In law, there is a general public policy that encourages an eventual end to any ongoing litigation. This concept is commonly referred to as the “finality of judgments.”
L
ike most jurisdictions, Texas has a series of legal steps a losing party can take that brings their losing issues up on appeal. A higher court on appeal can reverse a judgment from a lower court. After the appeals process ends, however, or deadlines for filing the appeals expire, the judgment becomes final. Well, maybe. The finality of these laws and rules can be harsh for a defendant in a lawsuit, if they lose, especially, where they lose because of a procedural error. For instance, a defendant may have failed to answer the lawsuit, for some good reason; and, a judgment may have been entered against them as a default judgment. The defendant may have first learned about the judgment when the sheriff shows up at their door to execute a writ and collect on the judgment by seizing certain legally, attachable property. The good news for the Defendant and judgment debtor is that the judgment itself can be directly attacked in court by filing a petition for “bill of review,” in the same court; but, within four years after the judgment is entered and provided no avenue of appeals are available because deadlines for appeal have expired. As defined by the Texas Supreme Court, “A bill of review is an

independent equitable action brought by a party to a former action seeking to set aside a judgment which is no longer appealable or subject to motion for new trial.” A Plaintiff in a petition for “bill of review” requests the original court set aside its judgment and grant a new trial on the merits of the underlying cause of action. If the court grants the petition and the judgment is set aside, all the parties go back to square one. If the court denies the petition for bill of review, the petition is dismissed; but, the Petitioner can file appeals like in any other case. Generally, to prevail in a bill of review hearing, the Petitioner must prove that he or she had a “meritorious defense,” that their defense could not be asserted because of some third parties’ fraud, accident, or wrongful act (or some official mistake) and the failure was not associated in any way with the Petitioner’s
fault or negligence. However, those not properly served with an official court citation to appear have no duty to act, diligently or otherwise and aren’t required to petition or prove any fact other than they weren’t properly served. If you had a default judgment entered against you in the last four years, you may want to consult a qualified civil attorney about filing a “bill or review” and try to vacate the judgment. Local Author Signs Her Children’s Books
Marilyne Cizmich believes there are no coincidences in her life, just another chance to pause and look for an opportunity. She was working as a school nurse in Alaska when she accidentally fell causing major injury to both thumbs. Several surgeries and many months of rehabilitation caused her to wonder if she would ever be able to work as a registered nurse again. It was the perfect time to learn something new—writing children’s books. The Institute of Children’s Literature offered an online home course. She only had one usable hand at a time, the other being in a cast for almost a year. A voice-activated computer program helped, but it became easier to type with one hand and four finger tips. Her husband, Snyder King, modified her chopping board with protruding nails to hold down meat/vegetables/fruit. It took forever to cook a meal, but no one complained. When it was time to start writing stories, the saying, “write what you know” became the guideline. The previous year, 1999, Marilyne lived in the Ukraine on a sabbatical from her school nursing job. Each day was a new adventure in living. She decided to use the Ukraine as a setting for her first children’s picture book, Sonia the Church Cat. She visited a nearby orphanage every week and read stories and brought fruit or sweets. At the end of the year, the orphanage gifted her with a one-horned plaster cow sculpted by a former resident. This became the topic of her second Sonia story, How Cora Lost Her Horn. The third book in this series is about train travel in the Ukraine and visiting Kiev. It has a working title of Sonia’s Train Trip and is now at Tate Publishing. Five years ago a little dog, Albert, knocked on their door and hearts. Marilyne learned that dogs wore clothes when they are cold or sometimes just for dress-up. So now she designs denim dog clothes made from recycled jeans and sells them at her booth on Market Days.

Marilyne also completed an advanced writing course with the Institute of Children’s Literature. This required writing her first chapter book. So she told the story of her husband’s boyhood adventures catching and raising animals here in Texas. This book is also at her publisher’s in Mustang, Oklahoma. Helping Your Parents Manage Their Finances As the U.S. population gets older, more people- particularly baby boomers- are confronting a dilemma. As parents age, their ability to manage their own finances may decline. That can make it more likely that they may neglect the life savings they’ve worked so hard to accumulate or make costly mistakes with them. Even worse, they’re more likely to fall victim to one of the fraudulent schemes that frequently target seniors. A recent study found that seniors were 34% more likely to lose money to fraudsters than were those in their 40s.
What’s behind parental reluctance?
Suggesting that parents might benefit from assistance, either from their children or a professional, may remind them of their own mortality. People are living longer; if they’re still active and involved, they may have difficulty accepting that their current good health and financial comfort may not always continue. Parents also may be uncomfortable discussing finances with only one child, preferring to involve all siblings. In this case, you may need to either try to reach a consensus about which child is best equipped to help, or divide responsibilities among siblings. For example, one child might assist with bill-paying and day-to-day expenses while another reviews investments or handles health insurance, Medicare, and Social Security.
When and how to offer help
Signs that a parent might need some assistance include: confusion about whether direct-mail offers are advertising or bills; failing to pay bills or file documents properly, especially if someone has always been highly organized; complaints about being unable to make ends meet; talking about the merits of certain investments, especially unfamiliar ones and especially if a parent hadn’t previously exhibited much interest in investing;
When and how to take control of your parents’ finances unusual behavior, such as making unexpected large purchases or spending a lot of time gambling. If parents are reluctant to discuss specific figures, try to make sure that key information, including online account information and passwords, is on paper, and that someone else knows the location of those items and will be able to access them if necessary. You might start providing assistance in stages. Offer to review checking account statements and/or credit card bills to ensure they’re not paying for services they want to cancel or didn’t request; this may give you insight into the overall state of their finances. Because seniors may be more willing to discuss issues such as health insurance and preferences regarding long-term care or end-of-life decisions before other topics, building trust in these areas could increase comfort levels on both sides with other matters. If a trust has been set up, a trustee or someone granted a durable power of attorney might be the logical person to handle finances, since he or she may eventually have to deal with trust-related issues anyway. And in a worst-case scenario, children can petition a probate court to name a conservator or guardian. Whatever approach you take, one of the key challenges of this process is to respect a parent’s dignity while protecting his or her ongoing well-being. oms and Barrels Sale Hill Country Master Gardeners invite you to “Blooms and Barrels,” your opportunity to buy plants after a dreary, cold winter.
Volunteers began growing plants in the greenhouse in late January for the annual sale set for Saturday, April 11, 9 a.m. - 2 p.m. at the Hill Country Youth Event Center, 3785 Highway 27, Kerrville. “We have more than 1000 plants, representing some 40 varieties of native and adapted plants suitable for our area,” says Sandy Lewis, greenhouse chairman. “We accept cash or checks for payment.” Shoppers can also participate in free educational programs as well as view exhibits and demonstrations. In addition to plants, the group will sell 55-gallon rain barrels for $50 each.

Those Kerr Country residents who purchase rain barrels will be given a receipt which Upper Guadalupe River Authority will honor for a 50% rebate, up to $50, according to Anne Brown, rainwater harvesting specialist. Proceeds from the rain barrel sale go to the Hill Country Master Gardener scholarship fund. Hill Country Master Gardeners is a service organization helping the Texas A&M AgriLife Extension Service meet the horticultural needs of the community. Speedball is a fast-paced game played in an open field filled with inflatable bunkers that can be used for protection and or concealment. Adrenaline Rush Paintball even can provide referees for your group or team.

For some people a home is more than just a place to live, it is a sense of well-being. I’m pointing this out because I recently had my house torn apart because of a water leak and realized how much of an affect it had on my whole life. I started to take notice of all the ways being in my house in different stages can affect me—whether it be good or bad—and what I learned was very surprising. Basically what I realized was that when my house is a wreck I’m a wreck and when my house is sort of in order I’m a little unsettled. And when my house is in good condition my days usually go really well. At first I thought that it made sense for me to be this way because of my design background, but then I started paying attention to my friends and their houses and it does seem to apply to them as well to some degree.

There are more materials, products, technology, information, and sources available than ever before. Many of our clients think in terms of numbers, and apply that to almost all parts of their lives. Well, for all you number crunching nerds out there, here’s a little food for thought. Before you grudgingly shell out the big bucks to make your spouse happy, consider these facts from realestate.com • Landscaping can add up to 14 percent to the resale value of a property. (BobVila. com claims up to 20%!) • Landscaping can reduce the time a home stays on the market by as much as six weeks. • Landscaped patios can raise property values by as much as 12.6 percent. • A 5 percent investment in landscaping can raise the value of a home by 15 percent—a net 150 percent return on your investment. “Well, Zack, we aren’t selling our house anytime soon,” you may say. Great! How many opportunities do you get to enjoy your investments on an ongoing basis? Have you ever walked out onto your lovely “mutual fund,” sat down on your “annuity,” and looked around at all your “blue chips” blooming, and noticed that your “hedge fund” needed trimming? The great thing about a welldesigned landscape is not only the investment

ver wonder how the birds know that there is delectable food for them in your feeder? The answer is oil. Seed-eating birds are always on the lookout for oil content. So a feeder full of plump, fresh Black Oil Sunflower seeds will appear to the birds as a rainbow of color—the sheen from the oil. Birds see things in four-cone color which, without getting technical, means they see things in an ultraviolet image. This is why they can see the sheen on the seed. If your seed is old it may have lost the oil content and if the birds don’t see it, they won’t eat it.
So what about that wild bird food at the market? Do you notice that the birds kick most of it to the ground? It’s less expensive that’s for sure. But as the saying goes, you get what you pay for. Most wild bird food is chock full of fillers. MILO is the main ingredient put in as filler. MILO is a water based grain, not oil filled seed. Remember the birds looking for the sheen on oil? There is no sheen on MILO—it is filled with water so the birds don’t see it as food and kick it out of the way. Here is one more surprise about MILO—it is about 80% of the bag of food! So when shopping for bird food stay away from MILO! You are just wasting your money. Instead opt for straight Black Oil Sunflower. Other popular fillers to watch for are red millet (white is good), canary seed and wheat. If you doubt the freshness of your seed just check it. Take out of few seeds and crack them open on a piece of paper. If you get little spots of oil on the paper, it is still good. If you do not get any spots you should toss it to the deer, they’ll eat anything!

by far the world’s favorite, with potatoes a close second. The third is the tomato. By definition it is a fruit, but in culinary uses it is considered a vegetable. Whatever your opinion tends to be, the tomato is still the most prized possession in everyone’s garden. From its humble beginnings in the wild, to the 7500 different varieties available today, it is still the most popular fruit/vegetable in Americas’ gardens. There is no single way of growing the perfect plant. Tomatoes generally need six hours of full sun, and in Texas summers they do appreciate shade in late afternoon! They require lot of organic matter in the soil, and remember tomatoes are extremely heavy feeders. We don’t get fat unless we eat and the same goes for tomato production. Good soil drainage is also important. I have heard tomatoes can’t swim! There is no perfect variety; this year’s performer may not be next year’s. Site and soil selections are the key, and along with nutrition make the crop. Stake or cage
your tomatoes to help prevent them from having soil diseases, pull off suckers creates more energy for producing the fruit, rather than foliage. Remember there are only 2 types of plants—being determinate or indeterminate. Determinate tomatoes are a bush type, with large amounts of fruit being ripened usually all at once, while an indeterminate will continue to grow and produce more than once. Deep watering is essential, and don’t forget to monitor your plants closely for pests. The tomato horn worm is the most likely culprit for stripped plants. Sometimes the sneakiest of worms, they can look just like the plant.

For most women, hair loss is associated with old age, but
thinning hair can strike at any time. A variety of factors—such as pregnancy, stress, a sudden illness or change in diet, even a bad coloring or chemical straightening—can cause or contribute to an unexpected and noticeable reduction in your hair’s thickness. That volume may not come back, but there are ways to camouflage thin locks and prevent future hair loss. Whether your thinning hair is genetic or triggered by circumstance, you need to avoid products and styling techniques that will exacerbate the problem.
Choose Your Shampoo
Start by evaluating what’s in your shower. Volumizing shampoos and conditioners are a must, but avoid products that contain humectants or heavy moisturizers, which will weigh down the hair strands. Give your head a thorough rinse in warm, tepid water (make sure all the conditioner is removed) and de-tangle gently with a wide-tooth comb.
Style Smart
Apply a styling product that’s formulated for fine hair—a whipped mousse, light gel, or a spray gel or spray foam. Be sure to start at the scalp and apply to problem areas where you want more volume, like the crown. If you blow-dry your hair, the best technique is to flip your head upside down. It’s an old trick, but a good one. The more you lift the hair up over the line where it grows, the more volume you can get! Use a boarbristle brush to style as you dry, gently directing hair over your head. If your blowdryer has a cold setting, give your locks a cooling blast when you’re done styling. This works like a natural hair spray, freezing the memory of the hair. Finally, add a last-minute touch of finishing spray to hold the volume. As with any type of supplement, choosing the right
joint supplement can make a difference in how well you feel. Picking a high-quality supplement can be tricky, so it is imperative to ensure your supplement contains beneficial ingredients. An ideal joint supplement will contain glucosamine, chondroitin, hyaluronic acid, and methylsulfonylmethane.

Glucosamine, an amino sugar, helps promote the formation and repair of cartilage. Chondroitin makes up a large part of cartilage, and is responsible for its elasticity. It also prevents enzymes from destroying cartilage. Hyaluronic acid is naturally found in joint fluid, and helps keep joints flexible and cushioned. It also has anti-inflammatory and antioxidant properties. Methylsulfonylmethane (MSM) is a naturally occurring sulfur compound found in many fresh foods; however, it is destroyed when foods are processed, heated, or dehydrated. A supplement that includes MSM helps maintain healthy, flexible ligaments. Another ingredient to look for in high-quality supplements is Green Lipped Mussels. These mussels are found off the coast of New Zealand, and contain glycosaminoglycans (GAGs). GAGs are the main component of cartilage and joint fluid. They promote anti-inflammatory activity, which aids in the reduction of joint swelling. In trials, green lipped mussels reduced symptoms in up to 76% of people with joint inflammation and deterioration.
In addition to finding the right supplement for joint maintenance, it is also beneficial to find a supplement for acute pain and inflammation. Ingredients like white willow bark, Boswellia extract, and bioflavonoids have anti-inflammatory properties. By reducing pain and inflammation, these supplements provide an alternative to taking NSAIDs (e.g. aspirin, ibuprofen), which can have serious side effects. Remember, supplements are not regulated by the Food and Drug Administration, so it is important to choose a quality supplement made by a reputable company. The Comfort by Judy Jones-Amason
The Comfort Cart is a mobile cart available for use by family
and friends facing end-of-life issues with palliative care patients. The cart is provided and stocked with items that may be helpful, for example (but not limited to): prepackaged snacks, a Bible, current magazines, Sudoku/ word puzzle books, crayons, a box of Kleenex, etc. The purpose is to help families better cope and bring comfort to them during a difficult time.

The cart and contents are funded by the PRMC Auxiliary and are available for delivery by Volunteers during business hours. At other times, requests are filled by the House Supervisor. With certain conditions, the cart can be sent to an Isolation Room. Judy is the Volunteer Coordinator and Patient Representative for PRMC. She is a 28 year PRMC employee and was awarded the Duan Packard “Employee of the Year” Award for 2012 by PRMC.
