Streamlining Probate In Texas,
typically when someone dies, and if they have a will, the will needs to be probated. An order
from the probate court allows the title to estate property to transfer to the beneficiaries under the terms of the will. A Texas probate can be simple and efficient. A probate applicant asks the court to declare the will valid and appoint an executor. If they are qualified under the law, the court usually appoints the named executor in the will. Once appointed, the court will order the clerk to issue “letters testamentary” legally authorizing the executor to act on behalf of the estate. Varying institutions that hold possession or title to estate assets or property require some proof the executor has the authority to act for the decedent’s estate. In probate law, these institutions are protected if they act within the provisions authorized by letters testamentary issued by order of the probate court. Letters testamentary give the executor the same rights and privileges to act in regard to estate assets and property as the decedent had when he or she was living. However, an executor may only act in a fiduciary capacity to manage and dispose of the decedent’s Estate for the benefit of the decedent’s heirs under the terms of the Will. Letters testamentary are necessary if an order to transfer estate property
is needed. Under probate law, this is considered an “administration,” but, there are situations where an estate may be probated without an administration and the issuance of letters testamentary.
What you need to know about the Texas Probate Code. In Texas, “muniment of title” is an option to streamline the probate process, without the necessity of an administration, although this option is not for every situation. To qualify under an application for muniment of title, there must be less than 4 years since the decedent died. There must be no debts owed by the estate, except for those debts which secure an interest in real estate (as an example, a mortgage.) An order for muniment of title will transfer title to real property and other assets like vehicles, without an administration and letters testamentary. Institutions holding property and assets of the estate are allowed by law to transfer assets based on a court order for muniment of title, signed by the judge and by direction of the executor, with the same authority as if letters testamentary had been issued. Applying to probate a will as a muniment of title can shorten the probate process and cut out a few legal steps that are required with a probate issuing letters testamentary. As an administration is not required with
muniment of title, there is no requirement for the usual notice to secured creditors, public notices, or filing an inventory of the probate estate. Using muniment of title could save the estate time and money. If you are in need of legal services for the Texas probate of a will, be sure and ask an attorney if the estate qualifies for an application for muniment of title. K’STAR is a safe, short-term youth program for today, providing long-term solutions for tomorrow. This non-profit organization offers two programs—a counseling center and an emergency youth shelter. At no cost to families, K-Star provides counseling, parenting groups, parent and community trainings, professional trainings, and youth skill trainings.
While the Doyle School Community Center is Art2Heart’s primary location and where it welcomes youth for after-school programs, the leadershipbuilding organization also works with entities such as K-Star’s Youth Shelter, The Salvation Army Kroc Center, Baptist Children Family Services, and Schreiner University. In each instance, Art2Heart’s mantra of “using the arts to reach the hearts” is a thriving force.
K-Star’s youth and family services are designed for boys and girls, from birth through 17 years-old, to help reduce and prevent the problems of runaway and truant behavior. These services aim as well as to reduce the risk of abuse and/or neglect by providing timely and appropriate short-term services to eligible youth and their families. Priority is placed on supporting and strengthening the family unit.
Art2Heart has developed the unique blend of character building while teaching the arts. Lorraine explains, “It is our strong belief that every individual has the innate talents and gifts to help them pursue and complete their purpose in life. With the correct guidance and patience we are developing leaders, one stage at a time.”

Dr. Melissa Wampler, OB/GYN, has gently guided her patients through the many changes that mark the milestones in women’s lives. Now she is making a new change, herself, for growth in her professional life and in the life of her own family. The Three Ws Wellness, Women and Wampler
For an obstetrician, preparing for births and delivering babies often involves unpredictable trips to the hospital. Early or late, babies come into the work in their own time. And when they make their debut into life, nothing and no one else’s schedule should matter. Anticipating and delivering babies has always been a great joy for Dr. Wampler, but often she’s missed her own family events and children’s activities because she was caring for her patients.

Dr. Wampler and her husband David, recognized that something had to change so she could be more available for her own two children’s activities. With daughter, Ava, entering Peterson Middle School in the fall, and son, Blake, starting his junior year at Tivy, quality time as a family is a top priority. So, Dr. Wampler’s practice is now transitioning from offering full obstetrical care and delivering babies to focusing solely on gynecology and all aspects of women’s wellness.
A New Era “It is a bittersweet decision to make this transition, as I have enjoyed welcoming new life into the world and seeing the babies I have delivered grow up, but I am also looking forward to being more available for my own children’s lives. They will be grown up before we realize it.”

ow when her patients become pregnant, she will guide them through the first trimester and then Dr. Wampler will refer them to the highly skilled and capable obstetrical care of the doctors and nurses who deliver babies at the new Petersons Women’s Associates building on the Peterson Regional Medical Center campus.

Always seeking to make surgical procedures less invasive, Dr. Wampler is skilled in the use of the new robotic surgical system called DaVinci that was acquired by Peterson Regional Medical Center in 2011. This system, guided by a physician, makes very precise, delicate incisions that are less invasive and thus speed the patient’s recovery time. Many other surgical procedures can even be performed in Dr. Wampler’s clinic under conscious sedation. This allows a woman to have a procedure and return home without a hospital stay.

Over 135 guests attended the kick-off and announcement reception held on May 21 at the stunning newly-remodeled Vista Room at Comanche Trace Club for the always memorable Peterson Regional Medical Center Foundation Legacy Gala. Attendees enjoyed wine samplings from three local wineries as well as delicious nosh courtesy of Comanche Trace. This year’s cooking school and gala will be held at the Inn of the Hills Conference Center November 14 and 16. CEO and President Patrick Murray addressed the eager audience to share the importance of supporting the community hospital. Shared Murray, “It is our hope that Legacy Gala 2013 makes a lasting impression on each guest and reaffirms the importance of having a great hospital in our great community.” Past signature events have raised over $535,000 to support the growth and development of palliative care, women’s services, rehabilitation services, and the Peterson’s Ambulatory Center (ACC). The kick-off reception is just one of the exciting elements that are a part of the whole gala experience. From the VIP party to the much anticipated chef announcement, all of the events leading up to gala generate a buzz and excitement throughout the community. The cooking school scheduled for November 14 always dazzles taste buds as the celebrity chef gives an informative and interactive cooking demonstration, sharing practical cooking tricks of the trade. The gala evening on November 16 will begin with silent and live auctions. Each special item or experience offered in the auctions will be one of a kind, not available anywhere else but at the event. At the conclusion of the live auction, guests will enjoy a multi-course seated dinner by a celebrity chef. Following dinner, attendees and special guests will dance the night away.

“Tennis is a lifetime sport,” says Jess. This slogan of the US Tennis Association supports the Aspers’ belief that tennis helps you stay healthy and fit while having fun. As Jess notes, there’s no age limit for having fun while supporting wellness. “Every other day about 24 guys meet on our courts for a couple of hours before lunch. They break for lunch and return for a couple more hours of play. Their average age is in the 70s.” At the other end of the age spectrum is the younger set—elementary school-aged kids and teens out in the sunshine playing tennis instead of indoors texting or glued to computer games. “I love working with kids—I really get to know them and figure out how to motivate them,” Jess explains. He’s been there himself as a youngster on the courts and recalls, “As ten year-olds, mytwin brother
and I were top tennis champs in Southern California.” Think you have some handicap that keeps you from playing tennis? You might want to check with Jess before counting yourself out. As a young guy, he broke his neck in an accident and was told he’d never walk again. Five months later, Jess was playing tennis. “So grab a friend and your racket and get to the courts,” urges Diane. “You’ll see that tennis can be just the fitness vehicle you’ve been looking for.” The Aspers encourage you to browse the website for program options for you and your family.

The Bella family is no different. In May, Kim discovered she has Leukemia and immediately started on chemotherapy. She will soon be receiving a bone marrow transplant. As a family, we were shocked, saddened, and angry, but most of all, we became resolved. Resolved that we would pull together and do everything possible to help and support Kim and her family for as long as it took. Resolved to make sure Kim knows how much she is loved. Let’s talk about curtains

One
of the most important elements of a room, if done right, they add warmth and depth to help complete your space. In my opinion, there are really only two things that need to be addressed when doing curtains. First, decide a fabric and color. As a general rule, curtains are another element that help tie your room together. I recommend pulling out an accent color(s). Since curtains make such a presence in a room, it is important to maintain balance. You don’t want a color to be predominant to one side of a room, it needs to flow throughout. Find a repeating color in some of your artwork, pillows, rugs and upholstered pieces to use for your curtains. The same goes for the type of material; texture in curtains can be just as effective as color— something really popular right now is burlap.

The next thing is how you hang your curtains. Whether you are blessed with floor-to-ceiling windows or just have a standard size, your curtains are to emphasize the window opening. No matter the size of the window, I hang them and inch or two from the ceiling with the panels extending beyond the window on each side, and have the panels at least floor length. By hanging your curtains at the edge of the window and extending beyond there, you let more light in. For standard windows, this gives the illusion of a much larger window in length and height. This is very important when measuring for your curtain rod. Windows are such an asset to any room. Natural light not only makes you feel better, it makes things look better as well. There are three basic types of Solar PV installations with the most common being the grid-tied system. They’re so cute—and so costly! Somewhere around forty million dollars each year are lost to the destructiveness of these darlings, and I am sure you’ve been affected too. The whitetail population has gotten so out of control in some areas that the deer themselves are changing the rules of tried and true plants that are not dinner! While there are some plants that are resistant to whitetail, there is nothing that is deer proof. An exotic deer has no rules as to what they will not graze upon, pull up or simply trample. Native plants are not all deer resistant, mainly because they are a native food source. Under stress a deer will eat anything or at least try. Cacti are not a deterrent, but a major source of water when periods of drought linger.
this increases the risk for Lyme disease which comes from an infected tick that has been known to populate in deer herds. So what to do? Check out your neighborhood, look to see what other people have in the landscapes that has not been damaged. Or ask your local gardening expert for advice. Stick with plants that are resistant, use repellents, and cage new trees. Remember the only other way to deer-proof is an eight foot fence! a larger variety of birds to your backyard bird feeding station? Try feeding peanuts. In the Hill Country we get three different varieties of woodpeckers— Golden-fronted, Downey and Ladder-backed, all of which prefer peanuts. In addition to the woodpeckers, the Flickers, Black-crested Titmice, Cardinals, Carolina Chickadees, Blue and Scrub Jays all go nuts for nuts. In the winter we can attract even more birds with peanuts—like the Redbreasted Nuthatch, Brown Creepers and Thrashers.
Shelled peanuts have a specific mesh feeder that birds cling to, but in-shell peanuts can easily be served in a tray feeder. With that said, there are other Hill Country critters that enjoy peanuts too—squirrels and raccoons! There’s a specialized squirrel-proof mesh feeder that works very well for shelled peanuts. You can serve in-shell peanuts in a baffled tray feeder or just simply put out only a handful a day. Setting up a peanut station on a baffled pole system will bring you the most enjoyment. By following these simple tips and avoiding some common mistakes, you can create hardscaping you’ll love for years to come.
Consider the Whole
Choose Your Style
As much as you can, consider the entire area available to you for hardscaping before you design an element, even if you’re just tackling one space for now.

At the bare minimum you should plan a design for the whole area, or consult a professional to create a design for you. If you don’t consider the site as a whole, it’s like building one room of a house, and then a year or so later, a second room. You may decide to plop down a patio, and then decide you want a barbecue, pond or walkway and the patio blocks your plan.
Whether a single specimen plant, a seating area, or pergola, you want the eye to travel toward a destination. Don’t overdo it, one or two elements are enough.
Hardscapes can be relaxed or formal, but the best ones show a well-defined style. Think of a two- or three-word phrase that describes your vision and stick with it. I recently had a client describe her style as “formal Hill Country Seaside-ish.” I was immediately able to start visualizing elements that matched that look, although I have never heard those styles blended before.

Drainage Issues
More hardscapes are messed up by people ignoring drainage than by all the other errors combined. Drainage is very important to consider before installing landscaping. On commercial projects, be very clear as to who is responsible for drainage plans designed by engineers. We were recently on a commercial project wherein the contractor asked us to install 4 inches of topsoil on the whole site, but then established final grade for the drainage. After we installed our topsoil, the finish grade was several inches too high. Thousands of dollars
Develop a Focal Point
Some common mistakes: Boulders that are supposed to be helping to naturalize an area, but instead have been dropped right on top of the ground. To successfully use boulders in hardscape, you need to make sure they’re large enough to fit with the scale of the landscape, and bury them deep enough so they look like a naturally-occurring element. Shrub beds built so close to the house that there is no room for plants. This leads to either the overstuffed look, or a straight hedge, with no room for design. Pathways built too narrow, especially approaching a front door. The wider the walkway, the more inviting the entry. Paths should be a minimum of 4 feet—ideally 6 to 8 feet wide.
Hire a designer or landscape consultant who knows your style. If you do opt for a hired designer or contractor, get recommendations and check portfolios and references. Established almost thirty-six years ago by the late Marge Nicholson at Sid Peterson Hospital, the original “Pink Ladies” have grown to an organization of some 80 ladies and gentlemen who regularly volunteer 20 hours (or more) per month (usually five four-hour shifts) at Peterson Regional Medical Center. With the advent of the new hospital and changing from pink to teal or turquoise vests, these caring citizens daily brighten the lives of patients and lighten the load for PRMC staff. As well, this caring group often shares fun and fellowship with each other. If you’d like to be a part of our volunteer family, please stop by or give me a call. Peterson Regional Medical Center is taking steps this season to encourage all employees to get fit and improve their overall health and wellness. Whether enjoying a brisk walk around the campus, taking the stairs instead of the elevator, or enjoying after-hours on-campus exercise classes, Peterson is trying to make it easier for employees to be more active at work and energize their minds, bodies, and spirits. The efforts are really paying off. Proudly, Peterson received Fit-Friendly platinum status certification by the American Heart Association for the second year in a row and was the only company of 13 San Antonio regional companies to receive platinum. The American Heart Association’s FitFriendly certification program recognizes employers who go above and beyond when it comes to their employees’ health.
Fit-Friendly companies reach gold and platinum level status by implementing various activities and programs to encourage physical activity, nutrition and cultural enhancements such as on-site walking routes, healthy food choices in cafeterias and vending machines, annual employee health risk assessments and online tracking tools. 42 │July-August 2013 │

Several staff members boast dramatic weight loss while employees across the board share the fun of Tuesday and Wednesday Zumba classes or the great stress relief enjoyed after a brisk stroll on the established walking path. HIPAA Allows Disclosure of Information When Risk of Danger is Present On January 15, 2013, the Office of Civil Rights (OCR), the enforcer of HIPAA, published a letter that clarifies that providers may disclose information when there is a risk of danger. Specifically, providers may disclose necessary information about patients to law enforcement, family members of patients, or other persons when providers believe that patients present serious danger to themselves or to other people. The letter goes on to say that: The HIPAA Privacy Rule protects the privacy of patients’ health information but is balanced to ensure that appropriate uses and disclosures of the information still may be made when necessary to treat a patient, to protect the nation’s public health, and for other critical purposes, such as when a provider seeks to warn or report that persons may be at risk of harm because of a patient. When a health care provider believes in good faith that such a warning is necessary to prevent or lessen a serious and imminent threat to the health or safety of the patient or others, the Privacy Rule allows the provider, consistent with applicable law and standards of ethical conduct, to alert those whom the provider believes are reasonably able to prevent or lessen the threat. Then the letter provides guidance about what is considered to be a good faith belief. A provider is presumed to have a good faith belief when his or her belief is based upon the provider’s actual knowledge, i.e. the providers’ own interaction with patients. Providers also have a good faith belief if they rely on a credible representation by persons with apparent knowledge or authority, i.e. based on credible reports from family members of patients or other persons. These provisions are included in the Privacy Rule at 45 CFR Section 164.512(j). OCR interprets these provisions to mean that health care provider may disclose patient information, including information from mental health records, if necessary, to law enforcement, a patient’s family, or other persons who may reasonably be able to prevent or lessen the risk of harm. If, for example, a nurse has a patient who has made

a credible threat to inflict serious and imminent bodily harm on one or more persons, HIPAA permits the nurse to alert the police, partner, or other family members, school administrator, campus police, and others who may be able to intervene to avert harm from threats. It is important to note that the above is consistent with statutes and court decisions in most states that frequently require disclosure of information about patients to prevent or lessen the risk of harm.
The letter concludes with the following statement: We at the Office for Civil Rights understand that health care providers may at times have information about a patient that indicates a serious and imminent threat to health or safety. At those times, providers play an important role in protecting the safety of their patients and the broader community. I hope this letter is helpful in making clear that the HIPAA Privacy Rule does not prevent provider from sharing this information to fulfill their legal and ethical duties to warn or as otherwise necessary to prevent or lessen the risk of harm, consistent with applicable law and ethical standards. Successful medical practices view their office as a business. In order to meet the healthcare needs of patients, profits are necessary for a medical practice to survive and thrive. There are many ways to improve profits in a medical practice by decreasing expenses and increasing revenue.
Efficiency
Consider electronic patient management systems with automated voice reminders for patient appointments. Online insurance eligibility and verification are reliable and affordable. Delegating more services to nurses, staff, and midlevel practitioners will increase your patient load without increasing cost.
Expenses
Keep expenses low and look for ways to cut costs. Purchase energy efficient equipment and light bulbs such as fluorescents and CFLs. Keep lights off in unoccupied rooms. Monitor supply usage and decrease printing costs by adjusting forms to reduce the number of pages. Replace the paper files and charts with electronic documents. These small reductions will add up to increased profits over time.
Increase Sales
Consider offering additional products or services such as vitamins, cosmetic procedures, or massage services. Look for products that are beneficial to your type of practice, such as educational toys for a pediatric practice.
There are many ways to improve profits in a medical practice. Insurance
Maximize insurance payments. Finding a dedicated and knowledgeable staff that follows insurance claims, ensures that all services are properly billed and follows up on missing payments is difficult and expensive. Consider outsourcing your billing and other back office duties to a reputable billing service that works on commission and devotes 100% of their time to collecting your money. Working with insurance companies can be a timesensitive process that requires attention to details and adequate tracking. Reduce the amount of money you lose because of incorrect billing or inadequate follow up and your profits will increase.
Referrals
Keep your patient load high by encouraging referrals from your current patients. Referral clients may be more likely to become long-term patients since they are familiar with your services. The more long-term clients you have on roster, the higher your average daily patient load, which leads to greater profits.
