Think Global, Act Local RASM Asks the Experts About the World of International Real Estate The term “globalization” has been trending in recent years, as our society becomes increasingly more integrated with international economies, politics, and culture. Our strong local economy and recent developments attract more and more international buyers, and some savvy agents are taking advantage of the opportunities. But there is much to learn when working with international real estate, and much to be cautious of, especially for a newcomer. We interviewed a handful of RASM’s international real estate experts to hear their stories, and to guide us through these uncharted international waters. Here is some of their firsthand, professional advice.
What advice do you have for agents looking to get involved with International Real Estate? Miao Yu Whiteside: Be openminded. Let your customer feel as comfortable as possible. Put yourself in their shoes and try to understand how nervous it can be to make a very large purchase overseas. If they want to put fingerprints on every page of the contract, let them do it. Patricia Baker: The first thing you MUST do is get your CIPS; you don't drive your car without a license, and you shouldn't even attempt international real estate transactions without it. I once had a Chinese client, and I gave my customary closing gift of a Cutco Knife, in a white box. However, I later learned in my CIPS class, that you never give a person of Chinese descent a knife because it means that you want to sever the relationship. You should also avoid anything wrapped in white, as it’s a 6 MARCH 2019
sign of a funeral or death! Thankfully, my client still talks to me. Paula Cashi: We service many International Buyers in our area and understanding their culture gives them a greater confidence in your ability to represent them. A funny example happened to me a few years ago when I was working with a South African client. I was driving him around, touring homes and he commented, “you certainly have a lot of robot’s here, don’t you?” I almost wrecked my car, but somehow, I kept my composure. How many of you know what that means? Well, I won’t make you look up the answer… he was referring to our traffic lights! One of the best pieces of advice I received was to have a “Currency App” and a “Translator App” on your mobile device. When working with international clients, you want to make it easy for them to understand how our U.S. dollars equate to their home country currency and always be ready in case there is a language barrier.
What should agents be aware of when working with international clients? Miao: Be patient but be clear with them. They may not understand Florida real estate, so explain to them what is acceptable and what is not. You also need to build trust with them. They probably will doubt you in many ways, so prove to them that you are telling the truth.

Carla: Educating yourself on how real estate is conducted in your client’s country will help you convey the differences when they buy or sell here in the United States. Andrew: Even if the client's English is good the client may not understand the Florida legal and taxation systems nor the normal practices for the process of buying and selling real estate in Florida.
Also, With the expansion of our local airports, more direct flights are occurring. This enables us to see more Internationals arrive on our sandy shores, not to mention in our restaurants and shops. It is not unusual to walk down the halls of the UTC mall or on the sidewalks of St Armand’s Circle and hear 5 or 6 different languages as you move along. It is music to my ears and always makes me feel like our world is a little smaller when this happens!
How is it working with clients from different cultures?
Patricia: Each country has its own rules and cultural norms. In Europe, for instance, there is very little use of buyer's agents. So, when the potential client asks for the listing agent, you need to be prepared to explain that in America we use both buyers and listing agents. It is a good idea to familiarize yourself with customs in their country so that you can upfront deal with any differences.
Miao: It has its challenges and sweetness, for sure. My advice is to try to be understandable. They may expect you to do more than what you are used to, or expect things to go differently, so you will have to explain to them how you handle the process here. Many of my Chinese customers have served me meals when I meet them to sign paperwork, and it’s always super delicious. I was shocked and felt weird at the beginning, but offering a meal is definitely a part of their culture and a bonus for me.
With so many coastal cities in Florida, how do you see Sarasota and Manatee to international buyers?
Carla: Fun! Working internationally is a chance to learn something you didn’t already know, and you can make an everlasting impression on someone who can be a great referral lead for you and a friend for years afterward. Also, I strongly suggest becoming an avid reader of the news and different cultures, so you’re informed about what’s happening around the world. And be passionate about what you do and travel!
Carla: We’ve done a great job over the last decade putting our area on the map. Our biggest competition is Naples (particularly for Canadians), and Miami for those from South America. But the Sarasota/Bradenton area is booming in many ways and attracting more attention from international buyers. Andrew: Most UK buyers first experience of Florida is a family vacation to Orlando or a cruise from Miami. When they are looking for a home for longer visits, Sarasota and Manatee becomes an attractive option as a medium-sized, realistically priced region with great beaches, good golf and tennis and water amenities, good environment, quality cultural and dining amenities. Paula: It’s the same reasons we attract so many “Snow Birds” to our beautiful beaches. It doesn’t matter if you are searching from England or Minnesota, everyone would like this wonderful experience. www.MyRASM.com
Andrew: To work well with international clients, you have to like people and to be prepared to adapt your approach to accommodate different cultures' attitudes. However, you must always act professionally and ethically. You should be a consultant or advisor and, hopefully, become a trusted friend to the client.

So, it would help if you were prepared to eat with your hands. You will learn so much, you will have great friends, and you will eat things you never knew existed. But through modern technologies, we are connected on an unprecedented scale, making international real estate more attractive than ever before. Broadening your horizons internationally can give an agent financial success, more contacts, and a larger pool of potential clients. But perhaps one of the best reasons for getting involved in international real estate comes from our panel of experts. When asked the question, “What has been your greatest reward in working with international clients?” The responses received were nearly identical across the board: “enjoying quality, long-standing friendships with international clients that I would have never had the opportunity to meet otherwise.” “Working with international clients is not for everyone,” said Whiteside, “but if you have an open mind and are willing to learn about other cultures, you will find it’s a very enjoyable experience. Not only they will be your customers; their entire family will be your customers for life. My clients become my friends. I am thousands and thousands of miles away from my hometown, and to have friends who share the same culture and background, it’s extremely rewarding,” added Whiteside.

Realtor® Attorney Joint Committee I Got Sued for What?!? Broker’s Liability for a Seller’s Non-Disclosure By Morgan R. Bentley, Esq. Some things in life seem unfair. Getting sued for passing along information that someone else told you is one of these things. In the world of real estate agents and non-disclosure claims, that is often the case. In the context of the sale of real property, Florida law requires that sellers make a full disclosure of all known facts which “materially affect” the value of the property, and which are not readily observable or known to the purchaser. Johnson v. Davis, 480 So. 2d 625 (Fla. 1985). The duty to disclose announced in Johnson v. Davis has been extended to both agents and brokers by case law. And to make matters worse, courts have opined that while an “as-is” clause could potentially limit the duty of care the listing broker owed to the buyers, “asis” language does not waive the obligation to disclose known latent defects. While it seems unfair to most brokers, there is a logic to it. This extension of liability derives from agency law principles. A principal is civilly liable for the tortious acts of his agent that are within the scope of the agent’s employment, even where the agent’s acts or representations are fraudulent or deceitful. Conduct is within the scope of an agency relationship if it is motivated by a purpose to serve the principal. But things might be changing, as at least one broker has successfully implemented disclaimer provisions. The contract at issue in Billington v. Ginn-La Pine Island, Ltd., LLLP, 192 So. 3d 777 (Fla. 5th DCA 2016) contained a section for “Broker Agency Disclosure… and Disclaimer of Representations.” This section contained several disclaimer clauses which stated that the broker specifically disclaimed any responsibility for any statements, promises or representations, acknowledged that the broker did not have authority to make representations in conflict with or in addition to the information in the contract and community documents, acknowledged that the purchasers did not rely on any representations by the broker, and waived any rights or claims by the purchaser arising 12 MARCH 2019
from any representations by the broker. The Court held the disclaimer clauses at issue to be as “clear and conspicuous as they are comprehensive” and upheld the express waiver of a right to base a claim on precontract representations, affirming the lower court’s dismissal of the purchasers’ complaint. To limit misrepresentation liability, brokers, agents and their staff should consider the use of clear, conspicuous and comprehensive exculpatory language in the purchase and sale contract like the broker in Billington. Each seller should be required to fill out a seller disclosure form documenting the seller’s sources of information and use of professionals, including inspectors and repair personnel. As an added layer of protection, agents and brokers should consider having the seller certify in writing that he or she has disclosed all defects to the listing agent. Finally, if a defect is discovered during the inspection process and the seller hires a contractor to correct the problem, the buyer should have the repairs inspected by a third party. If nothing else by doing all this, you will keep out of the Courthouse.

Major Happenings in Government Affairs By Max Brandow, RASM Government Affairs Director This month, Realtors® from around the state will head up to Tallahassee to meet with their legislators for Great American REALTOR® Days (GARD). This is a great opportunity to educate lawmakers on legislative decisions that affect your business every day. It also provides Realtors® an opportunity to advocate for new ideas that preserve the health of the industry, and keep the dream of home ownership alive. If you are planning on attending GARD this March 18-20, let RASM know so that we can keep you in the loop on where and when the legislative meetings will be taking place. WATER QUALITY At the 2019 Florida REALTORS® Mid-Winter Business Meetings, the legislative priorities were released for this upcoming session in the Florida Legislature. Many Realtors® throughout the state experienced the negative impacts of water quality issues, whether it be Red Tide or the Blue-Green algae blooms. To combat these incidences, Florida REALTORS® will be advocating heavily for the legislature to support water quality, and environmental funding will be a major priority. AFFORDABLE HOUSING As always, we will be asking our legislators to support the Affordable Housing Trust Funds by not sweeping the funds for general fund purposes. The money Florida collects from Doc Stamp taxes on real estate transactions should go towards housing and housing only. Look for Florida REALTORS® to push for assignment of benefit reform to keep your client’s insurance premiums from raising every year. We will also continue to push for the state to preserve private property rights by limiting the restrictions municipalities can put on homeowners looking to rent their properties to short term tenants. NEW TAX LAW Earlier this year, the Treasury Department and the Internal Revenue Service issued final regulations regarding the new 20 percent deduction on qualified business income. As Americans begin preparations for the 2018 tax filing season, real estate professionals have been uncertain about the true impact of the 2017 16 MARCH 2019
Tax Cuts and Jobs Act on their respective businesses. Friday’s ruling from the Treasury and the IRS, however, signaled a significant victory for the real estate industry and for many of the National Association of REALTOR®’ (NAR) 1.3 million members. A central component of the new tax law is a reduction of the corporate tax rate, from 35 to 21 percent. The new regulation clarifies that all real estate agents and brokers who are not employees, but operate as sole proprietors or owners of partnerships, S corporations or limited liability companies, are eligible for the new deduction, which can be as high as 20 percent. This includes those whose income exceeds the threshold of $157,500 for single filers, and $315,000 for those filing a joint return. Also, the rule simplifies the process that owners of rental real estate property must follow to claim the new deduction. As written in the Tax Cuts and Jobs Act, only income that is from a “trade or business” qualifies for the 20 percent write-off. However, because this distinction was not clearly defined by Congress when crafting the law, various court rulings and prior IRS guidance have caused confusion among tax professionals in determining which rental properties were merely investments and which could accurately be considered a business enterprise. The final regulations included a bright-line safe harbor test requiring at least 250 hours per year spent on maintaining and repairing property, collecting rent, paying expenses and conducting other typical landlord activities. Finally, in the first regulatory draft released last August, those who had exchanged one parcel of real estate under Section 1031 for another parcel, were unfairly denied deduction eligibility. NAR and multiple additional trade groups concerned with commercial real estate were vocal in highlighting this shortcoming. In a positive resolution to the situation, Treasury and the IRS recognized the initial ruling was misguided, and corrected the policy in this year’s final guidance.

Making it Happen for You! Quarter 1 Update: Amy Worth, 2019 RASM President Season is in full swing, but that hasn’t stopped our volunteer committees from meeting Association goals to impact your membership and our community. The Young Professionals Network kicked off the year with a Celebrity Bartending event. It was a close battle behind the bar to raise the most tips. Bartenders (including me!) poured, mixed and served drinks to raise a grand total of $6,847.95 for the RASM Scholarship Fund. The Leadership Institute is off to a great start. Eight participants were selected to complete the 2019 program. They may be a small group, but they’ve already shown their strengths as future leaders of RASM. Knowledge is power. Fortunately for you, there are many RASM committees determined to offer the education you need to learn and grow as agents. So far in 2019, we’ve hosted 20 education-focused events for members (not including our regularly scheduled MLS classes!).
Our MLS Express event was revamped at the start of the year to be more user friendly and increase member participation. In addition to focusing primarily on pitching, we introduced weekly presentations about new developments. The packed auditorium is just one indication that members have responded well to the change! In January, we attended the Florida REALTORS® Legislative Meetings, where our Association received three RPAC awards. In the large Association category, we were recognized for highest total cash raised, first to reach fundraising goal and highest percentage of fundraising goal. And finally, we’ve been busy among the Sarasota and Manatee business community this quarter. RASM sponsored the Manatee Chamber of Commerce’s Annual Dinner and attended their Pancakes and Politics Breakfast. We purchased a table at the Greater Sarasota Chamber of Commerce’s Annual Breakfast, attended the Meet the Leaders Luncheon for the Economic Development Corporation and sponsored dinners hosted by local political parties. These are just some of the events we are participating in to show our presence as community advocates. #MakeitHappen!

Market Analysis More Options for Buyers as Housing Market Finds Balance Closed sales in Sarasota and Manatee County fall short at the start of 2019. Median prices continue to rise and a jump in inventory and new listings point to a more balanced market. Combined, closed sales in the two-county area decreased by 17.2 percent from January 2018. Singlefamily home sales in Manatee County decreased by 16 percent, while Sarasota decreased by 11.4 percent. Condo sales in Manatee decreased by 6.9 percent and Sarasota sales decreased by 33.1 percent. The combined two-county inventory increased yearover-year in January by 12.3 percent. Single-family home inventory in Manatee County increased by 5.7 percent from last year, while Sarasota increased by 18 percent. Condo inventory increased by 15 percent in Sarasota, while Manatee increased by 5.5 percent. “Although January sales may seem less than positive, the market remains healthy overall,” said Amy Worth, second generation REALTOR® and 2019 President of the REALTOR® Association of Sarasota and Manatee. “Additional inventory could ease rising prices, creating a more balanced market between buyers and sellers.” Median sales prices increased overall across the two counties. Manatee County single-family home prices increased by 3 percent to $309,000 and Sarasota singlefamily prices increased by 3.9 percent to $286,600. Sarasota condo prices increased by 0.8 percent to $240,000, while Manatee condos increased by 13 percent to $195,000. A balanced market is indicated by the months supply of inventory. If supply falls under 5.5 months, the market favors the seller and if supply is over 5.5, the market favors the buyer. In Sarasota County, singlefamily homes are nearly balanced with a 5.4-month supply, while the condo market has shifted to favor the buyer with a 6.1-month supply. As for Manatee County, the market favors the seller with a 4.4-month supply for single-family homes and 4.7-month supply for condos. Pending sales, or the number of properties that went under contract during the month, decreased www.MyRASM.com
year-over-year in January. Single-family pending sales decreased by 11.3 percent in Manatee County, while Sarasota decreased by 5.5 percent. Condo pending sales decreased 16.1 percent in Sarasota, while Manatee decreased by 15.3 percent. When compared to last month, total pending sales increased by 56 percent from December 2018 to January 2019. Under the right market conditions, this positive change in month-over-month pending sales may indicate future closed sales. “Pending sales typically slow down in December as many buyers wait for the new year,” said Worth. “This month-over-month change in pending sales is expected as we head into our regular season.” When combined, the two counties experienced a 4.7 percent increase from last year in new listings. New listings for Sarasota single-family homes increased by 8.6 percent, while Manatee single-family homes decreased by 3.1 percent. Sarasota condo new listings increased by 5.8 percent and Manatee condo new listings increased by 7.9 percent. The median time to contract, or number of days on market, increased for the condo market in January 2019. Sarasota condos increased by 21.4 percent to a median 51 days on market and Manatee condos increased by 39 percent to 57 days. Single-family homes in Manatee spent more days on the market with an 8.5 percent increase to 51 days, Sarasota experienced a 2.2 percent decrease to 45 days on the market. Historically, land ownership has always been the best defense against economic inflation and social chaos. Job relocation triggers people to move, and no matter what, people will always need a roof over their head. Shifting markets may come and go… and come and go again. Real estate, however, retains value. Therefore, investing in international real estate is a smart move. According to financial experts, investing in international real estate is probably one of the best ways to be prosperous over the next decade. Times of change are often seen as great opportunities. In some parts of Brazil, for example, we’ve seen increases in the value of condominiums go up to 60 percent over the last couple of years. The numbers in many other countries are similar. By investing in real estate, relatively small investment results in the control of a large asset. Property values will appreciate much faster than the economy or any other asset of value, and a real estate investment is a smart way to protect capital. Because the assets are real, and they have a use that produces income, it’s like printing money in the eyes of investors. Generally speaking, investors will always worry about where growth will come from, and how secure their investments are. However, investing internationally actually provides an abundance of opportunities for profit. Brazil, for example, where half the population now falls into the middle-class bracket, opportunities for mortgage financing and credit are opening up. Once people move into that “middle-class” category, buying and investing begins. This includes searching for condos or homes. Additionally, jobs are being created, and people need to work somewhere, which means office retail space and factories must accommodate the influx of jobs. Essentially, this results in an outpouring demand for these sets of real estate. We know from what we’ve seen in our markets here that this means prices should increase— as should the income potential powered by these properties.

There are five reasons why buying internationally is advantageous: 1. Multiple Uses: Land purchased can be used for agriculture while waiting for people, tourists or industry to come. The possibilities are endless. 2. Keeping Control: Your schedule and personal preferences can guide you to buy, rent, sell or develop. 3. Outside Currency Cash Flow: This is a great way to vary your real property collection towards appreciating currencies in other countries. 4. Inflation Defense: Real estate is better than income generating from your 9-5. It is a hard asset that retains a value separate from any paper currency’s value. 5. Investing is fun: Your real estate investment can serve as a personal getaway or part-time residence. You can choose to enjoy it while it’s growing in value, or generate rental returns, all the while protecting your net worth.
