Illegal Cubans using TCI to get to the USA- Cont’d CONTINUED FROM PAGE 1

Among those on the boat were a seven-month-old baby and her 17year-old mother. The baby, along with three other minors are being cared for by a Cuban doctor who is legally employed in the Turks and Caicos Islands. According to sources, when police and immigration officials carried out a further search of the property at Discovery Bay, they found that other Cubans were already living at the

house. One of the illegal immigrants reportedly even told law enforcement officials that she was living in the Turks and Caicos Islands illegally for more than three months. The SUN investigation also revealed that some of the illegal Cubans had old, fake TCI immigration stamps in their passports. “Based on what we’ve seen so far, this is is an extremely well-organised operation,” a law enforcement source told The SUN. Acting on information from the

illegal immigrants who were captured, police and immigration officials were also able to pick-up a few more illegal Cubans in Providenciales who did not come on the speed boat. One of the illegal Cubans even attempted to leave the Turks and Caicos Islands to travel on another Caribbean country on a fake passport and he was apprehended at the Providenciales International Airport. Police and immigration officials also discovered several money transfer receipts at the residence, along with

some other evidence which they hope will help them unravel the human trafficking mystery. Sources told the SUN that the illegal Cubans are not seeking political asylum in the Turks and Caicos Islands. “They said that life in Cuba is hard and they just want to get to the United States,” the source added. The huge water-front mansion which was occupied by the illegal Cubans is being rented out by a property management company that is owned by two brothers from a prominent Turks and Caicos Islands family. The two men have been questioned by police but so far there is no evidence that they are in any way connected to the illegal trafficking of Cubans, sources said. When contacted on the matter, Permanent Secretary in the Ministry of Immigration and Border Control, Clara Gardiner said: "Immigration Officers are continuing to process 25 Cuban nationals suspected of entering the Turks and Caicos Islands unlawfully, primarily by boat. Other than four minors and their mothers, all remain detained in the Five Cays Detention Centre pending the conclusion of enquiries and arrangements for their removal to Cuba. Supported by Immigration and Customs officials, Police are proceeding with investigations into how these persons entered the Islands and who else was involved.” Officials from British and US law enforcement along with representatives from Cuba, are expected to be in the Turks and Caicos Islands shortly as part of the investigation.

Anya williams appointed new Deputy Governor of Turks and Caicos Islands Anya Williams has been appointed as the new Deputy Governor of the Turks and Caicos Islands by William Hague MP, UK Secretary of State for Foreign and Commonwealth Affairs with effect from October 15th, 2012. The new Turks and Caicos Islands Constitution requires the appointment of a Deputy Governor who is an Islander. The Deputy Governor is the head of the public service and has a key role in ensuring good governance and effective financial management in the Territory. One of Anya’s first tasks will be to attend the Heads of Overseas Territories Public Services meeting in London from 16-17 October.

“Anya Williams was selected through a rigorous and open selection process,” said Governor Ric Todd. "She was a very strong candidate who has previously played a positive role in introducing reform in the Ministry of Finance in the TCI civil service and has worked with all ministries, departments and statutory bodies throughout Government in her previous roles." “Recognising the importance of the position of Permanent Secretary in the Ministry of Finance in keeping the country’s finances on track, we will look to replace Anya in that role through an open competition at the earliest opportunity.”

Anya holds a¬ Master of Science in Accounting,¬ Bachelor of Science in Accounting and ¬ Associate Degree in Arts (Law, English and Accounting). She was budget director in the Ministry of Finance from 2003 to 2012. The Deputy Governor is Head of the Public Service, a non-voting member of Cabinet and acts as Governor when the latter is absent from the territory. Anya will be the line manager of the Permanent Secretaries and will chair a Permanent Secretaries’ committee that will prepare legislation and decisions for Cabinet. The position of Deputy Governor has been vacant since September 2009.

Stolen vehicle dumped in canal A Black Chrysler 300 car was discovered in a canal in the area of Discovery Bay, Providenciales with extensive damages to the front bumper, on Sunday October 7th. The vehicle was last seen on Friday October 5th in the Discovery Bay area where it was parked by its owner. On Sunday 7 October 2012 at 7:30am the vehicle was discovered missing. Police are investigating.

many CARICOM governments have sought solutions to their economic problems in national efforts only, shunning the real benefits that could derive from regional action as well. National efforts for alleviating the budgetary strains on Governments and for a few infrastructural projects have focused recently on getting help from China and Venezuela. But, regardless of how generous and unquestioning these two governments may be now, their contributions, while welcome, are stop-gaps; they are not addressing fundamental weaknesses that persist. The EU’s frustration with Caribbean governments and their institutions is not exceptional; other countries and agencies have also expressed their disappointment and dissatisfaction. Among these agencies is the Canadian International Development Agency which has identified the Caribbean as a priority for its aid. It is significant that it is since May that the European Commission first advised Caribbean representatives in Brussels of the decision to use a “differentiated approach” to aid. While in ACP representatives have been engaged in lobbying and presenting the counter arguments in Brussels, there is urgent need for high-level representation to EU governments, particularly the newer ones that have little knowledge of the Caribbean beyond statistical information. If with the help of the Commonwealth Secretariat and the World Bank, CARICOM countries and the Dominican Republic could secure an International Conference on the Caribbean to address their fundamental difficulties of debt; a change in the criteria for concessional financing; differential treatment for trade based on their small size and limited capacity; deepening regional integration to allow for the creation of pan-Caribbean undertakings that are competitive; and, crucially, building machinery for transportation and storage of agricultural products within the region, many of their problems could be addressed through a co-ordinated approach by donor countries and agencies. But, first the Caribbean would have to assemble a single dynamic team to prepare a convincing plan with measurable outcomes, performance criteria, and a viable implementation mechanism. Otherwise they won’t be believed. It is a dark time for the region; emerging into the light requires regional ingenuity, regional commitment and regional action. Four candidates for the PDM – Deputy Leader and At Large candidate Charlene Cartwright-Robinson; Sean Astwood, the Five Cays candidate; Derek Rolle, the Grand Turk North representative and the Bight standardbearer Sonny Forbes, are all affected by the new interpretation in the Constitution. It is my understanding that the word in the section (of the Constitution) said ‘by his or her own act’, so I did not consider that it applied to me. “But once I noticed that there was a case that the AG was relying on and waiting for the guidance notes, that holding US Passport - which I do hold – (means) pledges my allegiance to the United States, which I don’t consider to be the case. But in any event, I would be the representative for the Leeward constituency, and I will renounce my citizenship.” For her part, Cartwright-Robinson declared that she had never went through the process of swearing allegiance to a foreign power, stressing also that she currently holds Turks and Caicos and British Passports, stating that her Bahamian passport was long expired. “I was born in the Bahamas; I was born there and came to these islands at the age of six. So, I held that country’s passport, but I currently don’t hold a Bahamian Passport,” CartwrightRobinson said. Stressing that she was prepared to surrender her Bahamian citizenship, Cartwright-Robinson said: “In fact, until yesterday (October 11) I didn’t realize that I was a Bahamian. The experience that I had in the Bahamas is that I was able to go to the community – College of the Bahamas - through a government scholarship, though that didn’t come through in the end, but that was my connection to the Bahamas. Both Misick and Cartwright believed that the new interpretation was unfair to the people of the country since 80 percent of the children born to Belongers did so in other countries, predominantly the United States. And that a number of them would be alienated from participating in the politics of their country. But they both expressed love for their TCI and said that they would do whatever it took to be qualified in order to serve their country. Cartwright Robinson said: “Its (legislation) not new; it is a part of the Constitution – Section 49 – it’s just that it is different interpretation from what a lot of lawyers that I have spoken to as recent as yesterday didn’t believe that having a travel document from the place that you were born was (an act of) swearing any particular allegiance to that state. I didn’t think it would be relevant to me not holding that passport for many, many years. In the meantime, CartwrightRobinson said that she made representation to the Attorney General, for him to determine whether or she was required to make a formal renunciation of her Bahamian connection.

Acting governor patrick boyle’s address to the final session of the consultative forum THURSDAY 11 OCTOBER 2012 Madam Chair, Forum Members, Government representatives, members of the public and those listening on RTC. It is my honour to address you today as Acting Governor on the occasion of the final session of the TCI’s Consultative Forum. The new Constitution comes into effect next Monday and with it the countdown to the elections on 9 November will truly begin in earnest. Since it was established under the provisions of the Constitution (Interim Amendment) Order in August 2009, the Consultative Forum has played a crucial and very visible role in the government of the Turks and Caicos Islands. Indeed we have seen a number of lively debates in this chamber. We have witnessed disagreements over certain issues. And we have seen the membership of this body change over time. But constant throughout has been the desire to do what is best for this country. To ensure thorough and rigorous examination of each piece of legislation put before the Forum for debate. To make considered recommendations for amendments to the legislation to the Governor. And above all to provide the necessary oversight required of any administration that professes to be open and transparent. We should recall with pride the enormous achievements of the Consultative Forum over the past three years. Though members may have changed over time, the purpose and objectives of this body have remained constant. The sheer amount of necessary legislation that has been debated, and the number of recommendations that has been made

and adopted in the final versions of the new laws is a testament to the dedication of the Consultative Forum. Your efforts and input into such vital legislation as the new Constitution last year; the updated Crown Land Policy and Ordinance during 2011 and early 2012; and the Public Financial Management Ordinance will all help in making the governance of the TCI a more transparent process. There are many other examples I could give but the key message is that the Consultative Forum has worked over the period it has been in existence to provide a better future for the citizens of these islands, who rightly have high expectations of their government. I want to thank you very sincerely for this. As we move towards election-day on 9 November and closer to having this very room used again for its original purpose as the House of Assembly, we should remember all that has been achieved to put the country and its political and legislative systems in a position to allow the elections to take place. Consultative Forum has been instrumental in achieving the necessary reforms to the governance of the Turks and Caicos Islands that satisfied Ministers in London of sufficient progress in the milestones required to make the return to elected government a reality. Not all of these reforms have been popular and I recognise that the Chair and members have, on occasion, been singled out for a degree of abuse, sometimes personal. I applaud and thank you for having the fortitude to continue in office during difficult times, and recognise that the work of the Consultative Forum has been vital in getting us to this position. The next time this room will be used will be to hold the inaugural session of the newly elected legislative assembly. It is a welcome return to elected administration following the suspension of ministerial government and sections of the Constitution over three years ago. I very much hope that you, of all the citizens of these islands,

appreciate the efforts that have been made to return to this democratic position. We have, between us, sought to put in place legislative reforms that will restrict the ability of those elected to office to abuse their positions of authority in the future. I hope you will agree that the supervisory bodies and legislation we have established are robust and fit for purpose. I would ask that you, as joint architects of the new systems, set the example in ensuring they provide the desired oversight of the next government. We cannot afford for this country to make the same mistakes again. In closing I wish to thank you again on behalf of the Governor; on behalf of the British Government; and most importantly of all on behalf of the people of the Turks and Caicos Islands for all that you have done over the past three years. Without your work we would truly not be where we are today. I offer you all best wishes for your future endeavours.

Ruth Blackman, the latest person to have hosted the popular talk show – Expression on Radio Turks and Caicos (RTC) – was apparently pushed from that position before the time of her slated departure. Blackman told The SUN that the number of changes that Government was making to public broadcast in the TCI, had prompted her to throw in the towel, but she decided to stay on until the end of the month. However, after interviewing a particular guest, she was placed on administrative leave for comments that she said the Interim Administration deemed disreputable. “I had made it known to the management of RTC that I was no longer interested in staying on, when they indicated that the Broadcasting Commission was going to be dismantled and they were going to repeal the Broadcasting Commission Ordinance, and that the government radio station would be operated under one of the ministries. “I indicated that I would not be staying on because it would mean that I would have to abide by regulations and instructions governing the public

service, and since I already retired, I had no intentions of going back in the public service,” Blackman said. She added that after Government dismantled the Board and repealed the Ordinance, they sent letters to the staff of RTC, including her, indicating that she was offered the position as host of Expression on a freelance basis on the condition that she abided by the financial instructions and the Public Service rules and regulations and the Public Service Ordinance. “I told Chris (Jarrett, Director for RTC) that I would stay on until the end of the month (October), and then I would leave on the 1st of October. He asked me to stay on because I had lined up a number of shows for them, and I would stay on and complete them,” she noted. However, Blackman said that things took a turn for the worse after she interviewed Eddie Astwood, when the matter of the illegal Haitian boat that was detected by the recentlycommissioned Radar Station, which notified the police, came up in the conversation. “I raised the question of the issue of that Haitian speed boat that had come onto Provo and the press release that the police said the speed boat did

Public and Private sector collaborate to revitalise Turks and Caicos financial services industry The Government has announced that the Turks and Caicos Islands continue to progress towards the revitalisation of its financial service industry. His Excellency the Governor Ric Todd confirmed that following the Financial Services Commission (FSC) seminar entitled ‘Vision 2015’ of earlier this year, a Financial Services Coordinating Committee was established with the aim of advancing plans and activities that will serve to position the Turks and Caicos Islands as an attractive, well regulated financial services centre among its global competitors.

The seminar ‘Vision 2015’, held in February 2012, was attended by a wide representation from Government and the private sector. It had discussed sustainable development for the financial services sector, and agreed that improved communications between all stakeholders within the industry and government was key in identifying opportunities for the promotion of the Turks and Caicos Islands to key international markets. Government continues to build on the success of the seminar and the willingness of the financial service industry to fully collaborate with the public sector. Talks have already taken

place to improve and introduce a number of pieces of legislation in the TCI to ensure the most modern legislative framework supports the financial products and services available. The Committee has also begun exploratory discussions aimed at producing a robust marketing programme that will seek to raise the visibility of the Turks and Caicos with a clear message that the country is open for business. The Financial Services Coordinating Committee is presently comprised of both public and private sector membership, including representation from the Governor’s Office, TCIG

Investment Unit, the FSC and various Financial Industry Associations. The Governor His Excellency Ric Todd said: “The Turks and Caicos Islands has a key opportunity to revitalise its Tourism, Investment and Financial Services industry as it sits on the doorstep of two of the world’s biggest markets.” He further added: “The partnership of public and private sector represents a key turning point and demonstrates the Government’s ongoing commitment to support the growth and further development of the financial services industry and all that it has to offer to the economic viability of the Turks and Caicos Islands”.

Nomination pack for general elections published The nomination pack for the Turks and Caicos general election has been published by Supervisor of Elections, Dudley Lewis on Wednesday, October 10th 2012. The pack contains all the various items that a every candidate or political party will need to complete to ensure that they are correctly nominated and that they have met all of the necessary legal requirements to allow them to stand for election. It includes detailed guidance notes about these requirements and a helpful checklist so that candidates can ensure that their nomination paper has been

properly completed, including all of the other required forms that must be submitted to either the Returning Officer or the Supervisor of Elections. According to the election timetable, the Governor will issue the formal writs for the election on 16 October and the public notice of the nomination day will be published on the following day. Candidate must submit their nominations on Thursday, 25 October at the venues to be specified in the notice between the hours of 1000 and 1300 and then 1400 and 1600. All nominations have to be made by that last time. The list of candidates for each

electoral district and for the All Islands district will be published by no later than the following day. “Although many people have come forward and said that it is their intention to stand for election, they cannot do so unless they have met all of the requirements stated in the nominations pack and they submit the correctly completed application by the deadline,” said Dudley Lewis, Supervisor of Elections. Chaos and confusion at Elections Office in Providenciales BY VIVIAN TYSON SUN SENIOR EDITOR

Scores of persons, who visited the Elections Office in Providenciales in the early part of this week to collect their voter identification cards that would enable them to vote in the November 9 elections, either left the building fuming or disappointed as a result of the distribution process. Some of the individuals that spoke to The SUN said that the exercise was poorly organized hence the long wait, which they said frustrated them to the point of some of them deciding not to collect their cards on the day. They claimed also that the three persons in the office were inadequate and, instead of using an alphabetical system, they opted to go by first names, which slowed the process tremendously. A woman, who said that she spent almost two hours waiting in line, was told, after making it into the building, that her card was apparently not ready having not been among the batch that came from Grand Turk. She said that she was advised to return another day. “Actually, I was waiting from

three persons sorting through the piles of cards, and since Providenciales had the biggest population, the authorities should have provided added manpower to make the process easier. “I think it was very unfair on the workers, I believe that they should have more workers in there because there are three people working the system, plus they are going by first names instead of last names, so it would be harder. Three people have to look through all the cards, so it’s not going to work,” she said. Orville Selver, another of the persons waiting in line, said that on top of the long wait, the heat in the building was sweltering, which added to the people’s frustration from the long wait. Church, Political billboards among illegal signs dismantled BY VIVIAN TYSON SUN SENIOR EDITOR

Billboards erected to announce church events and advertise political parties and candidates were among dozens of signs torn down and taken away by The Physically Planning Department to be destroyed, having been mounted without the blessing of that body. Ogail Awat, Acting Deputy Director of Planning was seeing with a team from that department uprooting and tearing down illegal signs along the streets of Providenciales on Wednesday, October 10. He said that a number of the signs, including some of those erected by churches on that island were not given approval by the Physical Planning Department, and therefore would have to be uprooted. He also said that signs which were given approval by the department, and were to have been removed by their owners after the events passed, were also removed. “We are going to take down all the illegal signs from the roundabouts, sides of the roads, along the Leeward Highway, Kew Town, Five Cays and Blue Hills. The next step we are going to prosecute these people. Right now we will do clean up ourselves, but next time anybody erect any sign illegally, we will take them to court, where they can be

Crown Land should first seek approval from the Crown Land Unit and Public Works before they approach the Planning Department. Awat said that the majority of political billboards were raised legally, as the parties duly contacted Planning for approval. He said however, that all the signs should be torn down three days following the elections, if not; the guilty party could face prosecution. “After three days after the elections all the signs should be removed,” he said. In the meantime, Land Use Planner with the Physical Planning Board, Toriano Williams, said that they have

been monitoring the situation for some time now, and that the illegal erection of signs was contrary to Section 88 of the Physical Planning Ordinance. “What they are doing is pretty much erecting signs on Crown Land without the necessary approval. We are not only concerned about the illegal development, but we are also concerned about the debris which is left after the signs are erected and the amenity in which the site is being kept. So, we are trying to send the message out to the public to ensure that going forward, there are procedures. “Development on any land, you need the necessary approval from Planning and for advertisement signs, what needs to happen is that you need to come to the Planning Department and seek the necessary permission, along with going to the Crown Land Unit, which is responsible for the Crown Land, and get permission. “Once you get the letter of consent from the Crown Land Unit, you will have to come to the Planning Department with an application and some form of drawings, stating what they are going to display on the particular area. Whether it is a Crown Land, on the reserve or even if it is their property, permission must be sought and obtained from the Planning Department in collaboration with Crown Land Unit,” Williams said.

In the next few days, the People Progressive Party (PPP) could have three additional candidates pushing its tally of representatives for the November 9 elections to seven. Party leader Harold Charles told The SUN that Wendall Wilson is their latest candidate to be confirmed. He would be running in the Blue Hills constituency. “Mr. Wendall Wilson is well

known to the public. He is from Grand Turk originally, but he is living in Providenciales right now, and he is going to be running in the Blue Hills constituency. We expect to have two more candidates signed up. We are still working on it because there are some issues that we are dealing with, but we are very pleased the way things are going,” Charles revealed. Responding to the question of quality of feedback that his party was getting on the ground and the chances at the polls, Charles weighed his prospects as on par with the other

Toussaint switches from PNP to PDM Luckner Toussaint, who, during the 2007 general election served as a strong supporter for the Progressive National Party (PNP), especially in the Five Cays Constituency, declared on Saturday, October 7, that he has switched parties and will now be supporting the Oswald Skippings-led People’s Democratic Movement (PDM). Toussaint made the statement while attending a PDM constituency rally in Kew Town – the district, which forms part of the Cheshire Hall/Blue Mountain constituency, which Oral Selver for that party is trying to land the seat ahead of Amanda Missick, who last held the Cheshire Hall constituency before it was redrawn to include Blue Mountain. Garbed in a PDM T-shirt, Toussaint, who was in tow as Skippings entered the stage for his keynote speech, defended his decision to switch party allegiance after in 2007, after being handed the microphone by Skippings, who referred to him as a ‘Haitian Brother’. Toussaint told the gathering that since he declared publicly of his turncoat decision, he had been receiving a great deal of flack from his detractors. He justified his about face by pointing out that other people had made political switches locally. Some of them then, he declared, were members of the PNP, who were now running on the PDM ticket. “When I walk on the street people cussing me, saying, ‘so much things PNP do for you and you switched’. I say, ‘November 28, 2012, make 22 years that I am here. I got a piece of paper’. We need the ‘blue and white’ (PDM) to bring the country back. “ If Harold Charles, who formed PPP was born in Haiti, and if Josephine, who was a strong PNP, switched (to) PDM, why I can’t switch? In my house I have six votes, and to be honest with you, I supposed to give Mr. ‘PPP’ Harold Charles one and Mr. Rufus (PNP Leader, Dr. Rufus Ewing) one. But I won’t give away none; I aint give Harold none. I aint scared o’ no ghost, and so all my votes are for PDM, I don’t care,” Toussaint said blurted, much to the delight of the crowd. That doesn’t pay the people’s bank payment; it doesn’t pay the people electricity bill; it doesn’t buy food. What happened to the young people who come out of school and can’t get a job? That is what I am focusing on. My focus is to do what is best for Turks and Caicos; not to focus on other individuals. “Some of the other individuals have not done anything. They don’t have a track record or a proven record where they have done good things; where they have created jobs. They talk about creating jobs, but most of them, how many jobs have they created? So, therefore they don’t have much to talk about. They want to distract the people by talking about my place of birth and all that stuff, which is bad for the country, because we are heavily divided already. And the way they are carrying on with their politics is going to divide us even further. When they pick on me, it is not just me, because I was not the only person who was born overseas, who is a Belonger. They pick on everybody else, and why do we want to focus on that, instead of focus on the real problem of this country? Let’s solve the problems that we have; let’s unite

this country instead of dividing this country. Let us embrace the people that come to live here to work hard for us to have a better life. If you look at the United States and other countries that succeeded very well, how they do it, they do it with immigrants…people who migrated to that country and poured their hard sweat into it to make it work. “It worked for them and it worked for the country, and that is the kind of opportunity that we, in the PPP want to provide. People said to me that I will be looking out for the Haitians. I have to tell them no, I will be looking out for everybody, because they say a rising tide lift all boats. What I want to do is look after Turks and Caicos,” Charles emphasized. Meantime Charles said that all of the PPP candidates so far are dual citizenship-free. He however, stressed that there were prospective candidates who had such issues, but the party was thrashing out that matter. “I do have one or two (prospective candidates) that have dual citizenship, but we are dealing with it. But they are pretty much prepared to give it up, but they would rather do that after they win. They think it is unfair for them to give it up before. And then again, if they don’t win they are stuck if the economy in Turks goes slow, and if they want to go to the United States to further their education or try to get a job, now they won’t be able to do it because they gave up their citizenship before the election. It (giving up of citizen) should be after (the election if the candidate wins),” Charles said.

Oswald Skippings called a ‘bold-faced liar’ Leader of the People’s Democratic Movement (PDM) Oswald Skippings has been described as a bold-faced liar, by Publisher and Editor-in-Chief of the Turks and Caicos Islands SUN newspaper Hayden Boyce. Boyce took Skippings to task over statements which the PDM leader made during a meeting in Kew Town, Providenciales, Turks and Caicos Islands. Skippings told the meeting that Boyce was paid $120,000 by Lord Ashcroft to attack him as leader of the PDM. In response to Skippings’ statement, Boyce said: “It is absolutely not true that I was paid $120,000 or any money whatsoever by anyone to attack Mr. Skippings. What is true is that Mr. Skippings has reconfirmed what many people in Turks and Caicos Islands have believed for many, many years; that he is a bold-faced liar who would do or say anything to score political points.” Boyce added: “It is most regrettable and quite sad that an ordained pastor and leader of a major political party who wants people to take him seriously and who is aspiring

to lead this country, would sink to such an all-time low but telling such a blatant, silly and unbelievable lie, when in fact he really should be focusing on serious issues. He has not only lied about me on political platforms. He has lied about many other people in the TCI as well. And what is worse, is that the man believes his own lies. You just can’t trust or believe anything that Mr. Skippings says.” Boyce and Skippings have for many years had a cordial relationship, but the PDM leader became angry and upset when the newspaper editor criticised him for inciting violence at the Clement Howell High School, by telling supporters to “go down there and block those bloody gates and no man move”. This was Skippings’ response to a Guyanese man being hired as the new principal there. The SUN Editor said it is obvious that Skippings is desperate and that he is out of touch with the real issues that are facing the Turks and Caicos Islands. Boyce added: “Skippings obviously has a fixation with Lord Ashcroft, because whenever he gets up a political platform he spends the

TCI politicians will have no choice but to give up foreign citizenship BY HAYDEN BOYCE PUBLISHER & EDITOR-IN-CHIEF

Like it or not, politicians in the Turks and Caicos Islands who possess dual citizenship, simply will have no choice but to give up their foreign citizenship. Although having dual citizenship does not, in and of itself, prevent them from running as candidates in the November 9th general elections, under the Constitution, it disqualifies them from being members of the House of Assembly. Section 49 (1) of the Turks and Caicos Islands Constitution which comes into force on October 15th, states: “No person shall be qualified to be an elected member of the House of Assembly who, on the date of his or her nomination for election is, by virtue of his or her own act, under any acknowledgement of allegiance, obedience or adherence to any foreign power or state.” This law, although rather controversial in its interpretation, is not at all new. It has been in the Turks and Caicos Islands Constitution for quite some, and it could have been removed altogether if the majority of persons who attended the constitutional amendment public meetings had presented a sufficiently

strong enough case against deleting or amending that particular section. This obviously was not done. And so, with the Constitution being the supreme law of the land, the unvarnished truth is that there is now precious little that politicians and prospective MPs can do other than read the Constitution and comply. To be sure, this must all be done in earnest before Nomination Day, which is October 25th. For even if they decide to challenge the matter in the law courts, the law and odds may well be against them. There is a famous case from the House of Lords, the highest court in the United Kingdom, that will be used against them. It is the case of William Joyce, one of the most famous treason trials in British legal history. It was not clear that an individual, born in the United States, raised in Ireland, who obtained British citizenship via deception for a relatively short period, and who then obtained naturalised German citizenship, could legally be tried for treason against the British Crown, by broadcasting propaganda in an area outside of the Crown’s legal jurisdiction. Because of the legal issues involved, the case went to the House of Lords. Joyce did not deny that he committed the alleged acts, but he denied that he had a duty of allegiance

and so could not be guilty of treason. In order to overcome the confusion surrounding his citizenship, the prosecution argued that the British passport, which Joyce had renewed immediately prior to his escape from Britain, and which was valid until July 2nd, 1940, entitled him to the protection afforded to all British passport holders, and that he therefore owed allegiance in return. Had he kept his US citizenship during his time in Britain, he could never have been prosecuted on treason charges in the UK. The appeal before the House of Lords in December 1945, was heard by the Lord Chancellor, Lord Macmillan, Lord Wright, Lord Porter and Lord Simonds. The appeal was dismissed,

with Lord Porter dissenting, on December 18th 1945. Joyce lost the appeal and was hanged at Wandsworth Prison at 9am on January 3rd, 1946, the last person in British history to be hanged for treason. Like all executed prisoners, he was buried in unconsecrated ground within the prison grounds. As a public service, the Turks and Caicos SUN reproduces below, the House of Lords ruling in the Joyce case, which, in the prevailing circumstances, is rather instructive and will be the landmark case used in against the retention of dual citizenship in the Turks and Caicos Islands for the purposes of being an elected or appointed Member of the House of Assembly.

Last week CIBC FirstCaribebean International Bank employees visited the Marion Williams Special Needs Association of Providenciales (SNAP) Centre, where they not only donated material to create a reading corner and art and craft material to assist with the children’s creative skills, but also spent time reading and playing with them. Bianca O’Neil, Business Support Officer for the bank, said that each year the institution chose a worthy cause where its staff members were given the opportunity donate and share with the recipients. “We choose a worthy cause to do something for. It is where we get staff involved in doing community service. Each year we choose a different cause, and this year we chose the SNAP Centre to do a reading corner, to help with the reading development of the kids in the school. The idea behind it is that the teachers would have material to help the kids. We donated reading material and art and craft items to the school, to help with their reading and creative skills. We also donated toiletries,” O’Neil said.

Dual nationality could hurt local candidates BY VIVIAN TYSON SUN SENIOR EDITOR

Some candidates, who have signaled their intention to contest the November 9 polls, could find themselves automatically excluded from the process as a result of them being born in another country or obtained foreign nationality. Under the new Constitution which is to be released later this month, a candidate possesses an overseas passport that could be rendered ineligible, since the act could be construed as swearing allegiance to a foreign power. Phillip Rushbrook, Director of Strategy in the Governor’s Office explained that being the holder of a foreign passport after the age of 18, or working for foreign government could be viewed as acts of swearing allegiance to a foreign power. “Holding a foreign passport after the age of 18 could be construed as allegiance to a foreign power. If you worked or are working in some way, even if it is part time, with a foreign public service, where you have to swear oath of allegiance – perhaps in the courts service in a judicial role or civil service – that, again, could be

construed as (swearing allegiance to) foreign power. “If you are a serving member or a reservist to a foreign military force, that could be regarded as having allegiance to a foreign power. So, because everybody’s circumstances are different, it would be more sensible to treat this on an issue by issue basis in conjunction with the supervisor of election and the attorney general,” Rushbrook suggested. Rushbrook said that in the event that someone found himself in such a predicament but still desirous of being an elected representative, could formally renounce his allegiance to that country in front of an official from

the foreign power state, pointing out however, that a specific act of renunciation was not yet defined. “If someone does have an issue, then they would be required to make a demonstrable formal act in front of an official from that country of renouncing their allegiance. And again, what that act could be would have to be determined by the attorney general,” Rushbrook said. Rushbrook said as far as he was concerned, at this time a foreign power constituted powers outside the UK, but as to whether it’s also outside the Commonwealth would have to be referred to the Attorney General’s Chambers for clarification. In the meantime, Supervisor of Election, Dudley Lewis said that in the event that someone found him and herself falling into the disqualification category as a result of having dual nationality, as soon as the individual contacted his office, he would immediately notify the Attorney General for clarification as to how to move forward with that issue. In the meantime, Rushbrook said it would be premature to conclude whether or not any of the persons put forward by the three parties fall into that category, since their candidacy would become official after they have been nominated on October 25, at which time they would be required to make their declarations. “We have people who make public

So constitutionally, Mr. Lewis does not know who the candidates are until we received the nominations,” Rushbrook said. In the meantime, Harold Charles, Leader of the People Progressive Party (PPP), who was in attendance, objected to the idea, explaining to Rushbrook that in the past, a number of persons were forced to have their babies delivered in foreign countries as a result of the dilapidated healthcare system in the TCI. And now that some of those children, who are grown and ready to serve their country, are faced with difficulties as a result of the dual nationality restriction. But Charles also suggested that a candidate who was the holder of dual nationality should be allowed to run, and if successful, then renounce his or her foreign citizenship, but if unsuccessful, be allowed to keep it. “I don’t think it is fair, because there are so many Turks and Caicos Islanders that were born in the Bahamas and the United States of America, and I don’t think it is fair for them to be forced to renounce their citizenship before they are sure that they are going to win. What I would suggest to the Governor is that, to let the process go through first, because most people (candidates) want to do it (run for office). But what if they renounce and they don’t win the election? “I am sure you would agree that for most of the Turks and Caicos Islanders it (holding a US passport) is an advantage for them, because since there is no universities in the Turks and Caicos Islands, I am sure they would like to take advantage of it (lower university costs to US citizens). So, I would suggest to the Governor that, let the process go through, and once you win the election, then you have to give it up (dual nationality) or step out,” Charles suggested

Young people urged to educate themselves BY VIVIAN TYSON SUN SENIOR EDITOR

Persons wanting to become part of the job market would now have to educate themselves since the era of politicians pulling strings on their behalf is fast becoming a thing of the past, this according to Chairman of the Board of Governors for the Turks and Caicos Islands Community College, Dr. Carlton Mills. Speaking at a news conference to officially introduce Lee Ingham as the new President for the Turks and Caicos Islands Community College, last Thursday (October 2), Dr. Mills made an impassioned plea to young locals, to get educated so that they would be able to effectively compete within the job market, especially in the area of tourism, which is the lifeblood of the TCI. “I just want to appeal to the young people of the Turks and Caicos Islands, you better educate yourself. Things are changing in the Turks and Caicos. Yesterday is history; the things that happened three years ago will no longer happened; where you could call a politician and he hooked you up on a job. What is going to determine

whether you get a job or not is the qualifications that you have. “Young people, educate yourselves, qualify yourselves. Yes, we will return to democratically-elected government in another month or so, don’t hinge your future on that. I beg you, I plead with you. Make your education your first priority. If you don’t, you are going to suffer some serious consequences. I don’t mind who say what to you, if you don’t make your education your top priority, you are going to suffer some serious consequences,” Mills warned. In the meantime, Principal for the Providenciales Campus of the Community College, Samuel Forbes, explained that the dropout rate was a concern for the institution. He said that some students would embark on their education at the college, but as soon as they obtained a job, would abruptly quit attending class. “Quite a bit of, especially our day students are coming from the high schools. They register and start to attend college but as soon as they get a job they stopped coming. So that creates a situation where there is a high level of drop out, especially at the beginning of the year. Their attitude is that they don’t see the importance of

continuing their education,” Forbes said. He said though that at times some of the delinquent students would later return to complete their courses. Conversely, Forbes said that students who obtained a job before entering the institution would stay the course. In the meantime, Forbes said that even though the college did not have all the facilities needed to make the work of the teachers and students easier, the teaching at the institution was sound, to the point that graduates who had gone on to higher learning would maintain a high grade point average. “We might not have all the resources that other institutions have, but our standard creates a situation where our students have to work even harder to keep up to the standards of other institutions. And when they would have been successful here and leave to go elsewhere, there performance would be of such where they are on the dean’s list, and they are performing extremely well because of the hard work that they would have done here. “There are a number of students that I could identify, who are out there now performing at top level in top institutions, simply because of the

background and the foundation that they would have gotten here, coupled with the hard work that they had to do as a result of lack of resources,” Forbes said. Meanwhile, Ingham explained that as part of his quest to elevate the level of education in the TCI, he would be visiting elementary schools across the country in an effort to explain to students the importance of education so that by the time they reach high school they would better appreciate the need for higher learning. “What I want to do is to talk to these students and tell them something about education, so that when they get to high school, or even before they get to high school, they would begin to say, ‘not if I go to college; but when I go to college’. So, if we can instill that in our students, they would see that a job right now would not be the best thing for them, especially if they are living at home with their parents,” Ingham said.

A National Message from Michael E. Misick Former Premier of the Turks and Caicos Islands My Brothers and Sisters, I address you today for two reasons. Firstly, to place the tenure and record of my former government in its full and proper perspective. Second, to ask you to support the Progressive National Party (PNP) team as they go full throttle ahead to win the November 9th general elections. We as Turks and Caicos Islanders have much of which to be proud and many blessing to thank God for. As your first Premier and last elected leader, I am very proud of the accomplishments that we made during our six years in office in spite of the usual obstruction by the British. You must surely remember that when we in the PNP won office in 2003, unemployment was high, tourism was struggling, there were very few foreign investments, virtually no money was being spent on public infrastructure and only the privileged few were getting free medical care, scholarships and land grants GDP was then $150 million, tourism arrivals were less than 200,000 and there were hardly and public parks and recreational facilities for young people to enjoy. Shortly after the PNP assumed office, under my leadership and with an able, hard working team guided by God’s help, we were able to turn around the fortunes of our country. We improved our tourism arrivals to one million visitors through our aggressive marketing which resulted in the Turks and Caicos Islands being one of the strongest tourism brands in the Caribbean. We attracted billions of dollars in investments in the tourism sector like the Grand Turk cruise port, Seven Stars, Beaches Italian Village, the Regent Grand, and the Amanyara Resort just to name a few. All of this investment while the PNP was in office, led to the Turks and Caicos Islands having the proud distinction of being the most rapidly developing country in the Caribbean and this part of the world. We also built sports and recreational facilities such as the Gus Lightbourne Stadium, the National Stadium which hosted the 2007 CARIFTA Games, the Bight Children Park, Horsestable Beach Park in North Caicos, the Community Centre in South Caicos, the Lighthouse Park, the over back park, and a many more. We made sure every person that wanted health care got it free of charge, even if they had to be flown out to Miami to get the best care that money could buy. We spared no cost because we felt, and feel, that nothing is too good for our people. We built two modern world-class hospitals for our people, although we are not now happy with how they are being run and managed, and I could assure you that if we were still in office, they would have been managed differently. We spent millions of dollars providing local and overseas scholarships to our young people to

pursue a wide range of disciplines (doctors, lawyers, pilots, accountants, engineers, managers), to the extent where every family in every community and on every island in the Turks and Caicos Islands benefited from higher education. We can now proudly boast of having one of the most qualified set of people per capita, anywhere in the Caribbean and the world. We also spent tens of millions of dollars investing in infrastructure, including roads and streetlights throughout Providenciales, deep water ports in North Caicos and Middle Caicos and paved roads throughout Middle Caicos and North Caicos including the causeway. We paved roads all through South Caicos, built a new clinic and began to build a new terminal. We also paved roads in Grand Turk and invested in other public infrastructure including new class rooms.In short, we increased the GDP from $150million to over $750million in six short years. We were building institutions like TCI Bank, TCI New Media, TC Invest and the National Health and National Insurance Scheme that are so essential to any developing country. Sadly the British has destroyed some of the institutions but a PNP administration would be committed to rebuilding them.These institutions took good care of our people and some are still are taking, care of the sick and providing pension for our elderly in their golden years. So, in spite of the nay-sayers, the facts speak for themselves. The PNP party under my leadership made some of the most significant economic and social gains ever in the history of the Turks and Caicos Islands. I am therefore asking those of you who supported me over the many years, and who love me to this very day, to give that same support to Dr. Rufus Ewing and his team so that they can continue the good work that my team and I started. We all know what happened. We know that because we were being successful and because we were moving our country towards selfdetermination, the British fabricated and used the PDM and others to fabricate corruption allegations and the ongoing investigation for their political purpose, simply to derail our progress and our plans. The ongoing SIPT investigation and court case is nothing but a sham and a Ponzi scheme. No defendant can ever get a fair trial when the British governor and the British government have changed the Constitution and so many laws, such as a Hearsay Law, to ensure convictions. They have also hand picked judges who will do their bidding and in spite of the law and facts they have consistently ruled in the favour of the prosecution team. However, I must point out this is nothing new for the British. They are masters at divide and rule. They have in the past done the same thing in

United States of America, South Africa, Kenya, and other countries which were once colonies like we now are. Fortunately for those countries the people had the courage to eventually kick them out of their country. The Turks and Caicos people have now seen after three years and US$60 million of the public money, that all of this was done to get me and others out of politics and to politically persecute us, victimise us and wrongfully criminalise us. The PDM conspired with the British because they knew that because of the progress we had made and the love my people have for me, that I could not be defeated at the polls. My people, we cannot afford to let the PDM win. A vote for the PDM is a vote to continue the British occupation of our beloved country. We know the PDM leader and we know that after 30 years in politics he can't point to anything good he has done for our country, and so, if he could not do it when he was young and full of energy, what can he do now? My people, don't be distracted by the third party PPP.They are agents of SIPT and the British who are only

trying to do what they can to prevent a PNP victory. It is so ironic because the leader of the PPP has benefited from the PNP more than any other citizen.My Haitian brothers and sisters, you know I love you. Remember who was there for you when Oswald Skippings and the PDM put your kids out of school. It was me and the PNP. Remember we made sure that your kids that grew up in Turks and Caicos Islands, although they were born in Haiti, were able to get Belonger status because we felt that it was the right and Christian thing to do. Remember who was always there to fight for your rights. Therefore, my advice to you is, don't waste your vote on the third party PPP. Vote for your party PNP ALL THE WAY!Finally, this upcoming general election is one of the most important and critical election that we will ever have. This election will determine whether we continue to allow the British and their agents to dominate and occupy our country without any regard or respect for justice, equality or our human rights; or whether we will vote PNP so that we can continue on the road to prosperity and self-determination. A vote for the PDM and Oswald Skippngs is a vote for the British and Slick Rick! So on Election Day, I encourage all of you who are registered to vote to go out and vote PNP straight down the line. An external perspective of VAT in the Turks and Caicos Islands BY MARVA COSSY

“Value Added Tax? Turks & Caicos Islands (TCI) is getting a VAT?” I asked somewhat incredulously. “Yes, the editor confirmed, asking if the telephone line was bad. The line was as close to perfect as I have ever experienced, but I had assumed that since TCI was an overseas territory of the United Kingdom, the VAT or one of its cousins - the general consumption tax - was long instituted there. I heard very little else of what he said as I vividly recalled all the drama associated with the introduction of VAT on my island Barbados, a few years ago in 1997. More recently, I have heard the outcry in St. Lucia as its government introduced the VAT on October 1, becoming the last in the Organisation of Eastern Caribbean States (OECS) to do so. We all have a love-hate relationship with taxes. We welcome their usefulness in running the country, including ensuring that our citizens have access to adequate public goods such as roads and good sanitation, but we moan about the drain on our pockets. VAT, however attracts special fury. It is an all-across the board tax, hitting us almost every time we spend and demanding the same amount (percentage wise) from the rich and poor every time they make a purchase. Moreover, given that lower income earners spend a higher proportion of their earnings than those in higher income brackets; it follows that a higher portion of poor people’s ‘income’ will attract VAT which is therefore regarded as a regressive tax. As such, introducing a VAT, any time, but more particularly during a recessionary period is a brave step for a government and provides political fodder for an opposition party. However, governments, including Barbados’ have dealt with some of the negative fallout by selecting a basket of goods deemed necessities such as some foods, especially for low income people, and charging VAT on them at zero rate; while some services are exempted. In contrast, the TCI government, according to its White Paper, will exempt items that appear necessary for ensuring that households can afford proper nutrition and vital supplies. These include basic foods, meat, vegetables, contraceptives, hurricane protection items, baby and infant’s items as well as certain services for vulnerable groups including the disabled. Also on the list are items which send loud signals regarding government’s policy; for example agriculture supplies are exempted while exports of goods and services, the supply of water and electricity are zero-rated. From a consumer perspective, exempted and zero-rate goods have the same effect, no tax; but from a business’ perspective, the difference is

important. Unlike in the case of zerorated goods and services, sellers cannot claim tax credit on inputs associated with exempted items. This means that though no VAT is charged at the point of sale to the consumer in both cases, the price on a zero-rated good or service should be lower because of the business’ ability to claim tax credits, when compared to a similar good or service that is exempted. In essence, though governments use these tools, zero-rate and exemption to ease vulnerable groups and to make sure that the new system is not a disincentive to growth in key sectors of the economy. So do these manoeuvres make VAT a preferred tax? Honestly, I did not like the VAT, but today after fuming about its introduction as another burdensome aspect of economic globalism, as a consumer I have settled down to paying it without complaining to cashiers and anyone willing to listen. I recognise that multilateralism as dispensed by the World Trade Organisation (WTO) puts pressure on countries to reduce or eliminate trade taxes. Governments, especially those of small, open, indebted economies like ours in the Caribbean have to find revenue-raising tools, which will not burden our households or discourage business expansion particularly in the export sectors, yet we need to generate enough finance to meet the cost of the rising expectations of our people for proper services; to pay for infrastructure and other things key to restructuring our economies in a changing technological driven world as well as to propel economic growth. We also have an aging population which has implications for payroll taxes as well as government pension schemes since the possibility exists that we may have to be paying pensions to a large number of former workers from the pockets of fewer employees. Additionally, the development of service economies as well as economic hardships has pushed more citizens into the informal sector where tax evasion is easy under traditional tax systems. So I understand the search for

an efficient tax that can tackle evasion, but I am not sure that VAT is the answer. I am thankful that prior to VAT’s January 1, 1997 introduction into my country all sectors of the economy business and households were exposed to an island-wide education and information programme. The relevant government agencies published final consumer prices with breakdowns that showed the imported prices and the effect of the multiplicity of taxes which were being replaced by VAT. This was accompanied by charts showing the effect of VAT, so we had a good idea of which final consumer prices were likely to increase after VAT; those that would remain constant and yes, those that would fall. We were armed with facts that could help us identify price gouging. Retailers, though, behaved admirably, and the January 1 start was helpful as it coincided with the time when inventories at retailers would now have to be replenished after Christmas. However, all is not well with our system. Few glitches need to be worked out. I watch small business operators cringed, weighted down by

the additional work to keep proper accounts, to file their VAT returns and in dismay over government’s slow machinery in sending refunds. I see Government’s effort to deal with defaulters, business that take VAT payments but find it difficult to hand over those monies. I leave my thoughts on small businesses and the hotel sector for another instalment. Indeed, as I tried to put myself in the place of a Turks & Caicos islander, my thoughts went to tourism and the recognition that most Caribbean islands, dependent as they are on tourism treated that sector with special VAT arrangements. The question really is that necessary? Is it fair to other sectors? But more in particularly does it affect the effectiveness of VAT? Does it signal that VAT is wrong for any country that has to make a significant allowance to anyone sector? Nick Cannon: 'American Idol' Producers Are Using Mariah Carey, Nicki Minaj Feud For Publicity MINAJ THREATENS TO ‘KNOCK’ CAREY OUT

The "American Idol" feud between Mariah Carey and Nicki Minaj has been generating headlines for well over a week, and according to Carey's husband Nick Cannon, that's exactly what Fox executives wanted to happen. Cannon hit the talk show circuit Tuesday and shared his theory that the feud is being used by "American Idol" producers to generate interest and ratings. TMZ first revealed the video in which Nicki Minaj derailed the "American Idol" auditions in Charlotte, North Carolina Tuesday, after swearing at Mariah Carey and threatening, "I'm gonna knock you out" ... but Mariah FIRED RIGHT BACK with insults of her own. In the footage, Nicki is clearly furious ... shouting, "I told them I'm not [expletive] putting up with her [expletive] highness over there." Mariah can be heard saying, "“Oh why, WHYYYY .do I have a three year old sitting around me?” Carey continues, "I can’t see my kids, because you decided to act like a little crazy b****h and go all around the stage.” Sources say Nicki later threatened to "knock out" Mariah ... but she said it before the video starts.

It all went down while the two were sitting at the judge's table ... with Keith Urban sitting in between them and Randy Jackson sitting on the far end, next to Mariah. According to the site, the whole thing exploded over a disagreement over a contestant's performance. However Cannon implied that he believes "Idol" producers were the ones who leaked the video of the argument to TMZ. "I believe it was real to the extent that it actually happened," Cannon told the ladies of "The View." "If you ask my opinion, I've produced

So when you hear that there's going to be someone else, of course that comes to you as a surprise ... Barbadians say no to casino gambling Even if it is in the Bridgetown Port or on the waters, churches in Barbados are still saying no to casino gambling. Far from extending gambling to cruise liners, religious leaders are calling for a reduction of the opportunities for gambling already here, citing Government’s proposal for a broadening of what the ships could do as a further corruption of morals. The Barbados Evangelical Association, an Anglican cleric and Baptist minister came out strongly against Government’s proposed Cruise Ships (Opening of Facilities) Bill, under discussion in Parliament. But they were not alone, because in debates in the House of Assembly as well, Minister of Tourism Richard Sealy and Opposition Shadow Tourism Minister Ronald Toppin did likewise in their contributions, noting they did not see it either as any incentive to tourism. While Sealy said no in relation to this form of gambling in Barbados, he supported the cruise ship measure, as Toppin was opposed to it both dock side and land side. The Barbados Evangelical Association said it considered the addition of casino gambling, even if it was only for tourists, as a step that would further corrupt Barbados’ morals and undermine the spirit of honest enterprise. In a statement issued by its president Reverend Dr. Nigel Taylor, the body noted: “The BEA opposes the introduction of casino gambling and appeals to the Government to act without delay to arrest the growth of gambling in this nation and also to reduce

the number of lotteries which are now draining the resources of the country.” The statement argued that the suggestion that casinos might be located in the country for tourists could be compared to implanting a cancerous cell in the body on the pretence that it could be isolated from the other cells and would not contaminate them. The churches further argued that the introduction of casino gambling in Barbados or the extension of existing forms of gambling would be morally harmful, economically destructive, socially intolerable, and a serious disfigurement of our national heritage. During a Press briefing earlier in the month, Minister of International Business and International Transport, George Hutson had promised to bring a Bill to Parliament in an attempt to extend the time spent in Port by cruise liners. At the time, Hutson had indicated that by restricting casino gambling to cruise passengers while the vessels were in Port, would give passengers additional time to shop in Barbados. It was stated that even though the cruise liners leave the island’s territorial waters early, they opened their casinos to gambling without first steaming to another destination. The BEA, priest-in-charge of the St. Clement’s Anglican Church and a Baptist pastor put paid to the idea today, however, saying they were having none of it. St. Clement’s priest, Reverend Keith Griffith said: “It may be a subtle way of testing the waters. If

we accept that casino gambling should not be engaged in on the land, then it should not take place in Barbados’ territorial waters. There is a contradiction. We cannot detach our territorial waters from the land. Our territorial waters constitute part of Barbados’ land mass.” Meanwhile, Pastor of the Emmanuel Baptist Church, Vincent Wood, said it was something he would not support. “Barbados is going in the wrong direction. In the Bahamas citizens are not allowed to engage in casino gambling, while the doors are opened to tourists. If the Bill is passed in Parliament it will not be healthy for the country,” he posited. Meanwhile in Parliament, Sealy said the moral argument was a “murky” one given the amount of gambling that takes place presently, but nevertheless said it was not the kind of tourism development he had in mind for the island. On the other hand, Toppin accused Government of trying to legalise gambling through the back-door with this Bill. The BEA said contrary to what was believed, the church had not been silent on the matter. The association stressed that because some Christian churches tolerated some of the less harmful games, such as raffles, this in no way meant that the Church in general approved and sanctioned lotteries and casinos. The BEA argued that in any event the Church had the right to speak when it perceived increasingly dangerous trends in society, even if it did miss or failed to note the danger signals in the nascent stages.

Hugo Chavez win in Venezuela sets new challenges CARACAS, Venezuela -- Venezuelans awakened on Monday to the prospect of another six years under President Hugo Chavez as the leftist president's supporters celebrated his victory against a youthful rival and a galvanized opposition pledged to build on its gains. Chavez emerged from Sunday's vote both strengthened and sobered, having reconfirmed his masterful political touch but also winning by his tightest margin yet. Challenger Henrique Capriles said while conceding defeat that his campaign had launched a new political force and that he would keep working for change. The 58-year-old leader now has a freer hand to push for an even bigger state role in the economy and deepen friendships with U.S. rivals. Meanwhile, he's under pressure to address nuts-andbolts governance issues such as soaring crime rates, power blackouts and doubledigit inflation. With a turnout of 81 percent, Chavez only got 551,902 more votes this time around than he did six years ago, while the opposition boosted its tally by about 2.1 million. Chavez appeared to acknowledge the opposition's growing clout during a boisterous victory speech late Sunday night. "I extend from here my recognition of all who voted against us, recognition of their democratic weight," he told

thousands of cheering supporters from a balcony of the presidential palace after midnight. Capriles, a former state governor, had accused the flamboyant incumbent of unfairly usingVenezuela's oil wealth to finance his campaign as well as flaunting his near-total control of state institutions. Still, he accepted defeat as Chavez swept to a 10-point victory margin. The former army paratroop commander won nearly 55 percent of the vote against 45 percent for Capriles with more than 95 percent of the vote counted. "It was the perfect battle!" Chavez told his supporters. The crowd

responded with chants of "Chavez won't go!" Chavez spent heavily in the months before the vote, building public housing and bankrolling expanded social programs. With the largest proven oil reserves in the world, Venezuela has received hundreds of billions of petrodollars over the past decade. "I think he just cranked up the patronage machine and unleashed a spending orgy," said Michael Shifter, president of the Washington-based InterAmerican Dialogue think tank. But Shifter also noted the affinity and gratefulness Venezuela's poor feel for Chavez. "Despite his illness, I still think he retains a strong emotional connection with a lot of Venezuelans that I think were not prepared to vote against him." Perhaps the top question facing Chavez now is whether he has truly beat cancer, after having two rounds of surgery since June 2011 to remove tumors from his pelvic region as well as chemotherapy and radiation treatment. He has said his most recent tests showed no sign of illness. Venezuela would have to hold a new election if Chavez were forced to step down during the first years of his term. Without referring to his illness, Chavez said in his victory speech: "I ask God to give me life and health to keep

serving the Venezuelan people, more and better every day!" Both sides now turn to regional elections scheduled for December, in which Venezuelans will choose state and municipal leaders. While fireworks exploded over downtown Caracas, Chavez supporters said Sunday night they were prepared to turn back local victories scored by the opposition in recent years. "It's time now to sweep away the squalid ones," said Ignacio Gonzalez, using a description of the opposition Chavez employed during campaigning. The 25-year-old student wore a red shirt that wedded the images of Chavez, Jesus Christ and South American independence hero Simon Bolivar. "It's time to get them out of governor's and mayor's offices," he said. "The next battle is in December." Chavez opponents pointed out that they had posed the strongest challenge yet to Chavez, who won by a 27-point margin in 2006 and by 16 points when he was first elected in 1998. "I will continue working to build one country," said Capriles, the wiry, 40year-old grandson of Holocaust survivors, in his concession speech. Guyana increasing gold mining and export GEORGETOWN, Guyana – Guyana is reporting an overall increase in gold production, declaration and sales, with production recording 314,000 ounces, an increase of about 23 percent over the corresponding period last year. Minister of Natural Resources and the Environment Robert Persaud reported that for the same period last year gold production declaration was just about 207,000 ounces. “We have seen declaration and sales going up, sales to the Guyana Gold Board as well as to the private dealers,” he noted. Antigua plane crash leaves three dead ST JOHN’S, Antigua – An island hop between Antigua and Montserrat turned deadly for passengers on a small Fly Montserrat plane on Sunday October 7 around 4:15 pm. Reports are that the BrittenNorman BN2 A Islander, registration VP-MON performing flight 5M-107 took off from the VC Bird International Airport's Runway 7, but lost height immediately after becoming airborne and crashed to the ground, nose first near Runway 10. The aircraft was reportedly carrying one crew and three passengers. Initial police reports stated that a British couple who were passengers on the flight died in the accident, while the other two people were taken to the Mount St John’s Medical Centre hospital in critical condition where the pilot later succumbed to his injuries. The other passenger has survived so far but with critical injuries. Onlookers suggested bad weather conditions may have played a role in the crash as heavy rains accompanied by thunder and lightning was witnessed around the time of the crash. FlyMontserrat spokeswoman Karen Allen said the airline was still gathering information about the crash and expects to issue a statement later. Airport authorities closed the airport for just over two hours as scores of emergency personnel converged on the scene. Flights on LIAT, British Airways and American Airlines were disrupted by the temporary closure as flights in and out of Antigua were suspended. Newly appointed chief executive officer of the Antigua and Barbuda Airport Authority Stanley Smith has pledged an immediate review of the airport’s emergency response procedures following Sunday’s deadly crash.

Bahamas police call for offduty officers to be armed NASSAU, The Bahamas -- In the aftermath of a police officer being shot six times over the weekend, the Police Staff Association (PSA) plans to once again press The Bahamas government and the hierarchy of the police force to allow all officers to be armed when off-duty. PSA executive chairman Sergeant Darrell Weir said the PSA will no longer “bury its head in the sand” while criminal activity threatens officers’ lives. “We are of the view that this should spark serious consideration with regards to officers being allowed to be armed on a 24-hour basis,” said Weir during a press conference at PSA headquarters on Tuesday. “In the coming days we will formally address this matter with the commissioner of police and the government. We are confident that the commissioner will continue to act in the best interest of all officers and the general public.” As it stands, many officers in the lower ranks are not allowed to carry guns home after their shifts are officially over. Wilfred Christopher Atherley, a corporal with more than 20 years of service on the police force was attacked around 10:30 p.m. on Saturday. Initial reports indicate that the officer, who is in his

40s, was approached then shot by a masked gunman as he walked to his car. The Nassau Guardian was told by law enforcement sources that Atherley visited his 15-year-old daughter minutes before the shooting. Weir was reluctant to reveal personal details about the wounded officer, but said that Atherley’s condition had been upgraded to stable yesterday. “It’s no secret that the days are gone where persons will resolve their conflicts in a peaceful manner -- the order of the day is guns... and we must not play the fool and say we don’t know what’s going on,”?he said. “It’s no use when we knock off [to have] to turn the firearm in, because the same brother we locked up today, we are going to see him out there and he’s not going to say, ‘Hold on, you have your gun on you? Let me allow you to go and get your gun’.” Commissioner of Police Ellison Greenslade said on Monday that police would spare no effort to ensure the “coward, culprit or culprits” responsible for attacking Atherley are brought to justice. At least three officers have been shot this year, including reservist Dennis Clarke, who was killed during a robbery outside a laundromat on May 31.

IDB launches credit facility for Caribbean WASHINGTON – The Inter-American Development Bank (IDB) has launched two new contingent credit facilities for Latin America and the Caribbean to help countries deal beforehand with shocks caused by external financial crises and to help nations cope with the aftermath of natural disasters. The Washington-based financial institution said a new Development Sustainability Contingent Credit Line (DSL) will make US$6 billion available to the IDB’s 26 borrowing member-countries over the 2012-2014 period, with a maximum of $2 billion per year and with unused resources from one year carrying over to the next one. The new line is designed to help countries protect its poorest citizens from sharp fluctuations in commodity prices, global liquidity crises and other exogenous factors. It said a separate Contingent Credit Line for Natural Disasters (CCL) will help countries cover urgent financing needs that arise immediately after a natural disaster. The IDB said the overall amount for the CCL is capped at US$2 billion for 2012-2014. In addition, it said a separate and currently available Contingent Credit Facility for Natural Disasters (CCF) is being expanded. “Many of the poorest citizens of Latin America and the Caribbean region have seen their lives improve in recent years thanks to better social programs and macroeconomic management,” said IDB President Luis Alberto Moreno.

“Development Banks, such as ours, can help protect these policies and social programs from earthquakes, floods, commodity price fluctuations, external financial crises and other events that are beyond the control of governments,” he added. The new DSL replaces the previous US$3 billion Emergency Lending facility, the IDB said. It is designed to specifically protect programs and policies that assist the poor from external financial shocks and is capped at a maximum of US$300 million per country, or 2 percent of a country’s Gross Domestic Product (GDP), whichever is lower. Countries get the contingency line approved before the event takes place, the IDB said. It said the Contingent Credit Line for Natural Disasters is to provide borrowing member countries with resources to cover urgent financing needs that arise immediately after a natural disaster, until other sources of funding can be accessed. The IDB said the country limit is US$100 million or 1 percent of GDP, whichever is lower. It said the new CCL will complement the currently available Contingent Credit Facility for Natural Disasters (CCF), a more restrictive facility created to help countries deal with catastrophic natural disasters. Unlike the CCL, the CCF has no overall limit, though the limit per country has been set to US$300 million or 2 percent of GDP, whichever is lower.

Antigua considers offering economic citizenship ST JOHN’S, Antigua – Antigua and Barbuda could join Dominica and St Kitts and Nevis as the only Caribbean nations to offer wealthy investors citizenship in exchange for them pumping significant capital into the economy. A series of public consultations started on October 11th on the Citizenship by Investment Programme being put forward by the Baldwin Spencer administration. At a recent media briefing where Prime Minister Spencer and Members of the Citizenship by Investment Taskforce presented the details of the programme to the Antigua and Barbuda media as an avenue for the country’s future growth, it was projected that by the end of the third year, the programme could yield a gross investment in excess of EC $550 million.

The programme would be made available through four mechanisms: a real estate option, with the purchase of property with a minimum value of US$400,000 in a designated resort zone; a contribution of a minimum US$250,000 to a National Development Fund; a contribution of a minimum US$250,000 to a charitable fund; or a business investment of US $1.5 million. Spencer said the Citizenship by Investment Programme was in keeping with the homegrown National Economic and Social Transformation (NEST) Plan, to revitalize the economy and stimulate growth. Chavez’s next presidential term will begin January 10, 2013. The number of votes in favor of Chavez, represent 54.42 percent of all 13 million 667 thousand 934 valid votes. This means that Chavez won over his rival Henrique Carpriles with a difference of nearly 10 points. Capriles garnered 44.97 percent (6 million 151 thousand 544 votes) the president of the National Electoral Council, Tibisay Lucena announced in a press conference after the vote counting. Lucena stressed the massive turn out at the polls, which totaled 80.94 percent, one of the largest participations by the people in an election over the past decades in Venezuela. $16.5 million worth of cocaine seized near Puerto Rico San Juan- US federal authorities announced that they seized 660 kilograms of cocaine on a speedboat near Puerto Rico in one of the island's largest drug busts this year. Mother charged with prostituting girls including daughter, 14 SAN JUAN, Puerto Rico — A woman suspected of prostituting her 14-year-old daughter, among other young girls, has been arrested by federal agents in the United States island territory. A federal criminal complaint has been filed by authorities charging Betsian Carrasquillo Penaloza with taking her teenage daughter and two other girls to the Sheraton Hotel at the San Juan Convention Centre after meeting with undercover US agents. Carrasquillo demanded US$500 for sex with her daughter and US$250 more for each of the other girls, the affidavit says. A Homeland Security Investigations agent says in an affidavit signed last Friday that Carrasquillo also prostituted other underage girls. The obese 34-year-old woman goes by the nickname ‘‘Fatty the Maneater.’’ Carrasquillo Penaloza has not entered a plea and remains behind bars.

Romney extends lead over Obama: Reuters/Ipsos poll Republican challenger Mitt Romney has extended his lead over President Barack Obama to 3 percentage points, according to a Reuters/Ipsos tracking poll released on Thursday, ahead of a high-stakes debate between the two candidates' running mates. Romney now leads the Democrat by 47 percent to 44 percent among likely voters in the online poll, with less than a month before the November 6 election. The Republican had a onepoint lead over Obama in survey results on Wednesday, his first in more than a month. Romney has been enjoying one of his best runs of the campaign after

handily winning the first presidential debate last week, partially due to Obama's passive performance in that contest. "The momentum is in Romney's direction right now," Ipsos pollster Julia Clark said. Vice President Joe Biden will look to recover some momentum for Obama's re-election bid when he faces off Thursday evening with Republican challenger Paul Ryan in the only vice presidential debate of the campaign. The veteran Biden, an accomplished debater known for delivering withering attacks with a smile, will try to improve the outlook

for the Democrats before Romney and Obama meet for a second debate Tuesday. Ryan, chairman of the House of Representatives budget committee, will look to ward off aggressive moves from Biden while avoiding his own tendency to get mired in numbers. Clark said Romney's rise in the poll comes from convincing undecided voters, not winning over Obama supporters. And there were signs that a large number of votes are still up for grabs. Sixteen percent of registered voters said they could still change their minds about whom to vote for, including 28

Biden, Ryan Clash in Aggressive Vice-Presidential Debate Vice President Joe Biden and Congressman Paul Ryan sparred Thursday night in a sharp and wideranging vice-presidential debate, clashing early and often in a tussle likely to reinvigorate Democrats demoralized by President Barack Obama’s listless performance last week. While Ryan’s performance was steady and controlled, the night belonged to Biden, for better and for worse. The Vice President displayed the pugnacity and pluck that his boss failed to flash against Mitt Romney. Seizing the debate from the start, Biden marshaled an aggressive defense of the Obama Administration’s record at home and abroad. He promoted the success of the stimulus, praised Obama for his progress unwinding two foreign wars and sought to convince swing voters that the economic recovery was gaining traction. Where Obama pulled punches, Biden swung from his heels, repeatedly invoking Romney’s damning comments about the 47% of Americans who see themselves as “victims” and rely on government. “I’ve had it up to here with this notion that, ‘Forty-seven percent, it’s about time they take some sort of responsibility here,’” Biden said. He chided the Republican ticket for embellishing the shaky state of the economy to score political points and for eliding the GOP’s role in causing the exploding deficits it pins on Obama. “I’ve never met two guys who are

And, by the way, they talk about this Great Recession [as] if it fell out of the sky … It came from this man voting to put two wars on a credit card, to at the same time put a prescription-drug benefit on the credit card, a trillion-dollar tax cut for the very wealthy. I was there. I voted against them. I said, ‘No, we can’t afford that.’” In several testy exchanges, Biden also accused Ryan of twisting the truth. “Not a single thing he said is accurate,” he said after Ryan’s first answer. “That’s a bunch of malarkey,” he exclaimed later, when Ryan attacked Obama for imposing defense cuts that congressional Republicans

— including himself — in fact supported. “This is a bunch of stuff,” Biden groused later, prompting moderator Martha Raddatz to ask what he meant. “It’s Irish,” Ryan responded, one of his few moments of humor in a debate whose levity largely consisted of Biden visibly snickering while Ryan spoke. Early on, the seasoned, silverhaired Biden, 69, appeared to unsettle Ryan, 42, with his combative and sometimes condescending tone. Biden sneered, smiled broadly and shook his head theatrically as Ryan spoke. He interrupted his younger opponent repeatedly, and at times he seemed to regard the House Budget Committee chairman as though he’d mistakenly wandered over from the kids’ table. What some might have seen as smugness — which Biden kept under

wraps while debating Sarah Palin four years ago — could rankle swing voters. It certainly seemed to irk Ryan, who at one point shot back: “I know you’re under a lot of duress to make up for lost ground.” Ryan, who totes a thin foreign policy résumé, evinced a fluency with world affairs, sparred heatedly with Biden during several exchanges over the drawdown timetable in Afghanistan and the recent consulate attack in Libya. “What we are watching on our TV screens is the unraveling of the Obama foreign policy,” he said. Biden, by contrast, may have gotten the better of the economic realms Republicans expected Ryan to dominate. It seems unlikely the debate will drastically shake up the race — and certainly not to the degree that Romney’s drubbing of Obama upended the contest. In an instant poll by CNN/ORC, 48% of respondents said Ryan won the debate, while 44% preferred Biden. But there was no question that Biden dominated the debate, bringing to bear his four decades on Capitol Hill in an animated performance. His broadsides and body slams seemed geared to energize a Democratic base dispirited by Obama’s flop last week, while Ryan’s steady, constrained answers appeared calibrated to appeal to moderate voters the Republican ticket wants to coax into its camp. Whether you preferred the Democrat or the Republican may hinge on whether you found Biden’s forceful performance brilliant or boorish.

Pope acknowledges "bad fish" in Church Pope Benedict urged lapsed and lukewarm Roman Catholics on Thursday to rediscover their faith but acknowledged there are "bad fish" in the Church itself. The pope made his comments at two large events before thousands of people in St. Peter's Square on the 50th anniversary of the opening of the Second Vatican Council, a far-reaching event in the Church's 2,000-year history. "Recent decades have seen the advance of a spiritual desertification," he said in his sermon of a morning Mass, opening a worldwide "Year of Faith". "We see it all around us ... the void has spread," he said. The mass was attended by hundreds of Roman Catholic bishops as well as representatives of other Christian churches, such as Archbishop of Canterbury Rowan Williams. The bishops are in Rome for

Among its innovations was the introduction of the Mass in local languages after centuries of it being said in Latin. The Council also encouraged dialogue with, and respect for, other religions and repudiated the concept of collective Jewish guilt for Jesus' death, revolutionizing Catholic-Jewish relations after 2,000 years of mistrust. But 50 years on, the Council is divisive. Liberals in the Church say Benedict, who attended the Council as a young priest, has turned back the clock on some Council reforms and moved to centralize power in the Vatican again. Conservatives praise him for correcting what they regard as errors in applying its ideas. For example, conservatives assert that the Council's push for dialogue with other religions went too far and weakened the traditional teaching that Catholicism is the one true faith.

Astronomers discover Diamond planet Forget the diamond as big as the Ritz. This one's bigger than planet Earth. Orbiting a star that is visible to the naked eye, astronomers have discovered a planet twice the size of our own made largely out of diamond. The rocky planet, called '55 Cancri e', orbits a sun-like star in the constellation of Cancer and is moving so fast that a year there lasts a mere 18 hours. Discovered by a U.S.-Franco research team, its radius is twice that of Earth's with a mass eight times greater. That would give it the same density as Earth, although previously observed diamond planets are reckoned to be a lot more dense. It is also incredibly hot, with temperatures on its surface reaching 3,900 degrees Fahrenheit (1,648 Celsius). "The surface of this planet is likely covered in graphite and diamond rather than water and granite," said Nikku Madhusudhan, the Yale researcher whose findings are due to be published in the journal Astrophysical Journal Letters. The study - with Olivier Mousis at the Institut de Recherche en Astrophysique et Planetologie in Toulouse, France - estimates that at least a third of the planet's mass, the equivalent of about three Earth masses, could

be diamond. Diamond planets have been spotted before but this is the first time one has been seen orbiting a sun-like star and studied in such detail. "This is our first glimpse of a rocky world with a fundamentally different chemistry from Earth," Madhusudhan said, adding that the discovery of the carbon-rich planet meant distant rocky planets could no longer be assumed to have chemical constituents, interiors, atmospheres, or biologies similar to Earth. David Spergel, an astronomer at Princeton University, said it was relatively simple to work out the basic structure and history of a star once you know its mass and age. "Planets are much more complex. This 'diamond-rich super-Earth' is likely just one example of the rich sets of discoveries that await us as we begin to explore planets around nearby stars." SAO PAULO—Brazil's first black Supreme Court justice has been chosen as the presiding judge for the high court. Joaquim Barbosa was elected Wednesday as Supreme Court president. His two-year tenure begins next month with the retirement of the court's current president, Carlos Ayres Britto. Barbosa currently is presiding over a high-profile corruption trial involving a congressional cash-for-votes scheme. His election is not a surprise because the Supreme Court presidency always goes to Joaquim Barbosa the justice who has sat on the bench the longest. Barbosa became a Supreme Court justice in 2003 and is the only black to have ever served on the court.

US State Department acknowledges rejecting requests for more security in Libya The State Department acknowledged Wednesday that it rejected appeals for more security at its diplomatic posts in Libya in the months before a fatal terrorist attack in Benghazi as Republicans suggested that lapses contributed to the deaths of the U.S. ambassador and three other Americans. Republicans also tried to use a congressional hearing to blow holes in the Obama administration’s public explanations for what happened in Benghazi on Sept. 11, accusing the White House of playing down the possibility that the attack was a successful al-Qaeda assault. The highly charged congressional oversight session, titled “Security Failures of Benghazi,” included sharp accusations from Republicans that the State Department was more interested in presenting a picture of an improving

Canadian naval officer admits to spying for Russia Moscow: A Canadian naval officer, arrested in Canada on suspicion of espionage, has pleaded guilty to charges of selling classified information to the Russian military. Canada's CBC television network said SubLieutenant Jeffrey Paul Delisle, 41, who served at a Canadian naval intelligence centre in Halifax, was taken into custody in January. Attorney Lyne Decarie said he provided his Russian handlers material downloaded from the computer at the HMCS Trinity intelligence facility, which shares information with intelligence communities in the US, Britain and other countries. Prosecutors alleged that his Russian handlers paid Delisle $3,000 a month for the information, which was mainly military intelligence but also included reports on organised crime as well as personal information on politicians and senior members of the intelligence community.

Delisle's spying, which apparently began in 2007, caused "severe and irreparable damage to Canadian interests", prosecutors said. Delisle has confessed via his lawyer to all the allegations, CBC said. He faces life in prison for "passing secrets to the enemy". The charges were brought under the information security law adopted in December 2001 after the 9/11 terror attack in the US. Delisle came under suspicion last year after Canadian customs officials found that he had returned from a four-day trip to Brazil with $10,000 in cash and $40,000 in prepaid debit cards, which he had in fact received from a Russian contact in Rio de Janeiro, according to the allegations. The matter was turned over to the Royal Canadian Mounted Police, which surreptitiously hijacked the e-mail address that Delisle used to send the secret material to his handlers.

Opinion polls in Israel predict easy win for Netanyahu Jerusalem: Israel's hawkish Prime Minister Benjamin Netanyahu and his right-wing religious bloc will have an easy victory in the snap polls to be held early next year, opinion polls published on Thursday. According to a poll by Israeli daily Ha'aretz, Netanyahu's coalition is set to increase its share in the 120-member Knesset (Israeli parliament) garnering 68 seats compared to a centrist-left coalition which will manage only 52. The right-wing bloc, backed by five members of the centrist Atzmaut party, has 66 seats in the current Knesset. Netanyahu's popularity is also on the ascent with Dialog poll for Ha'aretz showing that 57-62 per cent of respondents found him the best suited to lead the country (depending on who he is up against). Former Foreign Minister Tzipi Livni, who

failed to win her Kadima party primaries, scored 28 per cent while former Prime Minister Ehud Olmert, who resigned following a series of charges of graft but has managed to get reprieve from the courts, scored 24 per cent. Malaysian couple charged with beating, scalding and exploiting their Indonesian maid KUALA LUMPUR, Malaysia — A Malaysian couple has been charged with beating, scalding and exploiting their Indonesian maid in the latest such abuse case in Malaysia despite new rules to better protect domestic workers, a prosecutor said. A series of cases involving the abuse of Indonesian maids by their Malaysian employers has strained ties between the Southeast Asian neighbors. Indonesia this year lifted a three-year ban on sending maids to Malaysia after the countries agreed to better protect the workers, including giving them one day off per week. Prosecutor Chuah Shyue Chien said Mohamad Shukur Suradi, 28, and his wife, Daeng Norulasyikin Bachok, 27, pleaded not guilty Friday to causing grievous harm to their 21-year-old maid, Marsini, who like many Indonesians uses one name. Chuah alleged that the couple used a knife, a golf club, a clothes hanger and a belt to hit Marsini and scalded her with hot oil and water between July and Sept. 23 at their home in southern Johor state. The car salesman and his teacher wife also were charged under the Anti-Human Trafficking Act with exploiting Marsini by making her work long hours and working against her will, Chuah said. They face up to 35 years in jail and whipping if convicted for both offenses. Chuah said Marsini, who started working for the couple in January, managed to escape from her employers and lodged a police report. He said she is currently in a shelter home to nurse her injuries. The couple has been freed on bail, with a court date set for Oct. 16. Indonesian Embassy officials could not be reached immediately for comment. More than 200,000 Indonesian maids work in Malaysia. Indonesian officials say hundreds complain every year of mistreatment, overwork and unpaid salaries.

US court clears Samsung phone, hands Apple setback WASHINGTON/SAN FRANCISCO - A U.S. appeals court overturned a pretrial sales ban against Samsung Electronics Co Ltd's Galaxy Nexus smartphone, dealing a setback to Apple Inc in its battle against Google Inc's increasingly popular mobile software. Apple is waging war on several fronts against Google, whose Android software powers many of Samsung's devices. The ruling on Thursday from the U.S. Court of Appeals for the Federal Circuit is not expected to have an outsized impact on the smartphone market, as the Nexus is an aging product in Samsung's lineup. Apple's stock closed down nearly 2 percent at $628.10. However, the court's reasoning could make it much harder for companies that sue over patents get competitors' products pulled from the

market, said Colleen Chien, a professor at Santa Clara Law school in Silicon Valley. Such sales injunctions have been a key for companies trying to increase their leverage in courtroom patent fights. "The Federal Circuit has said, 'Wait a minute,'" Chien said. Apple declined to comment, while Samsung did not immediately respond to requests for comment. Apple scored a sweeping legal victory over Samsung in August when a U.S. jury found Samsung had copied critical features of the hugely popular iPhone and iPad and awarded Apple $1.05 billion in damages. The Nexus phone was not included in that trial, but is part of a tandem case Apple filed against Samsung earlier this year. District Judge Lucy Koh issued a

pretrial injunction against the Nexus in June, based on an Apple patent for unified search capability. The appeals court then stayed that injunction until it could formally rule. In its opinion on Thursday, the Federal Circuit reversed the injunction entirely, saying that Koh abused her discretion. Apple failed to prove that consumers purchased the Samsung product because of the infringing technology, the appeals court ruled. "It may very well be that the accused product would sell almost as well without incorporating the patented feature," the court wrote. "And in that case, even if the competitive injury that results from selling the accused device is substantial, the harm that flows from the alleged infringement (the only harm that should count) is not." The court considered a single

patent - one which allows the smartphone to search multiple data storage locations at once. For example, the smartphone could search the device's memory as well as the Internet with a single query. The appeals court has sent the case back to Koh for reconsideration. A separate pretrial sales ban Apple had managed to win against Samsung targeting the Galaxy Tab 10.1 - was dissolved earlier this month after Samsung won at trial on that patent. Beyond the Nexus, Samsung also has a collection of new tablets and smartphones intended for launch before the holidays. On Wednesday, Google executive chairman Eric Schmidt called the intensifying struggle between Apple and his company a "defining fight" for the future of the mobile industry. US jobless claims fall to lowest in four and half years

The number of Americans filing new claims for jobless benefits slid last week to the lowest level in more than four and a half years, according to government data that may provide a boost to President Barack Obama a month before voters go to the polls. The Labor Department report on Thursday was the latest data to suggest improvement in the jobs market, though the surprisingly large 30,000 drop in new claims may have reflected distortions due to seasonal adjustments that are likely to be smoothed out in coming weeks. "The overall trend seems to be that the labor market is improving," said Brian Kim, a currency strategist at RBS Securities in Stamford, Connecticut. A Labor Department analyst said seasonal factors had predicted a very large increase in claims last week, which he said would be typical for the first week of the quarter. Unadjusted claims did rise, but far less than expected, resulting in the sharp drop in the seasonally adjusted figure. He noted that one state reported a decline in claims last week when a rise had been expected. No states had been estimated for the report, he said. "We will likely see some payback in the claims data reported next week. But through this potential volatility, it does look like the trend in the claims is improving somewhat," said Daniel Silver, an economist at JPMorgan. California, given its large population and past "massive swings" in its claims data, was probably the state that caused the sharp drop in the seasonally adjusted figure, Silver said. A second Labor Department official said "a processing issue" resulted in the state, which he did not identify, reporting fewer claims than expected. "We cannot dictate to a state how they process their claims ... This is one of the years they happened to be behind everyone else," he said, adding the Columbus Day holiday this week may have been one factor. "This individual state, whenever there are increases in claim, usually range from 15,000 to almost 20,000," he added. The jobs data was tempered by a second report on Thursday that hinted at weaker U.S. and global demand. The trade deficit widened in August to $44.2 billion, as goods exports fell for the fifth consecutive month and imports declined fractionally.

The patent brawl between Samsung and Apple marches on. Samsung on Tuesday filed amendment documents requesting to add the iPhone 5 to its existing suit against the Cupertino company. Samsung accuses Apple’s latest smartphone of infringing eight of its patents, the same ones it claims Apple’s new iPad, iPad 2, iPhone 4S, iPhone 4, and iPod touch also infringe. In its filing, Samsung states, “The iPhone 5 has the same accused functionality as the previously accused versions of the iPhone, so the proof of infringement of the patents-in-suit by the The Apple/ Samsung saga continues iPhone 5 is the same as for other Apple devices already accused of infringement in this litigation.” To justify adding the iPhone 5 to the previous filing, Samsung states in its amendment that it “could not have known whether the rumored iPhone 5 would practice its patented technologies when it filed its infringement contentions on June 15. The product was not on the market at that time and could not have been included in the contentions.” Nonetheless, Samsung had already threatened to sue Apple over the iPhone 5 this month. And earlier reports indicated that Samsung had planned to add the iPhone 5 to its list of infringing Apple devices once it confirmed that the smartphone had 4G LTE capability. The news comes just over month after a U.S. jury found Samsung guilty of violating many of Apple’s design patents. The jury decided Samsung owed Apple close to $1.05 billion in damages.

Hewlett-Packard edged out as biggest personalcomputer seller, according to industry report Amid a global slump in personal computer sales, Hewlett-Packard has relinquished its position as the world's biggest PC seller for the first time in five years, one research firm reported Wednesday, while another had the Palo Alto technology giant clinging to the top spot. The bad news for HP was compounded by an additional report Wednesday that PC shipments from computer makers for the year would likely shrink about 1 percent, with the last such drop recorded during the dotcom bust of 2001. "HP has given up the PC vendor position for the first time since the third quarter of 2006," according to the market monitoring firm Gartner. It said the top position for the quarter was held by Lenovo of China, which previously had been in second place. Lenovo edged out HP with 15.7 percent of the 87.5 million PC shipments for the quarter, a nearly 10 percent increase for the Beijing-based company over the same period a year ago. HP's 15.5 percent share represented a drop of 16.4 percent from the third quarter last year, Gartner said.

Another research firm -International Data Corporation -reported that HP still held a narrow lead in the top position, with 15.9 percent of the market, while Lenovo held 15.7 percent. Asked to respond, HP spokesman Michael Thacker noted that, "while there are a variety of PC share reports in the market, some don't measure the

market in its entirety. The IDC analysis includes the very important workstation segment and, therefore, is more comprehensive." Nonetheless, both reports contained troublesome news for HP, as well as for Santa Clara-based Intel , which gets most of its revenue by providing microchips to PCs and which counts on HP as its biggest customer.

Gartner said worldwide PC shipments from computer makers declined 8 percent in the third quarter, while International Data Corporation estimated the drop at 8.6 percent. "PCs are going through a severe slump," said IDC senior research analyst Jay Chou, in a prepared statement. "The industry had already weathered a rough second quarter, and now the third quarter was even worse." Research firm IHS offered a similarly gloomy assessment for 2012 as a whole. It projected PC shipments to shrivel by 1.2 percent to 348.7 million units, down from 352.8 million in 2011. "There was great hope through the first half that 2012 would prove to be a rebound year for the PC market," said IHS principal analyst Craig Stice in a prepared statement. But now, he added, "optimism has vanished and turned to doubt, and the industry is now training its sights on 2013 to deliver the hoped-for rebound. All this is setting the PC market up for its first annual decline since the dot-com bust year of 2001."

S&P cuts Spain credit rating to near junk Standard & Poor's on Wednesday cut Spain's sovereign credit rating to BBB-minus, just above junk territory, citing a deepening economic recession that is limiting the government's policy options to arrest the slide. The S&P downgrade comes with a negative outlook reflecting the credit ratings agency's view that there are significant risks to economic growth and budgetary performance, plus a lack of clear direction in euro zone policies. "In our view, the capacity of Spain's political institutions (both domestic and multilateral) to deal with the severe challenges posed by the current economic and financial crisis is declining," S&P said in a statement. S&P's two-notch downgrade from BBB-plus brings it in line with Moody's Investors Service's Baa3 rating. Moody's has Spain on review for a possible downgrade. Both firms have Spain just on the cusp of junk status. Fitch Ratings has a BBB rating on Spain, one notch higher, but also with a negative outlook. A spokeswoman at Spain's Economy Ministry told Reuters the government had no comment on the ratings action. The country has been in recession since earlier this year, its second economic contraction in just a few years, and unemployment is stubbornly high at close to 25 percent with a return to job creation still two years away. Falling tax revenue and rising costs of unemployment benefits are confounding the government's efforts to hit a 2012 deficit reduction target of 6.3 percent of gross domestic target agreed with the European Union. Both the International Monetary Fund and Spain's own Central Bank cast doubt on the savings envisioned in Prime Minister Mariano Rajoy's 2013 budget, saying they are based on a too-rosy outlook for the economy. In the wake of the downgrade, the euro dropped about 0.25 percent to $1.2865 in late New York trade from just under $1.29 prior to the news. "This is weighing on the euro. A downgrade from S&P could be followed by a downgrade from Moody's, and while S&P did not downgrade Spain to junk, Moody's might," said Kathy Lien, managing director at BK Asset Management in New York. "If Moody's goes to junk status, that's even more

significant, and this adds to the pressure on Moody's to make a decision. It could lead to higher bond yields in Spain and push the government closer to asking for a bailout," Lien added. In European trade earlier on Tuesday, ten-year Spanish bond yields fell 1 basis point to 5.83 percent. Those yields spiked above 7 percent earlier this year, but have since come down on a European Central Bank bond-buying plan. SOCIAL DISCONTENT AND EURO ZONE DOUBTS Prime Minister Rajoy's centre-right People's Party has an absolute majority in parliament and so far has

been able to pass spending cuts and economic reforms without any problem. However, street protests have increased in recent months as Spaniards revolt against public sector wage cuts and lower spending on education and healthcare. Resentment is also rising over huge public bailouts for the country's crippled banks, while social benefits are cut. Although Rajoy's PP governs 11 of 17 Spanish regions, which have been forced to make massive budget cuts, S&P noted that tensions between the central and regional governments are rising, "leading to substantially diluted policy outcomes."

BP to export U.S. crude to Canada, Shell seeks permit NEW YORK/HOUSTON - Oil major BP Plc has secured U.S. government permission to ship U.S. crude oil to Canada, and Royal Dutch Shell has applied for an export license, as rising production in the world's top oil consumer upends global energy flows. A surge in output from shale oil reserves in the Bakken of North Dakota and Eagle Ford of Texas has raised U.S. domestic production to the highest level since 1995, light, sweet crude that could fetch better prices on international markets. The United States still imports more than 8 million barrels per day, making it the world's biggest importer. BP Plc received a crude export license this summer from the Bureau of Industry and Security, a branch of the US Commerce Department, to ship crude oil to Canada, a source familiar with the issue said on Thursday. BP has yet to export any crude oil on that license, the source said. "We have applied to the Department of Commerce to export domestic U.S. crude oil," Shell spokeswoman Kayla Macke told Reuters, adding that as a global commodity, imports and exports would follow supply and demand. Macke declined to comment on the likely export

destinations or the volumes of crude involved. A nearly century-old U.S. law requires companies to get a special license to export crude oil. Until recently, there has been no demand for overseas shipments, apart from a trickle of crude from Alaska that has been routinely exported. The Financial Times first reported the news, saying Swiss-based trading firm Vitol applied for a license, citing people familiar with the matter. "Other than routine movement between Canada and the United States, we have not been involved in any crude oil export requests," a Vitol spokesman said. Experts say some U.S. crude oil has routinely moved through Canada or has been refined over the border, but must be reimported to the United States. The FT said the Department of Commerce refused to confirm or deny the existence of license applications or licenses, but quoted the DOC as saying exports to Canada had a "presumption of approval". But domestic U.S. refiners, especially on the Gulf Coast, were built to process cheaper, heavier types of crude from Mexico or Saudi Arabia, and are often illsuited for refining the lighter crudes and natural gas liquids created by the U.S. boom in hydraulic fracturing or 'fracking'.

Cheshire Hall, Pedagogue, Sharks, expendables impressive in Super 7s kick-off The TCIFA Super 7’s Men’s Football league got off to a promising start last week as eight teams took to the field. The league will run until December and judging by the opening night’s play it is going to be a very competitive league. In the opening games Pedagogue FC beat the COE Boys 4-0 with goals coming from Romain Small (2), Haroon Swaby, Erwin Twain. This was the first time the young

boys had played against adult opposition but despite their lack of size and experience they held their own against the PPL team. SWA Sharks pulled off a dramatic victory as they came back from 3-1 down to defeat AFC Academy 4-3. Paul Collis had given the Sharks the lead before Myrohn Pereira, Wildens Delva and Fred Dorvil opened up a comfortable lead for the Academy team.

However, complacency seemed to set in and AFC Academy did not anticipate a determined Shark’s performance in the second half as goals by Richard Lock and Arlindo Serpa (2) gave the Sharks a well earned victory. The final two games were largely one sided affairs as Cheshire Hall defeated the Police 6-0 and the Expendables had a comfortable 4-0 win against the Teachers. Navar

The previous games had been high scoring affairs (6-4 and 3-2) but with both teams having worked hard on improving their defence in recent weeks this game was a very close with both teams finding it hard to create clear chances. Both teams started positively with Yarielca De La Cruz (Strikers) and Ruth Francois (Hurricanes) controlling the game from the midfield. Jenny Fluerenvil made some strong runs on the right wing for the Strikers but was not getting enough support from her team mates. Guerline Hall worked tirelessly as ever and engineered the opening goal as her strong tackle and exquisite pass gave Kadine Delphin an opportunity to cut inside and score. Both teams continued to work hard to score but both teams defences help up well. Armstrong accusers banned after confessing NEW YORK - The five American cyclists who testified against Lance Armstrong have all been formally banned for six months after confessing to using performance enhancing drugs, USA Cycling said on Thursday. Tom Danielson, George Hincapie, Levi Leipheimer, Christian Vande Velde and David Zabriskie all agreed to serve six-month suspensions as part of a plea bargain to provide sworn testimony to the United States AntiDoping Agency (USADA). USA Cycling praised the cyclists for confessing to their own transgression but said the bans would stand and their results annulled during

the period they admitted to cheating. "As a result of their testimony in the Lance Armstrong investigation, USA Cycling will enforce these sanctions and is currently reviewing the impact of the sanctions on historical results," USA Cycling Chief Executive Steve Johnson said in a statement. "More importantly, I would like to personally acknowledge the extraordinary courage of these riders who placed their careers on the line in order to come forward with their experiences of past doping practices." While it was initially believed that Rose could be ready to return to the Bulls during the All-Star break this upcoming season, the Bulls guard is noncommittal about his return. Rose spoke with NBA TV's Steve Aschburner and acknowledged that there is still the possibility that he will miss the entire 201213 season as he recovers from the knee injury. Rose has been warned about returning to action to soon and knows that returning for the final few months of the season could prove to do more harm than good. Knee injury will sideline Bills DE Anderson TEMPE, Ariz. - The Buffalo Bills have suffered another blow to their porous defense. Defensive end Mark Anderson will have surgery on his left knee and will be out indefinitely. Anderson, who signed a four-year, $27 million contact prior to the season, suffered the injury - and had difficulty putting any weight on it - in the second half last Sunday during the 45-3 blowout at San Francisco. "It looks like he needs surgery and he is going to be out. I don't know how long,'' Bills coach Chan Gailey said. "He will be back. It is not like he is going to miss the rest of the season. They just said indefinite and they will no more when they go in.'' According to general manager Buddy Nix, Anderson will visit Dr. James Andrews to determine the severity of the injury. That leaves 10-year veteran Chris Kelsay to take over the starting duties at right defensive end. Kelsay traditionally plays the left side. Kyle Moore will also see action and former All-Pro Mario Williams will remain at his left end spot. The Bills are down to three defensive ends because veteran backup Spencer Johnson is expected to miss his second game with an ankle injury. "(Anderson) has been a very good addition to our football team. You hate to lose people that have his kind of energy and have been playing the way that he has been playing,'' Gailey said. "It hurts your depth, it hurts your pass rush, and it hurts every little thing there. Next guy in line has to step up. We got three defensive ends right now and those guys are going to have to make it happen.'' The Bills attempted to improve their defense by signing Anderson and Williams in March. The plan's been unsuccessful so far.

Williams, who has been hampered by a left wrist injury, has not played up to expectations, having managed just 1 1/2 sacks so far. The injury has bothered him since hurting it in the final week of the preseason, though he's not been placed on the team's injury report because he's not missed practice. That changed on Wednesday, when the Bills listed Williams on their report as having practiced fully with a wrist injury. The move comes days after the NFL revealed it is investigating whether the Bills have violated a league rule, stating that teams are required to list players on their injury report even if they don't miss practice time. And the rule stresses that it's especially important to list "key players.'' Williams didn't think the issue is a big deal. "I don't care about that. Only thing that matters to me is that I am playing,'' Williams said. "It is still the same pretty much. That is why I have to cope with it. It is one of things you have to deal with.'' A potentially more worrisome development is starting defensive tackle Kyle Williams being listed on the injury report as missing practice due to an ankle injury. Without Anderson, more pressure will be placed on Mario Williams to perform up to his capabilities. "It is going to be a huge challenge,'' Williams said. "Mark is a great player. Having him, his intensity, and his demeanor out on the field is definitely going to be a (challenge) for us. We have to be able to pick it up. Not just us needing to do it for ourselves, but to fill in his place and the injuries we have been faced with.'' Sandusky gets 30 to 60 years for sexual abuse BELLEFONTE, Pa. — Jerry Sandusky stood in court Tuesday in his current uniform, the bright red jumpsuit of the Centre County jail. No longer was he in his Penn State coaching gear, nor in the suit and tie he wore at his trial in June. He was, in a sense, as powerless before his victims as they had once been before him. So he sat, forced to listen. We both know exactly what happened,” said one of three victims who stood and spoke. Another said: “I am troubled with flashbacks of his naked body, something that will never be erased from my memory. Jerry has harmed children, of which I am one of them.” “There is no punishment sufficient for you,” the mother of another victim wrote in a statement read by the lead prosecutor. Another victim wrote: “There is no remorse. There is no acknowledgment of regret, only evil.” The Penn State sexual abuse scandal does not have many chapters left. The former football coach Joe Paterno is dead, his name tainted by a formal investigative finding that he failed to respond to warnings of Mr. Sandusky’s crimes, even chose to cover them up. The university’s president, Graham B. Spanier, has been dismissed. The university’s football program has been sanctioned. The victims are seeking money, and Penn State has acknowledged it will have to pay. But there was the matter of setting Mr. Sandusky’s term in prison for 45 counts of abuse, and Judge John M. Cleland addressed that business with emphatic scorn. He sentenced Mr. Sandusky to 30 to 60 years.

“I’m not going to sentence you to centuries,” Judge Cleland said to Sandusky. “It makes no sense for a 68year-old man. This sentence will put you in prison for the rest of your life.” Judge Cleland added that the case, which shook Penn State and called into question the role of major college sports on campus, was, in the end, “a story of betrayal.” “You abused the trust of those who trusted you,” he said. Mr. Sandusky entered the courtroom just before 9 a.m., looking thinner than he had at his trial. He took his seat and turned, smiled and waved to his wife, Dottie. He soon gave a rambling, 15-minute statement in court, in which he professed his innocence, as he had in a recorded statement broadcast on a Penn State radio station Monday night. “I did not do these alleged disgusting acts,” he said Tuesday. Mr. Sandusky was convicted in June of sexually abusing 10 boys, all from disadvantaged homes. Mr. Sandusky used his connections to the Penn State football program, as well as his own charity for disadvantaged youths, the Second Mile, to identify potential victims, get close to them and then sexually violate them. Mr. Sandusky’s remarks Tuesday at times resembled a pregame motivational speech, perhaps reflecting his years as a widely admired defensive assistant for Mr. Paterno. Casting himself in the role of an underdog fighting against a conspiracy to find him guilty, Mr. Sandusky mentioned that “Seabiscuit” was one of his favorite movies. He read aloud a letter from a boy who

On his 46th wedding anniversary, he said, he rolled over in bed expecting his wife to be there. Instead, he literally hit the wall. He became emotional when discussing how he had not been able to see his family. And when he declared that he and his family would continue to smile despite his conviction and sentencing “because that’s who we are,” his voice caught. Others were not so moved. “His statement today was a masterpiece in banal self-delusion, completely untethered from reality and without any acceptance of responsibility,” said Joseph E. McGettigan III, the lead prosecutor. “It was entirely self-focused, as if he, him, were the victim. It was, in short, ridiculous.” Judge Cleland deemed Mr. Sandusky’s statement “unbelievable.” Mr. Sandusky’s crimes have exacted a tremendous toll on Penn State. Within days after the indictment of Mr. Sandusky was made public in November 2011, Mr. Paterno, the football team’s longtime head coach and a patriarchal figure at the university, was fired. He had been alerted to at least one of Mr. Sandusky’s attacks on a boy. Two and a half months later, Mr. Paterno died of cancer at 85. Meanwhile, the Penn State

community found itself confronting the idea that it had placed the interests of its football team above concern for children at risk. A seven-month investigation conducted by Louis J. Freeh, a former director of the F.B.I., determined that Penn State’s leaders — most prominently Mr. Spanier, Mr. Paterno, the former university vice president Gary Schultz and Athletic Director Tim Curley — had disregarded the welfare of Sandusky’s victims. Four of Sandusky’s victims are suing the university, as is Mike McQueary, a former assistant who testified to seeing what he thought was Mr. Sandusky raping a boy in a shower on Penn State’s campus in 2001. Mr. McQueary claims the university has mistreated him since Mr. Sandusky’s actions became public. Mr. Curley, who is on leave, and Mr. Schultz, a former senior vice president, are scheduled to stand trial in January on charges of perjury and failing to report child sexual abuse, relating to the attack Mr. McQueary reported in 2001. Mr. Sandusky’s lawyers said they would appeal his case, arguing most strenuously that they were not given enough time to prepare his defense before the trial. One of them was asked Tuesday if Mr. Sandusky could have pleaded guilty for a lesser sentence. “Jerry Sandusky has always maintained his innocence,” the lawyer Joseph Amendola said. “There could have been discussions, there might have been some deal that could have been worked out, but Jerry Sandusky wanted none of it.”
