The Turks and Caicos Islands presently has around 2200 Public Servants. Todd said it is hoped that much of the required efficiency improvements will be reached through the voluntary scheme. In other words, he is hoping that persons would volunteer to be made redundant, rather than be forced. “Any remaining savings will be achieved via a subsequent compulsory scheme whose terms will be less favourable than the voluntary programme,” he added. “Although the scheme is open to all sectors of the Public Service, an application is no guarantee of acceptance. This is to ensure that essential skills are retained in Government and to ensure effective management of the scheme’s costs. Statutory Bodies are not included in the voluntary scheme at

this time.” Individuals interested in the scheme should apply for an individual assessment by completing and signing an Expression of Interest form which should be returned to the Office of Public Service Management (OPSM) (Voluntary Severance Section) by 4.00pm on Monday 14th November 2011 Those who then wish to proceed should sign and return their forecast notification to OPSM by 4.00pm Friday 9th December 2011. TCIG will make the final decision on who receives the Voluntary Severance Package based on the needs of the organization and cost. Those who are accepted will have their employment terminated from 31 January 2012. Some people may be asked to work beyond this date to minimise disruption with salaries still drawn and compensation payments not affected. Any subsequent compulsory redundancy scheme will see the maximum payment set at the equivalent of 12 months’ salary for those under 55 years of age and 50% of the value of the voluntary offer for
‘Boogaloo’ appeals for financial help to restart conch restaurant business BURLEY WILLIAMS, AFFECTIONATELY called ‘Boogaloo’, is an internationally acclaimed culinary chef, especially in the area of conch preparation, but in recent times he has hit rock bottom and is in dire need of financial brace to climb from the destitute abyss that he has found himself. Williams was once a partner in a swinging restaurant in the Blue Hills area of Providenciales that was patronized by hundreds of tourists including celebrities and owners and CEOs of multinational corporations. But over the pass few years Williams’ fortunes took a nose-dive and has not emerged since. In a bid to get back solid financial ground, Williams acquired a piece of land along the beach strip in Blue Hills, on which he started construction of a restaurant, but that, too has hit a snag, as cash on the project has run out, leaving to seek a sponsor to get the project up and running. The sign on the unfinished building reads “the future home of Boogaloo’s”. “Since 1991, I operated a good business on the beach, but now the road is rocky for me. I got a business down here (Blue Hills) that is worth a million dollars, but I need some help,” Williams said. “I need somebody to come and look at the business and invest in the business, and then I will be able to promote the business. I think it takes about twenty (to) thirty thousand dollars to open it, and then I will be able to promote it. I specialize in conch, that is my specialty, but I need some help. I am disabled,” Williams, who relied on a piece of stick to maintain his walking balance, said. “I am a seafood man, and I have the ability to sell anything in that field, I am a good cook,” said the 60 year-old Williams.

A support package for staff will be available and will include counseling, developing CV and job interview skills, and financial advice from local banks as to how to make their redundancy payments work best for them. The voluntary scheme is based on similar programmes being run with UK Civil Servants. Its terms include: • Monthly paid staff (a) under 50 years of age, and (b) aged 50-54 years with post 1992 service only: One month’s pay for every year of service up to 21 years plus three months in lieu of notice plus up to 30 days accumulated untaken leave, subject to a maximum payment of two years salary. • Monthly paid staff aged 50-54 years of age with pre-1992 service: Early severance with pension payable from age 55 of which up to 25% of pension may be commuted and paid as a lump sum on the date of severance, plus a severance payment calculated at the lesser amount of: a. the normal maximum severance of up to two years salary (one month’s
pay for every year of service plus three months in lieu of notice) and up to 30 days accumulated annual leave: or b. a payment equivalent to one month’s salary for each month the officer has remaining up to pension age (55) at the date of severance plus 3 month’s in lieu of notice and 30 days accumulated undertaken annual leave (with a maximum of 24 months) • Monthly paid staff aged 55-59 years of age with post 1992 service: 75% of TCIG pension entitlement, payable up to age 60, with NIB entitlement from that date. There is no severance or gratuity entitlement. • Monthly paid staff aged 55-59 with pre 1992 service: Current pension entitlement and option to take a lump sum (commuted pension gratuity for a reduced pension) if not already paid. No severance. • Persons aged 60 and over: released with no severance • Weekly paid staff aged up to 59: one week’s pay for each year of service plus four weeks pay in lieu of notice. Individuals who apply for voluntary redundancy but who are not accepted will be protected from any compulsory scheme for 12 months.

US officials investigating wire transfer of $1.6million from Sandals Resorts to accounts in TCI

LAW ENFORCEMENT OFFICIALS in the United States are investigating the circumstances surrounding the transfer of $1.6million from Gordon “Butch” Stewart’s Sandals Resorts bank account in The Bahamas into certain accounts in the Turks and Caicos Islands. According to a report which was carried in the Nassau Tribune, details of the US probe are revealed in a legal action filed in the Bahamian Supreme Court on behalf of Bahamas-domiciled Sandals Resorts International 2000, a company that acts as the parent for numerous entities that own Sandals hotels throughout the Caribbean. The article which was written by the Tribune’s Business Editor Neil Hartnell, said the action, filed on June 30 this year, is alleging that Dr Jeffrey Pyne, a former Sandals Resorts International 2000 director, and the group's ex-treasurer and "governmental liaison officer", "breached his fiduciary duty" and employment contract by causing the Bahamian company and another Sandals entity to make a series of seven purportedly unauthorised wire transfers to three Turks & Caicos-based companies between March 3, 2005, and October 26, 2006. The three entities that received the wire transfers included two law firms, Chalmers & Co and Misick & Stanbrook, both of which were headed by two of Michael Missick's brothers, Chal and Ariel. The other firm, Prestigious Properties, is a real estate company run by another of Mr Missick's brothers, Washington, the article said. Sandals Resorts International 2000, in its Statement of Claim, is alleging that the seven wire transfers, totalling $1.65 million, "were not made for any legitimate commercial or other purpose of the plaintiff's business or interests." It further claims that "the purpose of most of the transfers" was to equip the three Turks & Caicos companies with funds "to pay the debts of certain third parties in Turks & Caicos" - a cryptic reference to former Premier Michael Misick. Sandals is seeking the return of its allegedly missing $1.65 million, either through the recovery of the original funds or compensation from Dr Pyne. However, in denying the allegations against him, Dr Pyne claimed the Bahamian action initiated against him resulted "from an investigation being carried out by the US authorities in respect of whether Sandals or Mr Stewart made political contributions to Michael Missick. "Based on the same, Mr Stewart has

wrongfully sought to allege that I, in my capacity as managing director of Gorstew, forwarded the funds to Michael Missick without Mr Sewart's approval or instructions. This is a fabrication which I have strenuously denied, and have taken steps to explain my involvement." In a September 22, 2011, affidavit, Dr Pyne alleged the Bahamian Supreme Court action had been filed to avoid litigation in either the Turks & Caicos or Jamaica, and that Sandals was merely "forum shopping." "The flow of all funds" through the resort chain, Dr Pyne alleged, was controlled by Mr Stewart through Unique Vacations, Sandals' worldwide marketing and reservations agent, and Phyllis Thompson in the Bahamas. All payments of "special requests or unusual bills" had to be approved by Mr Stewart, he claimed. In response via an October 21, 2011, affidavit, Dmitri Singh, general counsel for Sandals Resorts International 2000, alleged that Mr Pyne was merely seeking to besmirch Sandals and Mr Stewart's reputations by revealing the US investigation. "It is correct to state that there is an investigation ongoing by the United States authorities into Sandals' affairs in the Turks & Caicos," Mr Singh conceded. "However, Sandals has nothing to hide in relation to the same, and is fully cooperating with the United States authorities to resolve this matter. "This investigation does not change the fact that Dr Pyne breached his fiduciary and contractual duties to (Sandals Resorts International 2000) in improperly authorising the transfer of $1.65 million to Chalmers & Com, Prestigious Properties and Misick & Stanbrook."

Mr Singh described Dr Pyne's claim that the transfers were conducted on Mr Stewart's instructions as "completely baseless and without merit", having been informed by the Sandals chairman no authorisation came from him or anyone else in the group. "At all times Dr Pyne was acting on a frolic of his own, and in breach of his fiduciary and contractual duty," Mr Singh alleged. He admitted that Sandals had in the past made a political contribution to Mr Missick's party, the Progressive National Party, but said these transfers were unauthorised. Recalling the origins of the dispute with Dr Pyne in an earlier June 30, 2011, affidavit, Mr Singh said three wire transfers made to Prestigious Properties between March-December 2005, totalling $1 million, had purportedly been made to purchase property on Sandals' behalf. David Davies, Sandals' group chief financial officer, and Mr Singh were asked to probe the transfers after no evidence was produced to show the funds had been used to purchase real estate. A November 2009 meeting at Prestigious Properties, involving the investigating team, two Missick brothers and Dr Pyne was held. Mr Singh alleged the Sandals executives were told "that the funds in question had not in fact been used to purchase property for Sandals, but had been used to pay off Michael's (Missick) personal expenses." Hand-written notes attached to the Prestigious Properties accounts indicated the $1 million was used to pay items such as Michael Missick's credit card bill, plus "parental support and gifts" to a Jacqueline Lightbourne. As for $500,000 transferred to the Chalmers law firm, Mr Singh alleged Mr
Stewart said the payment - purportedly to pay his legal fees - had not been authorised by himself, and he was unaware of what it was for. After some inquiries, Michael Missick's brother, Chal, allegedly said it was a political contribution to the PNP and its re-election campaign. "It was clear that a fraud has been perpetrated on Sandals in relation to the $500,000 transferred to Chalmers," Mr Singh alleged. As a result, Sandals launched an October 4, 2010, action in the Bahamian Supreme Court against FirstCaribbean International Bank (Bahamas) and Chalmers, seeking an injunction and discovery orders to trace the $500,000. This was granted by Justice Bernard Turner, but FirstCaribbean said it was unable to disclose any information as the account in question was located in the Turks & Caicos. The Bahamas injunction and action were halted, and new proceedings brought in the Turks & Caicos. And a final transfer of $150,000, also allegedly unauthorised, to the Misick and Stanbrook law firm, was said by the latter's principals to also have been used as a donation to the PNP. Dr Pyne, meanwhile, alleged that he could not recall having served as a director of Sandals Resorts International 2000, or attended any of its Board meeting, Mr Pyne said he was surprised to learn he was listed as a director from May 2002-2010 in the Bahamian Companies Registry, and claimed he was never advised of his appointment as treasurer. In response, Mr Singh alleged this assertion was "incredible", as there was evidence to suggest to the contrary.

Is Scotland’s Independence from the U.K. Inevitable?

What would an independent Scotland look like? Alex Salmond, Scotland's nationalist First Minister, sits in the formal reception room at his official residence, Bute House in Edinburgh, and quickly recites his list. Free Scotland would, he says, still have the Queen as head of state. It would consider an alliance with the North Atlantic Treaty Organization, though it would insist that England remove its nuclearsubmarine base at Faslane and its Trident-missile bunker at Coulport. Scotland would join the European Union and, like Ireland, would allow anyone to apply for citizenship if they could prove Scottish roots back a couple of generations. It would keep the British pound until the right moment came to join the euro. But no matter what the currency — and this is perhaps the biggest reason the country is taking Salmond's drive for independence so seriously these days — Scotland would keep all its money for itself. In that way, Salmond's argument is a slightly updated version of the American revolutionary mantra of the 1770s: he wants to stop lining London's pockets. Until five years ago, Scotland was a receiver state, putting less into the exchequer than it received. But the discovery of oil and gas reserves off Scotland's peaty shores and its booming whisky, salmon and tourism industries have helped boost the Scottish economy. Salmond gestures toward Spanish architect Enric Miralles' sleek new building housing the Scottish parliament, which started up in 1999 — the first local parliament since England suspended the last one in 1707. "What you have to understand is that the parliament up the road there," he says, "has the powers of the majority of spending, but it only has the right to raise about 10% of Scottish taxation." Add in how little political support Britain's leaders have in Scotland — the Conservative and Liberal Democrat parties that have formed a coalition government in Westminster won only 20% of the Scottish vote, combined, in the past elections — and Salmond makes a fairly credible case for taxation without representation. Salmond, 57, a stocky, jovial character
renowned for both his charisma and his temper, began his push for Scottish independence more than two dozen years ago, when he was first elected to represent Aberdeen in the north, the home base for much of the country's surging oil and gas industry. His Scottish National Party (SNP) rose as Scotland did. "There was a rediscovery of the importance of Scottish nationhood," Salmond says. "That rediscovery was happening at the same time as the decline of British identity at the end of the empire." It was the SNP's growing popularity that forced the Labour government, which had ruled Scotland for more than 50 years, to allow a Scottish parliament in 1999 with a Scottish head of government — the First Minister. Salmond won the job in 2007, when the SNP formed a coalition government with Labour. The party's growth has spiked, from six seats in 2005 to an outright majority of 69 seats after a landslide victory earlier this year. Independence, however, is by no means a forgone conclusion. It's not just that former British Prime Minister Tony Blair dubbed Salmond's plan "crazy" or that current Prime Minister David Cameron promised to "campaign to keep our United Kingdom together with every single fiber that I have." On Oct. 11, Labour Party leader Ed Miliband said he planned to form a "Team Scotland" to fight Salmond. "We've always accepted that Scotland has a right to leave the union," says Douglas Alexander, a Scotsman and a member of Labour's shadow cabinet in London. "The question is if this is a good thing for Scotland, and most Scots aren't convinced it would be." It is true that for all the popularity of Salmond and the SNP, support for full independence has rarely gotten more than 40% in the polls. But it has been gaining traction. A Sunday Mirror poll out in mid-October found that 49% of Scots and 39% of Britons overall support independence, up from 11% and 6%, respectively, five months ago. Salmond plans to hold a referendum on independence before the end of his term in 2015, and he's already working hard to ensure success. In October he announced plans to drop the voting age to 16; independence is more popular with young Scots. He's also hedging his bets. The referendum will have two questions.

One: Do you want Scotland to be independent? And two: Should Scotland have full financial powers — i.e., the ability to tax? Of course, Salmond prefers full independence, which would grant Scotland the powers of defense and foreign policy, but he'll settle for the right to tax if the first question fails. There are plenty of reasons to question how sure-footed Scotland would be on its own. In 2008 the British exchequer had to bail out the Royal Bank of Scotland. And that gleaming new parliament building? It was finished three years late and cost 10 times more than its original estimate. For Salmond, however, the drive toward self-rule is inevitable and irreversible. Just look at the 50 countries that have sought independence from London since World War II, he says. "In just about every case, they were told the whole thing would be a complete misadventure, a disaster. And I'll tell you something strange," he notes with a grin. "Not a single one of them ever said, 'We're coming back under London rule.' Not one."

Haitians youth giving sex for favours

A number of Haitian youths are engaged in transactional and commercial sex, according to Head of the National AIDS Programme, Aldora Robinson, who was making a presentation last Friday (October 28), during the workshop at the Department of Social Development in Providenciales. Robinson said the DFID-funded study revealed a number of ills in the Haitian community ranging from a severe misconception on HIV /AIDS to an overall lack of self worth. She said the report shows that the Haitian and the Dominican Republic Spanish populations are the two most at risk groups. Explaining transactional sex, Robinson said young girls, especially, would give up sexual favours for promise of work permits, jobs, phone top-ups and promise of house rent payments. Robinson said the study showed that Haitians feel dehumanized because of the way they are being treated, as discrimination against them has limited their access to land tangible employment, and as a consequence they settle for menial jobs. She also stated that they wait until they are extremely ill to access medical care because they feel largely mistreated when they go to access care. She said since Haitians speak French Creole and the Turks and Caicos is an English-Speaking society, there is a language barrier at the hospitals and service providers don’t take the time to hear them out. “Persons don’t always take the time to (listen to) what they are saying or what their complaint actually is,” Robinson said, pointing out that the AIDS Department once

provided an interpreter at the former Myrtle Rigby Clinic, but had to pull the individual because its field work in the community had expanded. She said following the study, another consultancy was conducted, this time to find solutions to tackle the problem faced especially by the Haitian community. “So, we had training of the Creole Youth in message development, presentation and communication. We also develop materials - posters, brochures, TV ads and radio ads in Creole,” Robinson said. In addition to the various media messages, Robinson said the youth interaction group – Rapport – often goes into the community to frame dialogue with their peers on social matters, with a few to allowing the youth to see themselves in a more positive light. Robinson noted that the communication plan and strategy developed for the Haitian population is so comprehensive that they plan

to use it as template for all the AIDS Programmerelated campaigns across all demographics. “I am a person who does not like to reinvent the wheel, and so, this communication strategy that was created for the Creole population, we have made it in such a way that it is the communication plan that would address our communication needs for the Programme,” Robinson said. Arlene Husbands of the DFID-Funded Project – which is Taking Action against HIV/AIDS in the British Overseas Territories, said the project which started some four years ago will come to a close at the end of December 2011. “So we just came back to the
country to share with the National AIDS Programme and all of their partners some of the things we have achieved in the overall project in the last four years. And so, we are disseminating some of the good practices, some of the challenges, some of the lesions learned, and sustainability issues, and how they are going to move forward beyond the life of this project. She said during the workshop, all of the work done was put under the microscope, with a few to chisel out how they would be able to build on progress made in order to move them forward in the coming years. She said too, that going forward, polices, bills and ordinance on the books in some countries would be needed to support the work the project had already achieved on HIV, sexuality and sexual health.
Police injured in North Caicos fight Two officers attached to the North Caicos Police branch of the Royal Turks and Caicos Islands Police Force sustained minor injuries, while two men are in custody answering to charges arising from that incident. Deputy Commissioner of Police, Brad Sullivan confirmed the incident, which he said took place last weekend. However, he said that the injuries sustained by the police officers did not hamper them from turning up for duties.
“There was an incident on North Caicos where we had a couple of officers injured. The matter is still under investigation by the office over in North Caicos. I know that there has been a couple of arrests in relation to that and the persons are in court. The officers were injured but there were minor injuries and have not affected their ability to work to any great extent. A couple of male individuals appeared in court earlier this week to answer to the charges,” Sullivan said.

NHIP contributions to increase by one percent
Contributions to the National Health Insurance Plan will be increased by one percent and will now be six percent of earnings. This was among the changes to the national health care plan announced by Governor Ric Todd at a press conference on Friday November 4th. Todd said significant steps to ensure the future of the TCI health care system were taken in key decisions at the Advisory Council (AC) meeting in Grand Turk, Thursday 3 November 2011. These recognised the challenge of how to make the health care system sustainable and affordable. There are currently 11,000 dependants of the the National Health Insurance Plan (NHIP) supported by 18,000 paying contributors. The decisions reached were informed by public feedback to the Health Care Funding Challenge consultation announced last month. The Advisory Council accepted proposals to: • Increase NHIP contribution by 1% to 6% of earnings – split 50:50 between employers and employees. This figure was directly influenced by public feedback which was concerned about proposed rise to a 9% contribution. This will raise an additional $3.5m a year. • Establish a minimum payment of $50 per month for each contributor. Introduce a fee of $10 per
dependent for up to three children. Together these proposals will raise a further $1.5m a year. • Abolish the co-pay charges for the primary care level while continuing to review this service. • Begin to shift resources to primary health care in the community by opening the Blue Hills Clinic in Providenciales Measures to control costs and make the system fairer include: •Working with InterHealth Canada to reduce the number of overseas referrals, and making better use of Caribbean based providers. This could see all tertiary treatments outside of the region stopped, unless an exceptional circumstance. • Reducing inter-island travel for some basic diagnostic procedures, by improved scheduling and better use of technology and equipment. • Work permit holders and temporary residents will only be entitled to onisland primary and emergency care. They will be directly responsible for care or treatments beyond that provided locally.
SIPT arrests and charges man The Helen Garlick-led Special Investigation and Prosecution Team (SIPT) has announced that it has made an arrest. In a brief press release, it was stated: “The Special Investigations Prosecution Team (SIPT) can confirm that a 47 year old man was arrested in Providenciales on Wed, 2 Nov 11, and charged in connection with their ongoing investigation. He will appear in court in due course. In accordance with their policy and to ensure fairness SIPT will not release the names of any person connected with investigations until they appear in court.”

AN EROSION OF civic pride and the influx of other cultures have been blamed for the Turks and Caicos Islands becoming filthy, and the complaints are not coming only from persons living here, but also tourists who visit these shores after being lured by the “Beautiful by Nature” catchphrase. Kenrick Neely, Deputy Director for Environmental Health Department and Ralph Higgs, Acting Director for the Tourist Board said they have received complaints of persons and have seen the indiscriminately disposal of garbage at areas not designated for solid waste disposal. According to Neely, in the past, residents took great pride in the way they disposed of their waste, but today, no conscience is exercised in that regard. “In the past the islands used to be very clean, the islands were not dirty like this. But I think (the reason for the mess) it’s the people’s attitude towards national pride and the different

cultures that we have today. Growing up in South Caicos you never use saw a bottle on the ground. Today, it is the attitude and no national pride,” Neely said. For his part, Higgs said since tourism is everybody’s business, it is incumbent on each individual to be good stewards ensuring that the country is pristine. He said while there has not been many reports from

visitors of garbage sightings in areas not designated, one report is one report too many. “One or two incidents or any incident of report is too much. I don’t want to say that they are overwhelming, but we are concerned about any reports of litter, trash or garbage. Certainly at the tourist board, we take that very seriously. And while the concerns are not crushing, we want
to nip it in the bud,” Higgs said. Neely pointed out that laws are on the books to tackle such behaviour, but was quick to point out that it was not lack of will on the part of the police, since, for the most part, these unscrupulous people commit their dastardly deeds at nights when they believe the police are not around to catch them. In the meantime, Training Manager at the Tourism Board, Blythe Clare, revealed that from her visits to schools across the country, children have demonstrated greater attitude towards cleanliness over their adult counterparts. And according to her, going forward, children will be key to effectively getting the campaign message across. “It begins at home. So we all have to take ownership. This is my country, this is your country. And for those who come and live and work among us, you are a part of us, so therefore, you have an important role to play. So, I want to challenge our young people, you are our future leaders, so you have to partner with us and getting the message out,” Clare said.

Middle Caicos teen found guilty of killing 81-year-old Charity Higgs

RANDY HARVEY, THE teen who was accused of killing elderly South Caicos resident Charity Higgs in August of last year will know his fate on November 25 after he was found guilty in the Supreme Court last Friday (October 28) by a seven member mixed jury. The murderous teen could, however, wind up in a mental institution instead of regular prison, as pursuant to Section 50 of the Criminal Procedure Ordinance, the jury returned a special verdict that states that Harvey was guilty of murder but was insane at the time of committing the act. The whole of Middle Caicos was plunged into shock when the elderly

Higgs, the mother of 11 children including former government minister and businessman Sam Harvey, was found with stab wounds at neighbour’s doorstep on that island, on the night of August 3, 2010. Higgs, 81 operated a shop from her house. She was found with her throat slashed. Her death was said to have occurred after she refused Harvey’s request of a can of soda and a candy bar. It was stated that Higgs-Harvey, described as an energetic, philanthropic woman and a member of the Mount Moriah Baptist Church in Middle Caicos, met her untimely death minutes to 8 p.m., that day, after Harvey, who was14 years old at the time and posing as a customer,

went to her home and requested a bar of Snickers candy bar and a soda. It is said that when Higgs opened the door, the minor pounced and overpowered her before slitting her throat. The injured woman ran a few yards from the scene to a neighbour’s house where she collapsed on the steps and later died. Harvey, who was said to be one of the many children that Higgs cared for in the community, was apprehended at his home while in the process of getting rid of the evidence – his blood-stained clothes which was already placed in the washing machine. A psychiatric evaluation was order on one occasion when the teen appeared in court last year. That report was used during the trial, which resulted in the jury returning such verdict. He was represented by Kendle Williams, while the Crown was led by Senior Crown Counsel Jo-Ann Meloche. Presiding Judge was Mr. Justice Edwin Goldsbrough. Samuel Harvey told The SUN days after his mom’s murder that he spoke with her minutes before the incident took place and that she was in high spirits.

THE TURKS AND Caicos Islands is one of 41 countries which the government of the Philippines has banned its citizens from seeking future employment. The Philippine Overseas Employment Administration (POEA) imposed the ban on countries where overseas Filipino workers (OFWs) are barred from going, because in their opinion the 41 countries fail to meet provisions of the Amended Migrant Workers Act which outlines measures to protect the rights of migrant workers. According to the POEA, acceptable host countries must have labor and social laws protecting the rights of workers; is a signatory to and/or a ratifier of multilateral conventions, declarations or resolutions relating to the protection of workers; and has concluded a bilateral agreement or arrangement with the government on the protection of the rights of OFWs. The 41 countries included in the list are the following: Afghanistan, Antigua and Barbuda, Barbados, Cambodia, Cayman Islands, Chad, Croatia, Cuba, North Korea, Dominica, Timor Leste, Eritrea, Haiti, India, Iraq, Kyrgztan, Lebanon, Lesotho, Libya, Mali, Mauritania, Montenegro, Mozambique, Nauru, Nepal, Niger, Pakistan, Palestine, Serbia, St. Kitts and Nevis, St. Lucia, St. Vincent and the Grenadines, Sudan, Swaziland, Tajikstan, Tonga, Turks and Caicos, Tuvalo, US Virgin Islands, Vanuatu and Zombabwe. The deployment ban applies only to new hires and not to overseas Filipino workers who are already working in those countries. On the other hand, the POEA through its Board Resolution No. 6 has also identified the additional countries to the initial list of 76 where deployment of OFWs is allowed. The following countries are Armenia, The Bahamas, Bangladesh, Belarus, Benin, Bermuda, Burkina Faso, Burundi, Cameroon, Cape Verde, Central African Republic, Comoros, Congo Republic, Cook Islands, Democratic Republic of Congo, Denmark, Equatorial Guinea, Fiji, Gabon, Gambia, Ghana, Grenada, Guinea, Guinea Bissau, Guyana, Iceland,Ivory Coast, Jordan, Kazakhstan, Liberia, Madagascar, Malawi, Malta, Mauritius, Morocco, Nigeria, Norway, Puerto Rico, Rwanda, Sao Tome and Principe, Senegal, Seychelles, Sierra Leone, Tanzania, Togo, Trinidad and Tobago, Tunisia, Uganda, and Ukraine. Attorney General defends proposed Hearsay laws
Attorney General Huw Shepheard says the proposed Hearsay legislation is being introduced as part of his programme of “modernisation of the criminal law” of the Turks and Caicos Islands. Shepheard made the statement in response to strong and widespread criticism from the legal fraternity and other sections of the Turks and Caicos Islands society who have expressed concern about the new law which they believe is designed and time to help the Helen Garlick-led Special Investigation and Prosecution Team (SIPT) secure convictions. In response, the Attorney General stated: “Legislation allowing hearsay evidence to be given is not designed to secure convictions against particular individuals. It is a statute of general application that is intended to improve the administration of criminal justice in the Islands. It is my intention to introduce a complete codification of the criminal law and a uniform system of criminal procedure for both the Magistrate's Court and the Supreme Court and I am pleased to be able to say that the UK is funding a legislative drafter to undertake the work. In addition, I am aiming to produce a completely revised law of evidence for both civil and criminal cases. These projects will take many months to complete but Chambers will keep you advised of progress.” He added: “There is a commonlaw rule of evidence that, at present, prevents the repetition in court of statements made otherwise than in giving evidence, if the purpose of repeating the statement is to assert the truth of what is said in the statement. This is known as the hearsay rule and its operation is difficult to explain briefly because it is subject to numerous exceptions. It can actually work to create injustice, as when a suspect is prevented from giving evidence that the victim of a crime has made a statement exonerating him. Many common-law jurisdictions, including the TCI, abrogated the rule in civil proceedings many years ago, and some common-law jurisdictions including the UK have abrogated the rule in criminal proceedings. In my view, it is a sensible development.

He added that his Chambers have been working hard to introduce much-needed reforms. “One of the considerations that has prompted me to press for these reforms is that it has been represented to me that development of the financial services industry will greatly assist in enhancing the prosperity of Turks and Caicos Islanders,” the AG added. “If this route is to be pursued, there needs to be a robust regulatory regime meeting international standards, together with a modern criminal justice system, and it is my intention to continue to modernise the criminal justice system thoroughly over the coming months.” He said the timetabling of this legislation has depended on the available capacity for law drafting, and, after having the draft bill prepared, he will be “keen to bring it before the Advisory Council and Consultative Forum as quickly as possible, given that there is a considerable body of other legislation to be considered in order to meet the milestones for the return to elected government."

UK Diplomatic Chief says 2012 election still on track

THERE IS A shared concern between United Kingdom Politicians and their local counterparts that the Turks and Caicos Islands should return to local rule, but the process should be transparent and understandable to the local populace. This is according to Simon Frazer, Permanent Secretary at the British Foreign and Commonwealth Office and Head of the Diplomatic Service, who met with members of the media on Wednesday, October 3, in the conference room of the Department of Disaster Management in Providenciales. He said the measures that are currently being taken by the Interim Government are par for the course. “I think there is a shared concern that we should move forward towards establishing elected government here, and that the process of getting there should be one which is as transparent as possible, in which the people understand the necessary measures that the Interim Government is taking. So, we have been discussing those issues,” Frazer said. He noted also that the other monster that needs to be tackled is the

A THREE-STORY building located along Academic Avenue behind the Island Pride Supermarket in Providenciales, which was designed to become a police barracks, appears now to be the shelter for an unwelcomed democratic – homeless Haitians. The SUN cannot confirm whether or not the people occupying the building are undocumented, but it appears that they do not have an alternative place of abode. The $2 million architecture courtesy of a loan from the failed TCI Bank and constructed about more than three years ago, is embroiled in controversy between the Attorney Generals’ Chambers and the owner of the structure as to whether or not Government should bear responsibility for the building’s lack of occupancy. Persons in the area brought the attention of the illegal occupancy to The SUN and expressed concern of grave implications, especially for persons who operate businesses in that area. The concerned individuals said that the illegal occupants, for the most part, utilize the building in the night. In the day they would vacate the property. When The SUN visited the location, no one was seen on property, but there were obvious signs of occupancy, as items of clothing were seen hanging from an upper floor rail, apparently washed and hung out to dry.

While a main entrance to the building, which showed signs of vandalism, was battened up, a bottom floor side door was missing. That door appears to be the entry and exit access point to the building. In an interview conducted over a year ago, the owner said in addition to $2 million borrowed from the bank, she also expended her lifesavings of $350,000 on the now white elephant, which comprised 42 one bed-rooms. The building was specifically built as a police barracks after the developer said she and the former administration penned an agreement in 2005, to that effect. Government representatives, in the past, often told the media that in short order police personnel housed at a decrepit barracks on Old Airport Road would soon be relocated to the now controversial building.

The developer named the Attorney General’s Chambers as well as Permanent Secretary in the Ministry of Finance, Delton Jones, for the snail’s pace approach they have been taking to bring to matter to a close. However, the Attorney General’s Chambers, at the time, has sought to rubbish the charges, rather saying that there were a number of anomalies about the project that needed to be verified, and that solutions were being worked out. She said following the agreement, Government issued two letters of commitment – one in 2006 and another in 2007. She said in addition to being ratified by Government, the plan was also approved by both the Physical Planning Department and the Environmental Health Department, explaining that it was as a result such resolution that the bank disbursed the loan to her. Deputy Attorney General Rhondalee Brathwaite Knowles, when contact concerning the matter, at the time, said while negotiations between Government and the woman had been “difficult”, there was no truth that terms were being changed, adding that the developer should take the majority of the blame for stalling talks. Nevertheless, Knowles told The SUN that despite the differences of opinion by both parties, Government was inclined to work with the developer to bring closure. In the meantime, the facility remains unattended whilst being occupied by individuals for whom it was not intended.

MOTORISTS are putting lives at risk at the TCI hospitals. That’s the warning from InterHealth Canada management, who fear that poor parking could lead to a death. Drivers are leaving vehicles parked in front of the emergency department (ED) entrances, blocking access for ambulances. And hospital chiefs say they will be forced to get ‘tough’ with offenders if the problem continues. Head of the ED, Dr Denise Braithwaite, explained: “Vehicles parked in the emergency areas is becoming a big problem at both the Cockburn Town Medical Centre in Grand Turk and the Cheshire Hall Medical Centre in Provo. “The access roads to the emergency departments are for emergency vehicles only and I would urge people to respect this very important rule. “While we empathise with people who come to the hospitals concerned about injured or sick relatives and friends, they must park their vehicles in the parking lots provided. “We have no objection to people coming to the emergency department entrance to drop off patients who are unable to walk from the car park, but the

driver must immediately move the vehicle to an approved parking place and not leave it at the ED entrance. “On a number of occasions ambulances have not been able to make their way to the emergency department entrance doors and delays like that could result in people losing their lives. “When an ambulance is transporting a sick person to the hospital, expediency and efficiency are crucial. If valuable time is lost due to wrongly parked vehicles, lives will be put in serious danger.” She added: “We have to get tough with offenders before someone dies and so I would urge visitors to think carefully about where they park their vehicles.”
NIB EMPLOYMENT INJURY TRANSFER OF $10MILLION TO NHIB
An actuarial review of TCI healthcare costs has recently been undertaken by Mr. Hernando Montas, National Health Insurance Board Consulting Actuary. The review was undertaken to examine the current and historic situation associated with the legal provisions under the National Insurance Board existing legislation which requires the transfer of funds to cover all medical service costs arising from employment injury and occupational diseases. It was identified that this transfer has not been historically made to the TCIG despite contributions being collected and these healthcare costs being incurred. As a proportion of NIB contributions has been earmarked for employment injury but not used, this has contributed to a NIB disablement and death surplus reserve in excess of $20m. It was agreed by the Advisory Counsel that to correct the historic underpayment to TCIG that a transfer of reserves of $10m would be made to the government. The NIB employment injury branch will continue to show an actuarial surplus despite this transfer, as shown in the last NIB Actuarial statutory valuation. This will be used to temporarily fund the healthcare deficit for this financial year and provide a small reserve in accordance with the legislation. The current consultation on the Healthcare Challenge will continue as it is addressing the longer term sustainability of healthcare in TCI. Furthermore the formulae used by the National Insurance Board will be based on the ‘level funding’ method to finance emerging cases of NIB employment injury and occupational diseases together with a provision for a catastrophic reserve. This will increase the annual sum payable to TCIG and will be reassessed actuarially on a regular basis to ensure the transfers are consistent with costs being incurred. Despite this small increase in annual costs there will continue to be an annual surplus accumulating in the employment injury branch of NIB. The public should be informed that this transfer will be made only from the employment injury branch and as such will in no way affect the other NIB benefit branches including substantial reserve for future pensions.

TCHTA sees potential business from South American Market
Last month the Turks and Caicos Hotel and Tourism Association and the TCI Tourist Board joined forces to promote the Turks and Caicos Islands in Rio De Janeiro, Brazil. Representatives from the two leading TCI tourism organisations attended the 39th annual Brazilian Congress of Travel Agencies and Fair of the Americas, also known as ABAV, with the objective of securing business opportunities, forging alliances and promoting the islands to this emerging market. On return to TCI, TCHTA’s AE Stacy Cox noted, “ABAV is the largest travel trade fair of its kind CVC’s representative meets with TCHTA’s AE Stacy Cox and in South America and we were Tourist Board’s Director Ralph Higgs afforded the opportunity to network with some of the big players in the industry like CVC Tours out of Brazil. DECEIT WITH RESPECT TO AND DESTRUCTION OF THE PUBLIC SERVICE EVERY DAY, MORE and more - we are witnessing how this Interim Administration, first led by Governor Gordon Wetherall and now Governor Ric Todd operates with dispassion at the mercy of Turks and Caicos Islands. First of all they had their advisors come in and write reports that are completely disparaging to us. Afterwards, they issued a number of mumble-jumbled statements that continue to confuse the process. These are all done in an effort to destabilize the service and make sure that current senior staffs are not fit for purpose, so that they can justify bringing in BOTC citizens to man all key positions within the civil service. This inapt Administration has known from the very beginning of their hostile takeover that they intended to reduce the present compliment of Permanent Secretaries to five. And to this effect, replace them with outsiders! Just look at what they have done! They have extended contracts to three current Permanent Secretaries who have already reached retirement age: Mrs. Mary Harvey, Mrs. Susan Malcolm and Dr. Beatrice Fulford.
Consequently would it not spell better sense had they let those persons go home, through normal attrition? What is more, it has been widely speculated the Mrs. Judith Campbell would be going home anyway and that would mean that there would be six persons vying for five positions. These same five positions that BOTC citizens will also be vying for too. However, the current PS’s are all disqualified when one looks at documented statements such as these: 1 “The lack of capacity and capability at senior management levels to take forward a strategically integrated management and business plan.” 2 “Rectifying the paucity of strategic capacity and capability in government as a whole will take time. Reliance is placed on a few Permanent Secretaries, many of whom are due for retirement and there is limited availability of suitable candidates for succession.” The above is a serious indictment of the senior public service in writing. Yet you have the Governor going around saying that the current crop of Permanent Secretaries are eligible to

The documented truth is that “Turks and Caicos Islands Permanent Secretaries need not apply!” This is the type of hypocrisy that is being perpetuated by the Interim Administration, led by none other than the Governor. To cover their deceit and conspiracy, in public they will continually deny that it is their plan to systematically eliminate whatever institutional memory exists in the service by Turks and Caicos Islanders and replace it with a completely foreign element. But as always, the proof is in the pudding. They still subscribe to the old adage that: “if you want to hide things from the ‘niggers’, then reduce it to writing and they would walk pass it.” While that might still pertain to some, many us do read, research and comprehend, and are therefore on top of most things that are happening. In the interest of transparency and accountability, we must call on the Governor to publish the list of names, salaries and allowances that are being paid to the current advisors. And from that, we will ascertain the head count. Governor Todd, do not try to fool us in saying that DFID is paying, so we need not dig deeper or ask further questions. That is absolute hogwash as the amount, whatever it is is tacked on the side of the ledger dedicated to Turks and Caicos Islands. If we are not getting value for money, then that money should be redirected to some more beneficial activity that we can quantify. Take for instance there has been lots of talk about redoing the Causeway between North and Middle Caicos, resurfacing the Millennium Highway in Providenciales, and providing additional classroom to reduce the overcrowding. Put some money to these ventures! But as can be seen from every activity, these guys are only interested in wreaking havoc on us,

ROYAL ROBINSON CONTRIBUTER rather than doing things that reduce our pain and suffering and create a better social and economic environment that would redound to the benefit of our ordinary citizen. But these guys are not about building any infrastructure! All they care about squeezing the TCI bottom line at the expense of Turks and Caicos Islanders while making sure that we pay through our noses in the process. Let me just return to the issue of the Permanent Secretaries and other senior staff members. I am sure that you can now see that your snitching on one another has only strengthened the hands of the oppressor. They had a good laugh about you with their friends and colleagues at your expense. They are now comfortably sitting on the dock of the bay while you are now being hung by your own petard! • But all is not lost. If you as a group put your pettiness aside and band together for the common good, then something positive can come out of the exercise and the axe that is about to fall on your heads can be deflected! Be forewarned and do what is necessary. Local claimed original business idea now being used by someone else

A local security agent Darren Ewing said a business idea that he developed in 2004, involving advertising local businesses on aircraft, at the Providenciales International Airport and in taxis is now being utilized by the Tourist Board, and he believes that something is fishy about it. Ewing, who works with American Airlines, said after developing the business idea, he created a video of it, so that he could go around and demonstrate it to local business hoping they would buy into the idea. Ewing he did not have the capital to start the business, so he visited the Tourist Board hoping that it would partner with him in getting the project of the ground. “They saw the video, the liked it, they thought it was a good idea, and they told me to hold on, they would get back to me. Now, some six, seven years later I haven’t heard anything,” Ewing said.

However, Ewing said recently, he saw where a new company into the country that will be partnering with the Tourist Board, is embark on the same business that he presented to that body sometime ago. “The video that I showed back then was like three advertising opportunities in one or three avenues where you can advertise your business, which was the aircraft, the airport and the taxicabs. “Two weeks after it was aired on the news that this company is coming in to do business with the Airports Authority, the Director came on saying that they are going to advertise in the aircraft. So, I am thinking now that another two weeks, perhaps, they are going come out and say, they are going to advertise businesses in local taxicabs,” Ewing said. Ewing added: “I just want my story to get out there to Turks and Caicos Islanders that there was a Turks and Caicos Islander who came up with this business idea in 2004, who also showed it to the Tourist Board; showed it to a lot of local businesses on the island (of Providenciales). As a matter of fact, a lot of local businesses on the island signed up with this business to advertise their businesses on videos in taxicabs, in the airport, in the aircraft. Ewing said at time of starting the business, he was granted permission to use the airport by its former owners Coxco, but said the project was delayed because of lack of start-up funds. “They guy who was operating the airport, I wrote him a letter (seeking permission to advertise there). And he wrote me back a letter giving me permission to have videos in the airport above the head of the immigration officers. I was supposed to go back and meet with him, to finalize it, to get is sorted out, but never happened. “It never happened because after going to the Tourist Board they told me to hold on; they would get back to me. And I have been holding on for years now,” Ewing said. When contacted, Acting Director of Tourism, Ralph Higgs, said while he could not comment on any conversations that he was not party to, between Ewing and the former director of the board, said that the board’s promotion on LCD screens at the airport came under the aegis of the Turks and Caicos Islands Airports Authority (TCIAA). NEW YORK — CNN announced it is remaking its morning lineup and will bring Soledad O'Brien back as host of a "conversational ensemble" show beginning next year. O'Brien's program is set to air on weekdays from 7 a.m. to 9 a.m. ET. Ashleigh Banfield and Zoraida Sambolin will be hosts of a news show that will air from 5 a.m. to 7 a.m., the network said. Banfield, most recently at ABC News, played a prominent role at MSNBC a decade ago. Sambolin has worked in local news in Chicago. CNN's "American Morning," where O'Brien worked from 2003-2007, has struggled competitively. Conversational shows "Fox & Friends" on Fox News Channel and "Morning Joe" on MSNBC do better in ratings and buzz, and CNN is often eclipsed by its sister channel HLN with Robin Meade in the morning. Since former co-hosts John Roberts and Kiran Chetrey left "American Morning" in the past year, the network has experimented with other approaches and anchors, adding more business news and a greater story count. "There's a real opportunity to do a show that has more thoughtful conversations," O'Brien said on Thursday. She said her model is less the type of talk featured on the other cable morning shows, and more the topics that she's covered in documentaries on topics like education and race. O'Brien will be the host, with a combination of regular and occasional or one-time panelists, said Ken Jautz, CNN's executive vice president in charge of the domestic network. An appeals court threw out on Wednesday a federal agency's decision to fine CBS Corp television stations $550,000 for airing singer Janet Jackson's "wardrobe malfunction" during the 2004 Super Bowl broadcast. A divided 3rd U.S. Circuit Court of Appeals in Philadelphia said that in imposing the fine, the Federal Communications Commission "arbitrarily and capriciously" departed from prior policy that exempted "fleeting" indecency from sanctions. In a statement, the FCC said it is disappointed by the decision, but plans to use "all the authority at its disposal" to ensure that broadcasters serve the public interest when they use the public airwaves. CBS spokeswoman Shannon Jacobs said the New York-based company is gratified by the decision, and hopes the FCC will "return to the policy of restrained indecency enforcement it followed for decades." Jackson's right breast was briefly exposed to almost 90 million TV viewers after the singer Justin Timberlake accidentally ripped off part of her bustier during a halftime show performance. CBS was fined $27,500 for each of the 20 stations it owned. The 3rd Circuit in 2008 voided the fine, but that decision was vacated when the Supreme Court in 2009 upheld the FCC policy as rational, in an opinion involving News Corp's Fox TV stations. It did not decide whether the policy was constitutional, and returned the CBS case to the 3rd Circuit. Writing for a 2-1 majority, 3rd Circuit Judge Marjorie Rendell said that the FCC had for three decades maintained a "consistent refusal" to treat fleeting nude images as indecent, and that there was no justification to change policy for CBS. She said FCC regulations governing indecency treat images and words interchangeably, and "it follows that the Commission's exception for fleeting material under that regulatory scheme likewise treated images and words alike." Judge Anthony Scirica dissented, saying the Fox opinion "undermines" the 2008 decision in the CBS case, which he had written. He said the CBS case should be sent to the FCC so it could apply the proper standards. The Supreme Court is expected in its current term to decide whether the FCC policy is constitutional. It is reviewing a decision by a federal appeals court in New York that voided the policy as unconstitutionally vague. That court said it was improper to fine broadcasters over expletives by the singers Bono and Cher on awards shows, or showing a woman's buttocks on "NYPD Blue."

Haiti president returns following surgery in US

Haitian President Michel Martelly returned to Haiti on Thursday after doctors in Miami performed surgery on his left shoulder. The 50-year-old leader said the operation was to relieve pain in the shoulder that he had bothered him for more than five years because of his previous career as a musician. Before he was elected president early this year, Martelly spent more than 20 years playing keyboard and singing under the stage name "Sweet Micky." "Every time I lifted the left arm I had pain," he told reporters at the

airport's diplomatic lounge, his arm in a sling. "I've come back strong and healthy." He added that he also sometimes feels pain in his right shoulder, which may require surgery in the future. Martelly left last week for the United States, saying he was going for medical treatment but without specifying the problem. His departure coincided with anger over the jailing of a lawmaker who had been openly critical of the president. Police locked up legislator Arnel Belizaire for a night because

they said he had escaped from the national prison on the chaotic day of the earthquake that shattered the capital on Jan. 12, 2010. The detention of Belizaire, rare for a government official because investigators need to formally submit a request to lift immunity, sparked outrage among members of both houses in Parliament. The Chamber of Deputies called for the removal of two Cabinet ministers and another official who they believed followed Martelly's orders to lock up Belizaire. Martelly and Belizaire had
lashed out at each other on the grounds of the National Palace. Martelly hadn't commented on the arrest until Thursday at the international airport, when he denied having any influence on the police action. "Close or far away, the presidency doesn't have anything to do with the" matter, he said. Martelly said he has asked his prime minister, Garry Conille, to set up a commission to examine what led to the arrest and to prevent something similar from happening again.
Vybz Cartel murder on video, prosecution says
THE prosecution in the murder case of entertainer Vybz Kartel and his three co-accused revealed for the first time in court yesterday that it has video and telephone evidence tying the accused men to the killing of a man in August of this year. According to the Crown, the evidence, when disclosed in full to the defence, will cause the lawyers to advise their clients to plead guilty to the charges against them. It was not specified which of the accused men were on the video but the Court was told the it showed Clive 'Lizard' Williams being mobbed and beaten to death.
The revelation was made when the men appeared before Senior Corporate Area Resident Magistrate Judith Pusey. Included in the case file, the court was told, are statements implicating the men. Kartel — whose real name is Adidja Palmer — fellow artiste Shawn 'Shawn Storm' Campbell; fashion designer Calvin Haye; and Cayro Jones are charged with Williams' murder on August 16. Williams, according to the police, was stabbed and shot to death over a missing illegal firearm. His body has not been found. Notwithstanding the purported evidence, Haye,
through his lawyer Chris Tavares-Finson, was adamant that he had nothing to do with the killing, which is believed to have occurred in Havendale, St Andrew. The men were remanded into custody until December 2 when bail applications are expected to be made in the Corporate Area Resident Magistrate's Court. Jones was not brought to court yesterday. Meanwhile, Kartel will return to the Gun Court Division of the Corporate Area Resident Magistrate's Court on November 30 in relation to the murder of Barrington 'Bossie' Bryan earlier this year. He was shot as he stood among a group of people in Gregory Park, St Catherine.
International rating agency Standard and Poors (S&P) has lowered the crediting rating for The Bahamas, while revising Jamaica’s outlook from stable to negative. The Bahamas’ credit rating slipped from BBB+/A2, to BBB/A-3 and its transfer and currency convertibility assessment from A- to BBB+. However, S&P maintained Jamaica's B- long-term foreign currency rating. The Hubert Ingraham-led administration indicated that it was not surprised by the downgrade since the credit agency has changed its methodology to place greater emphasis on diversification and growth prospects. “Given The Bahamas’ economic concentration on
tourism and financial services for more than 50 years and given its limited growth prospects in the current challenging global economic environment, it seemed likely that a rating down grade would follow this change in methodology,” the Ministry of Finance said in a statement. “…The government of The Bahamas remains focused on stimulating economic growth through inward direct foreign investment, increasing support for small and medium size business development, improving the domestic environment for doing business and strengthening the productivity of The Bahamas’ workforce.” Meanwhile, Jamaica’s finance ministry said S&P’s
revised outlook for the country is largely due to the noncompletion of reforms related to its medium-term targets under the International Monetary Fund (IMF) standby agreement. The ministry said the non-completion of the reforms has led to delays in Jamaica's last three quarterly reviews under the agreement. "It should be noted that discussions with the IMF continue as the country seeks to secure the agreed medium-term economic plan which will ensure both fiscal and debt sustainability," the minister stated. It also noted that the credit rating agency has said the achievement of these conditions would lead to an improvement of Jamaica's credit worthiness.

Honduras becomes Western Hemisphere cocaine hub LOCAL NEWS CARIBBEAN NEWS
TEGUCIGALPA, Honduras — On Honduras' swampy Mosquitia coast, entire villages have made a way of life off the country's massive cocaine transshipment trade. In broad daylight, men, women and children descend on passing go-fast boats to offload bales of cocaine destined for the United States. Along the Atlantic coast, the wealthy elite have accumulated dozens of ranches, yachts and mansions from the drug trade. And in San Pedro Sula, local gangs moving drugs north have spawned armies of street-level dealers whose violence has given the rougher neighbourhoods of the northern industrial city a homicide rate that is only comparable to Kabul, Afghanistan. Long an impoverished backwater in Central America, Honduras has become a main transit route for South American cocaine. "Honduras is the number one offload point for traffickers to take cocaine through Mexico to the US," said a US law enforcement official who could not be quoted by name for security reasons. A US State Department report released in March called Honduras "one of the primary landing points for South American cocaine." Almost half of the cocaine that reaches the United States is now offloaded somewhere along the country's coast and heavily forested interior — a total of 20 to 25 tonnes
each month, according to US and Honduran estimates. Authorities intercept perhaps five per cent of that. The flow is hard to stem, said Alfredo Landaverde, a former adviser to the Honduran security ministry, because there are few other sources of cash income here. "We have to recognise that this society is very vulnerable," Landaverde said. "This is a country permeated by corruption, among police commanders, businessmen, politicians." The country's isolated, impoverished Atlantic coast, remote ranches and largely unguarded border with Guatemala — where much of the cocaine is taken — also make it a haven for traffickers. "When the traffickers are unloading a go-fast boat in (the Atlantic coast province of) Gracias a Dios, you can sometimes see 70 to 100 people of all ages out there helping unload it," said the US law enforcement official. "The traffickers look for support among local populations." In the past year, authorities seized 12 tonnes of cocaine, according to the Honduran government — a vast improvement from previous years, but still a small portion of the estimated 250 to 300 tons that come through annually. Most of the cocaine arrives in Honduras via the sea, in speedboats, fishing vessels and even submersibles. In July, the US Coast Guard, with

Honduras' help, detained one such craft that had been plying the waters with about five tonnes of cocaine per trip. Fishermen who once worked catching lobster now look instead for a much more prized catch, the so-called "white lobster" — bales of cocaine jettisoned by drug traffickers to either escape detection or to be picked up by another boat. Honduras is also by far the region's biggest centre for airborne smuggling. Of the hundreds of illicit flights northward out of South America, 79 per cent land in Honduras, said the US official. Ninety-five per cent of those flights hail from Venezuela, which also has become a link for cocaine produced elsewhere. Landing aircraft in Honduras was once so profitable and planes so easy to get that traffickers would sometimes simply offload the drugs and burn the aircraft, rather than take off again from dangerously rudimentary clandestine landing strips. Last year, however, they started reusing the planes to ferry loads of bulk
cash back to Colombia, the US State Department report said. Authorities found one load of $9 million in US cash stuffed in plastic bags in the trunk of a car, and millions at a time in suitcases at local airports. Earlier this year, as aircraft became more difficult to obtain, traffickers stole a military plane from the San Pedro Sula army base on the Atlantic coast, said Landaverde, adding that soldiers were accomplices to the theft. It is not just poverty-stricken fishermen and corrupt soldiers who are the beneficiaries of the emergent cocaine republic. Last week, authorities seized 13 luxurious homes and ranches and 17 boats in the first such mass raid since the country enacted a drugproperties seizure law in 2010. All were owned by local people. Key members of the region's business community who have hotel, real estate and retail holdings have been named as associates of the cartels, often for money laundering. Nor are the drug trade's ripple effects restricted to the coast.
NEW US$400MILLION HOSPITAL FOR BARBADOS The Queen Elizabeth Hospital (QEH) in Barbados will be replaced with a new US$400million hospital in the near future. This announcement was made by Minister of Health, Donville Inniss, at a post Cabinet press conference held at Government Headquarters. Inniss said Cabinet had agreed that a new 600-bed general hospital would be constructed in the area of Bridgetown, which is the capital of Barbados. He said financing for the project would be a joint public/private sector initiative and international funding would be sourced, adding that the hospital would be constructed on enough acreage to ensure it would be both aesthetically pleasing and therapeutic, promising that it would "serve the people of Barbados". The Health Minister disclosed that the proposed new hospital would be one of the largest physical development projects perhaps in the last decade and would have room for expansion, but conceded that "it had to be done". He noted that currently, some BDS$195 million (US) $97.5million) was being spent annually to keep the QEH running and he identified inadequate electricity and poor maintenance as issues that had been plaguing the plant over its 47 years of operation. "The cost of operating the existing Queen Elizabeth Hospital is one that perhaps relates closely to the age of the plant and our inability over the years to maintain it properly. This does not mean that the QEH will, in any way shape or fashion, be neglected. It will be a gradual process. We will not be able to turn the key and open a new general hospital overnight,"
Inniss said. Against this background, he stated that the Board, the staff, and the management of the Queen Elizabeth Hospital had been tasked to continue maintaining a good system at the QEH, in spite of the prevailing limitations. Inniss also disclosed that the operating theatres had been plagued with maintenance issues over the years, and, as a result, four theatres would be closed "for another two weeks or so to effect the necessary changing of parts". The Health Minister stressed that this state of affairs could not continue ad infinitum. "When things like these happen they place undue pressure on the clinical staff, but, more importantly on those individuals who are waiting for surgery," he affirmed. The QEH has a staff complement of 2,500 employees and it is estimated that some 44,000 persons are treated annually at the facility. The 600-bed Queen Elizabeth Hospital opened on November 14, 1964. It is the only acute care medical facility in the 166-square mile island of Barbados, which has a population of close to 300,000, but it also provides medical services to several countries in the Eastern Caribbean. The QEH provides a range of medical, diagnostic and treatment services to the public of Barbados. These include: everything from digital diagnostic imaging services including on-site CT, emergency services, general and specialized surgery (neurosurgery, orthopedics, ophthalmology, cardiology), birthing services, neonatal services and cancer care. In 1967, the QEH became an accredited teaching hospital affiliated with the University of the West Indies, Cave Hill Campus.

New Prime Minister Andrew Holness went with good news to Jamaica’s tourism mecca of Montego Bay, announcing that $60 billion in capital investment, creating 21,648 jobs through 15,825 new rooms, is on the cards for the industry over the next four years. With the second’s city’s movers and shakers his captive audience in the upscale Ritz Carlton Hotel, Holness reeled off figures showing tourism’s status as the highest foreign exchange earner and the likeliest to move Jamaica’s development along. The prime minister said that five attractions were scheduled to be opened this year in Montego Bay, Falmouth, Ocho Rios and Kingston, with projected capital investment of $718 million and employment of 427 persons within the attractions subsector. But the prime minister did not give details about the coming attractions. "Another 15,825 new rooms are expected to be completed between 2011 and 2013, translating into an estimated 21,648 new jobs and approximately J$60 billion in capital investment,” he announced. He added that last year employment in the accommodation sector alone had seen an increase of 664 jobs over the previous year. Tourism Minister Edmund Bartlett in his address urged the JHTA members to re-examine their business models in order to ensure greater efficiencies and increased earnings. “I again encourage you all to endeavour to further revamp and enhance our tourism product by introducing new technology and new rooms in order to ensure that our tourism product and room stock always remain fresh and crisp,” he said. “...This invites a new approach to cost management and operational efficiencies in our industry and demands creative approaches to tackling the energy issues at the base of these spiralling costs,” Bartlett said. To this end, Bartlett said the ministries of tourism and energy had collaborated with the Inter-American Development Bank (IDB) and the Caribbean Hotel Energy Efficiency Action Programme to make available a pool of funds to the sector for retrofitting, energy audits and the application of renewable technologies.

Republicans struggle in hunt for Obama challenger

President Barack Obama's Republican foes are struggling to pick a champion for the 2012 elections, eyeing former White House hopeful Mitt Romney but energized by former pizza chain chief Herman Cain. Obama's abysmal job approval rating, which is stuck in the mid-40 percent range, stubbornly high US unemployment of over nine percent three years after he took office, and deep national pessimism have left the incumbent vulnerable. But Republicans' affections have been fickle, see-sawing between Romney, a former Massachusetts governor and Mormon who is eyed with suspicion among the party's conservative faithful, and other candidates with more appeal to those core voters. "It's still Romney's to lose," according to John Feehery, a former spokesman for erstwhile Republican House speaker Dennis Hastert who now heads Quinn Gillespie Communications in Washington. "They (Republican voters) tend to

fall in line, but it takes a while for them to get there," said Feehery. "They still aren't that excited about him (but) they'll probably go with him." VATICAN STUNNED BY IRISH EMBASSY CLOSURE
- Catholic Ireland's stunning decision to close its embassy to the Vatican is a huge blow to the Holy See's prestige and may be followed by other countries which feel the missions are too expensive, diplomatic sources said on Friday. The closure brought relations between Ireland and the Vatican, once ironclad allies, to an all-time low following the row earlier this year over the Irish Church's handling of sex abuse cases and accusations that the Vatican had encouraged secrecy. Ireland will now be the only major country of ancient Catholic tradition without an embassy in the Vatican. "This is really bad for the Vatican because Ireland is the first big Catholic country to do this and because of what Catholicism means in Irish history," said a Vatican diplomatic source who spoke on the condition of anonymity. He said Ireland informed the Vatican shortly before the announcement was made on Thursday night. Dublin's foreign ministry said the embassy was being closed because "it yields no economic return" and that relations would be continued with an ambassador in Dublin. The source said the Vatican was "extremely irritated" by the wording equating diplomatic missions with economic return, particularly as the Vatican sees its diplomatic role as promoting human values. Diplomats said the Irish move might sway others to follow suit to save money because double diplomatic presences in Rome are expensive. It was the latest crack in relations that had been seen as rock solid until a few years ago. In July, the Vatican took the highly unusual step of recalling its ambassador to Ireland after Prime Minister Enda Kenny accused the Holy See of obstructing investigations into sexual abuse by priests. The Irish parliament passed a motion deploring the Vatican's role in "undermining child protection frameworks" following publication of a damning report on the diocese of Cloyne. The Cloyne report said Irish clerics concealed from the authorities the sexual abuse of children by priests as recently as 2009, after the Vatican disparaged Irish child protection guidelines in a letter to Irish bishops.

The Palestinians will not accept anything less than full U.N. membership and do not want an upgrade to an observer state in the world body, their foreign minister said on Thursday. Riyad al-Malki's remarks suggested the Palestinians would not seek such an upgrade once their bid for full state membership meets its widely expected fate -- failure due to opposition from the United States and other governments. Malki told journalists in Ramallah the Palestinians could have won observer state status long ago and were not interested in it now. They currently hold the status of observer entity. "We do not want, after all of these struggles, sacrifices, and efforts by the entire Palestinian people, to accept an observer state in the United Nations. We will not accept less than we deserve: a full member state," he said. Analysts said if the Palestinian leadership does not seek enhanced status after failing to gain full membership it would mark a retreat. But they said Malki's remarks may not reflect the path President Mahmoud Abbas may take. "This reads like a tactical move," said George Giacaman, a political analyst. "It could be directed toward the Americans, the Israelis, to show flexibility, but I would not view it as a final position."

The Palestinian bid for statehood recognition in the U.N. system has drawn fierce criticism and sanctions from the United States and from Israel, which in 1967 captured territory the Palestinians now seek for an independent country. The U.S. Congress has frozen some $200 million in aid to the Palestinian Authority over its statehood quest. Israel this week froze duties it collects on behalf of the Palestinian Authority in response to its admission to the U.N. cultural agency UNESCO. Malki said for now the Palestinians would not seek to join more U.N. agencies as a full member. "At this moment, we are not concerned with applying for membership for Palestine in the rest of the international organizations," he said. UNESCO's vote in favor of Palestinian membership triggered an automatic cutoff in U.S. funding to the agency under U.S. law. The idea of the Palestinians joining more international agencies had raised the prospect of bodies such as the World Health Organization also losing their U.S. funding. "The official Palestinian position is to concentrate only on the request for membership which we presented to the United Nations," Malki said.

McALLEN, Texas — A Texas family law judge says his daughter posted a YouTube video of him beating her several years ago because he told her he was reducing her financial support and taking away her Mercedes. Aransas County Court-at-Law Judge William Adams issued a statement through his lawyer on Thursday in which he questions his daughter Hillary's motives for posting the secretly-made 2004 video online last week. The judge does not apologize in the three-page statement for lashing his then 16-year-old daughter 17 times with a belt while she wailed and pleaded with him to stop. He told a TV station Wednesday that the video "looks worse than it is" and that he was just disciplining his child. Police are investigating and Adams says he will "respond" to any investigations.

A woman who accused Republican presidential candidate Herman Cain of sexual harassment Thursday offered a statement telling her side of the story, in a move that could further undermine his 2012 campaign. Cain has been accused by at least three women of sexual harassment when he was head of the National Restaurant Association in the mid1990s. The issue is dominating the race to decide a Republican challenger to face Democratic President Barack Obama in the November 2012 election. "This is absolutely fabrication, man," Cain told conservative talk radio host Sean Hannity, adding later: "We're not going to get distracted. As of today we're back on message and we're going to stay on message." One of the women said earlier this week that she wanted to talk publicly about accusations that Cain had sexually harassed her, but she has since changed her mind and wanted to make a written statement through her lawyer. The woman's lawyer, Joel Bennett, gave the statement to the restaurant group, said Sue Hensley, a spokeswoman for the restaurant association. The trade group's lawyers were reviewing the statement to decide whether to lift a confidentiality agreement that she signed when she left the association. It is likely to conflict with Cain's version of events.

Greek leader calls off referendum on bailout plan

ATHENS — In a tumultuous day of political gamesmanship, Prime Minister George A. Papandreou on Thursday called off a referendum on Greece’s new debt deal with the euro zone after winning a measure of support from his opposition and managed to repair, at least for a day, a major rupture in relations with Europe. The decision to abandon his idea of holding a popular vote on the European debt deal did not end the political turmoil here; Mr. Papandreou still faces a rebellion in his own Socialist Party and the fury of some opposition figures, and he will have to weather a difficult confidence vote on Friday. But talk of a possible unity government eased international fears of immediate new elections and a looming default if he did not survive in office, cheering markets in Europe and abroad. In an address to his party’s central committee on Thursday evening, Mr. Papandreou said there was no need for a referendum now that the opposition New Democracy Party had said for the first time that it would back the agreement, reached last week, to write down Greek debt in exchange for austerity measures and a commitment to the euro as the nation’s currency. The prime minister invited the New Democracy Party to become “conegotiators” on the deal and later said that talks on a unity government should begin immediately. He also suggested that he would be willing to step aside so that others could form a unity government if he won Friday’s confidence vote. “I am not clinging to my seat,” he said. He made those comments after the New Democracy leader, Antonis Samaras, accused the prime minister of “deception.” Mr. Samaras was angry that Mr. Papandreou appeared to be trying to hold on to his post after securing the opposition’s cooperation. the referendum followed three days of political volleyball that whipsawed world markets, shook the Continent to its foundations and drove angry European leaders to issue an ultimatum on Wednesday demanding that Greece decide once and for all if it wanted to remain a part of the European Union and its currency bloc, the euro zone. But after a day of political horsetrading, Greece’s Byzantine political storm began to look less like points of departure for Europe than hastily considered parliamentary maneuvers by a prime minister who was looking for a way to shore up support with both the Socialists and the opposition — or to negotiate a graceful exit. As has happened so often in the euro crisis, the fate of the European enterprise seemed to hinge on the political machinations of one of the union’s smallest members. At first, Mr. Papandreou was said to have offered to resign before the confidence vote on Friday. By late afternoon, however, the Greek news media reported during the cabinet meeting that he not only was refusing to resign but was in fact calling off the referendum.

Insurer American International Group lost more than $4 billion in the third quarter, as its aircraft leasing unit took an impairment charge on a portion of its fleet and the fair value of the company's one-third stake in Asian insurer AIA fell. It was the 10th time in the last 15 quarters, dating to 2008, that AIG lost at least $1 billion. Shares fell 3.2 percent in after-hours trading after the company announced its financial results, then rebounded a bit after AIG said it would launch a $1 billion share buyback. AIG's core insurance businesses were profitable on an operating basis, and its mortgage insurance unit both raised prices and gained market share amid difficulties in that industry. But those results were not enough to overcome the charges, which were partially driven by declining equity and debt markets during the quarter. AIG reported a loss of $4.11 billion, or $2.16 per share, compared with a year-earlier loss of $2.52 billion, or $18.53 per share. In the yearearlier period AIG took a number of charges on asset sales; it also had a smaller share count. On an operating basis AIG lost $3.04 billion, or $1.60 per share. Analysts polled by Thomson Reuters I/B/E/S had on average expected a loss of 63 cents per share in the quarter, though the range of estimates was wide, from a loss of 22 cents to a loss of 99 cents. AIG said that ILFC, its plane leasing business, took a $1.5 billion impairment on 95 planes as customers' appetites shifted toward newer, more fuel-efficient aircraft. Last February, Chief Executive Bob Benmosche said he did not expect any further large charges for the business this year, after it took roughly $1 billion in write-downs in the last six months of 2010. AIG said it lost $2.3 billion on the declining fair value of its stake in AIA during the third quarter. AIG took AIA public late last year in Hong Kong. It recently became eligible to start selling AIA shares after the IPO lockup expired. AIG has also filed to take ILFC public. Proceeds from the sale of AIA shares and from any ILFC IPO are already earmarked to pay back some of the U.S. Treasury's remaining $50 billion interest in the company. The government rescued AIG from the brink of bankruptcy in September 2008, at a price tag that exceeded $182 billion. The Treasury still owns a 77 percent stake in what was once the world's largest insurance company. In the third quarter, AIG also had substantial catastrophe losses totaling $574 million, mostly because of Hurricane Irene and Tropical Storm Lee. Beyond the charges, though, AIG said its insurance units had posted nearly $900 million in pretax operating income. Property insurer Chartis saw net premiums written rise nearly 1 percent, though the gain was attributable to foreign exchange benefits. Pricing improved in its U.S. commercial business, echoing similar results from other insurers as the market rebounded. unAmerica's life insurance sales rose 14 percent, while assets under management also rose.
Poorest poor in US hits new record: 1 in 15 people
WASHINGTON — The ranks of America's poorest poor have climbed to a record high — 1 in 15 people — spread widely across metropolitan areas as the housing bust pushed many inner-city poor into suburbs and other outlying places and shriveled jobs and income. New census data paint a stark portrait of the nation's haves and havenots at a time when unemployment remains persistently high. It comes a week before the government releases first-ever economic data that will show more Hispanics, elderly and workingage poor have fallen into poverty. In all, the numbers underscore the breadth and scope by which the downturn has reached further into mainstream America. Traditional inner-city black ghettos
are thinning out and changing, drawing in impoverished Hispanics who have low-wage jobs or are unemployed. Neighborhoods with poverty rates of at least 40 percent are stretching over broader areas, increasing in suburbs at twice the rate of cities. Once-booming Sun Belt metro areas are now seeing some of the biggest jumps in concentrated poverty. Signs of a growing divide between rich and poor can be seen in places such as the upscale Miami suburb of Miami Shores, where nannies gather with their charges at a playground nestled between the township's sprawling golf course and soccer fields. The locale is a far cry from where many of them live. About 20.5 million Americans, or 6.7 percent of the U.S. population,
make up the poorest poor, defined as those at 50 percent or less of the official poverty level. Those living in deep poverty represent nearly half of the 46.2 million people scraping by below the poverty line. In 2010, the poorest poor meant an income of $5,570 or less for an individual and $11,157 for a family of four. That 6.7 percent share is the highest in the 35 years that the Census Bureau has maintained such records, surpassing previous highs in 2009 and 1993 of just over 6 percent. Broken down by states, 40 states and the District of Columbia had increases in the poorest poor since 2007, and none saw decreases. The District of Columbia ranked highest at 10.7 percent, followed by Mississippi and New Mexico. Nevada had the
biggest jump, rising from 4.6 percent to 7 percent. Concentrated poverty also spread wider. After declining during the 1990s economic boom, the proportion of poor people in large metropolitan areas who lived in high-poverty neighborhoods jumped from 11.2 percent in 2000 to 15.1 percent last year, according to a Brookings Institution analysis released Thursday. Such geographically concentrated poverty in the U.S. is now at the highest since 1990, following a decade of high unemployment and rising energy costs. As a whole, the number of poor in the suburbs who lived in high-poverty neighborhoods rose by 41 percent since 2000, more than double the growth of such city neighborhoods.

TCIFA makes presentation in Mexico

The general secretary and technical director of the TCIFA, Sonia Bien-Aime and Matthew Green visited Mexico last week to attend a FIFA seminar for the CONCACAF region. The event was designed to allow member associations a chance for their officers to discuss the challenges that they face as well as highlight their achievements. For many associations it was also an opportunity for their officers to learn more about their roles and responsibilities but as for the TCIFA pair, which has been working together for several years, its focus was more on how FIFA can help the TCIFA in its development plans. As a result of its hard work in developing the game of football, the TCIFA was asked to deliver a presentation on one of their key development areas, Beach Soccer. Green's presentation was well received by the convention and several associations have already asked the TCIFA about receiving technical advice on how to start Beach Soccer programmes in their own country. During the week long seminar Green was also given an opportunity to represent the

The TCIRFU has been targeting this tournament for 6 months now and has put together specialized sevens training program to condition the squad. Under the directorship of coach Blair Mason, National trials and final selections were made with 4 weeks to go and the final twelve have been training intensely over the last few weeks to be prepared for what they anticipate will be an exciting challenge in Barbados. Having not competed at this level since 2007 and with the TCIRFU recently gaining its affiliate membership, the players know how important it is to give a good account of them and their country in what will be for the majority of them their first taste of international rugby. The challenge is large but the players are enthusiastic about playing some good sevens rugby and learning what is required to
compete successfully at this level. With rugby developing so quickly in the Turks & Caicos Islands and the increasing number of youngsters joining the ranks, it's important for them to be able to see that international honors are achievable and the TCIRFU has been actively encouraging the older junior players to try out for selection. The experiences gained as part of this process will stand them in good stead in just a few years time when they will be pushing for selection in the National U19 and well as senior men's National side. The TCIRFU would like to thank their gear sponsor O'Neills for their new playing strip, and also DHL for their support of this NACRA tournament. Sailroack U14 Girls league gets intense The Sailrock under 14 Girls league produced some exciting games last weekend, and after two weeks of action it is difficult to spot a clear favourite as all teams are close in the league table. The Yellow Jaguars tied 1-1 with the White Wolves. Ella O'Connell gave the Jaguars the lead but an own goal gave the Wolves a share of the points. The Titans then beat the league leaders, the Green Dragons by a 3-1 margin. Gianna Roberts, Octavia Gardiner and Makayla Ellis scored for the Titans and Briande Brooks for the Dragons. The Striking Cheetahs tied 0-0 with the Red Devils before going on to beat the Titans 2-0 with goals coming from Evnisha Saintvertu. The Red Devils tied for the second time on the day, this time with the Jaguars (1-1) as Lomekiah Thompson and Guerline Hall's goals ensured the honours were even. The final game of the day was a six goal thriller, as the White Wolves beat the Green Dragons 4-2. Tiffany Grant and Briande Brooks gave the dragons hope but a Waldine Pierre hat-trick and a Cessia Johnson goal put the Wolves top of the league. All six teams are in close contention as the league moves into its third week.
PROVO Golf Club officials are busy rewriting the record books following last weekend’s annual Ryder Cup competition. And one name that will feature prominently in its latest chapter is Delancy. The Ryder Cup is the club’s biggest tournament, with North America taking on an International line-up for the coveted trophy. This year’s showdown saw history made before a ball was struck as Agatha and Elijah Delancy became the first ever grandmother and grandson to be selected for duty. The talented duo represented the International side with 15-year-old Elijah being the youngest player and first ever junior to take part.And if that wasn’t enough, Agatha also became the first woman to hit a hole in one in the tournament. In fact the only downside to an otherwise perfect weekend was that the Delancys finished on the losing team, with North America recording a 26-19 victory. Agatha, a youthful 62, said: “It was a wonderful occasion and I was very proud to have been selected alongside Elijah. “Elijah knew before I did that he was playing and I was so pleased for him. I then rang the International captain, Chris Bruno, on another matter and I was shocked and surprised when he told me I’d been selected too. “Getting the hole in one in the singles on Sunday was such a big surprise too. It came on the fourth hole – a hole I had played badly in the pairs on Saturday. “I have a bad knee which was playing up a bit and a combination of that and the poor shot the day before just helped me relax. I knew I’d hit it well with my trusty 7-wood, but had no idea it had gone in the hole until I actually got up on the green. “I couldn’t believe it. It’s my first hole in one ever and all my team mates and opponents were so kind and pleased for me.” The Delancys moved to the TCI just over a year ago from the Bahamas and so neither had expected to be thrown into Ryder Cup action so soon. “I was delighted to be picked”, said Wesley Methodist School pupil, Elijah, who has a handicap of just 15. “I played a little bit of golf in the Bahamas but only started seriously here in the TCI. “To play in the Ryder Cup alongside my grandmother was incredible and I would like to thank my captain and all the guys at Provo Golf Club for their amazing support. “It’s a shame we didn’t win the competition but it was still a very special occasion for me and my family, and I am so proud of my grandmother, especially after her hole in one.”
Super 7’s Men’s League in high gear The Sailrock U13 Boys league completed its second round of games with some high scoring and entertaining football last weekend. In the opening game Blue Hill Sharks beat Long Bay Revolution 3-1, with two goals from Wikins Sylvain and one from Jackson Pierre. Idlin Belony scored the consolation goal for Revolution. In the second game, Five Cays edged out Leeward Knights (32) with Ras Diamond (2) and Greshawn Been netting for Five Cays and Deshawn Dorcius and Ledson Gerome for the Knights. Two high scoring games rounded off the morning action as Five Cays overcame the Knights
by a 5-2 margin. Gerome was again on the score-sheet for the Knights and Samir Tolani added the second goal but it was not enough to stop a dominant Sharks performance as Sylvain added two more goals to his impressive tally and Pierre rounded off his MVP performance with a hat-trick. The final game was the best of the day as Long Bay Revolution beat Five Cays FC 4-3. National Basketball Association (NBA) owners have launched a "preemptive strike" by commencing legal action they hope will end the labor dispute, an anti-trust lawyer said. With negotiations for a new collective bargaining agreement stalled, the NBA this week launched an anti-trust lawsuit against itself, asking the U.S. Second District Court to decide if the lockout was legal under anti-trust laws. The players' lawyers responded by asking the court to throw out the case because the union has yet to decertify and bring any action against owners. Michael Keeley, an anti-trust and litigation lawyer for Axinn, Veltrop and Harkrider, told Reuters the owner's actions were designed so they could pick the time, the place and the court for the key legal battles ahead. "It is a pre-emptive strike," Keeley said. "They are saying, "I know you are going to hit me with this anti-trust lawsuit and I want to pick the court
and the time. "It's like I sued you over the possibility you might crash your car into my house. You haven't crashed your car into my house so there is no case to hear yet. "But there is law that, even when there is a dispute that has not happened yet, gives a court jurisdiction to hear a case." By seizing the initiative, the NBA may have gained home field advantage by filing their lawsuit in the Second District Court, which Keeley says, has traditionally been favorable to the ownership side on issues. "The threat of decertification and a lawsuit by the players gives them some degree of leverage," said Keeley. "The owners are trying to defuse that by bringing their own lawsuit. "They are sort of lancing a boil." The NBA contends the players association has been using the threat of decertification and anti-trust lawsuits as leverage in negotiations and the owners are keen to remove that threat.

Keeley believes the NBA players association is approaching the antitrust option with caution having watched the National Football League (NFL) survive a similar challenge during collective bargaining negotiations earlier this year. Shortly after the NFL lockout began the union decertified and players launched individual lawsuits against the league. The case was initially supported by the district court but then unsuccessful before the Eighth Circuit Court of Appeals. Once the Eighth Circuit sided with the league, the parties returned to the table and struck a deal. "One might assume it was because they (NBAPA) saw what happened with the NFL players that they thought it was more valuable to have the threat of decertifying and bringing a lawsuit rather than actually suing," explained Keeley. "The (Second District Court) judge is deciding should this case be confronted right now or is it
premature. "He could say, I'm tossing this out, come back to me when the players decertify. "But if he rules I'm willing to hear the case then you have basically an anti-trust lawsuit like you had in Minnesota with the NFL." While the legal wrangling may seem tedious to fans, a decision by the courts may be the quickest way to getting players back on the courts. "This is all designed to give one side more or less leverage over the commercial negotiations," said Keeley. "If you are a basketball fan the hope is that this gets resolved by the courts because you look at the NFL case. "As soon as the court ruled one way or another, the parties got together and they struck a deal. "The NFL players had built their whole strategy around getting this (anti-trust) lawsuit and when they lost it was time to come to the table."
Bishoo bashes Bangladesh as Windies claim victory
DHAKA - Spinner Davendra Bishoo completed his maiden five-wicket haul as Bangladesh collapsed either side of lunch on the fifth day of the second test to succumb to a 229-run defeat to the West Indies Wednesday. Resuming after the interval on 263 for six, Bangladesh lost their last four wickets for just 15 runs in a little over seven overs to be dismissed for 278 as the tourists secured a 1-0 victory in the twomatch series.
