Costly Mistakes During a Divorce DENISE KOVACH, CFP®, AIF®, NSSA®

Don’t forget about taxes. Be careful about how the assets are divided… it may smell good on the surface, but could stink on the inside. You could be stuck with a larger tax bill. For example, in a case I am familiar with, the husband wanted to give his wife a $1,000,000 IRA, for which he would retain an after‐tax investment account worth $1,000,000. There’s a huge difference in the taxation of both of these accounts and the wife would have gotten the short end of the stick here because the IRA would be taxed at the higher ordinary income tax rate versus the lower capital gains tax rate that the after‐ tax account would be subject to, if it is subject to any tax at all! Accounts subject to the higher tax rate include not only IRAs (traditional, SIMPLE and SEP), but 401(k), 403(b) and 457 plans, and annuities. Don’t forget proper insurance protection. Your ability to collect child support or alimony is only as good as your spouse’s ability to pay. You can request that your spouse obtain adequate life insurance policies (or modify existing policies) to ensure that the payments will continue in the event of death. Also be sure that your spouse has designated the proper beneficiary… you. You may also ask that your spouse obtain sufficient long term care insurance, as well as disability coverage.

Divorce can be hazardous to not only your health, but your financial health, as well. It can also be expensive. You will be faced with many decisions that may affect your financial security. So if you are headed in that direction, take heed to plan carefully ahead of time so you can make rational decisions, not emotional mistakes. Don’t overlook any assets. Be sure to have an inventory of valuable property. Have access to your tax and financial records. Are there any businesses that may need to be valued by an expert? If the assets are great enough, this would be money well spent. Keep track of shared debts, as well. If your name is on the loan with your spouse, then you are still responsible for paying it off. And be careful about a divorce settlement that states that your ex‐spouse will pay it off, because lenders won’t let you off the hook. I have a friend whose ex is responsible for paying for a credit card bill per their divorce decree. However, her ex continually paid it late or even missed payments without her knowing about it, and now her credit score is suffering. Don’t Seek Revenge. If you hire experts who recommend aggressive tactics in an effort to boost your share of the pie, it can be costly… even if the strategy works, because you could end up with a larger piece of a smaller pie. The less you spend, the more you keep. Don’t underestimate expenses. Make sure that you can take care of post‐divorce expenses on your own without relying on your ex. Take the time to write down all of your expenses and create a monthly budget. You will also want to consider the cost of your future expenses by taking inflation into account. Don’t ignore inflation because you will underestimate your future needs. Don’t forget to consider your long‐term financial security. You would be doing yourself a disservice if you only focused on the immediate tasks at hand, such as splitting assets and getting alimony or child support. You need to be aware of how things might look several years down the road. Consider hiring a financial planner to take a look at the proposed settlement agreement before you sign it and advise you on the long‐term financial consequences. Don’t forget about the busy work. After the divorce has been settled and assets divided, it is time to get busy on updating your will, living will, power of attorney, healthcare surrogate, and beneficiary information. Transfer titles for any real estate, cars, financial accounts or any other asset held jointly by the two of you. And, don’t forget to change all of your passwords on any joint, online accounts! Finally, keep in mind that if you were married 10 years or longer, you may be able to receive half of your ex’s Social Security payments at your full retirement age (reduced if taken earlier and you cannot remarry if you want to continue to receive them). Or, if your ex passes you may be entitled to a survivor benefit.
