Or maybe they’ll hear about Yertle the Turtle. The man responsible for such fantastical stories is Theodor Seuss Geisel, better known as Dr. Seuss. Arguably one of the most influential and creative writers of the 20th century, Dr. Seuss had the incredible ability to create worlds within worlds that have entertained the young and old alike. So how does the childless son of Bavarian immigrants become a global children’s literature icon? But this was the time of Prohibition and the future Dr. Seuss wasn’t above the law. When he got caught drinking gin in his dorm room with nine other friends, the dean of students, Craven Laycock, banned Geisel from participating in any extracurricular activities including the “Jack-O-Lantern.” Not to be so easily dismissed, he continued to write and submit cartoon drawings for the magazine under the name “Seuss.”

First off, let’s set the record straight. The name “Seuss” was the writer’s middle name and his mother’s maiden name. But all this time, people have been pronouncing it incorrectly. It’s actually pronounced “zoice,” as in voice with a z. Dr. Seuss used his name in several different variations over the course of his life, including Dr. Theophrastus Seuss, Theo LeSieg (which is Geisel spelled backwards) T. Seuss, and Seuss. Obviously, the one that stuck was his faux-doctoral title which he adopted in 1927 and then shortened to just Dr. Seuss in 1928. When his work became popular, the mispronunciation was never corrected and Dr. Zoice became Dr. Soose.

Geisel graduated from Dartmouth in 1925 and headed to Oxford where he intended to study for a Doctorate of Philosophy in English. It’s said that although Geisel sincerely attempted to take his studies seriously, his notebooks were often filled more with drawings and sketches than with notes from the lectures.

Born on Mar. 2, 1904, in Springfield Mass., Theodor “Ted” Seuss Geisel had a relatively run-of-the-mill upbringing. He graduated high school in 1921 and went to Dartmouth College. Geisel began writing and drawing for the school’s humor magazine called

In a small apartment in New York, Geisel worked on his cartoons, hoping to make a living for himself and his new bride. A year went by without much success. Then, in 1928, officially drawing cartoons under the name Dr. Seuss, he submitted a cartoon to Judge magazine which referenced an insecticide called Flit. The cartoon was of a knight who said, “Darn it all, another dragon. And just after I’d sprayed the whole castle with Flit!” Piggybacking off the initial cartoon, Dr. Seuss created an entire campaign

And with that, Dr. Seuss began his 30-year career writing and drawing advertisements. His achievements included ads for NBC, General Electric and Holly Sugar among others.

The text in “And to think that I saw it on Mulberry Street” was his way of entertaining himself while on the trip; he put together the entire story to coincide with the rhythms of the ship’s engines. The Mulberry Street he wrote about was actually a street that was just a few blocks away from where Dr. Seuss grew up in Springfield, Mass.

By 1941, Dr. Seuss had written and published four children’s books and was working on his fifth. But with the onset of World War II, Dr. Seuss set his sights on a different type of writing. He began writing and drawing political cartoons for the New York newspaper PM. Dr. Seuss spent 21 months in that position, where he developed a strong political point of view. Dr. Seuss made his opinions most obvious in several stories that he wrote after WWII ended. In 1958, he wrote “Yertle the Turtle,” the inspiration for which he supposedly took from Adolf Hitler’s rise to power. Having experienced some racial prejudice while he was in college, Dr. Seuss also had strong feelings about discrimination, which he illustrated in 1961 in “The Sneetches.” It is said that those experiences, in addition to the anti-Semitism that raged during the war, helped him create a world where “Sneetches are Sneetches / And no kind of Sneetch is the best on the beaches.” He picked up on the political theme when he wrote “The Butter Battle Book” which it is said shows his concern about the United States’ contribution to the progression of the nuclear arms race.

LEAVING A LEGACY… By 1960, he and his wife, along with Phyllis Cerf founded Beginner Books, a division of Random House. Through this company, Dr. Seuss published “Green Eggs and Ham,” his best-selling title to date. In total, Dr. Seuss published 46 chil-

MORE ABOUT SEUSS • Dr. Seuss once claimed that the ideas for his stories came from a town called Uber Gletch, located 2,000 feet above Gletch in Switzerland. He said he went there every Aug. 4 to get his cuckoo clock repaired and while it was being fixed, he talked to people in the town who gave him story ideas.

ARONIA IN THE SPOTLIGHT

ronia or Chokeberry bush is a cold hardy deciduous shrub that has dark green glossy foliage in the summer and delicate white flowers in the spring. It’s not the same as the Chokecherry we all have in our backyards. It is a multiseason shrub that is often overlooked. Aronia is very adaptable to light and water conditions. It can do well anywhere from full sun to part sun to shade! It has moderate water requirements, but it will also tolerate a wet site. This can make it a good option for a full sun and wet site or a shady and slightly dry site, where many plants won’t grow.

• “Nerd” first appeared in Dr. Seuss’s “If I Ran the Zoo.” • In 1939, Dr. Seuss went into business with Ralph Warren to invent an Infantograph, which claimed it could show what a couple’s children would look like. It didn’t work.

Aronia is a great landscape shrub because it has something of interest for every season. In the late summer it is covered with beautiful plump dark purple or red fruit, which is why it is in the spotlight right now! Now all of the dangling fruit which, depending on the variety, are black to dark red are starting to ripen, and if their not harvested they will persist well into winter making it highly ornamental. As the days and nights get cooler the foliage turns to orange and then red which really sets up an eye-catching contrast of colors.

Directions Wash fruit and cover with water; simmer 15 minutes. Strain juice. Measure juice into a 6- to 8-quart kettle. Add pectin and stir. Bring to boil, add sugar, stir, and bring to a rolling boil. Boil exactly 2 minutes. Skim and pour into jars.

Aronia Berry Bread Ingredients 2 cups flour 1 1/2 teaspoon baking powder 1 teaspoon salt 1/2 teaspoon baking soda 1 egg 1/8 cup shortening 3/4 cup orange juice 1 cup sugar 1 cup aronia berries or one cup of juice 1 cup nuts Directions Sift together flour, baking powder, salt and baking soda. In blender, combine egg, shortening, orange juice, and sugar. Add Aronia berries & nuts and chop briefly. Empty into flour mixture. Mix by hand until moistened. Bake in a greased 9×5 pan at 350F for 50 to 60 minutes.

eniors older than 65 who have higher levels of omega-3 fatty acids in their blood benefit from reduced mortality risk, specifically from heart disease, according to a study by the Harvard School of Public Health and the University of Washington.

IT’S WHAT’S FOR BREAKFAST By Nick Yanez

T

he birthing process is entirely unique to it’s species. I mean, look at the difference between how a Human and Chicken are born. The entire idea if the egg is totally foreign to us (it’s what’s for breakfast!). Strange to imagine being cooped up in an egg outside in the real world. You would wiggle and grow until you’re finally strong enough to break out of the shell and breath fresh air. That’s how many creatures come to be, though. Even some of the more unique species that have come to be extinct. Take the Elephant Bird for instance. The dinosaur-like creature roamed the Earth until roughly the beginning of the 17th century. It towered to an astonishing 11-feet tall and resembled the Ostrich. The flightless bird was also known to lay eggs that were 100 times larger than an average chicken egg! Wouldn’t that be a sight to see? Well, now it is. Recently, scientists have discovered a party fossilized Elephant Bird egg in Madagascar. It’s diameter measured at 9 inches and was nearly a foot tall. It’s a rare, unique find. So unique in fact, that those who discovered it were overcome by the temptation of selling it. So, at a British auction last week, they did. The egg was valued at around 30,000 pounds (almost $50,000 US Dollars) before the auction went live. Seems like a lot for a round fossil to me. Nevertheless, once the bidding began, the interest in the egg soared.

After 10 minutes of competitive bidding, the anonymous winner claimed his new prize with a final bid of 66,675 pounds. That’s equal to over $100,000 US Dollars! For an egg, people. This seems borderline preposterous. Now if the egg were not fossilized, we have a different story. Not only would you be buying a giant cool egg to be the centerpiece of your foyer, but you’d also have just purchased a future pet Elephant Bird. That, if I do say so myself, would be worth a hundred grand. Heck, I wouldn’t be angry if some rich British guy paid a million dollars or more for an egg with a pending Elephant Bird birth. But, alas, that is not what happened. Instead, this guy just bought an egg. It makes me seriously question how some people are willing to waste their money. There’s the infamous story of the grilled cheese sandwich that sold for $28,000 on ebay, because the burn marks in the toast resembled the Virgin Mary. This egg fiasco isn’t as bad as that. The egg itself is cool too, or I wouldn’t be writing about it. Don’t get me wrong, I think the egg is fabulous. I just don’t find it worth a brain surgeons year-long salary. Unless this gentleman is planning some sort of giant breakfast for the worlds most renown billionaires. We’re talking Trump, Gates, Zuckerburg and the whole gang. He will serve them this one of a kind egg in an omelet for the elite; taking donations for his future political aspirations all the while. In that situation, I applaud anonymous British buyer; you are an inspiration to the masses. May we all walk in the footprints of your untainted journey through life.

he carrot is a very versatile vegetable. It can be used as a starter, main course, dessert or just as a snack. Carrots can be eaten raw or cooked in almost any manner imaginable. Carrots help to maintain acidic and alkaline properties in the system. They provide important vitamins for eyes, skin, bones, heart and muscle health. Carrots also can act as a blood puri-

When selecting carrots, make sure that they are a deep, rich color. The deeper the carrot’s color, the more betacarotene it contains. If you’re buying the carrots with the leaves, select ones that they are moist and a bright green. Remove the carrot greenery as soon as possible because it robs the roots of moisture and vitamins. You can eat the green tops in a salad or use them similar to the way that you’d use fresh herbs to sprinkle on a dish. Carrots that are less than 8-inches long and relatively uniform in shape and size are the best selection. Carrots should not bend when gently tested. They also should be well-shaped, firm and smooth with no cracks. They should not look wilted. When grated, carrots should be quite juicy. Carrots are often sold with the tops removed. To judge the freshness, check the top of the carrot for darkening.

Whether loose or in plastic bags, avoid carrots with green shoots sprouting out (not to be confused with their green tops) yellowed tips, soft spots or withering, as these are a sign of age. Carrots that have an excessive amount of new sprouts or leaves could have large or woody cores. Also avoid carrots with large green areas at or near their tops. This indicates sunburn damage. Before storing carrots, remove their green tops, rinse, drain and put the carrots in plastic bags. Store them in the coldest part of the refrigerator with the highest humidity, they’ll last several months this way. To keep the carrots crisp and colorful, add a little bit of water in the bottom of the plastic storage bag; this will keep the carrots hydrated. Carrots should be stored away from fruits such as apples, peaches and pears that release ethylene gas, which causes carrots to become bitter. If carrots have become limp or dehydrated, cut off one of the ends and place the carrots, cut side down, in a bowl of ice water for about half an hour, to recrisp them. 3. Pour carrot mixture into a large bowl. Add eggs to the bowl, and 1 cup of breadcrumbs and 1/2 cup of the cheese. Reserve remainder of breadcrumbs and cheese to sprinkle on the top of loaf. Mix the ingredients until well combined. 4. Spread the 2 tablespoons of the butter on the bottom and sides of a 9 x 5 inch, oblong baking pan. Spread the carrot mixture into the pan. Sprinkle with remaining cheese and breadcrumbs. Cover with foil and bake for 30 minutes. Remove foil, dot with the remaining tablespoon of butter, and bake for 5 to 7 minutes until brown on top. Makes 4 to 6 servings.

New DVD Releases for Week of April 29, 2013 PICKS OF THE WEEK “Silver Linings Playbook” (R) -- Pat (Bradley Cooper) is a man with some complicated issues. He gets worked up over little things, he’s recently been released from a mental institution, he lives with his parents (Robert De Niro and Jacki Weaver), and he believes he will reunite with his estranged wife any day now. While trying to figure out life, he meets Tiffany (Jennifer Lawrence), a similarly neurotic young woman. Thus

begins an unconventional and well-crafted love story. Really. It’s dramatic and funny and romantic and not too trite in any way. We all know the two attractive basketcases will fall in love, but this movie handles it so well that you will actually care. Cooper’s performance shows he can do more than “The Hangover.” Lawrence won an Oscar for her performance, and De Niro owns his supporting role. “The Guilt Trip” (PG-13) -- This road trip comedy doesn’t smash expectations, but doesn’t let down, either. Andy (Seth Rogen) is a young, single guy about to promote his new invention -- an eco-friendly cleaning product. Out of sheepish guilt, he invites his widowed mother, Joyce (Barbra Streisand), to join him -- in the hope that he can help her reconnect with an old flame, or just make her happy for a bit. The comedy is more for the Streisand crowd than Rogen fans. Many of their exchanges

are improvised, and this pays off in onscreen chemistry. You can really see these two as mother and son -- in a goofy, Hollywood kinda way. The movie is short, mildly charming and offers some easy chuckles along the way. “Broken City” (R) -- In a city in disrepair, a lone ex-cop (Mark Wahlberg) begins to untangle a web of intrigue and corruption that goes all the way up to the mayor (Russell Crowe). Normally, I give noir films a pass for convoluted plots and silly twists of fate that attack loose ends. “Broken City” gets no mercy. It’s boring. Even Wahlberg looks bored. The loose ends are just forgotten, and in the final act, it is revealed that many different characters were secret best friends the whole time. That’s just cheating. “Not Fade Away” (R) -- David Chase, the director of TV’s “The Sopranos,” looks back at life in 1960s New Jersey. Douglas (John Magaro) is a teenager in the suburbs just getting tuned into the rock music. His

father, Pat (James Gandolfini), doesn’t quite get it. Pat never dared give real thought to leaving his hometown, and now his son has long hair, plays covers of British music and seems like he enjoys the idea of “endless possibilities.” While the story isn’t the most moving, the attention to detail will grab you. Everything fits, right down to the creative differences in Douglas’ garage band.

RISKS OF USING A SINGLE MEMBER LLC FOR YOUR BUSINESS OR INVESTMENT: A LEGALLY DISREGARDED ENTITY? © April, 2013 Lisa Welch Stevens, Attorney at Law P.C.

A

number of court cases in both the United States federal and individual state courts may have drastically reduced the liability protection offered by single member LLCs. This raises the specter of a business’ creditors being able to go after its owner’s personal assets, and of a person’s personal creditors being able to go after the business’ assets, in order to satisfy debts, judgments, etc. against the other. As an attorney, I would not advise any client to use a single-member LLC through which to operate a business, or in which to segregate assets such as real property investments, etc. Usually, legally, a legal entity such as a limited liability company (LLC), a corporation, or any of the many and various forms of limited partnerships, is considered by the courts to be and is treated as a separate

legal person, distinct from its owners. This has been true - for corporations, at least - for hundreds of years. As a result of the entity being a separate, legal person, the owners of a business operated through the entity are protected from being personally liable for any debts of or judgments against the business. Likewise, if a parcel of real property is titled in the name of an entity, the owners of the entity are not liable if someone is hurt on the property, etc. This is why attorneys recommend that business owners operate their businesses through an entity – not as a sole proprietorship or a general partnership – and that real estate investors title their real property investments in the name of an entity, rather than in their personal names.

While there has always been a mechanism through the courts for “piercing the corporate veil” in certain circumstances, enabling creditors of a business or investment to go after an owner’s personal assets, or creditors of a natural person to go after the latter’s business assets, that mechanism was available only in certain very egregious fact situations, and only at great legal cost and time. However, as a result of certain court decisions during the past 10 years or so, in Colorado as well as in other states single member LLCs may now simply be disregarded by the courts, at least in certain circumstances, as if they do not even exist in the first place, for purposes of attaching assets of the LLC or its owner. For example, in the bankruptcy context the United States Bankruptcy Court for the District of Colorado disregarded the fact that an individual debtor’s real property was titled in the name of her single member LLC, and permitted the bankruptcy

trustee to sell all of that LLC’s assets to pay off the individual debtor’s personal creditors. See, In re Ashley Albright, 291 B.R. 538 (Bankr. Colo. 2003). The LLC had not filed for bankruptcy; none of the creditors was a creditor of the LLC. None of the factors that would normally justify a traditional “piercing of the corporate veil” was present. Normally, creditors of an owner of an LLC would only be able, under Colorado law, to get a court to issue a “charging order” against any distribution of profits actually made to that owner by the LLC, when and as they were actually distributed out. However the Court in Albright, interpreting and applying the Colorado state LLC statutes, ruled that in the case of an LLC with only a single member, that collection restriction is inapplicable. Albright at 540-541. The Court reasoned that the charging order limitation was enacted by the Colorado state legislature solely to protect other innocent members of an LLC from credi-

tors of a liable member; where there are no other LLC members to protect, there is no “need” for that limitation, and all of the assets are available to satisfy the liable member’s personal creditors. Id. There was no need for the bankruptcy trustee – or the member’s personal creditors – to establish any grounds for a traditional piercing of the corporate veil of the LLC. The Court simply disregarded the existence of the single member LLC, and gave the trustee full authority to sell all of the LLC’s real property, and distribute the proceeds to the single member’s personal creditors. Notably the Albright Court did not limit its ruling to the bankruptcy context. To date there apparently have been no published Colorado state court opinions addressing this issue; however, it is important to note that at least several other state’s courts have used the Albright case’s reasoning in permitting, under those state’s LLC statutes (substantively similar to Colorado’s), personal creditors of the owner of a single member LLC to obtain payment of the personal debts or judgments with the LLC’s assets, and vice-versa. Other courts have also used the fact of a single-member LLC’s failure to elect tax treatment of the LLC other than the default “disregarded entity” against its owner, arguing that if the LLC is to be disregarded for tax purposes, where there are no other owners to protect, the LLC should be disregarded for liability purposes as well. Given the Albright decision, I personally would not recommend the use of a singlemember LLC to my clients, if another arrangement is possible. For example, addition of even a single other member to the LLC should remove any concerns, so long as that other member has more than a mere “peppercorn” membership interest. This additional member could be a spouse, child, etc. With respect to operating businesses (as opposed to passive real estate investment), a single-member corporation might provide greater liability protection. As always, you should consult your own legal counsel as to the facts of your particular situation.
