Three Keys to a Simple Estate Plan Every adult, no matter their wealth, age, gender, or status can plan for the inevitable. A simple estate plan consists of three fundamental keys. You need a written instrument that directs your property and affairs in the event of your death. However, a will cannot be probated until you die. So, you need written instruments that direct what happens to your property and affairs in the event you cannot do so yourself, for instance you become incompetent; but, you are still living. Finally, you need to take advantage of some of the not so obvious non-probate options at your disposal. If you take these three minimum steps, then, you have a simple estate plan. The first key is to have a written instrument which directs who you want to inherit your property. If you have children under the age of eighteen, you can name a guardian to care for them in the event something happens to you. The most common written instrument is the last will and testament; but, you can also utilize trust instruments in combination with your will to allow for more after-death control of your property. Wills require very formal procedures for proper and legal execution. So, you should consider hiring a lawyer. Trusts lack the same formality requirements of a will; but, because trusts are more complicated, a lawyer is recommended. The second key is to have written instruments that can become effective during your life,

usually only upon your disability. These are called power of attorneys wherein you elect in advance some person or persons authorized as your agent to make your decisions when and if you are unable. There are two types, one is a power of attorney concerning your property and the other is a power of attorney concerning your health. They are two separate documents and the agent or backup agents don’t have to be the same. They can be drafted in very precise or broad terms and rights for the agent. There are statutory forms available and these documents are easy to execute. Nobody should be without these instruments.

You don’t have to be rich to consider estate planning. The third key to a simple estate plan is to make yourself aware and utilize outside of probate options you have with most property accounts. These include, but are not limited to, bank accounts, stock brokerage accounts, retirement accounts, insurance policies, vehicles, and manufactured homes. All of the property items can normally be given to your named beneficiary or beneficiaries upon your death immediately and directly without the necessity of your will being

probated. Consult with the account holders to determine if a right of survivorship designation or a paid on death designation naming beneficiaries is available. Each person is different. So, you need to consult with your lawyer about how to proceed. Even using the legal services of a lawyer, a simple estate plan as I have described should be relatively inexpensive. Some new additions include a wide assortment of boots, belts, hats, and western apparel, as well as potpourri, linens, and keepsake lace. Remote control cars, airplanes, helicopters, scooters, and fishing equipment will also be showcased––great gifts for men and women. Be sure to look for the parade of decorated trees ready for purchase for your home or office. You’ll find treasures for everyone on your shopping list, and for yourself too. The show starts on Thursday night from 5 to 8 P.M. for ticketed Kerrville Chamber of Commerce members, and opens to the public at 10 A.M. Friday. Sleigh Bell continues on Saturday from 9 to 4, giving shoppers plenty of time to see the downtown Christmas parade and take part in the Courthouse tree lighting. Sunday hours are from 10 to 3, and Santa will be present to visit with kids for free from 11 to 2. Bring your cameras and capture some memorable holiday moments.

Victorious Walk Ministries

The Finds stores, Sleigh Bell Boutique, and Breakfast with Santa are all projects of the Kerrville nonprofit organization Victorious Walk Ministries. VWM is a 501(c)3 nonprofit corporation, founded in 2005. Beneficiaries of the VWM current projects include Kerr

County Christian Women’s Job Corp, Dietert Center’s Meals on Wheels Program (with the Tables for Good events), the YMCA, and others. September’s Tables for Good show at Dietert raised about $24,000—funding more than 4,200 meals for home-bound seniors through the Meals on Wheels program. VWM greatly appreciates the support of the Kerrville community, whose donations keep the stores humming. Finds welcomes donations of gently used clothing, furniture, books, jewelry, home décor, linens, art, tableware, small appliances, and electronics. The store does not accept mattresses, or any items that are ripped, stained, or otherwise unsalable. Donations may be made behind the store any time during business hours— just follow the donation signs. If you have large items, Finds offers free pickup service. Plant ON! With the holidays fast approaching, it’s time to get a head start for the winter festival. Tired of pulling weeds this year? Try an economical approach by layering thick sheets of 2-3 inches of wet newspaper—or cardboard— in those weedy spots. Sprinkle the paper with snail and slug bait, and cover with mulch. Another thing to consider is planting Elbon rye grass. This grass acts as a way to control those pests organically, and at the end of the season, you simple till the grass back into the soil as a green manure fertilizer for the soil. Now also is the time for blooming winter annuals. Pansies, snapdragons, violas, dianthus, ornamental kale and cyclamen can greatly add to the winter ho-hums with their brightly colored flowers. Thinking about planting a tree? The best time of all is fall to early winter. This planting time is so the tree can get a start on its root system before next year’s heat of the summer, plus it’s cooler when you dig that hole!

Don’t forget to prune those perennials after the second hard freeze, generally leaving a 2-3 inches of stump so you know where they’re located. It’s okay to plant annual color there too, and your watering will help them both survive the winter. Have a thankful season and a very blessed Christmas!

don’t know anyone that doesn’t have some kind of organizing issue. We are all guilty of acquiring too much somewhere in our houses. If you’re like me, when my house is unorganized so is my life. Here are a few questions to ask yourself to help create order and to ensure it suits your style, the room and what you need to stash. Do I like to see everything, or would I rather it be hidden? Some people don’t mind having their stuff out in the open, but others want it out of sight. What items do I need to store? Figure out which items you use the most and what gets used occasionally. Things that can be tucked away to only get at every now and then frees up space for items you use every day, which need to be more accessible. What upkeep am I willing to do? Be honest with yourself—if time to tidy is limited, make cleaning easy with lots of closed storage. Displaying items can be a great look, but they need to be kept in their place to keep things looking organized. For an eclectic/funky look you can get really creative with storage solutions. Look at what you already have that may be used. For a streamlined look, use all the same color. This is one of those projects you will be glad you did and you will probably have more room than you thought which means you can get more stuff…yeah! This time we would like to talk about batteries, which is a very important part of the next two types of solar installations we will be writing about. Hybrid and off-grid arrays both require batteries, so before going more in-depth regarding those arrays, we felt it important to address this.

We have all used multiple types of batteries throughout our lives, solar is no different. They come in all different shapes, sizes, voltages, capacity, and even technologies. Solar batteries are basically deep cycle batteries, not much different from a marine battery, however the two are not interchangeable.

Whatever battery technology, capacity, or voltage you choose, the result will be your “Battery Bank.” This is when multiple batteries are connected in series to increase voltage or parallel to increase storage. One disadvantage to batteries, besides the cost, is if one battery goes bad the entire bank must be replaced or you will damage the new battery. Life expectancy of a battery bank is 4-7 years before requiring full replacement.

The most common solar battery is a flooded lead-acid cell, which has been around for quite some time. They require adding distilled water periodically, and a wellventilated storage area due to the hydrogen that is released during charging. Under a heavy charge (40+amps) you’ll actually be able to hear the batteries boiling; this is a

How to Choose a Landscaper Reputation

First, has the company been around for a while? For mowing your yard, the high school kid next door is fine, and will save you money. But for more intense landscape construction, it is imperative that you choose a company with a solid foundation and a great reputation. More than one homeowner has ended up with a lien on their house from a local contractor who didn’t pay for their materials. Don’t let someone “practice” at your expense. The great thing about landscaping is that it is such an easy field to get into. The bad thing about landscaping is that it is such an easy field to get into!

References

Ask for references. Even then, a landscaper will give you their favorite clients. Try to find a couple of jobs that the company has done that they haven’t told you about, and see what those clients have to say.

Design

Beware of companies that offer free plans. We have not found a way to offer a well thought out, detailed design for free. A basic construction sketch to show you what areas are encompassed in the project may be given, but a true landscape design that accounts for all of your ideas, includes knowledge and experience in horticulture, local conditions, irrigation, drainage, and construction, is a very time consuming process. In return, however, planning always pays off and can more than pay for itself by streamlining the construction process.

Personnel

Take a look at the crew. Are they in uniforms? Are their vehicles clearly marked with the company name? Are they cordial and happy to be on the job, or surly and unwilling to work? Happy workers create beautiful landscapes! Now just because a crew is in uniform is not a litmus test for the perfect company, but if an owner

has invested in great people and creating relationships to keep them happy, they are usually in it for the long haul. Ask about the on-site management. Make sure the crew leader is fully trained and has years of experience, not a high school kid or someone just out of prison.

Liability

Liability is a big issue in our day, and many times people don’t think about it until it is too late. Your landscape contractor should carry at least a $1,000,000 GL (General Liability) policy and should be eager to provide you with a copy. This is not an automotive insurance policy, but a separate policy that will protect you if something goes wrong on your property. Zack Derese has deep roots in Kerrville. Texas Furniture Makers Show Returns by Lisle Drake

The Kerr Arts & Cultural Center

is bringing the nationally-acclaimed 14th Annual Texas Furniture Makers Show to its spacious downtown galleries October 31 through November 30, 2013. This juried exhibition is a statewide competition featuring handcrafted pieces by the best custom furniture makers in Texas and is co-sponsored by Woodcraft, a national retail chain of specialty woodworking tools and equipment located in San Antonio, Austin, Houston, Dallas, and Fort Worth. The purpose of the show is to present the work of Texas furniture makers to the public in a formal gallery atmosphere, to improve the quality and skill of Texas furniture making by formal consultation and by example, and to bring national attention to the one-of-akind handmade works of art created by Texas furniture makers. This year’s three judges are: Asa Christiana, a teacher and editor of Fine Woodworking, Newtown, Connecticut who has been associated with Fine Woodworking since 2000. Jeff Miller, a furniture designer, craftsman, teacher, and author in Chicago, Illinois. His furniture has been shown in galleries and shows nationwide, and has won numerous awards. Omar Angel Perez is a designer/ builder of fine studio furniture and also 2004 Emmy award-winning designer/ animator. Most recently his Stilett“O” series of sky-high heel sculptures has received much international interest, and have been admired by stylists and photographers around the world. Omar has recently been nominated for a second designer/animator Emmy award in broadcast television. Debbie Minns, KACC Executive Director notes, “While the show will be up for the entire month of November, many pieces sell early, even before the awards are announced, so we encourage anyone looking for that special piece of hand-crafted furniture for their home to visit KACC early and avoid being disappointed by seeing a red dot on the tag of the piece they fall in love with.” Many of the artists will be present at the Presentation & Awards ceremony from 5:30-8:00 P.M. on Saturday, November 9, and available to discuss commissions as well as sales of their show pieces.

When looking into real estate transactions, you have probably come across the term “short sale.” These sales can provide sellers an opportunity to avoid foreclosure and can also provide buyers with an opportunity to purchase a property below its market value. Following is some basic information I came across on short sales: In a short sale, the seller arranges with their mortgage lender to accept a price that’s less than the amount they owe on the property. As part of this arrangement, the lender typically agrees to forgive the rest of the loan. As a result, the seller doesn’t have to go though a foreclosure, the buyer picks up a property at a discount, and the lender avoids taking on the burden of unloading the property. Sounds good right? Well, sellers need to know that a short sale may damage their credit, though probably not as much as a foreclosure. Also, lenders generally will only agree to a short sale if the seller is many payments behind and has received a default notice. Buyers may get a great property at a discount, but they also will need to go through some extra paperwork too. Not to mention, they also need to be prepared to roll up their sleeves if that new property needs fixing up. What would happen in your later years if you couldn’t leave your home? Couldn’t shop for food? Couldn’t prepare a meal? Who would help you survive?

The Dietert Center would! For nearly 45 years, Dietert has been feeding Kerr County’s elderly. A hot, nutritious meal is the lifeline that keeps many of our oldest citizens independent and in their homes. Every weekday, Dietert’s “Meals On Wheels” program provides a hot lunch and warm friendship to 300 frail elders. Many are disabled and on limited incomes. More than 73,000 meals were delivered by smiling volunteers in Kerr County last year. “In many cases, our volunteers are the only people these elders see,” says Pat Hudgins, Dietert’s “Meals On Wheels” Coordinator. This year, $155,200 must be raised to keep this critical program going. Help feed a senior by sponsoring meals for a day, a week, a month, or even a year. PRMC Auxiliary Volunteers

This tiny little lady is the (great-grand) mother of all volunteers, as well as a skilled craftsperson and a ping pong champion.

orn and raised in San Francisco, Lorraine Mannering fell in love with a handsome Texan and moved with him to Texas’ Rio Grande Valley in 1945. Being so far from her family, Lorraine felt the need to “help others” and choosing a hospital auxiliary over the Junior Service League, she began her 57 years of volunteering. This included 44 years of service at the State Board level of the Texas Association of Hospital Volunteers (TAHV) and her election as President of that organization in 1989. During those Valley years, Lorraine, raising a son and daughter, was a scout leader, PTA president, and active in Altar Guild while working in the family automobile dealership as an independent insurance agent.

After losing her husband of 47 years, Lorraine moved to Kerrville in 1994 to be closer to family. She has two children, two grandchildren (one of whom is an Orthopedic Surgeon in San Antonio) and six great-grandchildren. Of course, the Hospital Auxiliary here at (the old) Sid Peterson Hospital beckoned and Lorraine continued her “Life Membership” (she now has four in four different hospitals) association with volunteering. In her spare time this energetic, 93-year-old lady enjoys needlework, especially counted cross-stitch. For the Hospital Auxiliary she crochets baby blankets and hats, and stuffs and paints bears. She is most proud of her 19 gold and four silver medals won playing ping pong in Senior Olympics. Pat Murray, CEO of PRMC, stated that he would never play ping pong against her. “Not with that vicious backhand,” he stated. If you are in the area of the PRMC Gift Shop on any Tuesday afternoon, drop in and meet Lorraine Mannering, working as usual. She will sell you a balloon—and steal your heart.

Dawn after Darkness

The month of November is National Hospice Month. Dawn Keehn wrote this wonderful article after her husband, Rick, passed away. Her insightful words tell the story of hospice. Dawn, thank you so much for your words and the opportunity to care for Rick. — Peterson Hospice

Terminal cancer and hospice—three simple words which can strike fear into the bravest of souls. When my husband Rick was first diagnosed and hospice was suggested as an option, we panicked. Our minds raced, running straight to the blackest of thoughts where terminal=death, cancer=death and hospice=death. The reality is that life is terminal. We are all heading in that direction, whether we admit it or not. None of us are assured of tomorrow. We may only have an hour, month or years remaining, but each is a lifetime for someone. Our choice is not whether we live or die, but rather how we live and die. Our cancer diagnosis didn’t take away that choice; it simply allowed us to be reminded of the choice. The reality is—a diagnosis is not a guarantee, we all live and die. Hospice is for the living—dying is a part of living. Hospice’s goal is to ensure that individuals have a good quality of life, respecting and honoring individual wishes. Our Peterson Hospice nurse explained, “Hospitals are here to treat you until you are well enough to return home. Hospice offers a specialized care, focusing on quality of life and comfort.″ We can’t say enough about the Peterson Hospice staff. From the beginning they treated us with respect. Notice I said “us.” The staff was there for both my husband and our entire family. The staff ensured that Rick was pain free, symptom free and as comfortable as possible, by providing medications and equipment to ensure Rick’s quality of life. We looked forward to our hospice nurse visits; she was a ray of sunshine and lifted our spirits. The social worker, chaplains and volunteers constantly assisted Rick and our family. They asked about Rick’s goals, large and small and helped him achieve those goals. Flowers were delivered each week; we began to look forward to our “flower lady” visit.

When Rick passed, the Peterson Hospice nurse took care of everything. She called the funeral home, prepared Rick for his final ride and even helped put things back in order so I wouldn’t have to. She constantly checked on me and our loved ones. It was such a relief to know there was someone present, taking care of details. Quite honestly I was having trouble breathing, much less attending to details. A month after his passing, I received a book about grief, which brought me so much comfort. I was offered grief support now and in the future. Our family appreciates everything they did and are continuing to do for us! .

Tina Woods Outstanding Woman of the Year

Each year Kerr County Women’s Chamber seeks to honor a

woman of courage who is strong in her convictions and generously shares her talents and time with others. The Women’s Chamber selected this year’s award recipient Tina Woods from local nominations and assistance from a women’s organization named CABLE—a supportive, inclusive community that encourages every woman to reach her full potential and celebrate her achievements through mentors, leadership training opportunities, and networking.

Icon, Advocate, and Author

Those who know Tina all agree she’s special—not only for her leadership qualities but even more importantly, for her ability and dedication to helping others. Her nominations for the Women’s Chamber Outstanding Woman of the Year award were filled with praises of leadership, stability, trust, and compassion. But the common thread through all the nominations was her passionate concern for the elderly. Through her diligent work, Tina ensures that many elderly individuals are safe, cared for, and appreciated.

Her personal acts of kindness are countless and done quietly. Tina is a member of the Alamo Area Agency on Aging Senior Advisory Council, the National Council on Aging, Meals on Wheels Association of Texas, Meals on Wheels Association of America, and the Executive Women’s Club. She’s won two San Diego Emmy Awards, a National Emmy Award nomination, the Executive Women’s Club ‘Executive of the Year,’ and a Community Builder Award for Kerr County. In Tina’s book My War, From Bismarck to Britain & Back, she tells the story of her mother’s service in the Red Cross on bomber bases in England and France during World War II. Tina relates the tale in a fascinating compilation of her mother’s and grandmother’s letters, diaries, scrapbooks, and interview transcripts—a lasting tribute to all three generations of these courageous women.

Making a Difference

As Executive Director of Dietert Center for over ten years, Tina led the campaign to raise funds to build the current multi-use facility for the Center. She not only reached that goal, but surpassed it with funding for a building maintenance fund and doubling endowments for the organization that, among its many successful programs, now provides almost 300 meals a day, five days a week to home bound seniors through Meals on Wheels in Kerr County. The Center also provides an array of activities for seniors including continuing education, a respite program for care-givers, a medicalequipment lending program, and a medical alert system that serves 230 people in Kerr County. It is through Tina’s efforts, working with the Board of Directors, that the Dietert Center is one of the best managed and best funded senior centers—not only in the state of Texas but perhaps in the nation. In addition to her position as Dietert Center’s Executive Director, Tina serves tirelessly on many committees and collaborates with numerous organizations to insure that the physical, social, mental, and emotional needs of the aging are recognized and met. She is our best resource for understanding the community challenges of the aging. Please join us in saluting and thanking Tina Woods— Outstanding Woman of the Year.
