Message from the Chair We are at our best when synergy is at its best. Simply stated, synergy is the recognition that the whole is greater than the sum of its parts. Synergy is the catalyst that can unleash the greatest power of possibility, the spirit of discovery and the perseverance to keep going. To our fellow businesses and citizens who got beat up and ravaged in last month’s storm, tornadoes and flooding, we here at the Chamber are with you and please let us know if we can help in any way. Our prayers and thoughts are with you as you recover.

Whether it’s helping move forward legislation that promotes a better business climate so we can have a thriving business community, helping our small business owners connect and be educated on the latest developments at our Business Sense Workshops, or developing the next generation of leaders through YPN and Leadership Sioux Falls, we know that a rising tide lifts all boats. As a membership-based organization, our strength is not derived from one person but from the whole. The Sioux Falls Area Chamber of Commerce has committed volunteers, dedicated staff and over 2,000 member businesses who are invested in making Sioux Falls a great place to live, work, learn, play and grow. We are strong because we are a collaborative group of leaders working together for the betterment of our community, and I invite you to join us in this effort. If you want to learn more about how you can get involved in the Chamber, give us a call! For those already involved, you know the first week of October brings a time of transition as we bring in new board members and extend thanks to those terming off the board. New officers assume leadership positions, taking on important responsibilities to the Chamber membership. That includes myself, as I step into the role of your Chair of the Board for 2019-2020 – a position I am honored to hold. I also invite you to join me on Oct. 22 at the Chamber’s 113th Annual Meeting. The Annual Meeting is the networking event of the year, so don’t miss a minute of the networking reception starting at 4:30 p.m. We’ll celebrate all the good work that has been accomplished in the past year and lay the groundwork for the coming year. As the largest gathering of the year of business and industry leaders, it certainly is a can’t-miss networking opportunity! I look forward to seeing you there!

Noon–1 p.m. Chamber of Commerce, 200 N. Phillips Ave., Suite 200 years ago to play football for the Sioux Falls Storm. He fell in love with the community of Sioux Falls and started working with the youth on a full-time basis with a ministry named Collision. At Collision, Setzer served as the Director of Relationships and Community Engagement for three years. He felt a calling to serve youth and families on a deeper level, so he accepted the director role for the nonprofit organization Hope Harbor. Setzer has a degree in business management and plans to complete his pastoral studies within the next year. Setzer is married to his teenage sweetheart Marcy and they have five beautiful kids together. Setzer loves people but he loves Jesus more and his passion is creating a better Sioux Falls for the next generation. A Seat at the Table is reserved for the first 25 YPN members to RSVP using the “Register Now” link.

New Faces & Promotions Chris Conrad has joined Loft Advisors, the wealth management division of First Dakota National Bank, as senior vice president of private banking. Conrad has 17 years of banking experience in the Sioux Falls market. He holds an economics degree from South Dakota State University and an MBA from University of South Dakota and is a graduate of the Colorado Graduate School of Banking. Kelly Mackeprang joined AmesburyTruth as a buyer/planner. She is responsible for procurement, updating and maintaining MRP planning data and forecasting. Mackeprang has experience in routings, cycle counting, inventory reconciliation, FIFO and obsolete and slow-moving inventory. She has an associate degree in business administration from Western Iowa Technical College.
Reliabank has promoted two senior vice presidents to lead the bank as it approaches its 100th anniversary. Joshua A. Hogue has been named president of the bank and Jeremy W. Keizer has been named Sioux Falls market president. Hogue joined Reliabank in 2012. After 25 years, Big Brothers and Big Sisters of the Sioux Empire is ending its affiliation with Big Brothers Big Sisters of America and transferring support of its mentoring matches to Lutheran Social Services Mentoring Services. The change means the organization will no longer use the Big Brothers Big Sisters brand name, which will save on affiliation cost and increase efficiencies for volunteers, staff and families who use mentoring services. The former Big Brothers Big Sisters program will be renamed, but its mission of communitybased youth mentoring remains the same. LSS Mentoring Services currently offers two other unique programs – Everyday Heroes and USucceed, which work in partnership with local school districts.

Community Appeals Scheduled Fund Drives The purpose of the Community Appeals Committee is to qualify and provide orderly scheduling of capital fund drives to the business community. By vetting capital fund drives, the objective of Community Appeals is to affirm the project is a sound community investment and worthy of donor consideration. It is the intent of the Chamber to encourage every business to carefully consider such requests. However, we also acknowledge that many businesses have limited resources for capital fund drives, both in an ability to properly evaluate them and a sufficient budget to contribute. Our Community Appeals process is intended to provide our members with assurance that a Community Appeals campaign Is worthy of investment.

The Community Appeals Committee recently received a request from Active Generations to delay its campaign start date by one year, from April 2020 to April 2021. McCrossan Boys Ranch, which was scheduled to begin their campaign in April 2021, expressed willingness move up to the April 2020 time slot. The Community Appeals Committee approved the request to swap campaign time periods.

New Chair Bobbi Thury embraces teamwork in leading the Chamber BY JENNIE DOYEN

Anyone who has spent some time with Bobbi Thury could tell you that she is a go-getter. Thury is an attorney and the co-founder of Legacy Law Firm, P.C. She dedicates her work to helping businesses and families plan for the future. She seeks ways to challenge herself and to learn and grow professionally. She is an active community volunteer, freely giving her time to the Sioux Falls Area Chamber of Commerce as well as several other nonprofit organizations. “She doesn’t stop! She is always looking for ways to improve the business, better herself and lift up others,” said Felan Link, Director of Operations for Legacy. “Her passion just trickles down to everyone around here. It is tough not to be motivated when Bobbi is so motivated.”

Jayna Voss, co-founder of Legacy, said there is no one she would rather have as a business partner. “Whether it’s raising a family, running a law practice or serving the community, Bobbi puts her heart and soul into everything she does,” said Voss. “What really sets her apart is her genuine enthusiasm and desire to create something better and make a difference.” On Oct. 1, Thury began a 12-month term as Chair of the Board of Directors for the Sioux Falls Area Chamber of Commerce. As she begins her year in the Chamber’s top leadership position, Thury is focused on teamwork, connections and the value of membership. “A team is stronger than any individual,” said Thury. “The Chamber is our common ground, it brings people together to make things happen. We are stronger together and we are better together – as individuals, as businesses and as a community.”

Thury sees opportunities for the Chamber to build on an already strong track record of advancing and promoting economic health and quality of life in the Sioux Falls area. “I’m completely amazed by how much the Chamber does for businesses and our community. Still, we need to always keep evolving and adding value,” she said. One way to do that is to grow the membership. According to Thury, the best way to grow is for current members to invite their colleagues and business contacts to join the Chamber and engage in its programming. “There is so much value in a Chamber membership. We need to be sharing that value, telling others about the return on investment they could see by joining and being involved.” For Thury, the greatest value of a Chamber membership comes from the connections she has formed over the years. She shares the story of being relatively new to Sioux Falls when Dan Doyle of Cutler Law Firm invited her to attend a Chamber event. She went and was immediately drawn in by the opportunities to learn and grow. “I was at the kickoff party for the Young Professionals Network,” she said. “Membership in the YPN allowed me to form new connections and to learn from established leaders. Then I got to dive into the inner workings of the city and business community through Leadership Sioux Falls.”
These experiences and others with the Chamber helped expand Thury’s network and she credits in part her Chamber involvement for providing inspiration to launch her own business at a time that some might consider to be less than ideal. Thury and her law partner Jayna Voss started Legacy Law Firm just three years ago. At the time, Thury was eight months pregnant, so one month after opening their firm, she found herself with four children ages five and under and a new business. She credits having an amazing business partner and team at work, and lots of help from family, for being able to do everything. Since opening their doors, they have doubled the size of their employee team, built their own office building, and most recently, launched two complimentary businesses. Legacy began with an office in Donegal Center, a mixed-use complex owned by Lloyd Companies. Felan Link said, “The phone was ringing the first day the office was open. I don’t
know how people even got the number, but they knew Bobbi and Jayna and they wanted to schedule an appointment.” The firm grew so quickly that within two months they needed more space. Lloyd Companies worked with Legacy, allowing them to rent an apartment above their office since all lower office space was filled. The kitchen counter was a desk, the cupboards stored files and employees worked in the bedroom and living areas. Thury laughed, “You’ve heard of the basement start-up story? Well, ours is an apartment startup story!” The story illustrates that relationships matter. “Lloyd easily could have told us no on the apartment. But they chose to work with us to find a solution. I know that having those personal connections makes a difference – because you can have a conversation and work together.” Entrepreneurship was not exactly what Thury expected. “I realized it would be a leap of faith to start our own business,

but I quickly learned it is a walk of faith,” she shared. “It’s giving all you’ve got every day and saying prayers!” As with any new business, money was tight when they opened. “We started our firm with zero clients so we had to make hard choices about how to spend money. We made decisions based off long-term growth so if it meant we personally swept the floors to allocate the money toward our growth, we did it. Even from the beginning, we saw our Chamber membership as an investment in our business.”

I find inspiration from them and what they are doing in other industries and then apply it in our own business. Thury attributes Legacy’s growth and success to the willingness of their team to not just embrace disruption and innovation but to live and do it. And her team agrees. “My favorite part is that Bobbi regularly says, ‘do you think we should try this?’ and then we do. There is always is a new idea to explore,” said Link. For her part, Thury finds inspiration by looking outside of her industry. “Part of what I love about being involved in the Chamber is that I meet so many innovative leaders. I find inspiration from them and what they are doing in other industries and then apply it in our own business.” She goes on to state that the connections that you make can make your business. “If you want to develop great connections, the Chamber is your best avenue to the best people.”

Networking is Thury’s favorite part of the Chamber’s Annual Meeting each year. The 113th Annual Meeting will be held Tuesday, Oct. 22 at the Sioux Falls Convention Center, featuring keynote speaker Sekou Andrews. The event kicks off at 4:30 p.m. with a networking reception and with Thury’s encouragement, that portion of the evening is being ramped up this year. There will be live music, hors d’oeuvres and other elements to help set the stage for the remainder of the evening. “You don’t want to miss a minute of the networking reception!” said Thury. “It is the networking event of the year and a fantastic opportunity to form new connections and rekindle old connections.” Also at the Annual Meeting, Thury will share more about what she sees in the year ahead for the Chamber. Continuing our workforce development efforts and including everyone on the team is likely to be part the focus in 2020. When she first joined in 2014, Thury was one of just a few women serving on the Board of Directors. She will be the fifth woman in the Chamber’s 113-year history to hold the Chair position. She said that while there is still room for improvement, she is encouraged by the progress made in recent years in growing diversity and inclusion within the Chamber. “I would like our membership base to be a reflection of our entire business community,” she said. That means focusing on programs and services for small businesses and strengthening

So the bottom line goal is to keep working on that and keep striving to improve. “Life is too short to not be all in with your best.”

Advocacy on the road As I write this column, a group of Chamber staff, volunteer leaders and local business representatives are wrapping up our Washington D.C. Fly-in. First, thank you to our sponsors and participants. South Dakota’s economy requires our advocacy efforts to occur on all levels of government: federal, state and local. Moreover, Sioux Falls has actively engaged in promoting economic development for our region and state by coordinating D.C. Fly-ins with other cities, in anticipation of a larger economic win for our state. DEBRA OWEN

This year was our first I-29 corridor D.C. Fly-in, which included the Brookings and Vermillion Chambers of Commerce. The last few years we coordinated our fly-ins with Rapid City, bringing both east and west river’s largest cities to the nation's capital together. The Sioux Falls Area Chamber of Commerce actively supported Rapid City’s efforts for the B-21 bombers. This support included advocacy efforts in Pierre, with legislation (HB 1111) to allow licensure reciprocity for active military spouses. HB 1111 was a critical component of the B-21 decision, which was discussed when visiting with Air Force leadership at the Pentagon prior to the U.S. Air Force selecting Rapid City to be the first training center in the nation. The Sioux Falls Area Chamber of Commerce’s focus is advocacy while in D.C., but we also learn about our government through tours. Prior to our advocacy visits on Capitol Hill and at the Pentagon, our attendees received a special invitation from Representative Dusty Johnson for an after-hours tour of the Capitol. It was a treat for everyone in attendance. We want to extend a heartfelt thank you to Representative Johnson. The Capitol is a special place for all of us and Rep. Johnson’s tour didn’t disappoint. His extensive knowledge of our nation’s history deepened our appreciation for our country. Thank you, Dusty! The first official day included a briefing by the U.S. Chamber of Commerce about cybersecurity, the status of the USMCA and immigration. After meeting with the U.S. Chamber, we spent time on Capitol Hill and visited with our Congressional delegation. These visits affirmed the quality of our South Dakota elected officials. After visiting all three members of our delegation, one member of our advocacy group said, “I think (South Dakota) is spoiled to have such an excellent delegation.” Those of us engaged in advocacy on a daily basis couldn’t agree more. Our strong working relationships with our elected officials is key to positive outcomes for Chamber members and for all of South Dakota. The second day of the fly-in began with a visit to Arlington National Cemetery, where we watched the changing of the guard. Then we traveled to the Pentagon and spent the rest of the day in advocacy visits. Our talks at the Pentagon included a range of topics including the F-35 basing decisions, cybersecurity and other specific member advocacy efforts. South Dakota has much to offer when it comes to serving the needs of our military. Our member businesses offer unique and needed services to our military. The Chamber is focused on providing opportunities for our members to tell their story, which benefit our nation’s safety and security. As we come to a close of our D.C. Fly-in, we want to thank our sponsors: Avera Health; First PREMIER Bank/PREMIER Bankcard; POET; Sanford Health; SDN Communications; and Xcel Energy. As with all trips to the U.S. Capitol, this D.C. 113th Annual Meeting to feature Sekou Andrews The Sioux Falls Area Chamber of Commerce will hold its 113th Annual Meeting on Tuesday, Oct. 22 at the Sioux Falls Convention Center. The event is the largest gathering of the year of local business leaders and is an opportunity to network and form new connections, while celebrating the good work that has been accomplished in our businesses and community. Hey Sioux Falls celebrates entrepreneurship Nominations now being accepted for 2019 awards An award show and celebration of entrepreneurship in our community is returning for a second year. The Sioux Falls Area Chamber of Commerce, the Zeal Center for Entrepreneurship and 1 Million Cups are once again partnering to plan and host Hey Sioux Falls, which will be held Thursday, Nov. 7 at the historic Orpheum Theatre in downtown Sioux Falls. Hey Sioux Falls is an event for anyone that has a vested interest in the Sioux Falls startup community. It will feature live entertainment and conversation during a social hour starting at 5:30 p.m., followed by a program at 7 p.m. Six local individuals and businesses will receive awards for building great businesses or pushing the Sioux Falls entrepreneurial community forward. Program planned for Veterans Day Among the great days of national remembrance, none is more deeply moving to Americans than Veterans Day.

The Sioux Falls Area Chamber of Commerce’s Military and Veterans Affairs Committee, in partnership with local veterans organizations, will host a Veterans Day program on Monday, Nov. 11, 2019 at 10:30 a.m. The event will take place at Lincoln High School, located at 2900 S. Cliff Ave. The program will feature a mass colors presentation of flags from various military, veterans and service and civic club organizations in Sioux Falls, along with a performance by the Singing Legionnaires of American Legion Post 15. The Veterans Day program is free and open to the public.

Boy Scouts of America-Sioux Council celebrates successful Community Appeal BY MIKE LYNCH

For the past 92 years, Boy Scouts of America-Sioux Council has provided programs for young people that build character, responsibility, fitness and citizenship. With strong support from the business community and over 90 volunteers participating, over $1.3 million was raised through their Sioux Falls Area Chamber of Commerce Community Appeals campaign, which was conducted April through July, 2019. Funds collected will be used to make major renovations to the Sioux Council’s 45-year old Center for Scouting building. Construction will include an urban adventure center, which will include a 3-story structure to allow for state-of-the-art indoor rock climbing, rappelling, zip line, archery, classroom space and shower facilities—all designed to build individual self-confidence and foster team building, as well as develop social and leadership skills. The new amenities will provide opportunities for Cub Scout packs, Boy Scout troops and other organizations from outside the Sioux Falls area to utilize the space for overnight programming and serve as a base of operations to participate in weekend trips to Sioux Falls. Plans call for a fall 2021 completion. Campaign Co-Chair and First PREMIER Bank CEO Dana Dykhouse said that nostalgic feelings emanated from many who contributed financially. “Everyone has a positive scouting experience, and many enjoyed sharing their scouting stories with the campaigners,” he said. SDN Communications CEO Mark Shlanta also co-chaired the campaign.

The City of Sioux Falls and its businesses will be positively affected by the associated economic impact of an estimated 7,500 visitors from our tri-state area who are expected to utilize the facility each year. According to Scout Executive Tom Smotherman, the project aligns very well with the Sioux Council’s goals as they will be better able to meet its vision of making available, a scouting experience that “wows” every youth within its territory and helps attract youth into scouting, as well as to retain them. The Urban Adventure Center will enable scouting to continue to build more conscientious, responsible and productive employees, business owners and leaders for the future. Additionally, it will allow all scouts, regardless of where they live within the Council’s 61-county service area, the same opportunities as scouts who live in the Sioux Empire area. Visiting scouts and their family members will be afforded the same opportunity to take advantage of the multitude of cultural, educational and recreational activities available to local residents. Dykhouse was appreciative to be awarded a Community Appeals campaign slot, saying, “the endorsement of the Chamber Community Appeals Committee helped open doors all over the Sioux Falls area.”

Understanding your employment contract An employment contract not only establishes your responsibilities to your employer, but your employer’s responsibilities to you as its employee. Some of those responsibilities even continue past the termination of your employment relationship. So, whether you’re looking for your first big job or your next big adventure, this article lays out how to address three big questions you as a prospective employee should consider when reviewing the contract you receive from your employer.

Whether you’re an independent contractor or an employee is a significant consideration, as it can affect the benefits you’re entitled to, who pays taxes, whether the company can ask you to enter into a non-competition agreement, and on and on. Whether you’re an employee or an independent contractor has a lot to do with how much control your employer exercises over your relationship. The more control your employer has over your behavior and finances, the more likely it is that you’re an employee. The following table can be a helpful guide:

2. CAN I BE FIRED FOR NO REASON? If you’re employed in South Dakota, you can probably expect that you can be terminated “at will.” This means that you can be fired for about any reason, or no reason at all (as long as they’re not doing so in a way that is discriminatory—but that’s a lengthy topic that would require its own article). However, look for termination provisions
There are a few ways your employment contract can control you even after you’re no longer working for that employer. You might see these as separate agreements or as clauses within your employment contract. Two of the most common are: a) non-competes and 2) non-disclosure agreements. a. Non-Competition Agreements Generally, South Dakota doesn’t like contracts that restrain trade. However, the law makes an exception for non-competition and/or non-solicitation agreements (commonly known as “non-competes”) between an employer and employee (but remember, only if you’re an employee, not an independent contractor). South Dakota law allows an employee to agree with an employer that they will not directly or indirectly engage in the same business as their employer or solicit existing customers of the employer for up to two years from the date of termination of the employment relationship in a specific, identified area, so long as the employer carries on that business. In other words, your agreement must lay out the area in which you are not allowed to compete. Legally, it could be as small as the city limits of Sioux Falls to as large as the entire continental United States. b. Non-Disclosure Agreements Non-disclosure agreements (also known as “NDAs”) protect confidential information and the people signing these agreements need not be in an employment relationship for these to be enforceable (lookin’ at you, independent contractors). Some information, however, can arise to the level of a “trade secret,” which is statutorily protected from disclosure, even without being addressed in the contract. Unfortunately, this article covers only the tip of the iceberg when it comes to the kind of information your employment contract may contain. Do your research, ask questions and contact your own independent attorney for more on these important agreements. Five questions with Katie Haffeman Katie Haffeman is the general manager of KDLT-TV. She began her television broadcasting career in 2002 at KDLT and has grown through several roles with the station to her current position. In 2015 and 2016 she was nominated for an Upper Midwest Emmy Award for “Overall Excellence” for KDLT-TV. Katie and her husband Mark have three children: Hailey, Chase and Tyler. When she is not cheering on her children at their sporting activities, she enjoys long distance running and volunteering for Junior Achievement, Rotary, St. Michael Parish, Girls on the Run, EmBe Camp CEO and KDLT’s Coats for All.
How did you choose your profession? When I was young and spending summers at our lake cabin, the KDLT signal came in the strongest and had the best summer sports to watch; needless to say, I was hooked! When I was in college, I interned at KDLT and knew this was where I was meant to be. I enjoy meeting new people, problem solving and being challenged, so sales seemed to come naturally to me. KDLT isn’t just a job, I am proud of where I work, it’s my home away from home and it’s fun.
What makes a great leader? KATIE HAFFEMAN KDLT-TV
There is a saying that I strive to live by: “As you climb, lift. We grow muscles by lifting weights; we grow powerful by lifting each other.” As professionals we need to empower each other, not tear each other down. Someone else’s success does not lessen our own successes. Be confident in yourself, in your skills and treat others in the way you want to be treated. There should be a strong value in supporting others to help achieve their ambitions. As you climb, lift.
What is your favorite thing about Sioux Falls? I am very proud to call Sioux Falls home. I can’t put into words what Sioux Falls means to me or what my favorite thing is because there are so many. I was born here, made memories growing up here and came full circle as I am now raising my family here. We are blessed to live in a community that is forward-thinking, has amazing opportunities and is still a safe place where you can drive anywhere in under 15 minutes and are bound to run into someone you grew up with when you walk down the street. Memories are everywhere!
What is the best thing the Chamber does for the Sioux Falls area? An amazing benefit to joining the Chamber is the new member benefit package. KDLT has been a Chamber media partner since 2008, and we are proud to offer a mutually beneficial package to new Chamber members!
What is your favorite television program? Anything sports, specifically the Minnesota Vikings! I love watching Sunday Night Football, Notre Dame, football of any sort, Olympics, tennis and golf, but only if Tiger Woods is playing.
