OFFICERS FROM UK BORDER AGENCY ON ASSIGNMENT IN TURKS AND CAICOS ISLANDS SHARON TAYLOR, ACTING Permanent Secretary of the Ministry of Border Control and Labour, has announced that the Ministry has recently welcomed the arrival of two officers from the UK Border Agency, who will, along with the existing UK Immigration Adviser, Lorraine Rogerson, support the Ministry in its continuing programme of change and improvement. All three officers are supernumerary, and are fully funded by the UK. Their work is overseen by the Permanent Secretary, Clara Gardiner, and her senior team. Their assignment is part of ongoing support from the UK for a programme of training and capability building in the Ministry. Earlier this year two officers from the UKBA Nationality Department ran a week long workshop on the application of British Nationality law in the TCI; and a UKBA regional officer, based in Kingston, Jamaica, provided training in forgery detection, together with a colleague from Canada. The UK also funded a training mission by the UN High Commission for Refugees (UNHCR) and the International Organisation for Migration (IOM) in February of this year. This capability building programme is also intended to include specific training assignments for individual TCI officers. The Ministry has provided regular updates on its business plan and change programme to the Advisory Council and Consultative Forum, and will continue to provide reports.

THE NAMES OF the business persons who met with Overseas Territories Minister Henry Bellingham when he visited Turks and Caicos Islands in July this year, have been revealed in the House of Lords in London. According to the Lords Hansard, on September 5th, Lord Ashcroft, who is a prominent businessman in the Turks and Caicos Islands, asked Her Majesty's Government who were the "leading Provo business people" referred to in the press release issued by the Governor's office that the Parliamentary Under-Secretary of State, Mr Henry Bellingham, met during his visit to the Turks and Caicos Islands in July. The Minister of State, Foreign and Commonwealth Office (Lord Howell of Guildford) replied: “Twenty-one emails were sent to the constitutional inbox. All commented in detail on aspects of the draft constitution that

were of interest to them. None of these responses indicated either support or opposition to the draft constitution.” Lord Jones also asked Her Majesty's Government what is their planned timetable for introducing a new constitution in the Turks and Caicos Islands. Lord Howell stated: “The Order in Council containing the new draft constitution was made by the Privy Council on 13 July 2011 and was laid before Parliament on 20 July 2011. The new constitution will be brought into force when sufficient progress has been made against the milestones identified in my honourable friend the Parliamentary Under-Secretary of State Henry Bellingham's Written Ministerial Statement of 9 December 2010, Official Report, WS56. This will enable the elections to take place. The new constitution must be in force no later than 30 days before the elections can take place.”

Too many Chinese workers: Is the response racist? By Sir Ronald Sanders

Chinese workers labour round the clock delivering projects on time and within budget unlike workers in many other parts of the world. Yet, where ever the Chinese have undertaken projects, there has been an element of resentment by sections of local populations. Is this resentment a form of racism or xenophobia? Or, is it that the terms of foreign aid have not been explained sufficiently? These are the questions this commentary will explore. But, first, I return to two issues raised in my last commentary entitled: “Let the People Speak”. I said that only 9 of the 14 independent Caribbean Community (CARICOM) countries would be attending a China-Caribbean Economic Forum in Port-of-Spain. The 5 other countries would not attend because they recognise Taiwan as a legitimate state – something that China disputes vigorously. Since the commentary was written, I have learned that the Chinese government extended an invitation to all 14 independent CARICOM countries. This is a grand gesture by China, if only because it would have allowed CARICOM countries to engage China collectively at the Forum. However, it is unlikely that the 5 countries would attend for fear of upsetting Taiwan. In any event, it is difficult to see how China would have pursued any possible economic projects that might have arisen in the 5 Taiwan-linked countries. It is most unlikely that the Chinese government would have blessed projects in countries that insisted on maintaining the Taiwan connection. In opening the door for the Taiwan-5 to attend the Port-of-Spain Economic Forum, China may have been doing nothing more than showcasing the opportunities that switching from Taiwan to China might provide. Nonetheless, it is to China’s credit that it did not exclude the Taiwan-5 from the Forum. In this sense, China treated the countries of CARICOM as the “Community” they claim to be. Hopefully, the Forum will lead to a joint foreign policy approach to China by the 9 CARICOM countries that could result in a negotiated long-term

trade, aid and investment treaty. It would be in the interest of the CARICOM countries to do so collectively. They could bargain with China much more effectively together than each of them now does individually. Of course, this would require an effective regional co-ordination body; something that would have to be set-up for the 9 because, even if the CARICOM Secretariat could overcome its weakness as a co-ordinator for regional projects, the costs could not come out of a budget to which the Taiwan5 contribute. Despite all this, it would be very beneficial if the Chinese-9 in CARICOM would explore with China the possibility of a long-term treaty arrangement for trade, aid and investment that other CARICOM countries could join when and if they wished to do so. The second matter that arises from my last commentary was the observation that nongovernmental organisations (NGOs) in China require a link to a government institution in order to qualify for charitable status without which they could not survive. A senior Chinese official in the Caribbean region told me: “We might hope them not to go furiously against the government, however, we don't expect them to be government-akin or affiliated. That would be too tall an order nowadays, even for China, wouldn't it?”. In the interest of accuracy, I have requested official clarification of whether or not Chinese law mandates that NGOs require a link to a government institution to qualify for charitable status. Turning now to the use of Chinese labour on Chinese projects that are funded by grants or loans, my previous commentary recognised that there is unquestionably more than a little grumbling about the predominant use of Chinese workers in a number of countries in which China is executing projects. A response from a former international public servant of Caribbean origin was as follows: “Why are we grumbling? Foreign aid is strategic not philanthropic. Is Chinese labour on projects any different from the "technical assistance" that comes with USAID, CIDA, DFID, EU and Bretton Woods

The correspondent went on to say that “in 2004 the World Bank admitted that on average US$20 billion or 40 per cent of the global aid budget returned to the donors as 'technical assistance’ provided by their consultants, and Action Aid (UK) calculated that 47 per cent of global aid was "phantom". Recently, in analysing where aid money goes, two scholars on Caribbean affairs, reported that, “consultants have to be imported from the donor countries and this, in turn, can cost as much as 75 per cent of the total cost of the project”. The point is that a significant portion of money used for aid usually goes back to donors. The justification for this is that the recipient gets the benefit of the aid whether it is in the form of a road, a bridge or training while, at the same time, the donor creates jobs or an export opportunity for companies within its own country. Incidentally, this is the argument used by the Prime Minister of Trinidad and Tobago, Kamala Persad-Bissessar when she sought to link aid, from her government to hurricane-affected St Lucia and St Vincent, to the supply of goods and services by Trinidad and Tobago companies. So, the conclusion would seem to be that countries which want gifts from others should not be concerned with the labour (in the form of workers or consultants) that delivers it. Singling out Chinese is not only unfair, it smacks of racism. However, the matter of loans does take on a different complexion. Loans have to be repaid. In this connection, local communities have a right to expect that projects, funded by loans, should provide employment for a significant number of qualified local workers, particularly at times, such as now, of high unemployment. That argument is not racist whoever it applies to; it is sensible in the context of relations between the lender and the borrower, and stability within the borrowing country.


Report explains why TCI Bank collapsed

THE COLLAPSE OF TCI BANK into insolvent liquidation was the ultimate consequence of the imprudent actions of the bank’s Board and senior management over a protracted period. This is according to a report has been drawn up by Munro Sutherland and Gordon Kerr, and discussed and approved by the non-executive directors of the Financial Services Commission (FSC) Board. The report noted that the directors and managers permitted the bank to expand its lending too quickly, exercised poor credit judgments, paid inadequate attention to liquidity management, and failed to act properly to try to safeguard the bank’s position as the emerging economic downturn acted to further undermine credit quality. According to the report, the role of the FSC is not to run banks or generally to direct the actions of their Boards and management. “It (FSC) is to monitor the risks being taken by banks and to try to prevent imprudence that threatens the interests of depositors. The evidence shows that the FSC acted in good faith in seeking to supervise the bank effectively and, over a protracted period, in pursuing ongoing and active efforts to restore the bank to prudent and compliant operation. It identified correctly the remedial action that was critically necessary if the bank was to be restored to health; and the bank failed to implement the remedial action that was necessary; with the benefit of full hindsight, it is clear that the FSC should have acted sooner and more forcefully in its efforts to compel the bank to adopt more prudent behaviour. Even if the FSC

had been more successful in that regard, however, it is by no means certain that the final outcome for TCIB would have been different, given the seriousness of the bank’s problems,” the report added. With regard to the FSC’s decision to initiate Court action for a liquidation, Sutherland and Kerr noted that is clear that the step was taken only after extensive opportunities had been offered over many months for alternative solutions to be explored. “Moreover, the step was taken only once the FSC became convinced that TCIB faced a fatal loss of confidence on the part of its depositors and that action was necessary to prevent an imminent and disorderly failure of the bank. Mr Justice (Richard) Williams agreed in his ex tempore ruling on the FSC’s petition that for the bank to be allowed to collapse in an “ unstructured

ROAD TRAFFIC OFFICERS UNDER INVESTIGATION

THE SUN CAN report that Deputy Director of the Road Traffic Department Lionel Barranco and at least one other officer have been placed on suspension pending an investigation by the Ministry of Home affairs and Public Safety regarding irregularities in that department. The Ministry confirmed the men’s suspension to this newspaper through the Government Information Services earlier this week. Sources said both have been placed on suspension recently after reports surfaced that there could be some level of irregularities within the department. An officer, who did not want to go in record, said the men’s suspension was not a suggestion that they are considered culprits of any foul activities, but declared that the ministry deemed it necessary to place them on suspension that no one could accuse them of interfering with their investigation. It is not clear the length of the investigation period, and if the men will be allowed to return to work before it is ended. It is also not exactly clear why the ministry decided to launch the investigations against the men at this time.

The FSC’s report was prepared to support the process for developing recommendations for improvements in the supervision of the sector and the orderly closure of a bank. With the

technical assistance from the International Monetary Fund and the Toronto Centre almost completed, I am satisfied that although prepared as an internal document for government, it is now appropriate to release the FSC report, and to do so ahead of the start of the extensive programme of work to set up a new legal framework for the banking sector. This reflects the special circumstances of the case and the widespread public concerns.” Errol Allen, Chairman of the FSC said: “The publication of the FSC report on the licensing, supervision and subsequent failure of TCI Bank demonstrates the commitment of the FSC to moving forward with a strong legal basis for better supervision of the financial sector and protection of depositors. The FSC will also be publishing an Action Plan in the near future which will outline future regulatory objectives, and as part of this process we will be widening our consultations.” to include all stakeholders in the financial services sector in the TCI.” The FSC continues to work with its international partners to pull together the various recommendations and to incorporate them into prioritised action plans. The technical reports themselves, together with the resulting draft action plans will be the subject of detailed consultations shortly with the Bankers Association and other local stakeholders, with a view to reaching agreement on the action required to make the framework for banking supervision fully effective. 70 to lose jobs in EMS; more in other ministries

ABOUT 70 STAFF will lose their jobs in the EMS works department, according to a press statement from the Interim Government about the staffing of ministries. However, the press release said Recommendations have been made to consider offering some of the EMS Departments work (building maintenance for example ) to current employees on a contracted out basis to protect their employment opportunities. The press statement said that reviews of the staffing of Government ministries were done to ensure that the right number of staff are employed in the right place doing the right things at the right time. This can and has led to the approval of increases in the numbers employed in the Fire and Rescue Service and the Ambulance Service; and temporary increases to clear the backlog in the PRC Office. But it has also led to suggested reductions in the number of cleaners and night watchmen, and in the numbers employed in the Ministry of

Works, some of whose activities might in future be contracted out to the private sector. In relation to the Ministry of Housing, Works and Utilities, the review recommends that the servicing and maintenance of government vehicles should be undertaken by a small group of qualified staff who should ensure that the cost of the work (salaries, parts etc. ) are covered by the amount that is charged to each Ministry for the service it provides. This management method is called a Trading Fund and seeks to ensure that the government gets value for money for the work done. Consideration was given to privatising the work as it can be shown that the private sector is a cheaper option but regard was had for safeguarding some of the jobs of existing employees within government. Similarly the maintenance of government buildings and the repair and maintenance of structures like roads, seawalls and drainage ditches can be undertaken by the private

sector. The review recommends that a small team of staff is retained to do minor works but that the majority of larger projects should be offered to the private sector though appropriate tendering and contracts. Both the above options will only be implemented when full assessment has been undertaken of the actual cost of these services and whether the private sector can offer a better and cheaper service. Other parts of the Ministry have been reviewed including the recommendation to move the Housing Department and a greatly strengthened Projects Management Department (PMD) to join up with the planning departments and land management (Crown Land Unit and Survey and Mapping) units of the Ministry of Environment and District Administration. But a final decision will not be made until this Ministry’s own review is completed. With regards to the Ministry of Border Control and Labour, the release said the changes are intended to improve processing at borders and integrate the work of enforcement staff, to identify illegal entry and other irregularities, to provide a one stop shop for applications for visas and citizenship, passports and other legal documents, and to improve services to employers and their staff through advice on employment matters and resolution of disputes. The review team has identified a number of new job designs and improvements to the way in which work is processed. The recommended changes will lead to the net loss of 8 currently filled posts plus a number of vacant posts. The Ministry is proceeding with implementation and has already achieved the anticipated savings in staff numbers through natural wastage (staff leaving, resignations or removal of temporary posts). As far as cleaning services is concerned, it was noted that TCIG owns and rents around 60 buildings and employs staff to clean and

maintain the premises. Work is already underway by the Ministry of Housing Works and Utilities to make sure that effective use of these premises is made and that the cost of renting is minimised by moving staff into vacant offices. The cleaning services needed have also been considered and the numbers of cleaning staff and the wages they receive is being reviewed to ensure that the cost of cleaning is also managed effectively. Ministries are being asked to ensure that they only employ the right number of staff for the size of the premises to be cleaned. This will result in some reductions of staff. In relation to security of premises, the release said TCIG employs watchmen to ensure the security of government premises when they are not occupied at night and weekends. Modern technology provides the opportunity to monitor premises through remote surveillance and security alarms and several private sector companies operate in all the islands who can provide these security arrangements. Consideration is being given to contracting out these services to the private sector. There may be opportunities for staff currently employed to be re-employed by these private sector operators and will be part of the specification if and when external contracts are offered. The first stage in the contracting process will be to compare the cost of employing staff directly to the amount that a private operator would charge. The Government statement noted that where possible, actual redundancy will be avoided. Staff affected by a change in one ministry will if possible be given an opportunity to move to a job in another ministry or department. As noted above, the reviews have so far identified additional jobs in the Fire and Rescue Service for another 29 Fire-fighters and 11 staff in the Ambulance Service. This movement will require retraining of staff and existing staff will be assisted to get the skills they need.


Irene causes significant beach erosions

from certain sections of the beach shores in Providenciales, possibly precipitating the closure of at least one of the resorts on that island. Director for the DECR, Wesley Clerveaux confirmed the erosion reports, but said that a preliminary assessment was underway and the results of such investigations would be available in the coming days to determine what level of erosion had taken place. “There is some erosion. We are in the process of assessing the extent of the damage. We have some erosion around Beaches (Resort and Spa) area, that’s one of the reasons why Beaches

has closed, I suspect. Throughout the island (of Providenciales) most people look at the flooding, but they didn’t realize the extent of the damage with regard to the coastal impact,” Clerveaux noted. Clerveaux said from his understanding, the sand erosion is not widespread, pointing out that reports indicate that there are areas along Grace Bay Beach that the sand wore away than others, but the extent would be determined when the assessment is done. “We have some pockets that are more severe than others, and we are trying to find out where those pockets

are. But I wouldn’t say the erosion is widespread, and as soon as I gather all the reports, we would have a greater understanding,” he said. Clerveaux said erosion of the beach sand was expected, saying that the Mining Policy exacted by Government was to address such problem in areas that erosion was evident. “The Sand-mining policy identify beach-grade material/sand that we can tap into, if there is an extensive problem. We are working on that, and we are moving swiftly to restore some of those beaches that were affected,” Clerveaux said.

TCI BAR COUNCIL PRESIDENT GEORGE MISICK ATTENDS AMERICAN BAR ASSOCIATION MEETING

THE TURKS AND CAICOS Bar was well represented by Bar Council President Mr. George C. Missick at the American Bar Association’s (ABA) 134th Annual Meeting in Toronto, Canada, which was held from August 4- 9, 2011. Mr. Missick was invited as a distinguished guest by Mr. Stephen N. Zack, President of the American Bar Association along with other Bar leaders around the world. The ABA Annual Meeting offered a rich array of programmes in which the leading lawyers in the US exchanged their views on current legal and policy issues. There were also substantive law sections offering outstanding and comprehensive continuing legal education programmes where some of the best lawyers in the US addressed key substantive legal issues.

An estimated 7,000 lawyers and judges were in attendance including the first female US Supreme Court Justice Sandra Day O’Connor, now retired. Whilst at the Meeting, Mr. Missick attended a Bar Leaders Breakfast and Orientation followed by a Bar Leaders Summit where the Bar Leaders led discussions on various aspects of International Law. New Chief Financial Officer takes up office

Hugh McGarel-Groves has been appointed for a two year period as the new Chief Financial Officer for the Turks and Caicos Islands Government. He takes over from Caroline Gardner who has returned to the UK after completing her one year assignment. Mr. McGarel-Groves has recently completed a one year assignment as Acting Treasurer and Chief Financial Officer with the island government of Jersey. He worked closely with the Treasury Minister to tackle the substantial government deficit of over £100m that had arisen as a consequence of the economic recession, successfully proposing a combination of expenditure reductions and selective tax increases that were approved by the Jersey States Assembly and should result in elimination of the deficit by 2013. He is an Engineering and Law graduate of Trinity College, Cambridge, then he qualified as a chartered accountant with KPMG and spent the early part of his career in senior financial roles with major multi-national companies, such as BP, Guinness and Sedgwick. He subsequently worked in a number of CFO positions in the healthcare and public sectors, including with Nestor Healthcare,

Hospital Corporation of America, Dr Foster Intelligence, Oxfordshire and Bedfordshire County Councils and Glasgow Housing Association. The Turks and Caicos Islands Hotels and Tourism Association has released the list of hotels that have already, or will be, closed during the fall mainly for refurbishment. Among the hotels are Amanyara, Beaches, Blue Horizon, Comfort Suites, Grace Bay Club, Neptune Villas, Northwest Point Resort, Ocean Club East, Ocean Club West, the Meridian Club, Somerset on Grace Bay and West Bay Club. Amanyara’s closing date is September 6, and is down to reopen on October 7. Beaches Resort and Spa has been closed since August 25, and is scheduled to reopen on October 6. Blue Horizon Resort closed as of August 28 and is to reopen operations on October 1. Comfort Suite closed September 1st and is to reopen on October 22. Grace Bay Club Resort has also closed its doors for a month, ending operation on September 6 and scheduled to reopen on October 7. Neptune Villas closed its doors on September 5, and is down reopen on October 3. NorthWest Point Resort will close on September 11 and reopens on October 6. Ocean Club East closed from August 29 and is to reopen in approximately two weeks on September 23. Ocean Club West is scheduled to close on September 13 and to open on October 14. Minor glitches to start of school year

THE EDUCATION DEPARTMENT is reporting a relatively satisfactory start to the new school year, saying that it began with few glitches. Director for Education, Edgar Howell, told The SUN that for the most part, the glitches occurred on Providenciales – the island with the largest population. He said the other islands such as capital Grand Turk, North Caicos and South Caicos experienced fewer problems, since those islands are not as populous as Provo. “For the most part it was a smooth opening. Clement Howell did a phased return to school, now all of their students are back on the compound. And the reports from other schools through-out the country are that things are running relatively smoothly,” Howell said. For some time now, there has been a reported shortage in public school classroom space on Providenciales, to

the point that the Education Department decided to accept only four year olds at primary schools and just GSAT students at high schools, for the new academic year. Howell said as a result of the Education Department’s proactive attitude of registering children long before the start of the new school year, there were no reports of students turning up to schools and were turned away. “…Because we tried to deal with the registration, especially of the GSAT children. We dealt with that during the summer right up to the time for school reopening. In some cases (at the present) we have persons just showing up for registration even though we conducted the registration process already. “Whereas persons showed up to see if their child’s name is on the list, they came here to the department. So we are still maintaining a wait list, and we have assisted as many of the children as we possibly could; given the space that we have available at the public schools,” Howell said. Howell added: “Through-out the country, though, things have gone relatively smooth because they don’t have the same level of challenges that we have here on Providenciales.”

THE TURKS AND Caicos Islands Civil Aviation Authority (CAA) and the Air Transport Licensing Authority (ATLA) should decide in the coming days whether or not to grant new airline Sky Cruise permission to operate in the TCI and whether to broaden the license of existing carrier Caicos Express from Provo to Grand Turk via Salt Cay to other islands within the country. In a public inquiry that was held before official from the ATLA on Thursday, long-standing local and region carrier Air Turks and Caicos is objecting to the two airlines being granted the licenses for which they applied, saying that it could damage the market, causing all the airlines to go bankrupt and sully the country’s burnished aviation reputation. Sky Cruise, which, among its principals is Shaun Malcolm, has applied for a license to fly within the Turks and Caicos Islands and, between the TCI and among other places, the US and Jamaica. Caicos Express is seeking to fly directly between Providenciales and Grand Turk, and route, currently serviced only by Air Turks and Caicos following the buying out of main competitor Sky King in October 2008. Under the supervision of his lawyer Conrad Griffith Q.C., Gardiner told the hearing that the market was not at burgeoning as it once was just a few years back, saying that a great number of people have left the country, resulting in a down turn in the industry. According to him, a study on airline management and operation done in 2009 by Dr. John Wenseveen, Dean of the School of Aviation at the Dowling College in New York, showed that up to that time, there were 36,000 residents living in the TCI, which Gardiner said was now significantly lower. He said of that figure, 27,500 resided on Providenciales, plus the 200,000 annual visitors to the country. Gardiner said the study drew parallel with other islands considered relevant in comparison to the TCI and it’s avian industry, and proved that the majority of them either had one

domestic airline or none at all. Among the countries he said was factored in the study were American Samoa with a population of over 65,000; Marshall Islands with 62,000; St. Vincent and the Grenadines with 120,000 and Barbados with 279,000 –

each of which he said the study showed to have just one domestic air carrier. He said the study showed that Bermuda had a population of close to 68,000 and did not have a domestic carrier.

In the case of Sky Cruise, Gardiner said from the surface it appears that the management team was an inexperienced bunch and that Malcolm possessed no known experience in aviation. In his criticism of Malcolm, Gardiner said the former PDM chairman may very well be posing as a front to outsiders, since there was no indication to suggest that he possessed the financial undertakings of such an operation. He said a fronting exercise would only give away another piece of the Turks and Caicos Islands to outsiders, which he said was the case with crown land in recent time. In relation to Caicos Express, Gardiner pointed out that since that carrier is operating on Government subsidy, it would not be fair for it to enter routes on which it now services, as it would be unfair competition. He pointed out that Caicos Express was already eating away its market share by ferrying passengers from Provo to Grand albeit through Salt Cay. He hinted also that the Caicos Express appeared not to have sound financial backing to operate beyond its current routes. Both applicants however, stopped just short of accusing Gardiner of trying to monopolizing its routes by pushing for the authorities to block them from the market, hence his objections to their application. Attorney for Caicos Express, Stephen Wilson, said based on figures submitted by Gardiner on Air Turks and Caicos’ performance in the market recently, it appeared that he may have cherry-picked the period which the airline did not perform up to satisfaction, to present to the hearing, in a bid to assist his cause. In the early stages of the meeting, Air Turks and Caicos pressed for Sky Cruise to release confidential document so that they could learn more about the company’s background, but Noel Skippings, attorney for the proposed entrants successfully pushed back at the request. DIVIDE THE IMMIGRATION PRODUCT

Immigration is fundamentally broken in the Turks and Caicos Islands (TCI). Proof that TCI immigration has been incompetently administered on behalf of TCIslanders is that in these Beautiful by Nature islands, at the very moment when nearby US and Canadian baby boomers are beginning to retire and to look around naturally for part-time or full-time retirement destinations, there is an obvious lack of ANY new wealthy foreign retirees in these islands. The primary reason TCI immigration is broken is that it has never been treated as the national-asset product it could easily become. It has been treated instead as a mere method of border control and as a sordid emolument of political office by whichever of the two corrupt political gangs is in power. The TCI is extremely fortunate to have two potential national-asset cash-cow products: tourism and immigration. One of those products required foreign capital, skill, experience and innovation to create and develop. The other required local political thugs to have a basic understanding of the Rule of Law and of the concept of biting the hand that feeds. One was in the control of private, free market forprofit enterprises. The other was in the control of greedy, unaccountable, unsophisticated, anti-civil libertarian TCI political bully boys. The results were somewhat predictable. The Torch suggests that if these two cash-cows could be made to work together efficiently, they could easily support all necessary government functions as well as a reasonable level of interest-free scholarship LOANS and a bloated civil service of 1000-1500 individuals. They would probably not support the current criminally-administered scholarship grant system, the government's portion of the National Health Rationing System or the current civil service staffing level of approximately 3000, but then what could? In order to get both of these cash-cows fine tuned and working for the non-partisan co-equal benefit of all TCIslanders, the Brit High Command must accomplish two goals BEFORE the political gangs regain power: (1) almost completely ignore tourism and simply allow it to occur, as it will anyway, with only common sense safety regulation and immigration control at the airports and without any public expenditure on any other aspect of tourism; and (2) divide TCI immigration into its two natural components, work permit immigration (The Torch's proposals below have nothing to do with work permits or PRC's with the right to work.) and Designer Immigration; then remove the marketing and management of Designer Immigration, now and forever, from the frenetic control of the two political gangs. In the parliamentary system of government the Brits have forced upon TCIslanders, the civil service is supposed to administer government departments like Immigration in a non-partisan manner that disconnects crony politics from the administration of the government's business. Inarguably, that doesn't happen in the TCI. Management staff at the TCI Immigration Department and Board are inevitably the close relatives or friends of or appointed by the political gang in power for the time being. They are highly politicized and incapable of compartmentalizing their jobs. The Immigration Board and Department will do whatever the Immigration Minister or any other gang leader tells them to do. They think they work for the political gangs, not for the individual citizens of the TCI. That situation is dangerous. It is anti-Rule of Law, anti-civil liberty, anti-immigration, contrary to any chance of economic recovery and detrimental to the international reputation of the TCI amongst those who could be our specific customer base. Dividing the immigration product into its two unrelated components and separating Designer Immigration from the entirely different concerns of work permits and then marketing and managing Designer Immigration as the true national product it really is would produce huge income increases for TCIG in the form of immigration fees and consequent stamp duty, other government fees and consumption taxes. It would obviate a VAT and the customs surcharge and thereby promote further economic recovery in our island economy. Additionally, the types of high quality immigrants that should be targeted for the Designer Immigration product would pump the local economy. The Torch suspects that no one knows the actual multiplier for cash placed directly into the TCI economy, but bets that if he paid someone $100 at breakfast, an average of 1 to several individuals/businesses would see portions of that $100 by lunchtime. The cash multiplier in a down-at-heels,

Brit-screwed island economy would be huge. Pilot programs for say, 100 RIPE's (Rich Investor Professional Executives) and 400 Old Guys (see last week's The Torch column in the Sun) would provide 500 wealthy households pumping the local economy at The Torch's previously analyzed likely rate of $1012K per household per month on purchases of local goods and services. That would amount to $5-6M per month of extra cash injected into the local consumer economy at some very large multiplier effect. Those projected figures are from a pilot program only (there is room for much more controlled expansion). Do not be confused in this analysis by the current effect upon the local economy of existing ex-pats. With a few notable and worthy exceptions, the current crop of ex-pats are cash poor and make very little per capita contribution to the local economy. Some current ex-pats are land-rich, but they are almost all well and truly hand-to-mouth stuck here in the TCI. In fact, the current low quality, economic and otherwise, of the generic ex-pat in the TCI is another symptom of the broken politicized immigration system. Designer Immigration will bring fresh blood to our economic recovery efforts. “Wealth is ultimately the only thing that can reduce poverty. The most dramatic reductions in poverty, in countries around the world, have come from increasing the amount of wealth, rather than from a redistribution of existing wealth.”-Thomas Sowell Designer immigration would INCREASE OUR TOTAL WEALTH! This would be accomplished through wealthy retirees under The Torch's proposed Old Guys program and RIPE's under The Torch's proposed Executive Residency program. Most existing ex-pats are work-permit candidates at best. Very few could qualify as RIPE's or Old Guys. Each Designer Immigration program would require fees (either annual or one-time, at the customer's option), a health certificate, proof of major medical insurance (including repatriation in the event of death or major medical emergency), professional level criminal background checks in every country in which he has lived, with each such country requiring proof of residency, real estate purchase to a certain value (real estate commissions and stamp duty). RIPE's and Old Guys would have no possible legal path to ctizenship. The political gang fear-mongering story that justifies the current politicization of the immigration product, and which you can bet will be wheeled out against The Torch's Designer Immigration proposal, is that “we should control who lives amongst us.” There are two points arising therefrom. First, there is a thread of legitimate concern in that dumbly stated assertion. See below. Secondly, this argument is an overall fallacy designed to prey on the irrational fears of unthinking TCIslanders. The TCI political gangs and their henchmen are not fundamentally concerned with the concept of having TCIslanders design their own immigration ordinance. They are fundamentally concerned about losing leverage over ex-pats' wealth through threats of violations of ex-pats' civil rights by and through the unaccountable “public good” clause of the current immigration ordinance. While that ordinance remains in effect, the human rights of all expats in the TCI are subsumed under that clause. We remain here only until some prominent TCIslander doesn't like us or thinks our businesses should belong to a TCIslander by virtue of unearned entitlement. There is no Western Rule of Law jurisdiction, regardless of size, where individuals or families control subjectively over time who obtains or retains his immigration status. This is what the demagogues seek to protect and maintain for their lords and masters at the political gangs. The Rule of Law requires that the totality of a jurisdiction's immigration laws and regulations are fair, reasonable, written, published so as to be readily knowable in advance, enforced equally and transparently, afford an independent administrative appeal and are subject to judicial review. Further, decisions of administrative tribunals must be in writing with specific reasons provided for decisions, such that an appeal can be mounted. “Because it's good” is not a reason for a major decision over the life, health and wealth of a customer who has trusted you. The political gangs and their henchmen want none of that. So how to create and manage the Designer Immigration product outside of the control of the political gangs? There is no doubt that will be tough. The creation of a Designer Immigration ordinance and its assimilation within existing law could be a project of some combination of the two nonconsultative panels. This would allay the single accidentally valid concern of the political gang henchmen that only TCIslanders should create TCI immigration law, a concept with which The Torch

agrees, providing it is a Rule of Law ordinance without a secret subjective “public good” component. The Brit High Command knows that TCI immigration is broken. The Torch is advised by his TCI lawyer, who should know, that those ex-pats who were thrown out unlawfully in the 2000's and who lawyered up and moved towards the European Court of Human Rights had their claims settled by the Crown for substantial sums of money. The Torch has no proof of this as the settlements were of course secret. If this is so, and it makes sense, then Oswald Skippings and Jeffrey Hall cost the Crown a lot of money. The FCO will not have forgotten. So TCIslanders might as well propose a Designer Immigration ordinance. Otherwise, you're going to get what the Brits force upon you, which will not be a Designer Immigration ordinance. Does any member of the two non-consultative panels have the minerals to buck his or her masters' wishes and bring forth a Designer Immigration ordinance for public consideration and proposal to the Brit High Command? “What we think, or what we know, or what we believe is, in the end, of little consequence. The only consequence is what we do." - John Ruskin How to manage and market Designer Immigration outside the political gang infra-structure? That's even tougher. The Torch attempts to resolve the problem logically by objectives. The TCI Community College has a Business Studies program. Why not select the 5 top business students each year? Give them a faculty advisor paid normally by the College. Give them an advisor and a secretary from the Governor's office. Give them direct access to a lawyer from the AG's office. Form a Designer Immigration Public Service Corporation with students holding corporate officer positions and a Board consisting of the Governor, the Dean of the College, the President of the Chamber of Commerce, the Human Rights Commissioner and in due course, a RIPE or Old Guy selected by all other RIPE's and Old Guys. Let that Public Service Corporation administer the Designer Immigration program on a complete year by year basis. Student officers would be responsible for corporate administration, marketing, budgeting, contractual, licensing and regulation of Designer Immigration Consultants, processing of applications, renewal of annual Executive Residency and Old Guy permits, maintenance of legal standards under the ordinance and interface with the Governor's Office and other TCIG departments, etc. Their audited accounts and reports would be public and provided quarterly to all media, just as if they were reporting profits to shareholders, which in effect they would be. Student officers would be encouraged to follow management-by-objectives principles and to operate in all ways as a public service corporation responsible to its Board and stakeholders for its results, which would be profit-oriented. Administrative appeals from its Decisions Panel would be to the Governor. Students would get course credit and incredible experience. Imagine the prestige of such on their college resumes. Student officers would be “paid” through a scholarship trust funded up to an inflation linked dollar limit for that year and at a pre-determined rate based upon the net earnings of the Designer Immigration PSC during that fiscal year. Their individual scholarship funds would depend upon how well they had marketed the Designer Immigration Program during their year in office. All funds earned by the corporation over and above the scholarship trust fund limit for that year could be used in the first instance to discharge the public debt of $260M and thereafter for TCIG general fund expenses. Parallel taxiway at Provo Airport not practical

A PARALLEL TAXIWAY at the Providenciales International Airport is neither feasible nor good value for money at this time, this according to Chief Executive Officer for the Airports Authority John Smith, during an interview with The SUN. A number of people were clamoring for, among other things, a parallel taxiway at the airport during its expansion exercise, saying that such a facility would lessen waiting time for other craft the take-off and land. They claimed that in some countries airport facilities are constructed in such a way that as soon a plane lands it taxies off the runway onto an adjacent taxiway before resting at its designated deplaning point, thereby allowing for the take off and landing of waiting flights. They said that is not the case at the Providencicales International Airport, as since there is no parallel taxiway, planes are forced to taxi back down the runway to their designated areas of passenger disembarkation. However, in an interview with The SUN, Smith pointed to at least two areas of taxiway constructed during the

expansion of the airport, which he said enables the smooth transition for landing and take off of some flights. “A high percentage of our traffic is light traffic with the exception of the heavy ones. We have put in new taxiways. All the light airplanes, when they land, can roll off straight here,” Smith said, pointing to the relevant section of the airport master plan. ownership at the immediate area, such a parallel taxiway would not be possible even if there was a will to have such a landmark constructed at the aerodrome, since a vast portion is private land. He pointed to a section of the master plan which showed that a parallel taxiway would infringe on the Provo Air Centre FBO (Fixed Base Operation), which he said is private property. Smith emphasized that even if a way was found around such a scenario, it would impact on land set aside for future development, and so the construction of a parallel taxiway at this time would not be good value for money He pointed to other aerodrome plans in the country, including the one on North Caicos, where the land mass is available for the construction of a facility with an adjacent taxiway. Smith noted that consideration has been given for a bond cargo facility to be erected at the airport so that aircraft could maximize their cargo space and to save money at the same time. The facility, he said, is an element of the future development planned there. “We actually need a freight cargo facility here, to maximize the utilization of the space and allow the carriers to

lower their cost because everything is flown in. We are also high-end. These high-end resorts want fresh fruits, fresh vegetables and all these sorts of things. “They can’t get it because everything comes in by boat. But you’ve got aircraft that are flying in with space in their holes but there is nothing you can do with it. So here (a section of the airport) is where we have provision for a bond cargo facility,” Smith said. He told The SUN that land has been reserved for other FBO operations at the facility. “It is all thought out very carefully,” he said. Smith argued that despite the sayings of detractors, the Providenciales International Airport is one of the most modern and certified facilities in the region, since it has gone beyond the required certification boundaries. He said each end of the runway has a 240 metres overrun – 60 metres more than the 180 required. “There are very few aerodromes in this region - referring to the Caribbean and South America - that are fully certified. Kingston is not; Sangster (Montego Bay) is. Kingston does not have that RESA (Runway End Safety Area) as yet,” Smith pointed out.

TCI needs more hotel rooms, says John Smith By Vivian Tyson It is expected that very soon new airlines from North America, South America or Europe could announce entries into the Turks and Caicos Islands tourism market, but there are jitters that there may not be enough hotel rooms in the country to accommodate the expected increase in tourist arrivals. Chief Executive Officer for the Turks and Caicos Islands Airports Authority, John Smith, said there are talks between his entity and new airline companies to fly into the TCI, as well as negotiations between the Tourist Board, the Hotels and Tourism Association and other carriers. He said with the completion of phase one of the Providenciales International Airport Expansion Project, the county could expect added airlift into the country, but feared that hotel rooms could fall short of such occupancy. There are approximately 2,700 hotel rooms in the TCI, which many, including Smith, have argued are not enough, if the recent winter tourist season was anything to go by. He said there are signs to suggest that the country is lacking sufficient hotel rooms to accommodate increased arrivals in the short to medium term. He said this became evident courtesy of a mini hiccup during recent construction work at the airport, when flights were delayed forcing

outbound guests to remain in the country, while delaying hundreds of visitors who had just arrived at the airport, from alighting their flights. This, he said, caused chaos for some hotels. “We have got carriers out of Europe that have shown interest. And also the Tourist Board and the Hotel Association are talking to carriers out of Europe and carriers out of South America. One of the limiting factors we currently have is the amount of hotel rooms that we’ve got. The last time, as I understand it, we have about 2,700 rooms. “You saw what we experienced when we had a bit of a hiccup during construction (at the airport), and there were delay in flights and suspension in operation for about two hours, with four aircraft on the ground. And there was pretty much mayhem on the ground because they had pretty much brought in roughly 111, 112 or 74 percent load factor (per craft). “So there were about 444 people coming in, and you have another 444 trying to get out. That’s 888 folks, and you only have 2,700 rooms. That is about 40 percent of your rooms accounted for, while you are sitting on an occupancy rate of 70 - 80 percent, now you are in trouble,” Smith argued. He noted that with added airlift expected, there will be need for more hotel rooms especially on Providenciales.

ISLANDCOM WIRELESS HOSTED yet another fun-filled community event last Saturday – the Islandcom Back to School Beach Olympics! Children of all ages came together down at the Children’s Park Beach in The Bight to support C.A.P.A.A –a community organization that works to end child abuse - and take part in the games. The children were divided into six teams of six to compete in the games. They were tested on their speed, coordination, and ability to work together in games like Fill the Bucket, Water Balloon Dodge ball, Three Legged Race and Tug-O-War. The performances from all six teams were impressive – however only three teams could take home the prizes.

Following the first three rounds of games the children took some time out to eat and take a refreshing dip in the water. C.A.P.A.A kindly provided free burgers, hot dogs and drinks for the kids and their families throughout the event. A raffle was also held by the organization in order to raise money for their cause. Family of Russell Armstrong believes he was murdered

Russell Armstrong's family are claiming that the reality show star did not commit suicide but was 'murdered,' according to new reports. The 47-year-old businessman, who regularly made appearances alongside his wife Taylor on The Real Housewives of Beverly Hills was found hanged at a friend's house last month. Although the Los Angeles County Coroner ruled Russell's death was suicide by hanging, TMZ reports that the family have hired a private investigator to look into their theory that he was murdered. The website reports that the family are 'convinced' that Russell's money problems caused him to get involved with 'the wrong people.' As a result, Russell may have 'screwed over' someone 'out of desperation.' That person or persons then retaliated by killing him, according to the website. Reese Witherspoon on the mend after being hit by a car Reese Witherspoon suffered minor injuries when she was hit by a car while jogging in Santa Monica, police said Wednesday. Witherspoon was struck around 11 a.m. in a residential neighborhood. The driver of the car, an 84-year-old woman who'd been traveling about 20 mph, was cited for failing to yield to a pedestrian in a crosswalk. The actress was taken by ambulance to a hospital for treatment, police said. CARICOM Secretary General admits to information deficit on CSME

ST JOHN’S, Antigua – The newly appointed Caribbean Community (CARICOM) Secretary General Irwin LaRocque says the CARICOM Single Market and economy (CSME) “is alive and well” but acknowledge there is need for a concerted public education programme to inform the region about the initiative. “Despite what has been reported in the media earlier this year the CSME is alive and well. It is not on pause,” LaRocque said on a radio programme here. The CSME, which allows for the free movement of goods, skills, services and labour across the region, has in past several months come under severe criticism from various quarters in the region, particularly as it relates to the free movement initiative. Last month, Barbados Opposition Leader Owen Arthur called on the Barbados government not to make the

“strategic mistake” of joining others who believe the CSME should be put on pause. Arthur told legislators there is prevailing view across the community that the initiative has been stalled and warned that Barbados depends more on the CSME than any other country with the 15-nation grouping. The former prime minister, who was a chief architect of the CSME , pointed out that the creation of the initiative was a formidable exercise because it involved the removal of 450 restrictions in the region that existed to stop the movement of goods, services, capital and the rights of establishment. He said this move created a market which has laid the foundation for the creation of single economy. LaRocque said that Caribbean people were till largely unaware of the specific arrangements and benefits of the CSME.

“There is certainly an information deficit in terms of our public out there…I think we have to take stock of that…we have to step up our outreach. We have not been doing it on a consistent basis, not because we don’t want to, but simply because we don’t have the resources to be always doing it.” the CARICOM Secretary General said. Antigua and Barbuda’s Ambassador Colin Murdoch said an effective public education strategy must be centered on outlining the ways in which the CSME will address the needs of individuals within the region. “To my mind, the CSME, for it to be successful especially in the countries like the LDCs, it must be a lived experience. Evidence must be given where the CSME benefits the common man on the street. “The common man has a lot of challenges on a daily basis. How can

the CSME respond to some of these challenges? That I believe could be a way forward.” Murdoch said. LaRocque said that an information strategy will be developed later this year to help address the communication difficulties and that the Guyana-based CARICOM Secretariat has spent a significant amount of funds on public education initiatives so far this year.

Trinidad Government hints at widening curfew areas

PORT OF SPAIN, Trinidad – The Trinidad and Tobago government Tuesday hinted at extending the so called ‘hot spots” under the five hour curfew, but has refrained from commenting on an opposition claim that Colombian drug dealers may have been behind the decision to impose the state of emergency. National Security Minister retired Brigadier John Sandy told the daily news briefing that the authorities were looking at extending the six areas designated as “hot spots” that have also been under the 11.00pm to 4.00 am (local time) curfew.. “We are looking at some other areas from which current activity emanates and you will be advised once we decide to go there...if we don’t you will also be advised,” he said. Police Commissioner Dwayne Gibbs said that 1, 477 people had been detained since the state of emergency was declared on August 21, with 422 of the suspects being gang members. But he could not tell reporters how many of those detained had been charged. “I don’t have the exact information with me, certainly we are looking at the gang related charges, gang related arrests, those will be all associated charges as we go,” he told reporters, adding that he

was also not in a position to disclose how many detainees had been released. The government has also been moving to quell reports of overcrowding at the jails here and the Commissioner of Prisons, John Rougier said that there is no cause for concern. “We along with the government are dealing with the existing situation as it relates to the state of emergency as was indicated by the minister, a facility was designated a prison and work is going on at this point in time for accommodation of inmates. “At this point in time that facility is at the point where roughly 650 persons could be accommodated and they will be accommodated sometime before the end of the week,” Rougier said, adding that the facility could easily house up to 1, 000 people “so that there would not be any undue overcrowding problems within the general prison system”. Rougier said that the Kamla Persad Bissessar administration has provided over two million dollars (US$333,300) to the prison service to upgrade the facility. Meanwhile, Opposition Leader Dr. Keith Rowley, speaking on a local radio talk show on Tuesday, claimed he had been informed by “government spokespersons” that the reason behind

the state of emergency had to do with a possible bloodbath involving Colombian gangs. He said the spokespeople, whom he did not name “had quietly sought to tell the opposition that the reason why they could not tell the country what the problem is, because the problem as they is a matter of national security. “The information is that the drugs that were intercepted at Piarco International Airport belonged to some Colombian gang which hired a Trinidad gang securing it for export and the Trinidad gang allowed it to fall into the hands of the authorities”. Rowley said the opposition was told that the “Colombian gang was seeking a reprisal against Trinidad gang and coming or are present here to create bloodshed and mayhem against this Trinidad gang that lost two suitcases of cocaine,” he said. During the debate to extend the state of emergency by three months last weekend, both Prime Minister Persad Bissessar and the National Security Minister said that while the crisis had been averted with Sandy indicating that the bloodshed would have the failed coup against the ANR Robinson government in 1990 in which several people including a legislator had been killed “ look like a Christmas party”.

KINGSTON, Jamaica – Health Minister Rudyard Spencer says he intends to table a Bill in Parliament “in a matter of weeks”, prohibiting smoking in public places and spaces. If the legislation is passed, Jamaica would be following the lead of several other Caribbean countries which have implemented similar laws. Spencer said the Ministry has already submitted its proposals to Cabinet for approval. He said the intention is to significantly

enhance the ministry’s healthy lifestyle campaign, which is being promoted in earnest by the relevant departments and agencies. Spencer said a major reason for the no smoking in public push is to alleviate some of the burdensome costs of health care for conditions associated with unhealthy living. Noting that over US$170 million are spent annually by his Ministry to treat chronic diseases, he said adopting a healthy lifestyle has become an urgent issue.

“Ideally, what we should aim for is to practice more physical activities; better eating choices, responsible behaviour and stop smoking,” the Health Minister suggested. Only one Caribbean country ranks within the top 50 of the annual World Economic Forum Global Competitive Index and large regional economies such as Jamaica and the Dominican Republic have seen their rankings tumble several places. The report, which was released Wednesday (September 7), revealed that Barbados was the only Caribbean country of the 142 ranked nations that came in above the 50-mark. Its global competiveness was ranked at number 42, up one place from last year’s ranking. Other CARICOM countries who improved their positions were Trinidad and Tobago, which hopped three positions from 84 to 81, and Guyana, which rose one place to 109. Next up behind Guyana was the Dominican Republic, whose ranking

at 110 marked a dramatic tumble of nine positions in just one year. However, this was not as large a drop as Jamaica, which saw its ranking plunge by 12 levels to 107. New CARICOM entrants to the list this year were Suriname, which ranked 112; Belize, which ranked 123; and Haiti, which at 141 was ranked ahead of only African nation Chad on its level of competitiveness. In its commentary on the results, the World Economic Forum (WEF) noted that while the region was heterogeneous, the nations shared “persistent challenges” in terms of a lack of physical security (the WEF even attributed Jamaica’s fall in the ranking mainly to its deterioration in security); poor development of infrastructure; an inefficient

infrastructure, macroeconomic environment, health and primary education, higher education and training, goods market efficiency, labour market efficiency, financial market development, technological readiness, market size, business sophistication and innovation. The rankings are calculated from both publicly available data and the Executive Opinion Survey, a comprehensive annual survey conducted by the World Economic Forum with its network of partner institutes. This year, over 14,000 business leaders were polled in a record 142 economies. The survey is designed to capture a broad range of factors affecting an economy’s business climate.

Three killed amid revelry at West Indian Day Parade in New York

NEW YORK — A shooting on a street corner a few blocks off the route of the annual West Indian Day Parade alst Monday, scarred by violence at least twice in the last several years, left two police officers wounded and three people dead, Mayor Michael Bloomberg said. An officer was hit Monday night by bullet fragments in his left arm and chest and was hospitalized but was expected to survive. Another officer was grazed by a bullet. At least three other people were hit in the shooting, which started after the parade as an exchange between two armed men, police said. Officers who had been assigned to parade duties arrived at the scene, were fired upon and returned fire, police said. Both gunmen were killed, as was a bystander, they said. The bystander, 56-year-old Denise Gay, was killed by a gunman's bullet while sitting on a stoop two doors down, with her daughter next to her, said Bloomberg, who called her death "a senseless murder" and blamed it on the scourge of illegal guns. "It is a matter of life and death," he said, "and in this case the death was an innocent New Yorker." He said the gunman who killed Gay had an extensive criminal history. The gunshots rang out in the Crown Heights neighborhood of Brooklyn after the parade, which was marred by fatal shootings in 2003 and 2005. The Tourism Minister emphasised that it was not the responsibility of government to maintain Ocho Rios in a clean and pristine condition, but that of the people. BOFA DISCUSSING ABOUT 40,000 JOB CUTS

Bank of America Corp officials have discussed slashing roughly 40,000 jobs during the first wave of a restructuring, the Wall Street Journal said, citing people familiar with the plans. The number of job cuts are not final and could change. The restructuring aims to reduce the bank's workforce of 280,000 over a period of years, the Journal said. BofA could not immediately be reached for comment by Reuters outside regular U.S. business hours. The Journal said BofA executives met Thursday at Charlotte, North Carolina, where the bank is headquartered, and will gather again Friday to make final decisions on the reductions, putting the finishing touches on five months of work. Investors are pressing BofA to improve its performance after it lost money in four of the last six quarters and its stock has fallen by half this year. The Journal said the proposed job cuts may exceed BofA's last big cutback in 2008 when it called for 30,000 to 35,000 job cuts over three years. That move was triggered by an economic slowdown and the planned takeover of securities firm Merrill Lynch & Co. Earlier this month, the Charlotte Observer reported that BofA executives were discussing plans to potentially shed 25,000 to 30,000 jobs over the next several years. BofA had earlier planned to cut 3,500 jobs, its Chief Executive Brian Moynihan had said in a memo to staff on August 18, as it tries to come to grips with $1 trillion of problem home mortgages. President Dmitry Medvedev demanded a rapid reduction in the number of domestic airlines on Thursday and said Russia may have to buy foreign aircraft to improve safety after a plane crash killed 43 people, including an ice hockey team. "The government has to take a very tough decision. We cannot go on like this," he said as he inspected the wreckage of the Yak-42 passenger plane which slammed into a river bank near the city of Yaroslavl on Wednesday. Acknowledging there were "big problems" with Russia's safety record, Medvedev said: "The number of air companies must be radically reduced and we need to do it very quickly." Looking somber in a black suit after arriving from Moscow with the transport and emergencies ministers, Medvedev said the government should help revive the civil aviation fleet and improve training and pay for flight crews. "The cost of human life is greater than any other concerns, including support for national producers," he said after laying flowers at the charred wreckage of the plane, which had been carrying the Lokomotiv Yaroslavl ice hockey team. "We must support our own people. If we are unable to sort it out, we must buy foreign aircraft. I am giving the government an order and they will have to find the money. It will be a big program." Medvedev did not give details. His remarks could herald a shake-up of Russian aviation with the aim of improving a safety record widely regarded in Russia and abroad as dire. Perry leads Romney in new poll; Bachmann fades

WASHINGTON, -- Texas Gov. Rick Perry jumped ahead of former Massachusetts Gov. Mitt Romney for the Republican presidential nomination, a Washington Post poll indicates. Perry, who announced his candidacy three weeks ago, now is perceived by Republicans as having the best shot at beating President Obama, results of the Washington Post-ABC News poll released Tuesday indicate. Among Republicans and GOP-leaning independents, Perry pushed ahead with 27 percent of the vote, followed by Romney with 22 percent. Former Alaska Gov. Sarah Palin, who has yet to announce her intentions, picked up 14 percent, U.S. Rep. Ron Paul of Texas collected 8 percent and Rep. Michele Bachmann of Minnesota, whose luster is fading after her firstplace finish in the Iowa straw poll, tallied 6 percent. After what could be considered the worst summer of his presidency politically, Obama's approval rating is at a new low of just 44 percent in the NBC/WSJ poll. Just 37 percent approve of his handling of the economy--a sixpoint drop since July. The poll's margin of error is 3 percent. Britain lifts ban on gay men giving blood

Britain said Thursday it was lifting a ban on gay men giving blood providing they have had not had homosexual intercourse within a year. A lifetime ban on blood donation by men who have had sex with another man was introduced in Britain in the 1980s as a response to the spread of AIDS and HIV. But a review by a panel of leading experts and patient groups found it could no longer support their permanent exclusion. However, men who have had anal or oral sex with another man in the past 12 months, with or without a condom, will still be barred from donating blood, the Department of Health said. The experts considered the risk of infection being transmitted through blood, the willingness of potential donors to comply with the selection criteria and improvements in testing donated blood. The change brings the criteria for men who have had sex with men into line with other groups who are deferred from giving blood for 12 months due to infection risks associated with sexual

behaviour. These include women who have slept with a man who has had sex with another man, people who have slept with prostitutes and those who have had intercourse with anyone who has injected themselves with drugs. The announcement was welcomed by human rights campaigner Peter Tatchell, but he said it fell short of lifting the ban on gay men who always use condoms. He said: "Although the new policy is a big improvement on the existing discriminatory rules, a 12-month ban is still excessive and unjustified." Tatchell, who launched the first campaign against the lifetime ban in 1991, added: "Most gay and bisexual men do not have HIV and will never have HIV. "If they always have safe sex with a condom, have only one partner and test HIV negative, their blood is safe to donate. "They can and should be allowed to help save lives by becoming donors."

BURGER KING FAULTED FOR UNDERCOOKING SEATTLE -- Washington state food inspectors found undercooked hamburgers served in many Burger Kings, the state Health Department said. Larry French, the state food safety adviser, told Mary Sanford, Burger King's manager of food safety and regulatory compliance, inspectors found a "disturbing trend" at many of the chain's restaurants, SeattlePI.com reported. He said many employees appeared to believe that the final step in cooking, a brief microwaving, would solve any problems of food safety. In his letter to Sanford, French said the chain must take steps to correct the problem. "The minimum outcome must be fully cooked foods, trained staff to assure this, and equipment that is reliable and easy to operate," he said. A spokeswoman told SeattlePI the chain is working with franchise owners on the problem. The 62-year-old victim from The Hague filed a police complaint in August due to the persistent phone calls. Police arrested the suspected stalker Monday, seizing several cell phones and computers from her home in Rotterdam. Hague prosecution spokeswoman Nicolette Stoel said Thursday the woman argued to judges at a preliminary hearing she had a relationship with the man and the number of calls she placed to him wasn't excessive. The man denied they had a relationship. The court ordered her not to contact him again.

SPERM DONOR FATHERS 150 OFFSPRING WASHINGTON- A Washington area social worker said she has learned the sperm donor used to conceive her son seven years ago fathered 150 other children. Cynthia Daily, 48, told The New York Times in an article Tuesday she began a quest for her son's half-siblings by searching a Web-based registry for other children fathered by the same sperm donor. Daily said she set up an online group to track the children and today they number 150 -- with more on the way. Her story has prompted concern among parents, donors and medical experts about the potential negative consequences of having so many children fathered by the same donor. Britain, France and Sweden limit how many children a sperm donor can father but there is no limit in the United States, only guidelines. Law Professor Naomi R. Kahn of George Washington University said without limits the same donor could theoretically produces hundreds of related children. It's that accidental incest could occur, Kahn said.

UK oil output falls below one million barrels a day

LONDON - UK oil production fell below 1 million barrels per day (bpd) for only the second time in more than 30 years this summer as maintenance exacerbated a decline in output from depleted North Sea oilfields. The British sector of the North Sea pumped 984,000 bpd of oil in June, down from just over 1 million bpd in May and a peak of more than 2.7 million bpd in 1999, industry data show. "The decline is worrying," said Mike Tholen, economics director of industry lobby Oil & Gas UK. Britain first produced commercial quantities of oil in 1975 and the country has enjoyed billions of dollars in revenue over the last 35 years as its light, high quality grades of crude oil have become a benchmark for the international spot market. It was a net oil exporter until 2005. But British oil reserves, mostly deep below inhospitable waters far offshore, are gradually running dry and cost more and more each year to maintain and operate as the large, easily accessible oilfields are exhausted. Oil & Gas UK says there are still billions of barrels of hydrocarbons in the UK Continental Shelf (UKCS), but much of these reserves are in the form of natural gas and lie in very difficult areas to explore. "The figures for the quarterly decline in

production of oil and gas highlight the need to focus on investing in the UKCS and on long-term trends in the basin," Tholen said. Michael Wittner, head of commodities research at Societe Generale in New York, said Britain would still be an oil producer for many years but the trend lower would continue. Oil & Gas UK have said British oil and gas output could fall to around 500,000 barrels of oil equivalent per day (boepd) by 2020, or just 12 percent of the country's expected demand. But if sufficient investment were brought into the industry, output could be as much as four times that level and still meet around 40 percent of the country's projected consumption. Improvements in technology now allow companies to pump an increasing proportion of oil and gas reserves to the surface and to collect hydrocarbons from fields that would previously have been out of reach. But costs have escalated and unit operating costs jumped 10 percent last year as production fell. The UK oil and gas industry also faces decommissioning costs of more than $40 billion over the next 30 years. The only other time in recent years when UK oil production has fallen below 1 million bpd was in August 2009, when maintenance work also affected output.

"A warmer atmosphere has more energy to power storms. Federal Reserve Chairman Ben Bernanke on Thursday said the U.S. central bank would spare no effort to boost disappointingly weak growth and lower unemployment, and he downplayed concerns about inflation. While the Fed chairman did little to disturb expectations of a further easing of monetary policy when officials meets on September 20-21, he offered no details of steps the Fed might take, disappointing some investors "The Federal Reserve will do all it can to help restore high rates of growth and employment in a context of price stability," Bernanke told the Economic Club of Minnesota. In what could be taken as a bid to quell concerns among some of his colleagues that a further monetary easing could spark inflation, Bernanke said a rise in prices this year would likely to be transitory. "We see little indication that the higher rate of inflation experienced so far this year has become ingrained in the economy," he said. U.S. stocks fell, the dollar extended gains against the euro and Treasury debt prices rose on Bernanke's comments. "The markets are going to be disappointed in this and concerned that the Fed is only acknowledging the problems without offering any real solutions," said Joseph Trevisani, chief market analyst at FX Solutions in Saddle River, New Jersey. A widening debt crisis in Europe and collapse in consumer and business confidence in the United States has raised concern the U.S. and global economies could slide back into recession. So stark is the recent deterioration in the global economic recovery that the political debate in Washington has veered in only six weeks from a preoccupation with how to cut U.S. debts to a renewed urgency on lowering unemployment. President Barack Obama is scheduled to lay out a jobs package worth more than $300 billion later on Thursday, and job creation was a key theme for Republican presidential hopefuls at a debate late on Wednesday. Other than offering a bit more detail on the outlook for inflation and emphasizing that sluggish growth is not enough to satisfy the Fed, Bernanke offered few fresh insights into thinking at the central bank on measures to aid the recovery.

HTC Corp has extended its lawsuit against Apple Inc to include nine more patents the Taiwanese firm acquired from Google Inc last week, underscoring intensifying legal actions between the Google camp and Apple. The world's No. 5 smartphone maker said on Thursday it has amended its existing complaint with the International Trade Commission (ITC) and U.S. District Court of Delaware against Apple over three patent infringements. It has also filed an additional case in Delaware alleging patent infringement by Apple's iOS devices and Mac computers. "HTC will continue to protect its patented inventions against infringement from Apple until such infringement stops," said Grace Lei, HTC's general counsel, in a statement. The Taiwanese company, one of the largest manufacturers of devices based on Google's Android operating system, is embroiled in an acrimonious patent war with arch-rival Apple, which has filed several patent lawsuits against the Taiwan-based company in Delaware in the last two years. ESPN extends deal with NFL for $15 Billion

Hours before the N.F.L. season was to begin Thursday, ESPN demonstrated what “Monday Night Football” means to the cable empire by renewing it for $15.2 billion through 2021, according to a person briefed on the details. The completion of the contract was delayed by the league’s player lockout. At $1.9 billion a year, ESPN will be paying 73 percent more than the $1.1 billion a year it has been spending for “Monday Night,” the highest rated program on cable television. ESPN began carrying Monday night games in 2006, when its previous package of Sunday night games moved to NBC. But when ESPN made that earlier deal, which will expire in 2013, it received no playoff games and no chance of carrying a Super Bowl, which is rotated among CBS, NBC and Fox. All ESPN had were the rights to carry 17 regular-season games a year. The new deal provides a path to adding a wild-card playoff game on the network by providing the league with an option to give one to ESPN — which would appear to mean taking one away from another network. How that develops will probably be a part of the continuing negotiations with CBS, Fox and NBC, which will be under pressure to retain their N.F.L. rights, at possibly steep fee increases, in a sluggish economy. ESPN’s agreement will allow it to further secure its role as the cable channel with more N.F.L. content than any other except for the NFL Network. Under the contract, ESPN will expand its use of video highlights and add 500 new hours of league-branded studio shows almost immediately, including adding a third hour to the Sunday program “NFL Countdown,” which will now start at 10 a.m., Eastern time. The daily “NFL Live” program will expand to 60 minutes from 30. The deal will also let ESPN stream its N.F.L. programming to Verizon cellphones. Tablet users will be able to

It’s daily product — we don’t have a day without the N.F.L.” He called the new deal, even at a much higher cost, “fiscally prudent for us” and one that “we will be able to absorb and continue to grow.” For ESPN, the length of the deal, eight years, is advantageous because it will span a period in which it will renegotiate all of its deals with cable, satellite and telephone companies — which will almost certainly lead to subscriber fees exceeding the estimated $4.50 a month that ESPN now charges. ESPN made losing bids for the N.C.A.A. and Olympic contracts, perhaps signaling that the deal it really wanted was the N.F.L. extension. “We do not have a more important deal than the N.F.L.,” Skipper said. The league’s next TV deal might be for a second Thursday night package of games to augment the one that is now carried by the NFL Network. But the creation, and sale, of a second such collection of eight games is not imminent. Roger Goodell, the commissioner of the N.F.L., said, “It’s not likely we will do it in the next year.”

Bin Hammam FIFA appeal set for next week

LONDON Mohamed Bin Hammam, handed a life ban by FIFA on bribery charges, will have his appeal against that decision heard next week, FIFA confirmed. The 62-year-old Qatari, a former member of FIFA's executive committee, was booted out in July after being found guilty of corruption and his case will be heard by FIFA's appeals committee on September 15. The hearing, at FIFA's headquarters in Zurich is expected to be completed on the day but it is not yet known if Bin Hammam will attened in person, or be represented by his lawyers. Bin Hammam was banned after the Ethics Committee ruled he was responsible for cash gifts totalling around $1 million (626 thousand pounds) for officials from associations belonging to the Caribbean Football Union (CFU) at a meeting in Trinidad on May 10. It was alleged the gifts of around 40,000 per member were to secure their votes in his battle to defeat incumbent Sepp Blatter in the FIFA

The letter, published by Bin Hammam on the Asian Football Confederation website, states: "I have never tried to bribe people and all the attendees of that CFU meeting are sure of this fact and you, yourself, heard this from all the witnesses that (were) brought to testify against me." He also says he is secure enough financially to pursue his legal defence for years if necessary to restore his reputation, and will emerge "unscathed by these creative allegations."
