PNP and PDM vote to repeal the controversial tax bill By Hayden Boyce Publisher & Editor-in-Chief

In a rare but strong showing of bi-partisan unity, Members of Parliament (MPs) from the ruling Progressive National Party (PNP) and the Opposition People’s Democratic Movement (PDM) on Thursday February 1st, voted to repeal the controversial Valued Added Tax (VAT) law. During a special sitting of the House of Assembly in the Island capital of Grand Turk, speaker after speaker from both sides of the political divide passionately expressed their opposition to VAT, which will be introduced in the Turks and Caicos Islands at a rate of 11 percent on April 1st, 2013. The motion to repeal VAT stated: WHEREAS the Interim Administration announced in April 2010 its decision to introduce Value Added Tax’; AND WHEREAS the Governor made a decision to sign the Bill into Law on July 19, 2012 despite the division in his Advisory Bodies; AND WHEREAS there has been a consistent and strong opposition to the implementation of VAT since its announcement; AND WHEREAS both major Political Parties ran on an Anti VAT Platform; AND WHEREAS the Roe Report commissioned by the Interim Administration speaks to the Turks and Caicos Islands enjoying strong revenues from its existing tax system; AND WHEREAS the Appropriations Committee met in public and the lack of preparedness for the implementation of VAT on the part of TCIG was evident; AND WHEREAS it is the expressed view of the majority of the Hon. Members of the Assembly that VAT is detrimental and not suited for the economy of the Turks and Caicos Islands AND WHEREAS this Hon. House of Assembly bases its position on expert opinion, examples from around the world and local knowledge and experience. BE RESOLVED that this Honorable House agrees to repeal the Value

PASTORS WANT REMOVAL OF GOVERNOR TODD, CFO, AG

These two pastors – Bishop Reuben Johnson (left), pastor of the New Testament Church of God on millennium Highway in Providenciales and Brandford Dean of the National Church of God are calling for the removal of Governor Ric Todd, Chief Financial Officer, High McGarel Groves and Attorney General Huw Shepheard. Johnson said his reason for protesting was that he was unhappy with the direction of the country and the role the Governor’s Office was still playing even after an elected government has been put in place. He said that there were now two simultaneous governments operating in the Turks and Caicos Islands, and that the elected government was not allowed to function on the mandate of the people. Johnson decried the state where government does not have office space from which to operate in Providenciales. Pastor Dean, who shared his colleague’s view, said that the Governor’s Office must turn powers over to government it now holds.

He added: “There should be no taxation without representation. Mr Speaker we, the elected members of this house, got here through the vote of the electorate who entrusted us with their confidence that we would act in their best interest and that of this country. Even the passage of the VAT ordinance at the level of the pseudo democratic bodies of the Advisory Council and the Consultative Forum was undemocratic as it was not passed by the majority of the voting members; but after all there was no need for the Governor to take the advice of members of those bodies. Mr Speaker we now found ourselves with an elected government. With no help from the Interim Administration the people of these islands are now knowledgeable about the good and the overwhelming bad that VAT would have on the Turks and Caicos Islands, and the people of the Turks and Caicos are screaming NO to VAT. The various prominent business groups, such as the TCIBC, Economic Resorts Association, Chamber of Commerce and numerous local businessmen are saying no to VAT and has produced evidence of the concerns about VAT.” The Premier noted that the persons elected by the people in general stand opposed to VAT. He added: “We are all saying NO to VAT. Mr Speaker we are all giving advice to the Governor and the FCO that VAT is bad for the Turks and Caicos Islands. Mr. Speaker is this another case where the Governor or FCO do not have to take the advice of the persons whom the people elected to represent them? Is this truly a democracy? Minister (Mark) Simmonds said that the matter of VAT was left to elected Government. All of the actions of the Governor and the FCO go contrary to that statement. It was stated that we the elected government has submitted no alternative revenue measures to VAT. This is quite to the contrary. Mr. Speaker, their idea of revenue alternatives is the implementation of property tax, income tax or sales tax as opposed to improving the efficiency of the current tax system and new revenue to be derived from the diversification of the economy. We are opposed to the European Union's tax policy of high tax and tax harmonization as revenue raising measures.” Ewing said the fiscal position of the Turks and Caicos Islands Government and future financial outlook without VAT is promising, adding that the current taxation system works and has been

working for some time now. “Mr Speaker, import duties has been and continues to be one of the main revenue earners for the TCIG. Mr Speaker this is a tried and proven method of taxation for this jurisdiction where greater than 90 percent of goods are imported and the compliance rate for collection is high. Mr Speaker if we try to change this policy at this time in favour of VAT during this period of economic fragility we run the risk of diminishing the revenue of government and hampering the achievement of our government's mandate,” the Premier added. Opposition Leader Sharlene Robinson stated: “Today is a historical day and though a sad day for a people with an elected Government. I am pleased to be a part of this day when we have all come together in such an important stance to stand on our convictions, beliefs and well placed expert advice from practitioners and world leading gentlemen on TAX. I trust that this stance will achieve the desired outcome but if not I say to the Government that the Opposition believes that this is a disaster to avert and we are committed for the long haul. We believe that this is an attack on democracy and if we do not stand today, then we can expect many more days to come of fighting to have elected voices heard. This is not intended to be a bucking of heads and should from me not be met with that spirit. I am a tax payer and a resident in these Islands and whilst I stand for others, I stand for myself. Mr Speaker, I believe that there must be a greater respect for local knowledge and authority and I sincerely believe that we must try to engage but when this fails, we must stand up and push until our voices are heard. If we fail then it is not the House of Assembly that fails, it is that the UK would have failed democracy.” She continued: “The anti VAT campaign began when persons realized that this was no real consultation and that this system was already decided upon and many who knew the pitfalls of the system, the possible impact on businesses and consumers began to react and publicly. Some people tried to taint peoples’ motives but Mr Speaker, I stand on conviction on this issue and I frankly don’t care what is motivating anyone right now to stand with me and others to fight this issue.” The Opposition leader stated: “Mr Speaker the VAT became a major issue and despite the widespread opposition and the calls to slow down and let us talk about it, the Governor in July last

The Governor never replaced these positions for wider consultation and proceeded with a third of its possible membership vacant. Mr Speaker, there was a scandal even around the debate in the Forum as much of the debate seemed confused and misled. The vote in the end resulted in 5 yes and 5 abstentions, a clear divide and in the Advisory Council an absence of 5 members (stories of members resigning over the issue) was very telling. The Governor’s spokesperson was forced to respond to the criticism of it passing the Advisory Council with more than three quarters of its members absent, and I quote he says, we do not need a quorum to pass the VAT Bill. Mr Speaker, this was a time for the Governor again to step back and take note that something was inherently wrong. Mr Speaker the Governor was forced to pass the Bill in his own discretion. Whilst everyone was advisory, there was a clear message that this nation was divided on this issue and overwhelmingly leaning towards opposing the implementation of VAT.” Robinsons said her party came out strong on this issue and like the PNP, ran on an anti VAT campaign pledging to work together to address this issue if needs be. “Mr Speaker, we were then informed by Minister Simmonds in what we thought to be a fresh breath of air, that VAT was a matter for the Government of the TCI. Mr Speaker the long and short of it is many challenges have been met and the end result of a Government’s request to delay its imposition has been rejected. The Minister, the Governor and the CFO remain firm in their stance and we see to this date no real evidence based studies to support this model of VAT or its introduction in any form nor any evidence based projections as to the revenue it will raise and evidence to suggest that the new services sector now being taxed will yield at least the difference in the shortfall in duties due to the reduction in customs rates. Mr Speaker, I genuinely feel that we are shooting in the dark and this level of certainty drives guides my thoughts. Mr Speaker it is the same feeling I had when NHIP was introduced and when Customs was toyed with and the CPF was introduced. We will all remember that both rates have been increased all because they did not yield what was expected in revenues.”

Press statement from Michael Misick in response to the AG statement

I have read with amazement the comments of the Attorney General Huw Shepheard as to why I cannot return home voluntarily. Firstly, I nor my legal representatives have ever been given any previous assurance of my return nor was I ever asked to show up at any police station at any given time to answer any questions. Sometime during 2011 my legal representatives received a letter from Helen Garlick saying that she would be inviting me to return for questions. My lawyer responded by asking for full disclosure and subjects of the questions so that I could be prepared to answer them. My lawyer never received full disclosure or the subject matter of the questions. The next time I heard anything from SIPT or Helen Garlick was in February 2012 when they issued an Interpol Red Alert for my arrest. By that time, because of my belief that I could not get a fair trial and that me and my colleagues are being prosecuted for our political beliefs I had already applied for political asylum in Brazil. Once the Red Alert was issued, I was stuck in Brazil and could not travel home freely. There was no window of opportunity given to me to voluntarily show up. I am a political prisoner having been arrested illegally at the request of the Attorney General Huw Shepheard and the British Government and documents they filed in the Brazilian Supreme Court requesting my detention and extradition to the Turks and Caicos Islands. For that reason, the only way that I can be released from prison is if the AG and the British Government withdraw the

prison order and agree to my voluntary return. My stay in jail is not up to the Brazilian authorities as the AG asserted but it is up to the TCI Attorney General Huw Shepheard, Special Prosecutor Helen Garlick and the British Government. In spite of still holding the belief that I cannot get a fair trial, my lawyers and I have offered for me to voluntarily return home in exchange for the AG and the British Government withdrawing my prison order. I was arrested on December 7th 2012. Today is January 27th 2013. If the AG and others were truly interested in me coming home to face justice why for almost 60 days they had not made the official request for my extradition or accepted my offer to voluntarily return home? It is obvious that the delay is about revenge and my continued political persecution. They want to punish me by keeping me locked down in a maximum security prison in Brazil for as long as they can. Reality is that I have applied for political asylum in Brazil and there is a Red Alert out for me, so how am I a flight risk? Why would I abandon my asylum application and leave Brazil? In fact I cannot do anything without the AG and Helen Garlick agreement to lift the Red Alert. By these facts I again call on the AG and Helen Garlick, if they are truly interested in fairness and justice, to allow me to come home voluntarily so that I can answer questions and begin to prepare my defense since they have already decided that I will be charged even before asking me the first question. It makes no sense to waste more of the TCI tax payers’ time and money on a long and drawn-

out extradition process. The AG knows that extradition is a process and that the process must be followed weather I consent to be extradited or not. I have publicly declared my willingness to come home voluntarily, I am interested in justice. I am interested in coming home to clear my name. The AG and others can facilitate my speedy return so I can face their justice or they can continue to make excuses and continue their prosecution of me and punishing me without a trial by leaving me in jail in Brazil because they are upset that I did not return home a year ago. This is revenge, not justice. The choice is theirs not the Brazilian authorities. I could be home to face whatever charges they choose to place on me in 24 to 48 hours of the AG and the British Government agreeing to my voluntary return. There is recent president for this in England where at least one high profile prisoner did agree to voluntarily return there to face charges after being away for many years. My situation is no different from theirs. It is highly unusual for a person that is a country’s most wanted to want to voluntarily return and the authorities of that country refusing to accept him or to expedite his return. Something is wrong with this picture. It is up to you Mr. Attorney General.

The Progressive National Party (PNP) –led government is moving to regulate the growing water sports industry in a number of ways, including making Belongers getting a fair shake. This was disclosed by Premier Hon. Dr. Rufus Ewing, while addressing the fortnightly post cabinet news conference at the Tourist Board in Providenciales on Wednesday, January 30. He said those concerned were presented to him while on his country-wide tour of the country, which was aimed to assess the needs of the people and the community. Dr. Ewing said that there were lots of complaints from locals, that they were being sidelined from the industry, and as a result, government has placed a moratorium on new application for licenses until a mechanism is worked out to ensure Belonger preference in the industry. This regulation is not only centred around the safety of the industry; it is centred around the competitiveness within the industry. Many persons felt that Belongers were being squeezed out of the business in the industry, and so we are committed to – one – putting in place a moratorium on new licenses because it is a reserved category and we want to enforce it as a reserved category until we can put proper mechanisms in place to ensure that

there is Belonger preference in that particular industry as we grow this economy,” Dr. Ewing said. He pointed out also that some of the Belongers already in the industry were complaining that the insurance coverage required to compete in the industry was too high and was calling on government to address that issue as well. “Government will have to find ways to assist them in dealing with that. Meetings were held in Providenciales and Grand Turk. DEMA (Department of Environment and Maritime Affairs) and the Ministry of Environment would be taking those on board, in trying to form new regulations for that particular water sports industry. Premier Ewing said also that while on his tour, he met with individuals involved in the cultural market, who too, had a great deal of concerns, including sales of produce, upkeep of their facilities and the challenge of customer accessibility. “And we are committed to working with them and to improving their opportunity to sell their produce in that cultural market and also beach locations,” Premier Ewing said.

Preliminary 2013 electoral list available

Turks and Caicos Islanders will be given the opportunity to view the 2013 Preliminary Electors list from Friday February 1st 2013. Supervisor of Elections Dudley Lewis will post the Preliminary List of voters at sixty three (63) locations across the Turks and Caicos Islands. After the publication of the Preliminary List, voters will have fourteen (14) days to scrutinize it and to make any claims or objections. Elector’s can make claims on their own or others behalf, as set out in Form 3 in Schedule 1 of the Election Ordinance. Similarly, objections can be made as set out in Form 4 in Schedule 1. An elector who is off Island for the next two weeks may appoint an agent to act on their behalf as set out in Form 5 in Schedule 1. The agent must produce a sworn affidavit that they are acting on the claimant’s behalf. Premier gives SIPT ultimatum to leave Hilly Ewing Building

Premier for the Turks and Caicos Islands Hon. Dr. Rufus Ewing is to issue an ultimatum to the British-commissioned Special Investigation and Prosecution Team (SIPT), to vacate their current home – the Hilly Ewing Building on Providenciales, which IS the established office for government on that island. The upstairs of the Hilly Ewing Building is referred to as the Premier’s Office. Deputy Premier Hon. Washington Misick made the disclosure during a post cabinet news briefing at the Tourist Board office in Providenciales on Wednesday, January 30. Misick told the roomful of journalists that Premier Ewing has decided to issue an ultimatum to the SIPT “in the strongest possible term” for them to find alternative accommodation, quickly. “Their being in the building is actually hampering the business of government now, and I believe that it is untenable,” Misick said. For his part, Premier Ewing stated: “We told SIPT to get out. And I already told my minister of Works (Government Support Services, Hon. George Lightbourne), and I also put the PS and put that department on notice that they (SIPT) need to get out. I know it is probably difficult

finding other places in Provo that suit their location, but I need them out A.S.A.P.” The Premier said that by virtue of the SIPT occupying the building, government’s thrust to be effective was being impeded. He said that ministers, when on Providenciales to conduct the nations business, are being forced to conduct those affairs in available department buildings. “It is hampering our efforts because this building, where we are now holding this press conference; it’s because of the upstairs of the Hilly Ewing building not available. And that is the same reason why we find ourselves in different offices, because those offices (at the Hilly Ewing Building) are not available. “Ministers now operate out of the various ministries that they are assigned to. Most of them have ministry departments that they operate from, like Hon. (Washington) Misick, here, the Tourist Board falls under his ministry, so he has the pleasure of using this particular office. I will have the pleasure of using the Ministry of Health’s Office, which I used to use before (while being Chief Medical Officer). “Hon. PDM expects Cheshire Hall by-election verdict By Vivian Tyson

The People’s Democratic Movement is expecting nothing less than a by-election ruling when High Court Judge, Madame Justice Margaret RamsayHale returns with a verdict in the Cheshire Hall Constituency election petition ruling. Ramsay-Hale told the court on Wednesday, January 9, that she would return a verdict soon, after lawyers representing PDM candidate Isaac Oral Selver and Minister of Health Hon. Amanda Misick of the Progressive National Party (PNP), made their closing arguments. Selver is claiming that Dr. Edward Smith, who finished a distant third in the race, was not nominated properly, and that the 58 votes he received could have changed the dynamics of the election outcome, since he lost to Hon. Amanda Missick by 30 votes. Missick polled 394 to Selver 364 votes. Selver, who has been busy making the rounds in the media lately, said all indicators pointed to irregularities in Smith’s nomination. Prior to the trial, Smith, a retired United States college professor, maintained that he had given up his US citizenship, which has become a requirement for nomination and election under the

new interpretation under the 2006 Constitution. It came out during the hearing that the college professor had not relinquished his US ties. Smith, who participated in the 2012 census gathering, had made a sworn oath of allegiance to Queen Elizabeth II, and according to him, that should have been enough to serve as severance of his US bond. Like Selver, his party bigwigs and supporters, a number of PNP supporters are also bracing themselves for a by-election announcement. Both parties seem to have been hit by the reality that election could be called any day now, and so they have been busy in the constituency – more so the PDM. From last week-end, the PDM has embarked on a massive clean-up exercise in especially Kew Town and Glass Shack. Selver said the clean-up team comprised mostly of volunteers, who lent their time, effort and resources during the process. Between Saturday, January 26 – when the cleanup began – and its plateau on Tuesday, January 29, more than 500 bags of garbage were collected from the two communities alone. Selver said that in the last general election on November 9, he made a number of blunders while on the campaign trail. He said those errors would

not be repeated this time around. The slip-ups, he said, included not visiting some homes in the constituency. In the meantime, the PNP staged a fun day in Kew Town, behind the Ball Park, on Saturday, January 26. The PNP however, downplayed the fun day as part of an election preparation thrust for the constituency, rather stating that it was mere attempt by its standard-bearer of staying in touch with the people there. And while the PDM have been busy taking about the prospect of a by-election, the PNP, which is the government, appeared not interested to make any public pronouncements on the matter. Journalists made at least two attempts during recent news conferences to get the party to elaborate on the prospect of a by-election, but the party did not budge. A change of hand in the constituency would also mean a change in government, considering that the PNP emerged as razor-thin 8 to 7 victors of the PDM in the 10 community and five countrywide (15-seat) constituency elections. A result in favour could see the country electing its first female Premier in its history in the person of Sharlene Cartwright-Robinson, who has taken over the leadership mantle from ousted leader Pastor Oswald Skippings.

Royal Turks and Caicos Police carries message to schools

The Royal Turks and Caicos Islands Police Force has taken its message of community policing in schools across the country, imparting the nature of the job to students and also what practices they should take to safeguard life and property. The campaign is headed by the public relations arm of the force, headed by Special Constable and Police Spokesman, Audley Astwood. The schools on the roster for visitation were the Clement Howell High, Enid Capron Primary School, Charles Hubert James Primary, Raymond Gardiner High School, Adelaide Oemler, Doris Robinson Primary School and Maranatha High School. Radio presentations were also on the cards as part of the campaign. “We have been speaking to the students about crime prevention, safety tips and other police matters including our cadet program and recruitment to join the police Force. He noted also that such sites are open to unsavory postings, such as pornography. “I know that a lot of the school children do not know the dangers that they are putting themselves, families and also their friends in, using the

internet. You could see the look on some of their faces when some of the things were mentioned, especially when I mentioned about those who like taking pictures of their homes and posting them online or those who like to brag about their new iPad or their new laptop that they have; or those who like to brag and letting people know that their whole family was going off the island. “You could see the look on their faces as if to say ‘wow, I have done this before’ or ‘I didn’t realize that I was putting myself and my family members in danger’. Anything that is considered private to you should not be posted on the internet. They should not be posted on Facebook or Twitter. If it is private to you and you post it on the internet, it becomes public – the internet is, in fact, a public domain,” Clarke noted.

GOVERNOR OFFERS HIS PERSPECTIVE ON THE FIRST THREE MONTHS OF JOINT GOVERNMENT WITH LOCAL POLITICIANS

As the anniversary of the first three months of locally elected Government in the Turks and Caicos Islands (TCI) approaches over the next week or so, His Excellency Governor Ric Todd reflects from his perspective both as Chair of the Cabinet and from a Constitutional standpoint, where he is responsible for ensuring good governance in the TCI, on his experiences since the general election on Friday November 9th 2012. Progress “I think that the people of the TCI can be satisfied with the progress of democracy and the appointment of a newly elected Government,” said Governor Todd. “As a key partner in developing this nation, the British perspective sees many positives in the manner in which Government business has been conducted so far. This provides a good platform for future progress. Many of the members of the House of Assembly and the Cabinet are new to their roles, as indeed are a number of senior public servants, but their desire to serve the people of TCI to the best of their abilities is there for all to see. “From my side, I have regular meetings with the Premier and other Ministers and Cabinet meetings are conducted professionally and cordially; I thank my fellow Cabinet members, from the Premier down, for their support in this. “I would like to take this opportunity to thank the public servants of TCIG, led by Deputy Governor Anya Williams and the six Permanent Secretaries, for their hard work, dedication and commitment to working for and with the newly elected Government. I know that this is as much appreciated by the new Ministerial team, as it is by me. “The UK remains committed to ensuring the success, safety and sustainability of all of its Overseas Territories. That is why arguments that there are somehow two governments operating here are simply confused. The long standing Constitutional arrangement agreed by TCI’s own political and civil leaders as far back as 2006,

and refreshed in the TCI Constitution Order 2011, clearly lays out the roles and responsibilities, the checks and balances, that are required to ensure the ongoing good governance of this country. I think that many of the challenges to the Constitution, the law, Integrity Commission rules and codes of conduct are either politically motivated or ill-informed as to their contents. Quite simply, the TCI Government and the UK share responsibility for the Territory, with each delivering to their Constitutional responsibilities. “The UK remains firmly in the TCI’s corner. When we made the $260m loan guarantee to TCI’s debtors, after the maladministration of the past, we provided multi-million dollar proof of this commitment. We want a strong two way relationship with the people and institutions of the Islands which is modern, successful and sustainable. But we should not forget TCI’s national debt and where this country stood financially only a few years ago when the government was essentially bankrupt. “Whilst the national debt is smaller than at the height of the financial crisis, it is still too large for TCI to sustain after the debt guarantee expires in 2016 and has to be brought down by the Government, therefore, to something more manageable and less expensive to refinance.” Governor Todd went on to address some specific issues that have arisen over the first three months of elected Government. VAT “VAT has been one of the bigger issues in the media recently. My regret is that the advantages of VAT to this country have not been as well communicated as they might have been. This has perhaps meant that the noise of the well orchestrated and very well privately funded anti-VAT campaign has rather dominated the debate. “The TCI set out upon the path toward VAT some years ago, and it was clearly a feature of the 2011 budget statement too. UK Ministers have consistently made clear that they are open to credible and sustainable alternatives to VAT, and have been awaiting proposals on this for

some time. “Their perspective remains that VAT is good for the TCI public finances, but they are willing to work with the elected government to implement a credible alternative. Meanwhile, implementation of VAT has continued as we approach the commencement date of 1 Apr 2013. FCO Minister Mark Simmonds has very constructively suggested that TCI implement VAT now and review it in a year, which also provides a further 12 months in which to develop workable alternatives. The Premier, Hon Dr Rufus Ewing, wrote to Mr Simmonds about VAT and the FSPS on 29 January. Mr Simmonds office has confirmed receipt of the letter. Mr Simmonds will reply as soon as he can.” Leaks “I have always said that Government should be open, transparent and accountable. But I very much regret that private exchanges of e mails between members of the Cabinet and the content of discussions in Cabinet have been leaked to the media. “In one particular case, given false reporting, I am obliged to set out the facts. I informed the Premier privately and then Cabinet on 24 January that I found unacceptable the nomination of an individual to the board of an important Statutory Body because that individual had made a racist insult and threatened violence against a public servant. “If anyone thinks that racist abuse and threats of violence against named individuals is an unimportant or petty issue or that those who aspire to elected or public office should make such abuse and threats in public let them say so. “There is open public debate on TCI – and there should be. But I am confident that all responsible people on TCI, and especially political, social and clergy leaders, will support me when I say that there is no place for personal abuse and insults in that debate. As President Obama noted in his inauguration speech, insults are not debate.”

Warner, her client submitted his itinerary to SIPT on two previous occasions and was allowed to travel freely. However, she said, when Hanchell sent an itinerary to travel to Brazil from January 31 to February 4th, his request was denied by SIPT who indicated in an affidavit filed in the Supreme Court that they felt that Hanchell was a flight risk and that he may even seek political asylum in Brazil and not return to the Turks and Caicos Islands. SIPT also said they were concerned that if Hanchell was allowed to go to Brazil he would “collude” with Misick in discussing matters that are presently before the court. Maroff, who revealed that Hanchell’s appointment to spend six hours with Misick in jail was already approved by the British Consulate in Brazil and prison authorities there, said it was “ridiculous” for SIPT to suggest that Hanchell would want to seek political asylum in Brazil, especially given what Misick is currently experiencing in that country after he was arrested there on December 7th. Furthermore, she said, if Hanchell wanted to discuss any aspects of pending cases with Misick he could have done so on many occasions

via telephone, Skype, email or other means before the former Premier was arrested. Madame Justice Ramsay-Hale said she did not find any merit in the SIPT’s suggestion that Hanchell was a greater flight risk now than before, simply because he was going to visit Michael Misick. She noted that he had travelled on two previous occasions and had returned and there was nothing to suggest that he would not return on this occasion. In addition, she said that the bail conditions that were originally set by Hanchell did not contain any non-contact clauses which would have prevented him from interacting with Misick. “I just can’t see any reason to say no to allowing him to have his passport,” the judge said. Judge Ramsay-Hale said that bail was set by the court and not by SIPT and that in the final analysis it was up to the court to decide whether bail should be varied and on what terms and conditions. She said that SIPT does not have exclusive rights to come before the court to make representation for or against bail conditions, adding that this right also extends to defendants, but the court will have the final say.

Government submits “limited expenditure package” to UK

The Fiscal and Strategic Policy framework that the Rufus Ewing administration has submitted to the United Kingdom Government for ratification does not include the controversial, and for some, dreaded Value Added tax, instead included what is referred to as limited expenditure package. Explaining the measure, Premier Ewing said that his government would submit an estimate of expenditure less $10 million, which is similar to that of the 2012/2013 budget, but said that it will include alternative revenue to VAT, which could rake in even more money than the proposed contentious tax, which is expected to hit the tracks on April 1. “We have been given two options by the British Government – either put in place Value Added Tax, income tax or property tax or you go forward with limited expenditure. What we put forward was that we intend to go forward with limited expenditure but at the same time put in place all of the alternative revenue measures that we have committed to put in place as an alternate to VAT. “We are operating on a 2012/2013 budget. The increase for the 2013/2014 budget would have been $10 million. We would not increase it as much as $10 million from a budgetary standpoint, but we are quite confident that the revenue measures that we have put in place will allow us to still have expenditure in excess of $10 million,” he explained. He added: “What we would have to do is conduct

a mid-year review, also a mid-year supplementary budget to allow additional expenditure within the mid year.” In order to collect the revenues proposed under the limited expenditure package, Ewing said that his administration would take a paper to parliament for approval, as soon as time would allow. Some of the alternative revenue measures would include an increase in head tax on cruise ship passenger and small increase in accommodation tax. “The main area of finance was that of Value Added Tax, and again, as a government, we are not committed to supporting Value Added Tax. I have already written to the (UK) Minister (Mark) Simmons, basically stating our position that we are not supporting Value Added Tax. “We also submitted to the minister, our Fiscal and Strategic Policy framework, which will form the basis for the preparation for the 2013/2014 budget, and he should be getting back to us on that particular document, which we will then take to the House of Assembly for a debate at the House of Assembly level,” Ewing explained. He said that his government already has the blessings of players in the hospitality industry to go ahead with the revenue-raising measures. “We will take a paper to cabinet next week, to address the regulations that govern (revenue collection); so we can improve on compliance, and so that we can expand the income tax base, so we can look at the head tax with regards to Carnival Cruise and other tax-raising measures.

“Most of these ideas we got from the people themselves from various sectors, and so, we aim to put them in place. We are quite confident that we can raise the revenue that will far exceed what VAT would have raised,” he said. Upon assuming office, the Dr. Rufus Ewing administration had asked the United Kingdom Government to initially delay the tax’s implementation for a year, so that his administration could craft an alternative revenue stream. But after British Minister in charge of the FCO, Mark Simmons said that he was not sold on the idea, and that such a long wait could affect revenue collection in the TCI, the government then altered the timeline from a year to six months. The government also presented its alternative revenue measure, which it claimed could raise in excess of $15 million - $5 million more than what the UK said VAT would fetch. However, the British rejected the timeline as well as the revenue proposal, dismissing them as not realistic, and has instead opted to stick with VAT’s implementation. As a result, Ewing, at a news conference two weeks ago, threatened that his government would not play any part in assisting the UK government establishing VAT in the Turks and Caicos Islands. He told media representatives that he believed VAT would be oppressive to many Turks and Caicos Islanders and would sink them deeper into poverty.

Haiti Consulate scheduled for February opening By Vivian Tyson

The acrimony that Haitians living in the Turks and Caicos Islands undergo to conduct personal and other businesses with Haiti could end on February 8, with the opening of a consular agency in Providenciales. The consulate is to be sited at the Southern Shores building along the Leeward Highway on that island, and The SUN has learnt work has been far advanced on the preparation of the office, as furniture has already begun to be moved in. Voluntary Haitian Consular Agent, Donald Metellus said that work is in high gear to meet the consulate’s opening date. He said that the office was scheduled to open on January 24, but because of hectic schedule of some of the Haitian officials who are expected to be in attendance, the date has been pushed back. “It was scheduled to open on the 21st (January) but they have postponed it again for the 8th (February). We are hoping that it would not be delayed again, because people here require a lot embassy service. The consulate would be there to provide all kind of services. It will ensure workings between the TCI and the Haitian governments; it would provide service for the Haitian Community like passport renewal and stuff like that. “It will also provide visas for people who require a visa to fly to Haitian. It will also provide documents for persons here who, say, want someone to purchase something in Haiti on their behalf,” Metellus said.

Metellus said that the Haitian Government, who will underwrite the staffing at the consulate, is yet to indicate how many employment positions would be available there. “It is up to the (Haitian) government to finalise that number. The office should have a main consular, vice consular, secretary, front desk clerk and receptionist, and so on. I am not able to tell you how much, but I believe it could be more than five persons,” Metellus said. Metellus said that a Haitian consulate for the TCI is more than 10 years late, and because of that void, a number of opportunities have been missed by the Haitian government to forge deeper ties with the Turks and Caicos, where thousands of Haitians currently call home. “I have been waiting for a consulate for more than 10 years. I was willing more than them, to set-up a consulate here for them. And because there was no consulate here, I have been helping people voluntarily. I would be more than happy to see that people who need certain immigration service could go and do their business and have their business done on a timely basis,” the voluntary consular agent said. It is also expected that the opening of the Haitian Consular Agency in the Turks and Caicos Islands should seek to better address the influx of illegal Haitian vessels into the country laden with people from that jurisdiction who have perennially been trying to escape arid economic conditions there. in the Western Hemisphere, often make treacherous voyages to the TCI, risking their lives in search of jobs. However, over the years, many have lost their lives during the two to three day journey. On September 10, 2011, 10 Haitians drowned off the coast of South Dock while being transferred on a cargo boat onto a wooden sloop. The authority also found drugs on the cargo boat and arrested a pair of Bahamian siblings. They were however, not charged with relation to the trafficking or drowning of the men. They later faced the TCI courts where they were sentenced. It has also been said that criminal enterprises here and Haiti have been profiting from the illegal voyages. Governor Ric Todd told the media early last year that human trafficking ring was flourishing between the two countries and called those involved to desist from such practice. He said at the time: ““I don’t want to trespass on the grounds of the police and the Ministry of Border Control, but I think it is clear that there is a criminal cooperation and collusion between people on the island and off the island, to bring about illegal migration. “And also, from something which happened on my first weekend here; often, the people who try to make their way illegally are victims of crime, and as you know, a number of them died. So, it is quite clear that this is a difficult and potentially tragic business. It is a criminal enterprise.”

Astwood made the disclosure while

giving an interview to The SUN shortly after completing a pep session with fifth form students at the Clement Howell High School on Tuesday, January 29, at the school’s auditorium. According to Astwood, a great deal of the antipathy was no fault of the police, but a culture cultivated mostly from the listening of American gangster rap music.

He said too, that the condition of absentee parenting was also a contributing factor antagonism towards the police. “I think it has a lot to do with the music that they are listening to – certain gangster rap that they are listening. A lot of students alluded or outright said so. I thing that there is also some deeper societal issues at hand, where you do not have father figures in the home or cases where both parents are working. “And young kids are always looking for a mentor – someone to look up to. Unfortunately, if they can’t have a positive role model, they will fall victim to a negative role model. So, we are hoping to today to be here to be positive role models for the kids,” Astwood said. Astwood noted that he went to the school with a scripted message but for the most part, had to adjust that strategy and engage in myth-busting preconceptions that many of the students had of the police. “Most times when the students made certain comments about the police force, it (incident) did not actually happen to them; it is something they heard from someone, who heard from someone else. But I have assured them that the police department falls under the law also.

The law is a level playing field, and we are not here to abuse our power; we are here to help the community, and we want to assure them about that,” Astwood declared. The police spokesman was quick to point out that the visit to the Clement Howell High was not as a result of what many described as a feud that took place in December, by opposing gang members, resulted in adult outsiders, said to be party to one of the factions, invaded the school with weapons among which what appeared to be firearms. There were also reports that shots were fired during the incident, but that was rebuffed by the police. Astwood stated that, while the police visit was not about the incident, the outreach was held to prevent another such incident from happening. “I know the media is still in a frenzy about what happened last month at Clement Howell High School. We, at the police force, would like to see that there is not a repeat of that. So, the whole idea is to show the kids here that the police are indeed their friends; they are not anyone to be despised or feared. “And at the end of speech today, we were able to do just that. I don’t think that we impacted everyone, but I think we have impacted a lot of students here today. So, it wasn’t a trip in vain,” Astwood said.

In my view, the Governor ought to have indicated to the appellant that, as a result of advice he had received including that from the CFO, he intended to suspend him and ought to have afforded him an opportunity to comment on the proposed suspension. For this reason and for the reasons set out below, I conclude that the suspension of the appellant (Edwards) was unfair and in breach of natural justice. The appellant was never at any stage given an opportunity to make any representation as to why he should not be suspended.” According to the Court of Appeal, in suspending Mr. Edwards the Governor acted on the advice of the CFO who had been a party to what the Chief Justice found to be the acrimonious emails passing between the CFO and Edwards. The Court of Appeal stated that it is clear from his Affidavit that the CFO Hugh McGarel-Groves was of the view that a serious disciplinary offence (the leak to the TCI Post) appeared to have been committed by someone close to the Edwards or by Edwards himself and that the appellant was refusing to arrange an investigation into the leak. This, according to the Court of Appeal, led to the CFO informing the Governor that he had serious concerns about the position taken by Mr. Edwards. The Governor in his affidavit stated that he sought advice from the CFO and the Attorney General and that he was advised under clause 9 of the contract of employment to end the contract with 3 months notice. BACKGROUND TO THE LEAK Giving the background to the case, the judgment stated that in late 2011 as part of a more general downsizing exercise within Government, meetings took place between senior officers concerned with the public finance and a Human Resource Consultant. Two particular meetings took place on November 24th 2011. At those meetings reference was made to the outsourcing of Government audit work. Two days later matters which had been discussed within the small circle, and possibly when only the applicant and the Chief Financial Officer (CFO) were together otherwise alone, appeared in an article posted on the TCI Post. This publication gave rise to a suggestion from the CFO that confidential information discussed between him and Edwards had been leaked. Edwards was asked for ideas as to how the information may have leaked and responded with a suggestion that it may well have been leaked by the CFO and his staff as opposed to Edwards and his staff. A subsequent exchange of emails took place, some of which was copied to the Governor. This somewhat acrimonious exchange of messages ended with a suggestion from the CFO that Edwards should launch a leak enquiry and a response from Edwards

that he would only do so on the directions of the Governor.” Following the meeting with the CFO on November 24th 2011 the CFO, by email dated November 28th 2011 enquired of Edwards as to whether he had any suggestions how the discussions of the private meeting of November 24th 2011 got into the TCI Post. By email dated November 29th 2011, Edwards replied that he thought that the CFO had made public comments or some other disclosure because by Friday morning (that is after the meeting) his office was abuzz with phone calls and staff coming to him ‘with claims to have confirmed statements that KPMG was taking over their jobs’. He indicated that because of this, he scheduled a staff meeting that day at which ‘he outlined to the staff the discussion I had with Mr. Catchpole and yourself, the previous day. Later that day, the CFO replied to the appellant indicating that the constant leaks by civil servants to the Turks & Caicos Islands post were unacceptable. He went on to point out that on Thursday morning 24 November 2011 the meeting took place and he understood by that evening the details were on the Turks & Caicos Islands post. The CFO indicated that he neither emailed nor said anything to anyone and that the leak can only have come from the Chief Auditor’s end. CONFIDENTIALITY BREACHED The CFO went on to point out that “staff who breached confidentially in this way are committing a disciplinary offence”. He stated further that while it’s normally impossible to identify the source of such leaks he indicated that in this instance he thought that Edwards should be able to and would take the appropriate action accordingly. He reminded the Chief Auditor that the audit team must be beyond reproach. The following day November 30th 2011, the appellant responded to the CFO noting that he had copied his bold accusation which he made to other persons. Edwards indicated that he did not consider it appropriate for him to do so and he informed the CFO that he wished to alert the Governor of the situation. Edwards indicated that he took strong objection to the CFO’s accusation that he, Edwards, had leaked the information to the Post. In his response, the CFO told Edwards that he found his response to be very different from what he would have expected of the Chief Auditor. He indicated that he would have expected him to be anxious, as he was, to identify the culprit and to bring him or her, at the very least, under some sort of investigation.

COURT OF APPEAL SAYS GOVERNOR WAS WRONG TO SUSPEND AUDITOR GENERAL OVER A LEAK TO THE TCI POST By Hayden Boyce Publisher & Editor-in-Chief

The Court of Appeal ruled that Governor Ric Todd unlawfully suspended Auditor General Albert Edwards from his duties because of circumstances surrounding an investigation into a leak that appeared on the TCI Post. In a ruling handed down on Thursday January 24th, the Court of Appeal which comprised President Rt. Hon. Edward Zacca, Hon. Mr. Justice Elliott Mottley (who wrote the decision) and Hon. Justice Richard Ground, ruled that “the decision of the Governor dated December 16th 2011 suspending the appellant (Edwards) from the performance of his duties as Chief Auditor was made in breach of the rules of natural justice and is therefore unlawful”. Queen’s Counsel Ariel Misick of the law firm Misick and Stanbrook appeared for Edwards, while Rhonda-Lee Brathwaite-Knowles appeared for the Governor. Edwards, a native of St. Kitts, was first appointed the Chief Auditor of the Turks and Caicos Islands in May 2008. On September 16th 2010 a new contract was entered into for a period of two years commencing July 3rd 2010 until July 2nd 2012. Acting on the advice of Mr. Hugh McGarelGroves, Chief Financial Officer (CFO) and the Attorney General Huw Shepheard, Governor Todd informed the Chief Auditor by letter dated December 12th, 2011, that his contract of employment was terminated with immediate effect. The letter of December 12th 2011 was withdrawn and another letter was written by the Governor. This subsequent letter, which is undated, was delivered to Edwards on December 16th. BREACH OF NATURAL JUSTICE The judgment stated: “It would seem that the Governor concurred in the opinion expressed by the CFO that the appellant (Edwards) was the person who leaked the confidential information (to the TCI Post) or was in some way concerned with the leak and concluded that his position was untenable. In reaching the conclusion that the appellant’s contract should be terminated for misconduct, the Governor appears to be acting on the advice of the CFO and also in conjunction with another person, possibly the CFO, hence his statement “we concluded that we should end his contract”. “The decision to terminate the contract for misconduct may very well have been a decision in which one person who was a party to “the acrimonious series of emails” took part. The Governor appeared to have acted on the advice of the CFO a party to the email correspondence without affording the appellant an opportunity to express his view on what had

The CFO then made a formal request of the Chief Auditor as the head of the department “to take appropriate action to investigate this apparent disciplinary offense and identify which member of your team leaked the information about our private conversation to the TCI Post as there can be no other source unless you mentioned our conversation to someone outside your team.” By email dated December 1st 2011, Edwards wrote to the CFO as follows: “I understand the words “the leak must have come from your end’ to implicate me, involve me, include me and all persons around me including my staff, my family, my friends and perhaps some foes. I further understand it to mean that I am the beginning, the nucleus from which the tentacles of this so called “leak” has sprung.” Edwards then went on to set out his reasons sharing his concerns expressed by the CFO and that he did not have the time or resources to allocate to searching for a ‘needle in a haystack’. As far he was concerned the matter was closed unless he was directed by the Governor to carry out an investigation. Later that day, the CFO responded to the appellant in the following terms: “Albert, Then I must be blunt. I have no doubt whatsoever that the leak came from your end and you must know who you spoke to that created the leak. If you are unwilling to carry out an investigation, you risk implicating yourself at the very least as an accessory to the disciplinary offence that appears to have occurred, in addition to the reputational damage to yourself and your department that will inevitably now arise if you do not allow an investigation to identify the culprit and have this matter cleared up. It is really your choice. Allow an investigation or be judged accordingly. I am sure the Governor’s view, like mine, is if you have nothing to hide why would you not investigate. “ Edwards replied to this email on December 2nd, 2011, stating: “I have no doubt whatsoever the leak came from your end. “ The emails were being copied to the Governor. CFO AFFIDAVIT CRITICISES TCI POST In his affidavit, parts of which were reproduced in the 20-page judgment, the CFO stated as follows: “On the following Monday morning, 28 November 2011, someone mentioned to me an article had appeared on the TCI Post, ... a popular web blog that is not normally public blogsite, or likewise or Wikileaks and other websites used for publishing leaked information: it’s a website run by disaffected civil servants and mainly aimed at civil servants, but it’s style of writing is to use hate-filled language to target individuals at all level in the TCIG that are considered to be supporting the interim administration and threaten them in all sort of nasty ways. Several senior individuals in the TCIG, including myself, have suffered verbal and physical abuse over recent months and we have no doubt that much of this is being encouraged and orchestrated by the TCI Post and its contributors. Therefore, refusing to investigate a leak to this particular website, with its deliberate intent to cause individuals to feel seriously threatened, is very different matter from considering an investigation into a leak of confidential information to any other external party.” His affidavit continued: “The article was about the Audit Department closing and attributing myself and Stephen Catchpole as the decision makers. I looked on the TCI Post and found the articles that had been posted on the 26 November 2011. It seemed to me that the articles must have been triggered by the meetings Stephen Catchpole and I had separately with the Chief Auditor on 24 November 2011. Since the meeting I had with the Chief Auditor was a private one on one meeting and no one but he and I knew what was discussed at

the meeting. I could not understand how TCI Post could have obtained information about the meeting or indeed the meeting had taken place at all. I knew I had not discussed the meeting with anyone, nor emailed anyone else about it, so I thought perhaps Mr. Edwards had discussed the meeting with one of the staff, who had then leaked the information to TCI Post. Therefore I sent Mr. Edwards an email at 1.52 pm. on Monday 28 November 2011 asking him if he could suggest how our private discussions might have gotten into TCI Post.” “This then started a chain of emails .... which are self explanatory. The responses from the Chief Auditor were generally unhelpful and flippant in tone, which I found rather unacceptable behavior by someone in the position of Chief Auditor. The second email I sent to Mr. Edwards in this chain at 11.32 pm. on Tuesday 29 November 2011 was also copied to Mr. Stephen Catchpole and Susan Malcolm, Permanent Secretary for OPSM, since Stephen Catchpole had featured in the same leak and Susan Malcolm, because the leak represented a potential disciplinary offence and as OPSM she should be informed of this. This email exchange with Mr. Edwards ended on 2 December 2011, when he sent his final email asserting that he had no doubt the email came from my end. Following this email exchange I recommended to the Governor that I had serious concerns about the position taken by Mr. Edwards, the Chief Auditor, and his refusal to consider my request that he arrange for an investigation to be conducted into the leak to the TCI Post. In essence, a serious disciplinary offence appeared to have been committed by someone close to the auditor, if not the auditor himself, and the Chief Auditor was refusing to arrange an investigation. I also raised with the Governor that in my opinion Mr. Edwards could not continue as Chief Auditor due to the lack of trust that had been created by his recent behavior, which meant that I could no longer feel confident that it was safe for him to be allowed access to confidential information in case he, or someone close to him, might leak it.” FAULTY LETTER The judges observed that the letter of suspension sent by the Governor to Edwards stated that he was being suspended pending consideration of whether he should be dismissed for misbehavior. The judgment added: “In my view, this was not a sufficient indication of the allegation against the appellant (Edwards). The letter made no mention of misbehavior on which the Governor was relying. By letter dated 16 December 2011 to the Governor, Mr. Misick pointed out that the appellant had “not been told by you what he is alleged to have done to constitute misbehavior which justifies his removal from office.” It was not until his letter of 20 February 2012 to the appellant that the Governor stated what were the allegations against the appellant. These allegations were “your handling and involvement in events leading to the publication of sensitive information entrusted to you in the course of your duties at TCIG.” The appeal judges said that while Governor Todd went on to state that he understood that Edwards declined to participate in an internal inquiry with officials prior to his suspension, he did not specify this alleged refusal was a ground for his suspension. They noted, however, that in his affidavit, the Governor stated that he concluded that Edward’s position was untenable as he refused to conduct an investigation into the leak of confidential information. The judgment continued: “In my view, it cannot be said that the appellant (Edwards) knew why he was terminated by letter of 12 December) or subsequently suspended (undated letter received

16 December). The Governor in his letter dated 12 December 2011 immediately terminated the appellant’s contract under Clause 9 of the Contract. In so doing the Governor acted under the early termination clause and did not set out any reason for terminating the contract. Clause 9 permitted either party “at any time without having or giving any reason, on giving (at the option of the terminating party) either 3 months’ written notice or paying 3 months’ salary in lieu of such notice.” The Court also observed that from early in the trail of emails, the CFO formed the view that the appellant was himself responsible for the leak of the confidential information. Yet the Governor sought advice from the CFO, a party to the acrimonious emails, without at the same time affording the appellant an opportunity of being heard on the content of the emails and on the representations which the CFO made to the Governor. “It is not asserted that urgency prevented the Governor from affording the appellant the opportunity of being heard as to whether he should be suspended pending investigations into his conduct,” the judges added. .In his subsequent undated letter received by Edwards on 16 December 2011, Governor Todd withdrew the letter of 12 December. This, according to the Appeal Judges, meant that the Governor was no longer purporting to terminate the contract under the early termination Clause (Clause 9). They added: “The subsequent letter stated that the appellant was being suspended from duties on full pay pending consideration of the termination of the contract of employment on the grounds of misbehavior. The letter did not stipulate the particular section of the Constitution to which the Governor was purporting to act. Presumable, the Governor was acting under the provisions of Section 85 ( 4) of the Constitution which provides the “ ... Chief Auditor may be removed from office only for inability to discharge the function of his office. . .... . ......... for misbehaviour and with prior approval of a Secretary of State.” The letter did not specify what was the misbehavior alleged against the appellant nor did it provide him with an opportunity of making representation.” The judges stressed that the Governor clearly, came to the conclusion that the appellant ought to be removed from the position of Chief Auditor and hence be purported to act under Clause 9 of the contract dealing with early termination. The judgment continued: “Was it fair in these circumstances for the Governor to have consulted with and to have acted on the advice of the CFO in these circumstances? In my view, the answer is no. Fairness required that, having sought the advice of the of the CFO and having wrongfully terminated the contract, a decision to which it may be reasonably be inferred that the CFO was a party, the Governor, before suspending the appellant pending consideration of the termination of his employment for misbehavior ought to have notified the appellant what were the allegations of misbehavior being made against him and ought to have informed him that he intended to suspend him pending an investigation into these allegations in order to ascertain whether there were grounds for dismissing him under the Constitution. He ought to have afforded him the opportunity to explain his reasons for not conducting an inquiry when directed to do so by the CFO and to give his view on the source of the leak of the confidential information. Fairness required this as it is not disputed that the Governor was acting on the advice of the CFO.”

Beyoncé admits singing 'with my prerecorded track' at inauguration Yes, Beyoncé can sing -- all by herself, thank you very much. That much she showed Thursday, when she opened her appearance before reporters in New Orleans -- where she's set to headline the Super Bowl XLVII halftime performance Sunday -with a stirring, a cappella rendition of the national anthem. It was the same tune she sang just over a week ago at the inauguration of President Barack Obama But on that momentous occasion, Beyoncé admitted on Thursday, she had some help. The world-renowned pop singer told reporters that "she decided to sing along with my prerecorded track," a decision she made in part because she didn't have time to rehearse with the U.S. Marine Band and had had "no proper sound check." "I did not feel comfortable taking a risk," Beyoncé said of what she called "a very, very important, emotional show for me." "I wanted to make (Obama) and the country proud." The admission about the January 21 performance wasn't a complete shock. A spokeswoman for the Marine Band initially said Beyoncé "was not actually singing" the national anthem. Hours later, the band backed away from the spokeswoman's remarks, releasing a statement that said the group was not in a position to know for sure. But that hardly stopped the speculation that one of America's most famous contemporary singers had lip synced at one of the nation's most important moments. Two days after the inauguration, an inaugural official who asked not to be identified said Beyoncé "did not sing live,"

even though "she was spot on" in her prerecording, which was taped separately from the band and then married together. The Houston native had been mum on the topic until she discussed the matter Thursday. Calling herself a perfectionist who will typically "practice until my feet bleed," she conceded worrying about potential problems during "a live television show" taking place outside on a chilly Washington day. Even with all the hubbub -- and her insistence that "I always sing live," with that exception -Beyoncé expressed no regrets about her rendition of "The Star-Spangled Banner" in front of the Capitol. "I'm very proud of my performance," she said.

Rihanna on Chris Brown: We know what we have

Rihanna has opened up like never before about getting back together with her exboyfriend, Chris Brown, and what it means for her public image. "I decided it was more important for me to be happy," she tells contributing editor Josh Eells in the new issue of Rolling Stone, out Friday, February 1. "I wasn't going to let anybody's opinion get in the way of that. Even if it's a mistake, it's my mistake. After being tormented for so many years, being angry and dark, I'd rather just live my truth and take the backlash. I can handle it." The couple's public reconciliation comes less than four years since Brown assaulted Rihanna the night before the 2009 Grammy Awards. Brown pleaded guilty to assault and performed community service, but he remains on probation. "When you add up the pieces from the outside, it's not the cutest puzzle in the world," Rihanna says. "You see us walking somewhere, driving somewhere, in the studio, in the club, and you think you know. But it's different now. We don't have those types of arguments anymore. We talk about s***. We value each other. We know exactly what we have now, and we don't want to lose that." And Rihanna says that if Brown were ever to display a hint of his past behavior towards her, she is ready to walk. "He doesn't have the luxury of f*****g up again," she says. "That's just not an option. I can't say that nothing else will ever go wrong. But I'm pretty solid in the knowing that he's disgusted by that. And I wouldn't have gone this far if I ever thought that was a possibility."

The 31-year-old said the practice of performers singing along with prerecorded tracks is common in her industry. Still, she promised she won't be doing it Sunday during the Super Bowl halftime show. "I will absolutely be singing live," Beyoncé said. "This is what I was born to do." As to exactly what she'll do, and with whom, she didn't say much Thursday, dodging a question about whether she will be joined by her Destiny's C h i l d bandmates or her husband, critically acclaimed rapper Jay-Z. While Alicia Keys and Jennifer Hudson (the latter singing with the choir from Sandy Hook Elementary, the Connecticut school where 20 children were killed in December) also will perform, Knowles will command the stage once the San Francisco 49ers and Baltimore Ravens break for halftime. "I'm trying to learn to live every moment, because these moments are not promised to us," she said of her excitement, recalling how she took off her shoes and ran the first time she set foot on the Superdome field. "This is such a huge opportunity." It's also a huge challenge, including working on a stage that needs to be put together in just more than seven minutes, condensing her career into one 12-minute set, then performing in what is often any given year's most watched program on television. Beyoncé admitted being nervous, but also said that after more than four months of preparation, she's prepared. "I've had a 16-year career, and all of the things that I've done have prepared me for this," she said. "I'm ready."

Grammy double whammy as JT, Streisand sign on!

Don't call it a comeback! Two big names will be taking to the stage after years of taking time off from music. First up: Barbra Streisand. The legendary singer and actress is set to perform at the Oscars for the first time in 36 years with a "very special performance" that will pay tribute to music and movies. Streisand, who last performed at the Oscars in 1977 to sing "A Star is Born," will be a welcome addition to the February 24 telecast, according to show producers Craig Zadan and Neil Meron. “In an evening that celebrates the artistry of movies and music, how could the telecast be complete without Barbra Streisand?" said the producers. "We are honored that she has agreed to do a very special performance on this year’s Oscars, her first time singing on the show in 36 years." The other big name to step back into music is Justin Timberlake, who will be bringing his "Suit and Tie" to the Grammys. Timberlake, who has taken time off in recent years to focus on business ventures and his acting career, will perform at the awards show for the first time in four years. The jack-of-alltrades star broke news of his third upcoming solo album, "The 20/20 Experience," earlier this month.

Barbados to hold general election on February 21 BRIDGETOWN, Barbados--Barbados will hold general elections on Feb. 21, the country’s prime minister announced as he grapples with slumping popularity over his handling of the Caribbean island’s economy. Prime Minister Freundel Stuart of the ruling Democratic Labour Party will seek his first full term in office. A former attorney general, Stuart was appointed prime minister in October 2010 following the death of his predecessor, David Thompson. New elections were scheduled to be held this year on the 166 square mile, most easterly Caribbean island of 300, 000 people, which won independence in 1966 and has overcome the decline of its once-powerful sugar industry to grow wealthy through high-end tourism and offshore financial services. Barbados, which has the third oldest Parliament in the Commonwealth, holds elections every five years.The announcement of the muchanticipated elections date and that of Nomination Day set for Wednesday, February 6, came by way of a press release from the Barbados Government Information Service. The announcement has also come almost two weeks before the term of the Parliament of

Barbados would have officially ended. Since January 15, the BLP’s Parliamentary group has not attended sittings of the House of Assembly nor the Senate, contending that the Democratic Labour Party has entered into its sixth year of Government. Their argument has, however, been refuted by the several Government MPs, who have explained that the Constitution states that the five-year term is counted, not from the date on which the elections is won, but the date of the first session of Parliament, which for the 2008-2013 session of Parliament,

commenced on February 12, 2008. Therefore, the Government indicated that they were in their right to continue past January 15, 2013. The last General Elections in this country were held on January 15, 2008, when the Owen Arthur led-BLP lost to the then-Opposition DLP, led by the late David Thompson. At that time, the DLP won a two-thirds majority in Parliament, leaving the BLP with 10 seats. The Government’s majority would later increase to 21, when Hamilton Lashley crossed the floor two years later.

In the lead up to the December 17 General Election, the OBA announced that it intended to suspend the limits for a period of two years. Earlier this month, Fahy said the policy might be scrapped entirely. He said after meeting with stakeholder groups, the decision was made to end the policy effective immediately, calling it a barrier to job creation. “The ministry obtained some time ago legal advice that demonstrated unequivocally the law, as it currently exists, was sufficient to limit reasonable expectation of permanent residents,” he said. “Term limits are not required in any way to do that. Period.” He stressed that work permits, not term limits, are aimed at protecting Bermudian jobs, and said

But a spokesman for the Progressive Labour Party (PLP) which ran the country for 14 years before being ousted in last month’s election, said the statement Bean supported the removal of term limits was “erroneous and disingenuous at best”. “Mr Bean has not declared support for this move in any forum and Minister Fahy is irresponsible for suggesting this,” the spokesman said. “Please be advised that the Progressive Labour Party has not released any statement citing a revision to our existing view of term limits.Prior to the December 17 election, the PLP had committed to widespread immigration reform, and those discussions continue within the party caucus. “Our primary concern is the need for there to be opportunities for Bermudians to ensure career progression and development. “The Progressive Labour Party understands the need for expatriate workers in Bermuda and supports the policies that make it more accommodating for them to set up employment and to relocate to Bermuda, however, we also must strike a balance between this accommodation and ensuring opportunities for qualified and capable Bermudians are provided.“Once the PLP discussions on Immigration reform are complete, a statement will be released from the party stating our position.” Expatriates account for roughly a quarter of the island’s workforce of around 36,000.

St. Lucia Opposition Leader warns about joining PetroCaribe

CASTRIES, St Lucia – Opposition Leader Stephenson King is calling on the St Lucia government against joining the Venezuelan oil initiative, PetroCaribe, saying it could bring the island into further debt. “Let’s not get involved in this matter, this is not one for the government, as it’s not a situation where fuel is being sold to the country at a cheaper rate. The fuel is being sold at the very rate that we are currently purchasing it from Trinidad or elsewhere,” King said. Prime Minister Dr. Kenny Anthony, who recently attended a meeting in Caracas where the PetroCaribe initiative was discussed, said plans were announced to expand the programme under which several Caribbean countries have so far benefited from an estimated US$800 million in investments. Under the PetroCaribe initiative launched Stephenson King in 2005, countries receive oil from Venezuela on concessionary terms, and although St. Lucia had Dominica, St. Vincent and the Grenadines, was among regional countries that signed the Antigua and St. Kitts- Nevis. Prime Minister Anthony said he has accord it has not benefitted from the initiative as

Crime taking on toll on Caribbean economies

WASHINGTON – The Inter-American Development Bank (IDB) says several commissioned studies have revealed that crime and violence have had a dramatic impact on women, youth and the economic well-being of families in Latin America and the Caribbean. The new studies “underscore the more hidden dimensions of the cost of crime” on regional economies, by looking at issues such as women’s health and property values” said a statement issued by the organisation. The studies were the result of a call for proposals to academics and other experts to use innovative and appropriate methodologies to measure the cost of crime and violence in the region, the IDB said. Out of a total of 117 proposals received, eight were presented by their authors at a January 24–25

seminar at the IDB headquarters here. “The children of women who have suffered from domestic violence have a greater risk of being born underweight, and grow up with more feeble health, with less chance they will be vaccinated and more likely to suffer from diarrhea,” said the IDB about one of the studies. The Washington-based financial institution said Latin American and Caribbean citizens cite crime and violence as their top concern, above unemployment, healthcare and other issues. It said the region suffers from some of the world’s highest homicide rates, stating that 20 of the world’s most violence cities are located in Latin America and the Caribbean. “Crime has tangible direct costs, such as the cost of funding a private and public security

infrastructure to prevent and combat crime,” said Ana Corbacho, sector economic advisor of the IDB’s Institutions for Development (IFD) Sector, which covers citizen security at the IDB. Gustavo Beliz, an IDB specialist, said “a better understanding of the economic costs of violence and crime is vital for public-sector decisionmaking in the citizen security sector. “It allows for a discussion more grounded on hard information, among officials in ministries who deal with the areas of security, planning and budgets”. The IDB said it aims to support the efforts of public institutions to better prevent crime and violence with actions that include social initiatives focused on the creation of opportunities for young people, strengthening management of police and penal justice, and with better rehabilitation.

Obama says ‘the time is now’ for immigration reform in the USA

President Barack Obama unveiled his vision for immigration reform in a speech on Tuesday afternoon in Las Vegas, Nev., telling Congress that he will send them his own bill and call for a vote if they don't move fast. "If Congress is unable to move forward in a timely fashion, I will send up a bill based on my proposal and insist that they vote on it right away," Obama said to applause from students at Del Sol High School. "It looks like there's a genuine desire to get this done soon, and that's very encouraging," Obama said, mentioning a blueprint put forward by a bipartisan group of eight senators on Monday. "But this time action must follow." Obama's speech was the latest move in a chess match between the White House and some Republicans in Congress to craft an outline for reform that can both be enacted into law while meeting the expectataions of the growing population of Hispanic voters who now overwhelmingly favor Democrats. Some Republicans want to support immigration reform in part to combat the party's demographic challenges, but the more involved the president is with the bill, the politically riskier it becomes to support it. In his speech, Obama laid out "markers" for reform, saying any comprehensive immigration bill must give most of the nation's 11 million illegal immigrants a chance to earn their citizenship gradually if they pay a fine, learn English and pass a background check. Immigrants would also have to get to "the back of the line," which means people who have already applied for green cards

would have their applications processed first. The president's bill would also include an employment verification system, more border security and a revamping of the legal immigration system to provide more visas for top graduates of U.S. universities and to reduce lengthy wait times for visas for relatives of U.S. citizens. The president mentioned the blueprint for reform laid out by senators including rising Republican star Marco Rubio of Florida and John McCain of Arizona, Obama's 2008 GOP presidential rival. The principles of that outline "are very much in line with the principles I’ve proposed and campaigned on for the last few years," Obama said. Obama said he recognized that immigration is an issue that inflames "passions," but he called on Americans to remember that they belong to a nation of immigrants. Man dies while getting lap dances A 67 year old man died of natural causes while getting lap dances at a Texas strip club on Friday night it has been revealed. Robert Gene got multiple lap dances during his time at the Red Parrot in El Paso, however according to KVIA when the time came to pay the employees at the strip club found him to be unresponsive. Meanwhile KTSM reported that while being entertained Gene suffered from a heart attack, which the strippers failed to notice. El Paso Sherriff deputies confirmed that so far there had been no signs of foul play however the investigation into the death was still underway. Meanwhile a manager at the strip club confirmed that employees tried to give Gene CPR but were unsuccessful in reviving him. Emergency responders were called in, who took the 67 year old to a local hospital. However deputies confirmed that he was declared dead about an hour after he was found at the Del Sol Medical Center.

Brazil police blame cheap fireworks for nightclub disaster

Police in Brazil say the nightclub fire that killed 235 people was caused by cheap fireworks meant for outdoor use. As people in Santa Maria again marched demanding justice for the victims, the chief investigator has backed witness accounts suggesting the band on stage had let off flares. “The people who bought this material knew it was for external use and not to be used indoors but they used it because it was cheaper,” said police inspector Marcelo Arigony. He said that whereas indoor fireworks cost 70 reales (25 euros), the band chose cheaper ones from a local shop that only cost 12.5 reales (under 5 euros). The inspector, who lost a cousin in the disaster, said the fireworks were part of the band’s show and they had even worn gloves on stage. A band member is among several people who have been arrested. Video filmed on Tuesday shows the damage to the Kiss nightclub from Sunday’s fire. Soot covers the doors and debris is strewn across the floor. The authorities also say the venue had too many people, combustible material in the ceiling, and faulty fire safety equipment. The country’s health minister said the lives of dozens being treated in hospital were in danger. Several other towns in Brazil have announced stricter controls on clubs.

UK PM David Cameron makes unannounced Libya visit

British Prime Minister David Cameron has made an unannounced visit to Libya to discuss concerns over security in the region. Meeting with Libyan prime minister Ali Zeidan, Cameron said the UK is willing to provide training and advice to Libya in the fight against terrorism. Within the last week, unspecified security threats prompted warnings to UK citizens in Benghazi and Tripoli. At a joint press conference, Cameron announced Scottish police officers have for the first time been given permission to visit Libya as part of the investigation into the 1988 Lockerbie bombing. Cameron’s stop in Libya comes directly after his visit to Algeria, where he also discussed how to fight militants in North Africa. Security in the region has become particularly important for the UK since the deaths of six British workers during an attack on a gas facility in Algeria two weeks ago. The UK and Algeria will now form a strategic partnership bringing together senior security, military and intelligence advisors.

There are cash-strapped governments, and there are broke governments. And then there's Zimbabwe, which, after paying last week's government salaries, has just $217 in the bank. No, we didn't forget any zeroes to the end of that figure. Zimbabwe, the country that's home to some of the world's largest plutonium and diamond reserves, is literally as rich as a 14-year-old girl after a really good birthday party. The country's finance minister admitted as much in a press conference on Tuesday. "Last week when we paid civil servants there was $217 [left] in government coffers," Tendai Biti told reporters. "The government finances are in paralysis state at the present moment. We are failing to meet our targets." So it seems. However, Zimbabwe is hardly a stranger to financial hyperbole. The economy started to come apart at the seams in 2000, when President Robert Mugabe seized the land of over 4,000 white-owned farmers, effectively dismantling the country's agriculture industry. Over the course of the next decade, the country spiraled into an extended period of hyperinflation, the likes of which the world almost never sees. It peaked in August 2008, when inflation reached 11,200,000 percent and economists around the world started to say that the country's situation was hopeless. Prices were doubling by the day, and the government had to print 100 billion Zimbabwean dollar notes. The following year, they went ahead and printed Z$100 trillion notes, just before deciding to chop 12 zeroes off of the currency. A new coalition government formed that year began the long process of recovery, a process that is clearly going to take a little longer. It's unclear how the Zimbabwean government is going to get itself out this fiscal mess, but whatever it does, it needs to do it quickly. As Quartz's Tim Fernholz points out, Zimbabwe is looking at $104 million bill for its upcoming election and dealing with brand new allegations that government officials have been running a corruption ring around the country's diamond mines. The country obviously desperately needs a major change. "But action against corruption probably won’t come until the end of Mugabe’s reign, and a new constitution coming up for a referendum this spring— presuming the funds can be found -- might set up the aging autocrat for another term in power," writes Fernholz. Until then, looking for quarters under the couch isn't going to cut it, so Zimbabwe is doing the only thing it can do. "We will be approaching the international community," Biti said.

Clinton says she doesn’t see herself getting back into politics

WASHINGTON - Outgoing U.S. Secretary of State Hillary Clinton on Tuesday cast doubt on speculation she might run for the White House in 2016. In an interview taped for National Public Radio, Clinton was asked what questions she needs to answer for herself as she decides whether to run for president. "I'm not even posing those questions. I am really looking forward to stepping off the fast track that I've been on. I've been out of politics as Secretary of State. I don't see myself getting back into politics," she said, according to an excerpt of the interview. Whether this is her last word on the subject is unknown. She will face strong pressure from Democrats to join the field of contenders. Clinton

will step down this week, following Senate confirmation Tuesday of Massachusetts Democratic Senator John Kerry as her successor. Those close to Clinton are eager for her to announce a 2016 run, so much so that a group has already formed a new super PAC and registered with the Federal Election Commission on Friday, called "Ready for Hillary." In 2008, she lost to President Barack Obama in a bitter Democratic primary campaign to be the party nominee for the White House. Although Clinton, 65, did not categorically rule out another presidential run, in a separate NBC interview she said that she was healthy enough to wage a campaign.

Texas woman execution halted

HUNTSVILLE, Texas — The first woman scheduled to be executed in the U.S. since 2010 won a reprieve Tuesday, mere hours before she was scheduled to be taken to the Texas death chamber. State District Judge Larry Mitchell, in Dallas, rescheduled Kimberly McCarthy's punishment for April 3 so lawyers for the former nursing home therapist could have more time to pursue an appeal focused on whether her predominantly white jury was improperly selected on the basis of race. McCarthy is black. Dallas County prosecutors, who initially contested the motion to reschedule, chose to not appeal the ruling. District Attorney Craig Watkins said the 60-day delay was "appropriate." If no irregularities are discovered, he said he'd move forward with the execution. "We want to make sure everything is done correctly," he said. The 51-year-old McCarthy was convicted and sent to death row for the 1997 stabbing, beating and robbery of a 71-year-old neighbor. She learned of the reprieve less than five hours before she was scheduled for lethal injection, already in a small holding cell a few feet from the death chamber at the Texas Department of Criminal Justice Huntsville Unit. "I'm happy right now over that," she told prison agency spokesman John Hurt. "There's still work to be done on my case." Hurt said McCarthy was in good spirits and "didn't seem tense or nervous" even before she learned she would live. A Dallas County jury convicted her of killing neighbor Dorothy Booth at the retired college psychology professor's home in Lancaster, about 15 miles south of Dallas. "We are very pleased that we will now have an opportunity to present evidence of discrimination in the selection of the jury that sentenced Kimberly McCarthy to death," said Maurie Levin, a University of Texas law professor and McCarthy's lawyer. "Of the twelve jurors seated at trial, all were white, except one, and eligible non-white jurors were excluded from serving by the state. ... These facts must be understood in the context of the

troubling and long-standing history of racial discrimination in jury selection in Dallas County, including at the time of Ms. McCarthy's trial," Levin said. Investigators said Booth had agreed to give McCarthy a cup of sugar before she was attacked with a butcher knife and candelabra. Booth's finger also was severed so McCarthy could take her wedding ring. It was among three slayings linked to McCarthy, who'd been addicted to crack cocaine. McCarthy would have been the 13th woman executed in the U.S. and the fourth in Texas, the nation's busiest death penalty state, since the Supreme Court allowed capital punishment to resume in 1976. In that same time period, more than 1,300 male inmates have been executed nationwide. Federal Bureau of Justice Statistics compiled from 1980 through 2008 show women make up about 10 percent of homicide offenders nationwide. According to the NAACP Legal Defense Fund, 3,146 people were on the nation's death rows as of Oct. 1, and only 63 — 2 percent — were women.

NEW YORK — Fox News Channel is parting ways with former Republican vice presidential candidate Sarah Palin, ending her three-year tenure as a contributor on the network. While Palin’s time at Fox was occasionally rocky, the network’s news executive, Bill Shine, said Friday that “we have thoroughly enjoyed our association” with her. “We wish her the best in her future endeavors,” said Shine, Fox’s executive vice president for programming. A person familiar with discussions between Fox and Palin described the parting as amicable, saying that Fox and Palin had discussed renewing her contract but she decided to do other things. The person spoke on condition of anonymity because they were not authorized to speak on the record. Palin’s lawyer in Alaska, John Tiemessen, had no immediate comment on her exit. Palin’s last appearance on Fox News was Dec. 19 on Greta Van Susteren’s show. Palin signed to deliver commentary on Fox in January 2010, reportedly for $1 million a year. It was a coup for both sides at the time; the former Alaska governor was a little more than a year removed from her attentiongetting run for the vice presidency and was considered one of the leading contenders for the 2012 presidential nomination. At Fox, she had a platform on the most popular network for conservative viewers. Fox installed equipment in Palin’s Wasilla, Alaska, home to make her regular appearances easier. Spain’s economy sank deeper into recession at the end of last year. Between October and December GDP shrank 0.7 percent from the previous quarter. That was the fastest decline in a year as households slashed spending in response to government cutbacks and high unemployment. The weak end to 2012 gave a preliminary full-year figure of minus 1.4 percent. That was much worse than the previous two years and the fourth quarter number worried economists. Fiona Cincotta, of City Index, said: “This particular figure was really quite important because it is the first

They also point out that much of the decline was due to a plunge in government spending, particularly on defence, and businesses scaling back on restocking, that is letting their inventories fall. Take those factors out and the US economy would have grown at a respectable 2.5 percent rate. Gross domestic product declined at a 0.1 percent annual rate, by contrast in the previous quarter it grew by 3.1 percent. Policymakers – like those at the US central bank, the Federal Reserve who have just completed their two-day policy meeting – did not seem too concerned and said the stall in growth was likely to be only temporary. They also blamed weather related disruptions, a reference to super storm Sandy. Fed Chairman Ben Bernanke and his colleagues left in place their 85 billion dollar a month bond buying stimulus plans. The improvement in consumer spending in the fourth quarter means businesses will now have to replenish their stocks, which should help lift growth in the early part of this year. In addition the jobs market seems to be improving. Private employers stepped up hiring in January, though still not to the level that the Federal Reserve has said is needed for it to end stimulus measures.

Toyota is number one again

Toyota has regained the number one spot for worldwide sales. Last year drivers bought 9.75 million of its vehicles. As a result the Japanese carmaker overtook its American and German rivals – General Motors and Volkswagen. Toyota had fallen into third position, behind them, in 2011, having held the top spot from 2008 to 2010. That was because it suffered a wave of negative publicity from recalls in the United States, and its supply chain was disrupted following an earthquake in Japan and floods in Thailand. Nissan also announced record sales – up 5.8 percent – as did Honda, with a 19 percent rise. GM sold 9.28 million vehicles in 2012, up 2.9 percent from a year ago, while Volkswagen sold 9.07 million vehicles, up 11.2 percent. Toyota aims to sell 9.91 million vehicles group-wide globally in 2013, up 1.6 percent from 2012. The Toyota group also includes sales at its small car subsidiary Daihatsu and truck maker Hino. Toyota-only sales hit a record-high 8.72 million vehicles, up 22.8 percent on a year ago. TOKYO - Toyota Motor Corp will recall nearly 1.3 million cars globally for two separate defects, including 752,000 Corolla and Corolla Matrix vehicles in the United States to fix airbags that could be deployed inadvertently, the automaker said on Wednesday. It is the third Toyota recall since October to involve more than a million cars, and it comes as

the company tries to recover from a damaged reputation following a series of recalls between 2009 and 2011 that were related to unintended acceleration problems. An IC chip in the airbag control unit can malfunction when it receives electrical interference from other parts in the car, causing the airbags to deploy when it is not necessary, Toyota spokesman Naoto Fuse said. Meantime, Toyota is also recalling certain Corolla and Corolla Matrix vehicles in Japan, Canada, and Mexico. The problem has caused minor injuries such as abrasions in 18 cases that have been reported, he said. Two accidents have been reported by customers outside Japan, although Toyota has not been able to confirm them, he said. Toyota will add an electrical signal filter to the airbag control module to the recalled vehicles -- repairs expected to take an hour to hour-and-a-half, he said. TRW Automotive Holding Corp has manufactured the airbag control unit in the vehicles, although the problematic chip is supplied by another company, an employee at TRW's Toyota office told Reuters. The financial impact from the airbag recall is likely to be limited, possibly costing Toyota about 5 billion yen ($55 million), said Koichi Sugimoto, a senior analyst at BNP Paribas in Tokyo.

Apple shares tank as tech giant’s growth slows

Apple shares closed down more than 12 percent on Thursday, slicing over 50 billion dollars from the company’s value. The market’s disappointment is no surprise, as the tech giant posted its slowest profit growth since 2003 late on Wednesday. The sell-off was sparked by fears that Apple is losing its dominance in smartphones, with customers switching to rivals such as Samsung, which offer more variety and bigger screens. Apple’s poor results also came despite the launch of the iPad mini.

The company said it shipped a record 47.8 million iPhones in the December quarter, but that was well below analysts’ forecasts. Expectations heading into the results had been subdued by news of possible production cutbacks by some component suppliers in Asia. That triggered fears that demand for the iPhone and the iPad could be slowing. The iPhone accounts for half of Apple’s revenue. “It’s going to call into question Apple’s dominance in the space. It’s still one of the strong players, the others being Samsung and Google. It’s

still a two-horse race, but Android continues to grow rapidly,” said Sterne Agee analyst Shaw Wu. “If you step back a bit, it’s clear they shipped a lot of phones. But the problem is the high expectations that investors have. Apple’s conservative guidance highlights the concerns over production cuts coming out of Asia recently,” he added. Apple shares have dropped by more than a third since mid-September as investors fret that its days of hyper growth are over and its devices are no longer as ‘must-have’ as they were.

Samsung sells 700,000 smartphones a day

Samsung continues to be the high flyer in the smartphone world. It sold 63 million smartphones in the fourth quarter of last year – 700,000 a day – and posted almost five billion euros profit. But the South Korean technology giant’s share price slumped 2.5 percent after its latest results were announced as it predicted people would buy fewer smartphones this year. Samsung also turned cautious on

spending for the first time since the global financial crisis. With the smartphone market slowing and demand for the computer microchips it makes waning, Samsung does not plan to increase the amount it invests in developing new products. For all of last year Samsung sold 213 million smartphones. Its share of the market is 30.4 percent, compared with Apple’s 19.4 percent, while Nokia trails with five percent.

Samsung took the number one spot from Apple early in 2102, but the iPhone maker’s problems also impact its rival. That is because Samsung makes the microprocessors used in the iPhone and iPad. The fact that Apple is buying fewer of them is one reason why Samsung is now forced to keep a lid on its spending. It has been one of the industry’s most aggressive spenders, ramping up capital expenditure every year

since 2004, with the exception of 2009, to meet soaring demand for its array of consumer electronics and mobile devices. “Overall its earnings momentum remains intact, and smartphone shipments will continue to grow even in the traditionally weak first quarter, as Samsung has got a broader product line-up and Apple appears to be struggling in pushing iPhone volumes aggressively,” said Lee Sechul, a Seoul-based analyst at Meritz Securities.

Rising Stars Basketball Club – more than just sports By Vivian Tyson

Rising Stars Basketball Club – a new sporting organization scheduled to be officially established on February 2, in Providenciales has been billed as more than just a sporting club, but an entity designed to curb youth from wayward behaviors. The scheduled meeting place for the club will be at the Gustarvus Lightbourne Sports Centre Saturday from 8a.m. to 10a.m. The commencement of its registration was slated to begin on February 2, and will continue from there. Mervin Forbes, one of the individuals behind the establishment of the club said that it is open to boys and girls ages 11 to 17 years old. “What we are trying to do is to cater more to the younger kids, because as you get older it is harder to teach you stuff, so we are keeping it from 11 to 17, just to give the kids that opportunity. He explained that although basketball is in the club’s name, it is also a, organization that would cater to mentorship, tutoring and counseling. “I played basketball

growing up, and basketball kept me out of trouble and gave me a positive outlet to look forward to. So, basically, what I am trying to do is to help the young kids of the Turks and Caicos Island in areas of basketball, tutoring, mentorship like big brother, big sister, and that is why I decided to come up with the rising stars basketball club,” said. He said that a board to run the club was already in place, and a number of volunteers have come on board to assist in different areas. He said that the tutoring aspect of the club should be housed at Fortis headquarters and the gym element for training should be at the Gustarvus Lightbourne Sports Centre. Forbes explain also that since he is the Turks and Caicos Islands ambassador for US sports organization – Youth Basketball of America (YBOA) – he could organize basketball tournaments overseas for the children. “What they (YBOA) do is host tournaments. So, eventually, once the club picks up, we would probably host basketball tournaments and going abroad to participate in tournaments. I am also

talking to a basketball trainer in Washington D.C. His name is Alex Harris, from Evolution Basketball, and we are trying to see how he can give those kids an opportunity to train over there, to either give them a career in college or any other place,” Forbes said. Forbes said that the mentorship programme would entail, taking the children on trips, including boat ride and exposing them to resource persons in the community and those who overcame challenges in their lives and are now successful in what they do. “A lot of things that they are doing now, I want to show them that I have been through that, because I grew up in the states. And everything that they went through, I probably went through worse than that. But I managed to keep my head straight, do the things that I had to do to get where I am now,” Forbes explained. Campbell-Brown motivated for Moscow 2013

She is just a few months away from being on the other side of 30, but Jamaican sprinting great Veronica Campbell-Brown says she remains extremely motivated and is already locked in to this year's IAAF World Championships in Moscow Campbell-Brown, who turns 31 in May, won her first 200m gold medal at the last World Championships in Daegu, South Korea, and has not won 100m gold since 2007 in Osaka. However, with no indoor distraction this year and a bye for the 200m, she star is looking to make up 2012's disappointments with a strong showing in Moscow. The sprinter left the Olympics without an individual gold medal for the first time since 2004, but she won a 100m and a 4x100m silver medal in London. "I decided to forego the indoor season this year, I just want to focus on training and get ready for the outdoor season. I do love Indoors and will definitely miss competing indoors, but I think it's what I want to do, I just want to take a break from it this year," said the back-to-back 60m World Indoor champion. "I have already put 2012 behind me so I am just looking forward to 2013; it's already here and I am just looking ahead in confidence. I am thankful for everything I achieved in 2012 though," Campbell-Brown added. "It went relatively good, but as an athlete you always want to do more and as a competitor it's always hard to be totally satisfied." Campbell-Brown, as defending 200m World champion, has been awarded automatic qualification for the event in Moscow, meaning she will not have to qualify from Jamaica's trials in June. It's a break she welcomes, as she looks

forward to making the most of having to only focus on one event for the trials. "Thankfully, I have qualified for the 200m already after getting the bye, so I will come to the trials and focus on the 100m so I can do the double. I cannot resist, I have to do both events and hopefully I can secure a spot in the 100m as well," said Campbell-Brown. "I will just run the 100m (at trials) and sit and enjoy the 200m from the stands, that will feel very good," CampbellBrown smiled. Campbell-Brown has won six individual and three relay medals in four appearances at the IAAF World Championships. Meantime, Jamaican sprinter Sherone Simpson is looking back, even as she looks forward to this year's IAAF World Championships in Athletics, intent on reclaiming the form she showed in 2006. Simpson was a bit of a monster on the track back then: 10.82 over 100m and 22.00 in the halflap. And despite an Olympic silver medal in the 100m at the 2008 Beijing Games, the 28-year-old has failed to return to her explosive 2006 form. However, with the World Championships on the calendar, Simpson is hoping to crank into high gear in the coming months, a first individual World Championships medal and lowering her personal bests, her targets for the fast-approaching season. "I haven't got an individual medal at the World Championships and I really need one," Simpson told The Gleaner."I have been working hard and it's not that I hadn't been working hard over the years, but, of course, sometimes injuries come along and I have to listen to my body. I think by

It was OK at the national trials and I thought I would have been able to build on what I did there, but unfortunately that didn't happen for me in London," she said. "Coach (Stephen Francis) and I found out what the problem was and from day one this season, we have been working on the problem, and I think things are going pretty well and I'm just looking forward to this season," said Simpson. The Commonwealth Games champion over 200m in 2006, Simpson has two 4x100m relay silver medals at the World Championships, plus gold and silver in the 4x100m at the Olympics, to go with her 100m silver.

Darren Sammy's team will begin their 2013 programme of international cricket on Friday with a limited-overs series in Australia. Ask them privately and some of the West Indians would have probably been happy to still be back on their islands, easing into the new year. In December they were trekking back from Asia, having lost the ODI series 2-3 to Bangladesh after winning the two Tests. Now they turn up in Australia for five ODIs and one T20. One could well ask, why bother? Lacking the history and tradition of Test cricket and the concentrated drama and newness of T20s, ODIs have become the suffering middle child in the family of formats. Outside of the World Cups every four years, the average one-dayer is as forgettable as yesterday's news - hardly remembered beyond the day, or at best the series it was part of. This particular rubber comes in an Australian summer where the hosts have already taken on World No. 1 South Africa in three Tests and Sri Lanka in three Tests, five ODIs and two T20s. Sammy's side, ranked a modest seventh in ODIs, has now come to wrap up the summer. Once upon a time, West Indies were the headline acts of the Australian season, not the clean-up men. But in

every assignment there is opportunity. Especially for West Indies now. Even the smallest signs of recovery can be significant for the very ill. So, debilitated by over a decade and a half of steady losses in formats old and new, each win, when it has come, has been a confidence booster, a lifeline of sorts for West Indies cricket. The year just past, bringing global success via the World Twenty20 triumph in Sri Lanka, parity with Australia in ODIs and T20s, and outright series wins in Tests, ODIs and T20s against New Zealand hinted at better days to come for the international team. In all ODIS in 2012, Sammy's side won half of the games they played. Success this time in Australia will be a further indication of a side growing in strength. But for some individuals, one especially, this series is big. Now Sarwan comes to a country in which he has struggled to score runs in the past, and he must work with coach Ottis Gibson, who he has publicly suggested caused him mental and emotional hurt. The odds of success do not seem great against

such a background. But here is a great chance for Sarwan to display the strength of character that can bring his unquestioned physical gifts as a batsman to the fore. Gibson knows how important it is for his team to make full use of their assets. On arriving in Australia he said of the World Twenty20 win: "It's something we have to move on from and think about moving up the ladder in one-day cricket and getting ourselves in the mix with the best teams in the world. We believe we're a top team, but we now have to show it with the way we play." The coach has questions to answer, since his future with the team is uncertain. When he flew to Australia, West Indies and Warwickshire were vying for his services. That Gibson would allow himself to go onto a shortlist as a replacement for Ashley Giles at the English county tells a story in itself. But for the moment his business with the West Indies team is not finished. In Bangladesh there was plenty of indiscipline in executing plans on the field. This series will show whether or not that end-of-year assignment was indeed merely an aberration.

As part of his preparations, the Jamaican 100 and 200 metre world record holder will run the longer sprint at the Bislett Games Diamond League meeting in Oslo on June 13. "The aim for 2013 is the IAAF World Championships in Moscow in August. My goal is to win three gold medals and repeat my Olympic Games success," Bolt said in a statement on Wednesday. "My preparations have been good this fall. I am injury free, working hard and everything is

going according to plan. I hope to come to Bislett prepared and ready to run a great race." Bolt won gold in the 200 metres and 4x100 relay at the 2011 worlds in Daegu but was disqualified from the 100 final for a false start. His training partner and compatriot, Yohan Blake, went on to take the title. Bolt gained a measure of revenge when he beat Blake to retain his Olympic 100 and 200 metre titles at the London Olympics. He also anchored the Jamaicans to a world record of 36.84 in the 4x100m relay. The Diamond League series of 14 meetings starts in Doha on May 10.

IOC plans to cut one sport, add another

The organization will recommend one sport to be cut from the original list of 26. Rugby and golf, which are being added to the Games from the 2016 Rio de Janeiro Olympics, will not be part of the process. The decisions of the executive board will need to be ratified by the session in Buenos Aires but it is unlikely that the board's recommendation would be overturned. Several Olympic sports are reportedly at greater risk, with modern pentathlon among those mentioned most. The IOC is eager to revamp the Games' sports program in an effort to keep up with the times and attract younger fans and sponsors as well as to rein in the size of the Games and keep the number of summer sports at a maximum of 28. Modern pentathlon with its five disciplines of pistol shooting, fencing, show jumping, swimming and running, is an outdated sport with little global TV and sponsor appeal, critics say.

Dr. Phil says Manti Te'o hoaxer admits to love for linebacker

A California man who has admitted to fabricating Notre Dame linebacker Manti Te'o's fake girlfriend in an elaborate hoax told talk show host Phil McGraw he felt a deep romantic love for the football player, McGraw said. "Here we have a young man that fell deeply, romantically in love," McGraw told the television morning show "Today" to discuss his two part interview with Ronaiah Tuiasosopo, which aired on "Dr. Phil" on Thursday and Friday. "I asked him straight up, 'Was this a romantic relationship with you?,' and he says yes. I said, 'Are you then therefore gay?' And he said, 'When you put it that way, yes.' And then he caught himself and said, 'I am confused,'" McGraw told "Today." Te'o has said in a previous media interview he is not gay. The fake girlfriend hoax involving Te'o, who was a finalist for college football's highest individual honor the Heisman trophy, caused a sensation when it was revealed earlier this month on news website Deadspin.com. Tuiasosopo says he played the part over the phone of Lennay Kekua, the fictitious woman who was Te'o's girlfriend in the hoax. Te'o, 22, had

spoken about the woman in media interviews, and reports described her surviving a car accident and then dying of leukemia in September. Te'o has said since the hoax was exposed that he was the victim of an elaborate prank, that he never met Kekua and that his acquaintance Tuiasosopo admitted to him that he was the one who played the part of Lennay. Dr. Phil said in a segment on "Today" on Wednesday that after an extensive interview with Tuiasosopo, he believes Te'o had no role in creating the hoax. "Absolutely, unequivocally, no," McGraw said, in pinning the blame for the scheme on Tuiasosopo. The NBC morning program also showed some comments Tuiasosopo made in his interview for the "Dr. Phil" daytime program. "There are many times where Manti and Lennay had broken up," Tuiasosopo told "Dr. Phil." "But something would bring them back together, whether it was something going on in his life or in Lennay's life, in this case in my life," Tuiasosopo said. But he said he was not really certain she never existed until Tuiasosopo's later confession to him. The linebacker, during the Katie Couric interview, presented a voice mail he received from the person he said he thought was Kekua. "Doesn't that sound like a girl?" Te'o told Couric. Te'o also told Couric he is not gay. "No, far from it," he said.

Judge rejects Sandusky's bid for new sex abuse trial

Former Pennsylvania State University assistant football coach Jerry Sandusky lost his bid on Wednesday for a new trial on child sex abuse charges. Judge John Cleland rejected the request in an opinion posted on the Centre County Court's website. Sandusky's attorneys had argued they lacked enough time to prepare for the trial. Sandusky, a former defensive coordinator, was convicted in June on 45 counts of abusing 10 boys over a 15-year period. He was sentenced to a prison term of 30 years to 60 years in a case that tarnished the reputation of late Penn State coach Joe Paterno and focused national attention on child sexual abuse. Cleland, who had presided over Sandusky's high-profile trial in Bellefonte, Pennsylvania not far from State College, said Sandusky's attorneys Joe Amendola and Karl Rominger had failed to show that they had needed a continuance to be able to sift potential evidence and to prepare. "There was, in other words, no prejudice to the defendant by denying defense counsel's motion for a continuance," he wrote. Sandusky's attorneys also had argued that a new trial should be held because of such issues as erroneous instructions to the jury, lack of specificity in the charges and prosecutors' comments on Sandusky's failure to testify at trial. Cleland rejected those points as well.
