aws help us determine right from wrong and while most laws (and the emphasis here is on MOST) are necessary and appropriate, others simply are not. It make sense to have a speed limit in the highway to help drivers continue on their way safely. But it doesn’t quite make as much sense to prohibit bear wrestling matches in Alabama. And that’s not an exaggerated example . . . that is a real and for-true law. Laws like this are not uncommon. The United States is filled with them. What better way to highlight these interesting, often laughable laws than to fill our humble little magazine with them!

In fact the first and most effective way to control fungus gnats is by letting your plants go lightly dry between watering. I’ve got to stress this one. If it is fairly old soil it could be breaking down and essentially turning into gnat food. At least remove the top two to three inches of soil since this is where most larvae will be found. Another solution I’ve seen used is yellow sticky traps. Yes they’re ugly but the gnats are attracted to the yellow and get stuck so this reduces the amount of eggs being laid. Then as a last resort there are insecticides that might help, but try both reducing your watering and replacing the top layer of soil in your plants first. I have found this is by far the most effective way of solving a fungus gnat problem.

Much advertising in the fashion and beauty industry is geared to make us feel like something is wrong with us. We are too fat, too old, too ugly, too undesirable, etc. The list is endless. It was perfectly awful. It is dull and uninspired to become homogeneous and fit a perfect mold. It is absolutely unattractive! True attractiveness comes in being you and being confident in yourself. Here’s the bottom line with perfection: The less you attempt at being perfect and more relaxed you are, the closer to perfection you inevitably come. You can say the same about success. Pursuing success will often make you miserable. Success happens by finding something you are good at and just letting it happen. Perfection, like success, when pursued will be the antithesis of your true goals. There’s a cliché’ that sums it up – Perfect is the enemy of Great. Watch Kate Moss walk a runway. Its slender central cavity was blocked, and bacteria grew in the blocked cavity. That caused swelling. The appendix finally burst and spilled bacteria into the abdominal cavity. What happened to those uninhibited creative forces? Where has the sense of adventure gone? Lost, most likely I suppose, to the urgency of the mundane – to the requirements of daily living.

Travel. Over fifty years ago on our honeymoon in Wyoming my wife and I began wandering around on the side roads. We’ve never stopped. And our wanderings have taken us around the world several times, to over 20 countries on several continents, and all but two states. And once again, you don’t have to go around the world to see something different. Go this weekend to somewhere nearby but off your usual paths of travel and discover something unique. Golly, some people won’t even take a different route to work.

Explore Your Dreams. Take a walk somewhere and let your mind dream a little … no, let it dream a lot! Pretend a bit, oh heck, go ahead and pretend a lot. Who knows what you may become if you give yourself a chance! Befriend an Eccentric Person. To be eccentric means to be a little off-center. Eccentric people are interesting and stimulating, never boring. My wife and I befriended one of my most eccentric professors in graduate school and we all grew because of that relationship. And last, Ask God a Big Question. He has all the answers to every inquiry and all the creativity in the universe. I am certain He would love to share some of His treasures with you. Just ask. • On Oct. 26, 1825, the Erie Canal opens, connecting the Great Lakes with the Atlantic Ocean via the Hudson River. Built in only two years, 83 canal locks accommodated the 500-foot rise in elevation. The canal was 363 miles long, 40 feet wide and 4 feet deep. In nine years, tolls had paid back the cost of construction. • On Oct. 25, 1861, the keel of the Union ironclad Monitor is laid at Greenpoint, N.Y. The vessel -- 172 feet long and 41 feet wide -- had a low profile, rising only 18 inches above the water. The ship had a draft of less than 11 feet so it could operate in the shallow harbors and rivers of the South. • On Oct. 27, 1904, the New York City subway opens. The first line, operated by the Interborough Rapid Transit Company (IRT), traveled 9.1 miles through 28 stations. That evening, the subway opened to the general public, and more than 100,000 people paid a nickel each to take their first ride under Manhattan.
• On Oct. 24, 1945, the United Nations Charter, which was adopted and signed on June 26, takes effect and is ready to be enforced. Representatives of 50 nations attended the first conference. • On Oct. 21, 1959, on New York City’s Fifth Avenue, thousands of people line up outside a bizarrely shaped white concrete building that resembled a giant upsidedown cupcake. It was opening day at the new Guggenheim Museum, home to one of the world’s top collections of contemporary art.

DOUBLE STUFFED DECEIT By Nick Yanez
A
re you prepared to read what may be the most unique Nick Snips article ever? Sure I’ve written about weird and wacky things before; stupid criminals, stories from space, and pointless rants about bizarre and irrelevant events all top the list. But this article is in a league of its own. You see, it’s not the actual content of the column that is unique, but rather the whole idea to write about the content. I know… that was confusing. Let me explain. When I started Nick Snips in 1984, I had a mission in mind – to tell the world about the most underreported story of the week. I was determined to tell people about the stories the mainstream media was trying to hide from them. I was a rebel, with a cause. Of course times change and people age, but I’ve always kept the basic philosophy of Nick Snips over the last 29 years. Today I bring to your feet an extremely over reported story. But I can’t resist. It’s just so ridiculous. As you may have already heard on any major news network, a recent study suggests that Oreo cookies are in fact more addictive than the illegal substance known as Cocaine! The story broke last week when a team of undergraduate students at Connecticut College stumbled upon some evidence that suggested such. Originally, the students were trying to examine the obesity epidemic in lowincome families, and how it related to junk food. What they found was baffling to many. In a “maze experiment”, researchers gave lab rats two options. They could either explore the maze with Oreo’s at the end, or the maze with rice cakes. After little internal debate, the rats
went with the Oreo’s (duh). Similar experiments were done with Cocaine and rice cakes, and the results were eerily similar. However, brain scans show that the “pleasure” area of the brain was illuminated more when they received Oreo’s then when they received the drugs. For those who don’t know, lab rats are used in experiments because their brains scan similarly to human’s. Our emotions, actions, and reflexes are thought to all be processed in the same area as rats. I know it’s demeaning, but it’s true. The shame is - what was originally supposed to be a study to help solve a major problem for families in poverty has become a national headline that supports binge-eating cookie mongers. Now, all of the sudden, it’s not so bad if you eat two packs of Oreo’s a day. I, your humble correspondent, am here to rid you of the mainstream media lies! First of all, this study has yet to be published in any major or respected scientific journal. More than that, the study gave absolutely no evidence to the theory that the rats were actually addicted to the cookies. It just showed that they had a desire to seek Oreo cookies equal or greater than the desire to seek Cocaine. But addiction, as many regret-filled people know, is a whole other animal. Oreo’s are not more addictive than Crack-Cocaine. Hate to break the heart of every proud Oreo over-eater, but that’s the truth. The media wants you to think it is okay to eat an entire box in one sitting; but it’s not. Just eat half the box. If for no other reason then now, you don’t have any excuses. What’s that you say? I sold out? I used an over reported story to get a cheap print? Not exactly. You see, the most underreported story of the week was the truth about the now famous Oreo article. This study should be exposed as a lie; it’s authors as hacks. Finally, it has been done. You’re welcome America. And the everhonorable mission of Nick Snips lives on…

PICK AN APPLE DAY
A
n apple a day really is good for you! Apples pack a nutritional punch. They contain antioxidants, which may help reduce the risk for cancer, as well as helping to lower bad (LDL) cholesterol. They also have vitamins C and K, potassium and fiber. At only about 100 calories per medium apple (about the size of a baseball), they make a wonderful, inexpensive snack. A Tufts University Health and Nutrition Letter (October 2010) mentions two significant studies that show the value of eating apples. A study in Italy found that “consumption of one or more apples a day significantly reduced the risks of many types of cancer compared to consuming less than one apple a day.� A large U.S.-based study indicated that “the number of servings of apples and pears eaten were correlated with a reduced risk of lung cancer.� Apples are one of the more common fruits, and there are lots of varieties to choose from. Here are some suggestions from The Visual Food Encyclopedia. For eating out of hand, select a firm, juicy, tasty, crisp apple such as Cameo, Cortland, Golden Delicious, Jonagold, Pink Lady and Red Delicious. Some apples retain their color better than others. These are the preferred varieties for eating fresh and for making into applesauce. Varieties that work well for sauce include Braeburn, Cortland, Fuji, Gala and Jonagold. Golden Delicious apples also make a tasty applesauce, but because they tend to hold their shape when heated, they would work better for stewed apples.

Pies do best with a drier, slightly acid apple, and one that does not disintegrate when heated. Braeburn, Cameo, Cortland, Fuji, Golden Delicious and Jonagold are good pie varieties. Granny Smith apples are sometimes called for by name in recipes because of their tartness, perfect for a culinary delight. For oven baking, choose a sweet apple, but one that retains its shape. Cameo, Cortland, Golden Delicious, Jonagold, and Pink Lady apples work well. Notably missing in these lists is the Red Delicious. Though just right for eating raw --by themselves, with cheese or peanut butter, or cut in a salad -- they do not hold up to heat well. Apple cider or apple juice are another delicious way to enjoy this fall fruit. Just be sure to choose pasteurized apple juice to avoid illness, especially for children and the elderly. The pasteurization process kills dangerous bacteria that may be found in fresh apple juice. When making juice or cider, a mix of varieties is recommended. The blend brings out the sweetness of some and the tartness of others, making for a rich flavor. Try your favorite baking apple in this recipe for Apple Crisp with Cardamom and Caramel Cream.
APPLE CRISP WITH CARDAMON AND CARAMEL CREAM For a burst of exotic, spicy flavor, purchase fresh whole cardamom and grind the seeds with a mortar and pestle or in a spice grinder. 4 medium (about 4 cups) tart baking apples (Braeburn, Cameo, Cortland, Fuji, Golden Delicious or Jonagold), peeled, sliced 1/3 cup plus 2/3 cup packed brown sugar 1/2 cup all-purpose flour 1/2 cup quick-cooking oats 1/2 to 3/4 teaspoon ground cardamom 1/4 teaspoon ground cinnamon 1/4 teaspoon salt 1/3 cup cold butter or margarine Continued on Page 15

he folks at AutoTrader.com have put together a list of hints and warnings for making smart choices when purchasing a new or used car. Here are some mistakes that can cost you money: • Negotiating the price based on the monthly payment: If you extend the time period for paying off the car, it will reduce your monthly payment. However, you’ll end up paying much more in the end because of the interest over a longer period of time. Negotiate the price of the car first. If the monthly payment is too high, reduce the price of cars you consider.
• Not running a vehicle history report on a used car: This is a fast, low-cost way to determine if the car is being correctly represented. If it’s ever been in an accident, you need to know, especially if it was totaled and written off, or even if it was in a flood. The report also will tell you the mileage, whether the car has been stolen and the history of the title. • Not taking a thorough test drive: According to AutoTrader.com, your test drive should be at least 45 minutes of different types of roads and under different types of conditions. Bring family to see if they’ll fit comfortable in the car, and bring items such as strollers and golf clubs to be sure there’s enough room in the back. • Falling in love with a car before you buy it: Don’t. Stay focused on the serious business of what you’re doing, which is trying to make a smart choice about something that is a major purchase. • Not shopping around: Test drive as many vehicles as possible, and visit multiple dealerships.
• Not getting a mechanical inspection: Just doing a test drive on a used car isn’t enough. There are far too many things that can be wrong with a car that will never show up during a drive.
One place to start is at AutoTrader.com. The site is full of information you need to know before you start your hunt for the right vehicle. Look at the Car Research category, especially the helpful shortcuts to cars rated above 30 mpg, sedans under $25,000 and cars for grads. Or search via your ZIP code or the type of car you prefer.
• Buying what you don’t need: Make your list of wants and needs before you even begin shopping for a car. Don’t be talked into options you don’t need or want.

W
hen a couple marries quite often they vow to take each other “for better, for worse, for richer, for poorer, in sickness and in health”. At the time, they undoubtedly mean those vows. But what happens when “for worse” or “for poorer” happens, and then the couple divorces? My legal practice is primarily focused on representation of small businesses and business owners, not what is termed “domestic relations”; however, when the owner or owners of a small business divorce, there are serious implications for that business, and business matters become a serious issue in the divorce. For example, I recently represented one of my business clients in her divorce from her much younger husband. Husband was what attorneys like to call a “wage slave”: he was employed, at an hourly rate, by a governmental entity, and had at least 20 more years ahead in which to accumulate earnings. Wife had previously also been a “wage slave” as a salaried professional with the same entity, and with a much higher income than Husband, and had been the source of the majority of the marital assets. She was retired, and had been engaged for several years in a small business, investing in, renting out, and flipping real properties, as well as in real estate development of raw land. Wife had used the very considerable amount of money in some of the couple’s retirement accounts to fund the business through a self-directed IRA. Unfortunately, she began this business in early 2007, just before the start of the Great Recession. And of course the Great Recession decimated real property values, resulting in a significant – although short-term – loss in her business investments. Wife’s business still owned the assets; they just were currently worth less than at the time of purchase. When Husband and Wife began the dissolution of their marriage, Husband (who had never been involved with the couple’s finances) was “shocked”
to discover that the “liquid” assets of the marital estate were hundreds of thousands of dollars less than he had thought; he would thus be receiving MUCH less in marital property than he had expected if things were divided up more or less evenly, as they usually are. At the permanent orders hearing Husband tried to argue that he should receive, on top of his approximate half of the marital estate, an extra $200,000.00 or so from Wife, claiming that she had “dissipated” the marital estate, and that he should not have to bear the losses resulting from her business’s activities. Now, the business’s investments had been made well before either party thought of divorce, and had not been made in contemplation of any divorce. The judge ruled against Husband, on the grounds that simply making bad investments, or suffering financial losses because of economic cycles, was not a “dissipation” of the assets of the marital estate by Wife. The judge based this on Colorado cases in which there is a dissipation of a marital estate where a spouse, for example, takes money from the marital estate and uses it to pay down debt against his or her sole property. Another classic type of dissipation is seen where spouse #1 has an affair prior to filing for divorce, and blows retirement savings buying his or her paramour jewelry from Tiffany’s, 3 week trips to a luxury resort in Fiji, etc.

In the case my Firm handled, Husband had married Wife “for better, for worse, for richer, for poorer”, and the fact that the marriage ended on “for worse and for poorer” was the luck of the draw. But Wife had not tried to make Husband “worse” or “poorer”; it was the result of circumstances outside her control. In the last case I described above, spouse #1 deliberately and purposefully took marital assets, which belonged to both spouses, and transferred them to the benefit of a paramour. In that case, the court was not going to let the marriage be dissolved leaving innocent spouse #2 “for worse or for poorer”; guilty spouse #1 was going to be the one left “for worse and for poorer.” This article is intended for general informational purposes only, and does not constitute the proffer of legal advice.
