SNIPPETZ NEVER GETS RUBBED THE WRONG WAY:
MASSAGE THERAPY! by Deborah Stumpf
ISSUE 464 • SEPTEMBER 20, 2010
“The physician must be experienced in many things, but most assuredly in rubbing.” - Hippocrates, The “Father of Modern Medicine”
581 Hwy 105
T
he word “massage” is from the French word of the same, meaning “friction of kneading.” Massage therapists press, rub and manipulate the muscles and other soft tissues of the body – most often using their hands and fingers. Some actually use their elbows and feet. Hippocrates wrote about the friction of rubbing, and said that healers must incorporate rubbing as part of their practices. Massage therapy was widely used in ancient Greece and other countries, gaining in popularity during the Renaissance period. In the 1850s, two American physicians brought massage therapy to the United States after studying the techniques in Sweden. At the end of World War I, massage therapy became a beneficial mode of treatment for American soldiers who had suffered from “shell shock.”

A FALL FROM GRACE During the 1930s and 1940s, massage therapy took a back seat to scientific and technological advances in medical treatment. And when “massage parlors” (so-called coverup for illegal sex trade and practices) cropped up, massage therapy became somewhat of a pariah. It would take 30 years before massage therapy would regain its popularity. In the 1970s, athletes were instrumental in bringing massage therapy its due in modern times. Today, millions of Americans receive a variety of massage therapy techniques every year.
THE FACTS Here’s what the American Massage Therapy Association 2009 annual consumer survey reported. • Between July 2008 and July 2009, about 48 million adult Americans had a massage at least once. • Thirty-two percent get massages for medical reasons. • Fifty-two percent who discussed massage therapy with their doctors reported that their doctors strongly recommended or encouraged them to get a massage. • Massage can be effective in reducing pain, according to 86 percent. • Massage is beneficial to overall health and wellness, as reported by 85 percent of Americans. • More than half of adult Americans (59 percent) think massage therapy should be covered under their insurance. • Massage has had positive effects for cancer-related fatigue, chronic lower back pain, carpal tunnel syndrome, high blood pressure, headaches, post-operative pain and osteoarthritis of the knee. • In 2009, 49 percent of consumers have considered massage to manage stress; up from 38 percent in 2008. •

SNIPPETZ ASKS OUR READERS TO BEAR WITH US
There are more than 80 types of massage; some are more well-known than others for relieving everything from headaches to sore feet. The following techniques are among the most popular, according to About.com, a division of The New York Times Co. (Some might wonder why Reiki is not included; however, Reiki is not considered massage by definition.

Aromatherapy This type of massage adds essential plant oils to the stroke therapy. The oils are selected to address specific needs like lavender oil for relaxation.
Hot Stone This technique uses smooth stones that are heated and then placed on certain points of the body to warm and loosen tight muscles. Hot stones also balance energy centers in the body. Some massage therapists apply light pressure with the stones. This therapy is good for people with sore muscles who don’t want a heavier massage.
Deep Tissue Speaking of heavier massage techniques, deep tissue focuses on deeper layers of the muscle and the connective tissue. The therapist uses slower strokes, and the pressure is deeper and concentrated on chronically tight or painful muscles. This type of massage is good for recovering from injuries or repetitive strain. Because of the pressure applied, patients can feel sore for a day or two after the technique.
Shiatsu With shiatsu massage – a form of Japanese body work – the therapist uses finger pressure in a localized area on acupuncture meridians. Each “point” is held for a few seconds to balance the body and improve energy flow.
Thai Thai massage also uses gentle pressure on specific points of the body. The difference is the patient is moved and stretched in a variety of postures. Thai massage is energizing and improves flexibility and range of motion.
Prenatal Massage Pregnant women are using massage therapists who are certified in prenatal massage to reduce stress and anxiety, decrease swelling and relieve aches and pains. The trained therapist knows the proper techniques for positioning the woman’s body, and customizes massage techniques for individual women.
Reflexoloy Reflexology is often thought of as an alternative medicine of its own. Although one thinks of foot massages, reflexology is much more. Practitioners must understand the system of the body and how it relates to certain points on the foot. Each point corresponds to an organ in the body. Reflexology is relaxing, and it can relieve a number of medically related issues.

Touch is the first sense to develop in humans and may be the last to fade. There are about 5 million touch receptors in human skin – 3,000 in one finger tip. Skin is the largest organ in the body. There are more living organisms on the skin of one human being than there are human beings on the surface of Earth. Any kind of touch can reduce heart rate and lower blood pressure. Touch stimulates endorphins – the body’s natural pain killers. Massage before an athletic event provides more flexibility, enhanced speed and power and injury protection to the athlete. Muscles are made up of bundles from about five in the eyelid to about 200 in the buttocks. There are 640 muscles in the human body. Bob Hope lived to be 100 years old; it’s believed that massage therapy was part of his everyday health routine.

• It was existential psychologist Rollo May who made the following sage observation: “It is an ironic habit of human beings to run faster when we have lost our way.” • Two countries are tied for the nation encompassing the most time zones. It’s no surprise that Russia is one of them, but it seems odd that the other would be France. It’s true, though; once you take a look at a map of French territories around the world, you’ll see. There are French Polynesia in the Pacific Ocean, the island of Reunion off the east coast of Africa, various holdings in the Caribbean, and New Caledonia off the east coast of Australia, among others. • If you had to choose, would you rather be bitten by a skunk or sprayed by one? The creatures can’t do both things at once.
• A snail’s teeth are located in rows along its tongue. • It’s a commonly held belief that the Coriolis effect causes water to drain out of sinks and toilets in one direction in the Northern Hemisphere, while it drains in the opposite direction in the Southern Hemisphere. As it turns out, this isn’t true. Drains are so small that the Coriolis effect has no measurable influence at all. It’s the shape of the sink and whether or not it’s level that determines the direction of the drainage. *** Thought for the Day: “Electricity is actually made up of extremely tiny particles called electrons, that you cannot see with the naked eye unless you have been drinking.” -- Dave Barry

corner arrangements, selection of focal point components, and most importantly, the room’s layout and space planning are all major components to any room’s design. The proper use of lighting is another important aspect of interior design. From ambient accent lighting to task lighting, proper lighting can be the difference between a professional, polished look and a disappointing result. Choosing furnishings that are the proper scale for the space is a key element to good design and decorating. A well-designed room will have good use of proportion and scale while keeping closely related to the architecture of the home and the lifestyle of the family who lives there. To do this all within your decorating budget can be the tricky part ~ that is where a good designer helps you succeed! For more information, please visit www.FlooringandDesignCenter.com

TAI YI ANGER?
I
n our society, it is not usually acceptable to express anger, unless it is at a situation where many people are angry, such as the September 11th terrorist attacks. There are many social situations where it is deemed acceptable to express anger, for example, in sports settings, protests, the finding of abuse of a small child or an elderly person, and in politics. However, when it comes to the expression of anger at a person within the family or friend or anger at a childhood event, many times the anger is suppressed. Suppressed anger creates difficulty. In addition, revealed anger that is not resolved creates difficulty as well. Negative anger is anger that is directed at a person or event and carries judgment and blame. The person holds onto the anger for different reasons, but the refusal to heal the anger can create difficulty in the liver, gallbladder, blood pressure, skin, digestion, in addition to leading to addictive patterns. As long as a person chooses to hold onto blame and judgment, the anger will not heal. Some people state they want to heal their anger, but do not know how in the process. Some people state they are very comfortable with their anger and DO NOT want to heal it. Neither person is right or wrong, however a person who heals the anger experiences a different outcome and reality than one who chooses to hold onto anger. In my experience in working with many different individuals, many choose to hold onto anger because

it has created a safety zone. The anger places a wall where, in the mind, the risk of being hurt is very low. This is not logical. The person is already experiencing pain from a painful interaction with a person/ people/event. How can putting up a wall prevent pain? All the wall does is keep the current pain intact. The anger recycles itself over and over while quietly and sometimes loudly creating difficulty in the body. Most people hold the energy of anger in their liver. This effects the full functioning of the liver, which can lead to high cholesterol and can lead to difficulties in the gallbladder creating gallbladder attacks.

she is betraying the family member by expressing the anger or is fearful of hurting the family member. So, that person suppresses the anger and it does not resolve. It recycles to where the person expresses anger at different people or holds it in entirely and that person experiences a lot of physical issues and difficulty in focus/concentration.
Some people choose not to express and heal their anger because it is directed at a family member. The person who is angry may feel he or

level of anger where there is damage to the body-heart attack, kidney, and blood pressure to name a few. This person has extreme levels of anger and the person finally wants to heal it. It consisted of 32 lanes of traffic weaving in eight directions at once. Today, the interchange’s cost of $5.5 million would pay for just 250 feet of urban freeway.
THE HISTORY CHANNEL
• On Sept. 23, 1846, at the Berlin Observatory, German astronomer Johann Gottfried Galle discovers the planet Neptune. The blue gas giant, which has a diameter four times that of Earth, was named for the Roman god of the sea. It completes an orbit of the Sun once every 165 years. • On Sept. 21, 1938, without warning, a powerful Category 3 hurricane slams into Long Island and southern New England. All told, 700 people were killed by the hurricane, nearly 9,000 homes and buildings were destroyed and nearly 3,000 ships were sunk or wrecked. • On Sept. 26, 1945, Lt. Col. In 1970, the convictions and contempt charges were overturned on appeal. • On Sept. 20, 1973, Billie Jean King defeats Bobby Riggs, 6-4, 6-3, 6-3, in a widely publicized exhibition tennis match dubbed the “Battle of the Sexes.” The match was set up after the 55-year-old Riggs routed Australian star Margaret Court four months’ earlier on Mother’s Day. here I was, standing on the sideline of a hotly contested football scuffle between Lewis-Palmer and Sand Creek when –BAM! I ran into my former English teacher. One whom I’d always adored, but hadn’t seen in quite some time. We had a short conversation; a little this, a little that. It was nice. All the while, Colton Goeas was ripping through the Sand Creek defense for a gain of over 20-yards. Shortly thereafter, he ran it in the end-zone for a touchdown, making the score 20-7, and turning a ‘hotly contested scuffle’, into a Ranger rout. I remember thinking that running into an old face was pleasant, and it was good to “catch up”; something Sand Creek had no chance of doing. The Rangers finished the night with a 4920 victory, and a 2-0 record. Goeas finished the night with 189-yards on the ground, and cemented himself as the Rangers best offensive threat this season.
THE ‘BALL BOYS As of the writing of this article, both the Lewis-Palmer Rangers and Palmer Ridge Bears Football teams have an undefeated record. Admittedly, it’s only week 2, but that doesn’t mean 2-0 isn’t something to get excited about. In the four games played between the two teams, they have outscored opponents 164-33. The Rangers appear more potent on Offense scoring an average of 48.5 points a game, while the Bears defense has given up just 7 points in eight quarters of football. It makes you wonder doesn’t it? What if these two teams stay undefeated? What if, come week 6, October 8th, Palmer Ridge and LewisPalmer meet at Don Breese Stadium with 5-0 records? Are you intrigued? Good. I sure am. Colton Goeas may have stolen the show against Sand Creek, but Ben Shaum led his Rangers well. He finished the night passing
SUNDAY IS FUNDAY, WHAT WILL YOU SAY? “I feel so relaxed.” “This is amazing”. “This is the greatest day of my life. Bar none. Win or lose. This is completely and utterly the most quintessential moment of my being. I have purpose now.” – These are just some of the words you’ll be hearing out of mouths of people as they pack the house and put on their game face at Rodz Bar & Grill (Located at Pinz) for NFL Sunday’s. The pleasurable day includes door prizes, bar specials, Broncos on the big screen, and any and every game available on NFL Sunday Ticket. PLAYING HARDBALL Alright folks, it’s time for a softball segment. Yes, girls’ softball is in full swing, literally; and though the attention isn’t there, it should be. After starting off the season with a loss, the Lady Rangers have won nine of the last ten games. In the last three games, they’ve torn the field up in all phases, combining for 55 runs, while only giving up 2. Their record stands at 9-2, yet they seem to be improving by the week. Haley Midzor leads the team with a .563 batting average, while pitcher Kelli Henry leads in both strikeouts (9) and home runs (3). The Rangers have 7 shutout victories on the year so far, but don’t be surprised if they get ten or more; because these girls play softball, hardcore. And with that, I conclude this episode of Sports Snippetz. Gosh, next time I’m standing on the sideline, I wonder what my English Teacher will say about that horrible “Softball” “Hardball” play on words. Well, if you don’t like it, you know who to blame - the person who taught me how to write. Here are some items to put on your Fall gardening "ToDo" list. When Spring arrives, you'll be glad you took these easy steps to help your garden come through winter ready to flourish.
Don't forget to aerate your lawn - this is essential to do in Fall and Spring.
Trees and Shrubs
Cleaning out leaves and other debris is particularly important with aspen and other poplars, which are susceptible to foliar diseases.

Overseeding and sodding is successful this time of year. Adding a Fall winterizer on your turf within the next month, will make for a healthy and strong root system next year.
Vegetable Gardens
Weeding and removing dead plant material will reduce the amount of habitat for overwintering insects and fungal spores. Make plans to rotate spring crops to avoid soil-borne diseases and maintain good soil vigor. Consider planting a "green manure" crop like annual rye or clover, which can be turned under in the Spring to add nitrogen and organic material to your garden.
Garden Tools
Take time to clean, sharpen and oil your garden tools.
For maximum effectiveness, turf must be green and soil must be moist when the fertilizer is applied.
You will not only extend their useful life, but also enjoy finding your tools ready for action in the Spring.
Fall is also a great time to aerate, especially when you're over-seeding to fill in bare

versity of Texas Medical Branch at Galveston. I saw one quote from a researcher that indicated a 70-yearold could end up with the muscle building power of a 30-year-old. Here’s how it works: In those who are young, eating a meal releases insulin, which then opens blood vessels, which then make amino acids available for muscle building. In seniors, that dilation doesn’t happen -- and often there is muscle loss because the right nutrients aren’t getting to the muscles. Muscle loss equals weakness, and we know what that means: loss of mobility, loss of common drug for high balance and the resulting falls that blood pressure can help can lead to broken limbs.

given the blood pressure medicine along with the insulin ended up with increased muscle-building protein.
Dilation of the blood vessels, along with the potential for increased muscle building, occurred in the study because of the high blood pressure drug that was given. The drug -sodium nitroprusside -- causes dilation of the blood vessels, which sends nutrients to the muscles.
Additional studies are needed, of course, to check their results. I hope they hurry up. Imagine how beneficial this would be. No more struggling to climb stairs, no more balance difficulties.
Participants in the study had to be dedicated to get through the research. They had to endure catheters being inserted into leg muscles so that insulin could be dripped in, mimicking the insulin increase that would normally take place after eating. The test subjects who were also

The Kitchen Diva by Angela Shelf Medearis
BEANS: A MUSICAL SOURCE OF NUTRITION
T
hanks to a recent scientific study, beans finally are getting the culinary respect they deserve. Although researchers haven’t come up with a foolproof way to avoid the more “musical” and indelicate side effect of beans, they have found yet another reason why you should eat more of them. In addition to their high protein and fiber content, a new study finds that beans, particularly black ones, are a rich but overlooked source of antioxidants and may provide health benefits similar to some common fruits, including grapes, apples and cranberries. In a study that appeared in The Journal of Agricultural and Food Chemistry, researchers tested the antioxidant activity of flavonoids -- plant pigments -- found in the skin of 12 common varieties of dry beans. Antioxidants destroy free radicals, which are highly active chemicals whose excess has been linked to heart disease, cancer and aging. The finding adds antioxidants to a growing list of healthy chemicals found in the popular legume, which also is rich in protein, carbohydrates, folate, calcium and fiber. The researchers hope to use information gleaned from this study to help develop new varieties of beans that pack even more disease-fighting power. Black beans came out on top, having more antioxidant activity, gram for gram, than other beans, followed by red, brown, yellow and white beans, in that order. In general, darker color seed coats were associated with higher levels of flavonoids, and therefore higher antioxidant activity, says lead investigator Clifford W. Beninger, Ph.D., a research associate at the University of Guelph in Ontario, Canada. “Black beans are really loaded with antioxidant compounds. We didn’t know they were that potent until now,” says Beninger, formerly a researcher with the USDA’s Sugarbeet and Bean Research Unit, located at Michigan State University in East Lansing, where he worked on the project under the leadership of co-author George L. Hosfield, Ph.D., a geneticist who recently retired from the USDA. Beninger acknowledges that some of the healthy antioxidants in beans will be lost in water upon cooking, but says that antioxidant levels will still remain high. Although dry beans were used
in this study, frozen or canned beans may have similar antioxidant activity, he adds. Americans gobble up an estimated 8 pounds of beans per person each year, with pinto beans and navy beans being the most popular. Red beans also enjoy immense popularity, particularly during colder months, as a staple of chili. Although not as popular in the U.S. as other varieties, black beans are a main ingredient in many international dishes. Try using canned black beans in this recipe for Toots, a healthy, no-cook, chocolate treat. Each square contains 19 grams of protein, 2 grams of fiber and approximately 104 calories. Toots are the perfect little afternoon energizer and a great lunchbox snack.
TOOTS
No one will be the wiser that this sweet treat contains beans. Black beans provide this dessert with a deep chocolate color and a smooth texture similar to a fudge brownie. Pinto beans can be substituted for black beans, if desired. Makes 12 (2-inch) squares. 1 (15-ounce) can black beans, rinsed and drained 2/3 cup butter, melted 1 cup cocoa powder 1 cup powdered sugar 1 1/2 cups (1 package of 9 crackers) honey graham-cracker crumbs 1 teaspoon vanilla 1 cup chopped walnuts, toasted 1. Using a mixer or in the bowl of a food processor, puree beans with 1/3 cup of butter until smooth. Add remainder of butter, cocoa, powdered sugar, graham cracker crumbs and vanilla. Pulse 3 minutes until the mixture is thoroughly blended. Mix in 1/2 cup of nuts, reserving the rest to sprinkle on top. Mix until blended. 2. Line an 8-by-8-inch pan with parchment, plastic wrap or wax paper with the ends overlapping the sides. Spread the mixture evenly in the pan. Sprinkle on the remaining nuts. Place the overlapping pieces of the parchment or wax paper over the mixture. Refrigerate until chilled and firm, and cut into 2-inch squares. Wrap the individual pieces with plastic wrap and store in an airtight container.

New DVD Releases for Week of September 20, 2010 PICKS OF THE WEEK
“Modern Family: The Complete First Season” -- Winner of this year’s Emmy for Outstanding Comedy Series, “Modern Family” is one of the best comedies to debut in the 2009-2010 season. If you haven’t yet discovered it, this is the perfect opportunity to get up to speed. The show is shot in a mockumentary style (a la “The Office”) and centers around Jay Pritchett (Ed O’Neill from “Married With Children”), his uberhot and much-younger new Colombian
wife (Sophia Vergara), her son and Jay’s neurotic extended family. The episodes are consistently hilarious and heartwarming, and the ensemble cast does a brilliant job. “Community: The Complete First Season” -- I had pretty low expectations for this series, but after giving it the ol’ college try, I have to admit I’m hooked on this sitcom -- even more so than “Modern Family.” “Community” stars Joel McHale as Jeff Winger, an ex-lawyer who’s forced to attend a community college to get the credits needed to be reinstated to the bar. He hooks up with a crew of misfits and deeply disturbed people when he forms a fake study group in order to hit on a cute co-ed (Gillian Jacobs). Throughout the course of the school year, the gang find themselves embroiled High Weirdness; from sinister chicken fingers to paintball battles and Great Debates. What’s surprising about “Community” is that each episode is funnier than the previous one. I don’t know how they do it. It’s positively brilliant television.
DOG OF THE WEEK
“Robin Hood: The Unrated Director’s Cut” -- I truly hope that “Unrated Director’s Cut” means
“This Version Doesn’t Suck -- Unlike The One You Saw In The Theater.” Goodness gracious what a bloated sad mess that was -- and I’m not just referring to Russell Crowe. You would think that after nearly 75 years, Hollywood would realize there’s no way to outshine the classic Errol Flynn/Olivia DeHavilland epic. But no. Every decade someone gets the bright idea of adding a new spin or twist to the legend and fails miserably. This time it’s director Ridley Scott falling on his face with this dour, overly self-important origin story of how Robin Longstride transforms himself into the mythic hero of Sherwood Forest. Gone are the Merry Men. Gone is any sense of swashbuckling fun and adventure. Instead, we get boring speeches about the rights of common men, convoluted political machinations, and after two hours of this drudgery, we’re rewarded with a battle scene that’s a pale rip-off of “Braveheart.” If you’re in the mood for a good Robin Hood movie that isn’t the Errol Flynn version, but is still a pretty good flick, I recommend 1976’s “Robin and Marian” starring Sean Connery as
16
Robin, Audrey Hepburn as Maid Marian and Robert Shaw as the Sheriff of Nottingham. It’s much more faithful to the 14th and 15th century tales than most Robin Hood films, has marvelous performances and is filled with good humor and bittersweet romance.
TV SERIES “Spartacus: Blood and Sand” The Complete First Season “30 Rock” Season Four “Hell’s Kitchen” Season 3 Raw & Uncensored “Desperate Housewives” The Complete Sixth Season “Castle” The Complete Second Season “How I Met Your Mother” Season Five “Two and a Half Men” The Complete Seventh Season “The Mentalist” The Complete Second Season “Law & Order: Special Victims Unit” Season Eleven “Bored to Death” The Complete First Season “Mythbusters” Collection 6 (c) 2010 King Features Synd., Inc.

BORN THIS WEEK: You have a penchant for persuasion that would make you a fine candidate for a political career.

MVEA has a new look!
ow that fall is officially here, change is everywhere. The days are shorter and cooler and, in many places, the trees are bursting with color. In preparation for the long winter, squirrels gather nuts and put many of them together in one place. If you’re nearing retirement, you might be able to learn something from our furry friends, as you, too, may want to consolidate some of your assets — in particular, your retirement accounts — as you prepare for a new season in your life. You might be surprised at the number of retirement accounts you’ve accumulated over time. For example, you may have 401(k) plans with a few employers, along with IRAs that you’ve established with different financial services companies. If you were to consolidate all these accounts with just one provider, you might find several key advantages. Possibly the biggest benefit of consolidating your accounts is that it may make it easier for you to track and manage your retirement assets. Once you retire, you could choose to do any number of things: travel the world, pursue your hobbies, volunteer or even open a small business or do some consulting. But whichever retirement lifestyle you choose to follow, you will need to know how much you can afford to withdraw each year, how you can stay ahead of inflation and how best to control your investmentrelated taxes. You may find it easier to accomplish these things if you have a single, unified investment strategy — and it may be easier to develop such a strategy if you have all your retirement accounts at one place, possibly under the guidance of a single financial advisor.
You’ll also find some other benefits to consolidating your retirement accounts: Less fees — You may be paying fees to several different providers for maintaining your retirement accounts. You might be able to reduce these fees by consolidating your accounts with one provider. Less trouble calculating distributions — Once you reach 70½, you’ll need to take withdrawals, or distributions, from your 401(k) and your traditional IRA. (This requirement does not apply to a Roth IRA.) It’s not that hard to calculate these required minimum distributions from a single IRA or a single 401(k), but if you have a mix of these accounts at different places, you might have to do a lot of number crunching. If all your accounts were held at the same place, you may have an easier time. Less chance of forgetting assets — You may find it hard to believe, but plenty of people lose track of their 401(k)s, IRAs and other retirement accounts. In fact, the National Registry of Unclaimed Retirement Benefits lists more than 50,000 individuals who are owed benefits from 401(k)s, profit-sharing plans or IRAs and either can’t be reached or don’t respond to inquiries. But if you hold all your retirement accounts in one place, you may be less likely to “misplaceâ€? them than if you kept them in several different financial institutions. Just as summer turns to autumn and autumn turns to winter, the seasons of your life follow one another in seemingly rapid succession. So when you enter your retirement season, make sure you’re prepared — and one way to help that preparation is to consider consolidating your retirement accounts. THE LAW ACCORDING TO STEVENS by Lisa Welch Stevens, Attorney at Law P.C.
HOW CAN JUDGE JUDY DO THAT? PRIVATE TRIALS © August, 2010, Lisa Welch Stevens, Esq.
I
have a guilty secret – when I am home sick or on vacation on a weekday, I love to watch Judge Judy’s television show. Trashy, I know, but I get a vicarious thrill out of watching her rip into idiots in ways that one never can in a real courtroom – at least when one is an attorney, and not a judge. Recently, one of my children (an adult), asked me how Judge Judy (or other judges on television such as Judge Joe Brown) can hear and issue binding orders in actual legal cases. I realized that non-attorneys probably don’t know that “private trials” are available to parties who do not wish to use the public legal system. These shows televise what are “private trials”. The option to seek to have a “private trial” to settle

one’s disputes usually is available only with respect to “civil trials”; i.e., tort or contractual disputes, and not criminal, probate or domestic cases. Parties may elect a private trial in order to avoid publicity or to go to trial more quickly. It is a fact that our public courts are overwhelmed with cases. Because priority is given to criminal cases (for constitutional reasons), and then to domestic cases, a civil case can often take anywhere from 1-3 years to actually go to trial. And, of course, all pleadings and proceedings are public. Parties may contractually agree to submit their dispute to an arbitrator for binding arbitration, or to a retired judge for a private trial. They may, in this context, agree to abide by the rules of an arbitration association, such as the American Arbitration Association, or the regular Rules of Civil Procedure and Rules of Evidence of their state, in presenting and having their cases decided. Of course, they must pay for the costs of doing so, which can be substantial; other than filing fees, the public court system is essentially free (if you ignore the fact of your taxes having paid for it). But, essentially, no one is required to use the public court system for civil disputes. When people agree to participate on a television show such as Judge Judy, they are agreeing to a private trial or arbitration, without having to pay

for the costs of doing so – the cost is simply a production cost of the show. The participants sign a contract with the show’s producers, agreeing to permit Judge Judy to decide their dispute, agreeing to the rules that will be followed, and agreeing to abide by the result, which is binding upon them. The Judge Judy show, according to the fine print at the bottom of the screen, uses the rules of the American Arbitration Association so, technically, the “trials’ are in fact binding arbitrations. The show also applies the substantive law of the state in which the case was originally filed. For example, if your agreement meets the requirements of a contract under the laws of Colorado, where it was signed and performed, then she will rule that it is a binding contract. While I, personally, would never want to air my dirty laundry on national television, the show does provide the opportunity to have a private trial to those who might not otherwise be able to afford it. And it is certainly a hoot to hear Judge Judy tear into some of the not so reasonable people who participate! For additional information contact, Lisa Welch Stevens, Attorney at Law P.C.
