MEDIATION

A PRIVATE ALTERNATIVE TO LITIGATION

THE

civil Justice system is open and available to all citizens for the resolution of conflicts and disputes. However, the system can be intimidating, time consuming, expensive, and is controlled by legislatures, lawyers, rules, regulations, and judges. In effect, it is your opportunity to introduce the government into your personal life and expose all of your problems to the public in order to settle a dispute. If that prospect is not so appealing, then, you might want to consider an alternative dispute resolution method. Many alternative dispute resolution methods are available that are more private and can either significantly reduce government involvement or eliminate it altogether. The Texas Legislature has codified the rules and regulations involving available alternative dispute resolution methods under Article 154 of the Texas Civil Practice & Remedies Code. Texas law allows for mediation, mini-trials, moderated settlement conferences, summary jury trials, and arbitration as an alternative to a public and expensive trial. Among these, mediation is the most widely used alternative dispute resolution method. The benefit to using mediation is that the process is confidential, can be relatively inexpensive compared to litigation, can be less time consuming, and is totally informal. There are no black robes, there is less legalese, there are no bailiffs, and there are no archaic rules, which only lawyers can understand. Mediation is a process where each party sits down with a trained and neutral mediator in an informal meeting to explore each party’s position and attempts to facilitate an agreed resolution acceptable to both parties.

Unfortunately, mediation is rarely used other than as one of the stages in the process of litigation. As a result, mediation may not have the full potential effect of reducing the time, the intimidation factor, or expense associated with a legal dispute. To take advantage of the full benefits of mediation, consider using the mediation process before a lawsuit is filed (prelitigation). The courts have the authority and will enforce mediated settlement agreements between parties like any other written contract. Locally, we are fortunate to have access to the Hill Country Dispute Resolution Center (HCDRC), which provides a neutral and qualified mediator and the mediation facilities for as little as $300.00 per party. Neither party is required to have an attorney to represent them in a prelitigation mediation with the HCDRC, but I recommend you at least consult with an attorney prior to mediation for advice on what your rights are concerning the dispute in question. Mediation can eliminate expensive legal posturing, still protect your rights, and bring about a satisfactory and peaceable result for all the parties involved. In addition, mediation provides each party a better opportunity to voice their feelings and to tell their story, which is an opportunity either party may not get in court. If you end up in court, a judge will make a decision that one of the parties will not like and the decision will be final. If one of the parties appeals the decision, there will be more expensive litigation. In mediation, the parties will be in total control of the outcome (mediation is non-binding) and will have the opportunity to ask questions about what is going on as it happens. If either

party does not like the potential outcome of the mediation, they do not have to agree to settle. Pre-litigation mediation is not for everyone or every dispute. Each party should consult with legal counsel about their particular circumstances before deciding their dispute can be mediated pre-litigation. If you are headed for litigation, then, consider prelitigation mediation as an alternative dispute resolution method. Pre-litigation mediation is not mandatory, so cooperation of all the disputing parties is required. W

earing his worn cowboy hat and boots, Dane Ellsworth might be mistaken for a typical Hill Country rancher. But there’s nothing “typical” about his art, now featured at Texas etc., 1001 Junction Highway at Inn of the Hills. Let’s call it “familiar,” and then some. Ellsworth’s acrylics, oils, and gouaches are pure Texas. “I don’t need to travel far to be inspired by Nature,” he explains, “I enjoy going within a radius of a couple of hundred miles from my home here in Kerrville to do my sketching and painting outdoors.” Yet his western landscapes are purchased by folks who “recognize” that particular barn or hillside . . . whether they’re from around here or not. “A man from North Carolina recently bought one of my paintings because it reminded him so much of a barn back home. A professor at Duke University bought my artwork because it reminded him of home.”

Perhaps the universal appeal of Ellsworth’s art finds its origins in his childhood. He grew up the only child of an itinerant sign painter, living in and passing through many states. Eventually Dane attended the Art Students League in New York and studied illustration and impressionistic theory. He went on to study with many other talented artists. Ellsworth describes his art as “impressionistic illustration” and his subjects can range from whimsical to nostalgic. The detail is precise, yet there is a pastoral sense of peace and serenity in his paintings. Reading frontier history informs his works and creates a calling to bygone days. With his fondness for painting horizons, Ellsworth captures a feeling of vastness—that unattainable place the viewer is drawn to on the canvass with what Ellsworth refers to as a “birds-eye, God’seye view.”

On Your Winter Energy Costs

is upon us, and we are finally getting some much needed relief from the extreme summer heat. As we all know, the mild days will turn cold soon, so now is a great time to prepare for saving some money this winter. Below are 5 tips to help you do just that. Lower the temperature on your water heater

Heating the water in your home can account for up to 25 percent of the average energy bill. According to the US Department of Energy (DOE), for each 10ºF reduction in water temperature, you can save between 3%–5% in energy costs. Reducing your water temperature to 120ºF also slows mineral buildup and corrosion in your water heater and pipes. This helps your water heater last longer and operate at its maximum efficiency.

Turn the thermostat down According to the EPA, you can save up to 4 percent on heating costs for every degree you lower your thermostat. Another way to save money with your thermostat is to buy a programmable thermostat. DOE estimates that you can save around 10% a year on your heating and cooling bills by simply turning your thermostat back 10°–15° for eight hours per day.

Turn ON the ceiling fan Reverse the direction of your ceiling fans so they are turning clockwise in order to pull cool air up and push warm air down.

Air sealing Air leakage, or infiltration, occurs when outside air enters a house uncontrollably through cracks and openings. Properly sealing such cracks and openings in your home can significantly reduce heating and cooling costs, improve building durability, and create a healthier indoor environment.

The Orange Crowned Warbler will be one you see often. This tiny, nondescript, drab yellow guy will be all over your suet and mealworms. He has a bright orange spot on the top of his head—something you rarely see— unless he is angry or flirting.

You should get to see the Yellowrumped Warbler as well in your yard. This warbler will have bright yellow breast patches and always has a bright yellow rump. Hence the nickname “Butterbutts.” They are very playful birds and will hang out all winter long.

The ever popular American Goldfinch and Pine Siskins will start arriving too. They usually come in together, and there will be a lot of them. Both will descend upon your Nyjer feeders along with our year round resident, Lesser Goldfinch. You can easily have 30 birds on one long mesh feeder at a time with 30 more waiting their turn. Attracted to moving water, you can have 10 or more in the bath at one time just splashing away.

Another favorite is the Cedar Waxwing. Can you guess why they love to come here in the winter? How about our abundance of Ash Juniper trees? You know—the ones that wreak havoc on allergy sufferers with cedar fever. They love the berries produced by the tree and will come in large flocks. 30-50 of them will swoop around in unison as a flock then land in the trees and happily gorge on the berries. They also love water features. Waxwings are gorgeous birds with velvet like plumage featuring a super bright, yellow band at the end of their tail that looks like someone dipped them in paint.

Keeping out lots of water, mealworms and suet will attract these delightful Winter Texans. Enjoy.

A Gift

that keeps giving

As the holidays approach each year, I spend time feeling thankful for family and friends who bring joy to my life. I love searching for the perfect gift for each person to express my love and thanks. Try as I may, sometimes my gifts miss the mark. There was the time that I gave my son-in-law, a music enthusiast, a satellite radio for his car. Initially, it seemed like the perfect fit but I soon realized I had created a burden because he had to pay a monthly subscription fee to enjoy the radio. I’ve also given gifts that are the wrong size or color, and gifts that stay in packages until they mysteriously find their way into someone else’s stocking next year. Yes, I know it’s the thought that counts, but I can’t help feeling pleased when I find that perfect gift— the one that doesn’t require money to maintain and is the right fit. As a title insurance professional, I like to think of title insurance as that perfect gift for homeowners. Consider the following story: a seller establishes a $100,000 equity line of credit against a property that he has under contract for sale. The seller then closes the sale 10 days later, which is too soon for the additional lien to show up in a title search. A year later, the new owner decides to re-finance his mortgage and discovers the $100,000 lien against his property. Of course, the seller is now nowhere to be found. If the owner has title insurance, he can simply ask the title insurance company to resolve the problem. Title insurance protects buyers who risk losing their money or home due to problems with the property’s title. A typical title insurance policy covers the amount of the real estate sales price, requires a onetime fee rather than ongoing premiums, and stays in effect until the buyer sells the property. Risks range from invalid and fraudulent real estate sales to hidden legal encumbrances tied to an existing property. In addition, sellers can have missing heirs, former spouses or other parties who claim that the property actually belongs to them. By providing ongoing protection to homeowners against risks with a onetime fee, title insurance is truly a gift that keeps on giving. aking the exciting announcement just in time for the holidays, Evelyn Hickey assures us her 1550 Gallery and Studio is alive and well. That trademark twinkle in Evelyn’s eyes hints Christmas might come early to the Texas Hill Country.

Medical reasons eventually forced Evelyn to close the Gallery doors at 1550 Junction Highway. But she insists, “I can’t not create art!” True to her word, Evelyn has spent the past six years working on a new type of canvas—Steepside, her and husband Mike’s new Kerrville home, built in 1929, above the Guadalupe River.

Raised on a South Texas ranch, Evelyn grew up visiting Kerrville every summer. Her grandfather helped develop Methodist Encampment in 1925 for summerhouse

For ten years, Kerrville art lovers made loyal sojourns to Evelyn’s eclectic 1550 Gallery on Junction Highway. Always treated to a totalimmersion experience with Evelyn’s bold style and brilliant use of color, gallery-goers reveled in her large canvases of expressionistic faces, florals, and abstractions. Evelyn’s fluid colors never fail to bridge the gap between artist and observer. The South Texas-born artist comments, “I want the viewer to experience a new way of seeing the nuances of each face and form and then to enjoy the total composition. The process of painting itself is my reward.” A decade of 1550 Gallery guests flocked to Evelyn’s imaginative events sponsored monthly. The Gallery tempted visitors with a wide variety of artists and media—from “Texas Hot Wax” to a classical guitar CD release party, from whimsical fiber art to bejeweled bangles and beads and wearable art—accompanied, of course, by food and wine. Evelyn offered the Kerrville community a true celebration of art—a real party. Evelyn’s creative flair has included work with painted quarry tiles, semi-precious stone jewelry, mosaics, batik on paper, textiles, paintings on canvas and paper, and mixed media collage. She explains, “I am attracted to the interesting shapes and designs that are inherent in all things.”

A cool autumn afternoon is the perfect time for painting on the deck of Evelyn’s newly renovated 100-year-old barn, which houses her 1550 Gallery and Studio.

Atlee B. Ayres, architect of San Antonio’s McNay Museum and many beautiful old homes in Olmos Park, designed the Spanish revival-style house. Kerrville’s Dr. Sam E. Thompson built the red-tile roofed, twostory home. In 1976, the stately house with its spiral staircase, graceful arches and scores of expansive windows even served as a filming location for the movie Pony Express Rider. Evelyn has published a book of her photos as a pictorial history of the challenging process of the house’s restoration. “The home’s limestone was quarried on the property, and the wood floors are original. We tried to keep the home’s integrity of style intact

sites. She moved to Kerrville in 1958, and attended Tivy High School. After college, at the then Schreiner Institute and at Texas Christian University, Evelyn took art classes and workshops, lived in Ft. Worth, and then moved to the Kerrville area in 1983. Numerous juried shows and invitational exhibitions welcomed Evelyn’s paintings, including one-person shows at the Hill Country Arts Foundation in Ingram, Salon Mijangos in San Antonio, World Trade Center in Dallas, and Schreiner University. Enrich a Life with Hot Meals and Warm Smiles What would happen in your later years if you couldn’t leave your house? Couldn’t shop for food? Couldn’t prepare a meal? Who would help you survive? The Dietert Center would!

F

or more than 40 years, Dietert has been feeding Kerr County’s elderly. A hot, nutritious meal is the lifeline that keeps many of our oldest citizens independent and in their homes. Every weekday, Dietert’s “Meals On Wheels” provides a hot lunch and warm friendship to approximately 240 frail elders. Many are disabled and on limited incomes. Smiling volunteers in Kerr County deliver more than 57,000 meals each year. “In many cases, our volunteers are the only people these homebound elders see,” says Pat Hudgins, Dietert’s “Meals On Wheels” Coordinator.

Getting “Meals On Wheels” starts with a phone call to (830) 792-4044. For those who qualify, meals are available on a donation basis. “We don’t put folks on a waiting list,” Hudgins added. “We know they need to eat—no senior in Kerr County should go hungry!” Since meals are available by donation, funds for this vital service are always in short supply. Demand has increased, along with expenses. One home-delivered lunch costs Dietert $5.36, including food, labor, packaging and operating expenses. This year, $127,000 must be raised to keep this critical program going!

Evelyn is also creating artwork for Kerrville’s restored downtown Schreiner Building. Her paintings will be hung on all three floors for display and sale. Evelyn confides, “I’m privileged and thrilled to be a part of this endeavor in our community’s historical restoration.” The latest project for this dynamic artist was the remodeling of a 100 year-old barn. It is the new home of 1550 Gallery and Studio. “This will be much more than another art gallery,” Evelyn shares with excitement in her voice and that twinkle in her eyes. “I envision 1550 as a sponsor of special weekend and weeklong art showings and trunk shows using local and Texas artists.” Evelyn plans to form a local studio group to participate in openstudio tours once or twice a year for area and tourist art lovers. In addition to paintings, 1550 Gallery will show and offer for sale a delightful potpourri of art glass, pottery, jewelry, fiber art, and one of a kind hand-made clothing.

Steps To Fighting

veryone knows someone who has been diagnosed with or died from cancer. In the U.S. alone, cancer claims more than half a million lives each year. It doesn’t have to be that way. Cancer is preventable and can be treated naturally. If that sounds too good to be true, here are five facts about cancer:

What Hospice Does

Sadly, hospice providers have heard comments like these more times than we can count.

Who Can Benefit?

Over a third of hospice patients die within seven days of admission to a hospice program. Why? Because they were referred for the care very, very late . . . because they didn’t know they could ask for the care . . . because they were hesitant to openly and frankly discuss the natural progression of an illness or disease process with their physician. Everyone with a terminal prognosis can benefit from a full six months of hospice services, if not significantly longer. In fact, a 2007 article from the Journal of Pain and Symptom Management Reports, “patients who chose hospice care lived an average of one month longer than similar patients who did not choose hospice care.” Electing the hospice benefit is not about giving up hope. It’s about shifting the focus

Hospice offers services for patients and their caregivers, wherever they call home, as long as the patient remains medically eligible for the benefit. Medicare, Medicaid and most insurance companies cover the services at 100%, and include medications related to the diagnosis, medical equipment and supplies, and all visits from the hospice team (M.D., R.N., C.N.A, chaplains, social workers, bereavement coordinators, and volunteers). Support is available 24 hours a day, every day of the year. And, according to a Duke University study (2007), hospice saves Medicare an average of $2,309 per beneficiary. And that’s a matter of concern for all of us in this time of interest in healthcare reform. Benefits of

O

ne of the most common surgeries performed on women today is a hysterectomy. Hysterectomies are done to treat several medical conditions such as heavy menstrual cycles not responsive to other treatments, enlarged fibroids, pelvic organ prolapse, and precancerous or cancerous conditions of the female reproductive organs. The method of performing this surgery has evolved to decrease the recovery time, pain to the patient, and complications.

This method of surgery has many benefits for the patient. Abdominal pain is decreased because the wristed instrument can easily be manipulated without putting pressure on the abdominal wall. Less pain translates to decreased need for strong IV or oral narcotics. Patients have done so well that in some cases they are sent home later the same day. Another benefit is decreased blood loss due to the superior visualization. The surgeon is able to zoom in on the area of interest and avoid small blood vessels. The robot system comes equipped with software that removes tremor and this allows for more precise surgical technique. There are some medical conditions that have traditionally been treated with large abdominal incisions requiring longer hospitalization and recovery times, but which can now be approached robotically.

The two most common conditions are large fibroids and pelvic organ prolapse. Other medical conditions can be treated robotically, such as removal of ovarian cysts and endometrial implants. But women are not the only ones benefiting from the da Vinci robot. The robot is used for prostate cancer surgery, colorectal surgery, head and neck surgery, and some cardiothoracic procedures. You should ask your physician if you are a good candidate for the robot and if he/she is offering this option at this time. The physicians at OB/GYN Associates are now offering this option to appropriate candidates. Peterson Regional Medical Center brought our community to a new phase in this evolution with the acquisition of the da Vinci Surgical System. This robotic system uses miniaturized wristed instrument and high-definition 3D technology to assist the surgeon in performing minimally invasive surgeries. The surgeries are performed through small 8-12mm incisions on the abdominal wall. The number of incisions can vary from 3-5 depending on the type of procedure. The surgeon places sleeves through these incisions and then the robot is attached, or docked to the sleeves. The surgeon sits at a console next to the patient and controls the wristed instrument while looking at the 3D image.

or Non-Traditional Medicare Advantage Coverage BE CAREFUL! Medicare’s annual enrollment period will begin on October 15 and continue through December 7. As Medicare Advantage (MA) and Medicare Prescription Drug Plans (PDPs) begin marketing their products for the 2012 calendar year, the Centers for Medicare & Medicaid Services want to make sure that the agents and brokers working on behalf of these plans act appropriately and in accordance with Medicare’s laws and guidelines.

PROHIBITED AGENT/BROKER BEHAVIOR—Insurance representatives may not do the following. •

Can’t state that they are from Medicare or use “Medicare” in a misleading manner. For example, they can’t state that they are endorsed by Medicare, are calling on behalf of Medicare, or that Medicare asked them to call or see you.

Can’t solicit potential enrollees door-to door.

Can’t send unwanted emails, text messages, or leave voicemails.

Can’t approach people with Medicare in common areas (i.e. parking lots, hallways, lobbies, sidewalks).

Can’t conduct sales activities in healthcare settings except in common areas. Improper areas include waiting rooms, exam rooms, hospital patient rooms, dialysis centers and pharmacy counter area.

Can’t make unwanted calls, including contacting people with Medicare under the guise of selling a non-Medicare Advantage (MA) or non-Prescription Drug Plan (PDP) product and allow the conversation to turn to MA or PDP. For example, an agent/ broker can’t begin by selling a Medicare Supplement plan and then turn the conversation to MA or PDP products.

Can’t provide meals to potential enrollees at sales presentation.

Can’t conduct marketing or sales activities at an educational event (such as discuss plan benefits).

Can’t market non-health related products (such as annuities and life insurance) to potential enrollees during MA or PDP sales activities or presentation.

Can’t offer gifts to potential enrollees of more than $15. If a gift is offered, it must be made available to all potential enrollees even if they do not enroll in a plan.

Make Sure You Are Informed Before You Change Your Medicare Coverage Before joining a plan, you should understand the type of plan you are joining. Some Medicare Advantage Plans have certain network restrictions requiring that you only see health care providers who belong to the plan’s provider network. Your local Area Agency on Aging can provide unbiased information to help you make informed decisions about your health care options. The telephone number to call is 1-800252-9240. You should make no change in your health care coverage without speaking to your physician, your pharmacist, local hospital, and your home health care provider.

This combined effort has assisted our community for over five years and is just one of the many services our volunteers help with throughout the year.
