We try to make our photo shoots fun—regular people usually seem so uncomfortable at the very thought of being photographed. Making it playful helps take that edge off. This one was especially fun for me. I love the idea of my sweet friend Tori and her mother Lorna partnering on a new venture. As soon as I posted the cover on facebook, a number of people recognized the tree immediately. Do you? What

You Need to Know

Before

a Car Accident

A tortfeasor is someone

who commits a tort. For instance, drivers who are the liable party in a car accident are tortfeasors. In most cases, the tortfeasor’s liability insurance carrier will represent them under the terms of the automobile liability policy. It is the liability insurance carrier’s responsibility to settle the claim any injured parties may have against the tortfeasor. If the tortfeasor needs a lawyer, the insurance company will likely provide legal counsel to represent the tortfeasor’s interest against the injured party. What about the injured party? The injured party normally doesn’t have any prepaid assistance because there is none built into the legal system. There is no provision in Texas law that allows an injured party in a car accident to recover attorney fees from the tortfeasor. If you can’t agree with the liability carrier claims adjuster on the amount of your settlement of all claims, your only alternative is to sue the tortfeasor. You can only sue the tortfeasor and you cannot sue the liability insurance carrier. In fact, if you do end up in court against the tortfeasor, you cannot tell the jury there is a liability insurance carrier involved who may be liable for the amount of all or part of a judgment the jury may award. This information is intentionally withheld from the jury in our legal system to discourage large jury verdicts. In theory, this

saves the general public a few dollars on their insurance bill every year. In reality, a lot of times, this leaves the injured parties short of their needed and just recovery, even when there is insurance money there to pay for the injury. The insurance liability carriers use these legal advantages to settle some claims for a lot less than an equitable amount. The playing field is not equal without professional help on your side. Although reimbursement for attorney fees is not an option for the injured party, personal injury attorneys will take these types of cases on a contingency arrangement. There is no set arrangement, but typically a personal injury attorney will take a case, under the right circumstances, for a fee of one third (1/3) of the recovered amount. Obviously, if there is no recovery, there cannot be a fee. That is why not every case is a candidate for a contingency fee arrangement as the risks are very high for the attorney. All of the attorney’s work could go unrewarded. These percentages can increase depending upon the stage of recovery. For instance, if the case has to go to trial, because the insurance company will not settle, the attorney contract may call for a larger percentage of the recovered amount. To account for the extra money needed to compensate the lawyer out of the recovery amount, a personal injury attorney looks for cases that could include what is known as “pain and suffering.” Under Texas tort law, injured parties may recover, at trial, a subjective amount of money for the pain and suffering that could reasonably result from the injuries. Claims adjusters may take a claim for “pain and suffering” into account in settlement negotiations, avoiding

litigation, but it is not likely to happen without an attorney involved. The percentages for contingent attorney contracts don’t always work out for the injured party in every case. Sometimes, accepting the liability carriers low ball offer may be more economical for the injured party than hiring a personal injury lawyer on contingency. If you become the injured party in a car accident, you want to at talk to a personal injury attorney about your rights and your case before accepting a settlement offer. After a long hiatus from bird feeding— mostly squirrel feeding, really—I decided to feed again. Why now? Kevin and Linda Pillow’s regular birding column in this magazine said that squirrels don’t eat safflower seed. While I adore watching the cute little squirrels, they empty feeders faster than I can fill them Birds like fresh water.

The first thing I did was a Google search and then suddenly realized that was ridiculous. The wiser choice was to email my friend Linda—who I fondly refer to as the Bird Woman of Kerrville—and ask for her expertise .

Linda responded with, “I’ll come with a bottle of wine.” So we sat at my dining table enjoying a nice bottle of Argentine Malbec, while Linda detailed what I needed to do to create a bird haven outside my dining room window.

Next I discovered that a sock feeder is perfect for finches. “The finches will just hang all over it,” Linda explained. “You’ll need hot pepper suet—titmice, woodpeckers, and warblers love it.” Hot pepper? Evidently it’s not hot to the birds.

If you can handle the mealworms (no pun intended), they really are an important addition to your bird-feeding plan.

“The most important thing,” Linda began, “is water. You must keep fresh water at all times. And the right feeders with the right foods to attract the birds you want.”

Use the right feeder to attract the right birds.

Healing Herbs You Can Grow Yourself

Now that spring has sprung and gardening season has arrived, consider planting medicinal herbs among your flowers and veggies. Many herbs grow well in the Texas Hill Country, provide culinary as well as therapeutic benefits, and bloom beautifully. Early in the nineteenth century, the Shakers built a thriving mail-order business, supplying herbs to pharmacists all over America. According to the University of Maryland Medical Center, one-third of Americans today use herbal remedies. With herbal medicine gaining popularity again, you may want to try growing and preparing your own inexpensive, natural remedies. It’s that time of year when we are so sick of

looking at our things all winter long that we start to talk about changing our look. Instead of replacing your furniture you might entertain the thought of just changing up some of your pillows. Pillows can be an easy and relatively inexpensive way to achieve a new look. Here are some of my favorite tips on what can be done with pillows. Mix things up. Don’t be afraid to be bold in this department. As I wrote in an earlier issue, pillows are to your room what earrings are to an outfit. This is also a great place to think outside the box. Pillows can be made from dishtowels, rugs, a silk shirt or scarf—any material that you love. Varying the sizes of accent pillows creates a pleasing change of scale for visual interest. Pillows in one uniform size are boring. You can mix square pillows with lumbar pillows or other shapes, varying from 18 to22 inches. It’s always better to mix and not match. Try mixing pillows that have a neutral base with pillows that have bright florals or patterns that have hints of the same accent color. You can mix patterns, solids and textures and put the same cording on all the pillows to tie the look together without being matchy-matchy. As always, the most important thing is to find patterns and prints that speak to your style and have fun with it. Public Notification regarding a violation of the Total Trihalomethane Maximum Contaminate Level. Total Trihalomethanes (TTHMs) represent a group of chemicals that are formed as byproducts of chlorine mixing with organic matter in water during the treatment process.

Can it be March already? If your plants could talk, they would be screaming for nutrition. Most perennials, trees, and grasses come out of dormancy this time of year, so it’s time to fertilize. The most important feeding months are March, April, and May.

The loveliest home doesn’t have a chance with the poor photography. This is the impression of your home for many buyers. Trying to make out details in dark, blurry photos when there are a lot of other listings to look at could have a very negative effect.

Look at Curb Appeal

Does the curb need to have sand, dirt or pebbles swept clean? Does have leaves, cigarette butts or other debris? Are there weeds or grass growing in the cracks of your sidewalks? Wash down the exterior of your house. You don’t necessarily need to rent a power washer. A hose and broom and some dishwashing cleanser work great. It’s good to have some color in your home. Tenebrio Molitor. Mealworms. Caviar to nesting birds. Don’t be squeamish. Serving mealworms will bring a wider variety of birds to your backyard—especially nesting birds. Since we’re in the midst of nesting season in the Hill Country, now is a fabulous time to start.

All of your birds are searching for live food right now, which provides the protein they crave to begin nesting. The male will often feed mealworms to the female during courting. However, the main event is taking live mealworms back to the nest for hatchlings to feast on. Many “parents” will come to your feeder and will load their beaks to capacity until they have depleted the feeder. They’ll continue to feed mealworms to their fledglings too. It’s amazing to watch this event unfold right on your patio.

Most every bird will come to mealworms, though you will probably see more insect-eating birds that usually don’t come to seed feeders. The most popular bird that enjoys mealworms is the wren, but many, many others will come too. Bluebirds, painted buntings, chickadees, orioles, flycatchers…the list goes on and on.

Mealworms are best found at your local bird store where they come in fresh every other week and are nice and healthy. They come in a container with air holes and bran. You keep them in the fridge—or the fridge in the garage—where they stay dormant. You then place a couple of forkfuls in a slick sided dish, preferably at the same time each day. You can play like you’re Pavlov, and tap your fork on the side of the dish each time so as to signal to the birds that it’s dinner time. Birds just can’t resist a bowl full of squirming mealworms!

Planning pays off

Planning ahead is essential in all areas of life: from financial matters to building a home, and of course providing the perfect setting for that home. You would never begin building a house without a detailed set of plans, yet many people wait until the building is finished and suddenly realize they haven’t even thought about their outdoor living spaces. Begin your landscape design along with site planning for your house. If you decide to do your own planning, make a list of your landscape priorities. Start a sketch that denotes hardscaping (walkways, structures, patios, etc.). Then fill in shrub beds, groundcover areas, lawn, and wildflower/native areas. Browse neighborhoods, magazines, and the internet, looking for styles and components you like. But be careful of non-local sources, as what they have done may not work here in the Hill

In 2008, shortly after Salada’s opened, I reviewed the restaurant and was most pleased. Then, as now, one can enjoy the all-you-can-eat buffet of over 50 salad items, breads, soups, baked potatoes, tacos, and desserts. I always enjoy visits to this clean and friendly restaurant. It’s been a pleasure watching Tori Varwig, owner and manager, expand her business. The menu has grown to include quiche plates, meatloaf and cold or hot specialty sandwiches. And don’t forget “Sweet Treats,” the great little bakery within Salada’s. My wife recently enjoyed the quiche plate served with a bowl of soup and a small green salad. I had to sample her Quiche Lorraine and the Cream of Jalapeno Soup. Great! I tried the Salada’s Ultimate Burger. Don’t expect a frozen patty here. The large homemade patty served on a jalapeno-cheese sourdough bun, topped with lettuce, tomato and red onion will delight all burger lovers. It was well seasoned and presented with a choice of chips or a side salad. My recommendation—order one next time—especially if you’re really hungry.

On another visit my wife ordered the Curried Cranberry Chicken Salad. It is always one of her favorites, and maybe it will become one of yours as well. I had the Premium Roast Beef “French Dip” with grilled onions and Swiss cheese on cibatta bread and served with a side of au jus. This has become my personal favorite. Of course, I love Tori’s soups, especially the Cream of Jalapeno and the Tortilla Soup when the weather is cool. In the summer the chilled Strawberry Soup and the Cucumber Soup are refreshing and delicious. Salada’s is a great place to take family, friends, and business associates for a casual, relaxing meal. When you think “hospital volunteer,” do you think of a sweet little lady in tennis shoes and a turquoise vest? Well, think again. Peterson Regional Medical Center is proud of their gentlemen volunteers—eighteen to be exact— from a total of 85 volunteers. With poise and smiles these guys perform varied duties for patients and staff; some even work other volunteer jobs such as home health, Meals on Wheels, hospice, and the library. Most are retired, but one enjoys a part-time job and juggles his work hours with his hospital shift. (PRMC) has taken a giant step toward improving the health of newborns and infants by earning the Texas Ten Step facility designation from the Department of State Health Services and the Texas Hospital Association. The Texas Ten Step Program encourages breastfeeding as the preferred method of feeding for newborns and infants. Peterson joins a growing number of Texas birth facilities that are supporting new mothers and their decision to breastfeed. Based on the World Health Organization (WHO)/UNICEF’s Ten Steps to Successful Breastfeeding, the program aims to assist birth facility’s support of breastfeeding mothers before, during, and after delivery; encourages them to identify breastfeeding resources for the mother after she is discharged; and encourages facilities to reach the Healthy People 2020 goal of having 82 percent of mothers exclusively breastfeeding when they go home with their newborn. Texas Ten Step facilities are asked to address 85% of the Ten Steps to Successful Breastfeeding, be designated as a Texas Mother-Friendly Worksite, evaluate their breastfeeding policies, maternity care practices and educate all healthcare staff routinely with evidence-based courses. “Our nurses, midwives, and doctors have worked on this project intensely for six months to raise breastfeeding rates and provide a healthy start for new moms and babies,” said Tina Korbelik, Director of Women’s Services at Peterson. “We are very pleased that our 42 │Mar-Apr 2013 │ KCP

breastfeeding rates increased over the years and that we have now earned the Texas Ten Step designation. Feedings may be bunched together, wake baby if needed. • Ask where you can get breastfeeding help if needed. • Breastfeed whenever your baby wants to. You will know its time when your baby turns his/her head, turns from side to side with an open mouth, or when he/she puts their hands to their mouth. • Don’t wait until your baby fusses or cries to feed, when upset, its harder to feed well. • If breastfeeding hurts, get help. A small change in how your baby takes the breast may be all you need to feel better. • Find a mother’s group near you. Spend time with other breastfeeding mothers. • Trust your baby to know the right time to feed. • A baby usually does best on mother’s milk alone until about six months.

Infant warmers are placed in the nursery and cesarean rooms to receive newborns after a delivery. They are a warmed bassinet to monitor and assess a newborn with stabilization as needed and have the ability to provide oxygen and maintain a newborn temperature.
