Official Notice: Annual Meeting and Bylaws Revisions Proposed The Annual Meeting is scheduled on Tuesday, September 27, 2016 at 11:30 AM at 2320 Cattlemen Road, Sarasota. In addition to the election of officers and directors, the RASM membership will vote on revisions to the Bylaws. Proposed changes relate to elections, meetings, quorums, and an additional seat on the Board of Directors for a representative of the Commercial Investment Division. These changes, if approved by the membership, would go into effect in 2017. RASM Employee Anniversary Daniel Andrews RASM happily recognizes the workplace anniversaries of our dedicated and professional staff. The “behind the scenes” efforts of the staff in conjunction with committee volunteers keep the Association operating like a well-oiled machine. Daniel Andrews, Director of Membership and Administrative Services, celebrates 11 years of service with RASM this August. The Association congratulates him on his achievements and longterm commitment to our members. Daniel graduated from Sarasota High School and went on to graduate from the University of Wisconsin-Whitewater, majoring in Communication Management. Daniel came to the Association with a diverse background in management, market research, and data collection. His many responsibilities include supervising four staff members in his department, maintaining a complex membership database, processing new members and transfers. Daniel also works closely with our Business Partners, overseeing many functions including the Smart Lunch, Summerfest, the Changing of the Seasons Gala, and many other popular events catering to Realtor® Members, provided by the Business Partners. In the past 11 years he has greatly enjoyed being part of SAR and now RASM, and the Association appreciates his hard work. Thank you, Daniel!

Realtor® Safety. We have all heard this phrase a thousand times…. But do we take it to heart? Or do we go about our busy day thinking “it can’t or it won’t happen to me?” There have been some disturbing stories in the news over the past few years surrounding Realtors® and personal safety in the Real Estate Profession. And although no one wants to dwell on the negative, our ever-changing worlds requires us to remain vigilant, remember the tried and true safety tips, and stay informed, so that if presented with a dangerous situation, you will know exactly what to do. Next month is National Realtor® Safety month, so what better time to brush up on vital safety tips? For over 10 years, NAR has provided information and tools to promote Realtor® Safety during the month of September and throughout the year. Recently, NAR launched their Realtor® Safety Program, designed to help members understand the dangers they face every day and to empower members with the tools they need to remain safe. Knowledge. Awareness. Empowerment. These are the core components of the NAR Realtor® Safety Program - helping members understand the risks they face. The program stresses the importance staying aware of their surroundings, becoming empowered with precautions, and avoiding risky situations altogether. To this end, NAR has developed an online Realtor® Safety Resources Kit with dedicated safety pages which offer many resources designed to help members keep safety first and features including:
• New webinars on Realtor® Safety, presented by industry experts • Quarterly safety messages focusing on seasonal tips for on the job and at home • Client safety materials, safety-related articles and resources • Information on Smartphone apps, online security precautions and other safety products • Safety presentations for managers • Banners to display on websites • Other checklists and handouts for agents to share with clients and colleagues 6

NAR has also created a video for consumers to learn about the potential safety protocols they may encounter when working with a Realtor®. The video, entitled “Real Estate, Safety & You”, is a great tool for members to use to help educate their clients about the importance of Realtor® safety. It was awarded Best Associations Online Video by the Web Marketing Association’s 2016 Internet Advertising Competition Awards. To see the video, visit realtor.org/safety. Like many other jobs that require interaction with the public, selling real estate involves some risk. Whether it’s putting up signs along the highway or showing a house to a prospective buyer, personal safety is often at stake. Yet, most Realtors® don’t think about the potential dangers until it’s too late. NAR wants to empower Realtors® to recognize risks and protect themselves — both on and off the job. Inattention is one of the main reasons people find themselves in dangerous situations. Another common tendency is freeze – to panic in a stressful, dangerous situation. By brushing up on safety tips now, members can know what to look for and be prepared in case of an emergency. Following these simple safety measures could mean the difference between life and death. Familiarize yourself with the 10 Second Rule: Take 2 Seconds when you arrive at your destination. • Is there any questionable activity in the area? • Are you parked in a well-lit, visible location? • Can you be blocked in the driveway by a prospect’s vehicle? Take 2 Seconds after you step out of your car. • Are there suspicious people around? • Do you know exactly where you’re going? Take 2 Seconds as you walk towards your destination. • Are people coming and going or is the area unusually quiet? • Do you observe any obstacles or hiding places in the parking lot or along the street? • Is anyone loitering in the area? In addition, he is the Broker/Operating Principal/Owner of Keller Williams on the Water in both Bradenton and Sarasota. Serving as Treasurer in 2016, on the Board of Directors six years, Finance Committee, Political Action Advisory Committee, Grievance Committee, and he is a graduate of the MAR Leadership program. Greg has earned the CDPE (Certified Distressed Property Expert®) designation. Xena began her real estate sales career in 2001 working as a sales agent in Bradenton, then as a Property Manager on Longboat Key before obtaining her Broker’s license and opening Xena Vallone Realty in 2009 in Sarasota. Xena has obtained her ABR and SFR designations as well as CDPE Certification. She is also a new member of the WCR. Feeling strongly about maintaining the integrity of the industry, the first committee she joined was the Grievance Committee. She then served on the Professional Standards Committee. Today, she is President-Elect after serving in 2014 and 2015 as Treasurer. She has served on the Realtor® Attorney Joint Committee, Public Policy, Finance, and Professional Development. Amy Worth is a Broker-Associate in RE/MAX Platinum Realty’s Sarasota office. Realtor® Safety Continued Take 2 Seconds at the door. • Do you have an uneasy feeling as you’re walking in? • Is someone following you in? Take 2 Seconds as soon as you enter your destination. • Does anything seem out of place? • Is anyone present who shouldn’t be there or who isn’t expected? 10 Seconds total … Taking in your surroundings lets you spot and avoid danger. Even if you can’t remember this laundry list of questions, being mindful of your surroundings and remembering to put your safety first could make all the difference. Make an effort to practice these steps and make it a habit. It’s also important for Realtors® to have a personal safety protocol in place every day, with every client. Whether meeting new clients, showing properties or sharing personal information online, there are a variety of tools members can add to your personal safety protocol. “Our members’ well-being is a top priority for the organization,” said NAR President Tom Salomone. “Realtors® are used to managing their own business, but it’s just as important for them to be attentive to their safety and security.

Whether you’re driving a client or hosting an open house, safety matters. Taking simple steps like showing properties before dark or keeping a working cell phone in hand at all times can make a difference - always trust your gut instinct if a situation feels unsafe.” A recent survey from the National Association of Realtors® found 96 percent of Realtors® have never been the victim of crime, but 40 percent have found themselves in situations where they have feared for their safety or the safety of their personal information (for full survey, visit http://www. realtor.org/reports/2015-member-safety-report). Some of the most common circumstances that resulted in fearful situations were open houses, showing vacant and model homes, working with properties that were unlocked or unsecured and showing homes in remote areas. So yes, “Realtor® Safety”, we have all heard this phrase a thousand times, but maybe we all needed to hear it one more time? Knowledge. Awareness. Empowerment. How Many Ways Can You Say Disclose? By Sylvia Golden Norris As Realtors®, you are certainly familiar with the real estate mantra “Location, Location, Location!” However, did you know that disclosure related claims are one of the top reasons Realtors® are named in a lawsuit, DBPR or ethics complaint? Maybe, now it makes sense to embrace in your real estate practice a second mantra: “Disclose, Disclose, Disclose!” Q: Isn’t a Seller required to provide a Sellers Disclosure to a Buyer? A. No. Florida law doesn’t require a Seller or Realtor® to give a written disclosure or to use any particular form, but both you and the Seller are obligated to divulge any fact or condition of which you have knowledge that a Buyer doesn’t, if it substantially affects the value of the property. Most of you use the Florida Realtors® or a Broker’s in-house form, because, well, we are human and we are forgetful. The Seller’s Disclosure form really serves as a ‘memory prompt’ to remind you to share those facts about the property’s condition which would be of interest to the prospective buyer who would not otherwise know about it. Practice Tip: A disclosure made verbally is not worth much at the end of the day; so get it in writing! Q. Does a Seller have to disclose there was a defect, if it was repaired or replaced? A. (This question was initially posed to the Florida Realtors® Legal Hotline regarding Chinese drywall, but the answer is the same regardless of the type of “defect or repair” that was fixed.) The simple answer is no disclosure is required, if an issue was corrected. The better answer (and don’t we all want the better answer?) is to disclose what was done, when it was done and who did it. Provide the Buyer with the name of the contractor and give them a copy of the paid receipt, if you are feeling extra generous. By doing so, the Seller and you have complied with the law. If a Buyer has questions, they can ask the vendor directly and no translation is required. Q. Isn’t there an exception to the disclosure requirement if the Seller never lived in the property (a bank, personal representative or corporate owner)? A. No. There is no exception. Regardless who the owner is, you disclose what you know. If a bank had an inspection done and received a report showing the roof leaked, that has to be disclosed. If an out-of-state owner never lived in the home, but paid bills for plumbing issues for a failed system, that too must be disclosed. Q. Can a Buyer waive the disclosure? (SOUND BITE: DING, DING, DING - DANGER WILL ROBINSON….you get my point.) A. No. Even if a Buyer signed a waiver, a court will not 12

enforce it to allow a Seller to fraudulently conceal a condition the Seller was otherwise required to disclose. Q. Doesn’t the As-Is contract act as a waiver? A. No. If you remember nothing else you read in this article, remember this: an As-Is Contract or provision does not serve as a waiver or exception from the disclosure requirement; its purpose is to reflect an agreement between Buyer and Seller that the Seller is not obligated to repair any unknown defect or property condition discovered by the Buyer’s inspection. Any preexisting and known condition the Seller was aware of is still subject to the mandatory disclosure. Q. I now represent a Buyer on a property I had listed years ago. I am aware of an unpermitted room, but the Sellers Disclosure my Buyer received doesn’t mention it. What should I do? A. Under Ch. 475, you are obligated to disclose any known fact that substantially affects the value of the property that’s not evident. Under the NAR® Code of Ethics, Realtors® must avoid concealment of pertinent facts related to the property. So, while you have a continuing obligation to maintain a former client’s confidential information, latent or hidden defects are deemed pertinent and do not constitute “confidential information”. Share with the listing agent first. (Who knows, maybe the issue was resolved.) If not, then advise your Buyer. Q. We read this article to learn more about disclosures – any final words to impart on the subject? A. Yes. I even have some “foreign words” for you. I personally don’t care whether it’s a multi-million dollar mansion or a shack overlooking a drainage canal; every home has a story. Every. Single. One. I learned long ago that you can read a home’s history in its walls, that its parcel can softly whisper to you, and that an unpermitted Florida room is the construction equivalent of a bad word. I’ve been learning to ‘speak house’ for over a decade and I’ll probably continue to do it for the rest of my life. For one thing, knowing about homes is a very helpful trait when I’m working with customers – I’m able to tell buyers about a steep insurance discount because of a roof ’s shape or show sellers low-cost fixes that net high-return prices. I also do it because I really, truly, deeply love it. We’re not out here selling toasters. Our primary purpose as Realtors® is to help our customers make the best decisions they can by being their real estate geniuses for hire.
Here’s the rub: learning to ‘speak house’ usually requires actually getting you into homes with qualified tutors. That’s where the MLSExpress/YPN Open House Caravan can go to work for you. Our group leaves the third Thursday of every month to visit 4-5 homes in and around Sarasota. We critically examine the goods and the bads of each home on our list for marketing tips, condition discussions, and pricing education. Market Analysis Median Prices Continue to Rise Median sale prices are on the rise for condos and single family homes in both counties. Single family median sales prices are up 7.8 percent in Sarasota County to $248,000, while Manatee County experienced a 12.4 percent jump to $285,000. The Sarasota County condo median sale price rose 4.3 percent to $219,000, and Manatee County also saw an increase of 11.6 percent in condo sales price over last year, to $173,000. “The rise in median prices reflects the continued popularity of the area and the impact of our current low inventory levels,” said 2016 RASM President, Linda Formella.
Sales have also been on the rise this year, with more single family sales reported in both Sarasota and Manatee County in June than any other month this year. Sarasota County single family homes jumped to 792, a 5.2 percent increase from May 2016. Manatee County single family homes jumped 1.2 percent from May 2016 to 610. While 2016 doesn’t compare to the record breaking numbers in 2015, this rising trend in 2016 is worth noting. Compared to last year, however, closed sales for single family homes in Manatee County and Sarasota County are down slightly from June of 2015. Manatee County saw a 2.4 percent decrease and Sarasota a 4.7 percent decrease in single family homes. On the flipside, condos in Sarasota saw a 0.9 percent increase from June of last year. However, condos in Manatee County decreased by 4.4 percent from June of 2015. New pending sales for both condos and single family homes in Sarasota and Manatee County are 25 percent lower than last June. This year, we are noticing a more typical trend, with pending sales slowing after season’s end, compared to last year’s tapering off in September. Distressed properties, foreclosures and short sales, continue to decline. In June, 6.3 percent of closed sales were distressed, compared to the 13.4 percent in June of 2015. Distressed sales for single family homes represented 7.1 percent and condos at 4.4 percent in the two-county area.

June data also reveals that inventory numbers continue to rise for the two-county area, likely from more sellers taking advantage of rising prices. For single family homes in Sarasota County, inventory is up 20.4 percent from June 2015, and up 17.2 percent in Manatee County. Condo inventory is also on the rise in Sarasota County, up 35.9 percent, while Manatee County experienced a 16.8 percent increase from last year. “The market seems to be balancing out compared to the high number of sales we saw last year. We see an improvement in distressed properties, inventory on the rise, as well as an increase in median sales prices,” says Formella. The months’ supply of inventory showed a small improvement, ranging from 4.2 to 5.1 months of inventory this year, compared to a range of 3.5 to 4.1 months at this time last year, due to a slight increase in inventory. A months’ supply of inventory reflects the time it would take to sell all the active listings on the market at the current month’s rate of sales. Six months is considered the benchmark for a balanced market; anything higher is considered a buyers’ market and anything lower is a sellers’ market. Commercial Investment Division CID Summertime Market Update By Tony Veldkamp, CCIM, 2016 CID President Well, August is here and that means that the summertime, and the usual summertime commercial real estate slowdown, are both coming to an end. As a boater, August and September are my two favorite months in Sarasota as it’s still nice and hot, the tourists & snowbirds are not on the water, and many of the locals are burned out (or too sunburned!) and not on the water as Tony Veldkamp much either. So it is nice and quiet out 2016 CID President there on our beautiful waterways. August also means the annual International Council of Shopping Centers (ICSC) Convention in Orlando. The ICSC is always interesting to attend as a CRE practitioner. To me there is no better barometer of the future of the CRE market than what the retailers are thinking and saying. Retailers are the first to feel a tightening economy and the first to know when it is expanding as well. When retail spaces start to soften, office and industrial will follow, and vice versa. So even if you don’t do retail commercial real estate, the ICSC is a great indication of the near future of all commercial real estate. All reports I heard out of the Las Vegas ICSC Convention earlier this year were, to my surprise, positive. With all the doom and gloom surrounding brick and mortar stores, store sales being off, Sports Authority closing, etc., I thought the Las Vegas show might indicate a slowing market. But retailers are adapting to make shopping in stores more of an event. They are using technology to create entertainment value in the shopping experience. So it will be interesting to see what the August Florida ICSC show brings. NAR Releases Results from 2015 Lending Survey In looking ahead to what the rest of 2016 may bring, looking back to what the experts and analysts said about 2015 and how the commercial real estate sector performed is obviously helpful. George Ratiu wrote recently for NAR: Commercial real estate (CRE) notched another year of growth in 2015. While global economies decelerated, U.S. gross domestic product rose, employment growth accelerated toward the tail end of the year, and housing prices reached new heights. Commercial vacancy rates declined for the core property types. Availability is expected to continue contracting for office, industrial and retail properties in 2016. Vacancies for apartments are estimated to rise, due to gains in supply. Commercial rents have risen across the board, and are projected to advance this year. CRE sales volume continued its positive trend in 2015, with $534 billion in closed transactions, compared with $432 billion in 2014, based on data from Real Capital Analytics (RCA). That all seems pretty consistent to what we saw in our local market here for 2015 and the first half of 2016. To read the whole story see “COMMERCIAL REAL ESTATE 22

2016 Profile of International Activity in US Residential Real Estate Since 2009, the Research Division of the National Association of Realtors® (NAR) has conducted an annual survey to measure the share of U.S. residential real estate sales to international clients. The 2016 Profile of International Activity in U.S. Residential Real Estate presents some interesting information based on the 12 months ending March 2016. The full report is available on www.realtor.org – just search for the title of the report. In the survey, the term international or foreign client refers to two types of clients: 1) Non-resident foreigners: Non-U.S. citizens with permanent residences outside the United States. These clients typically purchase property as an investment, for vacations, or other visits of less than six months to the United States. 2) Resident foreigners: Non-U.S. citizens who are recent immigrants (in the country less than two years at the time of the transaction) or temporary visa holders residing for more than six months in the United States for professional, educational, or other reasons. The dollar volume of purchases by foreign buyers decreased one percent, to $102.6 billion in this year’s report, while the number of residential properties purchased increased three percent to 214,885. The dollar volume decreased even as the number of properties purchased increased, because there were fewer non-resident foreign buyers, who tend to purchase more expensive properties than resident foreign buyers. The share of non-resident foreign buyers decreased to 41 percent from the almost even split in previous years. The slowdown in economic growth in many countries and strengthening of the U.S. dollar explains in part the drop in the number of non-resident foreign buyers. International clients come from across the globe, but buyers from five countries continued to account for most of the reported purchases: China, Canada, Mexico, India, and the United Kingdom. Together, they constituted 45 percent of foreign residential property buyers. While international clients represent a small segment of the total U.S. existing-home sales market, they are an important clientele, particularly to the five states that tend to attract international clients: Florida, California, Texas, Arizona, and New York. Together, these five states accounted for 51 percent of international buyers who purchased residential property. Florida attracted buyers from

Latin America, Europe, and Canada, who tend to purchase properties in warm climates for vacation purposes. The majority of international clients who sold their U.S. residential property originated from Canada, China, the United Kingdom, Mexico, Germany, and India. Properties owned by international clients sold for $446,191 on average and a median of $245,331. There are also U.S. domestic clients interested in purchasing property abroad. Mexico, Costa Rica, Philippines, Columbia, and Canada generated the most interest. Of those seeking to buy residential property abroad, 87 percent intended to use the property as a vacation and/or residential rental property. Optimism about the outlook over the next 12 months continues. The decline in the value of the British Pound is likely to mean fewer buyers from the United Kingdom. Longer-term ramifications could be mixed. Businesses and foreign real estate investors may choose to stay away from the United Kingdom, and the U.S. could become an attractive alternative. However, if the uncertainty impacts global economic growth, demand for U.S. real estate could fall.

Many, many thanks for all the hard work and dedication we are getting from the fashion-show committee. As the fashion show gets closer, they are having frequent meetings and arranging details to prepare for our biggest event of the year. This one promises to be a real blockbuster. Meanwhile, other committees are working just as eagerly to continue the functions of the Council while many others are on vacation and/or are working double time to do their own committee work.
