Fair Commemorating Years of the National Fair Housing Act
ForJANUARY Realtors®, the2018 Fair Housing Act is one of our nation’s most significant laws guiding the real estate industry today. This year, we commemorate the fiftieth anniversary of this major milestone in our nation’s efforts to bring greater equal opportunities in the rights to private property and housing. On April 11, 1968, President Lyndon Johnson signed Title VIII of the Civil Rights Act of 1968, more commonly known today as the Fair Housing For REALTORS®, the Fair Housing Act is one of our nation’s Act. After successfully completing the course, Realtors® are eligible to apply for the official AHWD certification.3 RASM is offering the AHWD course in August at the RASM South location. “Completing the At Home With Diversity Course will give our members the confidence and tools needed to face potential discrimination situations,” said Janet Sowers-Wilkins, RASM’s Professional Development Manager. “Discrimination isn’t likely to go away. Understanding the complex attributes of diversity in the real estate industry and protecting your rights and the rights of your clients, is imperative to a Realtor’s® bottom line.” The Role of Fair Housing Where and how people live directly affects their health, education, and access to economic opportunities. History has shown us over time that discriminatory housing practices create racial and economic segregation. Fair housing initiatives and awareness support the development of racially and economically diverse communities. According to NAR, three important aspects of residential housing that create healthy communities include the physical conditions within homes; conditions in the neighborhoods surrounding homes; and housing affordability. These circumstances not only shape home and neighborhood conditions but also affects the overall ability of families to make healthy choices. Housing factors that affect education include housing quality, residential stability, affordability, and neighborhood location. The presence of affordable, stable housing can support community development, including new or improved schools. Communities with high concentrations of poverty may have less access to the type of housing that can bring about positive change to local schools. Neighborhoods are becoming more segregated economically. NAR tells us that the number of poor people living in neighborhoods with concentrated poverty doubled from 3 million in 2000 to 6 million in recent years. At the same time, high-income households have become more likely to live in high-income neighborhoods. Affordable housing provides stability and can help households secure employment, and take steps to become self-sufficient.4 The REALTOR® Fair Housing Program To further assist its members, NAR has developed a Fair Housing Program which provides resources and guidance to Realtors® in ensuring equal professional services for all people. There is a great deal of responsibility behind the term Realtor®. NAR defines the term "Realtor®" as a licensed professional in real estate who is a member of the National Association of REALTORS®. They conduct their business and activities in accordance with a strict Code of Ethics. www.MyRASM.com
The Code of Ethics: Article 10 of the National Association of REALTORS® Code of Ethics provides that, "Realtors® shall not deny equal professional services to any person for reasons of race, color, religion, sex, handicap, familial status, national origin, sexual orientation, or gender identity. Realtors® shall not be parties to any plan or agreement to discriminate against a person or persons on the basis of race, color, religion, sex, handicap, familial status, national origin, sexual orientation, or gender identity. Realtors®, in their real estate employment practices, shall not discriminate against any person or persons on the basis of race, color, religion, sex, handicap, familial status, national origin, sexual orientation, or gender identity." Article 10 imposes obligations upon Realtors® and is also a firm statement of support for equal opportunity in housing. NAR has produced a brochure entitled “What Everyone Should Know About Equal Opportunity in Housing,” which outlines the value and requirements of fair housing regulations. Avoiding Pitfalls With Your Listing Agreement By Pam Ali, Managing Broker & Lisa Gonzalez Moore, Attorney and Vice-Chair of the RAJC “Fail to plan, plan to fail,” it is often said. Therefore, the best way to avoid problems en route to the closing table is to start off on the right foot with your listing agreement. Here, Lakewood Ranch Managing Broker, Pam Ali of Michael Saunders & Company, and Bradenton attorney, Lisa Gonzalez Moore, highlight just a few of the items agents should pay close attention to when finalizing the listing agreement with each new customer. Personal Property Versus Fixture A “fixture” is typically included in the sale of real property. Thus, its value should be considered when determining the listing price. “Personal property” is property which the seller may include when determining the listing price but is not under any obligation to sell with the real property, and may exclude from the listing. The question is: What distinguishes a fixture from personal property? To determine the answer, consider these three items. • First, is the item annexed or attached to the real property? • Second, is the item furthering (or integral to) the use of that portion of the real property? • Finally, did the installer of the item intend to attach it permanently? The key is always open and transparent communication with your customer regarding their intent when they originally attached the item to the property; and their goals in attempting to remove it. When in doubt, advise your customer to seek legal advice before removing the item. Virtual Office Websites and Seller Opt Out Rapid advances in technology have promoted the use of virtual office websites (“VOW’s”) for online brokerage. VOW’s incorporate MLS information into search functions on the company websites for consumers to use. Additional possible functionalities are numerous, such as mapping and blogging. However, some customers may be apprehensive about the use of the internet to sell their home. Agents should be clear with a concerned seller that opting out of displaying listing information “on the internet” means that any display online is prohibited (including on the agent or broker’s own VOW), and may make their listing more difficult for cooperating brokers to find. Compensation Know your customer’s goals. An “option” is the exclusive right to purchase a property, typically within a designated timeframe to exercise the option; and pursuant to certain terms of sale. Compensation is also available for a seller searching for a tenant versus a buyer. Additionally, reassure your seller that the blanks in paragraph 9 of the FAR Listing Agreements are for the purposes of sharing the 12 APRIL 2018
broker commission with a cooperating broker; and are NOT cumulative amounts. Neither Florida Statutes nor MLS rules and regulations mandate what percentage a listing broker must offer to a cooperating broker, notwithstanding strict requirements for the manner of payment of commissions to brokers. Wait, There’s More Inattention to the smaller details can derail your best efforts for a smooth transaction. Don’t forget to double check MLS rules and regulations regarding solicitation of existing listings and signage. Additionally, determining whether your seller is a foreigner, as defined by the Foreign Investment in Real Property Tax Act of 1980, or “FIRPTA”, is also a useful bit of information that will help pave the way to a successful closing. Effective research and planning when entering into a listing agreement with a new customer will help set the tone for your entire interaction with your customer from contract to closing. Realtors® Gain Key Victories in Tallahassee in 2018, By Max Brandow, Government Affairs Director Despite a very tight state budget, Realtors® and their communities throughout Florida are walking away from the 2018 session of the Florida Legislature with several key victories: a $31 million cut to the Business Rent Tax, $110 million for affordable housing projects and more than $400 million for Florida's natural resources. "Great job, Realtors®, for making the 2018 legislative session a big success," said Christine Hansen, 2018 president of Florida REALTORS®. "We knew this was going to be a tough session to work through given the status of the state budget. With the help of our members, we managed to keep the momentum going to further reduce the Business Rent Tax. We also scored victories on a number of other issues that will benefit Realtors® and property owners alike," Hansen added. Let's start with a recap of some of Florida REALTORS® more significant legislative victories: • Additional reduction in the Business Rent Tax - HB 7087 included a cut to the Business Rent Tax, and businesses throughout Florida will save an additional $31 million each year due to the second reduction in the tax rate in as many years. The new state tax rate businesses will pay on their commercial leases will be 5.7 percent. Effective: Jan. 1, 2019. • Tax credits for businesses that pay the Business Rent Tax - HB 7055 is a broad education bill that addresses several education-related matters. Included is a measure that allows businesses to receive tax credits for a portion of the Business Rent Tax they pay, which will go toward certain scholarship funds. Effective: July 1, 2018. • More than $400 million for Florida's natural resources - Everglades restoration, beach renourishment and springs protection received significant amounts of funding this year. A large amount of funding was also allocated to expedite repairs to the Herbert Hoover Dike around the southern boundary of Lake Okeechobee. Effective: July 1, 2018.
• Nearly $110 million for affordable housing projects - Affordable housing programs will receive close to $110 million from the state and local government housing trust funds. These funds go a long way in helping Floridians achieve the dream of home ownership with down payment assistance. They also provide rental assistance and housing rehabilitation to Florida's homeless population, veterans and persons with disabilities. • Strengthening flood insurance notices to protect homeowners - Many property owners forgo flood insurance because they mistakenly believe their standard homeowner policies include flood damage coverage. HB 1011 strengthens the current flood insurance notice included in their property insurance policy. Insurers must include the notice in the initial policy and when the policy is renewed. Effective: Jan. 1, 2019. • Creating an accurate 3D map of Florida - Included in the state budget is $15 million to fund LIDAR (light detection and ranging) mapping that would produce a complete and accurate 3D map of Florida for use in emergency management, infrastructure planning and other purposes. LIDAR is a next-generation mapping technique and has the potential to lower flood insurance rates throughout Florida. • Preventing unlicensed real estate activity - The Legislature allocated up to $500,000 from the Professional Regulation Trust Fund to the Department of Business and Professional Regulation to combat unlicensed real estate activity. Although Assignment of Benefits (AOB) reform did not happen this year, the momentum is building for a successful outcome to this escalating problem. AOB reform remains a serious issue for Florida's property owners. The business community and the Legislature will continue to work to find the right path forward. Vacation rentals are another issue that will be addressed in subsequent legislative sessions. This session, an incredible amount of discussion occurred among stakeholders on the issue, and several bills made it very close to passage. The progress made this year will provide a good starting place for continued discussions during the 2019 legislative session.

Market Analysis Sarasota-Manatee Home Sales Increase in February Home sales in Sarasota and Manatee County increased for the second consecutive month in 2018. The two-county area reports another month of tight inventory, pressuring median prices to rise again. Combined closed sales in the two-county area increased by 8.8 percent from February 2017. Manatee County single-family home sales increased by 8.6 percent to 441. Sarasota County showed a 9.8 percent increase to 569 closed sales. Sarasota condo sales jumped by 14.1 percent to 315, while Manatee increased by 5.2 percent to 202. "So far, our traditional 'snowbird' season has been more robust than last year," said Greg Owens, 2018 President of the REALTOR® Association of Sarasota and Manatee. “The opportunity for growth is reflected in the continuing demand for homes in our community.” Overall, median sales prices are up. Manatee condos increased by 22.2 percent to $213,250, breaking $200,000 for the first time since 2008. As for Sarasota condos, the median price decreased by 0.1 percent to $219,000. Manatee single-family homes increased by 3.5 percent to $300,000, while Sarasota single-family home prices increased by 5.8 percent to $272,500. "We are seeing a steady increase in sales and prices which is a good indication of how strong our market is," said Owens. "This competitive situation makes it even more important for buyers and
sellers to turn to their local, professional Realtor®.” Inventory is tight, with a combined 2 percent decrease from February 2017. Manatee County single-family homes decreased by 1.6 percent, while Sarasota single-family homes decreased by 5 percent from last year. Condo inventory increased by 2.9 percent in Manatee County, while Sarasota decreased by 0.1 percent. The number of properties that went under contract in February increased by 5.6 percent overall from last year. Condo pending sales are up by 11.3 percent, while single-family homes are up by 2.9 percent. New listings increased from this time last year, with condos increasing by 15 percent and single-family homes by 7.5 percent. However, when compared to last month, the combined number for of new listings decreased 10.1 percent, expected after January’s jump at the start of the season. The month’s supply of inventory reflects a sellers’ market. The condo market is close to the balanced market benchmark with Manatee condos at a 5.3-month supply and Sarasota condos at a 5.7-month supply. Manatee County single-family homes are at a 4.4-month supply and Sarasota single-family homes are at a 4.7month supply. We have moved the date, as you know, of our Global Conference and this will now take place on May 9 at the RASM South office. Our keynote speaker has been confirmed as Dr. Lawrence Yun, Chief Economist and SVP of Research for the National Association of REALTORS®. Those of you that have heard Dr. Yun speak before know that he is a talented presenter with the ability to deliver what could be described as a dry subject in an informative and entertaining way. Those that don’t know Dr. Yun should be aware that he regularly provides commentary on real estate market trends for the one million Realtor® members of NAR. He participates in many economic forecasting panels, among
them the Blue Chip Council and the Harvard University Industrial Economist Council. He also often appears as a guest on CSPAN’s Washington Journal and is a regular guest columnist on the Forbes website. Neighborhood Spotlight The Landings By Michelle Crabtree, Broker Associate, Realtor®, Premier Sotheby’s International Realty The Landings is a gated community “West of the Trail,” bordering Sarasota Bay with entrance halfway between the north and south Siesta Key Bridges. The neighborhood is comprised of estate family homes, carriage houses, coach homes, treehouses, villas and mid-rise condos. Housing styles vary widely and include Key West, Mediterranean and traditional, ranging in size from 2,000 to over 6,000 square feet. Centuries ago, Caloosa and Timuca Indians inhabited the area. Along the waterfront there are mounds that comprised the sleeping, kitchen and hunting area. In the early 1900s, part of the land was owned by the Hover clan of Lima, Ohio. They cleared the bayshore and built five houses along with a dock. In those days, most travel was by boat. The back of the property was lined with pine trees and citrus groves. From the late 1920s through 1950, the area became a cow pasture for Bispham Dairy. Development of The Landings as a neighborhood began in 1981. The original developer, Robert Morris, desired to preserve the environment. As a result, the area has curvy roads, nine lakes and mature landscaping, with ancient live oak and banyan trees. In addition, there is a 7.4 acre eagles nest preserve in the heart of The Landings. The Landings Racquet club was established in 1984, it is a private athletic and social club whose membership is comprised

of Landings residents only. The facilities include 8 Har-Tru tennis courts, pro shop, fitness center, two meeting rooms, lending library, pool and spa. Membership is optional for the single family residents but required for all other property owners. Sold prices as of the end of the year range from mid $200K for coach homes to high $700’s for single family with listing prices to over $1M of larger waterfront homes When doing property search, include both Landings and The Landings to capture all information.

While we are still in the first quarter of the year, we continue to start the year with much momentum. On March 15th, we had our first fundraiser at the Lakewood Ranch Country Club. It was the first annual Diamonds and Champagne White Party. While this event has passed, the excitement has not. Just to mention a few aspects of the experience, we had an entertainer, comedian, money booth, silent and live auction, one winner of a diamond, two photographers and a Rolls Royce for portraits. The profits benefit the education fund for the Women’s Council of Realtors® Manatee and the Humane Society of Manatee County. My co-host was Meredith Michaels from 107.9 FM and I have to admit, she is awesome. We also had media coverage. This event would not have had such an impact if it weren’t for the five ladies on this task force who performed their duties beyond my expectations. Their efforts not only elevated me as the President, but they also showed everyone the Manatee Network is on the rise and making a difference. I am honored and blessed to mention the five amazing women who shared a vision and failure was not an option.
