The Commercial Investment Division of the Realtor© Association of Sarasota and Manatee Having been a member of the CID organization for ten years and now the current President, I would like to share my thoughts about the origin of the CID and the reasons for belonging to this organization. Researching the history, I found a few folks that go back to the group's inception. Amongst them were the following former Presidents: Ian Black and Carl Wise. Erick Shumway, who remembers the 1st President, Glen Phelps in 1973, was my source historian. In the beginning, their reason was to pitch properties on a regular basis. As far as I can tell, monthly speakers became a part of the meetings in the 1990s. Beginning in 2005, I began selling Commercial Real Estate. Having passed the state test, taken courses, been a licensed Realtor® and licensed Appraiser in both Massachusetts and New Hampshire, as well as BOMA certified Real Property Administrator-RPA; I was not quite lost. Fortunately, Century 21 All Aces owner, Bob Rotondo, showed me the training tapes and gave me my first lead. I did not know the difference between an entitlement and a permit (some exaggeration here)-get my drift? I made two or three sales that year and somehow found a CID general meeting. Jag Grewal was President. At the 8:00 am networking session, I met Carl Wise, Anthony Homer, Joe Hembree, and Janet Robinson. They were very

warm and welcoming. I do not remember a speaker, but I do remember the pitches of properties. These Realtors® and many others in this Association are both friends and advisors to this day. They are not the only ones. They are, however, the reason for my remaining with the organization and becoming a member of the board. Very few of our owner brokers have the time to teach or coach Commercial Sales Associates. If you take classes from CCIM or other places, that can be helpful. However, the "real stuff" comes from sharing your needs and experience with others, often with our friends in CID. CID members are always ethical, have integrity, and share knowledge and experience. Attending the weekly pitch sessions and the monthly speaker education meetings will enlarge your overall realty scope. I have relied on this community of men and women who are both kind and helpful to each other to find properties, buyers, and sellers. Like a family, we share our needs and wants and encourage each other in our goals.

Every year, the Association awards scholarships to six deserving students in the Sarasota and Manatee area, as selected by the RASM Scholarship Committee. Members of RASM, their immediate family and members of the community who are continuing education or plan to continue education at a public or private university, college, community college or technical school are eligible to apply. Scholarships support tuition, textbooks and other course-related fees. Three scholarships are awarded to applicants from the public at large and three are awarded to applicants who are immediate family members of members of the Association or current RASM members who are continuing education. Realtor® Attorney Joint Committee No Pets Allowed! By Michael T. Hankin, Board Certified Real Estate Attorney, Hankin & Hankin 2017 Chairman - Realtor® Attorney Joint Committee Homeowners associations, condominium associations, and landlords may have sensible reasons to exclude pets from their properties—including safety, noise, and possible damage created by unattended pets. However, even those well-reasoned rules cannot overcome the requirements imposed by Florida and federal law. Under the Florida Fair Housing Act and the Federal Fair Housing Act (not to be confused with the Americans With Disabilities Act, which covers service animals) individuals with a handicap are permitted to have an assistance animal live with them, despite otherwise valid association restrictions prohibiting pets. If an individual requests a reasonable accommodation to permit their assistance animal to live with them in an association - or under a lease agreement that otherwise excludes pets - the association or landlord must determine if the individual qualifies for an assistance animal. Determining whether a person qualifies for such an animal is a twostep process. First, you must determine if the person requesting the animal has a handicap. “Handicap” is broadly defined under the Florida Fair Housing Act (FFHA) to include any impairment that substantially limits at least one major life activity. Second, you must determine if the assistance animal alleviates at least one of the symptoms or effects of the person’s disability. If the answer is “yes” to both questions, then the assistance animal must be permitted. If the answer is “no” to either question, then the animal is not an assistance animal and may be excluded. A person’s disability may not always be readily apparent just by looking at or talking to them. In these circumstances, documentation of the disability and the disability-related need for the assistance animal may be requested. According to the U.S. Department of Housing and Urban Development, the documentation can be as simple as a letter verifying the disability, and the disability-related need for the assistance animal, from a medical professional, peer support group, or “reliable third party.” If the individual’s disability is apparent or known, then further documentation of a disability cannot 12 FEBRUARY 2018
be requested. Additionally, in most instances, medical records showing the disability cannot be required. Under current statutes, any animal - be it a bearded dragon, pit bull, parrot, or cat - can qualify as an assistance animal. Additional charges or deposits cannot be collected when allowing an assistance animal under the FFHA. However, individuals are responsible for any damage caused by their assistance animal; and must ensure their assistance animals remain under their control. If an assistance animal damages property or threatens harm to others and no other restriction could be placed on the animal to ensure the safety of people and property, the animal could be excluded from the property. However, this exclusion must be based on the individual animal’s actual behavior, not based on the type of animal or breed. The FFHA applies to nearly all residences, with very few exceptions. Even if an individual landlord was exempt from the FFHA, the use of a real estate agent to rent their residence would subject them to compliance with its requirements. If the FFHA is violated, the individual who suffered the discrimination may bring a civil action and be entitled to injunctive relief, punitive and actual damages, and attorney’s fees and costs. Additionally, violations of the FFHA can be pursued by the Florida Commission on Human Relations; and firsttime violators can be fined up to $10,000.

Government Affairs Legislative Priorities for 2018 By Max Brandow, Government Affairs Director – 941-952-3410 This past January, RASM members, and staff had the opportunity to take a trip up to Tallahassee to lobby legislators representing Sarasota and Manatee counties on important legislative priorities. Here are some of the major priorities we discussed with the Representatives and Senators.

AOB allows policyholders to assign their post-loss insurance benefits to a contractor, such as a water remediation company or roofer, so the contractor can charge the insurance company

2017 Market Closes with More Sales and Rising Prices in December A strong market continues in the Sarasota and Manatee area, as indicated by December 2017 statistics. Compared to December 2016, combined numbers show an increase in closed sales, median sales price and pending sales. Overall, closed sales in December showed an increase from December of 2016. Closed sales for single family homes in Manatee County increased by 4.1 percent to 511, Sarasota County increased by 3.6 percent to 639. Sarasota condo sales increased by 9.7 percent to 327, Manatee condo sales increased by 0.5 percent to 221. “Compared to other months throughout the year, December will typically show more closed sales and less pending sales,” said Greg Owens, 2018 President of the REALTOR® Association of Sarasota and Manatee. “Buyers are closing out their major purchase for the year, while sellers ready their property for season.” Pending sales are indicated by the number of listed properties that went under contract during the month. Manatee single family homes increased by 0.5 percent in pending sales, while Sarasota increased by 4.3 percent. Condo pending sales show improvement in Sarasota with a 26.1 percent increase, however, Manatee County condo pending sales decreased by 9.2 percent. Median sales prices continue to grow. Single family homes in Manatee increased by 11.4 percent to $317,500, while Sarasota increased by 4 percent to $275,000. Sarasota condo prices increased by 15.2 percent to $250,000. Manatee condos increased by 5.4 percent to $195,000. “Sarasota condos continue to show a significant increase in dollar volume with a 64 percent increase from last year,” said Owens. “Overall, the sales volume is up across the board,
indicating the continuation of a solid market in both counties.” Inventory for single family homes in Manatee County increased by 1.2 percent from last year, while Sarasota decreased by 8.4 percent. Condo inventory experienced a 3.3 percent increase in Sarasota, while Manatee decreased by 2.1 percent. As for month’s supply of inventory, properties remain in a sellers’ market. Sarasota condos are close to a balanced market with a 5.3-month supply, while Manatee condos are at a 4.5month supply. Manatee County single family homes are at a 4.2-month supply and Sarasota single family homes are at a 4.1-month supply. New listings, or the number of properties put onto the market during the month, showed a decrease in December as buyers wait to list their property for the upcoming season. Combined in the two counties, new listings showed a 28.3 percent decline from last month, as well as a 12.9 percent decrease from last year. With fewer and fewer distressed sales, the market is healthy and median sales prices stay up. In December 2017, distressed sales for single family homes and condos in both counties experienced a 27.1 percent decrease from December of 2016. Respectively, the traditional sales (non-distressed) in the twocounty area experienced an increase of 5.9 percent. According to a recent report from ATTOM Data Solutions, foreclosure filings in the U.S. dropped to the lowest level since 2005. Commercial Investment Division CID Coming Attractions 2018 is off to a great start for the CID! Mark your calendars so you don't miss these great upcoming events. We welcome all Realtors® to our Weekly Commercial Marketplace Sessions! These meetings are held at the RASM South office every Friday morning from 9:00 to 10:00 a.m. Realtors® and Business Partners come David Roth and pitch their commercial properties 2018 CID President or business services. Light refreshments are served. It's a great opportunity to network and share information. In addition, our General Membership Meetings are held on the third Tuesday of every month at the RASM South Office, beginning at 8:00 a.m. and includes a delicious free breakfast. Our first meeting of the year was held on January 16th and the subject was "Bridging Generations" with John Scott, Managing Director of Florida Real Estate Management Services. It was highly informative and a great start to our series. Our next meeting will be on February 20th from 8:00 to 9:30 a.m. at the RASM South office featuring Ted C. Jones PhD, Chief Economist for Stewart Title. It is certain to be a meeting you won't want to miss. I am excited to announce our first social event of the year, the 2018 Annual CID Sporting Clays Tournament!
The tournament will be held on April 27th at the Sarasota Gun Club. Last year's event was tremendous fun and we're excited to do it again. All proceeds will go to a local charity. When considering the global impact on Sarasota and Manatee Counties, it is tempting to focus on the foreign nationals wanting to enjoy the Gulf Coast lifestyle and buying homes to allow them to spend their wellearned leisure time in our waterfront or golf course communities. However, we should not ignore the impact of international investment in the businesses of Sarasota and Manatee counties. This is probably making a greater contribution to the prosperity of the two counties and their residents.

In January, it was announced that Star2Star, a company headquartered on Tallevast Road near the Sarasota Bradenton International Airport, has merged with an Irish company to form a $500 million company. The combined businesses expect to be a “top five global provider in the rapidly growing global unified communications market.” The business is to remain headquartered on the Suncoast. At the other end of the business spectrum, we are seeing many foreign nationals investing in existing or forming new businesses in our region. These include health care services, home services, retail, restaurants, gas stations and automotive-based businesses.

Neighborhood Spotlight The Peaceful Neighborhood of Sabal Harbour By Lisa A. Hayden, Real Estate Professional, Exit King Realty Sabal Harbour is located off State Road 70 (53rd) and 45th (45th is Lockwood Ridge South of SR 70). It is a nineteen year old community, completed in 2002. It is a peaceful neighborhood close to dining, shopping, I-75 and 41. The community was developed with tropical landscaping laid out around several ponds that provide water views to the residences. The Braden River is only a short distance east of the community. Jo Ann shared some great tips on how we can legally squirrel away more of the money we work so very hard for.
