Dear Friends and Neighbors, The first issue of this magazine—Kerr County’s premier community magazine—hit the stands in November 2007. What a humble beginning—we were printing on 50 lb. offset back then, no nice glossy paper. But even so, you received it with overwhelming enthusiasm and support. And we have never looked back! It has been your support and feedback that has spurred us on to produce each issue since then. You have given us so many heartwarming stories, many about how articles or photos from events have reconnected you with someone from the past. As your premier community magazine, it has alwys been our intention to focus on our own community, Kerr County—its people, events, art, businesses. A little information and some entertainment. It is our intention to continue growing to bring you more of what you love. Accidents Happen No one plans on being involved in an automobile accident, but it can happen. Filing insurance claims and dealing with an insurance adjuster can be timeconsuming and frustrating. Here are a few things you should know before you get involved in an insurance claim and what you can do if the process doesn’t work out so well. You must immediately report the accident to your insurance carrier. Failing to report the accident promptly could affect your rights under the policy. If you have not read your insurance policy, now is a good time. Do you understand what the policy means? If not, you may want to consult with your agent or an attorney before filing any claim. At, or as soon as practical after the accident, try to record as much detail about the accident as possible. Take pictures of any damaged vehicles and injuries sustained during the accident. The names and addresses of witnesses could be crucial to support your claims. You need the insurance information on the other driver or vehicle involved. No insurance company will pay a claim for actual damages unless the claimed amount is supported by receipts or other forms of documentation. You need detailed invoices for every medical service, prescription, car repair, and any other claim covered under the policy. No matter where you are or who you’re talking to, never admit to any kind of liability on your part. You need only state

the facts that you know. It is the insurance company’s job to investigate the claim and make a fault determination. Never give any insurance company anything in writing unless you know what it means and the affect it may have on your claim.

result of the accident. Under common law, the courts may award damages for pain and suffering. This is a damage amount not easy to calculate; and is in most cases, proportional to the amount of actual medical and economic damages incurred.

In Texas you must bring a claim in court against any at fault third party within two years of the accident. In some cases and where you claim is against your own insurance company, you may have up to four years. You may also have other contractual limitations found within the insurance policy for filing claims. I recommend you consult with an attorney to determine the applicable statute of limitations that may apply in your case.

An insurance adjuster may not concede to any significant pain and suffering damages in settlement without the involvement of an attorney. The more serious the injuries, the more likely you will need to consult with a personal injury attorney about resolving your case.

Dealing with an insurance adjuster is a negotiation. The adjuster’s job is to reach a fair settlement as soon as possible. However, your view of a fair settlement may be significantly different. Your success will depend mostly upon your preparation of the claim. What if the offer from the adjuster is not enough? Should you hire an attorney? If your claim is with the at-fault third party’s insurance carrier, in most cases, you cannot recover your attorney fees in court, even if you win. This means the insurance carrier will not offer to pay your attorney fees in a settlement. Typically, a lawyer takes these types of cases on a contingency basis. This means the lawyer takes his fee as a percentage of the settlement proceeds; or if the case goes to trial, a percentage of the recovery, if any. If there is no settlement or recovery, then, there is no fee. For this arrangement to be economically feasible for both the attorney and the client, there needs to be a personal injury as a

Art as independence and marriage

—strong unique images integrated by a blending of the senses. A painting in which you can see, hear, smell, and feel its subject. This is Eric Forlee’s vision for his work. “Art should come from my heart, not my head,” according to Forlee. “It flows from my heart simultaneously with the experience and the excitement of being in the moment.” Born in China, it wasn’t until thirty years later that he would find

himself in Africa where the savanna’s landscape and animals enchanted him. Inspired, he filled dozens of sketchbooks during a yearlong trek in the Serengeti. Forlee’s award-winning art has been celebrated for over twenty-five years by the Safari Club International and by wildlife foundations around the world. Forlee moved to the States in 1989, and became a US citizen in 1998. Eight years later, after visiting the Texas Hill Country and finding it reminded him of his beloved African landscapes, he moved to Kerrville with his wife. “Everyone wanted me to start painting the Hill Country, but I did not know this place yet or feel it in my heart,” Forlee

explains. “But after a few years, these hills inspired me to begin painting local landscapes.” Forlee’s art captures the essence of early morning and evening light “when it is most beautiful and creates warm, rich colors.” His work reveals a technique that yields a three dimensional effect, bringing a striking power to his paintings. Forlee adds, “I start with love to inspire love.” His is art you’ll truly love to love.

your hairstylist frequently is a bit like playing Russian roulette. Even if you insist on a full consultation with a new stylist, you really don’t know what you’re going to get and you probably won’t be totally happy with your new hairstyle. Why? Because it takes time to build a relationship with your hairstylist and for him or her to understand your likes and dislikes, needs, lifestyle, and time considerations. The first visit to a new salon/stylist rarely gives you the best hairstyle possible. This doesn’t mean you won’t be happy with

your new look, only that it will get better with some “fine tuning” as a result of the feedback you provide your stylist on your next visit. Your stylist can see how your hair settled into its new shape and how it has grown out. Usually it takes a few visits for your hairstylist to work with you to develop a style that will best suit your personal needs and preferences, so give that person a chance to get it right. It’s well known that a kind of informal therapy or “counseling sessions” go on between hairstylists and their clients, in salons all over the world. Often your stylist can be the best person to talk to about your problems. He or she is not too close to you

to be objective or to give out your secrets, yet knows you well enough to listen to your problems as a friend. A brief encounter with a stylist won’t provide these benefits. Each time you change stylists or salons, you have to start all over again. Instead, find one hairstylist you feel comfortable with and trust, who will listen and understand you, and then stick with that person. Melissa and The Zebra Door are actively involved in all the community style shows, providing clothing for the Baubles & Beads Fundraiser, the Cattlewomen’s Fashion Show, and the Sheep and Goat Raiser’s Fashion Show. A little girl’s dream comes true

When Melissa was a little girl, she loved to play with paper dolls and dreamed of a day when she would design fashions for real-life ladies. But when she grew up, her childhood dream was locked away in memory. Raised in Austin, she moved to Lafayette, Indiana, where she graduated from Purdue University with a degree in nursing. She married her high school sweetheart, raised three children, and pursued her nursing career, caring for Alzheimer’s patients for twenty years. Life was good, but Melissa began to feel her Texas roots tugging at her. And she still remembered that sweet childhood dream of working with beautiful fashions. Was it too late to pursue that dream? Seven years ago, Melissa moved back to the Texas Hill Country. She stopped wearing her hospital scrubs and started doing jewelry and clothing home parties for friends and neighbors. The parties soon became so successful that her car, garage, and four storage units overflowed with clothing and jewelry. Seeing the obvious, her husband, Tom Nunn, and her mother-in-law, Margaret Nunn––her biggest fans––along with her many customers urged Melissa to open a boutique.

Her first store, A Passion for Fashion, opened in January 2010 in a storefront on busy Junction Highway. But people drove by too fast to notice her shop, so Melissa decided to paint big, bold, black-and-white zebra stripes on the door to get attention. This simple visual idea worked. Soon women started coming to Melissa’s store to shop for classic, contemporary, and fun clothing. Two years later, the renamed store––The Zebra Door––outgrew its first location and Melissa decided to relocate to a bigger, more visible space. Taking advantage of the exciting revitalization of downtown Kerrville, Melissa moved The Zebra Door Boutique & Day Spa to a fashionable new address on Earl Garrett next to Salada’s restaurant. Good DEEDS

ast week, I found a book of inspirational quotes that a friend gave me years ago. I came across the following quote from Sophocles: “If one begins all deeds well, it is likely that they will end well, too.” This ancient Greek playwright’s words reminded me of the importance of doing good deeds for others, but I also thought that I can apply this quote quite literally in my career. In real estate, a deed is a written document that conveys legal title to real property. Although there is not a standard form for a deed, Texas does have certain rules that apply for a deed to be considered valid (a ‘good’ deed). The general requirements are:

1. Who’s Involved

The document must contain the name of the grantor (the seller) and the grantee (the purchaser). In Texas, a grantor must be of sound mind and of lawful age (18 or older).

2. Consideration

Good real estate deeds and the good deeds we perform personally involve consideration. Often, real estate deeds will say, “For $10 and other good and valuable consideration.” Sometimes, gift deeds simply state “love and affection” as consideration.

3. Legal Description

The property being transferred must be described accurately. In platted subdivisions, the description will often include a Lot and Block along with the name of the subdivision.

4. Words of Conveyance

Typical words of conveyance are “convey and warrant,” “grant, bargain, and sell,” or “remise, release, and quitclaim.”

5. In Writing

The grantors must sign the deed for it to be valid. Imagine the fun we could have acquiring whatever property we liked if we didn’t need the seller to sign a conveyance document!

6. Delivered and Accepted by Grantee

Title is said to pass when the deed is delivered to the grantee (purchaser), either personally or through a third party such as a title company. Those who sign the deed must formally acknowledge that their signatures are genuine. This is commonly done before a notary. When you purchase real estate, make sure that you begin with a good deed. That way, when it comes time to sell, it is likely that your transaction will end well, too. Water, food, and shelter. Pretty much what we humans

need to survive is also what birds need. Providing water, shelter, and housing is relatively simple. Providing the appropriate food, however, can be challenging.

The bird food aisle gives you several choices. Some looking very generic and others with pretty packaging. Some say you will attract colorful songbirds, others boast added vitamins and some are from companies that manufacture fertilizer. So here’s the skinny.

Wild bird food contains mostly red milo and millet, with barley thrown in. In that 20 pound bag, only about ¼ of it is something the birds will eat. Generally speaking, only two species eat milo—turkey and dove. Milo is a water-based grain and birds are looking for oil-based seed so they don’t even recognize it as a food source. By the way, they don’t eat barley either!

Birds are looking for protein and fat and find that in black oil sunflower. Around 78 species will eat sunflower and most of those are the colorful songbirds you want to attract. If squirrels are eating your seed, you should try safflower seed. It’s a favorite of cardinals, chickadees, titmice and house finch. If you serve peanut butter it should not contain any salt or sugar. And, just like us humans, if birds are eating properly, they don’t need vitamin supplements. The only added mineral that birds benefit from is calcium carbonate—for stronger eggs.

Fresh bird food is a priority. Seed setting in a warehouse for months before hitting the shelves will become less viable—dried out. You don’t like dried out food, and neither do birds. Check the date on packages; it should not be more than a month old.

Investing in fresh, clean seed with no fillers will bring the greatest variety of birds and the most bang for your buck. If you have any doubt, come see us for a free sample!

some tips and tricks for It’s the time of year for flowers, and what a welcome addition a splash of color is! Try to resist the urge to buy one of every pretty thing at the nursery. Find your favorite 2 or 3 colors and plant “blocks” of all the same color. This mono-chromatic scheme sounds boring to some, but “mass planting” has tremendous impact. Multiple colors mixed together may end up losing their effect as they distract and confuse the eye. Identify problem areas in your yard. Consider converting sun-baked lawn areas to xeriscape, or areas too shady for grass to mulched beds. Fertilize your lawn with a slow release 15-5-10 fertilizer with trace minerals (especially iron and sulfur). Convert your existing irrigation system to SDI— Subsurface Drip Irrigation. (See January article in KCP or go to www.kerrvillelandscaping.com for more specific SDI information.)

Mulch conserves moisture, breaks down into rich organic matter, and looks great!

Don’t cut your grass too short. Doing so invites disease, wastes moisture, and weakens the turf. Never cut more than a third of the grass blade at one cutting. If you have St. Augustine, keep your mower height set at 3 inches or more. There is no need to scalp it in the spring, just bag up the leaves. If you don’t mow your lawn weekly, you may need to go up to 3.5” or 4” so that you don’t cut more than a third of the blade. Happy Gardening!

Start a master landscape plan. Include ideas for years down the road. Design as if you have an unlimited budget, and then prioritize projects/ areas based on importance. Although January and February are the best times to plant a tree, it’s still not too late. Choose a well adapted tree with a long life span such as Cedar Elm, Monterrey Oak, or Mexican Sycamore. Dig a hole twice as wide and the same depth as the root ball. Fill with a topsoil-compost mix. Water and compact thoroughly. Top-dress your lawn with a compost mix. Adding a half inch layer across your lawn annually will work its way down into, and enrich the sub-soil. For best results, water in with Medina Hasta-Gro or Medina Soil Activator. Re-mulch your shrub beds.

It takes guts to be healthy––literally. Seventy percent of your immune system is located around your digestive system. Regular Eye Exams An annual eye exam should be considered an important part of your health plan. Just as most people visit a doctor for a yearly physical or a dentist to maintain a healthy smile, your trip to the optometrist is just as necessary to maintain optimal eye health. One condition that you will eventually become familiar with is cataracts. Cataract development is most commonly an age-related issue, although there are cases where cataracts are found in younger people. Cataract diagnosis generally

occurs around age 55 or over, and is caused by a clouding of the lens. Less light reaching the retina (due to the cloudy lens) results in a loss of vision. Common cataract symptoms are: increased haziness, blurred vision, the need for more light to see clearly, gradual loss of color distinction and sometimes it seems as if it is easier to see without wearing glasses at all. During a comprehensive exam, your optometrist will be able to determine if cataracts are a factor. If cataracts are diagnosed, the development will be tracked during your annual exams. Your optometrist will refer you to a surgeon once the cataracts are mature enough to be removed. You may return to your optometrist for comanagement and a new glasses prescription.

Treatment for

Dysphagia

Dysphagia , or difficulty with swallowing, is a

medical disorder that impacts as many as 15 million Americans. According to the Agency for Health Care Policy and Research (AHCPR), over 6,000 people die in America from complications associated with swallowing difficulties, most commonly aspiration pneumonia which occurs when food or saliva go down the windpipe and into the lungs as a result of weakened or paralyzed muscles in the throat. Aspiration pneumonia is one of the leading causes of death among the elderly and has been reported as a growing cause of hospital admissions in the elderly population. (LaCroix et al. 1989)

Dysphagia can be caused by stroke, degenerative neurological diseases, and head and neck cancer. It predisposes patients to complications such as choking, bronchospasm, chronic malnutrition, severe life-threatening dehydration, significant weight loss, muscle wasting, and physical debilitation. (Marik and Kaplan 2003) Quality of life is also affected by the personal discomfort, inconvenience and pain of feeding tubes, and depression.

Dribbling or drooling from the mouth Pocketing of food between cheek and gums Coughing, choking or excessive throat clearing Extended chewing Holding food in the mouth without chewing or swallowing Tongue pumping to help move food and liquid back toward the throat Sensation that food is stuck in the throat Wet gurgly voice Coughing up reflux Copious secretions Pain during swallowing—may be expressed by facial grimace Onset of or recurrent pneumonia

For many years, the primary treatment for this condition was a feeding tube. However, in the last 15 to 20 years, neuromuscular electrical stimulation (NMES) has become an effective treatment option. It is used as an adjunct modality in the treatment of dysphagia. NMES as used in the treatment of dysphagia involves the administration of small electrical impulses to swallowing muscles in the throat through electrodes attached to the skin overlying the musculature. The treatment of dysphagia in the USA falls primarily to speech language pathology (SLP) professionals. Speech therapists treating dysphagia employ a variety of techniques and strategies to limit the risks of aspiration and to accelerate recovery. Strategies employed to limit the risks of aspiration may include compensatory swallowing maneuvers and diet modifications. Active treatment approaches include exercise therapy and behavioral techniques. In 2002, the Food and Drug Administration cleared the use of the VitalStim® Therapy System in the treatment of dysphagia. VitalStim® is a non-invasive, external electrical stimulation therapy that is a safe and effective treatment for patients with swallowing dysfunction. It is used in conjunction with traditional exercise that unites the power of electrical stimulation with the benefits of swallowing exercises. The combination of these treatments allows clinicians to accelerate strengthening and restore function. Research has demonstrated that combining these therapies results in better outcomes than using either one alone. The use of VitalStim® therapy is only allowed by speech therapists who have been through an extensive VitalStim® certification program. Peterson Regional Medical Center now offers treatment for dysphagia with the VitalStim® system in both the inpatient rehab and outpatient rehab departments. ver the last few months I have seen many women who are suffering from some degree of postpartum depression. Whether it’s a little “baby blues” or full on depression and anxiety, I can barely leave the room without crying myself. We talk a lot about postpartum hormone shifting, but the truth is that when I look into the eyes of a woman who hasn’t slept more than a few hours at a time in weeks, a woman who is trying her best to take care of her family while her bottom hurts, her breasts are sore and her baby is crying . . . I realize that it wouldn’t take postpartum hormones to put me over the edge. The real truth is that having a baby is hard. About 3 out of 4 women will have mood swings, tearfulness or irritability during the first weeks after birth, which can be worse 44 │ Mar-Apr 2012 │ KCP

Just reading this list should make you sad. We should be sad that any woman feels this way after having a baby, and even sadder that as a society we might blame her, instead of coming along beside her to support her and lift her up during this time. So, who is at risk for postpartum depression? Anyone who has had a baby. Especially women who have struggled with anxiety and depression in the past. We might assume that teen moms or those who are in difficult life situations are at risk for depression, but the truth is that more depression occurs in

women who are prepared for their babies. An older, first time mom or someone who has struggled with infertility—someone who really wants a baby and feels intense pressure to “get this right” might have a harder time. She might also feel guilty for not being happy, and have a harder time asking for help. So, how can we help new moms? First of all, we have to focus on the basics that keep all of us healthy. Make sure she is eating, drinking, and sleeping. Many moms are so exhausted that they skip the basics. This can make even a healthy person feel awful in no time. Help her get some exercise and get out the house from time to time. Go for a walk with her; offer her a chance to talk about how she’s feeling. Be supportive and encouraging. Never give her the impression that this is her fault, or that she should “snap out of it.” Seek help. Sometimes a short course of antidepressants can make a huge difference. Being Safe and Secure in the home

As we age and become increasingly dependent on others, more strangers will enter the home, such as those who provide maintenance, yard work, hot meals or medication delivery, solicitors, or personal care. Most companies have rigid policies and screening safe guards in place to help mitigate hiring persons of questionable character in regard to theft or malfeasance. When the economic picture declines it is hard to know what good workers will succumb to when they are struggling to survive. Good screening and policies sometimes cannot prevent theft or malfeasance. The best defense is to reduce the temptation and accessibility of financial materials in your home. Bonding insurance companies, as a rule, will not replace a loss unless there is a conviction of the suspect. Therefore, any allegation of theft or malfeasance must be reported to the company for whom the suspect works and to the local authorities for a complete investigation and determination of innocence or guilt.

Conducting a credit check of one’s personal accounts every three months. To access a free credit report yearly, go to: www.annualcreditreport.com/ cra/index.jsp. In addition, some credit card companies will, for a nominal fee, alert you to activity on the account.

Maintaining deposit slips and all checks in a secure, preferably locked, location. At the minimum, remove deposit slips from the check book.

Keeping cash to a minimum—enough for groceries or medications. Keep your cash in a secure location.

7.

Not asking strangers in your home to assist with your finances. Whether it’s someone doing maintenance, yard work, meal delivery, or personal care, they should not have access to your checking account or credit cards.

8.

Having one family specific person in charge of finances.

9.

Keeping valuables, such as jewelry, in locked storage. Collectable items which can be easily broken should be put in a safe location.

10. Never allowing door-to-door solicitors into your home.
