The Right NOT to remain silent

Y

our right to free speech is safeguarded by our federal and state constitutions. But what happens when someone with all the power and money (and the lawyers), sues you for something you may have said? A lawsuit of this type may not be filed with any expectation that the plaintiff can win, but just to silence you, because it is calculated you don’t have the same financial resources to defend the lawsuit. It does happen, and this strategy of intimidation has been coined as a “strategic lawsuit against public participation” (SLAPP). These types of lawsuits or the threat of a lawsuit, tend to censor, intimidate, and silence public criticism, burdening those who would speak their mind with the cost of a legal defence. To address this negative legal trend, the 2011 Texas legislature enacted the Citizens Participation Act (CPA) which helps you protect your right to free speech. The statute is codified under the Texas Civil Practice & Remedies Code at Chapter 27. The new legislation is also commonly known as the Texas Anti-SLAPP legislation. For you to take advantage of your rights under the new law there must be a showing that the SLAPP lawsuit is based on an act or acts of “communication” (defined in the law as the “making or submitting” of any “statement or document in any form or medium”) in connection with your rights of association, petition, or free speech. Texas has one of the broadest Anti-SLAPP protection schemes in the country. The Texas statute and some corresponding legislation under the Texas Civil Practice & Remedies Code at sec. 51.014 allows for simple and

immediate dismissal of any legal action which was filed and based on a movant’s exercise of their right to free speech, to petition, or a right of association. These rights are broadly defined under the statute. Generally, you are protected by the CPA law when you speak out in court or other public forums.

Texas has one of the broadest Anti-SLAPP protection schemes in the country. The Texas Anti-SLAPP statute allows an opportunity to a defendant in a SLAPP lawsuit to judicially and immediately dispose of the plaintiff’s claims without extended legislation and discovery procedures, which drive up unnecessary legal costs. The burden of proof will be on the movant to prove your motion by preponderance of the evidence. Though, you most likely will need to hire a lawyer to get a SLAPP lawsuit dismissed under the CPA, there is a mandatory allowance for the recovery of your legal expenses if you prevail. However, be cautioned, the court has discretionary authority to award attorney fees to the plaintiff, if you fail to prove your case. The new Texas Anti-SLAPP legislation is far from perfect, but it does put those who

would abuse the legal system by filing a SLAPP lawsuit on notice that a citizen’s free speech in Texas is of great importance to the legislature and to the courts. If you are considering suing someone for something they said, you are advised to check with a lawyer familiar with the new Texas AntiSLAPP legislation. Nevertheless, before engaging in right to free speech, research your rights under the constitutions and the new CPA and consult with a lawyer. Can You Dig It ? What a fantastic time of the year, the old is gone and the beginning of a new promise has begun! This is the best time to get your plans in motion, before the rush of spring planting begins. When is the last time you composted your planting areas? Enriching the soil now gives the earth time to refresh and reenergize those spent nutrients. Feed the soil now and it will feed your plants when the plants need it! Take some time now and reevaluate what plants did well, and which just really hung out. What did you water more than you should have? Do you need more mulch? Does that tree, shrub, or perennial need to be moved so it has ample room to grow? Do it now, while the plant is dormant so the root system can recover before spring growth appears. Severe pruning to most trees and shrubs should be done now while they are dormant. Don’t forget to check out your inventory of insecticides, fertilizer,

and tools. Most fertilizers and insecticides are good for about a year once opened, and it’s always a good idea to replace old and worn out tools before you need them. Beauty Product Diversion Are You Getting What You Pay For? The problem with big chains selling bootleg salon beauty products that they’re not authorized to carry is known in the beauty industry as diversion. What happens is that the world’s least threatening black market underlords (actually, they call it the “gray market”) will buy salon products from a legitimate distributor, then set them aside in a warehouse for years until the barcode expires so they can’t be tracked. During this time, not only does the barcode expire but so does the product inside, warping from heat, or just the cruel sands of time, into something that is an ineffective shadow of its former self.

I still occasionally cruise the hair aisle at drugstores and it annoys me every time, because there are some really obvious tell-tale signs that the general public is just not aware of. However, something that you can easily spot is that that the bottles of salon products sold at chains stores pretty often have weird stickers all over them,

and always a sticker with a different barcode slapped over the original barcode printed on the bottle.

I can feel the skeptics wondering if this is just a way for hairdressers to convince people to only buy products in their salons. And it is true, we do make money from people purchasing products through us. But I’ve seen and played with drugstore products firsthand, and they’re just not the same as their salon-dwelling counterparts— they’re separated and oily when they’re usually smooth, or they smell different, or they’re just a different consistency.

So I can’t in good conscience tell you that getting it at the drugstore is just as good. I can be a little skeptical myself, but I know from personal experience that diversion is a real thing and that you’re not getting what you pay for when you shop for salon products at the same place you pick up frozen pizza. Wild Comfort... Texas Style Ranching and shooting are part of Texas’s heritage. Kathy, a Texas state-licensed CHL Instructor and NRA Certified Pistol Instructor, will gently guide you through both the classroom and the live-fire portions of the CHL course. The four-hour classroom segment is held from 9:00 A.M. to 1:00 P.M. in the comfort of the upscale lodge. After a yummy lunch at the “Come ‘n Get It” serving bar, guests head down to the range on the Mule for the shooting portion of the course. If your fingers are itchy, feel free to take a little extra trigger time––just don’t shoot the exotic deer! Then, it’s back to the lodge for Happy Hour snacks and adult beverages until 5:00 or 6:00 to cap off the successes of the day. A Ranch Day Getaway offers a great opportunity to gather up a bunch of friends and share a fun outing, Texas-style, that you’ll always remember. It’s also the perfect way for small businesses to reward employees and encourage team-building.

Ranch Day Getaways are held on the second Saturday of each month except for the next one is Saturday, January 18th. Many economists are predicting that home prices will really take off by 2014—welcome news for home owners! According to the National Association of Realtors, prices are expected to rise five percent in 2014. The volume of sales is on the rise as well. In fact, home sales are expected to grow by about 14 percent in 2014.

Good News for buyers…

Mortgage rates are still at record-breaking lows. 30 year fixed-rate mortgages are in the three and a half percent range for the most qualified buyers. That’s quite a difference from 2009 when they averaged about 5 percent. Low rates won’t stick around forever, though. The National Association of Realtors is forecasting 30 year rates to climb to 4.6 percent within a couple of years.

The holidays are over. The decorations are down. Does your house suddenly feel ordinary? It’s time to freshen it up—what treasures will you display, how will you display them—and most importantly, how will your home feel? The way your home feels when someone walks in depends on a number of things—colors, lighting, accessories, furniture arrangement. To express your individuality in your home—not doing what everyone else does—one of the best ways to give your home that unique quality is through your decorative items. Show off your treasures, don’t keep them tucked away in a cabinet. Experiment. Move them around to different places and arrangements until you find the right fit. There are no rules for creating displays in your home. However, the rule of thumb when arranging is to group in odd numbers, 3 or 5 are the most common. Vary heights, either with the items themselves or using lifts. For maximum impact, group like items together instead of scattering them about the room. Recognize the beauty in imperfection and appreciate the unusual, or even unique qualities in ordinary objects, it adds character and creates conversation. Consistency is the key to making your displays flow. You can do a theme like oriental or western, a predominant color scheme like blue and white, a vintage collection or just a random collection of all things that you love and have nothing to do with one another…just remember to make it intentional. There is so much enjoyment to be had living with your treasures or collections. If you love something enough, show the world how much by displaying it for all to see. If you feel stuck or unsure, ask a trusted friend with good taste to assist you, or make a very small investment in having a professional decorator come in for an hour or two. Solar Batteries Hybrid Systems Worth Looking Into By James Hicks

Since we covered batteries in the last article, let’s go into more depth regarding inarguably the least common version of solar in the United States, battery-backed, also known as “grid-tied battery-backed” or “hybrid” systems. For the purposes of this article we will refer to them as “hybrid.”

Hybrid systems are designed around critical load handling—meaning they are more of an emergency power for only specific outlets or loads. If you have, for example, insulin or medications that must be refrigerated at all times, a hybrid system might be something worth looking into. That being said, the United States has an electrical grid that is 99% reliable, and short of natural disasters, the grid rarely fails. Because of our grid, these systems are much more common elsewhere with less reliable grids, where blackouts and brownouts are still likely to happen and generator backups are cost prohibitive.

The Bewick’s Wren, pronounced like the Buick car, is a very entertaining little guy. In 1821 after collecting the first know specimen in Louisiana, J. J. Audubon named it after his friend Thomas Bewick, a British engraver. This small, hyperactive bird with white eyebrows and a constantly flicking tail can be seen hopping about from branch to branch. The wren is an amazing vocalist and can be heard often belting out loud trills. Usually he is doing this to attract a mate. Audubon is quoted as saying “it was the sweetest song he had ever heard.”

Here in the Hill Country, the Bewick’s Wren can start calling for a mate as early as November. They are almost always the first bird in our area to nest in beginning of February. They love to nest up on our porches and patios in plants, bags and boots. Mailboxes also seem to be a favorite. The male will often make up to five dummy nests taking the female house hunting for her to choose which one she likes the best—life imitating nature. They typically have 1-2 broods each year laying 3-8 eggs each time.

They mainly consume insects and are constantly moving about darting in and out of crevices and bushes. The most fun you can have with wrens is feeding them live meal worms. Putting a few forkfuls in a small, smooth-sided cup on your porch every morning will bring you sheer delight…no really. While many birds may come to get some tasty worms, the Wrens are the most fun to watch. So, put up a birdhouse, set out some worms, and enjoy your Bewick’s Wren.

Year after year I write these, and although these will be brief and concise, I didn’t want to break tradition:

1. I will begin a master plan and list of what I want to do in the spring. This plan will work toward water conservation with either drip irrigation, SDI, native/well adapted plants, turf replacement, or combinations of all these. 2. I will still give my lawn and trees an occasional soaking, remembering that those roots are still growing. 3. I will trim all dead limbs and branches touching my roof. 4. I will make sure my mulch is 4-6” deep. This time of year is even more important, as it provides insulation for cold sensitive plants. 5. I will learn what plants will thrive by driving around my area looking for examples, not by going to a chain store and reading their publications! Argh! Sorry, but if I hear one more plant victim say, “They said it was deer proof and well adapted…” Yes, and they needed to sell a certain quota of plants pushed on them by headquarters, who ordered the same plants for every store from El Paso to New Orleans.

Ahem…sorry for the outburst. I guess this is the segway into the wonderful and loving spirit that the holiday season has brought upon me.

Time to Say “Thanks”

Although the first of the year is a time to look forward, to make resolutions, to throw away the eggnog that is beginning to grow fur, it only seems fitting to also look back and reflect on how we got to the end of 2013. There are so many people and opportunities that have helped us along the way, and here is just a short (by no means complete) list of people that come to mind. If you ever see a turtle on a fence post, you know he didn’t get there by himself, and that’s how I feel today—knowing that what I have accomplished took the effort of many others who don’t hear my gratitude nearly enough. With that said, “Thank you…”

On a sad note, the irrigation industry has lost one of its treasures. Danny Abel, a literal pioneer in our field, passed away recently. His license number was 85. To put that into perspective, my license number is 9453, and new licenses are approaching the 20,000 mark. As his competitor, I had the utmost respect and admiration for Danny. Thank you, Danny, for setting a high standard for all Hill Country irrigators… Zack Derese has deep roots in Kerrville. The above illustration shows those who are financially eligible for free medical services from the Raphael Clinic. With the State of Texas’ refusal to accept $79 billion to expand its Medicaid program, Raphael Clinic expects to be operating at its current level, with no dramatic decrease in the number of patients expected. Texas leads all states with 25% of its residents living without health insurance, and the decision not to expand Medicaid will leave an estimated 2.5 million Texans with limited access to affordable health care services. Raphael Community Free Clinic, located at 1807 Water Street in Kerrville, uses its clients’ financial records to determine eligibility. Approximately 10% of current patients may be eligible for a subsidy in

the marketplace exchanges, and clinic health care providers are encouraging these patients to investigate options for health insurance coverage. For our other hard-working neighbors who struggle to make ends meet and cannot afford health insurance, it is clear that Raphael Community Free Clinic will remain an important part of the community’s safety net, even after full implementation of the Affordable Care Act. Get Moving with

Nordic Walking

T

he holidays are over and winter is here. The weather is still cool and Kerrville’s city parks are preparing for a beautiful spring. It’s a great time to walk—my favorite way to exercise. I enjoy using the scenic loops in Kerrville-Schreiner Park and the Singing Winds Park trail winding through the woods.

Path to Fitness Is Not Short

From the time of my bi-lateral hip replacements and a friend’s helpful suggestion that I enhance my training effect by using Nordic walking poles, it took a couple of years to get really aerobically fit and reduce my weight. “Nordic walking” derives directly from the Scandinavian endurance skiers who use dual Nordic walking poles to train in the mountains during the months without snow. Many Europeans routinely walk with them as part of their daily life. In Kerrville, you may have noticed the growing number of people using double “walking sticks” in our parks and on our streets.

Benefits of Nordic Walking

After using Nordic walking poles for over two years, I can say without exaggeration that Nordic walking is a great inexpensive innovation for our walking community. There are the distinct mental and emotional advantages of being able to relax and get into the rhythm of a “zone,” boosting those mood-enhancing endorphins. This type of exercise can also be used for rehabilitation after injury or surgery and for cardiac rehabilitation under a doctor’s care, as well a handy protocol for physical therapists during all stages of physical rehab. Specifically, Nordic walking offers joint protection, bone and muscle development, and organ conditioning— available to those who are willing to put forth the effort to walk consistently and be patient. Hope to see you soon in the park—I’ll be there four to five times weekly for both short and long walks that are so relaxing, stress free, and health enhancing. Darrin Potter Imagineer, Bringing People Together

“This is what I was born to do,” claims artisan Darrin Potter. He sweeps his hand over a striking array of handcrafted furniture and accessories at Copper Cactus on the Ingram Loop.

In his artwork, form often follows function with an impressive show of style. Darrin smiles and adds, “Inside Copper Cactus, you can find one of everything but not two of anything.” So if you’re just passing by, the exterior might be misleading. It’s a colorful chaos—tin sculptures and Talavera tumbling across the porch, yard, and gardens.

Sharing Art

If you don’t find Darrin at Copper Cactus, you might check the back forty of our local ranches. Captivated by nature’s beauty at a young age, he enjoys being outdoors. “Wildlife and wild places fascinate me.”

Driftwood, copper, stone, and glass are just some of the mediums Darrin utilizes to create art—often repurposed from found objects. “My goal is to create great conversation pieces that can be handed down from generation to generation,” Darrin explains. Sharing Compassion

Glad to share that appreciation of nature with others, Darrin enthusiastically takes Wounded Warriors on donated hunts. “These soldiers suffer not only huge physical tolls, but emotional ones as well,” he notes. “They come from all over the country to San Antonio’s Brooks Army Medical Center for rehab. Most are far away from family and friends, making it even harder to try to figure out what to do next with the rest of their lives.” So instead of leading four or five Wounded Warriors for a single event’s hunt, Darrin prefers to take just one or two hunting at a time—often multiple times—to build relationships. “I’m fortunate to have a great life. It motivates my gratitude for these people who have kept our freedom safe.” According to Darrin, three or four ranches repeatedly donate hunts for these Wounded Warriors. He concludes, “I couldn’t do it without the ranches. They help me connect the dots that bring us all together.” Anyone else out there interested in keeping the dots connected to our Wounded Warriors?
