dilapidated home, or leave the premises. But at his age, finances are tight and his physical ability, even tighter. So, his caretaker and power of attorney stepped in, putting out a call for action on social media back in February. Since then, hundreds have stepped forward donating time and money, including two businessmen who went into overdrive.

“I agreed I would go over there and look at it and try to do something to get the park owners off of his back,” Donnie Harp, with Imperial Roofing of Polk County said. He stepped in along with another Polk business owner, Tim Leopard. “Once we realized how big the need was, we decided to step in and do a little bit more,” Leopard said. To these two strangers, doing more, meant a brand new donated home. “He had gone without help for so long that we were willing to jump in and show him that people care,” Leopard said. With help, Chet Lebrun moved into a new mobile home park, with neighbors welcoming him left and right. An innovative Australian storm recovery system, Stormseal, which "shrink wraps" damaged roofs or walls in a patented wind, rain and hail resistant polyethylene film, protecting buildings from further damage until permanent repairs are made, is now available in the United States. Officially launched at Stand 901 of the PRLB Claims Conference and Insurance Services Expo, Stormseal is designed to replace flapping, leaking, flyaway tarpaulins that usually require multiple reattachments using ropes and sandbags, allowing more damage to occur if storms or bad weather continue. The product is a major benefit for insurers, insurance builders, emergency responders, and, most of all, property owners and residents. For example, months after Hurricane Irma, there are still many buildings in Florida suffering ongoing damage because they're under tarpaulins. Unlike tarps, weatherproof Stormseal stays put for up to a year, preventing further property damage, significantly reducing expenses for insurers and minimizing stress on householders. Australian builder turned inventor and Stormseal Managing Director, Matthew Lennox, said that it has already been used to protect hundreds of storm-damaged properties in Australia and has established operations in Europe in 2017. “We are extremely excited to bring our innovation to the people of the United States, where in recent times they have felt the brunt of many storms and major weather events,” he said. The TAMKO Story In 1944 at the age of 69, E.L. Craig began a roofing business in an old streetcar barn in Joplin, Missouri. His wife, Mary Ethel, named the company TAMKO – from the first letters of the five states they anticipated as their sales territory: Texas, Arkansas, Missouri, Kansas and Oklahoma. She assumed the leadership of TAMKO in 1954 due to Mr. Craig’s health. The Craigs’ daughter, Ethelmae, directed TAMKO’s operations during the 1950s and has continued as TAMKO’s chairman to this day. In 1956, Ethelmae’s husband, J.P. (Jay) Humphreys, joined the company and in 1960 became TAMKO’s president. Over the next 33 years, Jay Humphreys led TAMKO’s growth and success with his entrepreneurial vision for TAMKO to rise to national prominence with the addition of manufacturing plants in Phillipsburg, Kansas (1969); Tuscaloosa, Alabama (1975); Knoxville, Tennessee (1976); Frederick, Maryland (1978); and Dallas, Texas (1985). In addition, Jay Humphreys’ recognition of the breakthroughs possible with the continuous quality improvement principles of Dr. W. Edwards Deming laid the foundation for TAMKO’s success today. Family leadership of the company continues today with Jay and Ethelmae’s children. Their daughter, Sarah Atkins, joined TAMKO in the 1980s and has served in a number of positions such as research analyst in TAMKO’s R&D department, commercial roofing sales and most importantly, in the implementation of Deming Total Quality Management training throughout TAMKO’s facilities. Today, Sarah continues as a TAMKO board member, training consultant and a key participant in the company’s strategic planning. Following Jay’s death in 1993, David Craig Humphreys (Jay and Ethelmae’s eldest son) assumed

the role of TAMKO’s President and Chief Executive Officer. In 1994, David changed the name to TAMKO Roofing Products, Inc. to reflect the company’s focus on roofing products. Since 1994, TAMKO’s expansion has continued at a dramatic pace. The addition of new manufacturing plants expanded TAMKO’s production capabilities for additional organic roll products as well as asphalt cements and coatings in Green Cove Springs, Florida (1994); additional glass mat production in Ennis, Texas (1996); polyester mat, cements and coatings, and waterproofing in Columbus, Kansas (1997); and the MetalWorks steel shingle production facility in Joplin, Missouri at High Street (2004). TAMKO also made numerous state-of-the-art production line upgrades and additions to its existing plants for the production of Heritage laminated shingles, the cornerstone of TAMKO’s residential roofing product line. In addition, TAMKO has pursued a strategy to achieve low-cost leadership through automation of many of its processes as well as vertical integration of raw material needs. Beginning in 1999, TAMKO entered the composite decking business with its purchase of composite manufacturing equipment in Lamar, Missouri. Since then, TAMKO has expanded its production of composite decking and added railings to complement its decking product line. TAMKO has continued to build on the success of the Deming continuous quality principles with the launch of a comprehensive Six Sigma program across the company beginning in 2002. Six Sigma at TAMKO is a business strategy and management philosophy for the urgent pursuit of perfection to achieve increased profitability with a goal of near perfection. FRSA Self Insurers Fund – Get the Most from Your Workers’ Comp Carrier

Since 1955, the FRSA Self Insurers Fund has been providing workers’ compensation insurance for the Florida roofing, sheet metal and air conditioning industries with quality services not found anywhere else. Four basic concepts set them apart from other insurance carriers – Underwriting Standards, Subcontractor Verification Services, Safety and Loss Control, and Claims Reporting and Services.

Underwriting Standards

Underwriting is the review of proposed new members and the continuing review of existing members to assure that they meet the mandated standards. The Board of Trustees of the FRSA Self Insurers Fund establish underwriting guidelines and standards for membership participation. Basic underwriting criteria for new membership include: ■■ Must be or become a member of the FRSA Association (www.floridaroof.com) or the FRACCA Association (www.fracca.org). ■■ Minimum annual payroll in a governing class code of $75,000 and at least five full-time employees with at least one employee trained and responsible for safety at each jobsite. ■■ If a contractor, must be Florida State certified or registered. ■■ Must consent to a pre-acceptance loss control inspection. ■■ Provide at least three years’ prior loss experience. Underwriting specifically reviews qualifications and compliance for: ■■ Premium payments ■■ Drug Free Workplace ■■ Safety and loss control ■■ Claims cooperation ■■ Auditing ■■ Other areas of ongoing compliance

Subcontractor Verification Service

All subcontractors who fail to obtain or maintain workers’ compensation coverage automatically become your responsibility for premium charges and potential workers’ compensation exposures under Florida Law. ■■ You should protect your business by requiring a new certificate of insurance from each subcontractor made out to your business as certificate holder prior to them doing any work for you. 34

■■ You should then contact the Florida Bureau of Workers’ Compensation Compliance at 850-4882333 or their website at https://apps8.fldfs.com/ proofofcoverage/Search.aspx to verify that coverage does indeed exist. Verification with the issuing insurance agency or carrier may also be necessary. ■■ As a final safeguard, you should record your subcontractor’s insurance certificate for periodic verification (perhaps quarterly) to assure that coverage continues to remain in force. Be advised that there is no guarantee or current legal requirement that the agency or carrier who issues you a certificate will notify you if the subcontractor’s coverage is subsequently cancelled. You can also register with the Construction Policy Contractor Tracking Database at https://www. myfloridacfo.com/WCAPPS/Contractor/logon.asp and they will notify you if any changes in coverage take place. ■■ If a subcontractor provides you with evidence of coverage provided through a PEO or leasing arrangement, you may have additional exposures. How FRSA Self Insurers Fund can assist you: ■■ At no expense to you, the FRSA-SIF staff will assist you in verifying certificates of insurance on your subcontractors. ■■ You can fax (407-671-2520) or email (underwriting@ frsasif.com) your subcontractor’s certificates to them and they will provide prompt return service of their findings to you (usually same or next day). Merely email or fax the certificates to the “SIF Coverage Verification Department” along with a cover memo with your company name and a return contact name. ■■ FRSA-SIF offers this service to encourage their members to be proactive, to help avoid audit pitfalls of additional premium billings and to assist members with proper compliance of the law.

Safety and Loss Control

The FRSA Self Insurers Fund has four full-time Loss Control Representatives dedicated to assisting members in reducing and preventing injuries. Each representative has a low designated number of members to service, providing the necessary time to accomplish each company’s safety and loss control goals. Some of the services provided include: ■■ Provide safety meetings, job site inspections, shop inspections, and construction pre-inspections with the goal of preventing workplace injuries. FRSA’s Educational and Research Foundation, CILB Provider #0000910, Florida Board of Architecture #0000910 (select courses), and the BCAIB Provider #0000910 (select courses), is offering a total of 25 hours of continuing education credit during the 2018 Convention. All courses are designed specifically for contractors. Our goal is to provide you with the educational tools you need to make your business successful.

Construction Contractors

Licensed construction contractors are required to earn 14 hours of continuing education credit per renewal cycle (two years). Within the 14 hours, they must meet six specific training requirements: (ADV) Course meets Advanced Florida Building Code requirements; (BSP) Course meets Business Practice requirements; (L&R) Course meets Laws and Rules requirements; (WPS) Course meets Workplace Safety requirements; (WC) Course meets Workers’ Compensation requirements; (WMM) Course meets Wind Mitigation Methods requirements. All additional hours are recorded as (G) Course meets General requirements. Excess hours cannot be carried to the next renewal cycle.

Unfortunately, these individuals often do not possess equal levels of leadership, communication and management skills needed to effectively run their crews. This program introduces the concept that managing, leading and communicating are tools needed to be a truly successful middle manager. It also uses interactive exercises to practice using these new “tools” to become effective crew leaders. This program is not included in the Full Registration – C.E. Debt Financing – Know Your Options Lee Rust, Owner, Florida Corporate Finance There are few companies which can operate without some source of external financing, and among those, most should use such financing to support additional growth. Knowing the sources, costs, and possibility of arranging financing for a company can be an important element in its growth plans and, on occasion, its survival. Of course, the best known and most widely available source of such operating capital is a local bank. For debt financing, bank loans are also the least expensive. Banks, however, are generally “cash flow” lenders. That is, they lend to companies that are operating profitably and have a relatively high debt service coverage (principal plus interest) provided by operating cash flow. The two primary forms of bank debt are credit lines and term loans. In general, credit lines are short term borrowings for working capital purposes and are used to support growth and fluctuations in the principal components of that working capital, that is, accounts receivable and inventories. The credit line borrowing base and outstanding amount changes as the levels of those two current assets change. The interest rate for credit lines are also usually variable and change with market rates from the prime rate as a low up to three

percent or more over prime depending upon the financial strength of the borrower. Bank term loans are fixed dollar amounts most often used to fund longer term asset purchases such as equipment, vehicles, or acquisitions. Those loans are payable monthly, usually over three to seven years, and can have either fixed or variable interest rates. Those rates are usually equivalent to credit line interest for any given borrower but may be higher for longer term loans. Although banks talk about asset-based lending and will certainly want a first lien security interest in all company assets to secure their loans, they are primarily interested in the profit and cash flow levels needed to assure that their loans will be repaid on a timely basis. True asset-based lenders are often referred to as commercial lenders. Those non-bank sources for debt financing will often provide funds to a weaker credit than a bank. Although commercial lenders may provide a loan to a company that is marginally profitable or, on occasion, even unprofitable, they will want to have their loan fully secured by assets that can be liquidated in the event of a default. In addition, that liquidation must be sufficient to fully retire the outstanding balance for

their loan. Because those assets are most often “near cash” items such as accounts receivable and inventory, most loans from commercial lenders have characteristics similar to bank credit lines. The total cost of funds charged by commercial lenders, however, is usually significantly higher than the interest for bank loans. In addition to interest on the borrowed funds in the range of prime plus two to six percent, commercial lenders also charge a number of fees that can increase the effective interest rate or total cost of funds to a range of 15 percent to as much as 22 percent. These fees include quarterly field audits

during which an auditor for the lender spends several days at the borrower’s facility confirming the accounts receivable, inventory levels, and other assets in relation to the borrowing base calculations used to establish the amount of allowable funding. Those audit fees can be $800 to $1,000 per day plus travel expenses. In addition, commercial lenders often charge an annual facility fee of 1 percent or so of the total funds available whether used or not, plus monthly servicing costs of 0.1 to 0.2 percent or more of the average outstanding balance during the month, and early termination fees of 1 to 3 percent of the total credit facility. All of those fees become part of the effective interest or cost of funds for the borrower. The least attractive form of debt financing is factoring. That is generally the sale of accounts receivable to a factor for some discounted amount. Although the account receivable is paid by the factor within days of the related sale, if your company averages a collection period of 45 days and you sell your receivables to a factor for a 3 P R E M I E R B U T Y L S E A L A N T TA P E S percent discount, that is equivalent to an annual interest rate of 24 percent. The effective interest rate for factored receivables can often be as high as 36 percent per year. Factoring was originally designed for use by garment manufacturers which sold goods to department stores that demanded 120-day payment terms. The Changing Face of Sexual Harassment I recall that we first began teaching management about sexual harassment prevention in the early 1980s and I remember how the Clarence Thomas/Anita Hill hearings in 1991 took the discussion to a different level. In 2018, we’re seeing yet another step in the evolution of sexual harassment. To this point, the employment regulations have recognized two kinds of sexual harassment. The first kind is called the creation of a “hostile working environment,” in which employees tell sexual stories or jokes or make sexual comments toward another employee or otherwise comment on sexual matters at work. In my experience, prior to late 2017, this kind of sexual harassment has been the most common and has occurred most often. The second kind is called quid pro quo, which means “this for that.” You get the picture – “You give me a sexual favor and I’ll give you a job or a raise or a promotion.” In my 47 years of HR experience, I’ve encountered this kind of sexual harassment on occasion but it has been less common than the creation of a hostile work environment. At least, that’s what I thought. Today, we’re hearing other terms like “sexual assault” and “sexually aggressive behavior.” My sense is that this term falls under the quid pro quo definition but in a much more serious and aggressive way. The Harvey Weinstein story emerged first, followed quickly by Kevin Spacey, Ben Affleck, Al Franken, Matt Lauer and a host of others and, at this time, not a day goes by without a new revelation. For the most part, those accused have been powerful men and have been politicians or members of the entertainment industry. However, if past is prelude, it is only a matter of time until powerful women are accused of sexually harassing men. And, since the workplace mirrors society, it is only a matter of time until these kinds of accusations come into the workplace. My prediction is that this will happen sooner rather than later. My sense is that, owing to the enormous amount of publicity this issue is receiving, as well as the notoriety of the people involved, employees will be emboldened and will be more likely to report claims of sexual harassment whereas, in the past, they might have just “put up with it.” If you as an employer receive a claim of sexual harassment, it is important to take every claim seriously and to investigate each claim fully and comprehensively and, if necessary, to take appropriate action based on the evidence. Accusations are not evidence and no employee should be presumed guilty based only on an accusation. Decisions about appropriate action should be based only on the evidence and only after a full and comprehensive investigation, preferably by an objective third party, like our firm. In addition, no employee should be harmed by filing a claim of sexual harassment. This is called “retaliation” and is a separate claim, standing alone. We recommend that every employer should have a policy, published in the employee handbook that prohibits sexual harassment at work and outlines a procedure for reporting allegations of sexual harassment. We also recommend a policy prohibiting management from engaging in a social, dating or romantic relationship with non-management employees. This includes virtually all persons in authority such as managers, supervisors, professionals and others. Otherwise, this is Trouble Waiting to Happen (TWTH). Here are some principles that might be helpful: 1. Management should not date or have a social or romantic relationship with non-managers, on or off the job, or with other

persons like vendors or suppliers, where a potential conflict of interest might develop, or where onlookers might sense a perception of favoritism or preferred treatment. 2. Management should not hire persons with whom they are having a social or romantic relationship because this is TWTH. 3. Management should refrain from language or actions that might send a romantic message to another non-manager. This could occur in person, by phone or by email or text. Indiscreet emails have been the downfall of many a person in authority. 4. Persons in authority should not go to lunch or dinner with their employees or other workers who are not at the same employment level, unless the lunch or dinner has a clear and necessary business purpose. 5. Revealing or immodest attire worn by one party is not a carte blanche invitation to impropriety by another party. 6. If a romantic relationship develops between a person in authority and another employee, the relationship cannot be allowed to continue, as this is TWTH. 7. The person in authority is the person who is held responsible and accountable for proper and prudent behavior and, in most cases, will be the person to suffer the consequences of an ill-conceived action. If a person in authority is the recipient of suggestive language or innuendo by an employee, the person in authority must put a stop to it. 8. In most cases, employers should not take disciplinary action against the person who is not in authority, as this could lead to a charge of “retaliation,” which is a separate charge, standing alone, even if no other discrimination or harassment has occurred. 9. P.T. Barnum once said, “Never overlook the obvious,” so picking up on P.T.’s advice, persons in authority should not ask for or require sexual favors from employees and should not force themselves sexually on other employees and should not condition continued employment or improved employment on receiving a sexual favor. Above all, this is the time to conduct Sexual Harassment Awareness and Prevention Training. We recommend this training for all employees every 18-24 months but, in the current active environment, we recommend it for managers, supervisors, department heads and professionals immediately. This is a service our firm provides and it can save you a ton of money in terms of avoiding sexual harassment claims. We should point out that sexual harassment is not the only kind of harassment that the employment regulations prevent. Harassment on the basis of age, ethnicity, religion, race, or any of the protected categories is also prohibited. But, sexual harassment is in the spotlight right now.
