The consensus among lawyers and other critics is that this new law has been drafted, designed and timed to specifically target and secure convictions against a number of persons who are under investigation by the Special Investigation and Prosecution Team (SIPT). However, there are fears and concerns throughout the legal fraternity and wider Turks and Caicos Islands society, that this Hearsay Ordinance will be a serious threat to the rights of ordinary residents who can very well find themselves being imprisoned because of hearsay evidence. According to a draft of the Ordinance which was obtained by The SUN, the new Hearsay law “sets out the rules which allow evidence other than first-hand evidence to be given in criminal proceedings. The two main categories are hearsay evidence and documentary evidence, but within those categories there are various types f evidence, including evidence given by signs, video camera evidence and so on”. The SUN understands that the Turks and Caicos Bar Council received the draft version of the new hearsay bill last week and they have until October 25th to review it and make their comments before the Governor enforces it by notice in the Gazette. Feedback which the SUN has received from the general public is that the proposed new law is totally outrageous and that if it is enforced, it would mark, as once critic said, a “very sad and dark day in the history of the Turks and Caicos Islands”. Attorney-at-law and leader of the Progressive National Party (PNP) Clayton Greene said in a press statement that the bill, if passed, will “change fundamentally the law relating to hearsay evidence as we know it in these Islands and would fundamentally diminish the protection that the law gives to accused persons”. He added: “One need not to have been a scholar of jurisprudence to have heard that “hearsay evidence was generally not admissible”. It is this core and fundamental issue that this draft Bill now seeks to change. The Interim Administration is so anxious to have the Legislation passed that the Bar Association was given just one week to comment on this far reaching piece of Legislation. On behalf of the people of this country whose rights and freedoms are being eroded with impunity I make the following observations in relation to this latest despotic and dictatorial act: (1). The draft Bill is unwarranted and represents an attempt by this

Administration to further erode an accused persons rights to a fair trial in these Islands and will deny accused persons of the protections previously afforded under our laws. (2). This Legislation is specifically designed to facilitate prosecutions that flow from the Commission of Inquiry so as to make them easier to mount and render convictions a virtual certainty. It would certainly be interesting (though not at all surprising) to know what lobbying has been carried out by the SIPT for this legislation to be brought forward. This type of lobbying is improper and calls the judicial system into disrepute. (3). This is but another step in the march of this Interim Administration to manipulate the justice system. This march began with the ripping from the constitution of the right to trial by Jury.” Greene said the next step in the advance of this “tyrannical journey” may well be the “ripping from the accused of his absolute right to silence”. He added: “It is not coincidental that it was this absolute power of the State and the State’s ability to influence, control and manipulate the justice system that resulted in the jury system being implemented in the first place. The fact that our Legislation is being changed, fashioned and or introduced so as to secure specific convictions for past acts is against the rule of law. In a democratic society it is the duty of the Judiciary, the Bar and ordinary citizens to protect the rule of law and democracy at all cost. We cannot allow this to happen. Let us stop this together. Let us stop this now.” The SUN was provided with a copy of email exchanges among various lawyers who expressed their concerns about the proposed legislation. However, because the emails were confidential and no permission was sought to reproduce their comments their names will be withheld. One prominent lawyer stated: “The current attempt to massage the law with no notice to or discussion with the very professionals who have to deal with it on a daily basis has long term implications for every defendant in every case in the islands, long after SIPT have departed our shores. If we were in such a hurry to emulate British legislation we might have copied their Divorce legislation or Bankruptcy laws many years ago. Target specific legislation for a single purpose should be opposed as a matter of principle until full discussion by the profession and the public who will have to live with the consequences. Another prominent lawyer noted: “I believe the issue of passing legislation to secure specific convictions was briefly discussed

almost three years ago at the Bar Association AGM held at Simba restaurant. Since then there have been extensive amendments to the Proceeds of Crime Ordinance (the amendments are thicker than the principal legislation), the right to trial with a jury, etc., etc. I recall that there are members of the bar who see nothing wrong with this, but it is my view that it is an appalling indictment on the rule of law when legislation can be changed, fashioned, and introduced to secure specific convictions for past acts by targets that an administration considers undesirable. I don’t believe that you need to be passionate about jurisprudence to recognize that this is the type of conduct that you read about and would expect from the world’s most oppressive and appalling regimes. It is my view that the Bar Association has an important role to play in this assault on the rule of law by being a check against the wholesale and flagrant fashioning of
legislation to secure specific convictions. Ultimately, we are talking about a rapid erosion of an accused person’s rights with little consultation, almost no public debate, and even less consideration of the real mischief that these changes are intended to address. Speak to practitioners whose work is mostly in the financial services industry, and see what efforts are being made to introduce new products and services or to even keep abreast of other jurisdictions by simply copying and pasting from competitors with successful products and service offerings. The answer is none. This has gone well beyond “enough”. “ Yet another lawyer opined: “It is entirely wrong for legislation to be determined on the basis of making it easier to bring specific prosecutions. Especially with virtually no notice or consultation. I would not be surprised if this was the first of a number of procedural changes to 'shift the goalposts' in favour of the Crown.”

As promised when he officially informed the media about three weeks ago on his decision to resign as Chief Medical Officer and Director for Health Services, Dr. Rufus Ewing has begun to mount a campaign to end direct British rule in the TCI by picketing the entrance to the Office of Disaster Management on Wednesday, where Governor Damian “Ric” Todd and the Advisory held a news briefing. Armed with a number of placards depicting a the litany of grouses often expressed by the TCI people, Dr. Ewing told The SUN that the British Government is not acting in the people’s best interest, but rather for the United Kingdom Government and as a consequence has caused unbearable suffering on the local populace. “Well (this protest action) is for the British to leave our country alone and give our country back, basically, and asking for the resignation of the advisory council, the Consultative Forum and all the institutions of the Interim Administration. “We have been dismantled piece by piece, disenfranchised by this administration, marginalized. And basically, what is happening to us is that we have been invaded. I have spoken to people, like the governors before, Mark Capes (former Head of the Civil Service), all of them, so there is nothing new for them to say to me, about ‘we are doing this, we are doing that’, while you strategically implement your plan. I have looked into the eyes of the infidel and see the evil, and see their plans, and know their plans. No one is going to

convince men otherwise, ” Dr. Ewing said. The protest which started as a one man band later attracted several other people, including former Deputy Premier and Lillian Boyce, minister of the gospel Bishop Dr. Usril Morris and Trevor Cooke, former director of the NIB. Dr. Ewing told the media that the Interim Administration has exercised total disregard for the people of the Turks and Caicos Islands, since the majority of the decisions made was not in the best interest of Turks and Caicos Islanders. “So I am taking a stand and staging this demonstration in front of the Advisory Council and asking for their resignation. Dr. Ewing was quick to point out that there are members on the Advisory Council and the Consultative Forum who are fighting for the country but have so far been stonewalled, and could be driven to the point of frustration. “A few people in those institutions such as the Advisory Council and the Consultative Forum, who have the interest of the people of the Turks and Caicos at heart, we know that. And some of them are inside fighting and hope that the can make a difference, like Sharlene Cartwright, like Courtney Misick and Dr. Linda Williams, to name a few. “They are soldiers; they are trying to make a difference inside. But they also know that they up against
something that is bigger and they are not going to get anything done. Once they realized that, they will step out as well, I am sure,” Dr. Ewing further asserted. Dr. Ewing used the opportunity to rally the people of the TCI into taking a stand with him, saying that if things do not change, he would demonstrate outside of every Advisory Council meeting. He said the Civil Service is being loaded with British citizens who he said are paid huge salaries and housed in penthouses, while locals lose their houses. At the news conference to announce his resignation, Dr. Ewing said there was a great deal of atrocities taking place against TCI people both in the health sector and the public sector as a whole, but based on his position, could not speak public In the meantime, Bishop Morris noted: I have lived in this country all of my life, and every time we tried to put our foot forward to advance for the betterment of ourselves and our fellowman there is always somebody to throw the monkey wrench in the way or putting obstacle in our way to hinder us from progress. “They tried to discourage us by trying to divide us, but we will not detour. We will not accept this. It is time for Turks and Caicos Islanders to stand up and take the fight where it has to be taken.” Governor Damian Roderick ‘Ric’ Todd, while leaving the meeting stopped briefly to chat with Dr. Ewing, who he told that he was rushing to another meeting but could make time for him to air his grouse in the near future.

WITH WARPED VISION, GADHAFI MADDENED LIBYA, WEST
During nearly 42 years in power in Libya, Moammar Gadhafi was one of the world's most eccentric dictators, so mercurial that he was both condemned and courted by the West, while he brutally warped his country with his idiosyncratic vision of autocratic rule until he was finally toppled by his own people. The modern Arab world's longest-ruling figure, Libya's "Brother Leader" displayed striking contrasts. He was a sponsor of terrorism whose regime was blamed for blowing up two passenger jets, who then helped the U.S. in the war on terror. He was an Arab nationalist who mocked Arab rulers. In the crowning paradox, he preached a "revolutionary" utopia of people power but ran a one-man dictatorship that fueled the revolution against him. His death on Thursday at age 69 - confirmed by Prime Minister Mahmoud Jibril - came as Libyan fighters defeated Gadhafi's last holdouts in his hometown of Sirte, the last major site of resistance in the country in an eight-month civil war. Interim government officials said his son, Muatassim, a former national security adviser, was also killed in Sirte on Thursday. Another, Britisheducated Seif al-Islam - widely seen as being groomed as a successor - was captured with a gunshot wound to the leg. The final declaration of victory by Gadhafi's opponents came weeks after he was swept from power by rebels who drove triumphantly into the capital of Tripoli on Aug. 21. "Dance, sing and fight!" Gadhafi had exhorted his followers even as his enemies were on the capital's doorstep before fleeing into Libya's hinterlands where his die-hard backers had continued to battle the rebelsturned-rulers. Gadhafi leaves behind an oil-rich nation of 6.5 million traumatized by a rule that drained it of institutions while the ship of state was directed by the whims of one man and his family. Notorious for his extravagant outfits - ranging from white suits and sunglasses to military uniforms with frilled epaulets to brilliantly colored robes decorated with the map of Africa - he styled himself as a combination Bedouin chief and philosopher king. He reveled in infuriating leaders, whether in the West or the Middle East. U.S. President Ronald Reagan, after the 1986 bombing that killed U.S. servicemen in Berlin was blamed on Libya, branded him a "mad dog." Former Egyptian President Anwar Sadat, who fought a border war with Libya in the 1970s, wrote in his diary that Gadhafi was "mentally sick" and "needs treatment." Behind the flamboyance and showmanship, associates say Gadhafi was meticulous in managing the levers of power. He intervened in decisions large and small and constantly met personally with tribal leaders and military officers whose support he maintained through lucrative posts. The sole constant was his grip on the country. Numerous coup and assassination attempts against him over the years mostly ended with public executions of the plotters, hanged in city squares. The ultimate secret of his longevity lay in the vast oil reserves under his North African desert nation and in his capacity for drastic changes of course when necessary. The most spectacular U-turn came in late 2003. After years of denial, Libya acknowledged responsibility - though in a Gadhafi-esque twist of logic, not guilt - for the 1988 bombing of Pan Am Flight 103 over Lockerbie, Scotland, that killed 270 people. He agreed to pay up to $10 million to relatives of each victim. He also announced that Libya would dismantle its nuclear, chemical and biological weapons programs under international supervision. The rewards came fast. Within months, the U.S. lifted economic sanctions and resumed diplomatic ties. The European Union hosted Gadhafi in Brussels. Secretary of State Condoleezza Rice in 2008 became the highest-ranking U.S. official to visit the country in more than 50 years. Tony Blair, as British prime minister, visited him in Tripoli. International oil companies rushed to invest in Libya's fields. Documents uncovered after Gadhafi's fall revealed close cooperation between his intelligence services and the CIA in pursuing terror suspects after the 9/11 attacks, even before the U.S. lifted its designation of Libya as a sponsor of terror in 2006. Still, Gadhafi's renegade ways did not change. After Swiss police had the temerity to briefly arrest his son Hannibal for allegedly beating up two servants in a Geneva luxury hotel in 2008, Gadhafi's regime arrested

two Swiss nationals and raked Switzerland over the coals, extracting an apology and compensation before finally releasing the men nearly two years later. European countries, eagerly building economic ties with Libya, did little to back up Switzerland in the dispute. But Gadhafi became an instant pariah once more when he began a brutal crackdown on the February uprising in his country that grew out of the Arab Spring of popular revolts across the region. The U.N. authorized a no-fly zone for Libya in March, and NATO launched a campaign of airstrikes against his military forces. "I am a fighter, a revolutionary from tents. ... I will die as a martyr at the end," he proclaimed in one of his last televised speeches during the uprising, pounding the lectern near a sculpture of a golden fist crushing a U.S. warplane. Gadhafi was born in 1942 in the central Libyan desert near Sirte, the son of a Bedouin father who was once jailed for opposing Libya's Italian colonialists. The young Gadhafi seemed to inherit that rebellious nature, being expelled from high school for leading a demonstration, and disciplined while in the army for organizing revolutionary cells. In 1969, as a mere 27-year-old captain, he emerged as leader of a group of officers who overthrew the monarchy of King Idris. A handsome, dashing figure in uniform and sunglasses, Gadhafi took undisputed power and became a symbol of anti-Western defiance in a Third World recently liberated from its European colonial rulers. During the 1970s, Gadhafi proceeded to transform the nation. A U.S. air base was closed. Some 20,000 Italians were expelled in retaliation for the 1911-41 occupation. Businesses were nationalized. In 1975 he published the "Green Book," his political manifesto that laid out what he called the "Third International Theory" of government and society. He declared Libya to be a "Jamahiriya" - an Arabic neologism he created meaning roughly "republic of the masses." Everyone rules, it declared, calling representative democracy a form of tyranny, and Libyans were organized into "people's committees" that went all the way up to a "People's Congress," a sort of parliament. In the end, rule by all meant rule by none except Gadhafi, who elevated himself to colonel and declared himself "Brother Leader." "He aspired to create an ideal state," said North African analyst Saad Djebbar of Cambridge University. "He ended up without any components of a normal state. The 'people's power' was the most useless system in the world." In the 1970s and 1980s, Gadhafi supported groups deemed by the West to be terrorists - from the Irish Republican Army through various radical Palestinian units to militant groups in the Philippines. He embarked on a series of military adventures in Africa, invading Chad in 1980-89, and supplying arms, training and finance to rebels in Liberia, Uganda and Burkina Faso. A 1984 incident at the Libyan Embassy in London entrenched his regime's image as a lawless one. A gunman inside the embassy opened fire on a demonstration by Gadhafi opponents outside, killing a British policewoman. The heat was rising, meanwhile, between the Reagan administration and Gadhafi over terrorism. In 1986, Libya was found responsible for a bombing at a Berlin discotheque frequented by U.S. troops in which three people died. America struck back by sending warplanes to bomb Libya. About 40 Libyans died. The Lockerbie bombing followed in 1988, followed a year later by a bombing that downed a French airliner over the West African nation of Niger. The West was outraged, and years of sanctions followed. Libya's road back from pariah status began in 1999, when Gadhafi's government handed over two Libyans for trial in the Lockerbie bombing. In 2001, a Scottish court convicted one, an intelligence agent, and sentenced him to life imprisonment. The other was acquitted. In 2002, Gadhafi looked back on his actions and told a crowd of Libyans in the southern city of Sabha: "In the old days, they called us a rogue state. They were right in accusing us of that. In the old days, we had a revolutionary behavior." Throughout his rule, he was a showman who would stop at nothing to make his point. His appearances at Arab League summits were an annual cause of cringing among fellow Arab rulers.

At one, he argued vehemently with Saudi Arabia's King Abdullah, winning the monarch's eternal hatred. At another, Gadhafi smoked cigars on the conference hall floor during speeches to show his contempt. In a 2009 address at the United Nations, he rambled on about jet lag, then tore up a copy of the U.N. charter, saying the Security Council "should be called the terrorism council." On state trips, he would insist on setting up a tent to stay in. He sported a personal escort of female guards - which he once explained by saying: "There are no men in the Arab world." A 2009 U.S. diplomatic cable released by the website WikiLeaks spoke of Gadhafi's intense dislike of staying on upper floors of buildings, aversion to flying over water, and taste for horse racing and flamenco dancing. "At night, Moammar dreams; by day, he implements," Libyans would say, referring to the bizarre rules Gadhafi would randomly impose on the country, like demanding all storefront doors be painted green, the signature color of his regime. Or like complaining that Libyans were going abroad for medical treatment and deciding it was because of a lack of Libyan doctors - so he ordered Tripoli's main medical school to take 2,000 new students regardless of qualifications, well beyond its 150-student capacity. He even renamed the months, calling the cold month of January "Ayn al-Nar," Arabic for "Where is the Fire." In the past decade, power was increasingly concentrated with his eight biological children, who snapped up elite military posts or lucrative business positions. They all fled into hiding when Tripoli fell. Son Seif al-Islam at one time seemed to be a Western-leaning reformer but threw in his lot with his father after the uprising began. Muatassim, who was killed Thursday, led a military unit in a crackdown on protesters. Two other sons, Saif al-Arab, was killed earlier during the uprising, and another, Khamis, was believed killed. His only daughter, Aisha, who became a lawyer and helped in the defense of Saddam Hussein, Iraq's toppled dictator, in the trial that led to his hanging. Gadhafi's wife Safiya, fled to neighboring Algeria or Niger. Gadhafi did spend oil revenue on building schools, hospitals, irrigation and housing on a scale his Mediterranean nation had never seen. "He did really bring Libya from being one of the most backward and poorest countries in Africa to becoming an oil-rich state with an elaborate infrastructure and with reasonable access by the Libyan population to the essential services they required," said George Joffe of Cambridge University. Still, about a third of Libya's people remain in poverty. Gadhafi showered benefits on parts of the country, such as Tripoli. Meanwhile, eastern Libya, ultimately the source of February's rebellion, was allowed to atrophy.

Maranatha wins National Disaster Quiz Competition

MARANATHA HIGH SCHOOL has etched its name in local history by becoming the inaugural winner of the Department of Disaster Management-staged National Disaster Quiz Competition on Tuesday, October 18 at the Feliz Morley Community Centre in Five Cays, Providenciales. Maranatha, represented by Jewel Ewing, topped Marjorie Basden, represented by Shamaad Lewis into second place, Clement Howell, represented by Ashleigh Brown into third place and Raymond Gardiner, represented by Glandesha Cox into fourth position. The quiz competition took the form of the popular American game show – Jeopardy – which features trivia in history, literature, the arts, pop culture, science, sports, geography, wordplay, and more. This contest, however, was based on disasters and disaster management. The game has a unique answer-and-question format in which contestants are presented with clues in the form of answers, and must phrase their responses in question form. The categories over the three stanzas were hurricanes, floods, tsunami and volcano, TCI hazards, world events, do’s don’ts, and fact and fiction. At the end of the rounds and a series of wagering, Maranatha ended atop the points table with 1500 points, with Marjorie Basden in a distant second with 699 points. Clement Howell’s score was
minus 250, while Raymond Gardiner ended with minus 1800 points. Director for the Department of Disaster Management, Jamel Robinson, was impressed with the level of participation from the schools, saying that the students maneuvered a series of tough questions and came out shining. “I think it is a good booking to a successful International Disaster Day, and it is definitely exciting being a part of this particular event because some of the questions were tough for me even as the Disaster Manager, who knows these things, so I know it, is that much more difficult for the students. “We had a good turnout with the various schools being represented here in the Felix Morley Community Centre, and the students represented their schools very, very well. So I am proud of them, and I definitely think this will be an annual event. “We look to get more schools next time, we have a little bit more lead team, so we can organize our financing a little bit better in such a way the we can be fully funded so we can have it aired on RTC and WIV, so that persons who are unable to witness it will be able to listen via radio or watch it on television,” Robinson said. According to police media relations officer Inspector Calvin Chase, Gibson appeared in the Providenciales Magistrate’s Court on Tuesday 18th October 2011 where he was remanded in custody until 7th December 2011 for a Sufficiency Hearing in the Grand Turk Supreme Court. On Wednesday 19th October 2011 he appeared in the Supreme Court in Providenciales for a Bail hearing which was denied.

GOVERNMENT IS AWAITING a consultation document from someone who has been described as ‘a serious investor’ interested in the unfinished West Caicos resort project, which it said should aimed at highlighting the benefits for the economy and the people of the TCI. Governor Damian Roderick ‘Ric’ Todd, who made the disclosure at a post Advisory Council press briefing at the office of the Department of Disaster Management and Emergency on Providenciales Wednesday, October 19, said also that a package to encourage the development is also being worked on. “There is a proposal by a serious investor to take over and complete the West Caicos development, and what I have decided is that, there will be two things will happen. First, the developer will produce a consultation document setting out what it is they plan to do on the island and the benefits they feel will come to the people and the economy of these islands. And that will then be discussed among everyone. “Second, we are negotiating with the developer a suitable package which will encourage that development to take place, subject to the consultation being favourable and subject to us agreeing the right terms and conditions, I would like to see that development go forward,” Governor Todd said. Prior to its sudden halt the project underwent a series problems, as the law-enforcement authorities had to be called there on at least two occasions to maintain the peace following disagreements between contractors, regular workers and management of the project. The first occasion involved local contractors and local skilled men, who said they were being sidelined in favour of imported Chinese workers, who took the job for far less salary that what the locals would bargain for. The second disturbance involved the Chinese workers, who were alleged to have held their bosses captive on the island for approximately two days, for non-payment of salaries, and said to have only released them at the intervention of the authorities. But the situation was downplayed by at least one side of the disagreeing parties, saying that there was no hostage situation on the job site. Ironically, the Chinese workers were brought in by local subcontractors, who ostensibly believed that by employing the Chinese workers, they would save a few more dollars as against employing their own.

PRC backlog could be cleared by Christmas

THE GOVERNMENT IS attempting to clear the huge backlog of Permanent Residency Certificate (PRC) applications by Christmas, in order to stream line that process for the future, according to a government source. However, the source said that such a time frame may be difficult to attain given the huge workload that needs to be cleared, while pointing out that three individuals from the United Kingdom are in the Turks and Caicos Islands to assist with the process of clearing PRC backlog. Their tour of duty, according to the source, is totally funded by the UK Government. The SUN also understands that the number of applications originally posted has been revised to a lesser figure, since it has been discovered that a number of persons had applied in some cases up to three times. This, according to the source, may have to do with persons being informed that their applications were lost and asked to reapply.
“We have cleared some, but we have started to put all the files together. We have taken them out of the boxes and the filing cabinets, and we have started to find double and triple. So, we will begin to merge these files into one. We have brought in three additional case workers from the UK, paid for fully by the UK Government, to work to bolster and up putting a new filing and management system in, and a protocol checking system” the source said. Some PRC applications, The SUN understands, have been cleared recently and there are about 1,000 still in the system waiting to be processed. During the post Advisory Council news briefing on Wednesday, October 19, His Excellency Governor Damian Roderick ‘Ric’ Todd, pointed out that Clara Gardiner, Permanent Secretary for Border Control and Labour, made a presentation regarding the path to citizenship. He said further discussions on that front will be ongoing until a clear path has been defined. The Government, it is understood is now looking into dividing the PRC applications into two categories – complete and incomplete. Having

GOVERNOR DAMIAN RODERICK (Ric) Todd is assuring the Civil Service and the public at large that the Interim Government’s decision to cut current Permanent Secretary positions and open remaining slots to competition is not based on performance dissatisfaction of the current crop. Governor Todd made the disclosure while addressing a post Advisory Council Meeting news conference at the Disaster Management and Emergency office on Providenciales on Wednesday (October 12). “I said to the 10 permanent secretaries that I much appreciate what they have done. Many of them being public service for many years, some of them continuing to serve after retirement age, and I much value and appreciate that. What I am saying is that, this country needs to have five better equipped ministries rather than a large number of weaker ones. And that the way forward is to have five ministries, each led by a permanent secretary. “In saying that, I am not saying anything disrespectful or critical of those permanent secretaries who will not win the competition. This is terribly important, we all know that

public sector in the TCI will have to get smaller over two year. Everyone knows that the public sector is bigger than what these islands can afford,” Governor Todd said.
Governor Todd told reporters that the Interim Administration intends to appoint the five new permanent secretaries before the end of the calendar year. He also plans to be a member of the interviewing team. He said applications will be taken from TCI citizens living inside the country, those living beyond it borders as well as from British Overseas Territories’ citizens. “Applications will be taken from TCI Citizens living either on the islands or living outside the islands and from British Overseas Territory citizens,” Governor Todd pointed out. He said that contrary to rumours, he has no plans of inserting retired British citizens in the TCI civil service at the expense of qualified locals. “That is not true; it is going to be a clear and open process. It is open to serving civil servants, obviously. It also opens to people who are not civil servants but feel they have the skills to offer and want to serve the TCI as permanent Secretary. We feel that we need to broaden the pool a little wider but equally allowing someone to apply

At least one female resident is warning others against being scammed out of their money by a Florida-based furniture retailer, to whom she claimed several locals have fallen prey. The woman, who asked not to publish her name, said in April she paid a home furniture store, which she said had taken out adverts in local papers, $3,150 for a bedroom set. She also paid freight and other relevant expenses for the furniture to be delivered here in the TCI. But after days passed and the goods were not delivered, she contacted the owner, who promised to send the merchandise but never did. “I personally paid for my furniture in cash. The transaction took place on the Friday, April 15 and I was scheduled to get my furniture on Monday, April 18. But until now have not received them,” she said. The woman said after several calls

to the dealer, who, each time, blamed the delay on the manufacturers, she visited the Florida store in August for a refund, only to find that the business has been closed down, and no reference of relocation. “I told him that if he could not sent the furniture I would come to collect my refund. When I went down in August to collect my refunds, the door was closed and the business was closed down. When I went back in September the door was still closed, and when I asked the persons next door what was going on, they said the door had been closed for a closed for a couple months now. “And when I visited the management company, they said he hasn’t been paying rent. So, I went to the police station and they came to the store, and that was when I filed a case in the court against him after reporting him to the Better Business Bureau,” she said. The disgruntled woman said also
that she contacted the furniture manufacturers regarding their association with the home furniture store and was told that they suspended supplies to him because he was behind in his payment and also that a cheque he presented was not honoured by the bank. The woman said now all communications to the dealer, including phone, email and website have all been unresponsive. She said other persons she knew also fell victim to the furniture dealer,
as they complained that they purchased furniture from the establishment but either got pieces of what was ordered or none at all. “Luckily for me, I only purchased a bedroom set, but other persons purchased, bedroom, living room and dining room sets, and up to this day they did not get any of what they paid for. I paid $3,150 for my furniture but I know other persons who paid from $2,000 to $5,000 plus,” she said. Efforts to contact the furniture store were unsuccessful.

BCB HOLDINGS LIMITED announced on October 19th that the Board is proposing to BCB Holdings Shareholders that the Company be reorganised by demerging its NonBelizean Businesses into a new holding company, Waterloo Investment Holdings Limited, which has recently been incorporated in British Virgin Islands to become the new holding company for the NonBelizean Businesses. It is intended that the Demerger will be effected by way of the declaration and payment by BCB Holdings of a dividend in kind to Qualifying BCB Holdings Shareholders, followed by a capital reduction and repayment to those Qualifying BCB Holdings Shareholders satisfied by the transfer of the Non-Belizean Businesses and the New Loan Note to WIHL, in consideration for the issue of shares by WIHL to the Qualifying BCB Holdings Shareholders and the assumption by WIHL of the obligations of BCB Holdings under the Assumed Loan Notes by way of the issue of the WIHL Debentures to the Assumed Loan Noteholders. The Company will be dispatching a circular to BCB Shareholders today containing further details of the Demerger. The Demerger will result in BCB Holdings Shareholders holding shares in two distinct entities, which will be the holding companies of two distinct groups with separate strategic, capital and economic characteristics and management teams: BCB Holdings, whose shares will continue to be admitted to trading on AIM, the Trinidad and Tobago Stock Exchange and the Bermuda Stock Exchange, will remain the owner of the largest banking operation in Belize, through Belize Bank, as well as international operations through BCB International. WIHL, whose shares are intended to be traded by JP Jenkins, will become the holding company for the Non-Belizean Businesses which have large exposure to the Turks and Caicos Islands through British Caribbean Bank. WIHL will also hold the interests in Associates. The Demerger will constitute a fundamental change of business of the Company which, under Rule 15 of the AIM Rules, requires approval of BCB Holdings Shareholders. In accordance with the AIM Rules, the Company is required to send a circular to BCB Holdings Shareholders setting out the reasons for, and principal terms

of, the Demerger and to seek BCB Holdings Shareholder approval for the Demerger. If the Resolution is passed, the Directors expect that, subject to the Directors considering at the Second BCB Holdings Board Meeting that the Demerger is in the best interests of the Company, the Demerger will become effective on 26 October 2011. The BCB Holdings Board believes that the BCB Holdings Group currently consists of two geographically separated financial services businesses which, due to recent economic developments, have become diverse from each other and which possess very different economic drivers. Belize Bank and BCB International (which together form the principal assets of the Retained BCB Holdings Businesses) provide a comprehensive range of banking services to both retailing and commercial customers. In contrast, the business of the British Caribbean Bank group (which forms part of the NonBelizean Businesses subject to the Demerger) focuses on the provision of lending and as such its assets are principally comprised of loans, which were in part funded by the BCB Holdings Loan Notes. These loans have a high concentration in asset backed lending to the tourism and property development sectors, which were in part funded by the BCB Holdings Loan Notes. The BCB Holdings Board believes that, given the differences in both strategy and funding structure between these two financial services businesses, the BCB Holdings Group and, therefore its shareholders, would benefit from separation of these financial services businesses, which will assist each financial services business to focus on its individual strategic direction and realise its future growth potential. More specifically, the performance of the Retained BCB Holdings Businesses will continue to be closely linked to the general economic performance of Belize which has a diverse and increasingly indigenous economy with increased banking regulation and political influence in domestic business policy, whilst the performance of the NonBelizean Financial Services Businesses will be more closely tied to the general economic performance of the Turks & Caicos Islands which are almost exclusively dependent on the tourism industry and related service sectors. In addition, BCB Holdings Group holds an aggregate interest of approximately 25 per cent in
Associates which own a successful edible oil and related products business based in Costa Rica with operations in Central America. The business and performance of Associates (the shareholding in which is to be owned by the Non-Belizean Businesses) is closely tied to world demand for palm oil and the world markets for edible oil bi-products. It is becoming clearer every day that the imposition of the interim Administration is intended to be a permanent feature in the lives of Turks and Caicos Islanders! Let us look at some of the recent actions by this government. First of all they brought in John Llewellyn to be the Crown Land Advisor. This man was unemployed at the time that work in the TCI was given him! His credentials are questionable. In any event, he took charge of without legal authority, the Ministry of Natural Resources. Instead of being an advisor, he became the person dictating policy and procedures. The PS seemed to have been absent or just went with the flow and allowed her authority to be usurped by this invader! Now look at the outcome of the Crown Land Policy that this man produced! It is so antiquated and full of flaws that it is too incredulous to believe! In order for a Turks and Caicos Islander to get a piece of Crown Land, he/she has to subject himself/herself to an auction, the outcome of which is not certain! That certainly is patently unfair to the bulk of Turks and Caicos Islanders because there is no certainty in the process and could be more subjected to manipulation. But the most egregious aspect of this new policy is the lodging of the authority to dispose of our land into the hands of an itinerant expatriate person with no direct connection to us. Is it because the Attorney General is foreign that he has more integrity than the collective wisdom of all of our elected officials? These persons have to gain the trust of the people for a specified period, and if they don’t adhere, then they are fired at the next elections! It is worth noting here that Terry Dunnigan, a former Attorney General was called before a Commission of Inquiry to answer for misdeeds in the transaction of Crown Land while he was Attorney General! What guarantee is there that the next one coming down the pike would not do the same and then leave! At least we can find our locally elected office holder, if not today, then certainly tomorrow! It is still government’s policy and under the Pensions Ordinance that Civil Servants must retire at age 55! While this number should be increased because persons are living productive

ROYAL ROBINSON CONTRIBUTER lives beyond that time, it does not make sense to send Turks and Caicos Islanders home at that age, but bring in from the UK persons who are far past that age and find work for them that they could not find at home! It is not that we are not in need of some technical assistance to progress us to the next level, but these persons that are coming off the “dole” to dictate to us do not add value to our system, but are only here to change the landscape of Turks and Caicos Islands and install persons “that know not Joseph”! Colin Hartwell, though well intentioned, is just a “fuddy-duddy” cousin of the UK. Not in my wildest dreams did I envisioned that an expatriate taking control of our National Security system (NIB). This is in the face of the fact that from its inception, a Turks and Caicos Islander was at the helm of that institution! That cannot be right in any sense of the word. Every institution in this country that has been built up with the blood sweat and tears as well as the insightfulness of our political directorate is now under attack by the infidel invaders! Those they cannot for whatever reason, destroy, they are performing a hostile take-over! By whatever means, we are being denied access to these institutions. Prize down in Blue Hills can see that by requiring all Permanent Secretaries to now apply for jobs from which they are required to resign from,

and by opening up the process to all and sundry, this is another means of installing persons who are loyal to the British occupiers to the detriment of our indigenous people! These people really and literally want to have a greater presence in our country to the extent that if you want to go to the toilet you would have to ask permission of one of them. Now if they were here to make a change for the betterment of our people that you would be able to take their occupation with a grain of salt! However, to date, they have not produced a value added to the process. There is no new job opportunity in the private sector that has come at the specific intervention on their part. I really thought that after the Junkanoo incident of 1975 and the Small Commission and the intervening years to the early 1980’s, we had gotten rid of the English from every position of prominence, save for that of Governor from our country! Now that they have really seen the potential that we have built up over the years without any help from them, they find that it is too good for us to have our hands on the tiller any more, but must return to the days of yester years when we were relegated to the position of “hewers of wood and drawers of water”. They have suspended our automatic right to a trial by jury, to as they say bring some semblance of transparency to the judicial system. But what they are really doing is to forceripe green sapodilla! That fact is being given further clarity by the abandonment of the previous jurisprudence with respect to the exception to the “hear say” rule in criminal proceedings. These are things being done to the process of justice in this country to ensure an outcome that has been contrived and not as a result of evidence produced that would convict someone beyond a reasonable doubt! This cannot be right for the civil liberties, fundamental and human rights of our people. In all of this, the Human Rights Commissioner seems to absent without leave. Is she too compromised by her position on the Advisory Council to see the ugliness that is rearing its head in our country to the detriment to our human rights? Or is it that she has come to the conclusion that human rights should be meted out to illegal
immigrants that invade our shores, but not Turks and Caicos Islanders? Our meager Pensions benefits are now under direct attack by these imposters to justice, fair play and transparency. Maybe not so much now, but the bulk of us that joined the civil service, particularly in 1950’s, 60’s and 70’s did so, one out of loyalty to this country and two because of the prospect of receiving a gratuity on retirement, and a pension from the government until we died and if we left behind a widow or widower until that person dies. Now having fulfilled our part of the contract, these usurpers are coming in to say that small “pendetty” should be taken away from us! I have written to Mark Capes about this matter before. These guys seem hell-bent on pursuing this asinine policy. All of a sudden they are trying to pass Legislation and approve policies that are retroactive! Nowhere in history has something like this obtained. These people are pressing the wrong buttons! They are taking our passiveness for granted. One fine day they are going to wake up to the other side of midnight and they would have brought it on themselves! Think about, I do not admire some aspects of Robert Mugabe, the leader of Zimbabwe, but I can fully understand why they had to dispossess the English and their minions from their land that had been captured by these types! People of the Turks and Caicos Islands, these acts of terrorism are not being designed to be administered to people who align themselves with the PNP Party. This is an attack on all of us that make this country our home! The English are reverting to what they know best! To pillage and plunder a country for their benefit! Just an easy example! Mummies are an Egyptian thing. But a lot of them are housed in UK museums and they are calling them theirs! That is the same attitude that they have brought to the Turks and Caicos Islands. The Turks and Caicos Islands National Insurance Board hereby informs the General Public of the following amendments to various sections of the National Insurance Benefits and Contributions Regulations 1992 which will take effect January 1, 2012 INCREASE IN PAYMENT OF PENSIONS AWARDED PRIOR TO JULY 2007 All persons awarded a pension prior to July 31, 2007 will be granted an 8% increase. As a result of this increase, minimum pension will also increase from $310.50 to $335.00. Some 73% of our pensioners across the Turks & Caicos Islands will benefit from this increase.

This requirement will now be relaxed to allow for the eight (8) weeks of contribution to be considered either in the first 13 weeks or last 13 weeks of the qualifying period. The relaxed contribution requirements will result in an increase in the number of persons being eligible for these benefits.\ Extension of Employment Injury Benefit Coverage to Temporary Residents The Ordinance makes provisions for contributors working and remaining in the islands for a period of six months or less to pay on a lower contribution rate of 2.5% as Temporary Residents. This group of contributors will now be entitled to Employment Injury Benefit.

The Department of Disaster Management wrapped up its weeklong of activities to mark International Day of Disaster Reduction, which was observed on Thursday, October 14. The list of activities culminated with the staging of a quiz competition among high schools. The event was held at the Felix Morley Community Centre in Five Cays on Tuesday, October 18. Tardy Lindsay Lohan turned away on first day of community service
Lindsay Lohan was turned away from the Los Angeles County Morgue on Thursday after she arrived over 20 minutes late to begin her first day of community service there. Lohan insists her tardiness was down to an honest mistake and she has thanked Coroner’s office staff for helping to make sure she isn’t late again on Friday. In a post on Twitter, the actress writes, “I’m sorry for the confusion that I may of caused (sic) to those at the Coroner’s office. Won’t happen again, now I know where to go! Thank
you for your help.” The actress was ordered to serve time at the County Morgue on Wednesday after a Los Angeles judge frowned on her attempts to complete 360 hours at the city’s Downtown Women’s Center – community service she was handed earlier this year as part of her probation following a shoplifting conviction. It emerged last week that bosses at the center had terminated Lohan’s arrangement because she had only completed a fraction of her required shifts.
The star’s probation was ultimately revoked during a progress report hearing on Wednesday, and Judge Stephanie Sautner ordered Lohan to complete 16 hours at the Los Angeles County Morgue before her next court date on November 2. She was led out of the courtroom in handcuffs but posted $100,000 bail and walked free less than an hour later. The actress was expected to begin her first day of community service at the County Morgue at 8 a.m. local time on Thursday and her assistant called ahead to alert staff members the
star was on her way, but she arrived late and was turned away at the door. Lohan’s publicist has since released a statement, insisting the star’s tardiness was based on “a combination of not knowing what entrance to go through and confusion caused by the media waiting for her arrival”. KINGSTON, Jamaica -It is now official - Education Minister Andrew Holness will become Jamaica’s ninth and youngest Prime Minister. The 39-year-old will be sworn in at King’s House at 4 p.m Sunday, shortly after Bruce Golding, the current holder of the office, tenders his resignation to Governor General Sir Patrick Allen. The head of government presided over his final Cabinet meeting Tuesday thanking ministers for their support and hard work. "He noted that the Government had overcome significant challenges over the last four years but emphasised that much remains to be done to accelerate the pace of economic recovery in order to be able to tackle the country's urgent social needs," a press release stated. Golding also noted that while some elements of the government's reform agenda had been completed, other important items are yet to be implemented. Following the Cabinet meeting, Golding, 63, met with government parliamentarians who unanimously endorsed the education minister as his successor. Holness became the youngest person appointed to the Golding-led Cabinet in 2007, when he was named education minister. This occurred ten years after he was elected parliamentary representative for the West Central St. Andrew constituency, a position he has held for three consecutive terms. Former Prime Minister Edward Seaga, widely regarded as Holness’ mentor, has endorsed the MP as an ideal candidate for the top position stating he is capable of making the correct decisions. Seaga said the immediate focus of the new prime minister should be the International Monetary Fund (IMF), which Jamaica has a 27-month standby arrangement with; the economy; education and agriculture.

“The economy really comes first; until you fix that, you’re really not going anywhere,” he noted. “I think he had that as part of the training he had at the University of the West Indies (UWI) from which he graduated. But if he hadn’t, he would have learnt enough in the past four years in which the JLP has been in power, because of the amount of discussions that would have taken place on the economy, to have a full grasp of it,” Seaga said further. Golding acknowledged earlier this month that questions about the role he played in the extradition "have remained a source of concern in the minds of many people". "It was never about Coke's guilt or innocence. It was about a breach of our constitution, and had it been a person other than Coke it perhaps would never have become the cause célèbre that it turned out to be," Golding said in a national address on Oct. 2. Four years ago, he led the Jamaica Labour Party (JLP) to victory over the incumbent People's National Party (PNP) headed by the island's first and to date only woman prime minister, Portia Simpson Miller. The JLP has since turned to Education Minister Holness, a protégé of former prime minister Edward Seaga, to guide it into the future as the next PM. But as the fallout from the Coke saga continues, the U.S.-based Time magazine noted last week that Jamaican officialdom's links to organised crime date back to the cold war politics of the 1970s, when both the JLP and the PNP "often employed armed thugs. By the 1990s, those gangs had morphed into drugtrafficking organisations." More than 70 people were killed in the massive police operation to arrest Coke, which led to a state of emergency being declared in the capital, Kingston. society in 21st-century Jamaica was determined to make life uncomfortable for politicians "who appear to ally themselves with unsavoury characters". "Things just could be getting better," he said after Golding's announcement to quit government. Golding had been steadfast in his conviction that Washington's extradition request was based on information obtained illegally. As he told Jamaicans on the eve of his departure, "We have since amended the Interception of Communications Act to permit in the future the action that was taken in Coke's case but which, at that time, was in violation of our Constitution." "However, the entire episode has affected me deeply and the perceptions that are held by some people have not been dispelled, notwithstanding the exhaustive deliberations of a commission of enquiry," he added. Apart from Golding, the Coke saga also led to the removal of attorney general and justice minister Dorothy Lightbourne, in a cabinet reshuffle that Golding announced in June. Public pressure had been mounting on Golding to quit after it emerged that he had played a pivotal role in the hiring of the U.S.-based law firm Manatt, Phelps & Phillips to lobby Washington on the extradition request. But even as he survived that onslaught, it was obvious that within his own party, it was felt his presence at the head of government would hurt the JLP's chances in the 2012 general election. Veteran Jamaican writer Ken Chaplin wrote that the main reason for Golding's resignation was that he had lost the confidence of key members of the party's inner circle. "There was a great deal of internal backbiting and criticism of Golding when he removed Dorothy Lightbourne as minister of justice and

attorney general...certain elements in the party were angry with how Golding 'dumped' Lightbourne and left her out in the cold. "Out of the contention emerged a small gang of conspirators who pledged to get rid of Golding," he added. During his stewardship, Golding began to implement various stringent policies under a 27-month "stand-by agreement" with the International Monetary Fund under which Jamaica can draw down 1.3 billion dollars from the IMF if the country meets quarterly targets along the way. The local economy grew by 2.1 percent in the second quarter of the year above the government's projection of 1.5 percent, which Golding claimed is evidence that the process of economic recovery is continuing – although Jamaica's unemployment rate of 11.8 percent remains the second-highest in the region. It also has the fourth-highest poverty rate, with 43.1 percent of the population earning less than 2.50 dollars a day. "There are several things that have been done and there are a lot of things that Bruce Golding would have wanted to come to fruition, and if he has any disappointment it would be that he wasn't able to do those. But he is very strong on the fact that they will be implemented despite him not being there," Information Minister Daryl Vaz told a post Cabinet news conference on Wednesday.

DALLAS, United States - District Judge David Godbey said he is concerned that court-appointed receiver Ralph Janvey is duplicating efforts of U.S. prosecutors in tracking overseas assets of accused Ponzi schemer Allen Stanford and should provide a plan to repay Stanford’s investors. “When the U.S. Justice Department has already checked and there’s no pot of gold, then the receiver can stand down,” Judge Godbey told a hearing Thursday held for dozens of Stanford-related civil cases. “There’s apparently not some trail to a $5 billion secret Swiss bank account that anyone knows about.” He said Janvey should consider paying
defrauded investors from the assets he has recovered so far. “If we leave this just in limbo for another two or three years waiting to see if there’s a bigger pot of money, it may be difficult for people to put together claims,” the judge said. Stanford, 61, is accused to masterminding a US$7 billion Ponzi scheme through his Antiguabased Stanford International Bank, and is scheduled to be tried in January. In the meantime, he is being treated for addiction to anti-anxiety drugs that he developed in prison. Janvey already has about $100 million in cash and has been locked out of access to more than $300 million frozen in bank accounts in Switzerland and
the United Kingdom. This week, the group representing Stanford victims in Latin America wrote to the judge stating that the possibility of them receiving economic relief that could mitigate our loses has all but vanished. In the letter dated October 12, the group said it is concerned about delays in the trial and accused US authorities of conspiring to deny protection to thousands of innocent depositors. “As far as the class actions against third parties, we consider the Receivership’s accomplishments in the recollection of assets for the victims’ distribution fund very frustrating,” stated Jaime R. IMF recommends decisive action to buttress the region’s financial sector

BRIDGETOWN, Barbados - The International Monetary Fund (IMF) has called for Caribbean governments to act decisively to address “persistent” weakness in the financial sector while stressing the need for stronger resolve to reduce high public debt. It said economic recovery remains weak as states continue to struggle to recover from the protracted recession, and warned that a further decline in advanced economies would dampen regional recovery and add pressure to an already heavy public sector burden. “Fiscal consolidation efforts should, to the extent possible, preserve growth and competitiveness by avoiding step cuts in infrastructure
spending,” the IMF’s Regional Economic Outlook launched here Thursday stated. It cited as “troubling”, the fragilities in the region’s financial sector specifically the Eastern Caribbean Currency Union, where, in July, the Eastern Caribbean Central Bank intervened in the operations of ABI Bank because of liquidity problems. Reference was also made to the issues involving the failed CLICO and British American Insurance Companies that have still not been resolved. “In the Eastern Caribbean Currency Union, ECCU, financial sector health indicators have continued to deteriorate, highlighting

the importance of steps to further strengthen the sector,” the report explained. “The authorities need to diagnose the health of the financial system quickly and develop options for strengthening balance sheets, and avoid further compromising public finances.” The IMF said while countries such as Jamaica, Antigua & Barbuda, and St. Kitts and Nevis have moved to reduce their public debt, greater efforts are needed over the medium term as debt levels across the region have climbed by nine per cent of the Gross Domestic Product since the crisis. “A strategy to gradually reduce public wage and pension spending –
not only in central government but also in autonomous agencies – will be necessary to guarantee public debt sustainability, with the added benefit of improving the region’s competitiveness,” it added. According to the report, tourismintensive economies are projected to expand an average of 1 ¼ percent during 2011-2012, almost one percent lower than previously anticipated. However, it said the mineral-rich countries of Guyana and Suriname would benefit from record gold prices. Growth in Haiti, it stated, is expected to fall just over two percent percent from the 8 ½ projected in April due to the slow pace of reconstruction efforts.

The trio said the Antigua-based airline must embrace change to adapt to increased competition in the aviation industry. “Processes of change to minimize costs and to enhance operational efficiencies will be required if the airline is to adapt in today’s dynamic and competitive environment,” a joint statement from the prime ministers stated. “In particular LIATs stakeholders – employees, management, unions, governments and private sector – must seek to develop win-win partnerships in recognition of the vital role which the carrier provides to our region and the fragility of its survival in today’s harsh economic climate” The heads of governments noted LIAT moved close to one million passengers last year, contributing to the region’s economic and social development. They said this provides important linkages for interregional travel as well as for connections to international, particularly trans-Atlantic travel. They saluted the airline’s staff, estimated at more than 900, for building, what they say is, an outstanding Caribbean institution.

And, CEO Brian Challenger said the company has developed a recovery plan, which he hopes would allow it to break even this year, in spite of the challenges. “We’re placing a lot of hope on our cargo to, if not carry us over the hill, at least certainly improve on what was done last year and we are seeing that,” he said in an interview. “Another area where we’re putting a lot of emphasis on – this will not change dramatically the numbers but every bit counts – is our Quikpak product. This is something we have not placed enough attention on over the years and it’s something that we intend to revitalize.” LIAT re-launched a cargo freighter service earlier this year that would allow it to move cargo throughout its network as well as connecting to international freight carriers at Barbados and Antigua. The CEO said management is also hoping negotiations on forming a partnership with Caribbean Airlines (CAL), which stalled last year, could resume soon. “I think there are many areas where there’re still possibilities and I’m using this regional forum to really indicate LIAT’s continuing interest in co-operation with CAL and our desire to see that co-operation formalised in a mutually beneficial way for all concerned,” Challenger said further.

JOHN’S, Antigua - Government has been asked to intervene in plans by American Airlines to send home between 20 and 30 employees, as the US carrier moves to outsource its local operations by month end. General Secretary of Antigua & Barbuda Workers Union (ABWU) David Massiah said the matter was referred to the prime minister and the tourism minister Tuesday, hours after AA notified the union of its decision. “It was more than a big disrespect to the union and the workers in particular because the workers were not aware, and all of a sudden you have people who have worked here 25 years and more with the company and to hear that they don’t have a job as of the 1st of November is more than traumatic in some ways,” he said. The company, Massiah explained, has not yet indicated how many workers will be sent home. Union representatives met with AA employees later in the day to notify them of the situation and decide on their next court of action. Minister of Tourism John Maginley indicated that government has limited options. “I don’t know what steps we can take at this time,” he stated. “I understand that they have already outsourced a number of Caribbean destinations. Apparently, this is part of their cost-cutting exercise.” The planned retrenchment comes as AA prepares to introduce on November 17, four weekly direct flights from John F Kennedy International Airport in New York to Antigua under a revenue guarantee arrangement with the government. Minister Maginley said that deal has not been affected. “Nothing will happen anytime in the near future,” he disclosed basing his argument on recent discussions with AA. “These big corporations, when they file for bankruptcy, there’s a long procedure and we don’t expect it to affect the flights into Antigua,” the minister added. AA has not made an official statement on the matter.

Interim government officials said one of Gadhafi's sons, his former national security adviser Muatassim, was also killed in Sirte and another, onetime heir apparent Seif al-Islam, was wounded and captured. The 69-year-old Gadhafi is the first leader to be killed in the Arab Spring wave of popular uprisings that swept the Middle East, demanding the end of autocratic rulers and the establishment of greater democracy. "We have been waiting for this moment for a long time. Moammar Gadhafi has been killed," Prime Minister Mahmoud Jibril told a news conference in the capital Tripoli. His death decisively ends a regime that had turned Libya into an international pariah and ran the oil-rich nation by the whim and brutality of its notoriously eccentric leader. Libya stands on the cusp of a new era, but its turmoil may not be over. The former rebels who now rule are disorganized and face rebuilding a country virtually without institutions by Gadhafi's design. They have already shown signs of infighting, with divisions between geographical areas and Islamist and more secular ideologies. Libya's new leaders had said they would declare the country's "liberation" after the fall of Sirte. President Obama said Gadhafi's death "marks the end of a long and painful chapter" for Libya. LONDON- Authorities knew that Rupert Murdoch's News of the World tabloid had hacked into the phone of murdered teenager Milly Dowler nine years before the scandal over the practice exploded, an English police chief said Thursday. Surrey Police Chief Constable Mark Rowley acknowledged that his force knew as far back as April 2002 that someone linked to the News of the World had accessed Dowler's voicemail, although he said it wasn't yet clear why no one was prosecuted over the practice. He said an inquiry team "is currently looking into why this was the case," he said in a letter to lawmakers disclosed Thursday. The disclosure that police were aware that the girl's phone had been hacked and took no action may raise new questions about how police have handled the scandal investigation.
Although former journalists say that the practice of hacking into people's phones to score scoops was common across the British tabloid newspaper industry in the early 2000s, the spying didn't come into the public eye until 2006, when the News of the World's royal editor Clive Goodman was arrested for eavesdropping on members of the British royal household. The News of the World long insisted that the practice had been limited to a single rogue journalist - but its explanation unraveled as evidence emerged that the hacking had been systematic across the tabloid. Public anger at the News of the World grew, and the scandal boiled over after the Guardian newspaper revealed that the tabloid had hacked into Dowler's phone at a time when her family still held out hope that the missing 13-year-old might still be alive. The idea that a tabloid would violate the

French spy chief investigated for spying on journalists
Investigators have launched an inquiry targeting Bernard Squarcini, the powerful head of France's domestic intelligence agency, who is facing allegations that he may have illegally spied on journalists. Squarcini, the chief of the Direction Central du Renseignement Intérieur, is alleged to have "obtained the Le Monde reporter's telephone records to uncover a mole feeding the newspaper information about a
political scandal," Kim Willsher of the UK Guardian reported Tuesday. Squarcini apparently wanted to know who in the government was leaking information from a sensitive campaign finance investigation concerning alleged payments to allies of President Nicolas Sarkozy. The French inquiry was looking into allegations that elderly French L'Oreal heiress Liliane Bettencourt may have "given Sarkozy allies wads of cash in
brown envelopes to fund the presidential election campaign," Willsher noted. Stories about the case apparently with internal details from the investigation were published by Le Monde reporter Gérard Davet and some of his colleagues. To that end, Squarcini--a close Sarkozy ally of Corsican descent nicknamed "requin" or "the shark" for his perceived ruthlessness in engaging in the spycraft dark arts--is accused of having "even obtained Davet's GPS locations from his mobile phone records," Willsher reported, while allegedly also keeping tabs on two other Le Monde journalists. Under questioning from a judge Monday, Squarcini reportedly denied engaging in any illegal activities. The powerful spymaster who heads what used to be two rival French intelligence services insisted that his intended target had not been the journalists at all, but rather the government official suspected of leaking information to them-apparently an employee in France's Justice Ministry. The judge's investigation seeks to determine if Squarcini violated French laws on "breaching communications privacy,"
"unlawful data gathering" and "violating the professional secrecy," Willsher wrote. The French president's office has firmly denied past French media allegations that Sarkozy ordered such politicized snooping on reporters. But Squarcini has a reputation in France of being Sarkozy's man who will do what he is told. And in France's rough-and-tumble political system, this sort of of shady executive intrigue is apparently not all that uncommon. (Witness former International Monetary Fund chief Dominique Strauss-Kahn's contentions that the rape allegations he faced from a New York hotel maid--since dropped--may have come about as the result of an elaborate--if as yet unexplained--set-up by his political foes, perhaps seeking to sideline him from France's 2012 presidential race.) The planet's population will reach 7 billion by Oct. 31. That's according to the United Nations Population Fund, which is trying to use that staggering figure as a wake-up call and an opportunity to harness the world's resources -- and not just resources of the food and water kind -- for the greater good. "It's a big number," Omar Gharzeddine, a spokesman for the population fund, told The Times. "We're confident that, while it's a challenge, it's also an opportunity with all of the young people in the world and how we can change." The fact that the milestone figure could be reached on Halloween is coincidence and not commentary, he said. The projection is based on the U.N.'s census data and birth rate information, but experts are already haggling over whether the data are accurate or not. The U.S. Census Bureau reportedly predicts a February

Plan International, an international child advocacy agency, is planning to seize that limelight on Oct. 31, according to Live Science. It will present a 7-billionth-person birth certificate to a baby girl in Uttar Pradesh, India's most populous state, in a bid to draw attention to the problem of sex-selective abortions in that country. Regardless, it seems that everyone can agree that Mother Earth's population continues to grow by leaps and bounds -- and won't slow down anytime soon. That recognition could help shape global policies going forward, even as authorities grapple to understand what the population growth will mean and how the world should respond. No doubt, there are politically charged discussions about family planning and birth control on the horizon, as well as
tough decisions about how to best help areas of the world burdened by poverty and hunger. Here are some U.N. projections to mull over with a handful of candy corn: -- Looking ahead, the U.N. projects that the world population will reach 8 billion by 2025, and 10 billion by 2083. But it cautions that those numbers are mere projections, and could veer dramatically with changes such as access to birth control. -- Average life expectancy is also expected to continue rising, but again that depends on a number of factors. Today, 893 million people are 60 or older. But by the middle of this century that number will nearly triple, to reach 2.4 billion, according to the population fund. LITTLE GIRL SUFFERS FROM A RARE CONDITION THAT MAKES HER EAT ANYTHING
Natalie Hayhurst looks like your average adorable 3year-old. She plays with makeup, loves Justin Bieber, and loves playing with her big brother on their farm outside Terre Haute, Ind. But when it comes to food, she's anything but average. Most kids her age are a little picky. Natalie likes everything – literally. "Well, I first noticed it was a problem … [when] she had actually eaten my vinyl blinds that hang out to cover your sliding door. She took two bites out of them," said Natalie's mother, Colleen Hayhurst. Natalie suffers from a rare condition called Pica that creates a compulsion to eat things that aren't food. "She prefers the wood, paper products, cardboard, sticks," said Colleen. "She'll eat rocks, dirt; she's had a bite out of a Diet Coke can; she's eaten the little magnet out of the shower curtain, plastic bottles, toys." Any parent knows it's hard keeping an eye on a toddler. Try watching one who wants to eat everything in sight. "You can't take your eye off of her, 'cause if you do she knows it, and she'll try to eat something when she knows you're not looking," said Colleen. Colleen fears Natalie could die if she eats the wrong thing. In February Natalie was rushed to the emergency room after eating a light bulb. "She had moved her entertainment center and pulled the light bulb out of the night light while I was doing dishes," Colleen said. "She was in bed; I assumed she was asleep. She had eaten all the glass. I was pretty much hysterical." Doctors performed surgery to help remove the glass. When Colleen took Natalie to the pediatrician for a checkup and explained what was going on, the doctor, Dr. Lily Dela Cruz, knew this was something that went beyond typical toddler behavior. She referred them to a developmental behavioral specialist. Although Pica is more common in young children – more than 10 percent of kids aged 1 to 6 are believed to have some form of the disorder – adults are not immune. One of them is Adele Edwards. She consumes couches like they're candy, knocking down seven of them in the past 21 years. She was profiled on the TLC reality show "My Strange Addiction," in which people eat everything from chalk to household cleaners. One of them, Kesha, craves toilet paper. She's been addicted to eating it since sixth grade.

"A bulky roll with the two-ply? ... I could probably take down half a roll in one day. ... I carry it with me in my purse," she said. Pica is the Latin word for magpie, a bird that will eat anything. Doctors say these unusual cravings can be triggered by a lack of certain nutrients like iron or zinc. Some with Pica crave the texture of some materials in their mouths. In the case of Natalie, who has a healthy appetite for regular food, Pica is thought to be psychological. Pica is a symptom of autism, but Natalie has not been tested for the condition. She does suffer from insomnia and ADHD. As she gets older, she understands more what she is doing is wrong, but she can't seem to help herself. In addition to working with a therapist to curb her cravings, at home Colleen sprays Natalie's tongue with a sour spray that helps satisfy her constant need to put things in her mouth. Natalie also chews on biting sticks. And she has what her family calls her Pica Box full of textured toys that stimulate her senses. Colleen is reaching out to help other mothers and their children in this predicament. "There are nights I have cried myself to sleep, because you feel helpless," Colleen said. "My kids are my world … and I care about helping other people who are in the same boat as me."

CARACAS, Venezuela -- Venezuelan President Hugo Chavez said he is cancer-free because a series of medical exams in Cuba showed no recurrence of the illness following two months of chemotherapy treatments. The 57-year-old leader announced the test results on live television Thursday after returning from Cuba, saying thorough exams found "there are no malignant cells active in this body." "I'm free of illness," Chavez said on state television, wearing military fatigues as he arrived in the southwestern town of La Fria. Crowds of supporters cheered for Chavez as he rode in a caravan to the town of La Grita, where he visited a church that is home to a famed image of Christ, whom Chavez referred to as "the comandante of comandantes." Red-clad supporters filled a square in the town and waved excitedly to the president. Chavez said he was becoming evermore religious Chavez underwent surgery in Cuba in June to remove a cancerous tumor from his pelvic region. He has not revealed where the tumor was located nor the type of cancer with which he was diagnosed. Chavez underwent four rounds of chemotherapy, both in Cuba and in Venezuela, between July and September. He said that from now on he expects to undergo regular medical checks and repeat the exams every four months. WASHINGTON -- The economy appears slightly healthier than many had feared it was a few weeks ago, raising hopes that it can end the year on an upward slope. A raft of data Thursday show layoffs are trending down to a six-month low and factories in the Mid-Atlantic are growing again after contracting for two months. Nevertheless, home sales fell and the housing market is expected weigh on the economy deep into 2012. The outlook for the final six months of the year has improved from August, when many thought the economy was at growing risk of falling back into a recession. Other recent reports showed hiring picked up slightly in September and consumers boosted their spending on retail goods by the most since March. Most economists now expect modest growth for the rest of this year. Still, they caution that it's unlikely to be strong enough to significantly lower the unemployment rate, which has been stuck near 9 percent for more than two years. And a recession in Europe, which many now predict, could slow growth in 2012. Macroeconomic Advisers forecasts the economy will expand at an annual rate of 2.7 percent in the July-September quarter, and 2.6 percent in the final three months of the year. The government issues its first estimate for third-quarter growth on October 27. "A recession now looks a lot less likely, but economic growth is still going to be pretty weak," said Paul Ashworth, an economist at Capital Economics. Reports Thursday were mostly positive: - The average number of people applying for unemployment benefits each week over the past four weeks fell to 403,000, the Labor Department said. That's the lowest level for the four-week average since mid-April. A month ago, it was 422,250. - Manufacturing grew in the Philadelphia region in October after contracting for two straight months, the Federal Reserve Bank of Philadelphia said. The
October reading was the best for the Philly Fed's regional manufacturing index in six months. - The Conference Board index of leading economic indicators rose 0.2 percent in September. It was the fifth consecutive gain for the index, although it was slightly weaker than increases in August and July. The financial markets rose in morning trading after the Philly Fed report was released. They gave up most of their early gains after reports showed Europe is struggling to agree on a plan to address the region's debt crisis. Eurozone crisis efforts in disarray amid divisions
BRUSSELS -- Europe's efforts to solve its escalating debt crisis plunged into disarray Thursday, after Germany and France could not bridge their differences in time for a summit Sunday, forcing them to call a second meeting. Sunday's summit was supposed to deliver a comprehensive plan to finally get a grip on the currency union's debt troubles by detailing new financing for debt-ridden Greece, a plan to make Europe's banks fit to sustain worsening market turbulence and a scheme to make the eurozone bailout fund more powerful. The offices of French President Nicolas Sarkozy and German Chancellor Angela Merkel announced that they needed more time after it became clear that the currency union's two biggest countries could not agree on the main points of the plan. Both governments said that all elements of the eurozone's crisis strategy would be discussed on Sunday "so it can be definitively adopted by the Heads of State and Government at a second meeting Wednesday at the latest."
It also said that the two leaders would meet Saturday evening ahead of the summit in Brussels in the hope of making progress. "The chancellor is confident that in this way good, coordinated measures for the stability of the eurozone can be achieved," Merkel's spokesman Steffan Seibert told journalists in Berlin. The announcement of a second summit is likely to increase concern over the eurozone's ability to stick together and stabilize the common currency. Sunday's summit had already been delayed from earlier in the week to give the leaders more time to agree on the key issues. "The parochialism and procrastination that got us into this mess continues," said Sony Kapoor, managing director of economic think tank ReDefine. "Unless EU leaders pull a rabbit out of their hat now, this will worsen the already deep politico-economic crisis that Europe is facing." European officials said ahead of the announcement that the eurozone remained deeply divided on important parts of its strategy on debtridden Greece, banks and its bailout fund.
Protest against Greek austerity vote turns violent
ATHENS - Clashes between rival groups of protesters broke out in front of the Greek parliament on Thursday, interrupting a rally by tens of thousands against a tough new package of austerity measures due to be approved later in the evening. Police stood by as hundreds of black-clad youths hurled stones and petrol bombs at demonstrators from PAME, a communist-affiliated labor group which has traditionally favored well-organized and peaceful protest rallies. At least six injured could be seen receiving treatment from volunteer first aid workers. ST JOHN’S, Antigua — The West Indies Cricket Board says estranged batsman Chris Gayle will have to apologise if he wants to wear maroon colours again. That was the decision taken by the Board of Directors who met last weekend in St Lucia, and it comes after several unsuccessful attempts to resolve the highly contentious issue. “Having received reports and reviewed correspondence between Chris Gayle and the West Indies Cricket Board and the West Indies Team Management and taking into consideration public statements made by Gayle with regard to the Board and its officers, the Board requires that Gayle withdraws his comments in order to be considered for selection to the West Indies team,” a WICB media statement said yesterday. The Board said it had communicated the decision to Gayle and was currently awaiting his response.

Attempts by CMC Sports to reach West Indies Players’ Association (WIPA) chief executive, Dinanath Ramnarine for comment, were unsuccessful. In the statement, the WICB said it viewed Gayle as an experienced player who “can contribute meaningfully to the performance of the West Indies team” and hoped that he would “comply with the standards and requirements set by the Board”. The Board said it would be happy to comply with a request from the Jamaican Cricket Association to engage the services of facilitator in order to help Gayle meet its requirements. Gayle has not featured in a West Indies side ever since making highly controversial comments about the Board and head coach Ottis Gibson earlier this year, following the World Cup on the Asian subcontinent. LONDON -- Here's the scenario: Take a cramped, crowded, not-veryclean and none-too-modern subway system, add several hundred thousand tourists with the same destination in mind. Do what you can. Hope for the best. Olympic planners are taking steps to keep London's creaking system from overloading during the 2012 Games. In some ways, this may prove harder than building the Olympic Park - with many who use the system daily expecting subterranean gridlock. "It's hard enough today - and it's just a normal day," said Jenny Claydon, 67, from Essex, who paused last week at the cavernous Stratford station, the main transport link near the new park. "I think it's going to be terrible." Less than 10 months to go before the Olympics, focus is shifting from building to delivering the games. With structures nearing completion, people are trying to see how they can eke out more capacity from the rails, roads and skies moving hundreds of thousands of spectators as well as athletes, officials and journalists. The success or failure of the games will hang in part on whether the system can keep up with the increase in demand. If the plans fail, London
will be remembered as the place where no one could get to the park, get to work or get home. No one wants another Atlanta. The 1996 Games provided a cautionary tale of Olympic travel woes - with bus drivers getting lost, athletes arriving moments before their events and overloaded trains that couldn't get residents home. It prompted the International Olympic Committee to lay out demands to make sure it didn't happen again. "Atlanta was an unmitigated transport disaster," rail expert Christian Wolmar said. "All the other Olympics - Beijing and Sydney - have learned their lessons." London set its goals high, aiming to have 100 percent of the spectators arrive by public transport, foot or bike. Day passes for the subway are included in the package for ticket holders. A special train - the "Javelin" - will take spectators directly from central London's St. Pancras station to Stratford. But there is the challenge of having so many tourists on the system, known here as the Tube, at the same time. The Tube can be confusing. Londoners accustomed to it learn the shortcuts - that hidden stairway that impossibly leads down a dark passage

to a platform. But tourists can be utterly perplexed, and often stop in the middle of narrow platforms searching for a sign. During normal times, London struggles with constraints on the Tube, which handles 12 million trips a day. The Olympics is estimated to add 3 million trips on the busiest days. And while the IOC officials have stressed that they are pleased with London's progress to accommodate the incoming masses, it is based on what critics see as overly optimistic goals - such as a drop in use of the Tube by ordinary commuters of about a third and a surge of people working from home. London transport officials stress that they've been planning for this for years, that they often handle large events and that they are accomplished at managing London's daily traffic patterns. Smoothly moving traffic was shown on computer screens everywhere during a tour this week of its hyper efficient control center in south London. Dozens of monitors and computers blipped and flashed - like something out of a movie showing the ops room at the Pentagon. A big board in the room's center shows a map of central London, together with traffic on surveillance cameras.
Transport for London has held seminars and tried to work with individual businesses in the city, whittling them down one company at a time, working with managers in hopes of changing work patterns. But not everyone can work from home. What about sales clerks, cooks or cops? Alicia Ng, 31, who lives in the London borough where the equestrian events will take place, is a health care worker at University College London. Staying at home from July 27 until Aug. 12 isn't an option. The skies will be busy, too. Heathrow, already Europe's busiest airport, is creating a special terminal for Olympic athletes, coaches and sponsor to fly out of Britain after the end of the games. Airport officials say 10,000 athletes and support staff will go through the "Special Games Terminal" in the three days after the closing ceremony to process the exodus. The day after the closing ceremony is set to be the airport's busiest ever. Some Londoners are hopeful that chaos will be avoided. Clare Payn, 35, looked dubious at the notion that all would work smoothly, but tried to look at the bright side."When London gets it right, it does get it right," she said.
Dan Wheldon Indy 500 Winner dies in wreck at 33
Dan Wheldon, who moved to the United States from his native England with hopes of winning the Indianapolis 500 and went on to twice prevail at his sport's most famed race, died Sunday after a massive, fiery wreck at the Las Vegas Indy 300. One of the most well-liked drivers in the paddock, Wheldon was 33. He called the Indy 500 "the biggest sporting event in the world," and his second and final win there came in a most unexpected fashion. Trailing rookie JR Hildebrand with only one turn remaining, Wheldon was resigned to finishing second for the third straight year. Then Hildebrand brushed the wall just seconds away from what seemed like certain victory, giving Wheldon one of the luckiest breaks ever at the Brickyard. He crossed the line in front, making the final lap the only one he led in the entire race. Wheldon started last in the 34-car field and was up to 24th quickly, but still well behind the first wave of cars that got into trouble on the fateful lap. Still, he had no way to avoid the wrecks in front of him. There was no time to brake or steer out of trouble. His car sailed into the fence extending high over the track barrier, and about two hours later, his death was
