In 2008, Darryl Roberts produced “America the Beautiful,” a film about America’s obsession with beautiful people. Roberts talked candidly with a National Public Radio show host about his relationships with gorgeous women. Dating three beautiful (“inside and out,” he said) women at once, he couldn’t settle with any one of them, because he was constantly looking for someone who was more beautiful. In his film, Roberts chronicles the life of Gerren Taylor, who began modeling at age 12. She skyrocketed to fame as a young model, but at age 15 she went to London and Paris to seek a job as an international model and was told that she was seven centimeters too big – too “obese” to model. Roberts described Gerren as 6 ft. tall and a size two. Her self-esteem had been developed purely through body image – through a walk on the runway, she told Roberts, and without that role she was lost. Many women and men get their idea of body image from the magazines that often feature the “beautiful” people on their front cover, from People Magazine to Sports Illustrated to Teen Magazine and AARP Magazine. Rarely do we see a 60-year-old with wrinkles and thinning hair on the front page of the latter magazine. Photoshop is a magazine’s answer to cosmetic surgery!

DROPPING THE POUNDS Amazon.com lists 23,876 choices for books on diet and weight loss. Amazon.com showed 708,552 results for books on exercise. Inarguably, weight defines body image. Books like the Atkins Diet, the South Beach Diet and the Flat Belly Diet have drawn thousands – millions – to seek help with losing weight. Those who wish to lose weight through the misery-loves-company method have thousands of choices, from weight-loss clinics to spas to boot camps. • In June 2008, there were 18,100 spas in the U.S., up 24 percent from the previous year. • Day spas comprise the highest percentage of the type of spas. • More than 32 million people go to spas on a regular basis. • The spa goers are opting for services that include about everything available to “enhance” the body: facial peels, waxing, massage, alternative therapies, wellness and cosmetic prevention (under a health care professional), healthy cuisine, exercise programs, and more. The irony of it all is that despite the number of selfhelp programs for issues like weight control, obesity continues to rise in this country. A study by the Robert Wood Johnson Association Trust for America’s Health concluded that two-thirds of Americans are overweight or obese; one-third of all children in the U.S. are overweight or obese. A vast majority of health care professionals, personal trainers and others in the business believe that the body and the mind are one. Perhaps obesity and any other body issues or lack of acceptance of one’s mirror image could be better controlled by seeking mind-improvement advice. And there is plenty out there.

SELF-IMPROVEMENT OF THE MIND KIND There are a number of talk shows devoted to improving the lives of Americans. Oprah Winfrey is probably the most well-known modern-day queen of howto-get-a-better-life television. And then there’s her magazine. ver forty weeks ago I began this series titled “Prepare for the Boom”. When I began the series I was anticipating an economic boom that I thought would naturally follow the bust of the last year or so. It was based on the theory that what goes up must come down…and what comes down must go up. I posited that those who were the best prepared for the break upward would receive the greatest benefits from the boom. That’s why each week I wrote about things you and I need to do to be ready when the bust turns into the boom. By most people’s standards, and despite promises of hope and change, what went down is still going down. About the only things that are going up are foreclosures, bankruptcies, prices and unemployment. Some pundits think we’re going to have to wait a long time for the boom. I hope they’re wrong and I know you do too. In the meantime, there’s not a whole lot you and I as individuals can do to bring about immediate changes to the national economic predicament we are in.

So if there’s going to be any boom in your life, you’re going to have to make it happen yourself. It’s up to you and me individually

You already know that there is little or no help in the forces that surround you. In most cases those outside forces are working against you, but the powerful forces within your own soul - they can lead you to your destiny. Let me ask you a few questions: Who are you, really? What great longings in your heart still linger? What significant yet perhaps repressed aspirations seek fulfillment? Answer those questions and you will find your real strength. It’s not in some government benefit or bailout. It’s not in winning the lottery or getting a surprise legacy from an unknown recently deceased wealthy uncle. Your strength and your riches are within you. You must bailout yourself, solve your own problems, and create your own legacy. In many ways, my friend, you’re on your own so get after it…whatever for you “it” is. Here’s the point about you that I am trying to make: You never know the measure of your strength until your strength is tested. And right now – this is the season of testing. Over the next few months and years you’ll find out what you are made of. And that is good. In a poll taken last year by the foodie Web site Slashfood.com, more than 78,000 readers weighed in on the foods they hate. Brussels sprouts finished No. 8 on the list of most hated foods. The comments section overflowed with horror stories about being forced to eat the vegetable as a child. One thing I noticed about the readers’ comments was that they ate Brussels sprouts that were muddy colored, overcooked and smelled bad. When Brussels sprouts are properly selected, stored and cooked, they have a bright color, a crisp texture and a delicious flavor. When selecting the vegetable, look for small, young, vibrant green, tightly compacted sprouts. Brussels sprouts are delicious boiled or

1. Using a large bowl, pour in the lemon juice. Cut bottoms off the sprouts, and discard. Halve sprouts lengthwise. Thinly slice sprouts, cutting around and discarding the firm core. Immediately toss sprout slices with lemon juice to separate leaves and retain color. 2. Heat oil and butter over high heat in a skillet large enough to hold all the sprouts. When oil mixture is hot, but not smoking, add the sprouts, onion, garlic, Italian seasoning and salt and pepper. Cook until sprouts begin to wilt, but leaves are still green and crisp, about 3 to 4 minutes. Some of the leaves might brown slightly. 3. Move the sprouts to one side of the pan and mix broth, mustard and honey or sugar together in the pan. Combine mixture with the sprouts and cook, stirring, 2 minutes more. Turn off heat, and stir in lemon zest, reserving a little to sprinkle on top of the dish. Transfer to serving bowl, sprinkle with remaining zest and serve. Serves 4.

If you want to add some nuts, sprinkle walnuts or pecans onto each pancake before flipping. I used canned pumpkin because it was easier but you can always cook down a pumpkin and puree it. The batter will last several days in the refrigerator and is even better after it sets a day. Separating the eggs make the batter much more fluffy but you can cream the whole eggs with the sugar and salt and skip step 5 if time is an issue.

Question: Is it true that I’m supposed to drink 8-8oz. glasses of water per day? Answer: This is actually a more complicated question than you might think, but the answer is no, not necessarily. The daily Adequate Intake (AI) for water is 3.7 liters (132 ounces) for men and 2.7 liters (96 ounces) for women over age 19. You’re probably thinking these numbers are high, but that’s because they represent total water intake from both fluids and foods. This even includes beverages with caffeine and alcohol, since the Institute of Medicine concluded that they contribute to overall hydration, assuming they’re consumed in moderation. Generally speaking, we take in 80% of our water from fluids and 20% from foods, so doing a little math gives us about 105 ounces for men and 77 ounces for women per day. These are rough estimates gathered from national data, and they may be appropriate for some, but how do we go about individualizing these recommendations? It’s actually pretty simple. Ideally, we should base our fluid needs on body weight, since a heavier person clearly needs more water than someone who weighs less. Therefore, a good goal is to drink half your body weight in ounces each day. This approximates the daily fluid losses from your body. For example, a 160-pound person should drink roughly 80 ounces of fluid per day. A simple way to check if you’re adequately hydrated is to make sure your urine color is pale yellow to clear on a consistent basis.

Stretching offers numerous benefits, including injury prevention, an increased efficiency of movement and improved blood flow and nutrient delivery to the joints. It also improves muscle coordination, overall balance and postural alignment. It can even help to alleviate muscle soreness and stress after a workout. These are pretty impressive results for just a few minutes of relaxation. Unfortunately, people always seem to be crunched for time, and stretching is usually the first thing to go. In order to make it a consistent part of your training regimen, you need plan for it. Reserve the last ten minutes of your session for stretching, and try not to let your schedule get in the way. After all, you wouldn’t normally cut your lifting or cardio sessions short, would you? I have it at least twice a year, and it’s so painful I can’t put my foot to the floor. Please list the things not to eat so that I can kind of keep it under control. -- E.W. ANSWER: Uric acid crystals that bore their way into joints are the cause of gout. Uric acid is a byproduct of the daily turnover of body cells. As long as blood uric acid stays within a normal range, all is well. When its blood level rises, the uric acid infiltrates joints and causes intense joint pain, swelling, redness and heat. Gout mostly happens to middle-aged and older men and to women who have gone through menopause. The base of the big toe is often the first joint to suffer an attack. Further attacks can target the heels, ankles, knees, elbows, wrists and fingers. The definitive proof of gout is finding uric acid crystals in joint fluid. A rise in blood uric acid level is another tip. The gout diet is not very restrictive. In the days before medicines effectively controlled gout, diet was the only remedy. It’s in second place these days. The consumption of red meat and especially organ meat (kidneys, heart, liver, brain and sweetbreads) should be minimized. It’s best to avoid gravies. Seafood, especially anchovies, sardines and shellfish, should be eaten in moderation. Alcohol -- beer in particular -- can provoke an at-

tack. All vegetables and fruits are permitted, and low-fat dairy products appear to prevent attacks.

any people put off concentrating on their weight loss efforts. Think about times when you may have said to yourself, “I’ll follow the program correctly tomorrow”. Or, “I’ll start exercising next week”. Procrastination is a hard habit to break. All of these emotions can be dealt with. They become a problem when you don’t pay attention to your feelings. Solutions involve focus and awareness. Try to talk about your feelings, write them down, or tape-record them. Discuss them with a support person, and/or check out past behavioral tips that address specific emotions. Becoming aware of and taking steps to resolve emotional issues can help you break the habit of procrastination; so that you can put your best effort into your weight loss program.

New DVD Releases for Week of September 21, 2009 PICKS OF THE WEEK “30 Rock: Season Three” -- “30 Rock” started out as one of those shows that virtually no one watched (think “The Wire,” “Rescue Me,” “Manimal”) yet every critic in the country gushed over. So naturally I avoided it, because critics are big dumb doody-heads and they’re not the boss of me. But my undying love for Tina Fey (and subsequent restraining order -- THANKS

A LOT L.A. County District Court!) could not keep me away. So I began watching the show’s third season. And you know what? “30 Rock.” Is. Awesome. Not only is it the best biting satire of show business ever, “30 Rock” rocks the metahumor and pop-culture refs harder than “South Park,” “The Simpsons” and “Family Guy” ever have -- or will. But don’t take my word for it. NetFlix or Hulu any episode from any season. Trust me, you’ll be “lizzing” within 10 minutes. “Wallace & Gromit: The Complete Collection” -- This four-disc boxed set contains all the “Wallace & Gromit” animated short films: “A Grand Day Out,” “The Wrong Trousers,” “A Close Shave” and the brandnew “A Matter of Loaf and Death,” wherein our heroes (the hapless inventor Wallace and his thankfully much smarter dog

Gromit) go into the bread-baking business, with hilarious results. If you already own the previously released boxed set of the first three films, don’t despair. You don’t need to buy this one just to get “A Matter of Loaf and Death,” because it’s also being released this week as its own stand-alone disc. “Zombies of the Stratosphere” -- Released in 1952, this is the third and final Republic serial in the Rocketman/Commando Cody series. The plot centers around a plan by the Martians (whose planet is dying) to blast the Earth out of its orbit in order to move Mars into its place. As serials go, this one is pretty good, but the real reason I’m mentioning this particular one is because “Zombies of the Stratosphere” marks the film debut of Leonard Nimoy, who has a small part as Narab, one of the zombie Martians.

BEWARE OF DOG: LIABILITY OF PROPERTY OWNERS FOR INJURIES ON THEIR PROPERTY © February, 2007, Lisa Welch Stevens, Esq.

ecently, I represented a client, a large scale dog breeder, in court on misdemeanor charges of possession of “dangerous” dogs. The case was interesting in that, although the owner of the dogs and the real property operated a business on the property where the alleged attacks occurred, and the alleged “victim” was allegedly a prospective “customer” of that business, the “victim” actually entered upon the property without my client’s permission, during a period of time when it was closed to the public, with signs clearly indicating that fact. And those simple facts may make all the difference in the world to our case. The possessor of real property has varying duties of care that he owes to those who enter upon his property, depending upon how they are classified under the law. Traditionally, those entering upon the land of another were classified as “trespassers”, “licensees”, and “invitees.” A “trespasser”, as most are well aware, is a person who enters or remains upon land in the possession of another without permission, express or implied. A possessor of real property has no duty towards trespassers, at least not adult trespassers, to keep them safe. By trespassing, that person assumes the risk of any harm that may befall him. As with most areas of the law, there are some exceptions to this general policy, but on the whole, it is the case with respect to adults.

A “licensee” is a person who enters upon the property of another, with that other’s knowledge and permission, but who enters for his own benefit and purpose, not for the benefit or purpose of the possessor of the property. Good examples of licensees are a social guest, a sightseer, solicitors, salesmen, recreational users, etc. The possessor of the property does have some duty to protect licensees, but only as to injuries caused by the possessor’s activities, dangerous conditions actually known to him, and the like. An “invitee” is a person who enters upon the property of another, with the express or implied invitation of the possessor of the property, to do business with the possessor, for the possessor’s anticipated benefit. The possessor of the property does have an affirmative duty to protect invitees, not only against dangers of which he knows, but also of those that with reasonable care he might discover. Good examples of invitees are store customers, bar patrons, theater-goers, etc. However, even given this duty towards invitees, the possessor of the property is not an insurer of the safety of those invitees; he is only required to exercise “reasonable care” for their safety. A person who enters a store during business hours, while it is open, with the possibility of doing business with the storekeeper, is an invitee. That same individual, even if he wishes to do business with that storekeeper, who enters into the store during the night, or on a day or during a time of year when it is not open for business, and where that fact is clearly indicated, is a trespasser, to whom very little duty is owed. While strict liability might apply for injuries caused by a “dangerous” dog to licensees or invitees, in the absence of actual knowledge that a trespasser was entering upon the property, and actual knowledge that the dogs in questions are “dangerous” and will attack, there should be no liability imposed. This is a general discussion, and introduction only, to what is a very complicated topic. Please consult your legal advisor regarding your particular situation.

Examine the forced air furnace fan belt for wear, looseness or noise; clean fan blades of any dirt buildup (after disconnecting the electricity to the motor first). Open furnace humidifier damper on units with central air conditioning and clean humidifier two or three times during the winter season. Monitor your home for excessive moisture levels which can cause significant damage over time and pose serious health problems. One way to monitor: excessive moisture levels will cause condensation on your windows. Clean the heat recovery ventilator filters and the core. Pour water down the condensate drain to test it. Lubricate circulating pump and bleed air from on hot water heating system. Cover outside of air conditioning units. Vacuum electric baseboards. Keep heating vents free from furniture and draperies.

Consider having a Qualified Heating Service Company service your gas furnace or heating system at least every two years. This will ensure optimal performance and discover minor problems before they turn into costly major repairs.
