Do Condo Board Presidents Have More Power Than Vice-Presidents?

Some legal and financial matters require an owner vote, though most operational decisions can be made with just a Board vote.

This question represents one of the more misunderstood topics in Florida Condo and Homeowners Associations. Residential Associations elect Boards of Directors to represent the property owners in overseeing and managing the Association’s operation, finances, and maintenance of its common areas. Owners are often unsure about the authority, duties, and responsibilities that attach to individual Directors. Quite often, the actions and behavior of the Board members themselves raise even more questions among owners in the building or community.

In Florida, there are 2 separate entities involved when organizing residential Condominium Associations and HOAs:

• Association - All individual unit/ property owners are members

• Corporation - a not-for-profit entity created so the Association can conduct business, enter into contracts, maintain financial accounts, pay bills

In Florida, COA and HOA Boards must follow what is in the Condominium Act (FS 718) or the Homeowners Association Act (FS 720), Chapter 617 (Corporations Not for Profit) AND their own Governing Documents. The Bylaws section of Governing Documents covers Officer authorities and duties.

A New Adventure On Stage: Broward Center Students

The Broward Center for the Performing Arts has been selected by Music Theater International (MTI) to be among the first in the country to produce DreamWorks Theatricals Trolls the Musical, Jr., a brandnew original musical prior to its official release. The musical will be presented in the Amaturo Theater at 7:00 p.m. on Thursday, May 23rd and Friday, May 24th.

A special sensory-inclusive performance will take place on Saturday, May 25th at 10:30 a.m.

Audiences will join Poppy and her merry band of Trolls in a brand-new musical adventure set after the events of the first film. In the vibrant land of Berganland, trouble brews when a strict foreign emissary threatens to disrupt the cheerful world where the Trolls love to sing, dance and perform. With the threat of being turned into a diplomatic dish by a vengeful Chef looming over them, Poppy and her friends must revamp their show to meet the high expectations.

In the Trolls’ incredible journey through the world of theater, they prove that no matter what challenges come their way, the show must go on! This fun-filled, cheeky romp that only the Trolls can deliver features catchy songs, lively dances, uproarious comedy and, of course, plenty of vivid colors.

ship bracelet arts and crafts, a Trollsthemed selfie station, giveaways and a Trolls costume contest.

Broward Center students will perform in the musical under the direction of Broward Center artist-in-residence Tammy Holder. Students from Nova Southeastern University (NSU) and local public schools are designing and building the set in the fifth year of a collaboration, in which the Broward Center provides a unique, experiential learning opportunity for college students to work under close faculty mentorship and professional industry guidance.

Middle and high school students from Broward County Public Schools are taking part in a Costume Clinic in which they have the opportunity to apply their visual art skills to costume design by meeting with industry professionals, participating in skills building workshops and submitting design ideas for the show.

The Broward Center has become one of the foremost creative laboratories for the creation of family musicals. In a longstanding collaboration with industry leader Music Theater International (MTI), they have piloted for development ageappropriate adaptations of Beetlejuice, Jr., Matilda, Jr., Something Rotten, Jr! and Best of Broadway, Jr. Revue.

• 2 Green Bell Peppers

• 2 Yellow Bell Peppers

• 1 Lime

• 1 Medium Red Onion

• 2 Tablespoons of Extra-Virgin Olive Oil

• 1 1/2 Pounds of Raw, Peeled Shrimp, Fresh or Frozen

• 5 Teaspoons of Cajun Seasoning, divided

• 1 Teaspoon of Salt

• 1/2 Cup of Ranch Dressing

• 12 Small Flour Tortillas

Preheat the oven to 450 F.

Wash and dry the Green Bell Peppers, the Yellow Bell Peppers and the Lime.

Trim, seed and slice the Bell Peppers lengthwise into thin strips; transfer them

• 2 - 10 Ounce Bags of Cauliflower Florets

• 18 Ounces of Cheese Tortellini, Fresh or Frozen

• 1/2 Tablespoon of Salt

• 1 - 24 Ounce Jar of Marinara Sauce

• 8 Fluid Ounces of Heavy Whipping Cream

• 1/2 Teaspoon of Basil, dried

• 1/4 Teaspoon of Black Pepper

• 2 - 5 Ounces Packages of Baby Spinach

Fill a large pot halfway with hot water,

In a separate large pot over medium heat, stir the Marinara Sauce, the Cream, the Basil and the Black Pepper to combine and bring the Marinara Sauce to a simmer. Once simmering, reduce the heat to medium-low and cook it until it is slightly thickened, 3-4 minutes. Wash and dry the Spinach.

When the Marinara Sauce has thickened, add the Spinach to the pot in handfuls, waiting for the Spinach to wilt slightly before adding the next handful. Remove from the heat and cover it to keep it warm. When the Cauliflower and the Tortellini are done, drain and add to the pot with the Creamy Marinara Sauce; stir to combine. To serve, divide the Pasta between plates or bowls.

• 2 Tablespoons of Extra-Virgin Olive Oil, divided

• 1/4 Cup of Mayonnaise

• 1 Teaspoon of Garlic Powder

• 1 Teaspoon of Salt, divided

• 2/3 Cup of Parmesan Cheese, shredded

• 1/2 Cup of Panko Breadcrumbs

• 1/2 Teaspoon of Paprika

• 1 1/2 Pounds of Boneless, Skinless Chicken Breasts

• 1 1/2 Pounds of Green Beans

• 1/2 Cup of Honey Mustard Dressing

Preheat the oven to 450 F. Coat a baking sheet with 2 Teaspoons of Oil. In a medium bowl, stir the Mayo, the Garlic Powder and a 1/2 Teaspoon of Salt to combine. In a separate medium bowl, stir the Parmesan, the Breadcrumbs and the Paprika to combine.

Working in batches, dredge the Chicken Tenders in the Breadcrumb Coating, pressing to adhere. Transfer to a baking

Bake them until the Chicken Tenders start to turn golden, about 10 minutes.

On a clean cutting board, wash, dry and trim the Green Beans and Set them aside.

When the chicken is golden, flip and bake it until it is cooked through for 6-8 minutes and remove it from the oven.

Preheat a large skillet over medium-high heat.

Add the remaining Oil and swirl it to coat the bottom. Add the Green Beans and the remaining Salt; cook, stirring it occasionally, until it is tendercrisp for 4-5 minutes and remove it from the heat.

Divide the Chicken Tenders and the Green Beans between the plates. Serve them with the Dressing for dipping.

“power” when it comes to Association business operations. The Board of Directors makes decisions as a group for the benefit of the entire Association.

Officer within the Board. Effectively operating a residential Owners Association requires the distribution and delegation of admin istrative duties. In most Florida COAs and HOAs, Directors are also Officers, though an Officer’s job description cannot conflict with (or expand) her or his shared author ity as a Director.

Many Florida COAs and HOAs run into trouble when an Officer assumes that her or his position on the Board confers more power than it really does. Accepting an Association Officer position places spe cific duties on an elected Director, without adding any additional authority or power.

Deciding which Director will take which Officer job occurs at the organizational Board meeting held immediately after an election. When a Board of Directors seat becomes vacant due to a resignation midterm, the Board is empowered to appoint a new Director to serve out the resigned Director’s remaining term. In this case, the newly appointed Director’s duties as an Officer are usually decided at the next scheduled Board meeting.

In a Florida residential COA or HOA, a property owner can be an Association Member, Director, and Officer - all at the same time.

Keep in mind that immediately upon taking a position on the Board, each Director accepts a fiduciary duty and responsibility to all Association members. Fiduciary duty applies to that person’s activities as a Director and an Officer. Florida residential Owners Association Boards usually include these Officers:

• President - leader of the Board and spokesperson for the Association; conducts Board meetings as chairperson; signs Association checks and contracts with vendors; direct contact person for the Association’s management company. Some Board Presidents are considered CEOs (Chief Executive Officers), meaning they make sure the Board’s collective decisions are executed properly.

• Vice-President - steps in when the President is not present or unable to participate; assists the President and Board by handling a wide variety of duties contributing to Association operation

• Treasurer - monitors monthly financial statements, income and expenses; prepares initial draft of the Association’s annual budget for Board discussion and eventual approval; keeps track of YTD expenses in relation to budgeted amounts; delivers a financial report at Board meetings; makes sure the annual Deferred Maintenance Schedule is financially on track with the most recent Reserve Study.

• Secretary - records the proceedings (minutes) of Board and Owners meetings; submits them to the entire Board for approval; supervises communication with all owners.

• Director At-Large - a Director who does not hold one of the above jobs. Many Florida COA and HOA Boards have 5 Directors, though only 4 named Officer positions.

Most Governing Docs contain provisions that with Board approval, another Director may perform another Officer’s

duties when needed. Example - a Director-At-Large may take over the duties of a Treasurer who is undergoing medical treatment. Remember the difference between a Director and an Officer.

All Directors have the same level of authority and power. All decisions must be made by the Board as a group.

Unfortunately for the affected ownermembers, some Directors of Florida residential COAs and HOAs have attempted to increase Officers’ powers within the Association. This has usually been accomplished through owners allowing questionable or improper Board behavior to become accepted practice. Boards have even been known to pursue amending Governing Docs to give Directors and/ or Officers more power, which can be pushed through when not enough owners get involved with Association business.

Boards are structured and how they distribute the workload among themselves.

To answer our headline question: No, Condo and HOA Board Presidents do not have any more power than the other Officers. They have a different job than the others, though no more power. Remember - the keys to owning and living in a Florida residential Owners Association are education and participation. Learn all you can about your Association so you can participate.

Warrantless Surveillance Makes A Mockery Of The Constitution

“Whether he wrote DOWN WITH BIG BROTHER, or whether he refrained from writing it, made no difference ... The Thought Police would get him just the same ... the arrests invariably happened at night ... In the vast majority of cases there was no trial, no report of the arrest. People simply disappeared, always during the night. Your name was removed from the registers, every record of everything you had ever done was wiped out, your

Basically, as Senator Ron Wyden (Democrat, Oregon) has warned, the Deep State wants to turn the American people into extensions of Big Brother.

This is how an effort to reform Section 702 has quickly steamrollered into an expansion of the government’s surveillance powers.

We should have seen this coming.

After all, the Police State doesn’t relinquish power easily, the Surveillance State

in the warrantless surveillance of innocent, law-abiding Americans on a staggering scale.

Indeed, the government has become the biggest lawbreaker of all.

According to the Foreign Intelligence Surveillance Court, the FBI repeatedly misused Section 702 in order to spy on the communications of two vastly disparate groups of Americans: those involved in the George Floyd protests and those who may have taken part in the

Journalist Leo Hohmann reports that the government is also handing out $20 Million in Grants to police, mental health networks, universities, churches and school districts to enlist their help in identifying Americans who might be political dissidents or potential “extremists.”

Ask the government why it’s carrying out this far-reaching surveillance on American citizens, and you’ll get the same Orwellian answer the government has been trotting in response to every so-called crisis to justify its assaults on our civil liberties: to keep America safe. What this is really all about, however, is control.

The government long ago sold us out to the highest bidder.

The highest bidder, by the way, has always been the Deep State.

What’s playing out now with the highly politicized tug-of-war over whether Section 702 of the Foreign Intelligence Surveillance Act gets reauthorized by Congress doesn’t just sell us out, it makes us slaves of the Deep State.

Read the fine print: it’s a doozy.

Just as the USA Patriot was perverted from its stated intent to fight terrorism abroad and was instead used to covertly crack down on the American people (allowing government agencies to secretly track Americans’ financial activities, monitor their communications, and carry out wide-ranging surveillance on them), Section 702 has been used as an end-run around the Constitution to allow the government to collect the actual content of your conversations (phone calls, text messages, video chats, emails and other electronic communication) without a warrant. Now intelligence officials are pushing to dramatically expand the government’s spying powers, effectively giving the government unbridled authority to force mil-

What most Americans don’t get is that even without Section 702 in play, the government will still target the populace for warrantless, suspicionless mass surveillance, because that’s how the police state maintains its stranglehold on power.

These maneuvers are just the tip of the iceberg.

The police state has passed the baton to the surveillance state.

On any given day, the average American is now monitored, surveilled, spied on and tracked in more than 20 different ways by both government and corporate eyes and ears.

Beware of what you say, what you read, what you write, where you go, and with whom you communicate, because it will all be recorded, stored and used against you eventually, at a time and place of the government’s choosing.

Talk about a system rife for abuse.

Now, the government wants us to believe that we have nothing to fear from its mass spying program because they’re only looking to get the “bad” guys who are overseas.

Don’t believe it. The government’s definition of a “bad” guy is extraordinarily broad, and it results

According to the Brennan Center for Justice, intelligence agencies conduct roughly 200,000 of these warrantless “backdoor” searches for Americans’ private communications each year.

No one is spared.

Many of the targets of these searches have done nothing wrong.

Government agents have spied on the communications of protesters, members of Congress, crime victims, journalists, and political donors, among many others.

The government has claimed that its spying on Americans is simply “incidental,” as though it were an accident, but it fully intends to collect this information.

As Journalist Jake Johnson warns, under an expanded Section 702, U.S. intelligence agencies “could, without a warrant, compel gyms, grocery stores, barber shops, and other businesses to hand over communications data.”

What we are dealing with is a government so powerhungry, paranoid and afraid of losing its stranglehold on power that it is conspiring to wage war on anyone who dares to challenge its authority.

When the FBI is asking banks and other financial institutions to carry out dragnet searches of customer transactions—warrantlessly and without probable cause— for “extremism” indicators broadly based on where you shop, what you read, and how you travel, we’re all in trouble. You don’t have to do anything illegal.

For that matter, you don’t even have to challenge the government’s authority. Frankly, you don’t even have to care about politics or know anything about your rights.

All you really need to do in order to be tagged as a suspicious character, flagged for surveillance, and eventually placed on a government watch list is live in the United States.

As long as the government is allowed to weaponize its 360 degree surveillance technologies to flag you as a threat to national security, whether or not you’ve done anything wrong, it’s just a matter of time before you find yourself wrongly accused, investigated and confronted by police based on a data-driven algorithm or risk assessment culled together by a computer program run by Artificial Intelligence. As I make clear in my book Battlefield America: The War on the American People and in its fictional counterpart The Erik Blair Diaries, it won’t be long before Big Brother’s Thought Police are locking us up to “protect us” from ourselves. At that point, we will disappear.

May is Jewish Heritage Month. It is a time to celebrate the many contributions our Jewish brothers and sisters have given to the betterment of our society. One would think this proclamation has been declared many times, but it has only been since 2006. President George W. Bush upon the request of The Jewish Museum of Florida and South Florida Jewish Community declared that the month of May would be the month to celebrate the many contributions of Jewish people in the United States. May was chosen since it was the Anniversary Month of documented Jews in America.

After some research, this date is when the first recorded group of Jewish settlers arrived in New Amsterdam aka New York City. In 1654 - 23 refugees from the Portuguese Inquisition came and founded

Congregation Shaharith Israel along with some other Jewish traders that had arrived a bit earlier. It is the oldest congregation in the United States.

Sadly, this group was stripped of all their earthly belongings on arrival in New York. Jews have always faced Antisemitism. It did not deter them from continuing to settle and become successful. It needs to be noted that the Dutch who controlled the new colony opposed religious plurality so any religious group other than Protestant Christians were often the victims of persecution.

Over history Jewish diaspora has continued to thrive under the worst of circumstances. Many minorities have but for well over 3,000 years Israelites have been stripped of their Temple in Jerusalem. They have been enslaved, occupied, and stripped of their home. I find it so disheartening that so many have been indoctrinated to believe that the Jewish people are the occupiers of their own land. The Jewish people are in their rightful home. She will continue to fight for her sovereignty while protecting democracy.

These struggles are not new but with the advent of the internet we are seeing

As we celebrate Jewish History Month the war against Hamas continues in the Middle East and now on college campuses. During this unrest our residents should be assured that our Police Department has remained vigilant since the October 7th Attacks. They remain on heightened alert and vigilant.

Recently concerns have been elevated since a vandal spray painted Antisemitic remarks on the sidewalk at 14th Avenue and Hallandale Beach Boulevard. It was reported early in the morning by pedestrians and immediately covered up and is

Even with cars locked and secured, criminals are jacking up cars and stealing the wheels or other parts for resale value.

As a result of these types of street crimes the Chief has established a Street Crimes Unit. This unit is in addition to our regular zone patrols. We have six zones in which there are marked and unmarked officers. They take calls for service. This additional unit does not automatically pick up 911 calls unless they are needed. Their task is surveillance, deterrence and solving crimes. We are truly committed to protecting every corner of our community. In October of 2022, the group was invited to perform at the Kennedy Center’s Millennium Stage in celebration of Hispanic Heritage Month. Jose Elias founded the band alongside Julio Cesar Rodriguez Delet, from Santiago de Cuba, in November of 2011

after a 12-year stint with Conjunto Progreso that garnered him a Grammy nomination for the album Masters of Cuban Son. The duo was an instant success and was celebrated for their ability to create a big band sound with such a small lineup. They released their first CD titled Abriendo Caminos in 2012, which featured an original composition by each of the artists “Delicias Caribeña” (Elias) and “Te Lo Perdiste” (Delet). In 2018, the group released their follow-up CD titled Canciones de Julio, which included five original songs and featured the participation of Double Bass Player Yorgis Goiricelaya and Roinel Vega, who performed with the likes of Albita Rodriguez and Oscar De Leon.

The current lineup includes Bass Player Alberto Pantaleon, who has toured with the Afro-Cuban All Stars and is currently touring with Eliades Ochoa in the United States. The group also features trumpet player Tony Perigo, who started his professional career at the age of 17 playing with Cuban songstress Omara Portuondo. Rounding off the group on percussion is Santiago McCook, who is referred to as “El Pulpo” (the octopus), due to his one-of-a-kind multi-percussion setup that allows him to play the role of

three musicians in one.

Next month the group will release their first full-length feature album titled “The Guajiro Triangle.” The album will feature a variety of original compositions that celebrate the traditions of Cuban music in the modern world. The triangle represents the connection between Santiago de Cuba, Havana, and Miami, the group’s home and final destination of this musical journey that was established two centuries ago.

Samambaia

Samambaia captures the essence of classic samba with an elegant and sophisticated twist. Fronted by the enchanting vocals of Rose Max, this ensemble features the elegance of the seven-string guitar, a masterful pandeiro player, an expressive percussive flutist, and a diverse array of Afro-Brazilian percussion. Their music not only embraces the traditional Samba Raiz but elevates it with a contemporary and polished flair that appeals to both purists and new audiences alike.

Concerts at the ArtsPark is a free series of family-friendly events at Hollywood’s ArtsPark Amphitheater at Young Circle (Hollywood Blvd at US1).

Happiness and Hope Go Hand in Hand

Physician-Scientist Reveals Simple But Profound Discovery

Dr. Alphonsus Obayuwana, a physician-scientist and happiness coach, reveals his groundbreaking, five-minute tool for measuring personal happiness in his new book, The Happiness Formula: A Scientific, Groundbreaking Approach to Happiness and Personal Fulfillment. In it, Dr. Obayuwana explains the interconnectedness between hope, hunger and happiness, and introduces a universal unit of measure called the “Personal Happiness Index” or PHI — the operative word being “personal.”

“Everybody has different issues, different hungers, different hopes, different assets, different aspirations,” Dr. Obayuwana said in a recent interview. “Yours are plugged into the equation, and we get your happiness index.”

This PHI, according to Dr. Obayuwana, makes it possible, for the first time ever, to calculate and assign numerical happiness scores to human individuals by plugging their unique hopes, hungers, assets, and aspirations into an equation.

But Dr. Obayuwana is quick to point out that The Happiness Formula is much more than a mathematical equation for measuring happiness.

“It is a book about life, the relationship between human hope and hunger, and one’s overall feeling of personal satisfaction and subjective well-being,” Dr. Obayuwana explained.

The Happiness Formula challenges the findings published in the World Happiness Report, debunks three major happiness myths, and then introduces the Triple-H Equation — the simple but profound formula about what makes life worth living.

Dr. Obayuwana’s discovery offers individuals a simple but scientific way to selfassess their levels of fulfillment; provides happiness seekers with a proven routine for achieving and sustaining a flourishing life; and offers a strong theoretical basis and a firm practical structure for happiness coaches.

In 1979, Dr. Obayuwana (then a medical student) was awarded a national research grant and Smith-Kline Medical Perspective Fellowship to develop an instrument for measuring human hope, with the purpose of detecting hopelessness in time to prevent suicide. The result was the widely used and often cited Hope Index Scale (HIS). This progressed into decades of research that ultimately resulted in The Happiness Formula.

“For full disclosure, my own PHI is 2.923, and that means I am a ‘very happy’ person but not yet ‘flourishing’ by definition,” Dr. Obayuwana added. “Like everybody else, I could be happier, and with the formula revealed in this book, I now know where I am compared to anyone else in the world — who also knows his or her PHI.”
