SO JUST WHEN WE THOUGHT IT WAS THE RIGHT TIME TO GO OUT AND BUY A HOUSE ...EVERYONE ELSE THOUGHT SO TOO New records for showhouse attendance are being set as we speak. With the serious lack of good properties for sale, buyers are beating one another to showhouse doors in the hope of securing the property of their dreams – and in some cases, even settling for next best because of the low numbers of properties for sale. I have never thought it clever of an agent to suggest a list price for a property and then to end up selling it for more than the list price. There seems to have been a trend of allowing for some negotiation in setting list prices. Well, this has recently allowed certain sellers to achieve full price offers because of the high demand for property in certain areas.

JUST WHEN WE THOUGHT THAT EVERYONE WANTED TO MOVE CLOSER TO TOWN The Constantia property market has really surged this year. There are over 65 000 ‘front doors’ in the traditional Southern Suburbs (Observatory to Tokai) – roughly 5 000 of these would have Constantia addresses (or around 7.5%). The Southern Suburbs annual sales turnover this year looks like it will be close to R5,0 billion. Constantia sales values look set to reach or even exceed R1,0 billion (that is 20% by value of turnover of the entire area). During the quieter years (pre 2012) the Southern Suburbs market reflected annual sales of around R3,0 billion – the discrepancy here would have been largely as a result of the slowness of the upper end of the market – and much of this would be explained by the slow Constantia sales during these years. Constantia property represents good value for money as property price growth in Newlands, Rondebosch and Claremont/Kenilworth has outpaced the growth of Constantia prices. It is now the turn of Constantia. Recent sales reflect this. Compare the recent Seeff sale in Newlands where a newly developed ‘town’ house on less than 1 000 square metres has just sold for R7,3 million. Have a look at the properties in this publication and see what value there is in Constantia at this price.
HOW TO MAKE FRIENDS IN PROPERTY – OR NOT Agents are often accused (and sometimes rightly so) of talking the market up to buyers and down to sellers. The market is what it is – and there is absolutely no point in gilding the lily nor is there anything to be gained by misrepresenting value in any way. “Let’s value the property high so we can get the mandate” is not only immoral, unethical or just plain stupid, but it is actually against the Code of Conduct for Estate Agents. Many of us who provide realistic, market related valuations for property often lose a mandate to sell the property to an agent who claims to be able to perform miracles with their idea of pricing. In most of these instances, these properties languish on the market and eventually are either withdrawn, rented out or sold at substantially lower prices. Small consolation for the ‘honest agent’ who told the seller the truth. So as agents, we are often damned if we do, and damned if we don’t. The seller mostly wants to hear what he wants to hear – and what he most wants to hear is the highest price (and it seldom matters from whom).

HOUSING MARKET IN THE HEALTHIEST POSITION SINCE 2009 The South African housing market is in the healthiest position since 2009 and even better than in 2010 when market activity was buoyed by the positive sentiment of the Soccer World Cup. Seeff’s year-to-date sales figures for example are not only 18% up on last year, but the best since 2007. Despite the fact that the winter months are historically a quieter period, our July sales figures are the best in recent years and about 20% higher than in 2007. Leading mortgage originator, ooba also recently reported that its bond approvals were up in August by 24% on a year-onyear basis and 227% higher than in the corresponding period in 2009. This year in particular, we have seen the balance between supply and demand improve and, indications are that we are moving closer to a position of equilibrium in the primary housing market.

For the first time since pre-2007/8, offers are now being taken on show days. Major stock shortages have become an almost universal challenge for estate agents countrywide. To remain consistent, Ryan would like nothing more than to look back in years to come and see a brand that has kept consistency in its offering to the consumer. Tribakery offers a quality product, matched with an equally good experience. Ryan started Tribakery with the intention of offering people a slice of the Big Apple in Kalk Bay. Tribakery is based on the concept of a combined bakery and restaurant that produces freshly baked goods as well as breakfast, lunch and dinner. It caters for the whole family, and provides everything from simple food to full three course meals. The restaurants are themed and based on TriBeCa in New York.
Ryan New started the business and brand in November 2009. Having always been involved in the hospitality industry, he saw an opportunity to bring a new and fresh concept to the Kalk Bay Main Road. Food and this industry, in particular, is his passion. Ryan is Group Owner of the Tribakery brand and oversees its successful operation. In a short space of time there are now 8 operational outlets with three new exciting stores opening this year. One, in particular, excites him the most, but assures us that he can’t give too much away just yet. Ryan says the Tribakery unique selling point would have to be the ability to cater for all. Having not put the brand “in a box”, so to speak, has seen them through some very difficult economic times. Whether it be a simple coffee and newspaper or coffee and croissant to go, a breakfast get together, lunch, formal meeting, or dinner with the family - they do it all. With the constant challenge of ongoing innovation to stay on top, it is very easy to set something up but then allow it to become stale. Q & A WITH RYAN NEW WHERE AND HOW DID IT ALL START? The concept originated from the need for a eatery of this kind in Kalk Bay. At the time it was never my intention to take the brand further expanding to other parts of Cape Town. Having grown up on this side, and having a love for Kalk Bay I wanted to contribute towards this busy stretch of road. I took over the Old Timeless Way Restaurant and converted it into Tribakery. It was a difficult space to work, but it came out better than I had planned.
HOW DO YOU CHOOSE SITES FOR YOUR RESTAURANTS? Obviously a degree of risk will always come into this. There are various Market Research and Analysis tools that can be used, but I find my gut works best. I have been fortunate, in that every current site was offered to us, and we haven’t had to actively find new sites. It’s a bit of winwin, as we have added incredible value to our current locations.
WHAT INSPIRES YOU, AND WHAT’S THE PROCESS FROM IDEA TO REALITY? My inspiration comes from the satisfaction the brand gives people. Whether it be strangers I overhear talking about the brand or family complimenting me on a good time they had, it all makes it worthwhile. This is a tough industry, and customer satisfaction remains key. As for idea to reality, I have enough belief and understanding in my concept to walk the brand through these steps.

Breast Cancer Awareness Month is observed in October every year. According to the South African National Cancer Registry, one in 29 women in South Africa will be diagnosed with breast cancer. Breast cancer, like other types of cancers, is treatable when detected early. It is important for you to examine your breasts regularly and to go for medical check-ups. The most common sign of breast cancer is a new lump or mass. A lump that is painless, hard and has uneven edges is more likely to be cancer. But some cancers are tender, soft and rounded. It’s important to have anything unusual checked by a doctor. Staging is the process of finding out how widespread the cancer is at the time it is found. The stage of a cancer is the most important factor in choosing a treatment option. The stage is based on the results of the physical exam, biopsy and other tests the doctor may have done. The Western Cape Provincial Department of Health has embarked on a Women’s Health Campaign. The campaign is targeting women from across the Western Cape, who will now be able to access any public health clinic in the province for cervical cancer and breast cancer screening, family planning assistance, antenatal care, contraceptive choices and chronic diseases management. GETTING YOUR GARDEN READY FOR SUMMER It is hard to believe the warmer months are finally here and we can get down to some relaxing gardening under the hot African sun. KIRSTENBOSCH CELEBRATES A CENTURY WITH A GOLD AT CHELSEA What better way is there to celebrate 100 blooming years at Kirstenbosch National Botanical Garden than with a gold medal at Chelsea Flower Show? Well, we did it again and while we never get tired of winning that illustrious medal, we love it more and more every year. Designers David Davidson and Ray Hudson took the South African National Biodiversity Institute’s (SANBI) Kirstenbosch – South Africa exhibit at the 100th Royal Horticultural Society’s Chelsea Flower Show in May to its 33rd gold.
WHAT’S NEW FROM MY GARDEN? I am so excited to bring you one of my new favourites, Fireworks ™. This Pennisetum setaceum or perennial fountain grass brings beautiful colour to your garden. You can use them in borders or containers in full sun. Their dark centre and red colour with pink plumes make for an explosive plant with unique foliage. Prune them back to 15cm at the beginning of spring and wait for them to flourish in the bright South African sunlight. Look out for Fireworks ™ at a garden centre near you.
GREAT OPTIONS FOR SMALLER GARDENS There are so many indigenous and non-invasive exotics available to brighten up little spaces. Here are some great varieties that suit smaller gardens: • AZALEAS love to show off from, January into the autumn months, and the colours they bring are exquisite. There are many varieties and they are great for containers in semi-shaded areas. Their foliage is attractive and evergreen. • ANGELONIA (Angelface Blue, White and Dark Violet) are great performers. Their large blooms of white, pink and blue tones are superb for vase arrangements, and an exciting addition to a summer flowering collection. They are perfect for containers and landscapes. They are often called summer snapdragons as they love the heat, flowering nearly all summer, but may take a break in high heat. Plant from mid-spring, as they won’t really grow until the temperatures warm. They tolerate a fair amount of drought and are easy to maintain. Angelface provides great long lasting cut flowers with a slight grape soda fragrance. • EUPHORBIA ‘Diamond Frost PBR is a just–about-perfect variety that has everyone talking. In every way Euphorbia ‘Diamond Frost PBR is a winner. It is heat and drought tolerant with clouds of fine white flowers, great for vases, all season and requires little maintenance. • EVOLVULOS Blue My Mind™PBR loves hot weather, performing best in full sun but needs protection from light frost. It is drought tolerant, but must be well watered well during root establishment. They are drought tolerant and can handle light frost. • AGAPANTHUS Double Diamond is the first double white, miniature Agapanthus that grows to a height of 20cm and is ideal for containers. They are prolific flowerers, hardy and water-wise. Plant in full sun to semishade. Do include some climbing plants. They create an illusion of space by drawing the eye upwards. Try any of a range of Bougainvillea Bambino varieties (Aurora, Beesnees, Jaspa, Jellybene, Juba, Miski Ningili, Panda, Shaba, Toffi, Wabag, Zuki or Zulu). Simply choose the one that you love the most. To top it all off, have some herbs in containers so that you can bring your garden to the kitchen table too. This year’s line-up of show highlights included Alfresco Living, d’VINE Life, inVOGUE, the Tuis/Home DIY Workshop, What’s it Worth – Antique Appraisals and the Kitchen Specialist Association feature areas. The expo proved a successful one in celebration of trends and ideas focusing on the very best of South African design and local creatives. The expo was a definite diary favourite for getting your home ready for summer and transforming your outdoor area into an inviting living space. The Alfresco Living feature area focused on alfresco dining under the stars with designer decks and patios, sparkling azure pools, innovative shade solutions, terraced herb and landscaped gardens. An array of lazy loungers, trendy outdoor showers and stylish furniture all on display for budding interior enthusiasts to draw inspiration, collective design efforts and more to make summer unforgettable. Exhibitors in the Alfresco Living feature area included Birando with a range of floating bean bags and outdoor partyware, Little Houses with a collection of greenhouses, hothouses, bird aviaries and garden sheds, and Cemstone with their range of individually handmade and naturally cured simulated stone. The expo reminded us all how to enjoy the good things that life has to offer with the d’VINE Life feature area. This area showcased the best wines from some of our most beautiful wine estates as well as delicacies including cheese, olive oils, tapenades, decadent soft toffees and other gourmet goodies. Particular brands on show included Bassalicious with their range of exotic Indian sauces and marinades, La Masseria offering homemade Italian cheeses, cured meats, fresh pastas and sweet treats, and the popular Blue Sky Organics with a range of certified organic olive and chilli products from the Klein Karoo. Interior enthusiasts got their fix of the latest trends with the inVOGUE feature area. inVOGUE inspired visitors to breathe new life

A brand new feature at this year’s Cape Homemakers Expo was the bold What’s it Worth – Antique Appraisals feature. Inherited and treasured items were assessed free of charge by Ashbeys Galleries and their team of experts bringing a few surprise values to items visitors thought had little to no value. Following the latest worldwide trends in handcrafted goods, the ARTISANaffair showcase proved innovative, unique with must-have crafts and little treasures. NATIONAL OBESITY MONTH Obesity is defined as excessive body fat and may also be regarded as a chronic and fatal disease since it contributes to causes of heart attack, cancer, arthritis and psychological problems. National Obesity Week (15 - 19 October) is commemorated to increase awareness about the impact of obesity in the lives of South Africans.
South Africa is heading for a health disaster: more than half the population is living in hunger or at risk of it, while a large percentage of the rest are obese or at risk of developing poor lifestylerelated illnesses. And more people in their twenties are prone to diabetes, high blood pressure and cholesterol. These are some of the startling findings of an extensive health and nutrition study conducted by the Human Sciences Research Council and Medical Research Council. Details of the South African National Health and Nutritional and Examination Survey are given in a 400-page report. The survey was undertaken to verify the health and nutritional status of the nation, looking at food security and dietary intake, among other factors. It also investigated perceptions of health and health-care services, and behavioural and social determinants of health and nutrition such as smoking, diet and physical inactivity. About 25 500 people were interviewed. Of these, 12 000 had physical examinations and were screened by medical practitioners, while 8 000 participants provided blood samples for biomarker testing (used to screen for or monitor disease). Speaking at the release of the report in Pretoria on Tuesday, the Human Sciences Research Council’s Professor Demetre Labadarios said 45.6 percent of the population was food secure. The council defines food security as access to food by all members of a household at all times – enough food for an active and healthy life. A household is classified as being food secure, as being at risk of hunger, or as experiencing hunger. Labadarios said: “Regarding food insecurity, which is those who experience hunger, one out of four households experience hunger. “The Western Cape, Gauteng, and the Northern Cape have low levels of food insecurity in comparison with 50 | THE PROPERTY PAGES | OCTOBER 2013
other provinces.” Labadarios said that while 26 percent of the population experienced hunger, 28.6 percent were living at risk of being hungry. The proportion of citizens living “at the risk of hunger” had risen from 25 percent in the previous survey in 2008. According to the 2012 study, the Eastern Cape, followed by Limpopo, had the highest numbers of citizens experiencing food insecurity. Food security was highest in the Western Cape. Two out of five people, or 40 percent, reported that their diets were poor, while 18.3 percent consumed a high fat diet and 20 percent a high sugar diet. About 26 percent of the population ate fruit and vegetables regularly, while 48 percent ate out regularly. While more females (about 55 percent) did grocery shopping compared with only 27 percent of men, only 14 percent took health into consideration when buying food, with 65 percent influenced by the price of the food item, followed by taste and the food’s
shelf life. The study also showed that South Africans were developing lifestyle diseases from a young age, with diabetes, high blood pressure and cholesterol starting to peak from as early as 25. Indians had more cholesterol than any other race group, while 61 percent of those aged 45 and above were pre-diabetic. The survey found that women were the most inactive and unhealthiest group, with 45 percent deemed inactive, compared with 28 percent of men. Most women were overweight or obese, with almost 60 percent in the obesity category. While 12 percent of men had anaemia, almost double the number of women did – 22 percent. Women of reproductive age were worse off, with the prevalence of anaemia at more than 23 percent and of vitamin A deficiency at 13.3 percent. Almost 80 percent of women had a waist circumference of more than the 80cm that is regarded as the cut-off point for obesity. Six out of 10 had waist circumferences greater
LIFESTYLE HEALTH AND FITNESS than 88cm – putting them at even greater risk of diabetes and cardiovascular diseases. Nearly two thirds of the population (about 62 percent of men and 66 percent of females) believed they ate and drank healthily and that there was no need for a lifestyle change. About 70 percent of the males surveyed were happy with their weight, compared with 63 percent of women. South Africans also seemed comfortable with their large waistlines, with 88 percent indicating that they regarded their ideal body image as “fat”. More females – about 15 percent – attempted to lose weight than males (8 percent). Smoking and alcohol abuse remained substantial. About 16 percent of the respondents smoked every day. The Western Cape, with 34 percent, had the highest proportion of smokers or people regularly exposed to smoking. The percentage of coloured people who smoked was twice the national average of 16.5 percent. Alcohol use also remained prevalent, with 31 percent of males drinking regularly, compared with 10 percent of females. Of the households that consumed alcohol, 61 percent did not perceive this as alcohol misuse and 29 percent did not consider alcohol abuse a problem. Human Sciences Research Council chief executive Professor Olive Shisana said it was clear that “South Africa is heading for a disaster”, judging by the high percentage of people living with chronic diseases, with “overweight and obesity being strong risk factors for these diseases”. Shisana also raised concerns about tobacco use, saying although the rate of smoking had declined over the past two decades, the threat remained

CHILDHOOD OBESITY AWARENESS Obesity is defined as excessive body fat and may also be regarded as a chronic and fatal disease since it contributes to causes of heart attack, cancer, arthritis and psychological problems. National Obesity Week (15 - 19 October) is commemorated to increase awareness about the impact of obesity in the lives of South Africans.
This Youth Day, the Heart and Stroke Foundation South Africa called on parents to recognise the dangers of expanding waistlines at a young age, and to take action. Many working parents feel guilty about not spending enough time with their kids. This leads to many spoiling their children with unhealthy foods that, instead of becoming the occasional indulgence, end up becoming part of the daily diet. The result? More and more children are suffering from obesity and thus increasing their risk for heart disease. “A shocking 20% of children today are overweight or obese, and one in three of our children and youth eat fast foods up to three times a week. With more overweight and obese children, we are seeing more cases of hypertension, high cholesterol and diabetes in children and young adults,” says Dr Vash Mungal-Singh, CEO of the Heart and Stroke Foundation South Africa. She says that every second obese child in South Africa suffers from high blood pressure, a known cause of heart disease and stroke. The risk of heart disease begins early in childhood and can even begin before birth, when the foetus is exposed to certain risk factors. Heart disease is one of the biggest killers of South African men and women (after HIV/AIDS). One in three men and one in four women will suffer from some form of heart disease before the age of 60. This roughly equates to 29% of the total South African population. Preventing heart disease in adults, however, begins in childhood when eating habits and physical activity patterns are laid down. The problem of childhood overweight and obesity is a worldwide one, with trends showing a dramatic increase in its prevalence – from 4.2% in 1990 to 6.7% in 2010 and are expected to further increase to a staggering 9% (or 60 million) by 2020. come into play regarding overweight children, increased consumption of energy-dense foods and drinks as well as decreased/no physical activity levels are the main culprits. While schools can do a lot to prevent obesity, the main onus lies on parents to ensure their children eat more healthily, get enough physical activity and are aware of the many controllable risk factors for heart disease and stroke such as smoking, high blood pressure, high cholesterol, diabetes and excessive alcohol consumption. But if parents themselves are unaware of the dangers of obesity, then clearly the message will not filter down to their children. According the South African Medical Research Council South African women have extremely high levels of overweight and obesity. More than 70% of women above 35 years old are overweight or obese. In the past 10 years, there has been a significant increase among men and more than 45% of those above 35 years are overweight or obese. Also 20% of children younger than nine years of age are classified as overweight and 5%
as obese – a trend that has increased from 2002 to 2008. “Obesity in children and adolescents is particularly a problem in developing countries and in low and middle-income homes in urban settings,” says Dr Mungal-Singh. She also warns that excessive television and video game exposure promotes sedentary lifestyles and decreased activity for children, all of which is bad for their hearts. “What is concerning is that nearly one in three South African youths report watching more than three hours of television daily.” However, the issue of weight gain is one that most parents can act on right away. “Childhood obesity can lead to heart disease later in life. Important safety message from Allan Dillon Our experience has shown that criminals will continue to be successful at committing crimes and getting away with them, utilising the same techniques and Modus Operandi, becoming confident to the extent of arrogance. We use this as our motivator to stay ahead of the game. In November 2008 after an increase in home invasions in the Zwaanswyk area, we recognised that if we were to be effective against this type of crime we would need to change our tactics. A group of criminals had become very good at approaching residential properties situated on greenbelts and at the foot of the mountain range. This was a good method to enter a residential area, as there were no police or security patrols active on the mountain and patrols conducted by members of Table Mountain National Park were limited. At night, these criminals would enter an area, using the mountain and greenbelts. Break into a home, confront the homeowners and threaten them with knives, screwdrivers, machetes or firearms. Residents would be tied up and money, laptops, jewellery, cell phones, plasma screen TV’s would be taken. To help combat this type of crime, we proactivley set up our Man Tracking Unit and Special Response Team. The members were handpicked from among our existing armed response officers. Specialised training was given to these members in the areas of: identifying
footspoor, track and locate techniques, identify criminal Modus Operandi and effecting arrests. The training helped prepare them for day and night operations. Our first success was in early 2009 with the ambush and capture of 5 suspects who had committed a house robbery in Zwaanswyk. Our Man Tracking Unit had established the infiltration and exfiltration routes that the perpitratortors were using and set up a night ambush. SAPS were notified of this and joined us. This led to our first arrests by this specialised team. Since then we have used this unit to apprehend criminals who have mugged and robbed hikers on the mountain above Kirstenbosch Botanical Gardens, broken into and robbed people inside their dwellings in Constantia, Fernwood and identified criminal activities taking place on the outside perimeter of security estates. Many times these activities were unbeknown to the estate security. Our Man Tracking Unit has now grown to ten members who all operate in the greater Cape Town area. This unit, together with our Special Response Team has been responsible for disrupting the criminal elements ability to operate with impunity, made significant arrests and have put criminals on the back foot. We work closely with SAPS and often share information with them. We are proactive in making our own arrests and taking away from criminals the feeling of invincibility. Our trackers
also conduct anti land invasion operations, where they prevent the illegal occupation of vast tracks of privately owned land. On 10 August 2013 our Man Tracking Unit made its latest arrest above Fernwood in Newlands, at night. This arrest was the culmination of 4 nights of laying in an ambush, by our teams, after they had identified a route that the perpitrators were using. The suspect arrested was in possession of bolt cutters, a screwdriver, and head mounted flash light. He had 2 outstanding warrants of arrest for him, dating back to 1994. Our Man Tracking Unit is winning the war on criminals who operate in our areas. FREQUENTLY ASKED QUESTIONS FOR TENANTS Information on the rights and obligations of people who rent residential property from a landlord or letting agent. MUST I SIGN A LEASE WITH MY LANDLORD? A verbal agreement is as binding as a written lease. However, if a written lease is required for you to occupy premises and you refuse to sign it, there is no agreement and you can’t legally move into the property. If you have rented a property on a verbal basis for some time and your landlord then asks you to sign a lease, you do not have to sign a lease with terms that are different to your verbal agreement. Rather, the landlord will have to negotiate new terms with you and secure your agreement first. Remember, it is always better for both of you to have your agreement in writing, setting out the terms and conditions of your agreement. This will go a long way to preventing later disputes.
MUST I PAY A DEPOSIT? Yes, if the landlord asks for one and it is stipulated in the lease. If the terms of your original agreement, whether oral or written, did not include a deposit, you need not pay one if the landlord asks you to do so later. Changes to an agreement are only valid if both you and your landlord agree to it.

CAN MY LANDLORD INCREASE MY RENT WHEN HE WANTS TO? No, the lease or verbal agreement determines when, and by how much, your rent can be increased. If the agreement does not specify an amount or date for an increase, the landlord has to negotiate the increase with you. Neither you nor your landlord can make changes to your original agreement without checking with the other party first.

This is specific to the renewal terms of your agreement. If your agreement doesn’t specify a reasonable escalation, your landlord has to negotiate an acceptable rent with you.
The landlord or his agent must keep your deposit in an interest-bearing account (or trust account, in the case of an agent) for the time you are living on the property. The full deposit amount, plus the interest earned, must then be returned to you when you move out less the costs of damages caused by you and any monies you may still owe to the landlord in terms of the lease.
WHAT CAN I DO IF MY LANDLORD SAYS I HAVEN’T PAID THE RENT WHEN I HAVE?
WHAT MAINTENANCE MUST THE LANDLORD DO? It depends on what your lease says. Usually, a landlord maintains the outside of the property
It is your responsibility to make sure that your landlord receives the rent, so it will be up to you to provide proof of payment (for example, a bank deposit slip). If you can’t, your landlord will be able to give you notice in terms of your agreement and seek a court order for eviction. It is your right, in terms of the Rental Housing Act (Act 50 of 1999), to insist on a receipt for all payments if your landlord does not

If your landlord retains your deposit and is unable to furnish you with proof of the costs he has incurred, you should lodge a complaint with the Rental Housing Tribunal. To prevent this, be sure to follow these steps: When you move in, inspect the property together and list, in writing, any existing defects. Both of you should sign this document and it must be attached to the lease agreement. When you move out, inspect the property together again. Compare the new list of defects with the list made earlier. You may be given a chance to repair the damage yourself, or you can agree that the landlord will do it. If the landlord does the repairs, you have the right to see all receipts for repairs paid for out of the deposit.
