We have reached the midpoint of the year, and it’s clear that 2024 has been full of adventures. Despite facing some challenges, our tone remains very positive, and we have achieved some great outcomes. I am incredibly proud of the work of our committees and specialty groups.
Our Young Professionals Network and Commercial Real Estate Alliance have successfully raised funds for the RASM
REALTORS® Charitable Foundation, benefiting our community and our members in need. Our business partners have been busy organizing fantastic events and supporting our mission. Community Outreach has been working closely with veterans in need, and our Leadership Academy is preparing for an impactful waterway cleanup. These are just a few examples of the tremendous work our volunteer committees have accomplished, and the year is far from over.
As we turn the page to a new chapter in real estate, making significant changes to our business practices, I am honored to work with the best professional leaders and staff in the industry. Our Leadership Team, Board of Directors, and staff are truly the best in class. RASM is a well-oiled machine.
The upcoming changes will be in effect very soon, and our association has been proactive every step of the way. We have followed the guidance from The National Association of REALTORS®, Florida REALTORS®, and Stellar MLS to compile all the necessary information. You can find it all on our website under the “NAR Litigation” section at the top of our home page, including FAQs, the history of the settlement, and the changes that will impact your business. It may seem overwhelming, but together, we will navigate this transition.
Many people are not fond of change, myself included, but I believe the first 60 days will be crucial in defining our success. Now is the time to show your value to your clients by being welleducated, managing expectations, clearly communicating, and most importantly, remaining professional.
If you have been in this industry for any length of time, you know that change is inevitable. Embrace it! Change is the new normal, and once we overcome this speed bump, we will tackle the next challenge. The strong will survive, so be cautious and make informed decisions.
I always look forward to meeting and talking with our members. I encourage you to reach out anytime with questions or thoughts on how we can improve our association. Thank you all for giving me the opportunity to serve this year. •

Realtor® Z, a broker and sole proprietor, had invested considerable resources into developing her website. Seeking to recoup some of her costs, she approached virtually every provider of real estate-related products and services in her area, including financial institutions, title insurance companies, home inspectors, mortgage brokers, insurance agencies, appraisers, exterminators, decorators, landscapers, furniture and appliance dealers, rug and carpet dealers, moving companies, and others about purchasing banner advertisement space on her website. As a condition of having a link to their own sites appear on her home page, Realtor® Z required that a fee be paid to her each time a consumer “clicked through” from her site to an advertiser’s.
Ads for providers of real estate-related products and services who agreed to Realtor® Z’s terms appeared on her home page under the heading “Preferred Providers.” Immediately under that heading read: “These vendors provide quality goods and services. Please patronize them.”
Buyer A frequented Realtor® Z’s website seeking information about available properties. Using that website, he became aware of a property on Elm Street that he made an offer on through Realtor® Z, which was accepted by the seller. The sale closed shortly afterwards.
Buyer A was an avid remodeler and, using Realtor® Z’s website, linked to the Real Rug company website, among others. Interested by what he found there, he subsequently visited their showroom in person and purchased wall-to-wall carpeting and several expensive area rugs.
Given the size of Buyer A’s order, one of the owners of Real Rug came to oversee the delivery and installation. In the course of conversation with Buyer A, he commented favorably on the amount of referral business received from Realtor® Z’s website. “And to think I only pay a small fee for each customer who’s referred to me by Realtor® Z,” he added.
Buyer A was somewhat surprised that Realtor® Z would receive money for referring clients and customers to providers of real estate-related products and services and contacted the local association of Realtors®. The association provided him with a copy of the Code of Ethics. Reading it carefully, Buyer A concluded that Realtor® Z’s actions might have violated Article 6, and he filed an ethics complaint against Realtor® Z.
At the hearing, Realtor® Z defended herself and her website, stating that the advertisements for real estate-related products and services on her website were simply that, only advertisements and not recommendations or endorsements of the products and services found there. She acknowledged she collected a fee each time a visitor to her website clicked on the links found under “Preferred Providers” but claimed that simply referring to those advertisers as “preferred” did not constitute a recommendation or endorsement of the products and/or the services offered.
The hearing panel disagreed with Realtor® Z’s reasoning, pointing out that a reasonable consumer would certainly conclude that referring to a provider of real estate-related products or services as being “preferred” by a Realtor® constituted a recommendation or endorsement. Further, since Realtor® Z received a fee each time a consumer “clicked through” to one of Realtor® Z’s “Preferred Providers,” Realtor® Z received a referral fee, and disclosure of that fee was required under Article 6. Realtor® Z was found in violation of Article 6. •

Ever since I became an attorney nearly twelve years ago, I frequently get messages and calls from friends and family (and even super long-lost friends!), who are in dire situations, and hoping I can save the day. The most popular of these requests goes something like this: “John’s grandpa is in the hospital and isn’t going to make it; can you send us a power of attorney for his grandpa to sign?”
Typically, a Power of Attorney (POA) isn’t going to be helpful at this late point because John’s Grandpa must have capacity (he must know what he is doing) to make a valid POA, and it is only valid while John’s Grandpa is alive. That’s right, a POA is no longer valid once John’s Grandpa (known as the “Principal”) dies. However, if a POA is valid, and is drafted timely, it can be very helpful in numerous scenarios. Let’s slightly modify the above example: John’s Grandpa came to my office five years ago at the anticipation of his “golden years” and he put in place an estate plan setting out who would inherit his assets upon his death, what health decisions should be made if he becomes incapacitated, and he appointed John, as “agent” to act on his behalf in various scenarios, including real estate transactions.
In Florida, the use of a POA for real estate transactions is subject to strict requirements in order to prevent fraud and ensure authenticity; the four main requirements for validity are:
1 | The POA must be signed by the principal in the presence of two witnesses and a notary public.
2 | The POA must be recorded in the official records of the county where the property is located, which serves as public notice of the agent’s authority to act on behalf of the principal, thereby protecting third parties involved in the transaction and ensuring transparency.
3 | The POA must specifically grant the agent the authority to conduct real estate transactions. In other words, the POA must specifically state that the Agent has the authority to buy, sell, lease, or otherwise manage the real estate. If the POA only grants general powers to manage the principal’s affairs (and does not specifically mention the real estate), then the POA is not valid for the agent to make real estate transfers.
4 | The POA must comply with all provisions of the Florida Power of Attorney Act, which are set out in Chapter 709 of the Florida Statutes.
John can now sell his Grandpa’s home, while his Grandpa is still alive, because his Grandpa has a properly executed POA. It is imperative to confirm the validity of a POA prior to moving forward with a Florida real estate transaction. A licensed Florida Attorney is best suited to confirm validity of a POA. •

With the primaries a few weeks away and the November general not far behind, the RASM Board of Directors and Public Policy Committee released the first round of candidate and ballot initiative endorsements for the 2024 election cycle. The Board and the Committee take this responsibility seriously and many hours are spent interviewing and vetting candidates running for local and state office positions.
Many factors go into the decision to give a candidate the REALTOR® Association endorsement, but above all is the candidate’s knowledge and support of issues that impact you, your clients, and your bottom line. Interview questions from the Committee are focused on Realtor® issues: Will this candidate support private property rights? What’s their plan to address our affordable housing crisis? Do they believe in smart growth? Will they support quality of life issues that impact housing values like water quality and a thriving school district? And so on.

The Federal Housing Administration (FHA) recently announced changes to its 203(k) Rehabilitation Mortgage Insurance Program. NAR previously submitted comments to FHA, seeking updates to the program to ensure they remain consistent with market trends and are more accessible and streamlined for all homebuyers. Specifically, FHA is updating the 203(k) loan program by:
Increasing the maximum cost of the limited 203(k) program to $75,000 from $35,000. FHA also created an annual review process for updating the maximum allowable amount.
Extending the rehabilitation period for the standard 203(k) to 12 months.
Increasing the number of months of financeable mortgage payment reserves.
The 203(k) Rehabilitation Mortgage Insurance Loan Program provides low to moderate-income buyers with the opportunity to purchase homes in a broader range of the market while simultaneously revitalizing the housing supply stock. e REALTOR® Association of Sarasota and Manatee (RASM) released its monthly market report detailing the real estate trends for June 2024. According to the data compiled by Florida Realtors®, the data highlights a trend towards a more balanced market across both counties, with increasing inventory levels and more moderate price changes. The shift in inventory suggests that buyers may find more opportunities, while sellers may need to adjust expectations in light of the growing competition. Monthly reports are provided by Florida REALTORS® with data compiled from Stellar MLS.
Sarasota County: The Sarasota County real estate market in June 2024 exhibited a trend towards a more balanced market with significant increases in inventory levels for both single-family homes and townhouses/condos. There was a noticeable decline in closed sales and median sale prices across both segments, suggesting a cooling off from the previously high demand. The increase in active listings provides more opportunities for buyers, while sellers may need to adjust their strategies in response to the growing competition and shifting market conditions.
Manatee County: The Manatee County real estate market in June 2024 shows trends of increasing inventory levels and moderating price changes. For single-family homes, the market is moving towards balance with a slight decrease in closed sales and median sale prices, coupled with a significant rise in active listings and new listings. In the townhouses and condos segment, there is a more pronounced shift towards a buyer’s market, with a substantial increase in inventory and a notable decline in closed sales and median sale prices. Sellers appear to be more cautious in listing new properties, reflecting adjustments to the changing market dynamics.
The market for single-family homes in Sarasota County showed a decrease in demand, with 692 closed sales, a 10 percent decrease compared to June 2023. The median sale price also decreased by 5.3 percent to $495,000. The total dollar volume decreased to $477 million, reflecting a 16 percent year-over-year decline.
However, inventory levels saw a significant rise, with 3,211 active listings, a 65.3 percent increase, leading to a months supply of inventory at 5.0 months. The median time to contract extended to 50 days, up 117.4 percent, and the median time to sale increased by 32.9 percent to 93 days. Manatee County’s single-family homes market also saw a decrease in demand, with 728 closed sales, showing a
decrease of 4.1 percent compared to June 2023. The median sale price slightly decreased by 1.2 percent to $518,950. The dollar volume reached $536 million, reflecting a 4 percent increase.
Active listings in Manatee County rose by 56.6 percent to 2,508, resulting in a months supply of inventory of 4.0 months. The median time to contract grew by 54.1 percent to 57 days, and the median time to sale increased by 32.2 percent to 115 days.
“We’re seeing a decline in closed sales for single-family homes in Sarasota and Manatee counties. This could be due to a combination of higher interest rates, which make borrowing more expensive, and economic uncertainty, which makes people hesitant to commit to large purchases like homes,” said 2024 RASM President Tony Barrett, Broker/Owner of Barrett Realty.
The townhouse and condo market in Sarasota County experienced a decline in demand, with closed sales dropping by 25.7 percent to 283. The median sale price slightly decreased by 1.5 percent to $384,060. The dollar volume also saw a decrease of 21.8 percent, totaling $164.5 million.
Inventory for townhouses and condos increased by 81.6 percent to 1,941 active listings, resulting in a months supply of inventory of 6.3 months. The median time to contract increased by 68.6 percent to 59 days, and the median time to sale rose by 32.1 percent to 107 days.
The townhouses and condos market in Manatee County also experienced a decline in demand, with closed sales dropping by 17.2 percent to 246. The median sale price decreased by 6.9 percent to $344,495. The dollar volume saw a decrease of 26.8 percent, totaling $102.4 million.
Inventory levels for Manatee County townhouses and condos increased by 72.3 percent to 1,330 active listings, leading to a months supply of inventory of 5.8 months. The median time to contract rose by 114.7 percent to 73 days, and the median time to sale increased by 45.6 percent to 115 days.
The slowdown in the Sarasota and Manatee housing markets is a multifaceted phenomenon influenced by rising interest rates, economic uncertainty, seasonal factors, market saturation, and evolving buyer preferences. While this cooling off can lead to more balanced market conditions and opportunities for buyers, it also requires sellers to adjust their strategies to navigate the changing landscape effectively. Monitoring these trends and adapting to the economic environment will be crucial for stakeholders in the real estate market.
“The single-family home market is shifting a bit in Sarasota and Manatee counties. This cooling trend highlights the importance of staying adaptable. Even so, the market remains vibrant, with plenty of opportunities for those looking to buy or sell,” added Barrett.

Despite being in the eye of hurricane season, I would like to focus on a term not often associated with Florida’s insurance market in recent history: optimism.
For the first time in several years, there is reason for legitimate optimism in the Sunshine State’s insurance industry. Carriers, agents, and policyholders endured the wrath of a hard insurance market for quite some time. By now, everyone has repeatedly heard the laundry list of reasons for increased rates, reduced coverages, and weakened terms:
“Fewer carriers are writing business in Florida!”
“Those darn attorneys! We have 14.9% of the nation’s claims but 70.8% of litigation!”
“Reinsurance rates have been steadily increasing.”
“Record-setting storms like Ian and Irma have scared property carriers.”
And the list goes on...
However, all signs are pointing towards better days ahead and a new sense of hope. The Office of Insurance Regulation (OIR) is forecasting market stabilization following the historic 2022 and 2023 legislative reforms. Rate filings for 2024 show a slight downward trend, with ten carriers filing a 0% increase and eight filing a decrease. Reinsurance has also responded positively to Tallahassee’s reforms. Likewise, after consecutive years of underwriting losses, many carriers reported net profits in 2023. Citizens is a prime example indicating a turning of the tide. The “Insurer of Last Resort” has reported a 2023 net income of $746 million compared to a $2.2 billion loss in 2022. Furthermore, they are achieving their goal of depopulation, with 350,000 policies assumed by thirteen traditional carriers in the first quarter of 2024 alone. This follows 650,000 policies being assumed by twelve carriers in 2023.
So, what could derail the improving, softening insurance market? Let’s keep our fingers crossed for a peaceful, uneventful hurricane season free from any Andrew’s, Charley’s, Irma’s, or Ian’s. It is not yet time to spike the ball in the endzone, but there is reason for optimism. Staying informed and prepared can help you navigate and capitalize on these positive changes. The Women’s Council of Realtors® Sarasota’s biggest event of the year is right around the corner! The popular Annual Fashion Show and fundraising gala celebrates a milestone anniversary this year and it promises to be the biggest event yet.
With a fun new theme, the “Welcome to The Jungle: 30th Annual Fashion Show” will be held at the Ritz Carlton on Thursday, October 24 at 11:00 a.m. The theme is “jungle,” because as we all know, real estate is one big jungle we navigate through every day! Most proceeds from the Gala will go to our charity of choice this year, which is Selah Freedom. Selah Freedom is a local non-profit, anti-human trafficking organization. Selah Freedom offers five pillar programs: Awareness, Prevention, Outreach, Residential and Consulting. They provide essential education and support services to those who have been victimized by human and sex trafficking. WCR was fortunate enough to have a tour at their safe house here in town. It was a very deep and emotional experience as we learned where some of the victims came from, how they ended up in a safe house and how they have to learn from scratch how to be an adult and live day to day on their own. Spending the day with the team at Selah gave us a huge appreciation to them for everything they are doing to help support local victims and survivors through their recovery phases, preventing future young people from becoming victims while providing more awareness about human trafficking to the community at large.

In real estate, we often emphasize customers’ outward behaviors and relevant sales statistics rather than the mental and cognitive processes that precede the sale. While listening to customers and sharing easy-tounderstand statistics about a particular area is crucial, understanding how consumers process information to make memories and decisions is equally as important. The interdisciplinary nature of real estate, involving economics, statistics, marketing, and various subfields of psychology and neuroscience, is often overlooked. To truly understand customers and their behavior, we must delve into their minds and the processes that underpin their memory, learning, and decision-making. As a Realtor® with a background in cognition and neuroscience, I aim to shed light on these critical topics.
While factors such as interest rates and inventory are certainly relevant, consumer behavior fueled by pain and pleasure is often thought of as the engine of the real estate market. When interacting with customers facing different emotional circumstances, you might notice there is a difference in their ability to recall previously presented information and grasp new information. That is because there is a proven correlation between emotions and memory!
Here in Florida, we see vacationers and seasonal visitors who have decided to purchase a second home or an investment property. Conversely, we also see grieving family members needing to sell the property of a recently deceased loved one. The neurochemical states of the two groups are markedly different and affect memory. Vacationers and “snowbirds” are experiencing happiness, which involves high levels of the neurotransmitters dopamine and serotonin, while grieving family members are experiencing sadness and stress, which involves high levels of cortisol and decreased levels of the neurotransmitters associated with pleasure. Memory formation is much better in states of pleasure than pain. To elaborate further, neuroscientists and researchers have also found that cortisol and low levels of certain neurotransmitters such as dopamine and serotonin inhibit frontal lobe function associated with memory formation, decreasing the probability of new information reaching long-term memory, mainly located in another area of the brain called the hippocampus. Perhaps this is part of our “fight or flight” mechanisms protecting our overall mental health and well-being by filtering out memories from difficult times in life, but it doesn’t always work to our advantage.
At some point, you might have heard the term “neural network.” This term refers to the interweaving webs of brain cells called neurons composing the brain. Billions of neurons are in constant communication with each other, sending information along the brain’s many highways.
While the brain works as a whole unit, different parts of the brain that serve similar functions are closely wired together and speak to each other. For example, a piece of information must first be encoded and successfully stored as a short-term memory before it can become a long-term memory. This speaks to the connectedness of the prefrontal cortex, which is the primary player in short-term memory, and the hippocampus, mentioned previously as the main component in storing long-term memories. Although they are anatomically distant, they both play vital roles in memory and related processes, such as learning and decision-making. This is why, as Realtors®, it is essential to make a positive first impression, present information clearly in an easy-tounderstand way, such as utilizing an infographic, cater to customers’ individual needs and learning style, and not overwhelm customers because they might already be feeling that way in certain situations like a cross-country move – promote dopamine and serotonin, not cortisol!
While this was only a brief introduction, my hope is we can continue making our business brain-friendly while fulfilling our customers’ needs to the best of our ability. •
