2024 Annual Report: RASM REALTORS® Charitable Foundation

The RASM REALTORS® Charitable Foundation (RRCF) is the 501c3 charitable arm of RASM, providing funding for individuals and not-forprofit organizations in order to contribute to the future of homeownership, education, and financial security for all. The RRCF contributes to three key areas: 1) Housing-focused non-profits in the two-county region. 2) College scholarships for members or their immediate family members and the community. 3) Financial support for RASM members in crisis, such as medical emergencies or hurricane relief.

As we approach the end of 2024, it’s clear that this year has been one of significant change and resilience. Navigating an evolving industry alongside the challenges of three hurricanes, I can honestly say this year has been one of profound growth, unanticipated challenges, and remarkable rewards.

I am incredibly proud of our volunteer leadership. Their dedication and countless hours have been instrumental in strengthening our association and advancing our goals. It has been my sincere honor to serve as your president, and as I prepare to pass the torch to our incoming president, Debi Reynolds, I am confident in her capability and vision. Debi, along with her team, is well-prepared to guide us through the challenges and opportunities that lie ahead.

GRANTS DONATED

RRCF is proud to announce the distribution of $48,100 in grant money to support several local nonprofits, each of which plays a vital role in improving the lives of individuals and families throughout Sarasota and Manatee Counties.

COMMUNITY COALITION ON HOMELESSNESS DBA TURNING POINTS - $4,800

Located in Bradenton, Turning Points provides services to those experiencing homelessness, including access to health care, job assistance, and basic needs. This funding will allow Turning Points to expand its navigation program, as well as provide four tablets to allow mobile access, enabling navigators to better assist clients.

EVERYDAY BLESSINGS INC. - $4,800

Everyday Blessings is a nonprofit that focuses on providing a stable, loving home environment for children who have been removed from their families due to abuse or neglect. This grant will support young adults in the Springboard Program by meeting the needs of up to 4-8 residents, as well as furnishing two additional apartments.

SECOND HEART HOMES - $5,000

Second Heart Homes, based in Bradenton, provides permanent housing and support services to homeless individuals who suffer from mental illness. This grant will fund therapy sessions for residents at Second Heart Homes, as well as therapy sessions for residents whose insurance doesn’t cover mental health services.

SAFE PLACE AND RAPE CRISIS CENTER (SPARCC) -

$3,500

SPARCC, located in Sarasota, is dedicated to providing services to victims of domestic and sexual violence. This grant will supplement support for survivors enrolled in SPARCC’s Housing Stability Program. The funds will be used to provide “Starter Kits” for new participants, containing essential household items.

MANATEE CHILDREN’S SERVICES - $5,000

Manatee Children’s Services in Bradenton is a child advocacy center that offers comprehensive services to abused, neglected, or at-risk children. This grant will fund new furnishings for the residential facility that houses the MCS Emergency Shelter and “Our Place Group Home,” which serves up to 18 foster children removed from their homes due to abuse or neglect.

HOPE FAMILY SERVICES -

$5,000

HOPE Family Services in Bradenton provides critical support to survivors of domestic violence. This grant will support individuals in crisis due to domestic violence by funding HOPE’s Emergency Safe Shelter, the only state-certified shelter in Manatee County.

MANATEE COUNTY HABITAT FOR HUMANITY -

$5,000

Manatee County Habitat for Humanity works tirelessly to provide affordable housing solutions to families in need. This grant will help fund the construction of one of 30 homes Habitat for Humanity will build over 30 months in celebration of their 30th anniversary.

THE SALVATION ARMY OF SARASOTA COUNTY - $5,000

The Salvation Army in Sarasota provides a range of social services, including emergency shelter, food programs, and disaster relief. This grant will fund the second phase of a locker replacement project at the Center of Hope, a 240-bed shelter providing safe haven and support services for individuals facing homelessness.

HABITAT FOR HUMANITY SARASOTA -

$5,000

Habitat for Humanity Sarasota works to eliminate substandard housing by providing affordable homeownership opportunities to low-income families. This grant will partially fund construction costs for a new, four-bedroom, two-bathroom single-family home in the DeSoto Lakes area.

NAR REALTORS® RELIEF FOUNDATION -

$5,000

The REALTORS® Relief Foundation provides housing-related assistance to disaster impacted communities through the generosity of Realtors®, state, and local associations and industry partners.

FUNDRAISING EVENTS

Fundraising initiatives at RASM and RRCF events significantly contributed to the Foundation’s financial support.

ƒ The YPN Putt Putt Palooza event raised a total of $3,358, with 50% of the proceeds ($1,679) benefiting the RRCF and the remaining $1,679 allocated to SPARCC.

ƒ CREA’s Sporting Clays event generated $10,161.79, with half of the proceeds ($5,080.90) going to the RRCF and the other $5,080.90 supporting Heroes Welcome Home.

ƒ Similarly, CREA’s Golf Tournament raised $27,470.78, giving half the funds, $13,735.39, to the RRCF and the remaining 50% to the charity Help to Home.

SCHOLARSHIPS

Each year, the Foundation Scholarship Committee awards scholarships in the amount of $2,000 each. In 2024, the RRCF awarded 22 scholarships to local students for a total of $44,000, the most in RASM’s scholarship program history. RRCF fundraising comes from a variety of sources: fundraising events throughout the year, dues income, the Buy-a-Brick program, and general donations.

Pave the path toward a brighter future for college-bound students, housing-related non-profits, and Realtors® in need through your purchase of an engraved brick. All proceeds from the Pave the Path brick campaign go directly toward the RRCF. DISASTER RELIEF

After three named storms impacted our communities, the RRCF is committed to providing essential financial support to our members. In 2024 alone, the RRCF has distributed $41,500 to assist members affected by these hurricanes.

In September 2024, the RRCF received a $300,000 grant from the National Association of REALTORS® (NAR) REALTORS® Relief Foundation (RRF) to aid victims of Hurricane Debby. This grant offers housing assistance, with up to $2,000 available per applicant to help relieve housing-related burdens. The program is open to both Realtors® and members of the public whose primary residence was damaged or who were displaced by these storms. To apply, visit www.myrasm. com/disasterrelief. The deadline to apply is December 1.

Advertising Real Estate-Related Products and Services

By: National Association of REALTORS® Interpretations of the Code of Ethics Agreement Case 6-5: (Adopted November, 2006. Revised November, 2017.)

Realtor® X, a principal broker in the firm XY&Z, developed a robust, interactive website that he used both to publicize his firm and to serve the firm’s clients and customers electronically. Realtor® X maintained positive business relationships with providers of real estate-related products and services including financial institutions, title insurance companies, home inspectors, mortgage brokers, insurance agencies, appraisers, exterminators, decorators, landscapers, moving companies, and others. Given the volume of business Realtor® X’s firm handled, several of these companies purchased banner advertisements on the XY&Z website and some, including the Third National Bank, included links in their banner ads to their own websites.

Buyer B, who had earlier entered into an exclusive buyer representation agreement with XY&Z, received frequent e-mail reports from Realtor® X about new properties coming onto the market. Hoping to purchase a home in the near future, he explored Realtor® X’s website to learn more about the home buying process and familiarize himself with the real estate-related products and services advertised there. Understanding that pre-qualifying for a mortgage would ensure he presented the strongest offer, Buyer B went to Realtor® X’s website and clicked on the Third National Bank’s link. Once at the bank’s website, he found a mortgage to his liking, completed the application process, and learned in a matter of days that he was qualified for a mortgage loan.

In the meantime, Buyer B’s property search proved fruitful. Realtor® X and Buyer B visited a new listing on Hickory Street several times. Buyer B decided it met his needs and made an offer which was accepted by the seller.

A few weeks after the closing, Buyer B hosted a housewarming attended by his friend D, a website designer who had, coincidentally, been instrumental in developing Realtor® X’s website. Buyer B told D how helpful the information from REALTOR® X’s website had been. “You know, don’t you, that each time a visitor to Realtor® X’s website clicks on some of those links, Realtor® X is paid a fee?”, asked D. “I didn’t know that,” said Buyer B, “I thought the links were to products and services Realtor® X was recommending.”

Buyer B filed an ethics complaint against Realtor® X alleging a violation of Article 6 for having recommended real estate products and services without disclosing the financial benefit or fee that Realtor® X would receive for making the recommendation. At the hearing, Realtor® X defended himself and his website, indicating that the advertisements for real estate-related products and services on his website were simply that, advertisements, and not recommendations or endorsements. He acknowledged that he collected a fee each time a visitor to his website clicked on certain links, regardless of whether the visitor chose to do business with the “linked to” entity or not. “In some instances I do recommend products and services to clients and to customers. In some instances I receive a financial benefit; in others I don’t. But in any instance where I recommend a real estate-related product or service, I go out of my way to make it absolutely clear I am making a recommendation, and I spell out the basis for my recommendation. I also disclose, as required by the Code, the financial benefit or fee that I might receive. Those banner advertisements on my website are simply that, advertisements.”

The hearing panel agreed with Realtor® X’s rationale, concluding that the mere presence of real estate-related advertisements on Realtor® X’s website did not constitute a “recommendation” or “endorsement” of those products or services, and that the “click through” fee that Realtor® X earned when visitors to his website linked to certain advertisers’ sites was not the type of financial benefit or fee that must be disclosed under Article 6. •

Mitigating Your Risk of a Negligent Misrepresentation Claim

By now, all of us are well versed with the seller of residential property’s obligation to disclose to a potential buyer all known facts materially affecting the value of the property, which are not readily observable and are not otherwise known. The failure of a seller to abide by this obligation, and/ or a buyer’s subsequent discovery of a defect in the property, most often results in the buyer’s pursuit of a Johnson v. Davis claim in which both the seller and the Realtor® are named as parties to the lawsuit. Although Realtors® are often targets for these lawsuits due to their insurance coverage, generally, pursuing a successful Johnson v. Davis against a Realtor® is difficult as the buyer is required to prove the Realtor® had actual knowledge of the defect at issue.

As buyers’ attorneys evolve their litigation strategies, and in an effort to pursue claims with a less cumbersome burden of proof, Johnson v. Davis claims are being abandoned in favor of negligent misrepresentation claims where the buyer only has to establish the Realtor® knew or should have known that a statement or representation was false. Most often, these negligent misrepresentation claims arise following the inclusion of inaccurate information within an MLS listing or a Realtor’s® involvement in a pre-closing remediation. Here are a few tips and practices to help mitigate your risk of a negligent misrepresentation claim:

1 | MLS Listings: Realtors® generally rely on information publicly available to them or contained within a previous MLS listing when preparing a property’s listing. However, inaccurate information regarding whether the property is on septic or sewer, is constructed out of block or wood, or is subject to any rental restrictions can result in a negligent misrepresentation claim. As a result, verify all information provided to you by your client, and then have them review and approve the listing prior to it being published. Don’t rely on information contained in a previous listing, as the status of the property being on septic or sewer, or ordinances involving rental restrictions, may have changed. Lastly, request that the inspector not rely on any representations made in the MLS listing, if possible.

2 | Representations Regarding the Property: As part of any real estate transaction, you will undoubtedly make representations regarding the property which are based on information received from a third-party. Often times, the information you have received and passed along to the buyer or seller is incorrect and leaves you exposed to a negligent misrepresentation claim. As a result, in circumstances where you are being asked to confirm the status of factors like the current amount of the association assessments, or the results of a mold test, make sure to distance yourself from the information by requesting the information in writing, and then forwarding the information from the third party directly to the other party’s Realtor®. If it comes directly from you, it becomes your representation.

3 | Retention of Professional Services: In the event a transaction calls for pre-closing remediation, for example where mold or water damage is discovered during an inspection, avoid making a recommendation for the retention of a specific service provider. In the event that an issue discovered is more extensive than originally believed, Realtors® will often times be blamed where the recommended remediation company fails to fully recognize or resolve the issue. As a result, where it is necessary to assist a party in the retention of a professional service provider, provide them with several names and let the seller select the provider.

Unfortunately, while most of these issues seem relatively trivial, hopefully awareness of these changing trends in residential real estate litigation can help realtors and brokers mitigate the likelihood they get dragged into a negligent misrepresentation lawsuit. •

SBA AND EMERGENCY BRIDGE LOANS NOW AVAILABLE FOR BROKERS

Brokers whose businesses have been affected by disasters, such as Hurricane Helene and Hurricane Milton, can access emergency financial support through the federal Small Business Administration (SBA) Disaster Assistance Program and Florida’s Emergency Bridge Loan Program.

Florida’s Emergency Bridge Loans are designed to provide short-term, interest-free working capital to help businesses “bridge the gap” between the time a disaster strikes and when longer-term recovery funds become available. This could include profits from a recovering business, insurance claim payments, or federal disaster assistance.

ELIGIBILITY CRITERIA:

ƒ The business must be based in Florida.

ƒ It must have been established before September 23, 2024 (for Hurricane Helene) or October 5, 2024 (for Hurricane Milton).

ƒ The business must have suffered economic injury or physical damage due to Hurricane Helene or Hurricane Milton.

ƒ The business must be located in an eligible county.

• Cover Eligible counties for Hurricane Helene: Calhoun, Bay, Escambia, Franklin, Gadsden, Gulf, Holmes, Jackson, Jefferson, Leon, Liberty, Okaloosa, Santa Rosa, Wakulla, Walton, and Washington.

September 2024 Real Estate Market Report: Trends in Sarasota and Manatee Counties

The REALTOR® Association of Sarasota and Manatee (RASM) has released its September 2024 real estate market report, detailing key trends across Sarasota and Manatee Counties.

Based on data compiled by Florida REALTORS®, both counties saw a noticeable slowdown in the housing market, with singlefamily homes and condos experiencing declines in sales. Median sale prices decreased across various property types, and properties remained on the market longer before going under contract. The slowdown may be partly attributed to the impact of Hurricane Debby’s flooding, which likely disrupted buyer activity and contributed to uncertainty in the market.

KEY TRENDS IN SARASOTA/MANATEE SEPTEMBER 2024:

ƒ Decreased Sales Volume: Across all property types in both counties, closed sales saw double-digit percentage drops, indicating a slowdown in market activity.

ƒ Price Adjustments: Median sale prices have declined in most sectors, reflecting a slight cooling in market demand.

ƒ Inventory Growth: Inventory levels have risen significantly year-over-year, suggesting a shift towards a more balanced market.

SINGLE-FAMILY HOMES

In Sarasota County, there were 513 single-family home sales in September 2024, an 18.9 percent decrease from the previous month. The median sales price rose by 3.2 percent to $490,000 compared to last month but remained steady year-over-year. Cash sales accounted for 40.7 percent of closed sales, slightly higher than the previous month.

Inventory is significantly higher than a year ago, with 2,841 active listings, marking a 31.6 percent increase from September 2023. The months’ supply of inventory has remained relatively stable, with 4.5 months of supply in September 2024. The median time to contract in September 2024 was 48 days, a 77.8 percent increase from a year ago.

In Manatee County, there were 532 single-family home sales in September 2024, a 13 percent decrease from the previous month. The median sales price was $470,000, the lowest recorded in 2024. Cash sales accounted for only 26.5 percent of closed sales, suggesting a decrease in investor activity in the county.

Inventory in Manatee County also rose significantly, with 2,461 active listings, a 39.8 percent increase from September 2023. The months’ supply of inventory remained stable at 3.9 months. The median time to contract in September 2024 was 47 days, a 62.1 percent increase from the previous year.

“Our local housing market has faced some unique challenges this past month, and Hurricane Debby’s flooding certainly played a role in that. The storm not only disrupted the daily lives of our residents, but it also impacted buyer confidence and delayed many transactions. We’re seeing the effects of that in slower sales as the community recovers,” said Tony Barrett, 2024 President of the REALTOR® Association of Sarasota and Manatee. “We should expect to see similar trends in October as well.”

TOWNHOMES AND CONDOS

In Sarasota County, the townhouse and condo market recorded a 21.2 percent year-over-year decrease in closed sales, with 230 transactions. Cash sales accounted for 59.6 percent of these transactions. The median sale price increased to $380,000, up from $345,000 in August 2024. Sellers received 93.5 percent of their original list price, a 1.7 percent decline compared to September 2023.

Inventory for Sarasota townhomes and condos increased 36 percent year-over-year to 1,617 active listings, resulting in a 5.4-month supply of inventory. The median time to contract increased by 46.2 percent yearover-year to 57 days.

In Manatee County, townhouse and condo sales dropped by 25.5 percent year-over-year, with 164 sales recorded. Cash transactions made up 43.9 percent of the sales. The median sale price decreased to $319,990. Sellers received 93.6 percent of their original list price, a 1.2 percent year-over-year decline.

Inventory for townhomes and condos in Manatee County remained stable at 1,316 active listings, leading to a 6-month supply of inventory. The median time to contract increased 58.7 percent year-over-year to 73 days.

SUMMARY

While the Sarasota and Manatee housing markets experienced a temporary slowdown in September, largely due to the impacts of Hurricane Debby, we expect to see similar trends continue into October as the region faced two additional hurricanes. Despite these challenges, the long-term outlook remains optimistic as the community recovers and rebuilds. Th is hurricane season has been truly overwhelming.

The physical and emotional toll it’s taken on us as a community is profound, and for many of us, recovery feels like a daunting journey. But now is the time to stand together, lean on each other, and rebuild with compassion, resilience, and hope. I recently had the privilege of speaking with Caroline Mitchell, a local Realtor with Michael Saunders & Company, who has been actively supporting the recovery efforts. Her story is a reminder of the strength that comes when a community unites in compassion.

Today, in 2024, I can confidently say that this has been one of the best years of my 27-year real estate career. I no longer feel the need to follow others; instead, I’ve developed my own leadership style that balances business success with personal fulfillment.

Condo Rider Revisions & FEMA 50% Rule

Florida, southwest Florida in particular, has had a rocky start to the 4th quarter.

While many are and will continue to be recovering from Hurricane Debbie, Hurricane Helene, and Hurricane Milton, for the foreseeable future, there is no better time for a refresher on the changes that were implemented to our contracts at the beginning of October as well as everyone’s beloved FEMA 50% rule.

There has been no shortage of condominium-related news and changes over the last year. Most recently, an updated condo rider was released to be used beginning October 1, 2024. The Condo Rider now reflects recent amendments in the last legislative session to Florida Statute 718, which is the governing statute for Condominiums in Florida.

CONDO RIDER REVISED TO INCLUDE A BUYER ACKNOWLEDGMENT DISCLOSURE SUMMARY:

ƒ The Condominium may have minimal common elements

ƒ Portions of the building may be governed outside of the Condominium’s Declarations if that part of the building is not a part of the Condominium definition

ƒ The Condominium Association and the Unit Owners are responsible for their shares of expenses, even if related to maintenance and operations of portions of the building not within the Condominium-shared elements

Beginning October 1, 2024, a new flood disclosure requirement was also implemented. The new Flood Disclosure is available now and will be required on all residential transactions with an effective date of October 1, 2024, or later. The disclosure contains the statutorily required language, which allows the Seller to easily select whether a claim has been made or assistance has been received.

Homeowner’s insurance policies do not include coverage for damage resulting from floods. Buyer is encouraged to discuss the need to purchase separate flood insurance coverage with Buyer’s insurance agent.

1 | Seller has OR has not filed a claim with an insurance provider relating to flood damage on the property, including, but not limited to, a claim with the National Flood Insurance Program.

2 | Seller has OR has not received federal assistance for flood damage to the property, including, but not limited to, assistance from FEMA.

3 | For purposes of this disclosure, the term “flooding” means a general or temporary condition of partial or complete inundation of the property caused by any of the following:

a. The overflow of inland or tidal waters.

b. The unusual and rapid accumulation of runoff or surface waters from any established water source, such as a river, stream, or drainage ditch.

c. Sustained periods of standing water resulting from rainfall.

It is imperative that Realtors® stay abreast of these changes and ensure that all of their listings, as well as contracts (as applicable), are updated to comply with these new requirements. Sellers should be advised of these updated disclosure requirements to ensure they are accurately updating the information being provided to Buyers. Buyers should also be made aware of the changes so all pertinent documents are reviewed.

WHAT IS THE 50% RULE?

The FEMA 50% rule is a National Flood Insurance Program (NFIP) regulation that limits property improvements to under 50% of a property’s market value before imposing additional requirements on the owner for standards of improving the property.

WHO DOES IT APPLY TO?

This rule applies to all properties located in a Special Flood Hazard Area (SFHA). In the event that the damage to the structure is less than 50% of the market value, then an owner can make all of their desired repairs as planned. If the cost exceeds 50% of the market value, the structure is deemed to have substantial damage, and an owner may be required to ensure that the entire structure is updated as needed to meet current flood regulations.

HOW IS MARKET VALUE CALCULATED?

Market value is calculated differently in different jurisdictions, it is always recommended to consult with your local building department to ensure you have the appropriate calculation. Generally speaking, the value is tied to the building value assigned to the structure on your tax bill with an adjustment. For example, in Sarasota County, the building value is + 20%.

HOW IS THE COST OF REPAIRS CALCULATED?

The costs are calculated to include all costs for items being purchased, including appliances, repairs to other parts of the structure occurring at the same time, costs for materials, and labor. Costs for surveys, development plans, and specifications, as well as the permits themselves, are excluded from the calculation.

SO, THE 50% RULE APPLIES, NOW WHAT?

One option is to reduce the scope of work so that it is less than 50% of market value and avoid triggering the rule. This option may not be practical in instances where you are remediating damage, in which case it is important to work with your local building department to ensure you understand what additional items outside the scope of your original plan may be required – these could include additional steps like elevating the structure above the base flood elevation, using floodproofing, etc.

Ultimately, the goal of the rule is to ensure that as structures are repaired or rebuilt, they are being made more “floodproof” to help mitigate future damage.
