Illegal Flying Objects
ffective September 1, 2013, Chapter 423 of the Texas Government Code specifically addresses the governmental prohibitions on the use of unmanned aerial vehicles (more commonly known as drones or UAVs) operated by Texas private citizens. The new statute prohibits Texas citizens from using “an unmanned aircraft to capture an image of an individual or privately owned real property in this state with the intent to conduct surveillance on the individual or property captured in the image.”
The Texas legislature was apparently attempting to address the potential proliferation of drones and their potential use by Texas citizens. Drone technology has come a long way. It is now possible to manufacture a miniature aircraft mounted with a camera that can be flown overhead capturing video. This technology was once only affordable by big budget government agencies like the military. But, new technologies always evolve into more economical options for the common citizen. That’s exactly what has happened with drone technology. Just look around on the internet, and you will be amazed at the now affordable prices for this innovative and developing drone technology. The Texas statute starts with the general prohibition but then incorporates nineteen (19) exceptions to the law. Among these are exceptions for law enforcement under certain conditions; and private citizen use such as scholarly research, real estate
brokers, or activities conducted in the course of oil pipeline safety. The Texas statute is enforceable with the threat of Class “C” criminal prosecution and imposition of a fine. Like most traffic violations, no jail time may be imposed under the penal code provisions for a Class “C” misdemeanor. However, the new Texas statute may not be the last word on the subject. Opponents point out that the Texas statute may conflict with the Federal Aviation Administration’s (FAA) new regulations mandated by the United States Congress concerning the use of these “unmanned vehicles.” As the individual States pass differing legislation concerning unmanned aircraft, the balance between the new federal regulations mandated by the United States Congress and the new state legislation may become clumsy and confusing. For this reason, the new Texas law may become a target in the courts under the doctrine of federal preemption. Will the FAA federal regulations on UAVs in some way preempt the Texas statute? We will see. Federal preemption isn’t the only potential road block to the Texas new drone legislation; and, Texas isn’t the only state to enact new legislation to restrict the use of drones. In those other states where new legislation is concerned only with limiting government use of drones, there seems to be very little concern. However, in the new state legislation in states like Texas where the limitation applies to private citizens, there may be an arguable conflict with the citizens’ rights under the First Amendment to the United State Constitution.
Before you purchase and fly a drone in Texas, you should contact your lawyer to see if you are exempted from the statute. If you are not exempted, don’t despair. I suspect the laws concerning the flying of drones in Texas are in an evolutionary state and subject to change by the courts or by new legislation.

Do you have a deep appreciation of our great state and love the outdoors? Then you may be the perfect candidate to become a Texas Master Naturalist.
Texas Master Naturalist is a master volunteer organization comprised of Texas A&M AgriLife Extension, Texas Parks and Wildlife Department, and over 300 local partners. The state provides an advisory committee, training guidelines, advanced training opportunities, program marketing and promotion, and curriculum resources. Also at the state level, a volunteer representatives committee represents the varied interests of the local chapters and provides a communication link to the state committees and program leaders. Since its beginning in 1998, the program has trained over 8,000 Texas Master Naturalist volunteers and has 44 local chapters, including the Hill Country Chapter, based in Kerrville. These volunteers have given over 2 million hours of service, valued at over $40 million—all the while having fun, learning new things, and enjoying the camaraderie of like-minded Texans. continue to next page

Most women with blonde hair are actually not naturally blonde. As we age our hair tends to darken to at least a dishwater or dirty blonde. Yet blonde hair remains the most popular hair color in America. If you’re considering taking the plunge and going blonde, make sure you’ll look good as a blonde. Here’s how to tell if you will. Were you blonde as a kid? The rule of thumb to follow when it comes to blonde hair is this one: If you had blonde hair as a kid, you’ll likely look good with blonde hair as an adult.

Are you willing to invest the time in upkeeping your blonde color? If you have naturally dark hair,
keep in mind that blonde hair will be high maintenance for you. Because hair must endure bleach and toner, going blonde when you’re a true brunette is a multi-step process that may take a couple visits to the salon. If you go too light, too fast, your hair can get dry and damaged, which isn’t pretty regardless of your hair color. You may need several visits to the salon to get the shade you’re looking for. So be patient, heed your colorist’s advice, and move at the pace they recommend. And once you go blonde, your roots will grow in dark, so make sure you’re committed to the hair color before you make the plunge.
Your skin and eye color matters. Most women will
look good in some shade of blonde. But not every woman will look like a natural blonde. If you have pink skin that burns easily, and blue or green eyes, you’ll look like a natural blonde with blonde hair. If your skin has yellow undertones, you may look jaundiced or washed out with hair that’s too light. If you are brunette, I suggest consulting with a stylist before deciding on a shade.

LEGACY GALA SETS RECORD From the Heart of the Hill Country, the PRMC Foundation hosted its two signature events this past Fall, 2013, the Celebrity Chef Cooking School and the Legacy Gala 2013.
More than 700 people gathered over two evenings. They wined, dined and danced the night away to help raise a gala record of more than $170,000 in net proceeds. PRMC President/CEO Pat Murray, commented, “We are very thankful for the tremendous community support from the Legacy Gala in 2013. The donations will be used to provide urgently needed medical equipment to care for our patients as well as help fund scholarships for our caregivers at Peterson who are expanding their educational horizons and pursuing advanced certifications.”

Executive Chef John Brand was the featured Celebrity Chef in 2013. Chef Brand is the Executive Chef at the Mokara Hotel & Spa’s Ostra on the River Restaurant and companion hotel Omni La Mansión del Rio’s Las Canarias Restaurant, both located on the world-renowned River Walk in San Antonio. “We were really pleased to have someone of Chef Brand’s background and personality involved in the Legacy Gala this year,” shared Sonny Baldwin, President of PRMC Foundation. “Not only did he bring a wealth of experience and creative and innovative culinary skills to our fund raising events, he was also willing to donate his skills and expertise to the events this year which helped put more money on the bottom line to help our community hospital.” Both Legacy Gala events were held at the Inn of the Hills Resort and Conference Center in Kerrville and highlighted by a cooking demonstration by Chef John Brand on Thursday, November 14, 2013, and a multi-course elegant dinner and wine tasting on Saturday, November 16, 2013. In addition, the Nash Hernandez Orchestra played dinner and dance music until midnight featuring everything from the big band sounds of 1940s and 1950s to rock and roll favorites.

really love to see antique pieces mixed in with other styles of furniture. There is a nostalgia that older pieces add to a décor that create a nice sense of depth. However, over time wood can accumulate a lot of “character” and makes them a little dull, which most of the time isn’t so appealing. We want these pieces to continue to be loved in your home and sometimes all it takes is a little cleaning to get some life back into them so you won’t want to replace them. For the most part non-painted wood is generally quite salvageable. When you have an old piece with a lot of “character,” it should continue to look old, it just doesn’t have to look like it’s been in a musty attic for 50 yrs. To clean away dirt, waxes, and grime that can accumulate over time, start with a bucket of warm water with a few tablespoons of Murphy Oil soap and several pads of fine steel wool. Be sure to always scrub back and forth with the grain. This process is very messy—you will want to wear gloves. You need to change the water out frequently and repeat the process several times to make sure it’s as clean as it can get. Then let the piece completely dry out for a while, at least a couple of hours. As it dries it may become significantly lighter looking like driftwood—it’s okay. After the wood is dried use a wood oil finish, such as Danish or Tung oil, with a lint-free rag rub a generous coating all over in the direction of the grain, then wipe off excess. It may take two or three coats depending on the piece. After oil is dried, buff in some furniture wax to give it richness. The wood will be a little sticky for a day or two, but everything should absorb and harden up. As always, have fun with it and remember that it’s important to take care of these older pieces…they aren’t making furniture like they used to. The Carolina Chickadee is another of our “usual suspects” at our backyard feeder stations. There are 7 different chickadee species in North America. They are easily confused with the black-capped chickadee. In fact, the two are so similar that they themselves have trouble telling their species apart—sometimes producing hybrids. Generally speaking, the black-capped is in the northern part of the United States and the Carolina is in the southern half.

During nesting season they have been known to land on people’s heads to grab some hair for their nests, although that doesn’t sound very friendly. These charming little birds readily come to feeders without much prompting, and they come often. It was once believed that they only came several times a day to a feeder, it is now documented that they actually can come well over a 100 times a day to the same feeder. That’s a lot of trips to the dinner table. To top it off, they don’t sit at the feeder and eat. They choose a seed and usually fly into a tree to crack it open and enjoy. Sometimes the chickadee will cache seeds only to retrieve them 1-2 hours later.
Chickadees will take full advantage of nesting boxes too. While there are wren/chickadee boxes available, they seem to enjoy raising their young in a bluebird box. Keep out nesting material for them to grab. Typically they nest in March/April and only have one brood per year. Mrs. Chickadee can lay up to six eggs in one day. Incubation is 12-15 days and they will fledge around 16-19 days after they hatch. Serving up treats like live meal worms, Bark Butter or suet makes it easy for the parents to feed their hatchlings—and it’s entertaining. May you enjoy one of our year round “usual suspects.”

ou are having surgery this morning at Peterson Regional Medical Center. You reported to registration, handled the necessary paperwork, and have been directed to a room on the second floor where a smiling (volunteer) lady (or perhaps a gentleman) in the waiting room will welcome you and your friends/family and inform the surgical unit of your arrival.

After you depart into the inner-sanctum known as surgery, that volunteer lady-in-waiting will turn her attention to your family, offering refreshments and a morning paper or magazine. A restless or apprehensive child will be comforted with a puzzle or game and friendly interest. Volunteers have been known to furnish a warm blanket and they always know where the cafeteria is located or where the restrooms are. If one wants to venture out somewhere during their wait, they will be keep in touch by cell phone, if possible. Volunteers with their cheerful, efficient demeanor provide a haven of comfort and security. More importantly, since the surgical unit keeps in touch with the volunteer by telephone, she or he will provide periodic updates on your condition during surgery to waiting family/friends and help them with any post-operative arrangements when it’s all over. These volunteer ladies and gentlemen-in (the) waiting (room) are pleased to help make the time of those who must wait as pleasant and as stressfree as possible.

Seeking Stories, Preserving Legends you’ve lived in the Hill Country for awhile and you Ifattend local happenings, you’ve seen her. Though
too short to stand out in a crowd, you can’t miss her—a tiny figure under a baseball cap scribbling intensely in a small notebook, or hidden behind a camera.
moving here until 1990. “But before that, we returned to the area for vacations and holidays—using any excuse to be here.” Locally, Irene worked as a reporter for the Mountain Sun and was on the air for radio station KITE and for HTV television station. Working as a reporter for the West Kerr Current since 2005, Irene covers the gamut of Hill Country events and has met countless interesting people during her career. Irene confides, “The honor I’ve received that most defines me and what I love is the Excellence in Media—awarded in 2009 by the Texas Historical Commission.” THC’s awards traditionally recognize exemplary leadership in community heritage development and preservation. Irene received this tribute for her fifty Kerr County historical stories and photos published weekly for five months in the West Kerr Current to mark the sesquicentennial celebration of Texas’ Statehood. “But I just can’t stop writing them,” claims Irene, “and I now have 363.” As much as local Texas history fascinates Irene, she finally considered turning her attention to her own genealogy. “I’m now diligently pursuing my family’s stories,” Irene admits. “Last fall I reconnected with family members on a trip back east. I uncovered all sorts of gems and jewels of knowledge and photos.” Particularly intriguing is Irene’s family tale of escape from Ukraine during World War II. “This experience wasn’t talked about when I was a kid. I was born in Austria after the War, but my older siblings witnessed that earlier history and still remember the details.”
This Wonder Woman doesn’t miss much that’s going on. Searching out stories of people, places, and things, she serves them to us in rich accounts we love to read. She’s won numerous awards, including ones from the Press Women of Texas Association, the West Kerr Chamber’s Community Star, and most recently the West Kerr Chamber’s Ross Rommel Citizen of the Year Award. This year’s Citizen of the Year Award honors Irene van Winkle—an outstanding citizen in our community for many years. Irene first came to Kerr County in 1973 for her honeymoon with David van Winkle, whose parents lived here. “I fell in love then with the Hill Country and vowed to come back,” recounts Irene. In the meantime she worked with Peterson Publishing in New York and later at the Dallas Times Herald, not 46 │ Mar-Apr 2014 │ KCP
Though only a small child at the time, Irene recalls coming to America with her family. “Our ship entered Boston Harbor and I could feel the excitement onboard. I didn’t comprehend what was happening—but I did know it was something amazing.” Amazing. A good word to describe a woman who chronicles and preserves history for the rest of us.
