The great commission rate debate! We use Cape Talk radio frequently to promote our magazine or other issues relevant to property. Last month, our flighted advert seemed to prompt some rather vocal discussion from listeners about real estate agents. It made for interesting listening! It seems that some people still have problems with the perception of real estate agents. In trying to summarise the types of issues raised, these seemed to fit into 3 main categories: • Buyers who lost a house to another buyer • Buyers who felt that the property had been

misrepresented by the agent • Sellers who felt that the agent charged too much after doing too little
Buyers who ‘lose’ houses The problem, particularly in an active market, is that when there are multiple offers on a property, someone is going to lose out. It is up to the agent, after taking instructions from the seller, to inform the purchasers the ground rules applicable to this situation. Sometimes, the seller would prefer the agent to play one offer off against another (a kind of auction situation) – always unpleasant for buyers and generally, we would advise against this as all buyers could get annoyed and withdraw completely. The best way of dealing with this situation (always remembering that it is the seller’s call) is to encourage each buyer to offer his ‘best and final’ and then present all offers in an unbiased fashion to the seller for him to decide. It is also important to remember that the agent is acting on instructions from the seller as the seller is his ‘employer’. A buyer has no recourse to the agent or seller for not accepting his offer.
Buyers who believe the property was misrepresented There is little point in an agent deliberately misrepresenting a property in order to make a sale. An agent would need to be delusional if they thought they would not be caught our by doing this. The Code of Conduct for Estate Agents is a sound measure for how an agent is required to act – as is common law and in certain instances, the Consumer Protection Act. Often, however, there are instances which give rise to the buyer being disappointed with his purchase. Remember that until occupation, the buyer has no history with the property and it is only after experiencing being there that the buyer is able to ‘test drive’ his property. So, the trickle of water in the shower, the door that sticks, the smell of damp in the storeroom, the noisy pool pump, the leaky roof after the winter storm – this must all be the agent’s fault! Sometimes, there are issues which simply did not occur to the seller to disclose as he had lived with them for all these years. They do tend to irritate the new purchaser, however.

farm and created an unrealistic expectation of price) and I ended up selling the property for 50% less than the ‘asking price’ to a friend of mine! Sharp estate agency that!
Obviously, it is in our interests to justify why the levels of commission are charged with respect to a property sale. Suffice to say, though, that as with any commodity trading and the value placed thereon in terms of supply and demand, commission rates are most certainly negotiable. I recall in 1999 trying desperately to sell a farm on which I had a high bond (remember the bond rates of 24%?). I would willingly have paid an agent 10% and more to get the noose from around my neck. The agents ended up being absolutely useless (they had overvalued the
What most people do not follow is the huge costs in selling property. It was interesting to follow some of the Cape Talk listener comments about the fact that large companies had to charge more because of their huge office costs. This is not strictly the case – marketing of property is by far the largest cost – making the office rentals seem insignificant. If one compared the marketing which goes into the promotion of popular motor cars, this in itself supports the prices asked and paid for these vehicles. It is less about the showrooms. The marketing support
collateral assists in the proper promotion of our clients’ properties. Compare the marketing collateral for a Mercedes with that of a lesser brand. As an aside, many larger national companies can afford to give commission discounts because they are able to support their cost structures from the large sales volumes they do – as opposed to a smaller brand which might need to support the lower turnover by charging more! An agent I employed some years ago (who charged 5%) would comment to the seller – ‘let me worry about my 5% - you need to worry about your 95%! This was sound advice, really, as the agent who cannot protect her earnings is hardly likely to defend the seller’s asking price.

It’s a good time to sell as the housing market continues trending upwards While the minor interest rate fluctuations over the last few years has had only a marginal effect on property demand and sales, we nonetheless believe that it is important that stability is maintained. In this light then, the recent decision by the Reserve Bank’s Monetary Policy Committee to keep the repo rate unchanged at 5,75% (9,25% base mortgage loan rate) is welcome news, especially as the housing market continues its upward trend. Having said this, home owners and buyers are cautioned to start preparing for a cycle of interest rate hikes over the next year. Economists predict at least a 100-basis point hike, likely to be introduced in small increments of around 25-basis points over the next few quarters. On the whole, sales activity is showing real upward movement for the first time since the 2007/8 down-turn, not only in the primary urban sectors, but also in the secondary coastal markets. The market is now nicely balanced with strong demand and tight supply. Where conditions were overwhelmingly in favour of buyers, the pendulum has now shifted in favour of sellers. Buyer urgency has grown, there is limited supply of property and, we are consequently seeing real activity in the market. Our branches report that not even the cold winter kept buyers at bay and they continue flocking to show houses in record numbers. Multiple offers are becoming common place with sellers getting close to and, in some instances, more than their asking price. Where it took about 20 weeks to sell the average home post 2009, it now takes about two weeks. While the slow economic and job growth and inflationary pressure remain worrying factors, the property market seems to be defying the economic trend. As we head into the summer months, we anticipate the strong activity to continue. With demand now considerably outstripping supply almost across the board and, given that summer is traditionally the time when buyers tend to start shopping for a new or second home, those looking to sell right now, should do so. Sellers should not be able to find a buyer well within two months. If not, then it is likely to be the wrong price or wrong choice of agent. Now is the right time to sell, but be sure to choose the right agent and hit the market at the right price. What is Home Automation? Home automation (also known as domotics) refers to the automatic and electronic control of household features, activity, and appliances. HISTORIC HOUT BAY Hout Bay (Afrikaans: Houtbaai, meaning “Wood Bay”) is a town near Cape Town, South Africa situated in a valley on the Atlantic seaboard of the Cape Peninsula, twenty kilometres south of the Central Business District of Cape Town. The name “Hout Bay” can refer to the town, the bay on which it is situated, or the entire valley.
Early Dutch settlers soon realised that Hout Bay could serve as an alternative anchorage when prevailing winds made Table Bay unsafe. However, successive Dutch and British administrations also perceived that the bay offered a possible landing place to an invading military force. Consequently, towards the end of the 18th century, the area saw the construction of a number of fortifications, first at the foot of Hangklip, and later on the eastern side below Chapman’s Peak. Initial developments took place after 1775, when both France and the Netherlands came out in support of the newly-independent American

As a historic and still-working fishing village, Hout Bay’s local colour and beautiful scenery make it a popular tourist attraction among both local and international visitors. There are a variety of fine restaurants in the village as well as two hotels (the Hout Bay Manor and the Chapman’s Peak Hotel), many bed and breakfasts and self-catering accommodation where visitors can stay. The harbour is a worthwhile visit, with restaurants, fresh fish outlets and craft stores, with spectacular views of the bay and boat rides to Duiker Island and around the Sentinel. Chapman’s Peak Drive is one of the world’s most scenic mountain drives and has recently undergone renovations to ensure the safety of travellers using the route. The East and West forts built by the Dutch in the 18th century can also be visited, with the original cannons and barracks still standing on the slopes of Chapman’s Peak. The East Fort is the oldest operating gun battery in the world. The mountains surrounding Hout Bay also make for good hiking trails. In the same area is a famous bronze statue of a leopard on a rock at the water’s edge, looking out over the ocean.
Hout Bay is a sheltered cove along South Africa’s Cape Peninsula. Before European settlement, the area was populated by Khoisan hunter-gathers who lived largely off the ocean’s bounty. By the 17th century the Cape Peninsula and it’s numerous safe harbors became highly coveted by Europe’s seafaring powers. Thus did Jan van Riebeek arrive in Table Bay (Cape Town) in 1652 to set up a refreshment station for the Dutch East India Company. It wasn’t long before the company looked into the feasibility of settling in other areas along the peninsula. Van Riebeeck had first visited Hout Bay in 1653. Upon arriving, he named it ‘T’Houtbaaitjen’ (Dutch for ‘Bay of Wood’), noting in his journal that its mountainous slopes held ‘the finest forest in the world’. Indeed, by this time the thinner forest around the more arid Table Bay side of the mountain were already under pressure, and the company was in dire need of wood for building and fuel. Woodcutters then soon set to work near Hout Bay, sending the timber around the mountain to Table Bay by ship. In 1677 as the thick forest was being cleared, the first agreement to rent land was signed and a small farming community began to flourish in Hout Bay. Attention also turned to the nearby sea and a thriving fishing community soon formed. By the early 1800’s they were able to catch fish in sufficient quantities for export to Mauritius. To this day, Hout Bay is home to a small, working fishing fleet. As for the marvelous forests that had caught van Riebeeck’s eye, they were never extensive and barely lasted a generation. Though trees now cover large areas of the mountain slopes once again, they are mostly of exotic species.

When the Dutch established a colony in Table Bay in 1652, a great quantity of good timber was required for construction, shipbuilding and other purposes. There was no large forest in the immediate vicinity of the settlement, mainly because the rainfall was not high enough. It was soon apparent that the colonists would be able to fell wood they needed in the wetter valley that lay on the other side of a low pass (called Constantia Nek) between the southern end of Table Mountain and Constantiaberg.[2] The area was originally made up of two farms, which were slowly subdivided to make way for urban expansion. While still maintaining its rural atmosphere, the area of Hout Bay has more than 12 000 residences inhabited by a population of about 42 000 people.

In 1794 this was replaced by three new forts, named Sluijsken, Gordon and Little Gibraltar. A fortified blockhouse was then built by the British in 1796, on the eastern side of Hout Bay. By 1804 these establishments were in need of restoration, and although the new Batavian administration attended to their maintenance, by 1827 all these fortifications had been abandoned. It was declared a National Monument under old NMC legislation on 17 April 1936. The remains of the western Battery, located at the foot of Hangberg, was proclaimed on 31 March 1939.

BEETLE COC Is a beetle certificate of clearance required by law? No, there is no law that obligates a seller to provide a Beetle Free Certificate. Then why are properties being inspected for beetle when they are sold? This dates back to the 1940’s when wood destroying insects were infesting properties on an epidemic scale. Financial institutions would not issue a bond to a buyer unless the property to be mortgaged was declared free of wood-destroying insects. And so the need was established for suitably qualified people to carry out inspections, and where infestation was identified, recommend remedial measures to eradicate such infestation. This requirement was written into the Offer to Purchase and it became the seller’s obligation to provide the Beetle Free Certificate.
WATER INSTALLATION COC The City of Cape Town introduced a new water by-law in 2010. It stipulates that before a property can be transferred, a COC must be issued for the water installation. It is a local by-law and only applies to properties sold where the City of Cape Town is the municipal authority. A new certificate needs to be issued each time a property is transferred. Does the Water installation certificate cover all of the plumbing? No, this certificate IS NOT a plumbing certificate. It is limited to the by-law and is not as comprehensive as a plumbing certificate. Some buyers will assume that this COC addresses all plumbing defects. ELECTRIC FENCE COC Since 1 October 2012, an electric fence certificate must be issued when there is a change of ownership of the premises on which such electric fence exists. The certificate is valid for 2 years.

Summer is here and our gardens are ready to entertain and feed us We are well into spring now and everyone is gearing up for a fantastic summer. What better time is there than now to get stuck into those gardening chores, getting the flowers flowering and the lawn green? This month we have some great tips from Life is a Garden.
What’s happening in the Western Cape Do not mow your lawn for a week prior and a week after spraying it with herbicides. This might irritate you, but it will give the herbicide the best chance to deal with the abundance of pesky weeds, which sprouted during winter. Start mulching your garden, leaving no bare earth uncovered – this will help the garden cope with high temperatures and hot summer winds to come. Watch out for red spider mite on roses, fuchsias and Azaleas. Now that waterblommetjies are starting to go dormant in ponds, try something grassy around the edge and in the water. Go for tufty Juncus effusus, a perennial grass- or reed-like plant, which loves growing in streambeds and marshes. For colour all summer, plant pelargoniums! These beauties like plenty of light welldrained soil, water when the soil feels dry and good air circulation. Feed them every two weeks with a water-soluble fertiliser – they are very tough, but very hungry plants! Spray your apple and pear trees towards the end of the month for coddling moth. Keep on watering citrus trees regularly and deeply. Cucumbers are quick growers and ready for harvesting in only 2 months. They can be planted in the garden or in pots as they grow upwards and do not take up much space. Ensure that soil is well composted and kept 56 | THE PROPERTY PAGES | OCTOBER 2014
moist. Fine Mediterranean herbs to grow are Rosmarinus ‘Tuscan Blue’ with its lovely sky blue flowers and long stems (which can be used as fragrant skewers for sosaties), Santolina chamaecyparissus (cotton lavender) with aromatic, lemony smelling, grey foliage and mustard yellow pompom flowers.
Hot tip: Place sprigs of cotton lavender amongst clothes, linen, under carpets and books to deter moths and dry the flowers for arrangements and potpourri. An excellent plant for borders and knot gardens.

TRANSFER DUTY
The point of departure is the Transfer Duty Act which provides that transfer duty is payable on ‘the acquisition’ of property. This effectively means transfer duty is payable in all property transactions, except where specifically exempted. The liability to pay transfer duty rests on the shoulders of the purchaser and a transfer duty receipt must be lodged in the deeds office before the Registrar will pass transfer.
