“Do you need the Immigration (Board)? Do you need the Immigration Board to meet on every occasion? Can more be done by exception and the Immigration Board only deals with the difficult cases? Which I believe is the more sensible way to look at it. “I have questioned Clara Gardiner (Permanent Secretary in the Ministry of Border Control and Labour) on that. I say, what’s the point of this kind of system? There is much effort at the moment, to streamline the immigration system in the areas of PRC’s naturalization (and) Belonger status. So, I think that is part of the mix that they are considering under this new system,” Rushbrook said. According to him, twice each week the governor gets what he described as a big pile of various immigration applications to sieve through, and had to make assignments. He argued that such a

system has resulted in massive backlog. He asserted that a more streamlined system would speed up the application processing and make it more efficient. “If you streamlined the Public Service, you can do more with less people. The more people you have got

the slower the service. So one of the things that we have to look at is where does this body fit into the system…is it part of the process to make the system more efficient or is it part of the baggage?” Rushbrook said. According to Rushbrook, an alternative Immigration system could see applications being accepted by the Immigration Department and once the requisite paperwork is properly filed, designated employees within the system would process and sign off on them on a daily basis. “This would all be done through protocol. If certain people got the right documents and are believed not to be fraudulent, and satisfied all the requirements (those documents would be fast-tracked). If you ticked all the boxes by answering the relevant questions, then you would get through on the fast track. But if there are some queries about the validity of marriage certificate or qualification, or you have got a gap in your employment record, then you would go into a slower lane,

He also pointed out that another system could be put in place whereby the head of department of senior officers are giving the responsibility to making the final decision, while problem applications would be referred to the Board for further scrutiny. Rushbrook also took the opportunity to put to rest rumours that the Immigration Board has been dissolved and all matters put on hold. He said that the life of majority of the Boards came to an end at the end of September, and since Government was conducting its Civil Service Reform, existing Boards with the same members were re-gazetted on October 1, to run for a period of two months, instead of appointing a new Board to run for another year. Rushbrook said if the reform is not done in the next two months, the Boards will get extensions of probably similar periods until such exercise is complete and instituted.

ELECTION POLITICS IN JAMAICA AND GUYANA

TODAY, while Jamaicans contemplate a forthcoming battle between incumbent leader of the Opposition People's National Party (PNP) Portia Simpson Miller, and the rising star of the governing Jamaica Labour Party (JLP) Andrew Holness, to lead this nation following the next general election, Guyanese would be anxiously awaiting the official announcement of the date for new presidential and parliamentary elections. The Guyana election date will come from its outgoing president, Bharrat Jagdeo, who became the youngest head of state in the Western Hemisphere at 35 and who will leave office at the comparatively young age of 47 after being executive president for a dozen years. Constitutionally debarred from more than two successive five-year terms, Jagdeo is expected to announce Monday, November 28 as the date when the ruling People's Progressive Party (PPP) will seek an unprecedented consecutive fifth term in government, this time under the leadership of its current 60-year-old general secretary, Donald Ramotar, an economist. Ramotar's primary opponent will be the 65year-old ex-Brigadier of the Guyana Defence Force David Granger. He is the presidential candidate of a newly established opposition front, Partnership for National Unity which is dominated by the People's National Congress (PNC) that has been defeated by the PPP at all national elections since October 1992. Here in Jamaica, now that Education Minister Holness has already obtained significant support from his JLP parliamentary colleagues, and appears to be popular within the party's traditional base, it is most likely that the endorsement for him to succeed Golding would be deferred for the party's November 19-20 annual convention. By then, Guyana will be in the final week of election campaigning to choose a new 65-member Parliament and executive president. If in the case of Guyanese politics the incumbent PPP's central message will be, as already signalled, "continuity" for social and economic advancement, in Jamaica it would be quite different to market the new JLP leader with a similar message. For, objectively, the social and political problems that finally forced Golding to quit as both

party leader and prime minister (read the Christopher 'Dudus' Coke controversy as a major factor), would be very much part of the election campaign of the PNP's Simpson Miller. She can be expected to link Holness to the JLP's political culture — as difficult as such a strategy could prove. The age factor has, surprisingly, been thrown into Jamaica's political mix of reasons for the sudden resignation announcement by Golding, who has chosen to emphasise a preference for a new generation of young leaders to be in control — in the best interest of the JLP and Jamaica. Golding's plus & minus The reality is that Golding, who will be 64 years old this coming December and is in good health, knows that age is not the substantive factor for his decision to walk away from the highest political office. He was certainly not going to face a leadership challenge at next month's convention, nor is he being magnanimous in suddenly making way for a suitable "young" successor. Rather, having seriously compromised his political integrity in his controversial handling of the sensational issues that surrounded last year's extradition to the USA of the accused trafficker in drugs and guns, Christopher 'Dudus' Coke -- an influential JLP supporter -- Golding came to realise the serious damage he had wrought on confidence in his leadership judgement. Further, and quite related, his decision was informed by how the Opposition PNP has been strategically manoeuvring to exploit the current national mood ahead of a new general election. The suggestion that it's time to make room for a new generation of youthful leaders could also be self-serving as a parting shot by Golding against those elements within the JLP's decision-making councils and some senior Cabinet ministers who may have disappointed him at critical periods of his four years as leader of party and Government. However, it is relevant to note here that even the more strident critics or opponents of Bruce Golding would have difficulty in ignoring an evident factor in his favour as a politician. He has, over the years, demonstrated a firm commitment to democratic governance (in party and government) — even when it came to opposing the leadershipstyle politics of his former mentor, Edward Seaga.

Some feel that Golding's plus factor would also point to the cultivation of a reputation for opposing corruption; And now, by his decision to quit as prime minister and JLP leader, he hopes to be remembered as a politician who did not wish to perpetuate himself in the structure of party leadership. Holness vs Simpson Miller Golding is departing as the first prime minister of Jamaica to voluntarily leave office without completing a first term. He is also the second to give up the prime ministership while still in good health, the first being P J Patterson. So far as the PNP is concerned, having put to rest — expediently or not — some of the very bruising areas of internal division and discontent, it now appears as a party under Simpson Miller's continuing leadership, to be in readiness to resume control of the reins of state power when the election bell rings, either early or late next year -- depending on how the political wind is blowing with Holness as prime minister. What both Holness and Simpson Miller would have in common is a desire to be prime minister for at least a full five-year term. The PNP leader had originally served in that office for less than a year when she succeeded Patterson before calling the September 3, 2007 general election that was lost to the JLP in a very tough battle and close outcome in terms of popular votes cast. The PNP cannot, however, be unaware that the timing and manner of Golding's decision to quit as prime minister and leave the political landscape well ahead of a new general election would necessitate a critical reassessment of the party's electoral strategy for 2012. Having already invested so much political capital in hammering away at the leadership blunders of Golding over the "Dudus fiasco" and more, the PNP would understand the need for its own post-Golding adjustments, which could also be a serious challenge for the JLP under the leadership of Holness.


Proposed Grace Bay hotel could bring more Europeans to TCI

THE INTERIM GOVERNMENT is predicting a greater influx of visitors from Europe on completion of the planned construction of what will be the Turks and Caicos Islands’ first European-style hotel to be cited adjacent the Seven Stars Resort in Grace Bay. This assessment was made by Philip Rushbrook, of the Governor’s Office during his weekly press briefing in Providenciales on Tuesday, October 11. “One of the things that nice about this is that it is the first European-style hotel, and it adds to the desire that we have to attract more of the European market into the TCI, because Europeans are more comfortable with those kinds of hotels than condominiums,” Rushbrook said. According to him, the recent overhauling of the runway at the Providenciales International Airport

will make it even more accessible for larger jets from Europe to increase its volume of flights into the TCI. While he could not give major details on the impending construction of the hotel, Rushbrook said it should generate much needed employment of the people of the Turks and Caicos Islands during and after construction. He told the media that the government investment agency – TC Invest – and the developers are currently in negotiations to land a deal that would beneficial to both negotiating parties as well as for the people of the country. “It is my understanding that they (developers) want to develop it quickly. Negotiation is still taking place (and we are working out to see) what’s in it for the TCI and what’s in it for the developers. This negotiation is between TC Invest and the developers. “It is to see what concessions they will get and what benefits we will receive, because what we want is a decent cost/benefit analysis, which is

DESIREE JAMES RESIGNED as Chief Financial Officer (CFO) of the National Health Insurance Board (NHIB) on Thursday October 13th, 2011, with effect from November 14th. In a press statement, James said although this was a difficult decision, it was done “as a matter of principle and taken in the best interest of the people of the Turks and Caicos Islands, while at the same time safeguarding and protecting my integrity and professional reputation as a Certified Public Accountant”. On March 1st 2008, James was

hired by the Turks & Caicos Islands Government (TCIG) in the capacity of Project Manager to implement the first ever National Health Insurance Plan (NHIP) along with a team of consultants. She was subsequently appointed CFO by the Board of Directors, because of her experience, education and intimate knowledge of all aspects of the plan, having worked on it since its inception. “In my two-and-a-half years with the NHIB, there were many challenges, but it was nevertheless quite rewarding in many respects,”

what the benefits are and what the cost would be. It is one thing that we had not had before. There is prospect for construction jobs and economy jobs,” Rushbrook said. However, Rushbrook hinted that Government would not give the green light to any such projects unless it has

sound finance to run the entire project without hiccups. “The sorts of things we expect to see are load guarantees from the banks. We are going to ask for bankers guarantee and if the loan is available for disbursement. There are all sorts of legalese things that we can ask for so that can increase the certainty or surety of what we ask is going to go ahead and if there is enough money behind it to take it forward,” Rushbrook further indicated. Rushbrook said he expects the projects to start soon, providing the negotiations are satisfactory to the talking parties and legal obligations met. “The faster the development starts, the faster jobs are created, and the faster revenues come in to Government, and also the faster we can grow the tourist market,” Rushbrook said. It is not clear what the height of the property would be, whether or not they are shooting for a high density to rival the Seven Stars Resort or will be going for a medium to low density akin to the majority of the resorts on Grace Bay.

British Government castrating TCI politics

Political castration is what the British Government doing to the local political system, this according to Progressive National Party (PNP) Leader Clayton Greene, while addressing the media and party affiliates on Wednesday at the Opus Restaurant in Grace Bay on Wednesday (October 12). Greene told the gathering that not only are the British on a campaign to render elected government impotent but are also to plunge the people into poverty. According to him, these plans were being crafted through the Civil Service Reform, Crown Land Reform, Education and the health sector. According to the PNP Leader, actions by the Interim Administration suggest a great of mistrust in all things Turks and Caicos. He said the new Crown Land Policy which Government has crafted is designed to make it almost impossible for locals to acquire such crown land. “The Crown Land Policy has one major flaw. It seeks to remove control of this admittedly limited resource from the cabinet and has placed it in the hands of the Attorney General. This is, again, evidence of the fact that

this Interim Administration is determined to castrate the local administration and render local government ineffective. What makes the Attorney – an unelected British Appointee – a better custodian of the people’s land than a government that the people would have elected to manager their affairs,” Greened said. “Just the other day we had to fight for scholarships. And I say, it is only because Turks and Caicos Islanders were the beneficiaries. Now we have to fight for adequate health care because by and large, it is Turks and Caicos Islanders and our brothers and sisters from neighbouring countries that can ill-afford private insurance, that are the major beneficiaries,” Greene insisted. Greene added: “The response of this administration is never to analyze critique or improve their own performance; rather, it is to threaten to increase taxes. On the hospital issue, the threat is to increase the National Insurance contributions. This is the coward’s way out. The Progressive National Party opposes in the strongest terms any increase to National Insurance Contributions or reduction in benefits unless or until the Administration has tried out the following: “Firstly, the Administration has to

apply its mind to the strict enforcement of the contract between InterHealth (Canada Limited and the Turks and Caicos Islands Government, so as a people, we can know what we are paying for, with a view to realizing the high level of the care that the facilities should be delivering. Secondly, if breaches are found to exist, then the Administration should be able to use those breaches on the basis for the renegotiation of the contract, particularly, elements of the contract that results in greater value for money.” He said the there has not been any explanation regarding systemic weakness in the public sector that Sir Robin Auld, in giving his findings of the Commission of Inquiry, discovered, adding that neither where those weaknesses were found and the what are the remedies to cure such anomalies. “It therefore appears to me that little or no plant or forward thinking has gone into the exercise. Giving this lack of analysis, we can only assume that the current public sector reform initiative is not focus on creating a civil service with high performance as

its goals, but more so, reducing public sector costs in an effort to balance a budget with no regard for potential widespread negative, social and economic impact. Addressing the move by the Government to make current Permanent Secretaries and Under Secretaries reapply for their jobs, Greene charged that if the people of the Turks and Caicos Islands allow that to take place, the current holders would be pushed from those positions, and those slotted would be made loyal to the FCO and not accountable to the local populace. “The Interim Government has said that all of the office holders would have to resign and reapply. There is no rhyme or reason for requiring the existing office holders to reapply for the posts, unless the attention is to rid the system of Turks and Caicos Islanders at the permanent secretary level. It is already been rumoured that positions are currently being outside of the Turks and Caicos Islands, including the United Kingdom . No permanent secretary, therefore, enjoys job security. We must make a pre-emptive strike with a view to letting the administration know that this will not happened in these Turks and Caicos Islands . Organize yourselves and peacefully protest this threatened action. If we sit back and allow this action to happen, we will live in a country where Permanent Secretaries’ loyalty will be to the FCO, as oppose to the Minister, whose policy agenda the permanent secretary is charged with helping to implement. If we let this happen Ministerial Government will be a thing of the past as ministers will have no authority. The return of representative government will mean nothing, as elected officials will be unable to represent.

Local businessman and economist John Hartley named in million dollar lawsuit in Florida

LOCAL BUSINESSMAN AND economist John Hartley has been named as a defendant in a $4million lawsuit that was filed last month in the United States District Court for the Southern District of Florida. The law suit is being brought by American multi-millionaire R.D Hubbard, who is also a Turks and Caicos Islands Belonger and a major investor and property owner here. It stems from a deal in which investors were convinced to come up with $4.5 million for shares in an electric car company, but they apparently got nothing for their money. Court documents obtained by The SUN showed that Hubbard, through Edward Burger who is acting as trustee for the Hubbard Family Trust, is suing Hartley along with, John Mattera, Bradford Van Siclen, John Ray Arnold, and Praetorian Fund Limited (www.praetorianfund.com), of which Hartley is a director. The story was even published in

Inc. ("Fisker"). It is alleged that Praetorian, G. Power, Mattera, Hartley and van Siclen, at various times, represented Plaintiffs these shares were owned by Mattera, Praetorian or G. Power. However, after they made their investment, Plaintiffs never received the shares reflecting their membership interest in Praetorian. Plaintiffs then discovered that Mattera, Praetorian and G. Power did not own the Fisker Series A Preferred shares. It is also alleged that Arnold and First American participated in these securities violations by violating their duties as escrow agents to the Investors who trusted them to hold their moneys pending a proper closing of this transaction. The court document said there is also an action for breach of fiduciary duty against the escrow agents for this transaction and an action for breach of contract against Praetorian, because Praetorian took Investors’ money but did not issue them shares representing a corresponding interest in Fisker shares and insofar as Praetorian and G. Power do not own the Series A Preferred shares in Fisker.

It is also alleged that Praetorian, G. Power, Mattera, Hartley, van Siclen and Fund fraudulently induced Plaintiffs to purchase membership interests by telling Plaintiffs that G. Power owned $20 million Series A Preferred shares in Fisker, and that through their investment, they would be purchasing an indirect ownership interest in Series A Preferred Fisker shares to the extent of their purchase. According to the Miami Herald article, Mattera acknowledges he never owned Fisker Series A-1 preferred stock, which the investors were told they were buying. He did have a substantial holding of similar Series B stock, which he said he tasked associates Bradford van Siclen and John Hartley with selling. Mattera said van Siclen, the New Jersey-based private equity broker who is a defendant in the lawsuit along with Hartley, was responsible for misrepresenting the offer. A message left for van Siclen at his business, The Praetorian Fund, went unanswered this week. The SUN was unable to reach Hartley for comment up to press time.

Train civil servants, don’t fire them, says PNP Leader Clayton Greene

INSTEAD OF CUTTING civil servants who are deemed inefficient, Government should embark on a training exercise to as to bring those lacking up to speed with the task that they are being required out, this according to Progressive National Party (PNP) Leader Clayton Greene, who was addressing the local media and party members on Wednesday, at the Opus Restaurant in Grace Bay. Greene pointed out that at the point when the British assumed the reins of power and the imposition of direct rule through the Governor, the civil service accounts for approximately 60 percent of the budget. Now he said that has been chopped to approximately 36 percent, while pointing out that earnest downsizing exercise has not begun. “At the end of 2008, manpower expenditure budget for the Civil Service was quoted as being 60 percent of recurrent revenue. Some people argue that 60 percent is high,

while others would argue that, given the need to duplicate essential services across the archipelago, 60 percent is not out of line. That is not the point that I wish to make. Today, ratio of manpower to recurrent budget is 44 percent, and the Administration contends that the rightsizing exercise has not begun as yet. “We also need to consider that a large number of posts in the manpower budget are on hold. So, even though a budget value is assigned to them, no recruitment is being allowed. Making adjustment with the fact that some positions are on hold, the actual ratio to manpower expenditure for recurrent revenue is more in the range of 35 percent. This again, is before the commencement of the rightsizing exercise,” Greene explained. However, he noted that experts have recommended that the current expenditure for the Civil Service should be in the region of about 45 percent. “This administration is significant below that,” he said. Greene charged that the Interim

Government is on a course to cut civil servants’ pay to the point that they would not be able to afford the day-to-day basic necessities in order to survive, while impacting the service delivery, since fewer people are being made to carry out particular tasks with even fewer resources. “It is time that the focus changes. A 35 percent ratio is already critical. We suggest that the Administration focuses its efforts on identifying those persons within the service that are in need of training and develop new skills sets, with a view to aligning skills sets with job tasks,” Greene said. FORMER DEPUTY PREMIER and Minister of Education, Lillian Boyce is advising the country not to expect the Interim Administration to make decisions in their best interest, as she commented on the recent developments in education, especially in the areas of scholarships. Boyce was making her contribution during a Progressive National Party (PNP) news conference at the Opus Restaurant in Grace Bay on Wednesday, October 12. Boyce revealed that Government intends to cut scholarships and other benefits to the community college in the coming weeks, and is warning that there has to be some level of belttightening by the people of the Turks and Caicos Islands in order for them and their families to survive. “We have seen our education system dwindle to nothing, and they are going to cut scholarships to the community college in the next few

weeks,’ she said, revealing also that students from North and Middle Caicos will be made to suffer even more, now that their community college subventions are under threat. Subventions are awarded to students on those islands essentially to meet the travelling and meal costs, and according to her, based on the situation that there are no community colleges on those islands, the students and their parents could face a daunting future as it relates to acquiring a sound education. “Our last administration believed in education. We believed in educating our people. We believed in health care, that is why we have those hospitals. But we must be reminded that civil servants are running our country. They are not politicians, and so they would never make decisions in our best interest,” Boyce said. Boyce, who also served as Minister of Health and Human Services, said employment of British nationals to fill the various positions across government does not help the

country economically, since the salaries earned are being shipped back to the UK to shore up that country’s economy, while the TCI barrels downward the abyss of financial peril. “They are sending it (salaries) back home to their families and their economy is getting better as we sink

She added: “I also want to remember the number of children on Providenciales who are not in school, whether they are Haitian children or whatever Caribbean country they are from, they are going to grow up in our country uneducated. They will contribute to the crime level that is escalating everyday, and we are going to be in trouble.” She also reaffirmed her stance on independence, saying that as long as self determination eludes these islands, its people would forever be treated as criminals by the United Kingdom Government. She also commented on the early calls for British intervention and the British attempts to vilify the former government saying, “Those of you who thought that the British came for five ministers are mistaken. They came for all of you also. They will try to make all of you criminals.” She continued “Our government only did what governments all over the world continue to do for their people.”

Postal terrorism drill draws curious onlookers

IN AN EFFORT to test their readiness in the event of the postal service coming under terrorist threat, the Disaster Management, Fire and Rescue, Environmental Health Department, the police and the Medical Department staged a simulation exercise on Wednesday (October 12) at the Providenciales Post Office. The exercise drew a number of curious onlookers, some of whom were led to believe there was a real situation at the post office based on the evacuation of the employees and other persons from the building and corralling of the area. Desmond Lightbourne, Community Preparedness Manager for the Disaster Management said the exercise was in keeping with International Day for Disaster Reduction, which was in fact observed on the following day, Thursday, October 13. He said the simulation exercise was not only to test the different agencies’ readiness in the event of a disaster but also to bring awareness to the general public, hence the drill being conducted downtown, in full view of the general public. He said the drill was predicated on a suspicious package believed to have contained a dangerous chemical, which arrived through the mail but got misplaced, but was eventually found by a supervisor. “The package contained infectious substances, and the package somehow got missing. On or about 9 o’clock, while the supervisor was sorting through the mail, the package was discovered and labeled to have contained infectious substances. She then called 911, who then alerted the relevant agencies and they responded very quickly,” Lightbourne said. Added Lightbourne: “We are trying to bring awareness to the public with regards to Hazards.”

With more than 80 players taking part in the two legs of the tournament, the event has already been a huge success with Grand Turk and Provo still to go! North and Middle Caicos Domino players came out to Islandcom’s North Caicos Authorized Dealer, KJ Foods, on Friday, September 30th, all hoping for a chance to take home the local pot as well as Nokia Touch and Type phones with 6 months of free Islandcom service. The winning teams from South, North and Middle, and Grand Turk will also receive all expenses paid trips to Provo for the final on October 22nd. The competition was tough in North as 26 teams vied for the coveted title. Juliette Lewis and Varlene Francis of ‘Kool Cats’ took on Defending Champions Eric Robinson and Javan Seymour of team ‘E & J’ in the first round – an unlucky draw for the only female team in the tournament. Despite their best efforts the ladies failed to overturn the defending champs who advanced to the second round only to be knocked out by ‘First One’, 6 to 2. Due to uneven teams for the competition bracket, first round losers were randomly drawn to get back in the game. Team ‘Facile’ were picked to take on ‘Black is Beautiful’ in the second round, beating them out to advance to the quarterfinals. ‘Facile’ capitalized further on the good luck of the draw and made their way straight to the finals to face ‘Ruff N Tuff’ for the title. Government, InterHealth squeezing TCI people

GOVERNMENT AND INTERHEALTH Canada, operators of the two recentlyconstructed hospitals – the Cockburn Town Medical Centre on Grand Turk and the Cheshire Hall Medical Centre in Providenciales - are being accused of seeking to take the lazy man’s way out in the funding of the National Health Insurance Plan (NHIP). The accusations have been leveled against the two entities by Progressive National Party PNP members – Leader Clayton Greene and former Deputy Premier and Finance Minister under the previous administration Royal Robinson. Recently, the NHIP said its coffers were swinging low, as there was more being paid out than what was being collected, and if things did not change in a hurry, it would have to seek Government’s intervention to raise rates in order to stay afloat. Government, which has been complaining that InterHealth’s bills are too high, appears to be warming towards the idea of a rate increase. However, both PNP representatives said that InterHealth Canada has not exhausted all its revenue-generating mechanisms under the initial contract, before calling for rate increase. According Robinson, who was an integral part of the hospitals’ negotiations and construction under the PNP administration, the contract bears what is called ‘a third party income’ clause, which gives

InterHealth Canada the opportunity to venture into medical tourism, especially in the area of cosmetic surgery, from which the revenue spinoffs would split down the middle between that entity and Government. But according to him, InterHealth had done nothing to explore such possibility. “From the third party income, TCIG would receive 50 percent of what money comes in, that’s number one. Number two, there is a provision in the contract to refinance the debt, and there again, TCIG would benefit from what accrued from that financing. I think a couple of months ago, there was a discussion with respect to that (refinancing),” Robinson said. He noted however, that Caroline Gardiner, the Chief Financial Officer at the time, appeared non-committed to that idea.

“So, the cards are in their (Government) hands. It is their management of the contract that is falling down, because one of the things that should have happened was that a proper contract management team should have been in place, to monitor whatever InterHealth is doing with the contract. And you cannot say that it is being done from the sidelines; you got to say it is being done from the inside, and people must have the information to do that. “There should have been a system to generate the type of information, so TCIG would be able to look at every transaction that’s happening in the hospital, so that they would be able to audit it independently of what InterHealth is doing. But InterHealth has a requirement to provide audited accounts of what’s happening. “You can’t just saying that InterHealth is charging too much to perform certain activity, when you have not looked into the things that make up that particular activity. They might well be overcharging us, but we don’t know what the numbers are. We would only know what the numbers are if the contract management team had been in place properly and monitoring the situation for us” Robinson. For his part, Greene called on the

public to join his party’s cause in insisting that the contract is adhere to, by InterHealth Canada and, that Governments bats for their interest. “There are (income-generating) things in the contract that had not been tried. All the administration said is, ‘this thing is not working, and we don’t have enough money, so I think we are going to start taxing some monies out of people’. “They have not looked at it and say ‘is InterHealth Canada doing what they ought to be doing under the contract?’ They have not begun to investigate critically the entirety of the contract to see whether or not we are getting value. What they are doing is taking the lazy man’s way out,” Greene said. In the meantime, another former Deputy Premier and Finance Minister, Floyd Hall said the operators of the hospitals have not begun to scrape the surface in maximizing the potential of the two facilities, which he dubbed to he of first world standards. According to him, there are many areas, including research that InterHealth could tap into, in order to raise not only its revenue collection but also its profile. However, he said until a stable government which cherishes those ideas, medical advancement in the TCI would remain stagnant.

LIME keeps in touch with Ona Glinton Primary School

Ona Glinton Primary School was damaged by fire not too long ago that had completely destroyed nine of the classrooms, and several others buildings. LIME stepped in with the text line that was used to mobilize support in the early days. Ona Glinton Primary was the recipient of the CARIFTA promotion where the lucky winner chose the school that LIME would donate $5000 towards. This money would be used towards the sporting program at the school. An additional $1000 was given as well for the school from LIME. Recently during Caribbean Wellness Week, LIME used the opportunity to once again touch the students and teachers at the Ona Glinton Primary School by donating fruits during that week. Mr. Seymour commented: “LIME believes it is important for students to develop a healthy lifestyle by including fruits for a balanced diet.” LIME’s Grand Turk staff members, Leaser Jones and Doreen Francis assisted with delivering the fruits to the Ona Glinton Primary School. LIME, a partner in Education, is once again giving all Grade 6 students the opportunity to log on to Caribbean Examinations online to participate in the Go GSAT Program. This educational resource is open to all Grade 6 students nationally. Parents are encouraged to get on board and push children to sign up and adequately prepare for the GSAT examinations to be held in 2012. Mr. Seymour commented: “We have started on a journey that will yield success because students have the chance to perform and be rewarded and LIME wants students to get an early start on GoGSAT online.” He cautioned, “Do not wait until it is two weeks before the exam to prepare, but actively participate in doing the test lessons online.” The Go GSAT Program has benefitted many students as the Education Dept has seen a tremendous improvement in the National Pass Marks for the GSAT exams. The Jamaica-based all-inclusive chain received nine prestigious Quality Assurance Awards from MLT Vacations, one of the USA's largest tour operators, on October 2 in St Paul, Minnesota. LOS ANGELES — Dr. Conrad Murray's use of a cocktail of drugs on Michael Jackson as he struggled to fall asleep on the day he died was a "recipe for disaster" and ultimately caused his death, a sleep therapy expert testified Thursday. Dr. Nader Kamanger described Murray's treatment as "unethical, disturbing and beyond comprehension." Kamanger, one of the experts who evaluated Murray's actions for the

California Medical Board, expressed dismay about the drugs Murray gave the pop star, his failure to immediately call for help and his lack of monitoring and record-keeping. Authorities say Murray gave Jackson a fatal dose of propofol, a powerful anesthetic used in surgeries. Murray has pleaded not guilty to involuntary manslaughter in the 2009 death. Kamanger was the third expert for the prosecution to criticize Murray's

"To summarize, Mr. Jackson was receiving very inappropriate therapy in a home setting, receiving very potent therapies without monitoring," Kamanger said. He said diazepam (Valium), lorazepam (Ativan) and midazolam (Versed) were given to the sleepless star during a 10-hour period throughout the night and morning. "This cocktail was a recipe for disaster," Kamanger said. Noting the addition of propofol (Dipravan), Murray's attorney, J. Michael Flanagan, asked: "Could this have caused death?' "Absolutely," Kamanger said. "Absolutely." Murray was unable to produce any written records on his treatment of Jackson, Kamanger noted. "There were no records whatsoever," he said. "It's very easy to forget details. We do not rely on memory." "So it's your opinion that there's no way he could have remembered what

he did if he didn't write it down?" Flanagan asked. "It is an egregious violation of the standard of care when you are using sedatives like propofol and you are not writing it down," Kamanger answered. He said Jackson's demand for the drug was not a sufficient reason to give it. He also suggested Murray should have done a physical examination, taken a history from his patient about his insomnia, and called in other medical experts if necessary to evaluate the problem. "The most important thing he should have done is call for help," Kamanger said. He said Murray's interview with police made it clear that he waited too long to call for help when he found Jackson not breathing. On Wednesday, Murray's defense team announced they were dropping a claim that was the centerpiece of their case — that Jackson swallowed additional propofol when Murray was out of the room. Flanagan did not bring up self-dosing on Thursday. Murray could face up to four years behind bars and the loss of his medical license if convicted

Caribbean to receive millions next year to fight crime

The United States has announced it will inject $US77 million into the Caribbean next year to develop projects to fight crime and violence. The funds will be disbursed though the security partnership between Caricom states, the Dominican Republic and the US called the Caribbean Basin Security Initiative (CBSI) that was launched last year. Deputy Assistant Secretary for Central America and the Caribbean, Bureau of Western Hemisphere Affairs at the United States Department of State, Julissa Reynoso, said the 2012 budget would be used in part to support greater coordination and control of border and maritime routes, training and capacity building for law enforcement and justice sector. She told a CBSI Commission meeting here that her country would be delivering high-speed interdiction boats and relevant equipment to the Eastern Caribbean as part of the US Secure Seas Effort to complement those already provided to the Bahamas, the Dominican Republic and Jamaica. Guyana and Suriname will also receive riverine patrol boats and related equipment in 2012. “We are proud of the accomplishments of the past year under the CBSI,” she said while noting concerns that the CBSI partnership had not made the impact that it should have. “We have encountered many challenges but we believe that the CBSI provides a useful and necessary

framework for coordination and collaboration with our partners in the region.” The US representative said automated fingerprint identification system equipment were being purchased for six states, and, in accordance with a CBSI agreement, a regional legal advisor will develop a task force to address critical crime issues including homicides and to advise on legal reforms. During the opening ceremony for the CBSI, Guyana’s Minister of Home Affairs Clement Rohee called for “practical well-thought out solutions” to relieve the strain on Caribbean populations by eliminating the causes of crime at the local, regional and hemispheric levels. He acknowledged that progress has been made through the partnership but added that “much more work needed to be done,” to ensure that the peoples of both regions could feel secure. He said the Commission needed to roll-out strategies and programs to address the growing problem of youth gangs and gang violence among other issues. “There is urgent need to get to the stage to implementation so that the fruits of the partnership can trickle down to the benefit of the Caribbean peoples…of importance is the urgent need to begin to rolling out programmes that go to the heart of countering trafficking in narcotics and firearms, which poses a major challenge in the national security of our respective countries,” the Home Affairs Minister said

Jamaica is reporting a 40 percent drop in homicides over the past 15 months, but Prime Minister Bruce Golding said crime is still at an unacceptable level. He said 276 less homicides have been committed for the year, from the 1,097 that occurred last year. This, he stated, is also less than what was reported in 2009. Golding commended the security forces for their “outstanding work.” “While we embrace this success, let us be mindful that the crime rate still remains at an unacceptable level and we must not in any way reduce our efforts," he said in a statement. “I urge your members to not let their feet falter, but to keep them firmly planted as we strive together to achieve the vision that we share for Jamaica- a country where sanctity and security are restored and our people enjoy peace and order." On the heels of that announcement came a United Nations report that cited Jamaica as having had the highest homicide rate in the English-speaking Caribbean last year. The 2011 Global Study on Homicide said this stood at 52.1. “In Jamaica, for example, a country with a generally high homicide rate and a high level of violence, some of the increases in homicide levels occurred during the economic crisis,” the report by the U.N. Office on Drugs and Crime stated. St Kitts and Nevis was next in line at 38.2, ahead of Trinidad and Tobago’s 35.2. The Bahamas was at 28.0, St. Lucia’s at 25.2, Dominican Republic at 24.9, and Dominica at 22.1. The lowest murder rates in the region in 2010 were in Antigua and Barbuda at 6.8 and Haiti at a 6.9. The report said the homicide rate in the Central America and the Caribbean is nearing “crisis point” having increased steadily over the past 15 years, while it has declined in Asia, Europe and Northern America.

BARBADOS WARNED AGAINST HIKING TAXES DUE TO MINIMAL GROWTH FORECAST The Central Bank of Barbados (CBB) said government should not consider increasing taxes to bolster the economy, which is forecast to grow a minimal one percent this year. Any increases could cripple the tentative recovery in output, it warned. The central bank said the economy grew one percent more than the 2010 period - half of what was projected at the start of the year. There was a drop in foreign exchange earnings from tourism, despite a significant increase in long stay arrivals. This led by a 10 percent increase in the UK market.

“Tourism receipts contributed 46 percent of foreign exchange earnings in the first nine months of the year. Foreign inflows for international business and other services accounted for 18%,” the CBB stated. The construction and wholesale and retail trade sectors grew, while manufacturing, sugar production, and non-sugar agricultural sectors contracted. At the same time, the bank noted, the fuel import bill increased about one-third leading to increased spending on imports. “Over the first six months of the

year, the prices paid for imports of corn, wheat and soya beans had increased by 46 percent, 51 percent and 27 percent, respectively,” it said. Overall, retail prices for the 12 months ending in July were about seven percent higher than the previous year. The bank explained, “This represents an acceleration in the rate of inflation, which stood at 5.8 percent at December 2010. The prices of food items, which account for 34 percent of average household consumption, rose 2.8 percent over the 12 months to September, and fuel and light prices

were up around 1 percent.” Unemployment, it estimated, was in the region of 11 percent up to the end of last month, with about 700 new benefit claims made between March and September. “This is supported by a survey of 30 large employers in tourism, construction, and wholesale and retail, as well as trade unions and the Employer’s Confederation,” it said. According to the bank, current account deficit rose to 9 percent of GDP for the first nine months of 2011, compared with 8.7 percent for the corresponding period of 2010. Focusing on the outlook for the remainder of the year and 2012, it said prospects of a full recovery from the economic recession have become more distant because of the weakened growth prospects for the U.S., the U.K. and other advanced economies.

Haiti president meets with 'Baby Doc,' Aristide

PORT-AU-PRINCE, Haiti - Haiti's new president met with former President Jean-Bertrand Aristide and former dictator Jean-Claude "Baby Doc" Duvalier on Wednesday in an effort to reconcile the Caribbean country with its troubled past. President Michel Martelly, who on Tuesday sat down with 1988 coup leader Prosper Avril, said the meetings were part of an organized effort to bring together former leaders so they can help Haiti pull together and rebuild from last year's devastating earthquake. The occasion, unprecedented by former Haitian leaders, prompted Aristide to make his first public speech on national television since he returned from South Africa in March after seven years in exile. "This visit reinforces all the steps that have been made so that we can put our heads together," Aristide said in a videotape of his talk with the president while sitting with his wife, Mildred, at his side. The National Palace released the video Wednesday night to The Associated Press. Haiti needs "to speak, to dialogue, to unite so that the country can become more beautiful," Aristide said at his home on the edge of Port-au-Prince. Martelly earlier told The

"We are writing a very special page in the history of Haiti," Martelly told AP after meeting with Haiti's other former leader, Duvalier. "It's time for us to unite." Martelly, a ribald musician before he was elected to the presidency in March, was once openly critical of Aristide, a Roman Catholic priestturned-two-time president who was ousted in 1991 by a military coup and

in 2004 by a ragtag group of former soldiers. Differences were apparently set aside Wednesday. "He received me as one of his own," Martelly said of Aristide. "We are all Haitians on this land — that's the signal we need to send out." Martelly said he hopes to meet with other former Haitian leaders soon, including his predecessor, former President Rene Preval. Cayman Islands gang law inadequate says Commissioner of Police

Police commissioner David Baines says gang legislation passed in the Cayman Islands several years ago is completely inadequate and there has never been a prosecution under it. The islands' top police officer has called for practical legislation instead that he says his officers can use in order to arrest and charge the young men behind the surge in gun crime. Echoing comments made by other senior officers in the RCIPS recently about changes needed to the firearms law, Baines wants to see the burden of proof switched from prosecutors to defendants under the country’s gun laws and officers given the ability to make warrantless searches whenever and wherever they have grounds to suspect guns are hidden. Speaking at a press briefing on Friday with visiting senior officers from the UK, the commissioner of police (CoP) spoke about the challenges of arresting gang members under current legislation. Baines spoke about the problem of the gang laws, which includes provisions that specific tattooes or colours can deem people to be gang members. He said trying to arrest these gang members for congregating was very difficult as it was not possible to prove they are planning to commit a criminal act. Baines said the law was insufficient. “There has not been a single prosecution under gang legislation,” he said. Baines spoke about amending the firearms law to give police more practical legislation that officers can use to arrest and charge people. The barriers presented by the need for warrants before police can search homes where they suspect guns may be

hidden needed to be addressed, he said. Baines pointed out that police can search homes without a warrant when they suspect drugs could be at a property but they do not have the same powers in relation to illegal guns. He also said in circumstances where firearms are found at a premises the police must prove that the suspect is the owner or user of the guns. The commissioner said that the burden of proof needs to switch so the suspect has to explain the presence of any weapons rather than the prosecution having to prove the weapons belong to, or are being used by, the resident of the place where they are found. Baines pointed to the importance of the right legislation as he said all of the social efforts, the extra cash for the police and other moves to fight crime would be “meaningless” if the police could not carry out their investigations lawfully. Both the police and legislators have been discussing possible amendments, the commissioner revealed, and recommendations have gone to the attorney general. Baines said he hoped the changes would come soon. “There is no lack of appetite to move forward on this,” he added. However, in the local legal profession a number of attorneys have voiced concerns about the trend towards altering of laws that trample on the public’s rights and freedoms in order to increase the chances of the prosecution getting a conviction. Many say that the legislation is not the problem but it is the work of the police and prosecutors which needs to improve. One local attorney expressed the views of a number of lawyers when he said that changing laws to aid weak prosecution and poor police

His inauguration in May marked the first time that a Haitian president, Preval, completed two terms. It was also the first time that a leader transferred power to a member of the opposition. Avril was an army colonel who led a 1988 coup that overthrew a transitional government. He resigned two years later amid protests.

We are already on the slippery slope and the leaders of non-performing institutions should be stepping aside instead of deflecting poor performance,” he added. Pollack questioned the appearance of legality when the checks and balances of an experienced judiciary are pushed aside in favour of laws that will ultimately lead to suspicion, then conviction. “The adoption of the German or Zimbabwean model will not lead to a more transparent or civil society,” he said. “Any legislator approving this amendment is endorsing the performance of the present commissioner.” The criticisms of the institutions have come hard and fast recently after a number of acquittals in gang related killings and fatal shootings, which some say were the result of either poor evidence gathering or poor presentation of the cases. Both the commissioner and the governor have spoken publicly on the need to review how evidence is being gathered and preserved and how police cases are being put together and ultimately presented in the courts. The authorities have suggested that an expert from the Canadian police service will be coming to Cayman in the near future to review those elements of criminal cases and the commissioner is also seeking to recruit forensic experts into the RCIPS.

With 316 votes for and 301 votes against, Mr. Berlusconi’s center-right coalition won the vote. But it failed to secure a solid majority, making it increasingly difficult for him to pass legislation aimed at protecting Italy from Europe’s sovereign debt crisis. Had he lost, Mr. Berlusconi would have had to resign, marking the end of an 18-year political era in which the billionaire businessman shaped Italian politics in his own image, entwining the country’s fate with his own. CARACAS - Of many surreal moments in the life and times of Hugo Chavez, the flamboyant Venezuelan leader's encounter with a puppet of himself this week was one of the wackiest. Despite his convalescence from cancer surgery and four rounds of chemotherapy, the 57-year-old Chavez has since the start of October been hitting the air-waves like the old days, with phone-ins to state TV any time from dawn to midnight. So when a supporter produced a life-sized puppet of the 'Comandante' on state TV, Chavez enthusiastically called in for the third time that day and was expounding on indigenous land rights when, embarrassingly, the puppet's trousers fell down. "Tie them up, brother! You can't let Chavez's trousers fall down," he laughed in a clip that naturally has been a hit in cyber-space. To supporters, the incident showed his sense of humor. To detractors, it was buffoonery unbefitting of a president. The wider message from his return to the air-waves was clear: Chavez's energy-levels and omnipresence are returning. "It's not time to die, it's time to live! To those who want me dead, I tell them that soon my return will be complete," Chavez said in what has become a daily mantra. Having disappeared from public view for several weeks in June, when he had a cancerous tumor removed in Cuba, Chavez first returned to Venezuela with a drastically curtailed lifestyle, serious demeanor and sporadic public appearances. His illness, and the specter of his disappearance from the stage he has dominated since taking power in 1999, turned Venezuelan politics upside down heading into an election year. But more than three months on, Chavez says four rounds of chemotherapy have been successful and tests he is due to take in Cuba this weekend will declare him cancer-free. WASHINGTON — President Barack Obama said Thursday that officials at the "highest levels" of the Iranian government must be held accountable for a brazen and bizarre plot to assassinate the Saudi ambassador to the United States on American soil. He insisted leaders of the world will believe the U.S. case without dispute once they absorb the details. U.S. officials, meanwhile, confirmed the Obama administration has had direct contact with Iran over the allegations. The U.S. ambassador to the United Nations, Susan Rice, met with Iranian officials at Iran's mission to the U.N. on Wednesday — a highly unusual contact for two countries that do not have diplomatic relations. Obama would not say whether Iran's supreme leader, Ayatollah Ali Khamenei, or its president, Mahmoud Ahmadinejad, knew of the alleged plan. Yet he called it part of a pattern of "dangerous and reckless behavior" by the Iranian government and said people within that government were aware of a murder-for-hire plot. The U.S. considers it an attempted act of terrorism. "We believe that even if at the highest levels there was not detailed operational knowledge, there has to be accountability with respect to anybody in the Iranian

U.S. officials have described it as a remarkably clumsy but deadly serious operation by Iran's elite foreign action unit, the Quds Force. Two men were charged in New York federal court Tuesday for allegedly trying to hire a purported Mexican drug cartel member to carry out the assassination with a bomb attack. Obama is seeking a vigorous response from around the world, on top of increased sanctions and pressure against Iran from the United States itself. U.S. diplomats have given their host governments information about the foiled plot. The U.S. criminal complaint says the Iranian plotters hired a would-be assassin in Mexico who was a paid informant for the U.S. Drug Enforcement Administration and told U.S. authorities all about their plot. "We've laid the facts before them," Obama said of world leaders. He said once they analyze them, "there will not be a dispute" over what happened.

A couple who won £101 million in the EuroMillions lottery said they would use their winnings to marry and make up to 20 friends and family millionaires. Dave Dawes, a shift supervisor at a food producer, and his partner Angela Dawes, a charity shop volunteer, were the only winners of Britain's third-largest lottery jackpot, worth 116 million euros or $157 million. In a press conference, Dave Dawes, 47, said the couple went into "meltdown" as they watched the draw live on television and realised their numbers had come up. French public prosecutors dropped an investigation on Thursday into a writer's accusation of attempted rape against former IMF chief Dominique StraussKahn due to lack of evidence. The Paris public prosecutor's office said evidence existed suggesting sexual assault but a prosecution on that lesser charge was not possible under the statute of limitations. The incident at the center of the complaint dates back to 2003. Strauss-Kahn, a Socialist who was once runaway favorite to become the next French president, quit as head of the International Monetary Fund in May after police arrested him in New York on charges of attempting to rape a hotel maid. He denied the charges, which were later dropped. In France, he was accused by writer Tristane Banon, a woman 30 years his junior, of attempted rape in a Paris flat where she went to interview him eight years ago. While it would have been possible to launch a prosecution on a count of attempted rape, other sex assault charges fall outside the judicial time limits. "What came to light is that, while there is not enough evidence to pursue on a count of attempted rape, there are elements that can be qualified as sexual

assault," the prosecutor's office said in a statement on the outcome of a preliminary inquiry by police. Since the incident dated back to 2003 and Banon had only filed her complaint in 2011, the matter could not be pursued, the statement said. Strauss-Kahn's lawyers had dismissed the accusations and launched a counter-suit against Banon for alleged defamation. Banon's lawyer, David Koubbi, said Thursday's outcome was disappointing but proved her complaint was not a figment of her imagination.

Strauss-Kahn has asked for the case to be dismissed on the grounds of diplomatic immunity. They held it together for several seconds and then he drank. The king, wearing his red Raven Crown, with an image of the protector bird rising from the top, came down from the throne and placed a smaller crown on her head. After she took her place as queen, the newly married couple was feted by monks playing deep tones on traditional trumpets and pounding drums. The Je Khenpo presented them a series of gifts — a mirror, curd, grass, a conch — representing blessings for longevity, wisdom, purity and other well wishes. Unlike this year's other royal wedding — that of Britain's William and Kate — there were no foreign princes, no visiting heads of state, no global celebrities. Just the royal family, thousands of nearby villagers gathered at a nearby field waiting for the royal couple to celebrate with them and the rest of the country's 700,000 people watching live on TV.

NEW YORK — BlackBerrys across the world buzzed back to life Thursday, leaving customers outraged and threatening to cost the granddaddy of all smartphones more business when it's already struggling to keep up in a crowded marketplace. The three-day blackout interrupted email and Internet services for tens of millions of frustrated users and inflicted more damage on an already tarnished brand. "I've been a pretty big BlackBerry advocate," said Kate Jacobson, a student at Michigan State University. "But I'm done playing these games with you, BlackBerry." After using a BlackBerry for three years, she said the outage was the "last straw." On Thursday, she got an iPhone. Her unhappiness was shared by users across several continents. BlackBerrys in Europe, Asia, Latin America and Africa had been without email or chat messages since Monday. In the U.S. and Canada, the

outage was shorter, starting Wednesday. But many, perhaps most, of the world's 70 million BlackBerry users were affected. Research In Motion Ltd., which makes the phones and handles email traffic to them, said the system was steadily processing a vast backlog of stalled messages. The company's two CEOs apologized profusely. It was a break from the past, when outages of BlackBerry service merited only terse statements from the company. Mike Lazaridis and Jim Balsillie said they had not made plans yet to compensate customers, but they were turning their attention to that question. "Our priority right up until this moment (has been) making sure the system's up and running," Balsillie said. "We're going to fully commit to win that trust back." It will take more than an apology to win back some Blackberry users. But RIM's latest fiasco is unlikely to result in a mass exodus of its corporate and government clients.

BlackBerrys, like other imperfect business technologies, are deeply entrenched in commercial settings, and getting rid of them represents time and money that companies may be reluctant to give up. In the April-to-June period of 2010, 19 percent of the smartphones sold in the world were BlackBerrys, while a nearly equal number, 18 percent, were from a variety of brands that use Google Inc.'s Android software, according to research firm Gartner Inc. In the same three-month period this year, 12 percent of smartphones were BlackBerrys, while Android phones zoomed to 43 percent, outselling BlackBerrys more than three to one. The outage started when a crucial traffic-routing computer in BlackBerry's European network failed. A backup also failed. Although the underlying issues were quickly repaired, the system had built up a backlog of emails and messages that needed to be released. Meanwhile, messages destined for

the affected countries were piling up at BlackBerry data centers in the rest of the world, slowing service everywhere. Then the outage spread to the U.S. and Canada. Among smartphones, BlackBerrys are uniquely tied to their manufacturers. BlackBerrys get their email through RIM's centralized setup, allowing the company to offer a high level of security that appeals to corporate IT managers. But when something goes wrong, it affects millions of people at the same time. Blackouts are not localized to one company or one carrier, as other outages are. Such a widespread, highly visible failure could threaten RIM stock. But investors have taken the outage in stride. The stock is down less than 1 percent since Friday's close. That's because RIM's stock is already so beaten down by other bad news. It's lost 83 percent of its value from its peak three years ago — the time it's taken for BlackBerrys to go from hot items and status symbols to near-has-beens.

US judge says Samsung Occupy Wall Street Protesters tablets infringe Apple patents angry at eviction move

Occupy Wall Street protesters are planning a new demonstration in response to being told to move from Zuccotti Park in Manhattan, New York. The private firm that owns the space gave protesters notice that they would begin enforcing regulations after cleaning the park. Thy include a ban on sleeping bags on the ground and no lying on benches. Hundreds of people have camped in the park for four weeks, and related protests have spread across the US. Protest organisers sent an email to supporters on Thursday asking them to join the protesters at 06:00 EDT (10:00 GMT) to "defend the occupation from eviction". Representatives of Brookfield Properties, which owns the park, distributed the notice on Thursday. Some were escorted by police. The park regulations existed before the protests began but have not been enforced. They include a prohibition on lying down on the ground or on benches, using sleeping bags or tarps, or the storage of personal property. "As sections of the park are cleaned, they will reopen to the public," Brookfield said in an emailed statement. "All are welcome to enjoy the park for its intended purpose as an open neighbourhood plaza, in compliance with posted rules." New York City councillors joined protesters at a news conference on Thursday evening, calling the effort to

move the protesters out of the park a "ruse" backed by Mayor Michael Bloomberg. As protesters pre-emptively scrubbed the park on Thursday, some questioned the need to clean the space at all. "This is the cleanest protest I've ever witnessed," Emilio Montilla, a nowunemployed teacher's assistant, told the Associated Press news agency. "We take care of ourselves. We're self-sufficient." New York Police Commissioner Raymond Kelly said police would be standing by on Friday. There have been some flashpoints between police and protesters in recent weeks, with hundreds of people arrested on 1 October during a march over the Brooklyn Bridge. "After it's cleaned, they'll be able to come back, but they won't be able to bring back the gear, the equipment, sleeping bags," Mr Kelly said. As the number of protesters sleeping in the park has grown, the occupation has shown signs of permanence. Food stalls have sprung up, as well as an infirmary and even a library. But protesters have no toilet facilities of their own and depend on local restaurants near the park. There have also been reports of locals complaining about demonstrators urinating and defecating in the streets. Earlier this week, New York Mayor Michael Bloomberg has said protesters would not be evicted from the park unless they broke the law.

A U.S. judge said Samsung's Galaxy tablets infringe Apple's iPad patents, but also that Apple might have a problem establishing the validity of its patents. The comments from U.S. District Judge Lucy Koh came on Thursday in a court hearing on Apple's request to bar some Galaxy products from being sold in the United States. Apple and Samsung are engaged in a bruising legal battle that includes more than 20 cases in 10 countries as the two jostle for the top spot in the smartphone and tablet markets. Earlier on Thursday, an Australian court slapped a temporary ban on the sale of Samsung's latest computer tablet in that country. Apple sued Samsung in the United States in April, saying the South Korean company's Galaxy line of mobile phones and tablets "slavishly" copies the iPhone and iPad. Apple then filed a request in July to bar some Samsung products from U.S. sale, including the Galaxy S 4G smartphone and the Galaxy Tab 10.1 tablet. Mobile providers Verizon Wireless and T-Mobile USA have opposed Apple's request, arguing that a ban on Galaxy products would cut into holiday sales. Apple must show that Samsung infringed its patents and that its patents are valid under the law. At the hearing on Thursday in a San Jose, California federal court, Koh also said she would deny Apple's request for an injunction based on one of Apple's so-called "utility" patents. She did not say whether she would grant the injunction based on three other Apple "design" patents. Koh characterized her thoughts on the utility patent as "tentative" but said she would issue a formal order "fairly promptly.

CIBC First Caribbean Lions begin autumn season with double header victory

The Autumn Junior Rugby Season kicked off at the Meridian Field last Saturday with great rugby on display by all four teams. The CIBC First Caribbean Lions proved too much to handle for the Scotiabank Storm and the BCQS Bears while the HAB Warriors played out a nail biting draw with the Scotiabank Storm. In the featured game Andrew Seymour starred for the BCQS Bears as they outlasted the HAB Warriors in a back and forth game. The Bears began the game in the Warrior half and cleverly worked their way across the field leaving the Warrior defence searching for answers. Having camped themselves on the Warrior line Andrew Seymour made a break for the line and narrowly dived over for the first of his three tries. The two teams then settled into strong defensive patterns as each team tried to force their way into the other teams 22. The excellent defensive work shown by Willdello Seymour of the Warriors and Javron

Greene of the Bears meant that neither side had a sniff of the opponents try line before halftime. With only one try scored in the first half there was little notice of the offensive fireworks that were come for the rest of the match. From the opening kick off Gino Agenor of the Warriors levelled the match running into space on the left side of the field before cutting back in and scoring his sides first try. The Bears would not relent and were soon back in the Warriors half. Kaydam Pratt dragged in two defenders before releasing Devon Ingham who sailed in to restore the Bear’s lead. Eduardo Villanueva was soon to add his name to the score sheet as he doubled the Bears lead. The Warriors refused to relent and after Rayjon Valentine snatched a loose ball Jaebets Jean scored to give the Warriors a shot at victory. Franco Mompremier then followed up for the Warriors levelling the game at 3-3 and ensuring that the final ten minutes would be played at a frenetic pace.

Despite appearing in disarray for the majority of the second half the Bears proved they had a killer instinct with Andrew Seymour grabbing the game by the scruff of the neck and quickly scoring two tries that left the Warriors with no time to respond. In their second match of the morning the HAB Warriors played out an exciting two all draw with the Scotiabank Storm as Gino Agenor and Rayjon Valentine scored for the Warriors and Miguel Malcolm put in two excellent individual efforts for the Storm to ensure that they split the points. In the days other matches LJ Outten provided an excellent effort to net 6 tries in the Lions two victories over the Storm and the Bears. The Lions won a shoot out with the aggressive Storm, the match finishing 5-4 to the Lions. In their second match the Lions ran out victors over the Bears 4-2 with Javron Greene’s late effort for the Bears not enough to reignite his team.

FIFA begins Caribbean bribery cases

ZURICH -- The latest wave of FIFA election bribery cases began Tuesday, as 15 Caribbean soccer officials started explaining their part in an alleged plot involving former presidential candidate Mohamed bin Hammam. FIFA said its ethics committee would hear the defendants over three days, and was expected to deliver verdicts on Friday. The 15 officials from 11 Caribbean countries are accused of accepting $40,000 cash payments in Trinidad during Bin Hammam's later-abandoned challenge to FIFA president Sepp Blatter. They were charged after FIFA appointed former FBI director Louis Freeh to continue leading an investigation that began in May. FIFA's gravest scandal in 107 years has removed two of its most influential powerbrokers -- Asian football president Bin Hammam and FIFA vice president Jack Warner -- from office after a

Jean-Bart sits on the associations panel that monitors FIFA's 208 national members and Groden helps allocate tens of millions of dollars of development funding as a member of the Goal Bureau which Bin Hammam chaired for 12 years. The Haitian official is among five national association presidents answering charges this week, including one of soccer's most senior women officials: Franka Pickering of the British Virgin Islands. Former international referee Mark Bob Forde of Barbados has also been charged and faces a ban from soccer duty. Along with Bin Hammam in July,

FIFA's ethics panel suspended two Caribbean Football Union members of staff after ruling that they distributed $40,000 cash payments in brown envelopes in a Trinidad hotel. Caribbean Football Union vice president Colin Klass, a longtime Warner ally, received a 26-month FIFA ban after a separate hearing last month. The Guyana federation president lost his seat on FIFA's futsal and beach soccer committee. Qatari candidate Bin Hammam withdrew his election bid three days before the FIFA poll in June. Blatter was left unopposed to receive a fourth four-year presidential term, and was endorsed by 186 FIFA members, including most Caribbean islands. Blatter is scheduled on Oct. 21 to provide details of his promised anticorruption project to clean up world soccer and its damaged image.

NEW YORK — Commissioner David Stern said his "gut" tells him there will be no NBA basketball on Christmas without a labor agreement by Tuesday. That day, when owners and players are scheduled to meet with a federal mediator, is a "really big deal," he added. Owners will then open two days of board meetings Wednesday, and without an agreement to bring them, Stern believes further cancellations are coming. "Right now, Tuesday, Tuesday, Tuesday, just before my owners come into town, having brought in the labor relations committee and Billy (Hunter) having brought in his executive committee, it's time to make the deal," Stern said Thursday. "If we don't make it on Tuesday, my gut — this is not in my official capacity of canceling games — but my gut is that we won't be playing on Christmas Day." Stern canceled the first two weeks of the regular season on Monday when the sides couldn't reach a deal before a deadline he had set.

Christmas is traditionally the first big day of the NBA season. This year's three-game schedule features the NBA finals rematch between the Dallas Mavericks and Miami Heat. The sides will need to act quickly to save it. The talks have stalled over the structure of the salary cap system and the division of revenues between owners and players. They will meet Tuesday with George Cohen, the same mediator who tried to resolve the NFL's labor dispute months before it eventually ended. Asked if Cohen had the ability to move the sides toward a deal, Stern said: "I'm hoping he does because I think that if we don't make a deal by the time my owners meetings come in Wednesday and Thursday, after we've met with the mediator on Monday and then met with each other on Tuesday, then I despair. In a separate interview with NBA TV, Stern said he thought one was in reach Monday. The sides met for more than 12 hours over two days before talks broke down, and he says despite

frequent meetings lately that "we aren't making any progress." "How many times does it pay to keep meeting, and to have the same things thrown back at you?" Stern said. "We're ready to sit down and make a deal. I don't believe that the union is. Hopefully by Tuesday, aided by the mediator, they'll be ready to make a deal. Certainly, I'll bring my owners ready to make a deal." Hunter is meeting with players on Friday in Los Angeles. The union has balked at owners' proposal to replace their hard salary cap plan by making the luxury tax much more punitive. Players believe it would become such a deterrent to spending that it would essentially work as a hard cap. The sides also have to decide how to divide up about $4 billion in annual revenues. Players were guaranteed 57 percent of basketball-related income in the previous collective bargaining agreement and have proposed lowering it to 53 percent. Owners are seeking the same 53-47 split in their favor. The parties have discussed a 50-50

SHANGHAI -- Rafael Nadal was upset by Florian Mayer, 7-6 (5), 6-3 Thursday at the Shanghai Masters, the second consecutive year he's failed to reach the quarterfinals at the tournament. Andy Roddick advanced with a 6-3, 6-4 win over Spain's Nicolas Almagro. Roddick had 11 aces and 23 winners to beat the seventhseeded Almagro. Roddick will play third-seeded David Ferrer, who saved three match points against Juan Carlos Ferrero in a 1-6, 7-5, 6-2 win. Mayer pressured Nadal at the net throughout the match, winning 21 of his 29 approaches. Nadal saved two set points while serving at 4-5 in the first, but then gave away several crucial points in the tiebreaker, which Mayer clinched with an ace. Mayer got the first break of the match at 33 in the second set when Nadal hit a shot into the top of the net. He converted another break on match point, running down a drop shot and flicking it past Nadal at the net. The top-seeded Spaniard lost in the third round in Shanghai last year to Austria's Jurgen Melzer, just a few weeks after winning his first U.S. Open title. FAN EXPLAINS WHY HE THREW HOT DOG AT TIGER WOODS A California man arrested for throwing a hot dog at Tiger Woods during a tournament said he wanted to do something "courageous and epic." Brandon Kelly of Petaluma told the Santa Rosa Press Democrat on Tuesday that he's a fan of Woods and got the idea after watching "Drive" — a recently released movie starring Ryan Gosling as a stunt driver who moonlights as a getaway driver. "I threw the hot dog toward Tiger Woods because I was inspired by the movie 'Drive,'" Kelly said. "As soon as the movie ended, I thought to myself, 'I have to do something courageous and epic. I have to throw a hot dog on the green in front of Tiger.'" The Santa Clara Sheriff's Office confirmed to The Associated Press on Wednesday that the 31-year-old Kelly threw the wiener at Woods. Kelly was arrested for disturbing the peace Sunday after yelling Woods' name and tossing a hot dog in his direction during the Frys.com Open in San Martin. "When I looked up, the hot dog was already in the air," Woods said. "The bun was kind of disintegrating." Woods backed off his birdie putt during the disturbance and ended up missing the 18-foot putt. "Some guy just came running on the green, and he had a hot dog, and evidently ... I don't know how he tried to throw it, but I was kind of focusing on my putt when he started yelling," Woods said after the tournament. "Next thing I know, he laid on the ground, and looked like he wanted to be arrested because he ... put his hands behind his back and turned his head." Kelly posted on his Facebook page Sunday morning a photo of a hot dog in his hand in front of his vehicle's steering wheel and speedometer, the newspaper reported. Sgt. Jose Cardoza, a spokesman for the Santa Clara County Sheriff's Office, said that Kelly's misdemeanor offense would likely result in a fine and community service.
