This month was the 20th anniversary of September 11th; the worst enemy attack ever on America’s mainland by terrorists.

Surprisingly, there are those who observed the day by going about their lives as usual. For me that was not possible.

I remember the moment the attacks took place. I remember exactly where I was and what I was doing. I remember having to sit down because the devastation of the attacks drew strength from my body. To this day, 9/11 pulls from me the joy that I experience on other days. I am sobered by the loss of life, liberty, and justice that not only Americans endure, but the world at large. 9/11 was the beginning of underlying sadness and heartbreak for me as I realized that America, and her way of life, were forever changed.

One would think that such an horrific act against us would leave an indelible impression upon our hearts. Sadly, as I look around me, I see that for some, it has not. Many children and young adults do not even know what 9/11 is, and others simply do not care. It appears to me that our government does not even remember what took place on that dreadful day. Even worse, they have opened the gates for more terror to cross our borders and harm our citizens.

40 Year Safety Inspection Committee Changes Will Directly Affect the Future of Our Aging Buildings

Over the last 5 weeks I have had the honor to work on the 40 Year Safety Inspection Committee. Mayor Steve Geller established the committee composed of Senators Book and Thurston, Representatives Gottlieb and LeMarca, Mayor Bolin, Commissioners Monlina-Macfie and Shuham, Michael Chapnick, Esq. Condo Lawyer, President Toby Feuer of Bon Adventure Council, President Johnson of Broward Palm Beach and Dade Realtors, Chair Dan Lavrich of Board of Rules and Appeals, President Nesbitt of Galt Miles Association, Director Dr. Jurado from Broward Environmental Protection, Maite Azcoitia, Esq. Deputy County Attorney and myself. All were picked due to our specialties and connection to legislative policy making.

The committee met for over 25 hours to review all aspects of the 40 Year Program and other items that directly

affect the future of our aging buildings.

There was expert testimony on insurance and future impacts of not fixing buildings, environmental impacts of sea level on structures including seawalls, engineering and waterproofing, concrete restoration and testing, reserve studies and their importance, building officials on the current state of the program and robust discussions on condo board governance and regulations. We also had a day for the public to make comments.

While the catalyst for the committee was the tragic Champlain Tower collapse there were no discussions about it. Our goal was to develop recommendations to send to the State, Board of Rules and Appeals, municipalities, condominium boards and residents. Some of our findings will require changes in Tallahassee to be approved regarding condo laws and other statutes related to building codes.

to do all we can do locally and lobby the state to approve changes.

Our committee is not the only group working on these issues, but we are one group that had participation from 2 Senators and 2 Representatives, all part of leadership. Miami Dade has had the benefit of Senator Garcia and Rodrigues who also have been working on condo reform and 40-year safety issues.

Our last meeting, we reviewed over 22 recommendations and voted on a final recommendation. The final report has not been issued. The major highlights include that associations budgets include reserve accounts for concrete restoration, statutes include that reserves can only be waived if there is a reserves study at least every three years and the waiver must be

A-SECTION approved by 75% of unit owners in a meeting quorum, all sellers of the units must provide information relating to all studies, waivers and condo documentation, realtors contracts must include disclosure of reserves and any waivers, the 40 year will be changed to 30 year with ability for 3 year phase in, inspections to happen every 5 years, seawall inspections to be included, a change in the notification process will start two years earlier, it requires that boards must distribute the inspection report to all owners and conduct a meeting to present the report even if the condo has no deficiencies, requires that that the condo must have insurance, requires that any condo over 50 units or having a budget of over 100,000 needs to have a professionally certified condo manager or that at least three of the board members have taken the required education courses, increase that amount of educational requirement for CAMs to include three hours including educational units in building inspections and maintenance, require the CAMs to file a report in writing to the board of any building inspection issues or concerns, remove the certification waiver form for confirming board education and requires that board members have a minimum of 3 hours every two years that will include condo maintenance, the $4 dollars that is paid per door be only used for its intended purpose and not be swept into the general fund, fully support the ombudsmen and increase his ability to provide education and lastly to have the property appraiser include in the TRIM notices for all unit owners educational material on their responsibilities as unit owners.

As you can see, we covered a lot of bases and now, Staff will be drafting the final recommendations. Our legislators have already started committee meetings in Tallahassee so our local elections will be putting together the proper bills. Once they are drafted, I will keep our readers informed. Considering the tragic collapse and the broad coalition of groups working together hopefully the State will see fit to correct years of erosion to the condominium laws which have created loopholes that have adversely impacted our residents. As a city we will continue to do what we can to ensure buildings are following the rules. Educating our residents will also be critical. I hope to meet with one or more of my colleagues to see what we can do as a municipality in ties in the event items do not pass in the State.

Constitution Day 2021: It’s Time to Make America FREE Again

The Constitution of the United States represents the classic solution to one of humankind’s greatest political problems: that is, how does a small group of states combine into a strong union without the states losing their individual powers and surrendering their control over local affairs? Although the Constitution was adopted on September 17, 1787, a “bill of rights” was demanded and became an eventuality in order to protect the citizenry’s fundamental rights or “first liberties” against usurpation by the newly created federal government. Unfortunately, although the Bill of Rights—the first ten amendments of the Constitution - was adopted as a means of protecting the people against government tyranny, in America today, the government does whatever it wants, freedom be damned. Here is what it means to live under the Constitution, post-9/11 and in the midst of a COVID-19 Pandemic.

The First Amendment is supposed to protect the freedom to speak your mind, assemble and protest nonviolently without being bridled by the government.

It also protects the freedom of the media, as well as the right to worship and pray without interference.

In other words, Americans should not be silenced by the government. To the founders, all of America was a free speech zone. Despite the clear protections found in the First Amendment, the freedoms described therein are under constant assault.

The Second Amendment was intended to guarantee “the right of the people to keep and bear arms.” Essentially, this amend-

ment was intended to give the citizenry the means to resist tyrannical government. Yet while gun ownership has been recognized by the U.S. Supreme Court as an individual citizen right, Americans remain powerless to defend themselves against SWAT team raids and government agents armed to the teeth with military weapons better suited to the battlefield.

The Third Amendment reinforces the principle that civilianelected officials are superior to the military by prohibiting the military from entering any citizen’s home without “the consent of the owner.” With the police increasingly training like the military, acting like the military, and posing as military forces—complete with heavily armed SWAT teams, military weapons, assault vehicles, etc. It is clear that we now have what the founders feared most—a standing army on American soil.

The Fourth Amendment prohibits government agents from conducting surveillance on you or touching you or invading you, unless they have some evidence that you’re up to something criminal. In other words, the Fourth Amendment ensures privacy and bodily integrity.

Unfortunately, the Fourth Amendment has suffered the greatest damage in recent years and has been all but eviscerated by an unwarranted expansion of police powers that include strip searches and even anal and vaginal searches of citizens, surveillance (corporate and otherwise) and intrusions justified in the name of fighting terrorism, as well as the outsourcing of otherwise illegal activities to private contractors.

Day of Tears From Page 1A things I have ever seen to date are the 9/ 11 attacks and the recent American abandonment of the Afghani people. To witness a sea of people run after jet liners, hanging on to them for coveted life and safety, only to be blown off their wings and plummet to death, is heart wrenching.

Their falls bring to mind those falling from the twin towers. And, to see Afghani mother’s handing over their wee babies to American soldiers goes beyond comprehension.

In September of 2001, we vowed as Americans never to forget the crimes inflicted against us on that mournful day.

In August of 2021, our government and a great number of our citizens, did just that.

They forgot about it all. To stand by and allow the actions that have transpired to go without consequences is to support them. In doing so, we are just as guilty and barbaric as those who try to tell us to look the other way or to focus on something different.

The consequences of America’s abandonment will have a far and long reaching effect. America’s safety and that of the people of the world has been colossally compromised. And, who is to blame?

Who is responsible? Responsibility is not solely that of our government; it is ours too. We are the fools who elected such imbeciles, we are the fools that stand by and allow them to do as they will without consequences. I fear, however, that the consequences will soon be ours.

Our troops have lost life and limb to protect and restore our safety and our liberty. Do the lives of those lost on 9-11-

The Fifth Amendment and the Sixth Amendment work in tandem. These amendments supposedly ensure that you are innocent until proven guilty, and government authorities cannot deprive you of your life, your liberty or your property without the right to an attorney and a fair trial before a civilian judge. However, in the new suspect society in which we live, where surveillance is the norm, these fundamental principles have been upended.

Certainly, if the government can arbitrarily freeze, seize or lay claim to your property (money, land or possessions) under government asset forfeiture schemes, you have no true rights.

The Seventh Amendment guarantees citizens the right to a jury trial. Yet when the populace has no idea of what’s in the Constitution—civic education has virtually disappeared from most school curriculums—that inevitably translates to an ignorant jury incapable of distinguishing justice and the law from their own preconceived notions and fears.

The Eighth Amendment is similar to the Sixth in that it is supposed to protect the rights of the accused and forbid the use of cruel and unusual punishment.

However, the Supreme Court’s determination that what constitutes “cruel and unusual” should be dependent on the “evolving standards of decency that mark the progress of a maturing society” leaves us with little protection in the face of a society lacking in morals altogether.

Why has our government let liberty, safety, and decency slip away again? Why do they dismiss the anguish of the survivors and impose policies that only encourage more attacks, more loss and more suffering?

Have Americans become so disconnected that they fail to see where much is given, much is expected? Do we not see that our blessings obligate us with responsibilities, not only to ourselves, but to the world at large? It is a truth that what a person will do to one, he will do to another. Do not bury your head in the sand. If our government will abandon our obligations of protection and safe transition to a nation of people, they will do the same to us. It is merely a matter of time and circumstance.

There were times in our nation’s history where certain groups (races and ethnicities) were considered less deserving than others. Many people have suffered oppressions due to period acceptances of hierarchy and classifications. Although our ancestors have battled against such atrocities and stigmas, do not assume that they might not return and divide us again. If we are not vigilant in our course to protect our constitutional declaration that all men are created equal, we may see that glorious gift fade. In its wake, battles, death, terror, and oppression shall most certainly take hold. These are the spoils of evil consequences; of evil men.

9-11 is a difficult day for me. It is a day filled with heartache for our nation and sympathy for the losses and sorrows of the survivors. If Americans do not stand up to their responsibilities, we will see the fall of our nation. If we see the fall of our

Popular sovereignty—the belief that the power to govern flows upward from the people rather than downward from the rulers—is clearly evident in this amendment. However, it has since been turned on its head by a centralized federal government that sees itself as supreme and

In other words, we have the power to make and break the government. We are the masters and they are the servants. We the American people—the citi-

As for the Tenth Amendment’s reminder that the people and the states retain every authority that is not otherwise mentioned in the Constitution, that assurance of a system of government in which power is divided among local, state and national entities has long since been rendered moot by the centralized Washington, DC, power elite—the president, Congress and the courts.

If there is any sense to be made from this recitation of freedoms lost, it is simply this: our individual freedoms have been eviscerated so that the government’s powers could be expanded.

Yet those who gave us the Constitution and the Bill of Rights believed that the government exists at the behest of its citizens. It is there to protect,

For instance, some argue that we need to make America great again. I, for one, would prefer to make America free again.

9/11 is a day of tears for the world. Let us pray and commit ourselves to the promise that we shall not fail. Let not the lives of our beloved soldiers, first responders, and innocent civilians be in vain. Terror is evil and governments who support it openly, or covertly, are evil too.

Let us right our wrongs and seek to protect the weak, squelch the oppressors, install liberty, and share prosperity for all.

That’s the American experience. It is our American dream, our duty and it used to be our honor.

In this lies our only security and our only hope. We believe that an informed citizenry will act for life and not for death.” (The Emergency Committee of Atomic Scientists in Post-War America, Oregon State Library) As Einstein plainly recognizes, society

is susceptible to atrocities due to ignorance, misinformation, and lies. His worries are the scientific consequences associated with unchecked control and use of atomic energy. He implies that the enormity of its power can be good or terrible dependent upon its application; yet control is possible through the conscious involvement of an informed and involved society.

Einstein knew that if left to the control of governments, nuclear power would be the end of the world. Terror and evil governments require that same cost. If our citizenry fails to put forth the required investment, civilization will suffer horrific acts of terrorism, enormous losses of life and the death of liberty.

My prayers are with you, they are with our nation; but most of all, they are with the surviving families of 9/11 as they suffer through the memories of this tragic day. May they and the world at large, never experience such a cowardice act of terrorism ever again.

We Want to Hear from You: Dixie Highway Complete Streets Project As part of Broward County’s Complete Streets Initiative, the City of Hollywood and the City of Hallandale Beach are considering a project to transform travel lanes within existing sections of Dixie Highway between NE 215th and Sheridan Streets that currently have three or four travel lanes per direction with proven excess capacity. As preparation for this project, the City of Hollywood and the City of Hallandale Beach worked together to create a traffic study for the Dixie Highway corridor in 2014. The study concluded that after the implementation of the Complete Streets project, the corridor will operate at adopted level of service standards during peak period traffic conditions, not restricting the flow of traffic.

The Plan recommends converting the Dixie Highway and 21st Avenue corridor into a Complete Street, transit-ready corridor that provides access to the proposed commuter rail sta-

Leaving Afghanistan Was the Right Move, Time to Turn Our Attention to China

The time had come for the U.S. to leave Afghanistan. Both Presidents Biden and Trump were correct, and it’s time we stop this bipartisan assault on their foreign policy decisions related to our withdrawal from Afghanistan. We must shift our resources (both military and financial) from nation-building to preparedness for a militarizing China.

We’ve all seen the disturbing images of desperate people trying to escape Afghanistan and the Taliban committing acts of brutality against peaceful protesters. As tragic as that is, we must accept that our withdrawal was the correct decision. Afghanistan was a losing proposition and remaining there ran counter to our own interests and national security. Both presidents realized this and had the conviction to act. We lost countless Americans and spent billions of dollars for nothing; it is not the job of the U.S. to spread democracy and be the global protector of human rights. A better allocation of those resources is toward the Pacific to prepare for our greatest threat, a militarized China.

The Taliban was able to take complete control of Kabul and its six million citizens in just 10 days without force. For the most part, they were welcomed into the city by countless Afghans, and their success left most American bewildered, angry, and heartbroken. We wanted to share the

American dream where hard work and dedication can give one a better life.

Where differences are protected by a constitution that ensures equality for all.

We wanted girls to be protected and educated and able to determine their own futures. We naively assumed the Afghans wanted this too. How can we expect Americans to die protecting Afghani freedom when they refused to fight for their own? Their military and security forces simply ran away, and their democratically elected president fled like a coward.

We did not betray the Afghani people.

We left every building-block they needed to establish and protect their democracy and they simply refused. We’re all left wondering, what was our national sacrifice for? It is clear there was no strategic plan to evacuate Americans and others from Afghanistan before the set deadline, as evidenced by the images we see on the nightly news. Despite this chaotic situation, more than 120,000 Afghans have been airlifted to freedom and that is something positive. The American people are welcoming Afghani refugees, and this compassion shows who we are as a people, and we should be proud. It is time we give both Biden and Trump the credit they deserve for putting American interests and security first, something their two predecessors failed to do. President Bush created a

Performing arts centers in South Florida and around the state are adopting similar guidelines to create what is, in effect, an industry standard that enables artists to successfully tour the nation.”

As an alternative, fully vaccinated guests have the option of presenting documentation of full vaccination with acceptable documentation being the original vaccination card, a printed copy of the vaccination card or a digital copy of such card. The final dose must have been received at least 14 days prior to the performance date.

Ticket Policies Refunds are available for anyone who submits confirmation of a positive test result in the tenday period prior to the performance. For tickets purchased through resale or third-party sites, ticket holders should contact those purchase sites directly to determine their refund policies. It is the responsibility of the person buying the tickets to communicate these policies to all those who will be using the tickets. Performance ticket holders who do not comply with these policies may be required to leave the theater without refund.

The new policies have been informed by guidance of public health officials including the Centers for Disease Control (CDC). These guidelines will be continuing to evolve as the environment changes, and may be accessed on the venue’s website.
