This need to shed light on government actions—to make the obscure, least transparent reaches of government accessible and accountable—was a common theme for Supreme Court Justice Louis Brandeis, who famously coined the phrase, “Sunlight is the best disinfectant.”
Of course, transparency is futile without a populace that is informed, engaged and prepared to hold the government accountable to abiding by the rule of law.
For this reason, it is vital that citizens have the right to criticize the government without fear.
After all, we’re citizens, not subjects.
For those who don’t fully understand the distinction between the two and why transparency is so vital to a healthy con-

The challenge is holding the government accountable to obeying the law.
Yet this isn’t merely about whether whistleblowers and journalists are part of a protected class under the Constitution. It’s a debate over how long “We The People” will remain a protected class under the Constitution.
Following the current downward trajectory, it won’t be long before anyone who believes in holding the government accountable is labeled an “extremist,” is relegated to an underclass that doesn’t fit in, must be watched all the time, and is rounded up when the government deems it necessary. Eventually, we will all be potential suspects, terrorists and lawbreakers in the eyes of the government.
All of us are in danger. Partisan politics have no place in this debate: Americans of all stripes would do well to remember that those who question the motives of government provide a necessary counterpoint to those who would blindly follow where politicians choose to requires—are individuals such as Julian Assange who routinely exercise their right to speak truth to power.
As I make clear in my book Battlefield America: The War on the American People and in its fictional counterpart The Erik Blair Diaries, the right to speak out against government wrongdoing is the quintessential freedom.

HB-1203 became law that amended the Homeowners Association Act (FS Chapter 720), and HB-1021 became law that amended the Condominium Act (FS Chapter 718). Governing Documents cannot conflict with the applicable Florida Statute, so what happens when a Statute is amended?
Here are some Discussion Points related to our headline question:
• An Association’s Governing Documents may or may not contain what is called Kaufman Language (“...as amended from time to time”) referring to the Homeowners Association Act or the Condominium Act. If similar language is in an HOA’s Declaration of Covenants or a COA’s Declaration of Condominium, the Governing Docs automatically stay in agreement with any amended Statutes. Kaufman Language keeps an Association’s Governing Docs in step with Chapter 720 or Chapter 718 as the Acts may be amended over the years. Best practices suggest that Boards send notices to all Association members/property owners explaining any changes when they occur.
• The language is called Kaufman because it comes from a 1977 Florida Civil Lawsuit in which judgment was made in favor of the Lead Plaintiff, Mr. Kaufman. The suit was filed over FL Statute Application in a North Miami Condominium Association and has become often referred-to case law which is part of this discussion.
• Things get much more complex when an HOA or COA Declaration does NOT contain this Kaufman Language. Without some version of “...as amended from time to time” referring to the Homeowners Act or Condominium Act, periodic Statute Amendments by State Legislators may not apply to that Association. Governing Docs without Kaufman are often considered frozen in time to the version of Chapter 720 or 718 that was in place when the Docs were drafted and recorded in County Public Records. Though it is not quite that simple...
• Attorneys mention the difference between substantive (affecting owners’ rights) changes in the law, and procedural (administrative) changes. Changes affecting owners’ existing rights are handled very differently from procedural changes. This is one of the areas in which some parts of the new laws may apply, and some may not. The Association’s Attorney has to make that call, not the Board of Directors or Management Company. (Procedural changes usually apply without dispute, substantive changes can be challenged when there is no Kaufman language in an Association’s Declaration.)
• Neither of the Bills (nor the resulting Statute Amendments) appear to say they apply retroactively. Unless specifically stated otherwise, Florida Statutes are presumed to apply prospectively (going forward from their effective dates). What does this suggest for application to existing Governing Docs? Do the changes apply to all existing Governing Docs or just those drafted or amended after July 1st, 2024? Without specific language, we will likely have to wait for a few civil lawsuits to create case law.

Florida’s Constitution includes a section establishing a general rule that amended or new State Legislation cannot interfere with existing contracts between parties. This can include impairing vested rights granted under a Declaration, according to attorneys I asked when researching this article. Does this have any bearing on how the new HOA and Condominium Act Amendments are applied to Associations without Kaufman Language in their Declarations? Only your Association’s Attorney can accurately answer that question.
• The Florida Legislature’s intent when considering and enacting changes in the HOA and Condominium Acts was to protect property owners’ rights while promoting proper administration and management of Residential Owners Associations. If Boards do not apply certain parts of the new laws, could that be construed as breach of Fiduciary Duty?
We have already heard rumors of Boards selectively deciding which parts of the Amended Statutes they want to enforce, and which they do not. Some Directors and owners are allowing their own Confirmation Bias to influence their interpretations of what the new laws say. This means that parts of the Amended Statutes supporting their points of view could be taken as applicable and enforceable, while those clauses that conflict with their own opinions could be disregarded.
Scenario 1: A property owner in a Florida HOA Community wants to park her pickup truck in her driveway, not in the garage as the community’s Governing Docs have required since the original Declaration was recorded back in the late 1990’s. She tells the Board they can no longer issue a Violation if she parks her pickup in the driveway because she saw on the evening news that the RecentlyAmended HOA Act says so. Not exactly...
To determine applicability and enforcement, interpretation and legal advice from the Association’s Attorney is needed. This situation may affect an owner’s rights (a
parked in a property’s garage are part of all owners’ contracts with the HOA. Does the Declaration include “...as amended from time to time...” language? Are the posted and distributed Rules & Regulations for residents sufficient basis for continued enforcement?
Scenario 2: A Condominium building has a high percentage of seasonal residents. Not many owners occupy their individual units during the summer months from May to October, so Board meetings are not held during those months. And for many years the Board has been comfortable with newly-elected Directors just signing a self-certification saying they read the Governing Docs rather than attending a State-Approved Certification Class presented by a law firm specializing in COA Governance.
A well-informed owner brings it to the Board’s attention that recently Amended FS Chapter 718 (The Condominium Act) now requires properly-noticed Board meetings to be held at least once each calendar quarter, and that Director selfcertification is no longer an option, class attendance is mandatory and retroactive to sitting Directors.
The Board President quickly responds that their Declaration does not include “...as amended from time to time” (Kaufman) Language, so none of the new clauses apply to them.
The owner reminds the President that the sections on quarterly meetings and Mandatory Director Certification Classes are procedural and do not affect owners’ rights, so they DO apply to their Association.
Who is right? Only an attorney can answer that question after closely reviewing the Association’s Governing Documents and interpreting the Statute Amendments in relation to them.
Are you starting to see some of the complications with applying and enforcing the changes? (Note - Procedural changes usually do apply, even without Kaufman Language.)
All property owners in Condominium Buildings and HOA Communities should be aware of the significant changes made in Florida Statutes that regulate their Associations. I suggest Boards of Directors consult with the Association’s Attorney for clarification on applicability and enforcement, then schedule a Board meeting (with the attorney attending) to present the changes to all owners.
Since it is now summer and many owners are “up north,” it is a good idea to arrange real-time video of the meeting (Zoom or similar platform) to present the changes within the context of your own Governing Docs and encourage owner questions. Announce the meeting well in advance and multiple times in order to promote owner participation. Be sure your Association Attorney is involved from the start to help explain the changes. Any legal fees for this purpose are money wellspent.
Best practices regarding these changes to the HOA and Condominium Acts will take time to sort out. The Florida Legislature has a long history of passing legislation before receiving sufficient input from non-government individuals trained and experienced in the matter being considered, reviewed, and debated.
As mentioned above, future civil lawsuits may create case law on which to base more reliable application of these new Statute changes. After all, Kaufman Language itself is based on the outcome of a civil lawsuit that became very significant Florida case law.
Until then, only your Association’s Attorney can provide dependable, actionable interpretation and guidance.

Hallandale Beach: Get The Full Perspective
How do you get your news? We all know it is easy to find out what is happening on the national level. At times it seems like we cannot get away from the 24-hour news cycle. We watch our local stations to get the news about what is happening in South Florida. Until recently, I was getting both the Herald and Sun Sentinel to my door for printed news. I now have opted reluctantly to get my papers online. I am happy this paper is still in print, but I also read the online version since it is not delivered to our doorstep.
News and information, I believe, are a bit different. In this column, I share what is taking place within our City and cover items of interest that affect our community. I like to consider this column not just news but information, a report per se, of what has taken place at City Hall with a deeper explanation. Not simply a sound bite.
So where else can Hallandale Beach get information about our City? For years we sent out the Hallandale Beach Happenings. It used to be sent out quarterly then biannual and about eight years
the city stopped production. This past year we once again started to mail out the Happenings. After a citizen survey we conducted this past spring, we found residents would like more information. We also found that just like we are all different we all like to get our information in diverse ways. Communication with our residents is critical. While we provide information on a website at: www.cohb.org and have used Social Media there is still valuable information that can be sent through a newsletter. The Hallandale Happening is mailed out to our residents. It includes greetings from myself and the commission, but it also takes a deeper dive into our City Departments. We have 10 Departments with multiple subdivisions. For example, the Department of Public Works covers everything from providing water to sanitation. The Sustainable Development Department, formerly the Building Department, includes Planning Code Licensing and everything that pertains to doing business. Police and Fire do not simply provide patrols and emergency responses, they
offer an array of services and programs.
So, you can see our City provides multiple vital services. We want to make sure our residents have and can get the information they need. We have decided to create the Happening three times a year. Obviously, we also know we need to make sure everyone has access through the media they like.
Over the past year we have had issues with our HB app. All technology evolves over time and the service provider was not able to ensure that Emergency Notifications were going out on time. We have contracted Everbridge Mass Notification. This company is geared to emergencies. We want our residents to be informed. We do have one task! You do need to sign up. You can download the app Everbridge from your app store. Please note the one you want has a logo that looks like a check mark. You can also visit our website at: www.cohb.org and click on notifications. The MyHB App is also a great resource
to connect you to the city. You can link to departments and even report an issue. We also have a Facebook page - City of Hallandale Beach Government. Note: there is only one that is officially the city. People want to connect as part of our community but please remember it is always wise to be cautious. Other Departments have FB including Human Service and Park and Recreation. Our Police Activities League is also a good one to follow. We also have Twitter, Instagram, and YouTube. Annual Water Line Flushing Program Scheduled
During
City of Hollywood Department of Public Utilities will begin its Annual Breakpoint Chlorination, AKA Free Chlorination, System Flushing Program on August 19th, 2024. The Free Chlorination portion of this program will end on September 22nd, 2024. Water Distribution System Line Flushing may continue across the city for an additional two weeks to achieve optimal system maintenance through October 3rd, 2024. The Annual Flushing Program changes the water disinfection type temporarily and uses High Water Volume Pressure to rid the water distribution pipes of accumulated sediments. Flushing is accomplished by Utility Staff opening hydrants systematically and may temporarily cause cloudy or discolored water. The water should settle and clear within a few hours after the pipes have been flushed. The cloudiness comes from sediments in the pipes and is not harmful or hazardous. Flushing typically takes place in the evening hours between approximately 8:00 p.m. and midnight when

• 1 Cup of 100% Cranberry Juice or 100% Cranberry-Pomegranate Juice
• 2 Cups of Ice Cubes
• 1/2 Cup of Seltzer (flavored or plain) or Low-Sodium Club Soda, chilled
• 4 Orange Slices or Lime Wedges (optional)
In a small saucepan over high heat, bring the Water to a boil. Remove the pan from the heat. Submerge the Tea Bags. Steep for 4 minutes. Discard the Tea Bags. Let the Tea Mixture and let it cool for 30 minutes. Pour it into a pitcher. Stir in the Cranberry Juice. Refrigerate it for 2 hours, or until it is chilled.
At serving time, put the Ice Cubes in four glasses. Pour the Tea Mixture into the glasses. Top each serving with the Seltzer. Garnish them with the Orange Slices.
Tip: To create Cranberry-Flavored Ice Cubes, fill the Ice Cube Tray with 100% Cranberry Juice and freeze it.

• 16 Ounces of Frozen Mixed Berries (about 3 cups)
• 2 Medium Bananas, peeled, cut in half and frozen
• 1 Cup of Fat-Free Plain Greek Yogurt
• 2 Teaspoons of Fresh-Grated peeled Gingerroot (optional)
• 2 Teaspoons of Vanilla Extract (optional)
• 2 Teaspoons of Chia or Flaxseeds (optional)
In a small saucepan over high heat, bring the Water to a boil. Remove the pan from the heat. Submerge the Tea Bags. Steep for 4 minutes. Discard the Tea Bags. Let the Tea Mixture cool for 30 min-
utes. Pour it into a pitcher. Refrigerate it for 2 hours, or until it is chilled.
In a Food Processor or a Blender, process the Tea, the Berries, the Bananas and the Yogurt until it is smooth. Add the Gingerroot and the Vanilla, if desired, and process it until it is smooth. Pour it into four glasses. Sprinkle it with the Chia Seeds, if desired.

• 4 Cups of Water
• 4 Single-Serving Single-Serving Green Tea Bags
• 32-40 Sprigs of Fresh Mint, plus additional for garnish, divided
• 2 Cups of Ice Cubes
• 1 Cup of 100% White Grape Juice
• 1/2 Cup of Fresh Lime Juice, about 4 Medium Limes
• 1 Medium Lime, cut into four wedges or Lime Zest twists (optional)
In a small saucepan over high heat, bring the Water to a boil. Remove the pan from the heat. Submerge the Tea Bags. Steep for 4 minutes. Discard the Tea Bags. Let the Tea Mixture cool for 30 minutes. Pour it into the pitcher. Refrigerate it for 2 hours, or until it is chilled. At serving time, add the Mint Leaves to the four glasses. Using a Muddler or a Wooden Spoon, mash the Mint Leaves several times to release the Juices. Don’t mash into pulp and add the Ice. Stir the White Grape Juice and the Lime Juice into a Tea Mixture. Pour it into the glasses. Garnish each one with the Lime Wedges and the Mint Leaves. Tip: To get more juice from Citrus, before slicing, microwave the Fruit on high for 30 seconds, or until it is warm. When it is cool enough to handle, use the Citrus Reamer or a Handheld Juice Press to Juice the Citrus.
