Welcome to FRSA’s 95th Annual Convention and Expo This edition of FRSA’s magazine, Florida Roofing, is our Convention and Expo issue and contains valuable information on the events planned for next month. I encourage you to set aside time to visit the Expo, speak with vendors and find out what’s new in the industry, not only where products and services are concerned, but with new information contained in many of the seminars. The Sixth Edition 2017 Florida Building Codes goes into effect on December 31, 2017. During the Convention, you’ll have three opportunities to attend a two-hour seminar outlining the new code changes specific to Chapter 7 Existing Building, Chapter 9 Residential Building and Chapter 15 Building. Last year, Florida passed a bill allowing the use of marijuana for medicinal purposes. Do you know how this will affect you as an employer? Do you have policies in place to provide a safe work environment? What are your rights as an employer? And more importantly, how will medical marijuana affect your workers’ comp policy? We have three seminars addressing these topics. Keeping your workforce safe is one of your key responsibilities as an employer. There will be seminars on fall protection, worker safety and hazard communication, along with many other seminars addressing items of concern for a contractor. See the center section of the magazine for specific topics and times. We’ve also added a TPO seminar conducted by industry-expert Helene Hardy-Pierce of GAF (not listed on schedule). This seminar will be held on Friday and is free. We encourage you to bring your supervisors or foremen. If you don’t need continuing education (CE) credit, seminars are free to attend. Make the most of your time at the Convention and attend as many seminars as possible. As a reminder, rates for full Convention registrations and the sports tournaments increase on May 22, so if you’re planning on attending, please be sure to register prior to that day. The host hotel, the Hyatt Regency Orlando, will also close our room block on May 22 or when sold out – whichever comes first. If you’d like to stay in the Hyatt Regency, please make your reservations soon. The April Board of Directors and Committee meetings took place two weeks ago and all committees moved forward with full agendas. The Codes and Regulatory Compliance Committee approved a document drafted by FRSA Legal Counsel Trent Cotney for FRSA contractor members to place in their contracts regarding sealed attics exclusions, and the committee is currently working on an FRSA position statement against sealed attic systems. These documents can be found on FRSA’s website, www. floridaroof.com, under Code Updates in the “Member’s
Login” section. The Roof Tile Committee is continuing their work on updating the Fifth Edition FRSA-TRI High Wind Concrete and Clay Roof Tile Manual. Any suggestions for changes should be sent to Lisa Pate at FRSA. The Young Professionals Council is sponsoring a drone update seminar at the Convention and invite all Young Professionals to attend. They’ll also be hosting a networking session on the expo FRSA President George Ebersold, floor on Friday in the lounge Tom Tanenbaum Roofing Inc, Orlando area. The Young Professionals will have a photo booth at the Welcome Reception and will be handing out favors to prospective members. Stop by and sign up to be part of this exciting group – the leaders of the future. The Affiliate Council groups will be “Building for the Future” by creating displays on the show floor using canned goods and nonperishable food items, which will be donated to a local food bank after the show. 2017 will mark the last time FRSA’s Expo will be held on a Saturday. Going forward, the Expo will be held on Thursday and Friday. Join us on the show floor as we bid farewell to Saturday show days and enjoy a Mimosa or Bloody Mary. A Guide to Politics in Tallahassee At this writing, we are halfway through the 2017 legislative session. By the time you read this, session will be over and we will know how the story ends (if it ends – we are expecting special sessions this year). But for now, I can share a little of what we see at work in Tallahassee. Our House, Senate, and governor are very strongly Republican. Much of this majority evolved from promises and assurances of being business friendly and of welcoming new industries to Florida – all to improve our economy and bring jobs, jobs, jobs to our state. One of the most important components of a business-friendly climate is the tax and regulatory environment of any state. One of the best measures is how a state handles the type of litigation that regularly can and does put a company right out of business. Typically, politicians who are business-friendly are against excessive litigation that comes from trial lawyers, too many of whom file lawsuits like gamblers roll the dice. So, what happens when Florida’s House and Senate leadership comes from two people who are Republican trial lawyers? We can see the answer by the handling of legislation that is intended to keep Florida from turning into a world of litigation gone wild. First, they look for an “attractive enemy” that can be blamed for all the problems that need to be solved. What does that mean? Well, if you have campaigned on a business-friendly platform but you are actually trial lawyer-friendly, you will not support anything that hurts trial lawyers but you cannot be seen as claiming that business is the enemy. For most purposes, the best attractive enemy is the insurance industry. The business community has a love/hate relationship with insurance – we need it and we are thankful for it when there is a problem but we hate the cost of premiums. The trial lawyer community has a hate/ love relationship with insurance – they hate being questioned or challenged on a claim or lawsuit filed but they love the fact that insurance is in place for the big payoff. Second, they make sure to give plenty of discussion time to any legislation so that no one can ever say that big issues (like workers’ comp or medical malpractice reform) were swept under the rug. Keep in mind that discussion time does not equal action. If there is no solution at the end of the discussion, then it was nothing more than talk. Third, they may try to propose something that looks like a solution but actually is or includes a “deal killer” for the business community and/or insurance industry. One would use this tactic to make oneself look like the problem solver and the other side look like the naysayer, but it is really all just smoke and mirrors. Variations on this scheme would be proposing something that would be a great solution but adding a “poison pill” or proposing something that 10

sounds like a big improvement but is really so small it would not fix much. Fourth, they look to see what the other chamber (the House or the Senate) is doing and try to come up with a strategy for failure that depends on the action or inaction of the other chamber. Keep in mind that any change has to be approved exactly the same by the House, the Senate, and the governor. An example of a strategy for failure is when it is pretty clear that the Senate will not accept any changes, then the House can propose something really good, pass it, and come out looking like a real hero to business knowing all along that the changes will not be made because the Senate will do nothing. There are hundreds of variations on this strategy, and there are at least 30 people in the House and Senate who know how to work this. Right now, this whole set of dynamics has a big impact on us and other types of businesses. It affects a long list of important issues, including workers’ compensation, assignment of benefits (AOB) abuse, construction defects, statute of repose, and general liability matters. The immediate threat to business is the cost of insurance but it is also the availability of insurance (as things get worse, it is likely that insurers will leave Florida). I am sure that some legislators would like to hide behind the position that these are just business issues and as such are not the responsibility of the legislature. That sounds nice but it is absolutely not correct when it comes to the types of insurance you must have: workers’ compensation. Insurance coverage that is required by law is as good as a tax that is imposed by the elected members of the legislature and the governor. I am pretty sure that we will be playing this whole game again during the 2018 legislative session, so you may want to keep this little “guide to politics” handy because we will use it again. Ponding Water and Manufacturer Warranties Ponding water can be a problem on roof systems and a routine justification for non-payment. Standing water can degrade roof materials, cause the collection of debris and muck and increase the UV degradation by focusing sunlight through water to the roof system. It is usually caused by problems in the roof deck, lack of or improper roof drains or scuppers, damaged insulation or materials, and improperly flashed rooftopped HVAC units or vents. Ponding water is commonly defined as water remaining on the roof 48 hours after a rain during conditions conducive to drying. Most building codes, manufacturer warranties, and roof association guidelines call for commercial roofing systems to provide positive drainage to allow for water to drain from the roof and prevent the ponding of water. Ponding water, over time, can lead to an accelerated aging of the roof membrane causing leaks, growth of algae and vegetation, as well as potentially causing a roof to fail from excessive standing water weakening the roof deck. The International Building Code states that a minimum slope of 1/4:12 is required for membrane roof systems on low-slope commercial buildings. Similarly, NRCA recommends that roof systems be sloped to provide positive drainage for a finished roof system. Proper slope for drainage is achieved when there is no ponding water on the roof 48 hours after
a rain during conditions conducive to drying. It is interesting to note that NRCA’s definition is based primarily on Midwest conditions where lower humidity and higher winds may be a factor. The Florida Building Code has multiple provisions which govern ponding water (special thanks to Mark Zehnal): 2014 FLORIDA BUILDING CODE SECTION 202 DEFINITIONS POSITIVE ROOF DRAINAGE. Exception: Reroofing shall not be required to meet the minimum design slope requirement of one-quarter unit vertical in 12 units horizontal (2-percent slope) in Section 1507 for roofs that provide positive roof drainage. SECTION 1611 RAIN LOADS 1611.1 Design rain loads. Each portion of a roof shall be designed to sustain the load of rainwater that will accumulate it if the primary drainage system for that portion is blocked plus the uniform load caused by water that rises above the inlet of the secondary drainage system at its design flow. The design rainfall shall be based on the 100-year hourly rainfall rate indicated in Figure 1611.1 or on other rainfall rates determined from approved local weather data. Roofs equipped with hardware to control the rate of drainage shall be equipped with a secondary drainage system at a higher elevation that limits accumulation of water on the roof above that elevation. Such roofs shall be designed to sustain the load of rainwater that will accumulate on them to the elevation of the secondary drainage system plus the uniform load caused by water that rises above the inlet of the secondary drainage system at its design flow determined from Section 1611.1. Such roofs shall also be checked for ponding instability in accordance with Section 1611.2.

roof perimeter construction extends above the roof in such a manner that water will be entrapped if the primary drains allow buildup for any reason. 1108.2 Separate systems required. Secondary roof drain systems shall have the end point of discharge separate from the primary system. Discharge shall be above grade, in a location that would normally be observed by the building occupants or maintenance personnel. 1108.3 Sizing of secondary drains. Secondary (emergency) roof drain systems shall be sized in accordance with Section 1106 based on the rainfall rate for which the primary system is sized in Tables 1106.2(1), 1106.2(2), 1106.3 and 1106.6. Scuppers shall be sized to prevent the depth of ponding water from exceeding that for which the roof was designed as determined by Section 1101.7. Scuppers shall have an opening dimension of not less than 4 inches (102 mm). The flow through the primary system shall not be considered when sizing the secondary roof drain system. Given the many provisions that affect ponding water conditions in Florida, a roofer should carefully review and consider code requirements before responding to a disgruntled customer. The fact that a roof has initially passed building department and manufacturer inspections does not relieve the roofer of liability from failing to adhere to Florida Building Codes. See Florida Statute 553.84 (creating a civil cause of action for building code violations). The typical commercial roof manufacturer’s warranty requires that the roofs have positive drainage and follow NRCA guidelines, or excludes failure of the roof membrane caused by lack of positive drainage. Other roofing manufacturers have “birdbath measurements” that discuss the allowable surface area for ponding water. Roofing manufacturers who provide warranties that either call for only positive drainage, or refer to NRCA guidelines, can lead contractors to believe that the warranty requirements are all that need to be met. This creates issues when the local building code conflicts with less stringent manufacturer requirements. Contractors may install a roof that is covered by the manufacturer warranty, but that
fails a ponding water inspection using Florida Building Code guidelines. Ponding water is always difficult to anticipate because ponding is in large part, determined by the deck and overall roof geometry. Repair or replacement of a portion of the roof may change that geometry thereby creating ponding water. To mitigate or eliminate ponding water, there are a variety of techniques that can be used. First, the installation of scuppers, roof drains or gutters to move water off the roof; second, the use of a tapered insulation system, insulation fill, cricket or similar technique to adjust roof geometry to allow water to flow off the roof; and third, adjust or modify the roof deck to eliminate ponding. While there may be other methods to eliminate ponding, including the use of some coatings, these three methods are the most prevalent. Roofing contractors cannot “contract” away the building code requirements, nor can they rely solely on a manufacturer’s warranty in the event they have ponding water that exceeds allowable tolerances. However, contract terms can be added that provide that ponding water may be unforeseeable and that the roofing contractor’s customer acknowledges that the cost to remediate ponding water is an extra, compensable charge. Industry Updates FRSA Welcomes Two New Employees
We’re excited to welcome two new employees to the FRSA team, Kelsey O’Hearne, Office Manager and Thom Combs, Technical Director. Kelsey is from Massachusetts, and relocated to Orlando in the spring of 2016 to participate in the Disney College Program. She is a 2016 graduate of Western New England University, in Springfield, MA, after completing her studies and earning a Bachelor of Science degree in Business Administration. In addition to her role as Office Manager, she will take on the responsibilities of social media, database management and assisting Executive Director Lisa Pate and Director of Convention and Expo Cheryl Sulock in their duties. “I am thankful for this new opportunity with the FRSA as their Office Manager, and looking forward to what’s to come,” stated Kelsey. Pate noted “FRSA’s Convention and Expo are next on our agenda and we’re very pleased to have Kelsey on board. She’s friendly, smart, a quick study and has a personality that meshes well with our staff and members!” Thom Combs joins the FRSA team as Director of Technical Services. Thom currently resides in Syracuse, Indiana with his wife of 41 years, but will be relocating to Winter Park, Florida within the year. Father of two and grandfather of
two-and-a-half grandchildren, he is a fan of Notre Dame football. Other interests include fishing, hunting, good food, and of course BBQ. Thom studied at Indiana University, Bloomington and was attached with the 122 tac Indiana Air National Guard for six years. Two years ago Thom was the owner and president of a roofing and sheet metal company for 28 years, where he was involved in commercial and residential roofing, manufacturing of metal roof panels, retained by architects and roof consultants to provide roof inspections, has appeared on several occasions as an expert witness, and aided major manufacturers on options with new materials and details. Thom also wrote computer estimating programs and safety guide lines. Recently asked if he had ever worked on a roof and the answer was “yes,” followed by, “Are you asking me if I ever hot mopped, the answer was yes.” “Kelsey and Thom complete the FRSA team and we’re excited with the potential they bring to our group,” stated Pate.

Mike Rowe Foundation Recognizes Jacksonville Roofing Company for Teaching Program
FRSA member, Reliant Roofing Inc., Jacksonville, was recognized by “Dirty Jobs” star Mike Rowe’s foundation for its teaching program. Sean Shapiro and his partner, Cameron Shouppe, of Reliant Roofing, Inc., were having a hard time finding enough skilled roofers for their projects, so they did something rather unusual. They started teaching people how to roof. First, they bought a vacant house in foreclosure. Then they scoured Jacksonville looking for people to hire. Sean said, “We look for anyone with good soft skills and work ethic, not necessarily skills in roofing.” Sean believes that anyone with a desire to work and learn can be taught how to roof. And if anyone can teach them, it’s Camilo Calle. Camilo is one of Reliant’s most skilled roofers. He takes the new hires and teaches them roofing by roofing and reroofing the vacant house. “The neighbors think we’re crazy,” said Sean, “They wonder why we’re roofing every day.” It’s a 4-to-8 week program that teaches people how to roof by roofing a real roof. Here’s the best part – the students get paid to learn. And once they pass the class, they get put on crews and sent out into the real world to roof real roofs. Sean is serious about helping close the skills gap. He speaks about his experience to anyone that will listen, “I want to inspire other businesses to do the same thing.” Wouldn’t that be great?

The profile can be used in TPO, EPDM and PVC roofing systems and is not sensitive to membrane thickness. EclipsEdge is not fastened to the horizontal surface of the roof, so there are no fasteners to seal with membrane flashing. There is no need to install a continuous clip when the face dimension exceeds 4 inches. The ends of the top cover are notched for easy overlapping, eliminating the need for joint covers.
OSHA Delays Silica Rule
The U.S. Occupational Safety and Health Administration will delay enforcement of its silica standard for the construction industry. The Occupational Exposure to Respirable Crystalline Silica rule reduces the permissible exposure limit for crystalline silica over an eight-hour shift to 50 micrograms per cubic meter of air for the construction industry, one-fifth of the previous maximum. The agency announced it would delay enforcement of the rule, scheduled to begin on June 23, to September 23, 2017 because of the need to provide additional guidance on the silica rule’s requirements for the construction industry. “OSHA expects employers in the construction industry to continue to take steps either to come into compliance with the new permissible exposure limit or to implement specific dust controls for certain operations as provided in Table 1 of the standard,” the agency said. “Construction employers should also continue to prepare to implement the standard’s other requirements, including exposure assessment, medical surveillance and employee training.” The silica rule provides guidance commonly referred to as Table 1 outlining exposure control methods for selected construction operations, with employers who follow these methods are not required to measure workers’ exposure and not subject to the permissible exposure limit. The silica rule is also the subject of an ongoing legal challenge.
Using the EclipsEdge provides the same aesthetics from the ground as traditional coping cap installations while using a fraction of the metal. It also eliminates the need to measure and fabricate copings, and then return to the jobsite to complete the job. Fastener holes are pre-punched for quick installation. EclipsEdge can be installed using battery-operated equipment. EclipsEdge complies with ANSI/SPRI ES-1, “Wind Design Standard for Edge Systems Used with Low Slope Roofing Systems.”
iCheckContractors Launching to FRSA Members
iCheck is an online service that instantly verifies Florida contractors’ professional license, workers’ comp coverage and corporate status using government data in real time. It’s like the “CarFax of Contractors” because it takes the guesswork out of credentials. This benefits legitimate contractors who often lose jobs to unlicensed and uninsured workers. For $250 a year, FRSA members will receive unlimited iCheckContractor reports that they can share with potential customers. They simply insert the link provided to them on their proposals (and even on their website), and their customers can instantly verify license and insurance compliancy. For an additional $250 a year, contractors will be listed on iCheckContractor’s “find a contractor” page, which notes contractor support of upholding professional standards. Listings will be linked to their company and also note the locations they work.

SPRI addressed roof gutters in 2010 with the development of ANSI/SPRI GD-1. This document was recently separated into two different standards, a test standard and a design standard. The test standard, GT-1, “Test Standard for Gutter Systems,” was approved as an American National Standard on May 25, 2016. Similarly, SPRI has separated ANSI/SPRI/FM4435/ES-1 into two separate documents, a Test Standard and a Design Standard. Both standards will be a reference for those who design, specify, manufacture, test or install edge materials used with low-slope roofing systems. Separating both standards (ES-1 and GD-1) into standalone design and testing documents will make it easier for designers, contractors and building code officials to consult the specific design or testing requirements needed for a particular roofing project. IBC requires that perimeter edge metal (fascia and coping), excluding gutters, be tested per three test methods, referred to as RE-1, RE-2 and RE-3 in the ES-1 standard. The design elements of ES-1 were never referenced in code, which caused some confusion as to how ES-1 was to be applied. The latest version of ES-1 (2017) only includes the tests referenced in code to eliminate that confusion. Test methods in ES-1 2017 have the same names RE-1, RE-2, and RE-3, and use the same test method as ANSI/SPRI/ FM 4435/ES-1 2011. Because there are no changes to the test methods, any edge system tested to the 2011 version would not need to be retested using the 2017 version. FM Global’s input was instrumental in the changes in 2011 when ANSI/SPRI ES-1 incorporated components of FM 4435 to become ANSI/SPRI/FM 4434/ES-1. However, there are no additional FM related changes in the latest ES-1 standard. Per ANSI requirements, ANSI/SPRI/FM 4435/ES-1 2011 needed to be reballoted, which is required by ANSI every five years. SPRI took this opportunity to have it approved as a test standard only to eliminate the confusion referenced above. FM Global was consulted and indicated it wanted to keep “FM” in the title. (FM was on the canvas list for the test standard and actually uses it as its own test standard.) The design portions of ES-1 and the GD-1 gutter standard have been combined and are now referenced by SPRI as ED1. It is currently being developed as an ANSI standard that will provide guidance for designing all perimeter edge metal including fascia, coping, and gutter. ED-1 will be canvassed per the ANSI process later this year. SPRI is not planning to submit ED-1 for code approval.
Using the GT-1 Standard to Your Benefit
Testing of gutters in not currently required by IBC, and is not required in FL. However, field observations of numerous gutter failures in moderate to high winds, along with investigations by RICOWI following hurricanes have shown that improperly designed or installed gutters frequently fail in high wind events. GT-1 provides a test method that can be used by manufacturers of gutters, including contractors that brake or roll form gutters, to determine if the gutter will resist wind design loads. Installing gutters tested to resist anticipated wind forces can give contractors peace of mind, and may provide

a competitive advantage when presented to the building owner. GT-1 tests full size and length samples (maximum 12’-0”) of gutter with brackets, straps, and fasteners installed per the gutter design. It is critical that the gutter be installed with the same brackets, straps, and fasteners, at the same spacing and locations as per the tested design to assure the gutter will perform in the field as tested. The contractor should also have the manufacturer label the gutter and/or provide documentation that the gutter system has been tested per GT-1 to resist the design loads required. The ANSI/SPRI GT-1 test standard was developed by SPRI and received ANSI Approval in May of 2016, as noted above. GT-1 consists primarily of three test methods, G-1, G-2 and G-3. Test method G-1 tests the resistance to wind loads acting outwardly on the face of the gutter, and G-2 tests the resistance to wind loads acting upwardly on the bottom of the gutter. G-3 tests resistance to the loads of ice and water acting downwardly on the bottom of the gutter. Tests G-1 and G-2 are cycled (load, relax, increase load) tests to failure in both the original GD-1 standard and the new GT-1. The only change being that in GD-1 the loads are increased in 10 lbf/ft2 increments from 0 to failure, and in GT-1 they are increased in 15 lbs/lf increments from 0 to 60 lbs/lf, then in 5 lbs/lf increments from above 60 lbs/lf to failure. Note also that the units changed from lbf/ft2 to lbs/lf, which was done so that the tests could be run using the test apparatus loads without having to convert to pressures. The GT-1 standard specifies a laboratory method for static testing external gutters. However, testing of gutters with a circular cross-section is not addressed in the standard, nor does the standard address water removal or the water-carrying capability of the gutter. In addition, downspouts and leaders are not included in the scope of the standard. SPRI intends to submit ANSI/SPRI GT-1 for adoption in the next IBC code cycle. The Perils of PEO’s for Florida’s Construction Industry Karen Phillips, General Counsel for FUBA Workers’ Comp, and Brett Stiegel, FRSA Self Insurers Fund Administrator Under Florida’s workers’ compensation law, companies working in the construction industry can be held liable if they hire subcontractors who do not have proper workers’ compensation insurance to cover all their employees. In Florida, everyone on a construction job site is required to be covered by workers’ compensation insurance or have a valid workers’ compensation exemption issued by the Division of Workers’ Compensation. If a subcontractor without proper workers’ compensation insurance for all his/her employees comes onto a job site, and one of the sub’s employees gets hurt, the responsibility for that injury falls on the contractor who hired the sub, and the contractor’s workers’ compensation insurance company can be held responsible for paying for the worker’s medical care and lost wages. This scenario isn’t a problem when a contractor subs out to a company with a valid workers’ compensation policy issued by a traditional workers’ compensation carrier. The subcontractor’s policy will take care of all workers the subcontractor brings to the job site, even if it’s just for one day or even one hour. However, when a contractor subs out to a subcontractor who receives workers’ compensation insurance through a PEO/employee leasing

arrangement, it’s a very different scenario, and one that leaves the contractor (and their insurance company) very exposed.
How?
When a company signs up with a professional employer organization (known as a “PEO”), that company’s employees are technically no longer employees of that company; they become “employees” of the PEO. While the employees still report to work at the same place, their payroll checks now come from the PEO. The PEO also assumes the responsibility for providing workers’ compensation coverage for these employees through the PEO’s workers’ compensation carrier. Under this arrangement, the PEO is the actual policyholder; the employer itself (the subcontractor in our example) is not insured by the PEO’s carrier and does not have its own workers’ compensation insurance policy. This type of situation can create a PEO “coverage gap.” The coverage gap can occur when the subcontractor hires new employees but doesn’t timely report them to the PEO. Because the PEO is now the employer, the PEO’s contract with the sub can state that workers’ comp coverage only exists for “employees” listed on its contract with the sub. The subcontractor is still free to hire new workers, but any new workers will not be “employees” covered by the PEO until they are specifically reported to the PEO. It is possible that the subcontractor could hire a new worker on Monday, put him or her right to work, but not send the paperwork to the PEO about the new hire until Monday afternoon. If that new worker gets hurt on the job before the PEO knows about him/her, the PEO’s workers’ compensation policy will not cover that new worker. That forces the injured worker to seek payment for his/her medical bills and lost wages from the contractor who hired the sub, even though the sub had “coverage” through the PEO. It’s the same situation for any casual labor or uninsured subcontractors that the subcontractor hires. Because these people are not considered “employees” by the PEO, the PEO does not provide workers’ comp insurance to them and will not pay if one of them is hurt on the job. So, if a contractor hires a sub whose workers’ compensation is through a PEO, the contractor will be on the hook in all the scenarios described above: if the subcontractor hires a new worker but doesn’t report him/her timely to the PEO; if the subcontractor hires casual labor without insurance or an exemption; or if the subcontractor contracts with an uninsured subcontractor. If any one of these workers suffers an injury on the job, the subcontractor has no workers’ comp policy and their PEO’s policy will not cover them. This means the contractor’s workers’ comp policy will have to step in and pay for these injuries, and it
also means that the contractor will owe additional premium to their insurance company for that exposure. If the subcontractor were directly insured by a traditional workers’ compensation policy, all of these workers would be covered, thus the existence of the PEO coverage gap. Another potential issue with hiring subcontractors who have a PEO arrangement is that the subcontractor’s workers’ compensation insurance can be cancelled at any time and without much notice. Because they are not providing insurance, PEO’s are not subject to the same cancellation notice provisions that traditional insurance companies are subject to. Traditional insurance companies have to give their policyholders advance notice before they cancel a policy – 10 days’ notice if the cancellation is for not paying premium, 45 days’ notice of non-renewal, etc. However, the PEO, because it is not an insurance company, does not have to comply with these notice provisions. The PEO can give immediate notice that they are cancelling the contract, which also cancels the subcontractor’s workers’ comp insurance. A subcontractor whose workers’ comp insurance can be cancelled at any time with short notice brings a lot of potential exposure to a contractor hiring that sub. If the sub’s insurance is cancelled, all the employees/casual labor/uninsured subs for that sub become employees of the contractor who hired the sub. Which means the contractor will be billed for premium for all that payroll and their insurance company will be on the hook for all on-the-job accidents. Contractors who rely on a Certificate of Insurance showing a subcontractor’s PEO arrangement need to understand that the subcontractor itself is not insured and is not provided the coverage referenced on the Certificate of Insurance. The Certificate is only for the PEO’s coverage and does not cover workers hired by the sub the PEO doesn’t know about, casual labor, or uninsured contractors. And contractors need to be aware that this “coverage” can be cancelled with very little notice, leaving them with a lot of exposure. PEO’s provide services for many small employers they might not otherwise have access to, such as weekly payroll processing and access to group benefit plans, and the segment of the Florida workers’ compensation marketplace who turn to PEO’s is growing. The Roofing Industry Alliance for Progress 2016-17 Construction Management Student Competition Bennett Judson, NRCA, Executive Director, The Roofing Industry Alliance for Progress, Vice President, NRCA Meeting Services The Roofing Industry Alliance for Progress (Alliance) held the oral presentations for its third Construction Management Student Competition on Thursday, March 2, during the 2017 International Roofing Expo in Las Vegas. A total of six teams presented – McWhorter School of Building Sciences at Auburn University, Colorado State University, the Bert S. Turner Department of Construction Management at Louisiana State University, Tuskegee University, the University of Cincinnati and the M.E. Rinker Sr. School of Building Construction at the University of Florida. The teams had been presented with a problem statement and tasked with submitting a qualified bid package for installing a roof system on the T-Mobile Arena in Las Vegas. Their written proposals were submitted in December 2016. The teams were asked to present their companies’ proposals as they would be presenting to the project’s owner and general contractor responsible for selecting the roofing contractor for the project. Each team was assigned a roofing contractor in their area to serve as their mentor. Auburn University was mentored by Kyle Thomas, Vice President of Thomas Roofing Co. Inc., Mobile, Ala.; Colorado State was mentored by Pat Wolack, Executive Vice President, Douglass Colony Group, Commerce City, Colo.; Louisiana State University was mentored by Tupac De La Cruz, owner of Roofing Solutions LLC, Prairieville, La.; Tuskegee University was mentored by Bruce McCrory, Operations/Business Development Manager, Nations Roof, Mobile, Ala. and Rich Nugent, President, Nations Roof, Lithia Springs, Ga.; the University of Cincinnati was mentored by Paul Novak, Project Manager, Kalkreuth Roofing and Sheet Metal, Lewis Center, Ohio; and the University of Florida was mentored by Rob Springer, CPRC, President, Springer-Peterson Roofing and Sheet Metal Inc., Eaton Park.
The teams presented before a panel of seven judges consisting of: Mitch Bernard, Project Executive for The PENTA Building Group, Inc. in Las Vegas; John Geary, Industry Consultant, Indianapolis, Ind.; Helene HardyPierce, Vice President of Technical Services, Codes, and Industry Relations for GAF, Parsippany, N.J.; Henry Jojola, Quality Assurance/Quality Control Manager for PENTA Building Group, Las Vegas; Scott Kawulok, Executive Project Manager for B & M Roofing, Frederick, Colo.; Todd Nathan, Director of Technical Services with Johns Manville, Denver; and Bob Pringle, Vice President of Evans Roofing Company, Inc. located in Elmira, New York. The teams were judged on the overall quality of their written proposals, project management and organization, feasibility of construction and program schedules, accuracy/feasibility of conceptual costs, quality of safety and quality control/quality assurance plans, supplemental, overall quality of their oral presentations, feasibility of project management, organization and schedule, accuracy and completeness of project costs and answers to questions. The team with the highest cumulative score was the University of Florida for their presentation as Orange South Construction. A few elements that set the University of Florida team ahead of the other teams were a thorough understanding of the project; their presentation was very well prepared, the team was articulate and concise; their safety, quality control/quality assurance plans were well presented; they were very prepared for the judges’ questions, they did a nice job answering specific questions – it was clear they had a good handle on the project, they had a thorough understanding of their site logistics and schedule, they had a strong safety plan which included planning, training and execution and they spent a great deal of time preparing their presentation. The University of Florida team consisted of Caleb Stauss, President and team captain; William Foster, Project Manager; Schaffer Weeks, Project Manager; and Forrest Wilson, Safety Manager. Bennett Judson is executive director of The Roofing Industry Alliance for Progress (Alliance) and vice president of meeting services for NRCA. As executive director for The Alliance, she oversees the day to day operations of The Alliance and its programs/projects. As vice president of NRCA’s meeting services section, she coordinates NRCA’s smaller meetings and NRCA’s convention events held in conjunction with the International Roofing Expo. She holds a bachelor’s degree in business management from Roosevelt University.
