Probate

Texas may be one of

the easiest states in which to probate an estate because Texas has the option to choose an independent administration. Using independent administration can reduce the cost and time involved in probate.

Nevertheless, there are some assets that can be placed totally outside probate with little effort. There are many creative ways of accomplishing probate avoidance; but, I will discuss a few that are most commonly used. The most common is the right of survivorship declaration and is one a lot of people use and don’t even realize they are avoiding probate. Right of Survivorship Agreements include “joint tenants with rights of survivorship” or “payable on death” money accounts. Monetary accounts (usually a bank account of some sort) owned as joint tenants with rights of survivorship will pass directly to a surviving account owner without passing through the decedent’s estate. Parties can easily create these types of accounts by completing a signature card at the institution where the funds are deposited. Caution though, a lot of people actually set up these types of accounts without understanding the consequences. If your intent in adding someone else’s name to your money account is merely for convenience, then, don’t check the box on

the signature card next to the words “joint tenant with rights of survivorship.” You may rather the money pass according to the provision in your will (probate) instead of in total to the joint tenant outside of probate. If you check this box, your money account won’t pass under the terms you provided in the will and you may inadvertently diminish you estate’s ability to pay taxes and expenses associated with your estate. Another common method of probate avoidance are beneficiary designations and “payable on death (POD) Accounts.” A lot of banks and other money account providers

The most common is the right of survivorship declaration. "Right of Survivorship Agreements" allow their customers to name a beneficiary to receive the funds or assets upon the account holder’s death. This method works much like paid beneficiaries on an insurance policy. Besides insurance policies, you commonly see this opportunity in brokerage accounts, IRAs, and other retirement accounts. Finally, there is another probate avoidance commonly used to transfer motor vehicles and manufactured homes outside of probate. If you look at the title to your motor vehicle, you should see a place where you can transfer the ownership upon your death directly to a named beneficiary. It’s called a right of survivorship; but, functions more like a pay on death provision. That’s because the beneficiary doesn’t have to be

named on or added to the title. If your title doesn’t have this designation paragraph for right of survivorship you can complete Form VTR-122 and have the right of survivorship designation added to the title. You can get a copy of this form from your county taxassessor-collector’s office. This opportunity is also available for manufactured homes if the home has a certificate of title; but, must be processed through the Texas Department of Housing and Community Affairs. These are only a few examples of passing assets outside of probate. Whether you intend to pass assets outside of probate or not, you should consult with your estate attorney about all of your opportunities. There are so many factors at work when coloring hair— if you have figured out the right box for you, great, carry on. However, if you’ve had an oops moment, stop and step away from box color. Color cannot be fixed by putting more color on top of what already is not right. So many variables are at work when formulating color, neutralizing unwanted tones, degree of lightness or darkness desired, how much gray hair is there to cover and so on. There is a reason why stylists are trained so extensively in chemistry and hair composition. To be able to assess a head of hair, whether it has been previously tinted or not, and determine how to take what is on your head to the color or colors you want. Color correction can be a lengthy, costly process. If your hair has had one unsatisfactory color experience after another, it will take a professional to

return your hair to anything resembling pretty and in decent condition. In the best case scenario it will only require a single process color and conditioning treatment to salvage it. This is rarely the case though and corrective color can take several hours and several applications of color, color remover, lightener and/or protein treatments. Sometimes this can be done in one visit but usually there will be follow ups every 3 weeks or so to get your hair back into optimal condition. ’Tis the Other Season

I

t is beginning to look a lot like fall is fast approaching. In some ways this summer has not been as dreadfully hot as other summers and with any luck at all the fall rains will soon be coming. The return of that crisp air and the fall planting season is now. It is time for cabbage, collards, cauliflower, lettuce and brussel sprouts. If you really like brussel sprouts plant them now, not later next spring as they need cold temperatures to be sweet. Don’t forget to stock up on Dipel dust as cold crops are magnets for little green loopers that like your vegetables as much as you do! This is also a good time to start checking your potted plants for insects before you house them for the winter. Now is the time to inspect saucers and containers for cracks, and pest. Snails, slugs, and ants have a way to make your containers into condos for the season, and waiting the night before a freeze to start dragging things in has often led to unhappy surprises.

Disney Comes to Kerrville For

The Lone Ranger Movie Prop

Where Legends Meet Those of a certain age recognize the familiar cry, “Hi-Yo, Silver! Away!” It immediately conjures up a masked man on a rearing white stallion. No need to ask, “Who was that masked man?” The Lone Ranger (an ex-Texas Ranger!) and his Indian friend Tonto have been around for eighty years. Created in 1933 for a Detroit radio show, these fictional characters fought injustice in the Old Wild West. The Lone Ranger’s popularity generated a series of books and a widely-watched television show (1949-1957), as well as a number of comic books and movies—the most recent one released in July.

Kerrville’s Own Legend Nearly a year and a half before last summer’s release of The Lone Ranger, Kerrville charged into Lone Ranger fame on the scribe of scrimshander Linda Karst Stone. What’s that, you say? Well, longtime Kerrville resident Linda creates her scrimshaw art with a steeltipped scribe, incising delicate lines to fashion amazing designs— usually on ivory and bone. 18 │ Sept-Oct 2013 │ KCP

The Lone Ranger’s saloon madam Red Harrington (portrayed by Helena Bonham Carter) brings a whole new meaning to “conceal and carry.”

So how do we go from scrimshaw—an art form made popular by sailors over 200 years ago—to last July’s Disney action adventure movie starring Armie Hammer as the Lone Ranger and Johnny Depp as Tonto? “In early January 2012, I received a phone call from Kris Peck— Disney’s prop master,” Linda confides. “He found me through my website and asked for a sample of my work.” It’s no wonder that Linda’s website attracted Disney’s attention. The site is a showcase of her stunning scrimshaw art and offers an introduction to her long history as a scrimshander as well as several pages of awards she’s earned and special works she’s created. Before Disney came calling, Linda’s scrimshaw already had Hollywood and famous personality connections. According to Linda, near the top of her memorable list are two knives she scrimshawed—one by Harvey Dean, made for Brad Pitt to give to Quentin Tarantino after working together in the movie Inglourious Basterds, and the other a knife by Edmund Davidson for famed race car driver Richard Petty.

Ending the Suspense After Linda returned the requested sample of her work to Disney, the job was hers. “I was stunned. This would be the largest piece I’d ever done,” Linda reveals with a laugh. “And I couldn’t tell anyone what it was.” A spoiler for those who knew Linda and her exceptional artwork, online movie-scene trailers the few weeks before The Lone Ranger’s release let the “leg out of the bag.” “All my friends and family knew by then, but I still couldn’t publicize the fact before the movie’s July 3rd release,” says Linda.

Indeed it is—the leg is about three feet long and Linda meticulously scrimshawed it from the garter area to mid-calf where the boot begins. “Along with the resin cast of the actress’ right leg, Disney sent me the designs and placement they wanted,” Linda explains. She worked four days nearly non-stop “under the gun” to complete the scrimshaw that included detailed images of a woman’s face, a two-headed hunter, a mermaid, a snake, and a variety of flowers and stylized patterns.

Forty of those friends and family joined Linda as guests of her husband Mark Stone for Kerrville’s premier showing of The Lone Ranger. The group cheered wildly each time the prop appeared on Rio 10 Theater’s big screen. Unmistakably Linda’s work, the intricately scrimshawed “ivory” prosthetic leg of actress Helena Bonham Carter’s character was a glorious thing to behold. Not only lovely, the saloon madam Red Harrington’s leg was overtly functional. The whole theater roared when Red pulled a trigger above the scrimshawed garter, dropping open the heel of her boot to fire a shotgun concealed in the leg. “It has a double-barrel shotgun in it,” said actress Helena Bonham Carter in USA Today, April 9, 2013. “It’s a prop like I’ve never had before. That should be next month’s [Disney movie promo] poster, the leg. It’s beautiful.”

WOUNDED WARRIORS

It was a typical July in central Texas—

hot. But the heat didn’t deter anyone from having a great time at the first annual Kerr County Wounded Warrior Family Hill Country Adventure, a project of Operation Second Chance. For five fun-filled days and four nights, five Wounded Warriors and their families were treated to a Texassized thank you for the tremendous sacrifices they’ve made. As one Wounded Warrior told Retired US Army Colonel Tony Arnold, coordinator of the huge happening, “You guys really know how to put on a party.”

And that they did. Tony, his wife Cynthia, and a planning committee of eighteen, spent nearly a year making plans for a memorable occasion for these five active-duty soldiers and their families. Grant money, donations of cash, inkind services, activities, and gift items—along with countless volunteers—helped make the multiple-day event a tremendous success.

On Wednesday, July 10, 2013, an estimated five hundred patriots gathered downtown to welcome the Wounded Warriors and their families.

The severe injuries Wounded Warriors sustain in the line of duty often preclude any welcomehome celebrations. Sergeant First Class Wade Mitcheltree commented on the impressive greeting they received their fist day in Kerrville. “The welcoming hospitality of this whole town was amazing. We appreciated it so much.”

After the inspiring parade, buses took the twenty-six Wounded Warrior family members to dinner and Mayor Jack Pratt’s welcome. The families received their busy schedule that included over a dozen activities and events. Staff Sergeant Ross Cox noted with a big grin, “You can’t fit all of Kerr County into just four days— but we loved every second we tried.” 22 │ Sept-Oct 2013 │ KCP

Thursday, Friday, and Saturday activities began with pick up of the families’ sixteen children, ages one to sixteen, for merry goings-on at First United Methodist Church’s nursery and Camp Stewart for Boys and Heart O’Hills Girls’ Camp. This gave the Wounded Warriors and their wives the rare opportunity to share valuable couple-time.


From the three days of adult activities available, one couple chose the kayak river trip. Three couples opted for the chauffeured Hill Country wine tour. A day of golf appealed to another couple, while one couple took the museum and art gallery tour. And two daring couples chose an art adventure on the river for watercolor lessons. Additionally, one Wounded Warrior and one of the families’ teenage daughters selected an experience at our local shooting sports center. All five couples came together for the scenic Kerr County tour and shopping, each enjoying $500 in gift cards. Food played an important part in the Hill Country adventure, too, bringing all the families together in the evenings for a fish-fry, a barbeque, some old-fashioned hamburgers and at their farewell luncheon, a homemade enchilada plate.

At the July 14, 2013 luncheon, one of the wives shared her heart-felt comment. “This gave us the opportunity to take a break while allowing our children to experience things they never would have otherwise. We enjoyed it, we love you, and we’ll be back.”Staff Sergeant Daniel Burgess, Jr. added, “We can’t say enough for what you’ve done for all of our families. Our families are our primary support system and you’ve supported them this week.”

It’s not over

After a wonder-filled five days and four nights, the Wounded Warriors and their families returned to San Antonio to face months or even years more rehabilitation. That’s more time away from their homes, more pain, more sacrifice. Last July, our big-hearted community joined forces to help offer these brave families a chance to retreat with honor and dignity to enjoy just being family. String inverters have been around as long as solar panels have been around. They work by multiple panels being “strung” together to get the voltage you need to operate the inverter. An easy way to think of it is like a flashlight, each battery increases the voltage so it is high enough to turn on the bulb; solar panels work the same. String inverter arrays have one (or more) central inverter(s) that all the strings are connected into, in order for it to turn on and produce AC out of the DC voltage from the panels. One main disadvantage to string inverters is if any part of the array becomes shaded it will drastically reduce power production. Micro inverters are a more recent

addition to the solar market. They became a serious competitor to string inverters around 2008 with the first commercially successful micro inverter. With micro inverters there is actually one inverter mounted on the roof per solar panel; consequently, this offers significant advantages compared to normal string inverter arrays. Some advantages are: you’re able to optimize the power production of each panel instead of the array as a whole, the shading of any panel does not greatly decrease the production as it would with string inverters, each panel can be individually monitored, it is easier for future expansion of the array, and you have better array sizing options compared to traditional string inverters. In the past, the Hill Country did not have many white-winged doves. Their native range extends from the Southwest US into the Caribbean. With the advent of irrigation and farming of grain, their territory expanded into the Lower Rio Grande Valley, where their population exploded to twelve million in 1923. A flock of one million was observed in a Texas grass field! An important game bird, over 35,000 hunters flocked to the Lower Rio Grande Valley each year. This decreased their population to around one million by 1939. With conservation efforts they have re-emerged stronger than ever and have moved their territory to cities and backyard bird feeding stations throughout south Texas. Now that they are well-introduced into our bird feeding stations, many people want to know how to keep them off their feeders. They do eat a lot of seed. In fact they will eat anything you put out except peanuts in the shell. Because they swallow seed, peanuts in the shell are too large to swallow. Along with wild turkey, they are the only birds that consume milo—that nasty round red seed in some wild bird food. It’s a water based grain that your other birds don’t recognize as a food source. It is strictly filler and a waste of money. The only way to keep doves off your feeders is to cage the feeder or get a weight-activated one. These usually do the trick. However, these birds are great cleanup crews. Being ground feeders they eat anything that falls to the ground. Whether you love them or not, they are fun to watch in your yard, as long as they stay on the ground.

Property Restrictions A View of Our Past

enjoy examining a title. In my opinion, examination is the heart of the title business. I think of examination as piecing together a puzzle that ends with a picture of a property’s history. Examining title can, at times, provide insights into Kerrville’s past through the restrictions placed on a property many years ago. Below are common deed restrictions from the early to mid 1900s that provide perspective on our past.

• Affordable Housing Restrictions created in 1947 for

property I was recently examining state that no dwelling house shall be erected on the said property which costs less than $3500.00 to build and finish. I’m sure you can imagine what $3500.00 would build today—not much.

• Kerrville’s History Revealed For about thirty years,

Kerrville was a destination for tuberculosis patients. In 1915, 1,000 acres were purchased and used to erect Mountain Park Sanatorium for patients with tuberculosis. The facility closed in 1949 and is now the home of the Kerrville State Hospital. Restrictions created during this period often state that no sanatorium for the care or treatment of tuberculosis or infectious or contagious disease shall be erected or maintained on property.

• Discrimination Was Commonplace Kerrville area

residents often created restrictions on property that prohibited certain individuals from purchasing property. Fortunately, discriminatory restrictions are no longer legally binding. The most common form of discriminatory restrictions that I’ve read are those that prohibited African-Americans and individuals with tuberculosis from occupying property. When preparing a title commitment that includes restrictions that are now invalid, the title company will include language that omits any covenant, condition or restriction based on race, color, religion, sex, handicap, familial status or national origin.

When purchasing real estate, you will be provided with a copy of the restrictions for your property. You might be surprised by your own property’s unique history as seen through the restrictions. hit a home run in their renovation of our main quadrangle at Schreiner University. They took a bare, dusty patch of land with little more than two heritage live oaks and turned it into a garden area that suits our Hill Country setting perfectly. The new quad combines efficiency and beauty, and those on campus are unanimous in their delight over this transformation. And Kerrville Landscaping accomplished everything on time! I could not be more pleased by the results of this partnering with Zack Derese, his foreman Alonzo Navarro and the entire crew. I know these guys probably got tired of my coming out several times each day, but frankly I came to enjoy seeing just what they could accomplish in two or three hours. Conservation The history of the Quad at Schreiner University, also known as the Bull Ring, goes back many years. When Schreiner was a military institute, rule-breakers were given a chance to reflect upon their misdeeds while marching silently around this area with a rifle on their shoulders. The three acre area has remained unimproved for decades, until the vision of Dr. Tim Summerlin came to fruition recently. Taking a rough sketch from Dr. Summerlin, which itself drew on concepts from Dean David Smith, we designed a conceptual plan with our 3-D Virtual Landscaping that included stamped and stained concrete sidewalks, flagstone patios, brick and rock seating walls, pergolas, LED lighting, natural pathways with boulder seating, drip irrigation, trees, and shrub beds. They loved it! Then came the bombshell: We had to complete the whole project during summer break, May 15th to August 1st! I’ve always been known for biting off more than I could chew, so I gulped, took a deep breath, and shook hands on the deal. Efficiency and conservation was the foremost priority for the University. At our first meeting, Vice President Bill Muse asked me how much water the landscaping would use, and then sent us back to the drawing board to reduce the amount by 50%! We made better use of xeriscaped areas, and designed a SDI (Subsurface Drip Irrigation) system that cuts water consumption of turfgrass drastically. (The same type of

system we installed at Peterson Plaza.) Electric consumption was also of some concern, thus the use of LED landscape lighting. A four- watt LED fixture puts out the same light as a 25-30 watt normal bulb. Longevity and low heat output are two more advantages. Although initially more expensive, they eventually pay for themselves in maintenance and replacement costs. Fast forward to August 1: 26,000 square feet of walkways, over an acre of shrub beds, close to an acre of sod, hundreds of tons of topsoil, mulch, gravel, granite, and 1,000-plus plants later…a proud but exhausted Alonzo Navarro (our project manager) and I shake hands with the Schreiner folks as they view Faulkner Plaza at the Quad. Another impossible deadline accomplished! Zack Derese has deep roots in Kerrville. As owner of Kerrville Landscaping, Inc., he has been in the landscape business for over 15 years. Sophia Pautler, a sophomore at Our Lady of the Hills reported to physical therapy at the Ambulatory Care Center, and would like to be a physical therapist.

The summer program sponsored

by the PRMC Auxiliary for high school students got underway in June when a group of outstanding young people reported for orientation. PRMC staff members covered topics such as environmental safety, hospital codes, infection prevention, patient rights, cultural diversity, and the mission, vision, and values of the Auxiliary.

Maria Mendez was assigned to patient rehab. A senior at Ingram TM, she plans to become an RN.

Ingram TM High School senior Jellyn Capalac worked in patient recovery. Jellyn hopes to become an RN.

Tivy High School junior, Damitra Holland, spent her time in care coordination and has an ambition to become a dietitian.

Cassidy Story spent her volunteer hours in women’s services. A Tivy junior, she would like to become a pediatrician.

Cynthia Miller, a junior at Hill Country High School, is interested in the mental health field.

Whitney Hall, an Ingram TM High sophomore, considers forensics would be an interesting career.

RN or MD? Perhaps Juan Cruces’ time spent in patient recovery will help him decide. Juan is a sophomore at Ingram TM High.

Noel Rodriquez,a junior at Ingram TM High was assigned to patient rehab and plans to become a nurse anesthetist.

Hayden Richter, a Tivy senior, returned to PRMC providing beautiful music in the atrium. He definitely plans a musical career.

Then it was off to work (usually four-hour shifts once a week, although some worked longer hours) at their assigned departments and tasks. Peterson Regional Medical Center and the Auxiliary express their gratitude to this enthusiastic “Summer of 2013 Group” and wish them well as they continue their life’s journey. Traditional Medicare Coverage or Non-Traditional Medicare Advantage Coverage BE CAREFUL! Medicare’s annual enrollment period will begin on October 15 and continue through December 7. As Medicare Advantage (MA) and Medicare Prescription Drug Plans (PDPs) begin marketing their products for the 2012 calendar year, the Centers for Medicare & Medicaid Services want to make sure that the agents and brokers working on behalf of these plans act appropriately and in accordance with Medicare’s laws and guidelines.

PROHIBITED AGENT/BROKER BEHAVIOR—Insurance representatives may not do the following. •

Can’t state that they are from Medicare or use “Medicare” in a misleading manner. For example, they can’t state that they are endorsed by Medicare, are calling on behalf of Medicare, or that Medicare asked them to call or see you.

Can’t solicit potential enrollees door-to door.

Can’t send unwanted emails, text messages, or leave voicemails.

Can’t approach people with Medicare in common areas (i.e. parking lots, hallways, lobbies, sidewalks).

Can’t conduct sales activities in healthcare settings except in common areas. Improper areas include waiting rooms, exam rooms, hospital patient rooms, dialysis centers and pharmacy counter area.

Can’t make unwanted calls, including contacting people with Medicare under the guise of selling a non-Medicare Advantage (MA) or non-Prescription Drug Plan (PDP) product and allow the conversation to turn to MA or PDP. For example, an agent/ broker can’t begin by selling a Medicare Supplement plan and then turn the conversation to MA or PDP products.

Can’t provide meals to potential enrollees at sales presentation.

Can’t conduct marketing or sales activities at an educational event (such as discuss plan benefits).

Can’t market non-health related products (such as annuities and life insurance) to potential enrollees during MA or PDP sales activities or presentation.

Can’t offer gifts to potential enrollees of more than $15. If a gift is offered, it must be made available to all potential enrollees even if they do not enroll in a plan.

Make Sure You Are Informed Before You Change Your Medicare Coverage Before joining a plan, you should understand the type of plan you are joining. Some Medicare Advantage Plans have certain network restrictions requiring that you only see health care providers who belong to the plan’s provider network. For a brief interval, the Kerr County Wounded Warrior Family Hill Country Adventure allowed these five families to forget about doctors’ appointments, medical procedures, and scheduled therapies. They could skip meal planning, cooking, and housekeeping. These unselfish young men, women, and children simply had a few days to play. Specialist Fourth Class Kevin Wear noted at the farewell luncheon, “You’ve created something awesome. When my kids grow up and look back on what you’ve done for us this week, then they’ll be even prouder of what I’ve done to serve my country.” Tony reports, “This year’s effort cost about $10,000 and I’m proud to say all our donations were local. Next year we plan on hosting eight families—and we’re going to need lots of help.” Some of that help will come from two of this year’s Wounded Warrior guests, Special Forces Chief Warrant Officer Daniel Carlton and his wife Juanita, a West Point graduate and US Army Reserve Major. Before their Hill Country summer’s experience even ended, they joined the Wounded Warrior Adventure committee to start helping with next year’s project. “This experience went way beyond our expectations,” Daniel remarked at the farewell luncheon. “Over the past few days we’ve been told often that we’re ‘heroes’—and that’s flattering. But to me, the heroes are the ones who didn’t make it back. They paid the ultimate sacrifice so I could have the honor of standing in front of you today. God bless them. God bless the Great State of Texas. God bless America.”

hen Cynthia and I began this project over a year ago, we knew that Kerr County citizens were patriotic and very supportive of our troops. However, at every turn as we progressed in the organization of the family retreat, we were astonished at the level of passionate support that we encountered with the Kerr County people we met. I want to thank everyone in the Kerr County Community that supported and participated in our first Wounded Warrior Family retreat held by Operation Second Chance(operationsecondchance. org).
