The glass is always half empty for the pessimist. They believe any negative events are their own fault and blame themselves for everything that goes wrong. They tend to be black and white thinkers with no middle ground. More and more negative events will likely happen and they anticipate the worst. Anything positive that happens to the pessimist is seen as happenstance and not likely to come their way again.

SHOULD BE OBVIOUS, BUT… Optimists just have it better. They have: • • • • • • • •

Longer life spans Fewer illnesses Career success Less depression Fewer common colds Better coping skills Less stress Less signs of aging

A positive attitude in the workplace is better for everyone. Employees feel less stressed; there is improved teamwork, better decision-making, better leaders, fewer sick days, higher productivity and improved sales.

“THE SECRET” FRENZY Author Rhonda Byrne claimed to know the secret of wealth, health and happiness and released a film and a self-help book in 2006 that seemed to take the world by positive storm. “The Secret” is simply that one’s positive and focused thinking can bring about life-changing events. The popularity of the book soared to Byrne’s expectations (of course) after Oprah Winfrey featured the book on her show twice. The Secret is not without its critics. Some say that Bryne’s and other books like hers promote a blame-the-victim mentality: If only I could think more positive, my cancer would go away. Many physicians will tell stories of patients whose cancer DID go away unexpectedly. Can a positive attitude help? Experts say it can’t hurt.

PUT ON A HAPPY FACE Body language says a lot about attitudes. Someone who walks around frowning with slumped shoulders, keeps their head down and avoids eye contact clearly appears unhappy and/or depressed. On the other hand, meet someone who walks with their head up, makes eye contact, has a pleasant facial expression, upright posture and a spring in their step, and we think they are happy and exuding confidence. LAUGH AND THE WORLD LAUGHS WITH YOU Laughter is contagious and one way to bring about a more positive attitude. It’s simple biology: laughter increases the body’s production of endorphins (feel good hormones), neurotransmitters and antibody-producing cells. It also increases the effectiveness of disease-fighting T cells which makes for a stronger immune system. Laughter reduces the stress hormone cortisol, epinephrine and dopamine that can wreak havoc on good heath. Laughter is a mini workout for the shoulders, muscles and heart.

LAUGH AND LOSE WEIGHT? It’s true and there is an emerging industry to support this. There are laughter clubs, trained laugh leaders, laugher CDs and an entire exercise movement called “laughtersizing.” It’s possible that some day dieters around the world will pop in a laughter CD instead of raiding the refrigera-

If not convinced, try on those two personas and see how you feel after a few minutes. Your attitude will likely begin match your body language. The message is that body language messages sent to others can also be internalized to affect attitude.

• Exercise and practice healthy eating habits • Do something creative – cook a gourmet meal, compose poetry, paint • Play with a child

Put on a happy face and positive posture and before you know it – positive attitude!

There’s a million of them, but here are a few:

According to Albert Mehrabian, professor emeritus of Psychology at UCLA, body language plays a key role in attitude. He calls it the “7%-38%-55% Rule.” Essentially, he is saying there are three elements in communication – words, tone of voice and body language – elements that impact how we feel about the person communicating. Mehrabian says that 7 percent of communication is in the actual words said, 38 percent is in the tone of the voice and 55 percent comes from body language. The problem is when these elements don’t match up or support one another. When the tone of voice and body language doesn’t match the words being said, people will tend to believe the tone and body language more than the words. Mehrabian cautions that this theory only works when a person is communicating their thoughts or feelings.

LET’S GET POSITIVE A pessimistic attitude does not have to be a cross to bear. Positive change can happen no matter how we are genetically predisposed. The benefits from making the effort toward becoming an optimist are substantial. That position empties blood out of leg veins. Admittedly, you can’t spend the entire day with your legs elevated, but elevate them as often as you can. Never stand for long in one place. If you have to stay still, contract your calf and leg muscles to push blood out of the legs. Should you change your mind about surgical vein removal, you should know that today there are many methods of getting rid of these veins. Endovascular lasers, radiofrequency catheters and sclerotherapy are recent-vintage techniques. Surgical removal has been refined to the point that most patients return home on the day of operation.

NEW WAYS TO TREAT VARICOSE VEINS

ANSWER: Leg veins face a Herculean task. They have to return blood to the heart in the face of gravity, which works to keep blood from moving upward. They couldn’t accomplish their task if they didn’t have valves. As blood moves upward in the vein, its valves close so that it can’t fall back down. The problem with varicose veins is a valve problem. Their valves no longer work. Blood stays in the leg veins, distends them and stretches them out of shape -- varicose veins. Varicose veins can make the legs ache or cause them to tire quickly. Sometimes, the pooled blood leaks fluid out of the veins, so the ankles and feet swell, and open ulcers -- most often around the ankle -- might form. And then there is the cosmetic aspect, about which I’m not qualified to comment. Things you can do for varicose veins are limited but worth trying. One is compression stockings. The very best stockings are the ones with graduated compression, with the compressive force greatest in the lowermost part of the leg and with lesser force in the upper parts of the

New DVD Releases for Week of February 15, 2010 PICKS OF THE WEEK

“Black Dynamite” -- Hands down, the funniest movie of 2009, “Black Dynamite” is a raucous and raunchy send-up of 1970s blaxploitation films. Michael Jai White stars as Black Dynamite, an ex-CIA agent fighting a one-man war against The Man’s conspiracy to fill the ‘hood’s orphanages with drugs and the ghettoes with tainted malt liquor.

“Goodfellas (20th Anniversary Edition) Blu-Ray” -- If you already own the previous Blu-Ray edition of “Goodfellas,” there’s really no compelling reason to buy this two-disc set. The digital transfer is the same as the previous release. The commentary tracks by director Martin Scorsese, Ray Liotta, Paul Sorvino, Henry Hill, et al., are the same, as is the documentary on Made Men. The only thing Warner Bros. did for this anniversary edition is pad out the extra features on Disc 2 with a couple of old Warner Bros. cartoons and a documentary on gangster movies from the Warners Gangster Collection boxed set.

“Dirty Harry Collection” -- For nearly 70 years, policemen in films and television were always portrayed as stalwart defenders of the law; men who did things By The Book -- and then threw it at you. Then, in 1971, all that changed when Clint Eastwood as “Dirty” Harry Callahan whipped out a .44 Magnum (the most powerful handgun in the world), aimed it between the eyes of a quivering perp and said the iconic line, “Well? Do ya feel LUCKY? PUNK?!!” From that moment on, virtually every cop in the movies has been a Maverick, a rogue cop who plays by his own rules. The boxed set contains the entire series of films: “Dirty Harry,” “Magnum Force,” “The Enforcer,” “Sudden Impact” and “The Dead Pool.” There is a sixth disc with a documentary on the films’ legacy and other featurettes and extras.

Required risk — The higher the return necessary to reach your goals, the more potential risk you’ll need to take on — in other words, the greater your “required risk.” For example, when it comes to retirement, the return you’ll need from your investments depends on several factors: your age, your retirement lifestyle, your available sources of income, your desired legacy and so on. To achieve your goals, you’ll need to find the right balance between the returns you need or anticipate and the amount of risk you are comfortable with. Ultimately, your challenge will be to balance your risk tolerance, risk capacity and required risk as factors in a comprehensive investment strategy. By creating this strategy and sticking with it over time, you’ll be able to make investment decisions based on your needs and goals rather than emotionally reacting to the constant changes in market conditions. M

y law practice is focused on business law, whether transactional (business formations and agreements and contracts) or litigation (suing over agreements, etc. gone wrong). I represent small businesses and their owners – “small” in the sense that the businesses, no matter how large their revenues, have only a few owners and/or employees. While I normally harp to my clients on the importance of putting everything in writing in order to protect themselves, there is one situation where I do not want my clients to put things in writing – and that is with respect to employment contracts or any documents spelling out the terms and conditions of employment. As I have discussed previously in this publication, Colorado is an “at will” employment state; if there is no contract of employment between the employer and the employee, the employer is the “king”: he can fire anyone at any time for any reason (or no reasons) whatsoever, and even for a completely horrible reason, so long as he is not an “employer” under federal discrimination laws. Thus, you absolutely do not want a contract of employment with your employees. You may think this is easy to avoid: if you don’t have a “contract”, denominated as an “employment contract” or “employment agreement”, with your employees you are in the clear. Not necessar-

hen you need to buy something right away, you do the best you can to find what you want at a good price. But with most items, it’s possible to time your purchase to when you’re more likely to get a real deal. Here are some suggested times to buy: Vacuum cleaners -- Shop for older models just in time for spring cleaning. Air conditioners -- anytime between October and March, before new models arrive in early spring.

Camping, hiking, biking and outdoor equipment -- Shop just as the newest gear hits the stores in January and February. Cars and trucks -- Many people believe that the best time to buy a car is at the end of the month, when sales personnel are desperate to meet their quotas. Instead, consider shopping for a car at the beginning of the month when the quota meter is reset to zero and sales staff hope to get a jump on filling that month’s quota. Cameras -- Keep an eye out for new models coming out -- and buy an older model. Airline tickets -- Book your flight at least 21 days in advance, but less than three months ahead of time. However, if you’re buying tickets for your family’s annual vacation, don’t play the waiting game for too long. Consult a travel agent early to nail down your best price, especially if you’ll also need a rental car and accommodations at the other end. Appliances -- look for sales in September and October. Negotiate for free delivery and setup, as well as taking the old item away. Furniture -- The best times to buy are February and August, when showrooms are cleared for new furniture after the holidays.

ily so! Courts (yes, even Colorado courts!) have ruled that many other types of writings constitute contracts of employment. For example, employee manuals or handbooks have often been found to be sufficiently detailed and to make sufficient promises as to be, as a matter of fact (not law), contracts of employment. The more specific the terms, conditions or provisions of an employer’s employee manual, handbook, policies or guidelines are, the more likely a court is to find that a contract of employment, rendering those terms, conditions or provisions or policies or guidelines legally enforceable by the employee, has arisen between the employer and employee. This problem most frequently arises when a client, to save money, either gets an employee manual or handbook form online or purchases one from an office supply store, inserts the name of his or her business, cuts and pastes various provisions, and then hands out the resulting document to his or her employees without having it reviewed by a Colorado attorney. Very rarely are any form business documents drafted with an eye toward Colorado law – we are simply too small of a state, businesswise, for it to be economically feasible for the form merchants to do so. A handbook, manual, policy or guidelines may not constitute a contract of employment in one state, but do so in Colorado. The safest course of action for Colorado employers is to put nothing in writing regarding terms and conditions of employment. When in doubt, leave it out! (The exception is with independent contractors rather than employees, which is a topic for another day.) Gym memberships -- It’s true that you’ll get the best deals in December and January as people gear up for their New Year’s resolutions. But if there’s a gym near you, approach them at any time to ask for their best possible deal. They might surprise you. As always, do your homework before you buy. Make comparisons. Look online for competitor pricing and coupons. The biggest way to save money is to plan ahead: If you know your window air conditioner likely won’t make it through another summer, start looking now. Don’t wait until July, when prices will be high and stock low.
