SADDLE BURGERS AND OTHER DELIGHTS Even though the meat grinder wasn’t invented until the 19th century, hamburgers likely began much earlier in slightly different forms. There are differing opinions on where and when the hamburger was invented, but here is some food for thought on the subject: There’s Genghis Khan (1167-1227) and his army of Mongol horsemen who rode on small horses for days on end to conquer the world as they knew it. Rarely taking a break from riding, the story goes that townspeople would follow behind the army and provide meat from the scrapings of lamb formed into patty shape. The soldiers would place them beneath their saddles while riding, which would tenderize the meat. When hungry, they could simply reach under the saddles, grab the raw meat and eat on the go. The first fast food? Khubilai Khan (1215-1294), Genghis Khan’s grandson, carried on the family’s conquering traditions and invaded Moscow in 1238. He brought along those saddle-tenderized patties which were adopted and modified by the Russians. They called it steak tartare, after their pet name for Khan’s Mongol army – the Tartars. Much later during the 15th century, minced meat made into sausage became popular throughout Europe.

By the 1600s when ships were moving about, Germans from Hamburg visited Russia and brought back the steak tartare for the Germans to partake. Eventually, by the 18th century, the steak tartare was brought back to New York by American’s visiting Hamburg, Germany as well as German immigrants. Americans began to call it Hamburg steak and made it with low-grade beef mixed with spices, bread crumbs and eggs. By the late 1800s, Hamburg steak began showing up on restaurant lunch menus right there with stewed veal and mutton chops.

HAMBURGER FARE AT THE FAIR As could be expected, there is more than one theory about how the true hamburger as we know it got its start in the United States. One theory is that a restaurant owner by the name of Fletcher Davis introduced the hamburger at the St. Louis World’s Fair in 1904. Another theory is that Frank and Charles Menches from Ohio brought the hamburger to the Erie County Fair in Hamburg, N.Y. in 1885. Apparently, the brothers ran out of sausage patties to serve and took beef, added ingredients such as brown sugar and coffee and called it the Hamburg Sandwich. HAMBURGER FACTS • White Castle is considered the first hamburger chain restaurant, founded in 1921 in Wichita, Kan. by Walter Anderson and E.W. Ingram. Their “slyders” were 2.5 inches wide, steam fried on a bed of chopped onions. They sold for a whole nickel. Still a popular Midwest burger, they now sell for about 69 cents each.

When democratic candidate Gary Hart advanced his campaign of new ideas, opposing candidate Walter Mondale asked during one of their debates: “Where’s the beef?” Several current TV shows have included the phrase such as “The Simpsons,” “The Office” and “Scrubs.”

GOING FOR A RECORD According to Guinness World Records, Mallie’s Sports Grill & Bar in Southgate, Mich. is the home of the world’s largest hamburger on the regular menu. Dubbed the “Absolutely Ridiculous Burger,” it weighs in at 185.8 pounds and costs $499. Be sure to bring a few friends to share in the calories (and the cost). A couple of record breakers: • In 2001, the Burger Fest in Seymour, Wisc. cooked and served a burger weighing 8,266 pounds. • In Rutland, N.D., folks made a 3,591pound burger and shared it with 8,000

who would prescribe three hamburgers a day in order to cure whatever ails you. • During World War I, the Hamburg steak was renamed Liberty Sandwich to disengage itself from Hamburg, Germany, home of the enemy. Same with German measles which became the liberty measles, liberty cabbage rather than sauerkraut, and so on. • The Wimpy burger came from the character Wimpy in the Popeye comic strip who had an insatiable appetite for the beef patties in the 1930s. • Ray Kroc founded the first McDonald’s in 1955 in Des Plaines, Ill., now a museum. Kroc named it after the “fastfood” hamburger restaurant he discovered in California that was owned by Dick and Mac McDonald.

Mohawk Industries, a Georgia-based company and one of the largest rug manufacturers in the world, processes their rugs to retain color. “The rugs are solution dried and [the fibers] are extruded with color pigment. That means the color is part of the fiber, not separate, so it’s colorfast,” explains Pat

If a rug will be a permanent outdoor fixture, the entire rug — including the backing and trim — should be 100 percent polypropylene to withstand harsh outdoor weather, resist mold and mildew and maintain its size and color. Polypropylene, a plastic, is usually manufactured under a brand name like Olefin or DuraCord. DuraCord, first manufacturered in 2003, was developed for The HammockSource, a North Carolinabased company that specializes in outdoor furniture and accessories. Unlike traditional polypropylene, DuraCord has a “cotton-like texture and feel” says Laurie Rudd, HammockSource creative director. DuraCord also has an ultraviolet resistance, which means it can withstand up to 2,000 hours of sunlight. Plus, a moisture regain of .01, means the rug dries quickly. Moisture regain refers to the amount of water a rug will absorb: the lower the number the less water a rug retains. Most polypropylene products have a .05 moisture regain.

Sometimes, depression occurs because the child was taught to suppress individuality and creativity.

ave you or someone you know suffered from depression? Depression can become a very serious issue for individuals, especially when their mind and emotions take them to a dark place that may feel impossible from which to escape.

The person who is depressed will need to search, but that person may need assistance in the searching. He or she may need assistance in bringing in clarity and bringing the “not so obvious” to the conscious mind in order to work with it effectively.

Depression does not simply ‘just happen’. Depression is caused, but many individuals attempt to work on the symptoms of the depression. Low levels of energy, loss of appetite or increase of appetite that is not healthy, hair loss, low immune system, low desire for enjoyment, a tendency to dwell on dark issues and not move out of that are some symptoms of depression. If a person discovers the cause of depression and works on the cause, rather than the symptoms, results can shift to a more positive outcome.

A Tai Yi treatment/exercise for this is called Removing the Snake. Removing the Snake brings clarity to what is wrong that is causing mental and emotional compression. The person may feel off and he or she may feel off in multiple areas of his or her life, not just one. It brings the issue to the conscious mind in order for the person to identify a new choice and then make the new choice. It brings awareness, it will not “just heal” the depression on its own. Snake symbolizes deception and wisdom. The person will need to ask, “Am I deceiving myself?” Symbolically, the exercise brings the snake to life and the person uses the snake as wisdom to heal whatever is not working.

Before mental and/or emotional depression can occur, one must SUppress, then COMpress, then DEpress. It works in this order. So, the individual must work on what was suppressed in the first place. That may require some self-searching and questioning if the person is not already very aware of the reason for depression. Some people are aware of their depression and some have been depressed for so long, for example since childhood, that it has become a very normal feeling. The person may feel “off” and not

• On May 20, 1506, the great Italian explorer Christopher Columbus dies in Valladolid, Spain. Columbus, and most others, greatly underestimated the world’s size. In 1492, Columbus sighted Cuba, which he thought was mainland China, and in December he landed on Hispaniola, which he thought might be Japan. • On May 19, 1864, President Abraham Lincoln writes to anti-slavery Congressional leader Sen. Charles Sumner of Massachusetts, proposing that widows and children of soldiers should be given equal treatment regardless of race. Read on as I share some amazing secrets that have been scientifically researched, tested and used by professional athletes and top Olympic gymnasts for years. Secrets revealed to me by one of the best trainers and body building authors in the industry, Dr. Ellington Darden, Ph.D. Exercise Your Abs from the Bottom Up. Stack Lower-Ab Exercises into a Workout and Repeat 3 Times a Week. Watch a gymnast train and it’s one related activity after another. Yes, there are runs, jumps, and rolls. But there are also handstands, balances, and graceful postures performed in a slow, controlled manner. Did you know . . . it’s the smooth, deliberate movements which require the greatest muscular strength and endurance? Advanced gymnasts practice connected exercises, one after the other, in what they refer to as stacks. A “stack” means to organize three related exercises and perform them back- to-back, with no rest time between the movements. In other words, you immediately go from exercise one to exercise 2, and then from exercise 2 to exercise 3. Using this style with similar exercises leads to a deep, burning sensation within the involved body parts. This deep burn has proven to be exceptionally effective in sculpting the abdominal and oblique muscles. Two routines are presented below. The first requires no special equipment. The second stacks three exercises involving an Ab Roller or Dual Ab Crunch machine, which is a unique piece of equipment that targets the lower and upper abdominals. Both routines apply only one set of five exercises, performed three times per week. The first three exercises in each routine are done progressively by doing 8 repetitions, initially, and adding one repetition each training day. At your sixth workout, you will be doing 13 repetitions. Try to do each repetition very controlled and smooth, taking approximately 5 or 6 seconds per repetition. At the completion of the first three exercises, take a few minutes rest – then insert a lower body exercise (such as wall squats) and a multi-joint upper body exercise (such as push-ups) to further enhance your total body endurance and core strength. The goal is to reach that burning state and keep going – progressively – workout-byworkout. For flatter and stronger abs, you must learn to focus and endure a certain amount of muscular fatigue toward the completion of each exercise. With a positive attitude, you will succeed! Reverse Trunk Curl (mid and lower abs): Lie face up on the floor with your hands on both sides of your hips. Bring your knees up toward your chest so your hips and thighs are flexed. Cross your lower legs at your ankles. Curl your hips toward your chest by lifting your buttocks and lower back off the floor. As you lift your buttocks, you must counterbalance your body by pushing down on the floor with your hands and arms. Pause briefly in this top position. Then, lower your hips slowly

to the floor. Don’t move your thighs and knees excessively. Keep them near your chest. Repeat for 8 repetitions. Move immediately to the Side Bend to the left.

Side Bend to Left (for right obliques): Stand with your feet hip-width apart. Extend your arms above your head and interlace your fingers. Stand tall and reach toward the ceiling. When you achieve the maximum height, start bending laterally to the left. Pause briefly in the stretched position and reach again with your arms and hands, this time maximally to the left. Return slowly to the top center position – do not let your hands move forward. Keep them extended and directly over the middle of your head. Reach toward the ceiling with both hands and repeat bending to the left side for 8 repetitions. After the final repetition, move immediately to the Side Bend to the right.

Side Bend to Right (for left obliques): Assume the same standing position as before. This time, reach toward the ceiling and bend laterally to the right. Stretch, reach to the right, return smoothly to the top center position, and continue for 8 repetitions. Wall Squat Hold (for buttocks and thighs): Stand erect and lean back against a smooth, sturdy wall. Place your heels 3 inches wider apart than your hips and approximately 12 inches away from the wall. Adjust hands on hips. Slide your back down the wall until the tops of your thighs are parallel to the floor. Hold this position for 10 seconds. Push back to the top position. Lower to the parallel position and repeat for 8 sustainedcontraction repetitions. Add 1 repetition to each workout. Negative Push-Up (for chest, shoulders, and backs of upper arms): This is the single exercise you’ll do in a negative or lowering-only manner. Assume a standard push-up position on your toes and hands with your arms straight and your body stiff. Lower your body slowly to the floor by bending your arms slowly in 6 seconds. Do NOT try to push yourself up to the top position. The idea is to focus only on the lowering, which will become very challenging. Use your legs to get up. Repeat for 8 repetitions. Add 1 repetition per workout.

s much as I would like to wake up every morning feeling joyful, excited about the day to come, lately I’ve been having a week of ‘Monday’s’. Probably due to the fact that winter seems relentless with gray days, and brown muddy ugliness, sleet and hail coming down sideways. How does one make the choice to be happy? If I’ve learned nothing else it’s that we do have choice to be joyful. This choice is not based on circumstances. While happiness is ruled by our relationships, the weather, and other serendipitous happenings, joy is not. Hope in something outside of ourselves gives this life meaning. The return of spring brings such relief and joy and anticipation. Life has returned after the wrestling match between winter and summer subsides. With it returns the sunshine, warmth, color, and the long days of summer adventure together. We replace the snow blowers with the lawn mowers. We tend the garden and drink in all the beauty. We head off for vacations. Isn’t that we all long for? To leave winter behind what Shakespeare called “the winter of our discontent,” and find ourselves suddenly in the open meadows

of summer? In the ‘between’ times, how do we hold on? We have to have hope and something to hope in. The allure of hope is what keeps me going. Get doctor approval for any of this. Strength-training exercise -- weightlifting -- also is strongly recommended for all adults regardless of age.

HOW MUCH EXERCISE DO ADULTS NEED? DEAR DR. DONOHUE: What is the amount of exercise recommended for a man or woman of 55? I was always under the impression that 15 minutes of aerobic exercise three times a week was a sufficient amount of time for heart health. Am I wrong? -- R.K. ANSWER: That used to be the recommended amount of exercise time for an adult. For readers, aerobic exercise is the kind of exercise that is tailored for the heart. It’s exercise that employs the continuous use of large muscles for a somewhat protracted period of time, at least 10 minutes. Jogging, biking, walking, swimming and dancing are examples of aerobic exercise. The latest advice for adults, if their doctors say they are fit enough to exercise, is to get 150 minutes of moderate-intensity aerobic exercise a week. That’s 20 minutes of exercise seven days a week or 50 minutes, three times a week. You can divide it any way you wish, but the minimum amount of one session of exercise has to be 10 minutes. If you are a novice, take your time to reach 10 minutes. A single session can be longer if you choose. Moderate-intensity exercise is walking at a pace of 3.5 miles an hour, a brisk walk. Or if you want to devote less time to exercise, you can if you make it vigorous exercise. Vigorous exercise for 75 minutes a week fulfills the requirement for

hile Betty Crocker is often associated with 1950s happy homemaking, she originally belonged to a different generation. Created in 1921 as a “friend to homemakers” for the Washburn Crosby Company (a forerunner to General Mills) in Minneapolis, her purpose was to answer consumer mail. “She” was actually the women of the Home Service Department who signed Betty’s name. Eventually, Betty Crocker’s local radio show on WCCO expanded, and audiences around the nation tuned her in, tried her money-saving recipes and wrote Betty nearly 5,000 fan letters per day. “Your talks ... have given me hope,” wrote one listener to the Betty Crocker radio program during the Depression. The fascinating book “Finding Betty Crocker,” by author and documentary producer Susan Marks, offers an utterly unique look at the culinary and marketing history of America’s First Lady of Food. According to Marks’s largely chronological “biography” (there was no real Betty Crocker), it was human connections like this one that made Crocker one of the most successful marketing tools ever. For a delicious light version (only 1 gram saturated fat per serving) substitute fat-free half-and-half for the regular halfand-half called for in the recipe. 3 medium (about 1 1/4 pounds) leeks Salt 1 package (16 ounces) vermicelli or spaghettini 1 tablespoon margarine or butter 2 bunches green onions, thinly sliced 4 medium (about 1/2 cup) shallots, finely chopped 1 clove garlic, crushed with press 1/4 teaspoon coarsely ground black pepper 1 cup fat-free chicken broth or vegetable broth 1/2 cup half-and-half or light cream 1. Cut off roots and leaf ends from leeks. Discard any tough outer leaves. Cut each leek lengthwise in half, then crosswise into 1/4-inch-wide slices. Place leeks in large bowl of cold water; with hand, swish leeks around to remove sand. Transfer leeks to colander. Repeat process, changing water several times, until all sand is removed. Drain well. 2. Heat large saucepot of salted water to boiling over high heat; add vermicelli and cook as label directs. 3. Meanwhile, in nonstick 12-inch skillet, melt margarine or butter over medium-high heat. Add leeks, green onions, shallots, garlic, pepper and 3/4 teaspoon salt, and cook until vegetables are tender and golden, about 10 minutes, stirring often. (May 12, 2010) – Readers in the Pikes Peak region will explore the creative genius of Colorado Springs’ own Nikola Tesla, and find ways to tap into their innovative and enterprising ideas with this year’s All Pikes Peak Reads selections. Pikes Peak Library District announced the 2010 selections at the Imagination Space in Colorado Springs Wednesday. The titles are: The Invention of Everything Else by Samantha Hunt; The Devil in the White City by Erik Larson; and Lightning in His Hand: The Life Story of Nikola Tesla by Inez Hunt & Wanetta W. Draper. APPR is a community-wide effort to improve literacy and foster dialogue across social, cultural, and generational lines. Author visits, art exhibits, book discussion groups, children’s programs, film screenings, and other APPR-themed events will be offered at PPLD and other community sites. ”This program connects the library district to the community in so many important ways,” said Dee Vazquez, co-chair of All Pikes Peak Reads. “It touches readers, writers, learners, children, teens, adults, seniors…it truly belongs to everyone.” With the assistance of community partners, APPR will bring author Erik Larson to Colorado Springs to speak during the project in October. Larson’s nonfiction bestseller, The Devil in the White City, intertwines the true tale of two men - the brilliant architect behind the legendary 1893 World’s Fair, striving to secure America’s place in the world - and the cunning serial killer who used the fair to lure his victims to their death. The inventive Nikola Tesla is the subject of the other two APPR selections: In the fiction selection The Invention of Everything Else, a woman obsessed with Tesla eventually uncovers the extraordinary story of his life as a Serbian immigrant and a visionary genius. In the biography Lightning in His Hand: The Life Story of Nikola Tesla, authors uncover the story of Tesla, one of the greatest inventive scientists of all time who had performed some of his most important experiments in Colorado. ALZHEIMER’S ASSOCIATION MEMORIES IN THE MAKING ART AUCTION ®

ART PROGRAM BRINGS JOY TO THOSE WITH ALZHEIMER’S Colorado Springs April 28, 2010 – A beloved 1932 Plymouth, a career spent as a dancer, and world travels are all memories illustrated in watercolors by participants in the Alzheimer’s Association of Colorado Memories in the Making® (MIM) art program. Forty-six pieces of artwork created in 18 Colorado Springs programs will be auctioned during both a silent and live auction at this year’s Alzheimer’s Association Memories in the Making Art Auction at the Colorado Springs Marriott, Thursday, June 3, 2010. The event begins at 5:30 pm with live music, the silent auction, buffet, balloon prize drawings and viewing of the live art selections as well as a collection of original palettes by renowned professional artists. The live auction begins at 7:00 pm. In addition to the 46 works by those with Alzheimer’s disease, nine pieces of professional art are being paired with the Alzheimer’s work in addition to 35 original art palettes all donated by local professional artists. The art featured in this year’s Memories in the Making Art Auction will be displayed in a gallery at Chapel Hills Mall during the month of May. More than 1,000 pieces were submitted for the jury process to select the artwork for the annual auction. That means Alzheimer’s artists were engaged in an activity that provides socialization, improves self esteem, creates a sense of purpose and, often times, simply joy. That joy is also shared with the families of the artist as memories long forgotten or no longer able to be shared in words are retold through art. One of the watercolors selected for this year’s MIM art auction is titled The Dancer. It was created by Suzanne Fowler, and when the family received the painting, her niece Kathy Meyer recognized it as a remembrance of Fowler’s own career as a dancer. Meyer said, “Suzanne was a beautiful woman and a beautiful dancer. She was about 15 years older than I am, and I remember always looking up to her and admiring her”. To support the event, a private collector has donated an original mixed media piece by Yamin Young entitled Flame. This piece will be available by bid prior to the event in the Chapel Hills gallery location or online at alz.org/co only. The high bidder will be announced at the Memories in the Making Art Auction on June 3. Proceeds from the art auction support Alzheimer’s education, counseling, support groups, the 24-hour Helpline as well as research to develop better treatments and to eventually find a cure. If so, tell him about the Medicare Prescription Drug Plan and the extra help available through Social Security. s you strive to achieve your long-term goals, such as a comfortable retirement, you may, at times, feel frustrated over events you can’t influence, such as the up-and-down movements of the financial markets. Yet there is much you can control — once you determine the answers to just five key questions. Where am I today? Take stock of all your assets — your IRA, 401(k) and other savings and investment accounts. Then, do the same for your debts, such as your mortgage and any other financial obligations. On your financial journey through life, it’s essential that you know your starting point. Where would I like to be? Once you’ve established where you are today, you’ll need to identify where you’d like to be tomorrow. How much will you need to pay for the retirement lifestyle you’ve envisioned? Will you be able to help pay for your children’s or grandchildren’s college education? Will you need to support any other family members? At this stage, you’ll want to write down all your goals and put a price tag on each one. Can I get there? After you’ve identified your goals, determine if they are, in fact, achievable. By considering a variety of factors — including your likely future income stream and your family situation — you should be able to determine if you can attain

your goals or if you need to modify them in some way. How do I get there? Now it’s time to put a strategy into action. Specifically, you need to choose those investments that can help you pursue the goals you’ve selected. Your ideal portfolio will depend on your risk tolerance and time horizon, but in general, you’ll want a diversified mix of quality investments. While diversification, by itself, cannot guarantee a profit or protect against loss, it can help reduce the effects of volatility. As you put together your holdings, make sure you understand what you can expect from your investments. For example, growth stocks may offer the highest potential returns, but they also carry the greatest risk. On the other hand, investment-grade bonds can offer a steady income stream and, barring the default of the issuer, will repay your principal when they mature. How can I stay on track? Once you’ve built your investment portfolio, you’ll need to review it regularly — at least once a year — to help ensure it’s still meeting your needs. After all, many things can and will change in your life, such as your family situation, your goals, your employment and your risk tolerance. To address these changes, you’ll need to adjust your portfolio over time. As you can see, answering all these questions will take both work and expertise. That’s why you may want to work with a professional financial advisor to help you identify your goals and create a strategy for pursuing them. In any case, though, start asking — and answering — these five key questions as soon as you can. It’s easier to reach your financial goals if you put time on your side. W

hen you read lists of the latest scams, they’re all different. There are some scams, however, that seem to make all the current lists. Here are the ones to beware of at this point, in no particular order.

or attorneys, trials are as much fun as the practice of law can get; for the parties, not so much. But before you get to the fun part, there is a lot of preparation. To conduct a good trial requires a lot of planning and practice, as well as good oratorical skills, good debating skills, good acting ability, the ability to think quickly on your feet, and to listen, observe, analyze and adjust all at the same time. Prior to trial, discovery and trial preparations are governed by a case management order. Usually, the parties agree to go by the presumptive case management order found in the Rules of Civil Procedure; if they want to vary from that order, the parties must agree upon, and get the court’s approval of, a modified case management order. As a pro se plaintiff, though, you will probably go with the presumptive case management order. At trial itself, the prosecution and defense of the case are governed by the trial management order, which I will discuss in a future

Where one or more of the parties is proceeding pro se, the court will hold one or more case management conferences, to assist the parties in developing the trial management order for trial, and to insure that all requirements of the presumptive case management order are met. These conferences are usually fairly short – 1530 minutes. No later than 15 days after the “at issue” date, the parties are required to meet and confer to explore possible settlement of the case (this is in addition to the mandatory mediation required before going to trial), and to discuss the nature and basis of all claims and defenses, matters to be disclosed to each other, and whether to modify the presumptive case management order under the Rules. No later than 30 days after the “at issue” date, the case must be set for trial by the “responsible party” (usually the plaintiff). No later than 30 days after the “at issue” date, each party must make its mandatory voluntary disclosures of witnesses, persons with information, documents, information, and tangible things in any way relevant to the case to all other parties. The parties thereafter have a continuing duty to update those disclosures until the close of discovery 50 days before trial. Under the presumptive case management order, ALL pretrial motions MUST BE FILED no later than 35 days before the trial date. This includes, but is not limited to, motions in limine to exclude the presentation of certain evidence or witnesses at trial. However, all motions for summary judgment MUST BE FILED no later than 85 days before the trial date. (I will discuss motions for summary judgment in a future article).

2. Home Repair: Spring is here, and so are the guys with a truck full of tools or asphalt, ready to take your money in advance.

9. Mystery Shoppers: You could be charged for a guide and a kit showing how to find the jobs, or they’ll ask for your banking information so they can automatically deposit your pay.

3. Weddings: Beware “free” tickets to bridal shows; dresses with fake labels; planners, photographers and caterers who take your money and run. 4. The Census: You may be contacted in person, by e-mail or by phone by people looking for your personal banking information and demanding that you’re obligated to give it. You’re not. 5. Toyota “Recall”: These scams involve a tollfree number that is very similar to the real Toyota number. When you call the fake number, you’ll be charged $5.96 and will be asked for information such as your Social Security number. 6. Work at Home: You’ll get information that tells you how to find the jobs, not the actual jobs. 7. Windows 7 Updates: You could lose money when you pay for fake software update codes, or postage for free updates.

To keep up with scams, take a look at the Scams website message board at www.scam.com. You don’t have to log in to read the messages. Also, Consumer Affairs at consumeraffairs.com is an informal site that appears to keep up with the latest scams as well as recalls. Rule of thumb: Be suspicious when it comes to your money or information. No discovery may be conducted until 45 days after the “at issue” date, and all discovery MUST BE COMPLETED no later than 50 days before the trial date. Anything not disclosed or discovered before that date may not be used at trial. No later than 30 days before trial, the “responsible attorney” must prepare and file with the court and serve on all other parties a proposed trial management order. (I will discuss trial management orders in a future article). However, if any party is proceeding pro se, the “responsible party” (usually you, the plaintiff), instead must file a Notice to Set Trial Management Conference with the court, and serve it on all parties, after all disclosures have been served and all discovery has been completed (i.e., approximately 50 days before trial). After the trial management conference the court itself will issue a trial management order. No later than 40 days before trial, all parties must exchange lists of witnesses they will or may call at trial, and of all exhibits they will or may introduce at trial. Any witness or exhibit not listed may not be used, called, presented, or referred to at trial. All parties must all provide a copy of each docu-

mentary exhibit that will or may be introduced at trial. Any documentary exhibit of which a copy is not provided to all other parties will be barred from introduction, presentation, argument or reference at trial. No later than 10 days before trial, any and all trial briefs must be filed with the Court. No later than 3 days before a jury trial, proposed jury instructions and verdict forms must be filed and served by the party who requested a jury trial. Failure to comply with any of these requirements may result in dismissal of claims and defenses, judgment against you, or a bar against presenting any evidence or witnesses at trial, as well as monetary sanctions. Again, as I have stated in previous articles: THIS IS NOT TELEVISION OR THE MOVIES. THERE IS NO “HIDE-THE-BALL”. THERE ARE NO SURPRISES.
