SNIPPETZ TAKES A TRIP TO
THE RED PLANET by Gregory Stumpf
ISSUE 474 • NOVEMBER 29, 2010
“Ladies and gentlemen, I have a grave announcement to make. Incredible as it may seem, strange beings who landed in New Jersey tonight are the vanguard of an invading army from Mars.” - Orson Welles, “The War of the World”
W
hen Orson Welles, American filmmaker, director, actor and screenwriter, performed the now famous radio adaptation of the H.G. Wells novel “War of the Worlds” in October 1938, many Americans believed Martians were attacking planet Earth. The reading was so real that it apparently caused widespread panic. Later reports have refuted the widespread panic rumor. Nonetheless, renewed fascination about the red planet was launched.
A COUPLE OF DAYS FOR CELEBRATING Here on the third rock from the sun, we celebrate Red Planet Day on Nov. 28, which also celebrates the launch of the Spacecraft Mariner 4 on that day in 1964. July 14 is also a big day for Mars because it’s the anniversary of the day the Mariner 4 was closest to the planet at 6,118 miles from its surface. Although there are no widely ac-

on Earth, and this time of year it’s the summer, or warmer season for the Martian southern hemisphere. During this time, the ice cap recedes due to the warmer surface temperatures. In our spring and early summer, the southern half of Mars turns colder and that ice cap will grow. If you have even a low power telescope, the polar ice caps are visible, but when to view our closest celestial neighbor (other than the moon) can be tricky.
WHY THE RED PLANET? Well, it’s really not red; it just looks red. Mars’ surface is comprised mainly of a fine iron oxide dust, the same iron oxide mineral that makes Red Rocks here in Colorado red. Scientists believe the iron in the soil and/or rocks turned rusty some time during Mars’ evolution – likely between the planet’s creation and subsequent floods that carved the famous deep crevices and channels. The moisture from the floods is what stimulated the rusting action that created the red layer and gives Mars the red color. The layer ranges in depth from a few millimeters to as deep as two meters. When the sun reflects off of the surface, it emits a light, mainly in the red/orange range, giving the planet its reddish hue. Hence, it’s famous name, The Red Planet.
At this time of year Mars is barely visible and especially later in the month it could be completely faded out by the evening glow, and too small due to its location; experts say that “backyard telescopes” will not be useful for viewing Mars this time of year. But there are other times during the year that Mars is not only visible with binoculars and/or a low power telescope; it is also visible with the naked eye. Mid to late August is coined the prime Mars viewing period, and thankfully so as the warmer weather makes the early evening to midnight window much easier to deal with.
WILL THERE BE BODY SEARCHES WHEN YOU GO THERE?
Mars also has more iron than Earth, a lot more. In fact, below the surface the planet is made up of a rock called basalt left by volcanic activity. Martian basalt has very high concentrations of iron that makes the iron oxide, which also makes the planet look red.
Man has been fascinated by Mars for centuries as far back as 1570 B.C when the Egyptians wondered about Mars and actually made it a god named “Hours of the Horizon.” But man has two primary desires about Mars: first is to fear any Martians who land and cause havoc and destruction about our planet, and second is to travel to Mars someday with the idea of colonizing, or just exploring. Lately, that discussion has taken a serious turn, even to the point that the government has funded a
IS THERE OR IS THERE NOT H2O? So what happened to all that water the scientists talk about? Scientists believe the water that ran on Mars’ surface perhaps millions of years ago has retreated below the surface and is now in a frozen state. For many years, and until advanced scientific exploration and technological advances in equipment, it was a commonly held belief that the polar ice caps were frozen water.

A manned mission to Mars would not only be a daunting task technologically but financially as well. The first hurtle would be the money. The cargo, including food, water and equipment, has been estimated at $1.5 million per pound. Which is why the second idea for a Mars trip was conceived – the one-way trip, with no return. A one-way trip with no return seems a bit unusual, but it’s not any different than the early Vikings or Columbus setting sail looking for the new world with the idea that there may be no return. Those in favor of a one-way trip cite the cost savings – the equipment and fuel needed to leave Mars for the return trip would not be necessary. The weight that would be eliminated could be used to ship food and water. Even trimming the return costs, the trip is estimated to cost around $10 billion. The one-way trip is currently being explored as a one-person trip, which could be defined as colonization – one small colony.

grant ($1.5 million) to explore the possibility of a trip to Mars. There are two scenarios for the first manned Mars mission. One would be the conventional “go there, snoop around, claim it for the United States and come back,” and the second would be a one-way mission, with no return.
Other than its red color, Mars has a few other distinctions that have captivated Earthlings for centuries, and one of them is the polar ice caps. Are they really ice or do they just look like ice? Well, they are actually composed of dry ice, the same variety that can be purchased at the grocery store that you might use to make your Halloween brew pot look smoky. Unfortunately, it’s not the same H2O that aids in sustaining life as we know it.

On Nov. 28 – just three weeks later – Mariner 4 was launched successfully on an eight-month journey to Mars. There were more Mariners launched through 1971.
AND THEN THE VIKING LANDED NASA’s Viking Project was the first mission to land a spacecraft safely on the surface of another planet. Two identical spacecraft, each consisting of a lander and an orbiter, were built. Each orbiter-lander pair flew together and entered Mars orbit; the landers then separated and descended to the planet’s surface. Viking 1 was launched Aug. 20, 1975 and arrived on Mars June 19, 1976. Viking 2 was launched Sept. 9, 1975 and arrived Aug. 7, 1976. It would be 17 years before there was another launch to Mars. The United States launched Mars Observer Sept. 25, 1992. The spacecraft was complete with science instruments designed to study the geology, geophysics and climate of Mars. However, on Aug. 22, 1993, the spacecraft lost contact before entering Mars’ orbit. Many Mars missions took place in the 90s. One of the most significant, however, was the Mars Global Surveyor, launched Nov. 7, 1996. This spacecraft operated more than four times as long as planned once it reached Mars on Sept. 12, 1997. The spacecraft returned detailed information that brought a new understanding about

ometimes people feel as if this place is not their home. Perhaps, a person, as a child, felt a sensation that kept doubt in place as to where that child may belong. How many children talk about feelings something that the parent/s cannot quite explain? How many children see something that the parent/s cannot quite explain? Many times, the parents will dismiss what the child is feeling or seeing out of fear or unknowingness of what occurred or is occurring. The result of the denial on the parents’ part is the child suppressing certain feelings that may not be seen as acceptable within the family unit. These children grow into adolescents who may then, again, try to express feelings that do not necessarily match the other family members’ feelings. He or she may try to express that this world feels different or odd. He or she may express that he or she does not understand why people engage in violent acts, why children are starving, or even why people are losing their homes. They may be told the logic and/or facts behind the violent acts, starving children, or ones losing their homes, but may not understand the reasoning on a deep level. It may not make sense enough for the adolescent to work with the information. Perhaps that adolescent ‘daydreams’ a lot or seems spacey and has ‘odd’ ideas according to the family.

adults who continue feeling odd with this world or that adolescent has suppressed the feelings out of wanting to be normal and accepted with peers and family. If one has suppressed the childhood/adolescent feeling of ‘this place isn’t home’, that adult may still feel a certain longing, but cannot explain it. That person may feel a sensation in the chest/heart chakra and not really be able to explain it articulately. If the adult continued to express those feelings, he or she will still have strong thoughts of ‘this place does not make sense’, but may not know what to do with it. He or she may seek out New Age books, websites, or individuals. However, many times those in the New Age field are recycling religion and may not be aware of it.

GREETINGS HUMAN, WELCOME TO THE FUTURE By Nick Yanez
Curb Appeal Exercise It is so difficult to be objective when looking at your own home. A pile of dirt or a broken shutter may have been there for so long that you don't even see them. In order to shift your thinking so that you can begin to look at your home objectively and make honest decisions about its true curb appeal you may want to try this fun exercise. 1) Choose a home in your neighborhood (not the best one, but not the worst one). 2) Then park across the street so that you have a good panoramic view of the house and yard. a) What is your first impression of the house and yard area? b) Where do your eyes so first….to something nice or something that's out of place? c) Make a mental note of as many things that you would fix or change if this was your home. (Don't write notes or take photos or you will most likely scare the homeowner!) d) Is there a dead tree, a cracked window, loose shingles, weeds growing through the drive
R
way, crooked house numbers, trash cans stored in front, too much yard art? e) Now picture that home without all the goofy broken and outof-place items, and with some upgrades you feel would help the look. Now THAT'S Curb Appeal! Now try it with your home....using the same mind-set. 1) Park where a potential buyer would and walk towards the house, looking around you as if it were your first visit. a) Is the approach clean and tidy? b) What could you do to make it more attractive? 2) Make a list of the problem areas you discovered. Tackle clean up and repair chores first, then put some time into projects that make the grounds more attractive. a) Move trash can where it's not visible from the front of your home. b) Clean windows and gutters. c) Edge sidewalks and remove vegetation growing between concrete or bricks. d) Trim tree limbs that are near or touching the home's roof. e) Paint the shutters.
emember those old movies that depicted the future? Those were the best. How people had flying cars and laser guns. They had houses in the sky and robotic butlers, waiting at their every demand. Of course, none of these illustrations turned out to be true. Sure, the Flying car has made some progress, but it’s far from being accessible to the average American. Most robotic servants turn into machine soldiers, and somehow organize to conquer the Earth. In some cases, it’s good that the future created by 1960’s Hollywood did not come true. However, the future is here; it comes in the form of bowling - Laser Bowling. Laser Bowling is just what the future needed. And now that the future is
the present, open it up; you’ll like what’s inside. The gift of current existence is ecstasy in nighttime entertainment. With lasers (I know, right!), disco balls, black lights, and blasting music, laser bowling is a little vintage, and very futuristic. Heck, if robot servants did exist, this is how they would bowl! Pinz Bowling Center (Located at 855 Hwy 105) is the best spot to crush your craving for a light-tastic time on the lanes. The revelry begins at 9pm every Friday and Saturday night. Now you have the time and a vivid description. But wait, there’s more! How about a great deal? Starting at 10pm, and available until closing at 2pm, customers need pay only $10 for 2 hours of bowling and shoes! I know, robots and flying cars can’t compare to Pinz night of fantastic future fun, right? Indubitably. For more information on Laser Bowling, or other futuristic events (like your holiday party) give Pinz a call at (719) 487-7469

MOMENTS IN TIME THE HISTORY CHANNEL
• On Nov. 30, 1886, the Folies Berg re in Paris introduces an elaborate revue featuring women in sensational costumes. The theater spared no expense, staging revues that featured as many as 40 sets. Among other long traditions, the show’s title always contains 13 letters and includes the word “Folie.” • On Dec. 5, 1933, the 21st Amendment to the U.S. Constitution is ratified, repealing the 18th Amendment and bringing an end to the national prohibition of alcohol. Mississippi, the last dry state in the Union, ended Prohibition in 1966. • On Dec. 4, 1945, in an overwhelming vote of 65 to 7, the U.S. Senate approves full U.S. participation in the United Nations. Some senators proposed a resolution designed to force the president to receive congressional consent before approving U.S. troops for any U.N. peacekeeping forces. The resolution was defeated. • On Dec. 1, 1955, in Montgomery, Ala., Rosa Parks is jailed for refusing to give up
her seat on a public bus to a white man, a violation of the city’s racial segregation laws. Parks’ refusal was not merely brought on by her tired feet, as is the popular legend. Local civil-rights leaders had been planning a challenge to Montgomery’s racist bus laws for several months. • On Dec. 3, 1967, 53-year-old Lewis Washkansky receives the first human heart transplant in Cape Town, South Africa. After surgery, he was given drugs to suppress his immune system and keep his body from rejecting the heart. He died 18 days later from double pneumonia. • On Dec. 2, 1972, the Temptations earn the last of their four chart-topping hits when “Papa Was a Rollin’ Stone” reaches No. 1 on the Billboard Hot 100. Earlier hits by producer-songwriter Smokey Robinson were “The Way You Do the Things You Do” (1964) and “My Girl” (1965). • On Nov. 29, 1981, actress Natalie Wood, who starred in such movies as “Rebel Without a Cause” and “West Side Story,” drowns in a boating accident near California’s Catalina Island. It was believed she somehow slipped overboard while untying a dinghy attached to the boat. (c) 2010 King Features Synd., Inc.

• Long before it was used as a “kiss encourager” during the Christmas season, mistletoe had long been considered to have magic powers by Celtic and Teutonic peoples. It was said to have the ability to heal wounds and increase fertility. Celts hung mistletoe in their homes in order to bring themselves good luck and ward off evil spirits. • Mistletoe, a traditional Christmas symbol, was once revered by the early Britons. It was so sacred that it had to be cut with a golden sickle.

stockings out at Christmas time. Their Dutch counterparts, however, use shoes. Dutch children set out shoes to receive gifts any time between mid-November and December 5, St. Nicholas’ birthday. • Christmas Day in the Ukraine can be celebrated on either December 25, in faithful alliance with the Roman Catholic Gregorian calendar, or on January 7, which is the Orthodox or Eastern Rite (Julian calendar), the church holy day. • According to historical accounts, the first Christmas in the Philippines was celebrated 200 years before Ferdinand Magellan discovered the country for the western world, likely between the years 1280 and 1320 AD. • Christmas is not widely celebrated in Scotland. Some historians believe that Christmas is downplayed in Scotland because of the influence of the Presbyterian Church (or Kirk), which considered Christmas a “Papist,” or Catholic event. As a result, Christmas in Scotland tends to be somber.

THE GRINCH IS LIKELY DEPRESSED, EXPERT SAYS
T
he Grinch, who lives atop Mt. Crumpet, is likely depressed, says University of North Carolina at Chapel Hill psychologist Cynthia Bulik, Ph.D.

“One of the things that happens with people who are depressed, and we see this especially with the Grinch, is that people don’t really want to be around him, and he doesn’t want to be around people,” Bulik says. “So, he’s not getting a lot of love.” And, she points out, depression can have physical manifestations. The Grinch is overweight, is badly in need of dental work and, Bulik says, “I think what we might be seeing

SANTA CLAUS IS COMING TO TOWN
“When people think about depression they often think about people being sad,” says Bulik, who has not officially treated the Grinch, but is very familiar with his story.
“Especially around the holidays you look around and everyone seems to be feeling the joy, but inside you’re just feeling dark and miserable,” Bulik says. “It’s that contrast between how you’re feeling inside and how all those happy people are feeling out there that can really be torture for someone who has depression.”

“Everybody’s always so down on the Grinch,” says Bulik. “But one of the things I’ve always asked myself is whether the Grinch himself might be feeling kind of down.
Being irritable, grumpy and seeking social isolation are also hallmarks of depression, and could explain the Grinch’s disdain for the Who -- the tall and the small -- his mistreatment of his dog Max and, ultimately, why he tried to stop Christmas from coming.

is that his heart might be shriveling from a lack of love.” The Grinch also might be suffering from seasonal affective disorder, which is associated with fewer hours of daylight, Bulik says. “There are a lot of people who get depressed as the days get shorter, and fall and winter arrive.” So, Bulik says, besides learning that Christmas doesn’t come from a store, we can learn from the Grinch that depression doesn’t always manifest as sadness. “If there’s someone in your life who is just really irritable and miserable, and just not getting any joy out of life, you have to wonder whether they might be being challenged by depression,” Bulik says. “Reach out and see if some of your friends who are not doing well could use some help.” (c) 2010 King Features Synd., Inc.

ibration therapy is said to address a number of ills: prevent varicose veins, break up cellulite, rev up the lymph system and reduce knee and leg pain. The big benefit, however, is that it’s possible for vibration therapy to address the problem of bone loss.
VIBRATION THERAPY FOR BONE LOSS
Here’s how vibration therapy is thought to work: The machine platform that one sits or stands on vibrates at 30-90 cycles per second, the same rate as muscles in the human body. The vibrations in essence mimic the body and do what the body isn’t doing anymore -- creating bone, in this case. The studies are numerous and come from all over the globe.

DELAY IN TREATMENT OF TIA IS DANGEROUS DEAR DR. DONOHUE: I’ve just hung up the phone after talking to my doctor. He has me scared out of my wits. This morning while reading the newspaper, I couldn’t hold it up. My right arm became weak. In about five minutes, everything returned to normal. I thought I had better call the doctor to see if this was serious.
The doctor thinks I had a ministroke and wants me to have someone take me to the hospital ASAP. I told him I was fine. He said that doesn’t matter. I thought I would drop you a line for your opinion. I trust your judgment. What should I do? -- T.R. ANSWER: I hope you listened to your doctor. You should do exactly what he told you. You have an emergency on your hands. You most likely had a TIA -- a transient ischemic attack -- a ministroke. Investigation should be taking place as soon as possible -- im-

Even a brief occurrence like the one you describe can cause permanent brain damage. Worse, it is often the foreboding of a complete stroke. You have to be checked for a blockage in one of your carotid arteries, the large neck arteries that deliver blood to the brain. You have to be examined for a clot in other body locations like the heart. Pieces of those clots can break loose and be carried to a brain artery, where they stop the flow of blood permanently. Atrial fibrillation, a common heartbeat disturbance, is often responsible for such clots.

woman is sitting at a coffee shop. She has a mocha and a bagel; plain, no cream cheese. The server, a man, waives the bill and gives her a wink. A man standing in the corner is minding his own business, sipping his beverage. A woman approaches. He tells a joke and she laughs, hitting him on the shoulder. A boy swinging on the set is ready to jump. He releases and eats it. A girl by the playground sees the boy and looks on. He stands up, brushes off and looks to her. She crosses her legs, clasps her hands, and giggles. These are all examples of flirting.
10 Things I Like About You (Lewis-Palmer) Lewis-Palmer was flirting with destiny this year. Back in 3A football, they were relevant again after years of struggle with tough power-house schools. The Rangers didn’t take their new position lightly, as they finished the season 8-2, beating new across-town-rival Palmer Ridge in the process. They claimed the 10th seed in the playoffs, and went on to pull a thrilling upset against 8th seeded Centaurus (8-2). The Rangers then had their biggest challenge of the year, taking on the number 2 ranked Glenwood Springs. They gave a valiant effort, but fell 21-42, ending their sea-

When giving as a gift, attach following baking instructions: Preheat oven to 350 F. Drop dough by rounded tablespoons, or using small cookie scoop, onto parchment-lined baking sheets, about 1 inch apart. Flatten dough slightly using back of spoon. Bake 10 to 12 minutes, until edges are lightly cracked but centers are still soft. Remove from oven and cool slightly on baking sheet beson. The flirting, though, will continue. The Rangers found a star in sophomore fullback Colton Goeas, who fell just 23-yards short of rushing for 1500 on the season. Coach Ramunno reestablished himself as the only coach for this team. There’s a lot to look forward to in the black and orange. Next year, they may forget about subtle approaches, they may just make their move.
When Our Heart Gets Broken, Get Over It, Or Get Even The Palmer Ridge Bears ended their football season as a last ranked playoff team. That means only one thing; they had to play the first ranked team, Elizabeth, who asserted themselves to a 35-7 victory. The Bears now have two options. The first, move on, football season is over, and they had a good year. The second, and more preferable option, is to return the favor. As one season ends, another begins. Basketball season will be in full swing next week, and guess who the Bears open their season against next Tuesday, December 7th? You got it, Elizabeth. It’s time to play ball boys. After the road opener, you can see the bears take on Air Academy at home on December 27th. Consider it a late Christmas present, from them to you. The new seasons are in full swing. Keep on the lookout for Basketball, Wrestling, Ice Hockey, and Swimming to consume your thoughts and reading material. You’ll be stunned with what the teens of our community can accomplish. It’s inspiring, commendable, and calming; and like a wink in a coffee shop, it’ll make you take notice. New DVD Releases for Week of November 29, 2010 PICKS OF THE WEEK “The Twilight Saga: Eclipse” (PG-13) -Part three of Stephenie Meyer’s sparkly vampire porn for tweens amps up the love triangle drama between poker-faced Bella (Kristen Stewart), dour vampire Edward (Robert Pattison) and constantly shirtless werewolf with a creepily shaped nose Jacob (Taylor Lautner). When the boys aren’t catfighting over who’s the better asexual freak for Bella, they join forces to battle the evil Victoria (Bryce Dallas Howard)
and her band of newborn vampires who are hellbent on destroying Bella. So, yes. I’m Team Vicki. The two-disc Special Edition contains audio commentary tracks from Pattison and Stewart, a photo gallery, music videos, a six-part making-of documentary, and a Edward or Jacob Fast-Forward feature that allows you to jump to all your favorite Edward or Jacob scenes. “Fantasia/Fantasia 2000” (Four-Disc Bluray/DVD Combo) (PG) -- Disney’s 1940 masterpiece combining classical music with animation and its 2000 sequel are finally getting a high-def release, promising the sharpest-ever visuals and sound. The bonus features are few, but noteworthy, particularly the inclusion of the 2003 short film “Destino,” the 50-years-in-themaking collaboration between Walt Disney and Salvador Dali.
“The Sorcerer’s Apprentice” (PG) -- It’s no coincidence that Disney re-released “Fantasia” on the same week as the home video release of the “The Sorcerer’s Apprentice.” Tenuously based on the most famous segment of the 1940 film featuring Mickey Mouse and the endless procession of animated brooms. In this live-action modernday fantasy tale, Jay Baruchel takes Mickey’s place as the titular apprentice, “Dave,” who must learn to find the magic within himself before an evil sorcerer (Alfred Molina) wreaks havoc upon our world. I didn’t have high expectations going in to this film, but for a children’s movie it’s actually pretty good. Not “Toy Story 3” good, but good enough. “Meet John Doe” -- 70th Anniversary Ultimate Collector’s Edition (NR) -- Gary Cooper and Barbara Stanwyck star in Frank Capra’s 1940 classic about an in-
16
jured former baseball player who sells out his integrity to pay for medical treatment by impersonating the fictional creation of a plucky newspaper columnist. In addition to the standard special features like audio commentary and making-of featurettes, is a rare radio dramatization of Hemingway’s “For Whom the Bell Tolls” starring Cooper and Ingrid Bergman. TV SERIES OUT THIS WEEK “Parks and Recreation” Season Two “Space: 1999” The Complete Season One “Lucy Show” Official Third Season “Sid and Marty Krofft’s Saturday Morning Hits” “Have Gun Will Travel” Season Five, Volume One “Touch of Frost” Season 15 (c) 2010 King Features Synd., Inc.

Whether or not you decide to get a flu shot depends on your individual situation, of course, but you may benefit from the idea of immunization in other areas of your life — such as your investments. Specifically, you may want to help “immunize your portfolio, as much as possible, against some of the volatility we’ve seen in the financial markets over the past couple of years. How can you do this? Here are a few suggestions:

Diversify, diversify, diversify. If you were to only own stocks, your portfolio would, at times, see some big gains — but at other times, you’d take some big hits. If you just owned bonds, you’d probably see fewer fluctuations than if you just owned stocks — but you’d almost certainly never get the gains you need to help achieve your goals. If you kept all your money in cash instruments, you’d protect your principal, but you’d eventually lose ground to inflation. In short, you can’t succeed as an investor by putting all your money in one type of asset. You need to spread your resources among stocks, bonds, and cash investments. And even within each of these categories, you need to diversify. For example, try to own a mixture of growth stocks and income-producing stocks; short-term and long-term bonds; and a
variety of cash instruments. While diversification, by itself, can’t guarantee profits or protect against loss, it can give you opportunities for potential success and help shield you from severe downturns that, at any given time, primarily affect just one asset class. Know your risk tolerance. If you frequently find yourself surprised, or perhaps dismayed, at the fluctuations in your portfolio, you may be overestimating your risk tolerance. If you familiarize yourself with your investments before you buy them — and you should — then you probably shouldn’t be surprised at how they perform. So, if you own growth-oriented stocks, you need to accept the inevitable short-term volatility in exchange for potential gains over the long term. But if you’re constantly worried over temporary setbacks, you may be taking on too much risk for your comfort level. If this happens, you may need to rebalance your portfolio to better accommodate your true risk tolerance. Maintain adequate cash reserves. Having sufficient cash in your portfolio can help you combat volatility in at least two ways. First, since cash essentially doesn’t fluctuate in price — though it may lose value over time, relative to inflation — its very presence can help stabilize your portfolio. And second, if you have enough cash in your investment mix, you may be less likely to dip into your long-term investments to pay for short-term needs, such as a major car repair, a new furnace and so on — and the less you disrupt your investments, the more progress you can make toward your goals. It’s not possible to fully shield your investments from volatility all the time. But by taking the steps described above, and by maintaining a long-term perspective, you can strengthen your portfolio’s resistance, and improve your own responses, to the effects of price fluctuations. And that’s a healthy way to invest. This article was written by Edward Jones for use by your local Edward Jones Financial Advisor. For additional information, contact:

YOUR BUSINESS IS IN A LAWSUIT: CAN YOU REPRESENT IT YOURSELF?
M
If your case is in the small claims division of county court, you absolutely may represent your business; in fact, plaintiffs in small claims are not permitted to be represented by attorneys unless and until the defendant elects to be represented by an attorney. The whole point of small claims is to be non-attorney friendly. If your case is in a regular (non-small claims) division of county court, or in a state district court, whether you may yourself represent your business depends upon what form of entity your business is orga-
P
olice and auditors have one thing in common: they make even the most honest, law-abiding citizens nervous. After all, who hasn’t felt their heart jump at the sound of a police siren close behind them even if they are obeying all traffic rules? Generally, the same feeling comes over people when the topic of an IRS audit arises. Most taxpayers fear an audit because they don’t know if they are adequately prepared. You may ask yourself: Did I save the right documentation? Are all my deductions legal? Can I answer all of the IRS’s questions? Following are some easy guidelines that can help lessen your vulnerability to an IRS audit. Obviously, every deduction claimed needs to be documented, but many taxpayers aren’t clear on what is adequate proof. The IRS does require more than just a few jottings in a notebook, but not much more. First, each deduction must be recorded with a copy of an invoice or bill. For example, if you are claiming your utilities expenses as a deduction, you need to keep a copy of each month’s bill. In addition to proving the expenses were incurred, you must also

ost businesses, if they are in business for any significant length of time, will end up involved in litigation at some time or another, either as a plaintiff or a defendant. This might be a simple collection matter (their business was not paid for goods or services received), or it might be a complex contractual dispute (you and your business partner want to “divorce”). Attorneys are expensive and you, as the owner of the business, might be tempted to save money and represent your business yourself. Aside from the issue of whether you have the time, knowledge or patience to do so, the court’s rules and/ or state law may not permit you to do so.

nized as. If your business is a sole proprietorship (for example, you are Joe Smith doing business as Smith Painting Contractors), you may represent that sole proprietorship in court. Likewise, if your business is a general partnership (for example, you are Joe Smith and your brother Carl doing business as Smith Brothers Painting Contractors), any partner may represent the general partnership in court. However, if your business is formed as a limited liability entity (such as a corporation, a limited liability company, a limited partnership, etc.), you may not represent that business in court. This is because, as a limited liability entity, your business is legally its own separate “person”; if you were to represent this other “person” in court, you would be practicing law without a license to do so. Natural persons have the legal right to represent themselves in court (“pro se” or “pro per”) if they wish; legal persons who are not also natural persons (living human beings) obviously cannot as they have no physical being to physically act. In Colorado, any legal person (this would include trusts too) that is not also a natural person must be
prove they were paid. So along with that utilities bill, you may want to staple the canceled check or credit card statement that covered the charges. Receipts, bank statements, and even invoices stamped “paid” also count as evidence that the expenses were have been taken care of. Along with documenting business expenses, all deposits must also be adequately documented to prove that you are reporting your profit correctly. If the funds are from payment for a service or product rendered by your company, you should attach a copy of the payment to the invoice it covers. Not only will this serve as documentation for the IRS, it will also help you keep track of paid and outstanding invoices from customers. Loans and other sources of company income must also be accompanied by all related paperwork. Overall, the best way to ease your concern over an audit is by maintaining thorough records and documentation on everything. Then, you will have nothing to fear if you are one of the .5% of taxpayers selected for an audit. In need of some good IRS Audit Solutions or Tax Reduction Strategies for your Small Business? Colorado Springs, CO 80921 (719)488-9395 Please visit our comprehensive website for divorce information: www.cmeyerlaw.com represented by an attorney in county or district court. Further, if you were to act in every way physically for that legal person that is your business, including representing it in court, you might become its “alter ego” under the law: you are not treating that business as a separate legal person. A court then will not respect that business as a separate legal person, will pierce the corporate veil, and you will then be personally liable for all debts, acts and omissions of that business, placing your personal assets at risk. If your business is suing or being sued, it is advisable to consult with an attorney as soon as possible to determine whether you can represent your business yourself. Please consult your legal advisor regarding your particular situation. For additional information contact, Lisa Welch Stevens, Attorney at Law P.C.
