SNIPPETZ HONORS THE GREATER GOOD - AND THE GIVERS by Deborah Stumpf
“Is the rich world aware of how four billion of the six billion live? If we were aware, we would want to help out, we’d want to get involved.” - Bill Gates
ISSUE 472 • NOVEMBER 15, 2010
N
ovember is the traditional month to celebrate National Philanthropy Day in cities and states across America. Different dates are set aside to pay tribute to the philanthropic community, to those who have donated for the betterment of lives, communities and the world. The U.S. gives more philanthropically than any other country in the world, with an annual contribution of about $300 billion. Americans gave more than $307 billion to charitable organizations in 2009, despite a gloomy economy. However, total giving was down 3.6 percent – the biggest decline since the American Association of Fundraising Counsel began reporting statistics on giving in 1956. Still, the following stories provide evidence that the spirit of giving is alive and well.

fined as the desire to benefit humanity; to improve the material, social and spiritual welfare of humanity … through charitable activities. Kids from coast to coast are involved in humanitarian and environmental causes.
YOU DON’T HAVE TO BE RICH The Secret Society for Creative Philosophy started in 2006 in New York City when Courtney Martin, after receiving a windfall advance for a book she was writing, gave 10 friends $100 each. She then asked them to give the $100 away in a creative manner. Afterward, they would all meet at a bar and discuss the results of the $100 give-a-way over a few beers. The stories of giving fueled a fire.
Each year, Kohl’s Department Store recognizes 200 young people nationwide who have given back to their communities. Thousands are nominated, and the winners are presented with a $1,000 scholarship toward post-secondary education. Here are some examples of young philanthropists – a few of the winners of Kohl’s 2009 scholarships. • David, 18, volunteered to teach math and science and technology programs to young students. • Philip, 17, raised more than $45,000 for care packages to veterans. • Julia, 10, sold homemade pins to raise more than $2,700 for autism research. • Tony, 12, created a charity that fixes old bikes, and after they’re repaired, they’re given to children in need. • Reid, 13, raised more than $100,000 for brain tumor research through bike rides and lemonade stands. Reid also had surgery for a brain tumor. • Kathryn, 17, collected more than 50,000 books for schools serving at-risk children. • Jake, 7, raised donations during the holidays to adopt a family in need to provide them with food, toys and clothing. • Sydney, 11, raised almost $50,000 for research for a rare cell disease (that she was diagnosed with) selling homemade jewelry. • Eamonn, 10, began a recycling program at his elementary school. When these kids are in their middle years
The following year, Martin’s friends gave $100 to their friends to creatively dish out, and the idea just kept on giving. Once a year, members of the Secret Society convene in cities throughout the country to relay their stories about how they dispersed their $100 each. New York, Seattle, San Francisco and Athens, Ga., all have formal chapters of the society. To be a member of the society, one has to be gifted by a special Creative Philanthropy agent, known as the CP agent. The San Francisco Chronicle published a story about the $100 give-away there. David Ibnale decided to give free umbrellas to people in a rainstorm, but they thought there was something “fishy” about his offer. “What’s the catch” was a common response. All total, he asked 27 people who were soaking wet if they would like an umbrella – 17 said no. Brett Lockspeiser took $100 in dollar bills to a mission in San Francisco and held up a sign that read, “I will give you $1 for you to give to someone else.” People thought he was trying to scam them. He could only give away $52, and one person who suspected that Lockspeiser was poor gave him a pair of socks. Some of those who took dollar bills gave them to street musicians.
in 2050, it’s estimated that $41 trillion will have transferred from one generation to the next, with gifts to nonprofit organizations projected at more than $6 trillion.
LEAVING A LEGACY Warren Buffet and Bill and Melinda Gates are throwing down the gauntlet to their peers of wealth in the name of philanthropy, setting unprecedented standards for giving back. Gates and Buffet have launched the Giving Pledge, a movement encouraging the wealthiest Americans to give it up for charity. The two ultra-wealthy, mega-successful and well-known philanthropists have been recruiting from the Forbes 400 list of America’s richest of the rich. Media mogul Ted Turner, Domino’s Pizza founder Thomas Monaghan, New York City mayor Michael Bloomberg and Barron Hilton, son of hotel icon Conrad Hilton, are among those who have formally signed the pledge. Significant, to say the least: Those who’ve jumped on board have promised to give away at least 50 percent of their net worth to charity during their lifetime or at death. Some have pledged more than 50 percent. Oracle’s founder Larry Ellison pledged 95 percent of his wealth. The 2009 net worth of the Forbes 400 was about $1.2 trillion. If all of them were to give 50 percent of their net worth to charity, it would amount to $600 billion.

Mollie Ricker spent $100 on a tip to a friendly cabdriver. Christina Zanfagna used her $100 to buy drinks for strangers in a restaurant. Jeremy Mende took his money to Union Square in San Francisco and offered a pair of strangers $1 each to have a one-on-one conversation. From the Chronicle story, some of the conversations were quite bold. Another woman used $100 to buy 400 quarters. She then scattered them on an elementary school playground before recess. What a surprise for the kids.

Those who’ve pledged choose their charitable organization under a common philosophy, according to Fortune: A life of monetary excess can be an empty life, if the wealth does nothing to advance a greater cause. As of August, 40 families have become part of the Giving Pledge – and many others have met with Buffet and Gates to discuss the possibilities.
STAR PHILANTHROPISTS Other big money makers in the U.S. like movie stars, musicians and athletes have doled out millions to advance their causes. Celebrities have a lot of clout in a starstruck country like the U.S. It’s a reason why the likes of George Clooney and Sean Penn were able to present their concerns about world strife before Congress. Some even give from the grave. The deceased king of late-night television, Johnny Carson, is still giving millions of dollars in securities and royalty rights from the John W. Carson Trust. The John W. Carson Foundation received $35.2 million in cash and $121.2 million during the fiscal year ending last June. Angelina Jolie and Brad Pitt give time and money to help people worldwide. Jolie is a goodwill ambassador for the United Nations. Together, Pitt and Jolie have established the Jolie-Pitt Foundation in support of human rights and environmental issues. Pitt has an avid interest in architecture, which led him to help families in New Orleans affected by Hurricane Katrina. Pitt committed at least $5 million to build environmentally friendly, sustainable structures in New Orleans – and he was active in the process of rebuilding. U2’s Bono has been nominated three times for the Nobel Peace Prize. Bono has been on the Forbes Generous Celebrity list for his work involving AIDS and debt relief in Africa. He has been involved in numerous causes, from racism to poverty to hunger. He was knighted in 2007.

• In 1666, the Great Fire of London destroyed 13,200 homes, 87 parish churches and St. Paul’s Cathedral, and it left some 70,000 people homeless. It also provided the impetus for the beginning of the insurance industry. After the conflagration, Nicholas Barbon, a well-to-do doctor, realized how much of his wealth was flammable. A year after the Great Fire, he began the world’s first insurance company.

TAI YICREATING SIN?
W
hen ones look back on their lives they may see missed opportunities. They may see missed opportunities regarding relationships with other adults or their children. They may see missed opportunities in working towards a new career, advancement in career, healing a particular issue, or perhaps moving in a completely different direction within one’s life pathway. Perhaps at the age of 21, an opportunity was presented to create a life with creativity and enjoyment, but rather than taking the opportunity, the person stayed within tradition-a safety zone, and missed the opportunity. If an opportunity is presented, why would someone miss it? He or she may miss it because there may have been negative feedback at the time. Perhaps the person heard, “Why would you do that?” or “That is a silly idea! Follow what we told you to follow.” Those types of statements, when accepted, can lead a person to make a choice that was NOT in the best interest, but a choice that was ‘safe’. Some people ask themselves the question: is this it? If one is asking that question, an opportunity has been missed.
The ancient Greek definition of SIN has nothing to do with religion. It means ‘missing the mark’. More specifically, it means moving away from one’s pathway. How many people have chosen to avoid creating something different because family may not have approved of that particular pathway, it seemed too daunting, the unknown created fear, or the expectations were that the person needed to follow family tradition? So therefore, that person missed the mark and created SIN? The result or outcome of creating SIN is lack of enjoyment and passion for life. One might feel he or she was ‘supposed’ to do something different with his or her life and feel unfulfilled in the current situation.

For one to heal the SIN, one must see what was missed in the first place and then re-create the missed opportunity. A Tai Yi treatment that addresses this is called Sin of I. Sin of I assists ones to be aware of what they have missed. It also increases energy in the spine and brings attention to what they have missed and are attempting to create and heal. This exercise does increase the flow of energy in the spine, which also assists the immune system. What did the person miss? What was the SIN?

here you are at the DMV. It’s crowded to say the least, and those numbers on the projector just won’t tick down any faster. You’re standing, leaning against a pole, and people are squeezing by you. Every once and a while a seat clears up, and you think about going for it. But sure enough there’s some 16 year old who jumps and snags it before you even finish the thought. The sweat is creeping down your left cheek, and as it hits your lips, you can taste the salty perspiration. It’s driving you nuts. You decide, it’s time to move. You start sifting through the crowd, your eyes peeled for pockets in the saturated human tangle. Then, there it is, the perfect spot. Everyone surrounding is well dressed, and probably smell just fine. There’s a young lady who seems absolutely delightful, and a business man. A quick check, to see that no ones on the phone, and you make your move. As you walk to the impeccable location, the lights go out. The crowd lets out a heavy dose of panic, and suddenly, everything is out of control. The lights flicker, and there’s people screaming all around. Then, there is peace. The lights resume, and the room is staring to the corner of the room. It’s the pole, the one you were leaning on earlier. The lights had an electrical error, and everyone touching the pole was burnt to a coffin-crisp. Good thing you moved…
IN A DARK ROOM It’s important where you stand. In the postseason, both The Rangers and Bears find themselves in an unfortunate situation. After losing the final two games of the season, the Bears snuck in the back door, and claimed the #16 seed in the playoffs; the last spot. In order to find their way to the State Championship, they’ll have to beat some of the best teams in the state, including the #1 seed in the state, Elizabeth. They’ll rely on their leader in both passing and rushing yards this season, Hunter Warwick, as well as sacks leader Colin Babcock (4) to put pressure on the opposing team.

closer, and lost what could have been a great spot. Instead, with an 8-2 record, they have the #10 seed. Lewis-Palmer is more than capable of overcoming their low ranking, and driving through the playoffs with high scoring affairs, but they’ll have to regroup. Colton Goeas completed his great season, racking up over 1200 rushing yards. If he can continue this momentum, and if Ben Shaum can manage the game and stay mistake-free, there’s no reason the Rangers can’t find themselves in the final four.

Both teams are in the dark concerning their future; for either team to find themselves playing for the Championship, they’ll have to move swiftly from where they stand, and find a better spot. If they don’t act quickly, they might just get burnt.

As fall sports reach their conclusion, winter sports take shape. The Rangers return to 5A Ice Hockey to defend their 2009 State Championship title. The Ice Hockey team is one of the only joint teams left, where students from both Lewis-Palmer and Palmer Ridge play together. Despite the newly-formed rivalry between the schools, the fusion of student athletes seems to work. The Boys’ Ice Hockey team may be the most exciting and promising teams in all of local high school sports. Look for them to take it to the ice, and not slip up. You catch the team’s first scrimmage of the year on Friday, November 26th, at Cheyenne Mountain.

MOMENTS IN TIME THE HISTORY CHANNEL
• On Nov. 19, 1863, President Abraham Lincoln delivers one of the most famous speeches in American history at the dedication of the military cemetery at Gettysburg, Pa. Using just 272 words, Lincoln brilliantly and movingly articulated the meaning of the conflict for a war-weary public. His address lasted just two minutes. • On Nov. 18, 1883, American and Canadian railroads begin using four continental time zones to end the confusion of dealing with thousands of local times. However, it was not until 1918 that Congress officially adopted the railroad time zones and put them under the supervision of the Interstate Commerce Commission. • On Nov. 21, 1927, Time magazine puts the Holland Tunnel on its cover. The tunnel, which runs under the Hudson River between New York City and Jersey City, N.J., had opened to traffic the week before, at the stroke of midnight on Nov. 13. The toll was 50 cents per car in both directions.
• On Nov. 16, 1945, the United States ships 88 German scientists to America to assist the nation in its production of rocket technology. Most of these “volunteers” had served under the Nazi regime. The voluntary nature of the scheme was somewhat undercut by the admission that the scientists were in “protective custody.” • On Nov. 20, 1955, Bo Diddley introduced himself and his namesake beat to the world with his television debut on “The Ed Sullivan Show.” Sullivan was so furious with Diddley for not opening with Tennessee Ernie Ford’s “Sixteen Tons” that Sullivan banned him from future appearances on his show. • On Nov. 15, 1965, at the Bonneville Salt Flats in Utah, 28-year-old Californian Craig Breedlove sets a new land-speed record -- 600.601 mph. His car, the Spirit of America, cost $250,000 and was powered by a surplus engine from a Navy jet. • On Nov. 17, 1973, in the midst of the Watergate scandal that eventually ended his presidency, President Richard Nixon tells a group of newspaper editors that he is “not a crook.” After a relentless federal investigation, Nixon resigned in August 1974. HEREAS it is the duty of all nations to acknowledge the providence of Almighty God, to obey His will, to be grateful for His benefits, and humbly to implore His protection and favour; and
Whereas both Houses of Congress have, by their joint committee, requested me “to recommend to the people of the United States a DAY OF PUBLICK THANSGIVING and PRAYER, to be observed by acknowledging with grateful hearts the many and signal favors of Almighty God, especially by affording them an opportunity peaceably to establish a form of government for their safety and happiness:” NOW THEREFORE, I do recommend and assign THURSDAY, the TWENTY-SIXTH DAY of NOVEMBER next, to be devoted by the people of these States to the service of that great and glorious Being who is the beneficent author of all the good that was, that is, or that will be; that we may then all unite in rendering unto Him our sincere and humble thanks for His kind care and protection of the people of this country previous to their becoming a nation; for the signal and manifold mercies and the favorable interpositions of His providence in the course and conclusion of the late war; for the great degree of tranquility, union, and plenty which we have since enjoyed; -- for the peaceable and rational manner in which we have been enable to establish Constitutions of government for our safety and happiness, and particularly the national one now lately instituted; -- for the civil and religious liberty with which we are blessed, and the means we have of acquiring and diffusing useful knowledge; -- and, in general, for all the great and various favours which He has been pleased to confer upon us. And also, that we may then unite in most humbly offering our prayers and supplications to the great Lord and Ruler of Nations and beseech Him to pardon our national and other transgressions; -- to enable us all, whether in publick or private stations, to perform our several and relative duties properly and punctually; to render our National Government a blessing to all the people by constantly being a Government of wise, just, and constitutional laws, discreetly and faithfully executed and obeyed; to protect and guide all sovereigns and nations (especially such as have shewn kindness unto us); and to bless them with good governments, peace, and concord; to promote the knowledge and practice of true religion and virtue, and the increase of science among them and us; and, generally to grant unto all mankind such a degree of temporal prosperity as he alone knows to be best. GIVEN under my hand, at the city of New-York, the third day of October, in the year of our Lord, one thousand seven hundred and eighty-nine. (signed)

Many of us already live close to the edge. With the cost of everything going up -- food, gas, utilities, clothing, medical (and never mind having any fun by going out to a movie or the occasional dinner) -- we’re going to be squeezed tighter than ever. Many of my friends are getting angry and making plans on how to survive with less. That’s my stance on it, too: Figuring out how to make it work.

o one likes to be underappreciated. It feels like you’ve been given a lack of credit; not been paid your dues. What can be worse is to under appreciate someone or something. Like not thanking your mother for Thanksgiving dinner (which is hard to screw up because ‘thank’ is right in the dinner title), or taking our freedom for granted. As human beings, we overlook a lot of exciting privileges we have everyday. Bowling is one of them. Yes, that does sound ridiculous, but think about it. In the last 12 month, over 66 million people have bowled. There are 2,521,617 certified league bowlers in the United States. These are staggering stats. And it’s simple. People love to bowl. Unfortunately, bowling has a stigma of not being cool. I suppose it makes some sense. In other sports and activities, the people representing it are iconic celebrities. Professional Bowlers are not exactly NBA players, they don’t usually date supermodels, and they wear those shirts. The only true celebrity who sports the “bowling shirt” is Charlie Sheen, and after his recent debacle, it’s unlikely the shirt will grow in popularity. But aside from a lack of pop culture representation, Bowling is one of the most popular sports in America. It’s a sport everyone can play, and everyone can improve on. It’s a sport on the rise. CASSEROLE COMFORT L
ast weekend, my family discussed our plans for Thanksgiving. Since dinner is at my house this year, I’ll handle the turkey and the dressing. My sister, Marcia, was asked to bring her fabulous sweet potato casserole. I started thinking about all the casseroles dishes that will be traveling from one place to another for Thanksgiving. While researching the topic, I discovered a photo of an ancient casserole dish in a museum in Athens. Casseroles, both the dish and various recipes, have a long and interesting culinary history. There’s some debate about the origin of the term “casserole,” but most culinary historians think that it’s from the French word for “saucepan.” Casseroles come in a variety of styles, but what they all have in common is a large, deep dish used both in the oven and as a serving vessel. The word casserole also is used for the food cooked and served in the dish. The Oxford Encyclopedia of Food and Drink in America provides detailed information about casseroles: “Casserole cookery has been around since prehistoric times, when it was discovered that cooking food slowly in a tightly covered clay vessel softened fibrous meats and blended succulent juices. ... With the addition or subtractions of leftovers or inexpensive cuts of meat, the casserole is flexible and economical in terms of both ingredients and effort. The classic casserole, a French dish, was originally made with a mound of cooked rice. Fannie Meritt Farmer’s Boston Cooking School Cook Book (1896) had one casserole recipe, for Casserole of Rice and Meat, to be steamed for 45 minutes and served with tomato sauce. In the 20th century, casseroles took on a distinctive American identity. During the depression of the 1890s, the economic casserole provided a welcome way to stretch meat, fish and poultry. Certain items also were scarce during World War I, and leftovers were turned into casserole meals.”

1. Preheat oven to 400 F. 2. Combine sweet potatoes, 2 tablespoons butter, orange juice and zest, salt, nutmeg, ginger and marshmallow creme. Beat in the egg and vanilla. 3. Coat a baking dish with remaining 1 tablespoon of butter. Scoop sweet potatoes into the baking dish. 4. In a small bowl, combine pecans, brown sugar, flour and butter, mixing until crumbly. Sprinkle the mixture over the sweet potatoes. Bake potatoes for 25 to 30 minutes until the topping is bubbly. Serves 6.
Modern casseroles, as we know them today, became popular during the Great Depression of the 1930s. Typically, casseroles are composed of a meat, starch, creamy sauce (after 1934, it was usually a creamed soup from a can) and a vegetable. Casseroles are an economical, one-pot meal during hard times. Starting in the 1950s, casseroles became an easy way for a busy cook to prepare the family meal ahead of time. Today, casseroles have been updated to include a variety of ingredients from lobster and tofu to made-from-scratch sauces and locally grown vegetables. The shape, size and construction materials of casserole dishes also has changed over the centuries. However, the purpose of the casserole is still the same: to bring a familiar container of comfort food to the ones we love. Bring a little comfort to your family and friends in the form of this delicious sweet potato casserole that was inspired by my sister, Marcy.

The possibility of a double-dip recession makes great headlines. But such events have been rare. In fact, we’ve seen only one double-dip recession in the past 77 years. However, this history hasn’t stopped gloomy forecasters from predicting a double-dip in 1991 (it didn’t happen) and in 2003 (when it didn’t happen again).

ears of a “double-dip recession are in the air. Obviously, this isn’t particularly good news; we’d all like to feel that the economy is growing robustly. At the same time, however, you’ll want to avoid making hasty, illadvised investment decisions based on the mere threat of a slide into another recession. Instead, you’ll want to keep your long-term investment plan intact — in all economic environments.

Will we again avoid the double-dip recession this time? It’s dangerous to make predictions, but it seems more likely that what we’re really experiencing is a “soft patch in the economic recovery as retail sales remain weak, consumer confidence is low and unemployment remains high. But on the positive side, manufacturing activity has been strong, corporate earnings have rebounded to pre-recession levels and profit margins are near all-time highs. And yet, many investors are focusing strictly on the negative reports — and they’re acting on their fears by moving money from stocks to fixed-income vehicles, such as bonds. During the period from July 2008 through June 2010, investors pulled more than $200 billion out of stock-based mutual funds and put more than $475 billion into bond funds,

according to the Investment Company Institute. Bonds can provide a source of regular income and will return your principal when they mature, providing the issuers don’t default. They’re an important part of most investors’ portfolios. But if you’re joining the crowd and over-concentrating on bonds, you risk losing the following: Growth opportunities —. According to Ibbotson, a leading investment research organization, stocks have done particularly well following 10-year periods in which the stock market hasn’t performed strongly — and the past 10 years were one of the worst periods we’ve ever seen for stocks. And right now, many quality stocks are trading at some of the most attractive values in 15 years, as measured by price-to-earnings ratio, or P/E. Portfolio balance — Ideally, you want your portfolio to contain a mix of investments — stocks, bonds, international and cash — designed to reflect your risk tolerance, time horizon and long-term goals. You’ll need to adjust your investment mix over time to reflect changes in your life, and regular portfolio reviews will prompt you to rebalance back to your target mix and determine whether any other changes are needed. But if you’re constantly disrupting your portfolio’s balance by reacting to shortterm events, you’ll have a much harder time achieving your objectives. In virtually all areas of life, balance is essential — and that’s certainly true in regard to your investments. A “double-dip recession might sound scary, but it may well never come to pass — so don’t let the mere prospect throw you off your investment strategy. Good investment opportunities are out there — so dip into them. Past performance is no guarantee of future results. Before investing in stocks, you should understand the risks. Stocks are subject to market risks, including loss of principal invested. This article was written by Edward Jones for use by your local Edward Jones Financial Advisor. HOW CAN A CORPORATION BE A PERSON, OR HAVE CONSTITUTIONAL RIGHTS?
I
n January of this year the Supreme Court issued a ruling that outraged many “people” (“natural” persons, which I will get to in a minute). That ruling had a huge effect on the recently concluded mid-term election campaigns. The Court ruled that corporations (and other limited liability entities such as LLCs) are persons under the law and, as such, have a constitutional right to freedom of speech, including funding free speech activities such as political ads. From the reactions of many, it was clear that the general public believed that this was based on a new rule of “law”: that corporations are persons. In fact that basic premise, that corporations are “persons” under the law, is rooted in literally hundreds of years of Anglo-American common law, as well as statutory law in most of the world. Corporations legally ARE “persons”; however, they are not “natural persons”. A natural person is a living, breathing human being (this is in part why, traditionally, unborn human beings are not legally considered to be “persons” under the law). Without the premise that corporations and other limited liability entities are legally persons, we could not have limited liability entities. The reason why the owners of a corporation are not personally liable for the debts and other liabilities of the corporation is that, legally, the corporation is a separate person. And in this country, at least in modern times, we do not hold one person liable for the acts, omissions, debts or other liabilities of another person. So long as the owners of the corporation treat the corporation as a separate, independent legal person, the courts will respect this legal fiction. If you review the United States Constitution, you will

lisa@lwslawfirm.com • www.lwslawfirm.com see that the founding fathers, throughout the document, made a distinction between “natural persons” or “the people” and “persons” in general. They were very aware of the common law that entities are legally persons – they just are not living breathing human beings. So for example the Fifth Amendment to the Constitution states that: “nor shall any person be deprived of life, liberty, or property, without due process of law”; due process of law is thus accorded to both natural persons and non-natural persons. By contrast, the Second Amendment states: “the right of the people to keep and bear Arms shall not be infringed”; this right is extended only to natural persons. I have been asked, “If corporations are “persons”, do they then have the right to vote?”. The answer, of course, is no: corporations are not citizens, and cannot be citizens. Only “natural persons” can be citizens. For example, the Fourteenth Amendment to the Constitution states: “All persons born or naturalized in the United States . . . are citizens of the United States and of the State wherein they reside”; citizens must be living, breathing human beings, capable of being physically “born” or “naturalized” and capable of “residing” somewhere. In my opinion (admittedly, an unpopular one), the Supreme Court reached the proper decision under the law as it currently exists. Unless and until the Constitution is amended to specifically limit freedom of speech to “natural persons” or “the people” only, this will not change.

Limited liability entities make business possible, and enable the economy to function. Without limited liability, very few natural persons would be willing to risk personal liability for businesses. From a practical, business point of view, we “need” corporations to be persons under the law. Otherwise, every natural person who owns a share of stock in any corporation would be on the hook for that corporation’s debts.
