In addition, there will be opportunities to attend live product demonstrations and earn continuing education credit for state licensure at the numerous educational sessions being offered at the Convention. There is a frequent misunderstanding of the role of the Construction Industry Licensing Board (CILB) in dealing with unlicensed activity at the state level. Generally speaking, the licensing board has no role in dealing with true unlicensed activity. That job belongs to the Department of Business and Professional Regulation’s (DBPR) Division of Regulation. It’s tempting to think that since most CILB members are licensed, they would be more motivated than “general” DBPR investigators to stamp out unlicensed activity. That is true until it is not. While it is true that CILB members most likely have more expertise in recognizing unlicensed activity, that is beneficial so long as each member can refrain from bias and no member allows self interest to direct his or her vote or other actions. True Unlicensed Activity True unlicensed activity is work performed by a person who has no license at all, as opposed to a person who has a license but is performing some type of work beyond that license. This is called operating beyond the scope of a license and can happen in two ways: 1. Performing a task that requires a license that is not the license held by the person doing the work; 2. For local (registered) licenses, performing work outside of the geographic area for the license, such as working in Hillsborough County with a Pinellas County license.

The person who already has a license can likely be disciplined under his or her existing license for operating outside of the scope of that license. If you depend on your license for your livelihood, this is a big risk most licensees would not be willing to take. The completely unlicensed person, on the other hand, has no license to lose. This person may not be able to qualify for a license, in which case breaking the licensure laws probably does not matter to them at all. Also, unlike licensees, unlicensed contractors are not required to maintain their current contact information with DBPR or the CILB, so there is usually a “catch me if you can”
element to fighting true unlicensed activity. Considering this and the fact that resources to combat unlicensed activity are limited, what do you think should be the priority for investigation and prosecution by DBPR and/or CILB? If you answered “chasing the truly unlicensed contractors,” you are correct.
The Preferred Choice of Roof Vacuuming
Investigating and Prosecuting Licensed Contractors If you see that the CILB is pushing for DBPR to investigate and prosecute a licensed contractor for operating beyond the scope of his or her license, extra scrutiny is in order since all licensee board members should (if honest and serving for all the right reasons) realize and agree that the priority for the construction industry is to stop truly unlicensed contractors, not licensees who are willing and are trying to play by the rules. Persons contracting for work that requires a license without a license send the message that they don’t care about playing by the rules. This likely means they also don’t care about giving the customer a fair result. That’s a formula for cheating and stealing and stopping it deserves the full attention of those responsible for investigating and prosecuting unlicensed contractors. Dedicated to the Roofing Industry with Dealing with a licensed contractor operating beyond the scope of his license is a more complicated picture for a a full line of Roof Vacuuming Services: number of reasons. First, it takes some time and thought to determine whether or not the licensee is actually engaging in unlicensed activity. There are many tasks that are included in more than one licensure category. There are plenty of instances where you think you understand the written word in the law but the task described may have more than one meaning or may be easily misunderstood by non-licensees (such as lawyers or licensure board FREE QUOTE members) or persons licensed in a different category. TAMKO Building Products: A History and a Future of Continuous Improvement What began as one small shingle plant in an old streetcar barn has grown into one of the largest roofing manufacturers in the U.S. with 12 plants and 13 distribution centers nationwide. And this year, TAMKO Building Products, Inc. celebrates the major accomplishment of 70 years of success in the building products industry. The TAMKO story is one of American entrepreneurialism, resilience and the belief that there is always room for improvement. In 1944, 69-year-old E.L. Craig sold his share of a Kansas City shingle plant and moved to Joplin, Mo. to start his own roofing business. By this time, Craig had already started, built and sold a number of other businesses, including a soup kitchen, boxing parlor, poker room, confectionary shop, a construction and demolition business and several rental properties. “My father was the kind of man who knew that unless he took a risk, he wasn’t going to reap many benefits, and that’s essentially what he did all of his life,” said Ethelmae Craig Humphreys, TAMKO chairman of the board and daughter of founder E.L. Craig.
On September 5, 1944, Craig renamed the new business TAMKO in honor of the five states he expected his sales territory to consist of – Texas, Arkansas, Missouri, Kansas and Oklahoma. Seventy years later, Craig would be pleased as TAMKO has grown into one of the largest privately-owned roofing manufacturers in the United States. “This is a very important milestone for us personally and for the entire TAMKO family,” said TAMKO President and CEO David Humphreys, grandson of the company’s founder. “This year we celebrate our ability to survive, grow and be profitable year after year when dozens of other roofing companies have not.” Surviving and Thriving Over the years, TAMKO has survived and thrived in the midst of personal, industry and economic ups and downs. In 1954, the health of the TAMKO’s founder began to fail. Still in its infancy, the company passed into the capable hands of Craig’s wife, Mary Ethel, and then to his daughter Ethelmae a few years later. Ethelmae Craig Humphreys continues as TAMKO’s chairman today, celebrating more than 65 years with the company. In 1956, Ethelmae’s husband, J.P. (Jay) Humphreys, joined the company and in 1960 became TAMKO’s president. Over the next 33 years, Jay Humphreys led TAMKO’s growth and success with his entrepreneurial vision for TAMKO to rise to national prominence with the addition of manufacturing plants in Phillipsburg, Kansas (1969); Tuscaloosa, Alabama (1974); Knoxville, Tennessee (1978); Frederick, Maryland (1978); and Dallas, Texas (1985). In addition, Jay Humphreys’ recognition of the breakthroughs possible with the continuous quality improvement principles of Dr. W. Edwards Deming laid the foundation for TAMKO’s success today. Family leadership of the company continues today with Jay and Ethelmae’s children. Their daughter, Sarah Atkins joined TAMKO in the 1980s and has served in a number of positions such as research analyst in TAMKO’s R&D department, commercial roofing sales and most importantly, in the implementation of Deming Total Quality Management training throughout TAMKO’s facilities. Today, Sarah continues as a TAMKO board member, training consultant and a key participant in the company’s strategic planning. Following Jay’s death in 1993, David Craig Humphreys (Jay and Ethelmae’s eldest son) assumed the role of TAMKO’s President and Chief Executive Officer. A New Generation Since 1994, TAMKO’s expansion has continued at a dramatic pace. The addition of new manufacturing plants expanded TAMKO’s production capabilities for additional organic roll products as well as asphalt cements and coatings at Green Cove Springs, Florida (1994); additional glass mat production at Ennis, Texas (1996); polyester mat, cements and coatings, TAMKO President and CEO David Humphreys, grandson of the company’s founder, with his mother, Ethelmae Humphreys, TAMKO chairman and daughter of TAMKO founder.

and waterproofing at Columbus, Kansas (1998); the MetalWorks® steel shingle production facility at Joplin High Street (2003) and many additions and modifications at existing plants to increase productivity for TAMKO 3-Tab shingles and Heritage® laminated shingles, the cornerstone in TAMKO’s residential roofing product line. In addition, TAMKO has pursued a strategy to achieve low-cost leadership through automation of many of its processes as well as vertical integration of TAMKO’s raw material needs. Beginning in 1999, TAMKO entered the plastic composite decking business with its purchase of composite manufacturing equipment in Lamar, Missouri. Since 1999, TAMKO has expanded its production of EverGrain® decking and added extruded railings to complement its decking product line. Continuous Improvement TAMKO has continued to build on the success of the Deming continuous quality principles with the launch of a comprehensive Six Sigma program across the company beginning in 2002. Six Sigma at TAMKO is a business strategy and management philosophy for the urgent pursuit of perfection to achieve increased profitability with a goal of near perfection.
In 1994, the company officially changed its name to TAMKO Roofing Products, Inc., and in 2006, the company changed its name once more to TAMKO Building Products, Inc. to better represent its growing product line. In the midst of such success, what makes TAMKO so unique is how the company has maintained its focus on quality and a small-town, family-owned business culture during decades of expansion. “I know my father would be proud of what this company has become,” said TAMKO Chairman Ethelmae Humphreys, daughter of TAMKO founder. “Our success has been possible because of the contributions of individual members of the TAMKO team over the years, as well as our customers who have been loyal throughout the years. Without them, this anniversary would not be possible.” Today, TAMKO remains headquartered where it began in Joplin, while operating manufacturing and warehouse facilities across the country in order to serve its customers across the nation. As part of its 70th anniversary celebration, TAMKO is producing a book detailing its history, in conjunction with author Jeff Rodengen and publisher Write Stuff Enterprises. “I believe we have something special at TAMKO; something unique both in the history of our family business and of the people that made it happen,” said David Humphreys, president and CEO. “It’s a great story of entrepreneurial success that’s worth telling and I’m excited to finally have it told in such a professional and complete way.” The book will be released later this year and features interviews with executives, employees, retirees, industry suppliers, TAMKO customers, historians and major competitors. It will also feature hundreds of historic photos of TAMKO employees, the Craig and Humphreys families, TAMKO construction, old documents, machinery, events and products, including some from the 1800s. The book will be available for purchase by the public after its release.

Awards Judges Meet The panel of three judges for the FRSA S.T.A.R., Spotlight Trophy for the Advancement of Roofing, Awards met in June to review the submissions received from FRSA member contractors. The judges are Brian DuChene, PE, of Terracon in Winter Park, Jim Brauner of REF in Orlando and Mark Zehnal, CPRC, of FRSA staff. Last year’s inaugural awards dinner and presentation showcased the premier projects of the best roofing and sheet metal contractors from around Florida. All licensees, all DBPR staff and all licensure board members should primarily focus on stopping unlicensed activity that comes from people who have no license at all. Every penny available to fight unlicensed activity should go toward this type of activity and nothing else. If anyone should ever find that a sitting member of a licensure board is using that position to try to prosecute licensed contractors for unlicensed activity when the accuser board member knows full well that not everyone agrees that a violation of law has occurred, all steps should be taken to remove that board member, possibly even prosecute that board member. Why? Because that board member is sending a very clear message: for him, killing his (or his colleagues’) competition is more important to

him than stopping the type of unlicensed activity that is clearly harmful to the consumer, hurts the industry and is a crime. Let me put this another way: a licensee board member who pushes to prosecute a licensed contractor who is his industry’s competitor is very obviously overstepping his authority, acting without integrity and has no place “serving” on a licensure board. It’s up to all of us: licensees, DBPR staff and CILB members to stay focused on eliminating truly unlicensed activity. Anything other than that is a selfish waste of time and we should all object to it.

CILB Registration Requirements for C.E. Seminars If you plan on earning continuing education (C.E.) credit at any of this year’s convention seminars (or any other FRSA Educational Foundation sponsored seminars throughout the year), you need to present your contractor’s license and valid picture identification when you check-in for each seminar. The Construction Industry Licensing Board (CILB) requires that “all training providers electronically transmit their seminar roster within 30 business days.” In order to receive your certificate, the seminar monitors must verify your contractor’s license and picture ID prior to each seminar. Refunds will not be given to those unable to produce the appropriate documentation. Licensed roofing contractors must earn 14.0 hours of C.E. credit every two years. Within the 14.0 hours there are six specific requirements that must be met: 1.0 hour Workplace Safety (WPS), 1.0 hour Business Practice (BSP), 1.0 hour Workers’ Compensation (WC), 1.0 hour Advanced Code (ADV), 1.0 hour Laws and Rules (L&R) and 1.0 hour in Wind Mitigation Methods (WMM). RC license holders must have their hours by August 31, 2015 and CCC license holders must have their 14.0 hours by August 31, 2014. Code Expert Jack Glenn Leaves a Legacy of Excellence The Florida construction industry is mourning the June 9, 2014 passing of Florida Home Builders Association (FHBA) Technical Services Director Jack Glenn, who died at his home in Melbourne. Glenn, 68, was a highly respected expert on the Florida Building Code and a strong voice to make the code more effective, efficient, and affordable in order to save costs for builders, their customers, and clients. After serving for 26 years as the City of Melbourne’s Building Official and Fire Marshal, Glenn joined FHBA on April 20, 1998. In addition to monitoring the building code and serving as a resource for builders and building officials, Glenn was an excellent instructor and taught numerous classes on the code around the state. “Our industry has lost one of its best friends,” said FHBA President Ron Lieberman. “Jack was totally dedicated to his job and virtually every builder I know has called on Jack one time or another with a code issue, and he always responded quickly and professionally. Jack’s legacy of excellence has been and will remain a huge source of pride to FHBA.” “Jack was an integral part of the evolution of the Florida Building Code,” said Richard Browdy, a Jacksonville builder and Chairman of the Florida Building Commission. “For over 22 years he enthusiastically participated in the code development process. He was an outstanding instructor in code education and a strong advocate for our consensus-building process. Jack was a colleague and a friend. His contributions to our efforts and his overwhelming presence will be sorely missed.” “Only a few months after becoming FRSA’s Executive Director I attended my first Florida Building Commission meeting,” said Lisa Pate, FRSA’s Executive Director. “Jack came up to me, introduced himself and offered his assistance and guidance with the code process.
