Careful Estate Planning for Retirees in Koh Samui and Phangnan Many long term foreign residents of Koh Samui and Koh Phangnan wrongly assume that the steps that they have taken in their home countries to deal with their estate in the event of their death is “water tight”. From our experience, this is seldom the case. Complex estate issues are often remedied by loved ones living thousands of miles from Thailand, trying to make sense of unfamiliar rules and regulations in a distant country which they may never have visited; and spending thousands of dollars of their own money to boot. The good news is that often, such issues can be avoided with some straightforward estate planning. Written by Paul D. Volodarsky of the law firm Limcharoen Legal
Paul Volodarsky, senior associate of the law firm Limcharoen Legal (Samui) sets out five simple legal tips to consider if you have assets in Thailand and wish to plan your estate wisely.
Have your Wills in Order People often assume that a Will executed in their home jurisdiction will protect assets located in other countries; however, this may not always be the case. According to international law, the distribution of immovable property such as freehold condominiums and villas is governed by the laws of the country in which that immoveable property is located. Conversely, the transfer of movable property such as jewellery and furniture is governed by the laws of the country in which the deceased was domiciled at the time of death. It is important to note that if an individual owns an interest in real estate through ownership of shares in a limited company, the asset which forms the subject matter of the will are the shares in the limited company and not the real estate assets themselves. In other words, shares in limited companies may be deemed to be moveable property and not immoveable property. Nonetheless, if you have any significant assets located in Thailand, it is recommended that you execute a valid Thai will. In the case of immovable property, if you die without executing a valid Thai Will, the assets forming the your estate will most likely be distributed according to intestate succession rules which stipulate that your property is distributed to the following people according to a set formula: spouse; children; parents; siblings; grandparents; aunts/uncles. Only true legally valid spouses are permitted to share in one’s estate according to intestate succession. Therefore, without a valid Thai Will, common law spouses and long-time partners will be totally disinherited of your Thai estate.

While the distribution of movable property located in Thailand may not be subject to Thai law, prudent practice nonetheless dictates addressing such assets in your Thai will. The issues of one’s “domicile” and the characterization of “immovable” and “movable” assets in the court system sometimes produce confusing and contradictory results. Addressing movable property in your Thai Will mitigates the risk that such property will be distributed by Thai intestate succession and does not create any additional risks or disadvantages. However, it is also highly recommended that you consult a lawyer in the jurisdiction of your home or domicile, in order to properly address any movable assets located in Thailand.

However, pursuant to section 374 of Thailand’s Civil and Commercial Code, you may include a clause written into any contract explicitly providing that your entitlements will pass onto your heirs. Therefore before entering into a long-term contract, such as a long-term lease, it is important to ensure that the contract contains a clause directing that your rights will pass to your heirs, the said clause should be carefully drafted in order to comply with Thai law.
Check your Corporate Structure
Subject to certain alternatives, in order to be valid, your Thai Will must be in writing, dated, signed, and witnessed by at least two other people, and should be executed within Thailand. While this process is relatively simply, you should retain a legal professional to advise you on your Will. The law pertaining to the interpretation and effect of Wills is complex, and requires adherence to specific language.
Careful corporate planning can ease the burden on your executor. For instance, depending on the circumstances, if you are the director of a company holding assets in Thailand, you may consider appointing your executor as co-director which will allow him or her to take over managing the assets easily after your death. It is very important that you seek advice from a competent professional before making any changes to your existing corporate structure, if any.
Select your Executor Wisely
Review Periodically
In your Will, you must appoint an “executor”, who will gather-up and distribute your assets when you die. It is generally imprudent to simply name a sibling or close friend as executor, simply because you trust that person. Often, the executor must come to Thailand, liaise with lawyers and Thai officials, and execute an abundance of Thai-language documents. This process can be overwhelming and costly. It is crucial that you carefully select an executor who will be up to the challenge; or if you do not know anyone who is fit for the challenge, you will have to consider other options, such as naming a law firm or another company to act as your executor. Fortunately, there are a wide range of options available to persons seeking professional or independent executors.

A founder of former software developer CyberPlanet Interactive Plc plans to launch a 700-million-baht villa project in Pattaya this year. The new project will be located on 10 rai in the Na Jomtien area and comprise 60 pool villas priced from 10 million baht apiece, said Chanin Vanijwongse. Mr Chanin shifted to property development two years ago and is now chief executive of new developer Habitat Five Co. The project will carry the brand name of Thai hotel chain X2, which will manage the property. "Property is real estate. It generates a higher margin than the IT business," said the former managing director of CyberPlanet. "Software development is an exciting venture, but trends change every two years. But with property, the longer you hold it, the higher it appreciates."
Chanin Vanijwongse, a founder of former software developer CyberPlanet Interactive, says property generates a higher margin than the IT business. The new property project will be the company's third, after The Ville Jomtien villa project worth 600 million baht, launched in 2013 and sold out last year, and the X2 Vibe Pattaya SeaPhere condo project worth 300 million baht, now 50% sold. Its eight-storey building will feature 65 units sized from 29-54 sq m and priced from 2.84 million baht. "I've been a condo investor myself and know what investors want,"
Mr Chanin said. "The project offers a rental management programme with a guaranteed return of 7% per year for five years, which will certainly attract investment buyers, as the rate is higher than bank deposit interest."

CONDO PRICES TO SOAR
angkok condominium prices are expected to rise by at least 10% next year, driven by new land appraisal prices that will be revised up by 25% on average. Nalinrat Chareonsuphong, managing director of property consultant Nexus Property Marketing Co, said higher land appraisal prices would affect prices of condos being launched next year, as land costs would be higher from bigger property transfer fees. "Increases in condo prices will vary by location," she said. "The more prime the location,
the higher the rise in condo prices."
According to Nexus's market research, overall prices of Bangkok condos launched in the first half rose by 10% on average from last year. In the central city, new condo prices rose by 12% to about 155,000 baht asq metre. A similar rise was seen in the city fringe and outer city, where new mass transit lines and extensions were under construction. Average prices of new condos in this emerging location were 85,000 baht per sq m. In the Saphan Mai area, The Episode condominium was launched on Aug 29, with selling prices of about 80,000 baht per sq m. In condo development, land costs currently account for 25-30% of development costs, up from 20% several years ago due to soaring land prices. In city areas, land costs represent up to 40%. In the first half of this year, land prices in Bangkok soared 15% on average from last year. Prices in prime locations such as Lang Suan Road increased by 25% to 1 million baht a square wah. In the Chidlom area, a new record land price of 1.91 million baht per sq w was recently recorded.
The 14-storey complex with 465 units worth 1.1 billion baht will be developed by Asset Wise Co. "Last year we launched a condo project in the same location at a selling price of only 55,000 baht per sqm," managing director Kromchet Viphanphong said. "The main factor was higher land costs."

Builders urge realty in focus  l  Property Design
Property developers are urging the government and its new economic cabinet to use tax incentives to help restore housing demand in the remaining months of this year.
They are concerned that already-soft demand will be weakened further by the recent bomb attack. Cutting property tax and transaction fees would help to stimulate the economy in general and the property market in particular, said Thongma Vijitpongpun, president and chief executive of Pruksa Real Estate Plc. He proposes the property transfer fee be reduced to 0.02% from 2%, mortgage fee to 0.01% from 1% and special business tax to 0.01% from 3.3%. The cuts should be applied to housing units priced 2 million baht or lower, which would help low-income earners to afford their own home, Mr Thongma said. "If these incentives were applied to higher-priced segments, annual tax revenue could miss the target," he said. Atip Bijanonda, president of the Housing Business Association (HBA), said the overall economy in the remaining months and full-year GDP growth would depend largely on economic stimulus. "We're not worried about new-home transfers in the rest of the year, as those will keep growing," he said. "But new-home sales are a concern due to unfavourable market sentiment in the housing sector and the weak economy, which is expected to be dampened further by the deadly bombing."

What can you tell us about the quality of the build? The Standards of the build are second to none. Using modern techniques from the structure to the taps all has been considered and implemented. Each units front door, will have rubber seals to stop cold air from escaping, which will also add to the sound insulation.

This means that no additional electricity will be required to heat the buildings, hot water. • Water cooling from the pond in the atrium of the building will mean that air conditioning will not be needed in the communal space.
What are the special features of Horizon Residence? • LED lighting will be used throughout the Horizon Residence, reducing electrical costs and consumption by 30%. This does not only help the environment but also the owners’ costs. • Inversion air conditioners are more expensive to purchase and install, but use up to 20% less electricity than traditional air conditioners. A remote system will also be employed, that will detect any problems with the air conditioners as soon as they happen and alert our onsite managers. This will increase customer satisfaction and decrease unnecessary loss of energy from the units. • Aluminum cladding will provide an additional layer of protection to the exterior of the buildings. The heating effects of the sun and UV rays will be reduced, which will help keep the interior of the buildings cooler. • Exterior painting will be reduced to once every 15 years, instead of once every 2 years which will vastly lower the amount of paint used over time, lower costs for the owners, and also cause less disruption. • The dry wall system will not only provide far better sound insulation than traditional brick walls, but also better cooling properties, therefore reducing the need for air con. • Floor sound absorption material that is made from a blend of recycled plastic and cork, will be used to help reduce sound from the above apartments. This provides greater sound insulation via a greener solution.

Last issue we looked at the benefits and reasons why you should choose edible plants and foliage for your garden rather than the predictable shrubbery and plants that dot most people’s gardens. This issue, we take a look at mapping out the location of your paths, patios, outdoor areas and garden beds, so you can select the best edible plants for your space. Some need to grow up in height, some need to grow wide – so we want to ensure you can have the biggest array of sizes, shapes and textures as well as selecting various plants that will look attractive when some are in season and some are not. Secondly, work out what you like. What is it you and your family like to eat? Making a list of the edibles you like most is a great first step and then see if these will grow in our warm tropical climate.
Choosing Your Edibles
There are 3 key main factors – can it grow here, what does it look like when it grows (texture/colour/ lealfyness) and do I like to eat it?
Size Think big and think small. Basically, think about what size the plant will grow to when it is fully mature. Large plants can overtake a space and other plants, whereas small plants may look out of place. Consider the end height and width before making your final selections.
Texture You want your edible yard to have some texture to it. Fine whispy plants, strong big leafy plants – think a Banana Palm in comparison to say a tomato plant. They are very different in terms of how thick and wide their leaves grow as well as their fruit. You want a mix of textures to give your yard some character. Colour Have some fun with your edible landscape. Use red or yellow peppers for bright hues, berries for a warm reddish hue and of course interlace with green (and there are many shades of leaf green from dark to light and almost yellow in colour) for some balance and a neutral to work against all the other colours you choose. Your imagination is the only limit here.
Produce That Produce
If you’ve never embarked on a garden before, do some research or even buy a couple of handy gardening books to give you the basics and help you along the way. Here are some tips that will help you get the best out of your new tasty landscape. • A well-drained garden bed is essential along with rich, organic soil with a pH between 6.0 and 7.0 – this is imperative for growing healthy vegetables. • Make sure any tall plants are positioned in the north part of your yard so they do not overshadow the smaller plants. • Make sure you intermix long-grow plants such as peppers and tomatoes with plants that grow quickly such as lettuce and spinach. • Give your plants ample room so they can grow to their full size without growing on top of each other. • Follow the recommendations on seed packets to work out when best to plant each. So, you’ve chosen your plants, you’ve mapped out your garden, you know where and when to plant them – so get planting! Set Yourself Work Hours You need to be strict and set yourself work hours, just as you would in an office environment. Too much flexibility and you will find yourself taking countless breaks, getting distracted, watching a quick bit of TV…the list is endless. Not only will dedicated work hours help you, but it makes it easier for others to get in contact with you. Separate Work and Home Just as important as having dedicated work hours, it is even more important to ensure once you switch off and into home-mode, you stay that way. It is so easy to ‘just answer this email and then I’m done’ – before you know it you’re working into the night and missing out on important friend and family time. You don’t want to burn out nor do you want to miss those special moments with friends and family – so make sure when you commit to ‘turning off’ for the day, you keep it that way. Make a Plan I can never get enough of lists! Making a list for the day ahead is a great way to ensure you get everything done, don’t miss anything and ensure you keep on track and put aside time for each task. Prioritise what needs to be done and allocate enough time for each, you’ll whiz through it in no time! It can even be helpful to make the following day plan before your current day is done. That way you can truly switch off and not stress about what lies ahead, and know full well what you are going to achieve and work on the following day. Break Time Try and plan your break times. This gives you something to look forward to, as well as adhering to the work schedule you have set yourself. You don’t want to be too flippant about your breaks, or before you know it you’ll be having a quick nap on the sofa! Get some fresh air, have a bite to eat, go out for lunch and meet a friend for some human interaction - all of these things will keep you invigorated and ready for the tasks that lay ahead. Get Out Of Your Pajamas It is so tempting when working from home to roll out of bed and stay in your pajamas! BUT this is not recommended. Getting up, having breakfast, having a shower and dressing as if you are going to an office (albeit a casual one) is a much better idea. It signifies you are getting serious and starting work and when you are done, there is nothing like changing into a comfy outfit for lounging around the house! Office Space Create a dedicated office space to work at (see our Island Home article about how to create the perfect home office space!). It is so tempting to want to work on the sofa or even bed, but you will be far less productive and find it hard to distinguish between work and personal hours. Sitting at a ‘desk’ or allocated work space, you will feel more organised and comfortable with all your work tools at the ready. Keeping It Clean Tidy Home. Tidy Mind! Keep your workspace and home clean and organised. A well-organised environment makes it easier to concentrate and complete tasks. If you are sitting in a mess, your work is most likely going to be messy and disjointed. So make sure you clean and tidy up every day to keep yourself focused. Keep In Contact Working from home is fantastic, but there is nothing like a bit of personal interaction to get the juices flowing and to inspire you or keep you on track. Make sure you schedule work calls or lunches with fellow employees or even friends. Chatting over some of your tasks, getting feedback and keeping you on the ball with what else is going on in the world. Don’t disconnect too much, or you can find yourself in a lonely place! the village ‘sala’ or celebrating weddings with dances and local music, local people remain distinctively Thai in many ways. As for the foreign residents, the ease of life, natural beauty and diversity of lifestyle choices make Koh Phangan a unique destination as either a permanent or second home.
REAL ESTATE OF KOH PHANGAN Koh Phangan’s real estate sector has grown as the island has developed and become more popular with visitors from around the world. Investment opportunities abound, whether it is raw beach and mountain land, off plan residential purchases or completed luxury villas for sale. Prices are considerably lower than they are on Koh Samui, which often attracts adventurous investors looking for an affordable slice of paradise. Restrictive ownership laws in Thailand, however, mean buyers are advised to go through reputable law firms when considering any purchases on Koh Phangan. As is the case on Koh Samui or Phuket, it is important for anyone considering an investment to thoroughly research the laws and regulations, as well as to ensure that any land titles are thoroughly checked and that the most secure method of purchase is found to guarantee a trouble free, longterm investment. It is advisable to research construction firms employed to guarantee that their reputation is solid and that any previous projects have been successfully completed.

LAND TITLE DEEDS IN THAILAND There are two main types of land ownership in Thailand which we should explain
RIGHTS OF POSSESSION Firstly there is the right of possession, for example, land that has been used by a family for generations to the benefit of the land and they have possession rights of the land under the civil and commercial code. Such titles are Sor Kor 1,Tor Bor 5 , 6 or Sor Por Gor 4. These titles basically are only family possession rights and generally only used for farming. These titles can not be bought or sold and no building rights or legal acts would be allowed on the land. I do know of cases where families being in possession of certain pieces of land for generations have been able to upgrade them to regular land title deeds but this is not generally the case and any serious investor would not normally give any credibility to these titles of possession.
RIGHTS OF OWNERSHIP Usually we are looking for land title deeds giving right of ownership not possession. Here there are basically three title deeds:- Chanote, Nor Sor 3 and Nor Sor 3 Gor. The most sought after titles are the Chanote and the Nor Sor 3 Gor as both these titles have legal documents of Rights of Ownership and can be sub-divided into smaller plots and planning permission and any such legal acts can be carried out immediately on the land.The only difference with the Nor Sor 3 is that although legal documents are issued for the land it has not been accurately surveyed which can lead to problems in verifying actual land area. And if any legal act is to take place on this land it must be published for at least 30 days. As we have been saying all the way through if it is not clear 100%, seek the advice of a legal professional in this field, as there are also many other issues that are important to consider such as servitude, access and rights of way.
LAND MEASUREMENT & SURVEY Land in Thailand is measured in Rai, Ngan and Talang Wah. • 1 Wah= 4 sqm • 1 Ngan= 100 Wah or 400 sqm • 4 Ngan= 1 Rai or 1600 sqm In comparison to Western Standards: • 2.50 Rai= 1 Acre • 6.25 Rai= 1 Hectare

TIPS FOR STARTING A NEW BUSINESS Are you planning to start your own business for the first time in Thailand? If so, we hope this useful information will help put your business on the right track. The simplest and easiest sort of company for foreigners to form with a small business is a Thai Limited Company. In Thailand, a Limited Company is a company with up to 100 shareholders, who share the same business purpose and is formed with a Capital divided into equal shares.
GETTING STARTED To set up a company, you must first have the memorandum that can be acquired at the registration office. To properly register, you are required to provide the authorities with details of your company and list a minimum of three shareholders (who can either be Thai or foreign nationals or both). At least seven days after you first approach the department, you can call a shareholder’s meeting to reach an agreement on the purpose of your business and set up the company’s operational rules. Having agreed on the purpose of your business, you can then apply for business registration at the same department. If you cannot agree on company rules, you can refer to those stated in the Civil and Commercial Code’s partnership and companies section.
SHARES Besides the issues of business registration, you must also make sure that your company’s shares are worth no less than 5 baht each. These shares can be transferred or even sold if the company has no regulations on this matter. Every shareholder must be given a share certificate, a document that guarantees their status as a shareholder. Should anyone wish to transfer their shares to another party; they have to fill in the share transfer form that confirms the deal between the transferor and transferee. The company also has to have in its possession a register of shareholders that contains a record of all the company’s shareholders. The book is evidence that will identify the company’s shareholders.
SHAREHOLDERS AND CHAIRPERSON A Limited Company’s shareholders can be either Thai or foreign nationals or both, but the percentage of shares held by foreign national plays a significant role in determining the nationality of your company, which may impose serious limitations on the company’s rights, such as landownership. If less than 49% of your company’s shares are held by foreigners, your company is considered a Thai company.

However, if foreign nationals hold more than 49% of the shares, your company is a foreign company. The significant differences between Thai and foreign companies operating in Thailand lie in their rights to buy and own properties or other businesses. It is therefore important, especially for those in real estate and development businesses, to know and remember that unless your company is Thai, you are restricted in the ability to possess and obtain land and property in this country without an exemption granted by the government. Foreign companies are also restricted to certain activities and to proceed with certain operations the company will have to apply for permission from the government. In such instances, applications will be considered case by case. They will also face tough scrutiny and strict restrictions on their right to operate and ability to run their business. These companies will be treated in the same way as foreign nationals seeking jobs in Thailand. If you are registered as a Thai company, you are automatically granted the right to purchase and own properties and other business and will be treated the same way as a Thai citizen. However, according to new legislation that has recently come into effect, the Land Department’s staff are now required to thoroughly investigate your Thai shareholders’ sources of income. Thai shareholders in a company wishing to purchase properties in Thailand have to declare their income and provide the authorities with evidence that proves their ability to co-invest with other foreign shareholders in the same company. Only those successful in convincing the authorities are granted the right to purchase and possess land. Companies with approval from the Land Department can then proceed with their applications for land title deeds or other certificates of use and possession.
LITTLE THINGS THAT MATTER A company limited has to have its own board of directors to act on behalf of the company. This panel will, however, act under the regulations and agreements approved by the shareholders. Appointing directors or removing any of them requires shareholders approval. At the end of the company’s financial year, within five months, it shall be the duty of the company to present the balance sheet to the Department of Business Development (DBD). If your company fails to present the balance sheet, the company will be fined up to 50,000 baht and the company’s board of directors may also be fined up to 50,000 baht. If the committee refuses to pay the fine, the police can appeal to the court for a warrant and file a lawsuit against the resilient parties. Withdrawal of the company’s business registration is also another penalty the company may face, should they not provide the authorities with the necessary statement. BUILDING REGULATIONS ON KOH SAMUI In order to build on Koh Samui you must first obtain a building permit from the municipality office and your building must meet certain requirements, depending on the location of the land on which you wish to build. There are 4 defined areas for land depending on its distance from the beach. (See diagram on opposite page)
STAGE 1. Land up to 10 Meters from the beach. The law states that no construction is permitted within this area. STAGE 2. Land up to 50 Meters from the beach. Within this area you are permitted to construct a single storey building only It’s height cannot exceed 6 Meters (including the roof) and the building cannot exceed the maximum allowed area of 75 Square Meters.
STAGE 3. Land up to 200 Meters from the beach. Within this area you are permitted to build up to a maximum height of 12 Meters (including the roof). The maximum allowed size is 2000 Square Meters.
STAGE 4. Land located more than 200 Meters from the beach. Within this area, building of up to 12 Meters in height (including the roof) can be constructed.
In addition, all buildings must now be constructed with peaked roofs, flat roofs are no longer permitted.

ENVIRONMENTAL REGULATIONS ON KOH SAMUI AND KOH PHANGAN There are defined areas relative to the distance above sea-level (i.e., reference to height above sea rather than set-back from shore-line), pursuant to the Regulations of Resource and Environment, 30th May 2557 (2014) (“Environmental Regulations”). Level 1 - Land less than 80 metres above sea level. In general, no additional rules apply in this level, subject to rules relating to hotels (50 percent of hotel land area must be left un-built on and “green”), residential projects consisting of 10+ units (must have water and waste treatment facilities), in addition to rules relating to water-dams, golf courses and airports. Level 2 - Land between 80 – 140 metres above sea level. Within this level, a single family home may be constructed on land that is 100 square wah or greater (if the land is less than 100 square wah, construction is prohibited). Structures cannot exceed 6 metres in height and must leave 50 percent of the land un-built on and “green; must have an architectural design based on traditional Thai, tropical or local aesthetics; must have a roof consisting of 80 percent of the total building area, and that matches the natural surroundings; and must include an approved water-drainage system, to prevent flooding. Level 3 – Land greater than 140 metres above sea-level. Within this level, the same rules apply as in Level 2; and in addition, structures in Level 3 cannot exceed 90 square metres. Slope Rules In all levels mentioned, where the land has a slope of between 35-50 degrees, only a single family home is permitted, which cannot exceed 6 metres in height and 80 square metres in area, and which must leave 75 percent of the land un-built on (50 percent of the un-built land area must be “green” with native trees). Furthermore, the land area must be 120 square wah or greater, otherwise construction is prohibited. If the slope is greater than 50 metres, construction is likewise prohibited. illa rental is fast becoming the preferred holiday accommodation option for a vast majority of vacationers to Koh Samui and Koh Phangan. Renting a villa as a family or group of friends can prove far more economical in the long run than hotel accommodation and can afford you the luxury and privacy you seek on a holiday without breaking the bank. For longer term lets, there is a multitude of options from private owners to agent lets ranging from basic to 6 star luxury – all you need to do is spend some time finding the right villa for your long-term living needs. Holiday villas are generally fully furnished and include a full western kitchen with appliances, towels and bed linens, water and electricity and will normally include a maid service who will come once or more a week to change linen and tidy the villa, as well as a maintenance person to take care of the gardens and pool if included. There are a host of other optional services on offer such as a private chef, babysitting, pre-arrival shopping, laundry, driver or car hire, butler, island tours, personal training, massage and spa treatments, Thai cooking lessons...simply do your research and ask lots of questions when selecting your villa to see what is available to you during your stay. If booking your villa from outside of Thailand, it may be wise to use one of the more established

and recognised agents to ensure you are getting what you pay for. While it may seem cheaper to go directly through the home-owner, agencies usually have representatives in Samui and Phangan who can advocate on your behalf. That can include minor repairs or even moving you to another property if you’re not satisfied with your original choice. That’s something that the owner can’t help you with. Prices can vary greatly depending on the location of the villa (closer to the beach or beach-front means you will pay for the access and view!), the size/bedroom numbers, the facilities, services and the standard of the villa - with several levels of luxury available! There are hundreds of villas available on the islands starting from basic, mid-level, luxury and beyond – it’s truly reliant on your budget and your requirements - either way, you will not be stuck for choice. Generally a deposit of 50% or more is required to secure the villa of your choice prior to your holiday and the remainder paid in full upon arrival, this may vary from agent to agent. Read the rental agreement very carefully to make sure you understand what’s provided as well as any and all conditions, exclusions, inclusions, costs and penalties. When you decide on the ideal holiday villa to suit your needs, you can relish in the fact that you will enjoy privacy, space and of course the beautiful tropical surrounds of Koh Samui and Koh Phangan.
