LESS THAN A month after being elected leader of the Progressive National Party (PNP), attorney Clayton Greene has found himself at the centre of a heated and turbulent partisan and national controversy for choosing businessman Albray Butterfield Jnr., as his deputy. Greene’s decision has promoted the top-brass of the PNP to write a letter to party chairman Norman Saunders Snr., requesting an urgent meeting to discuss the leader’s selection and, possibly, his future as head of the party. In a brief telephone interview with The SUN, Greene said: “The party has elected me to lead and I will do so, and its constitution has given me the authority and discretion to select a deputy leader and I have done that.” Meantime, petitions already have been circulating in the island-capital of Grand Turk as well as Providenciales, asking the 46-year-old Greene to revoke Butterfield’s appointment. Ironically, the official PNP effort to call Greene to account, is being spearheaded by former Chief Minister Washington Misick, who campaigned for, and strongly supported the former Speaker of the House of Assembly in his quest for leadership at the PNP convention on August 7, 2010. In a brief statement to The SUN, Misick, who led this country from 1991 to 1995, said: “The undemocratic appointment of an individual who has distinguished himself as the enemy of the PNP reflects poor judgment on the part of the new PNP leader, and complete insensitivity to the expressed wishes of a majority of the members of the National General Council of the party, and should not be allowed to stand.” Misick added: “As someone who has supported the election of Mr.

Greene, I am most disappointed in his first major decision in his new role. The summary dismissal of the wishes of the party faithful smacks of the highest degree of political arrogance. If this attitude is an indication of his leadership style, then things do not bode well for the party under his leadership. He should now admit that he blundered, and redeem himself, and his leadership image by revoking his unfortunate decision.” Greene’s choice has ignited and provoked intense talk and thought across the length and breath of the Turks and Caicos Islands, in addition to creating a deeper divide, further

disunity, stronger tensions and a heated outpouring of vitriol and outrage in the PNP, whose members said, in one voice, that they elected the 46-year-old lawyer to unite, rather than divide, their party. Days before, and since, Greene officially made the announcement during a press conference at the PNP’s Airport Road, headquarters on Wednesday August 31st, 2010, the airwaves, bars, social networks, supermarkets and restaurants, workplaces country-wide have been inundated by conversations about his choice for deputy; a decision that not only stunned the party’s hierarchy and faithful, but caught even some of his closet friends and advisers by absolute surprise. PNP supporters are said to be angry about Albray’s selection because it is widely believed that Butterfield is an ardent member and strong supporter of the People’s Democratic Movement (PDM), that he is politically inexperienced and that his words and actions have, over-time, indicated that he does not have the interest of the PNP at heart. PNP insiders told The SUN that members of the party are adamant that if Greene does not reverse his decision about his deputy, his leadership of the party may very well be in jeopardy. Other sources said whether or not

Greene changes his mind, this highlevel PNP meeting may very well be a catalyst for some tough action against the former Speaker of the House of Assembly. According to additional information reaching The SUN, the meeting is also being called to decide on a replacement for PNP Secretary General Savitrie Daniel who recently resigned from that post. It could not, however, be confirmed whether her decision was related to Greene’s choice, but it is widely and wellknown that Ms. Daniel has been a strong and staunch supporter of Queen’s Counsel Carlos Simmons, who Greene defeated 57-33 at the August 7, 2010 convention. In the PNP elections, Greene won from a field that included former Premier Michael Misick, Queen’s Counsel Carlos Simons and Digicel CEO Jay Saunders. In the first round of voting, Greene was in third position with 25 votes, behind the leader Misick who amassed 29 votes and Simons who received 26. Saunders, with 11 votes, was first to be eliminated. In the second round, Greene eased ahead, gaining 31 votes, while Misick and Simons were tied at 30 votes each. Because of the tie, there was a re-vote in which Greene opened his lead to gain 32 votes, to Simons’ 30 and Misick’s 29.

DON’T BLAME THE PEOPLE FOR THE CARIBBEAN'S FAILURES

Some leaders of countries of the Caribbean Community and Common Market (CARICOM) often suggest that the slow progress of regional integration is due to a lack of “trust and understanding” among the people. Certainly this was a view expressed by Bruce Golding, the Prime Minister of Jamaica, at the opening of the 31st CARICOM Heads of Government Conference in Jamaica. Interestingly Golding also said that integration also requires “building trust and understanding” among the leaders themselves. He is right on both counts. But, if the people of CARICOM countries lack trust and understanding of the benefits of regional integration, the blame lies with the leaders. Over the last 20 years of CARICOM’s existence, the people of the region have been fed a regular diet of CARICOM bashing in the media. That bashing was – and is – conducted by CARICOM leaders. The media simply report it. Instead of resolving trade disputes at the table of quiet diplomacy, government representatives choose to amplify them with heated exchanges through the media, creating the impression that CARICOM’s trade arrangements don’t work fairly. Yet, the CARICOM Treaty provides for the amicable settlement of disputes through consultation with recourse to the Caribbean Court of Justice only a last resort. New governments in CARICOM do not appear to be immune from the virus of injudicious public statements. Thus, the new Prime Minister of Trinidad and Tobago, Kamla Persaud-Bissessar, declared publicly that her country was not an “ATM machine” from which other CARICOM countries could draw money as they want it. Such statements would not endear Trinidad and Tobago to the rest of the CARICOM countries, nor would it encourage citizens of Trinidad and Tobago to regard other CARICOM citizens with anything but contempt. In reality, the relationship between Trinidad and Tobago and other CARICOM countries, particularly the smaller nations of the Organisation of Eastern Caribbean States (OECS), is far more mutually beneficial than is conveyed by the analogy of the

“ATM machine”. Other CARICOM countries are a lucrative and protected market for Trinidad and Tobago’s manufactured products and financial services under the CARICOM Treaty. Were it not for their membership of CARICOM, these countries could purchase most of what they buy from Trinidad and Tobago at cheaper prices elsewhere in the world. Barbados, too, benefits significantly from the export of goods and services to CARICOM. It is Bardados largest area for exports. This is one of the reasons why the Barbados government was concerned with the intention of the previous Patrick Manning government in Trinidad and Tobago to forge an economic union with the members of the OECS. The point is that membership of CARICOM is not a one-way street, nor indeed is it a one-way street only for the marketing of goods and services. Of equal importance is the bargaining strength which collective negotiations in the international community bring to each of the countries individually. But, little credit is given to the benefits of regional cooperation. It is seldom, if at all, mentioned by governments in their parliaments or in their media conferences. The impression left in the minds of the people is that CARICOM is a useless organisation that brings no benefit to them, and that they would be better off shedding it and dealing with the world on their own. Of course, leaders know better. That is why none of them have abandoned CARICOM, and more recent leaders, such as Bruce Golding, have significantly altered the almost hostile attitude to CARICOM with which they started out. There are a multitude of crucial matters that CARICOM countries cannot manage on their own and for which each of them needs to be bolstered by the collective effort of all. Dealing with drug trafficking is one example. There are myriad others such as coping with the effects of natural disasters and bargaining with the international community. Serious observers within the Caribbean and many more, including governments and international financial institutions, had hoped that the recent summit would address two matters with the gravity and urgency they deserved and so reinvigorate regional integration and reignite interest – if not

passion – for it among the Caribbean people and the wider world. The first is the twin issues of governance and implementation of decisions by CARICOM. Having laboured over the matter since 1992 when the West Indian Commission recommended the creation of a Caribbean Commission (similar to the European Union Commission), leaders pondered it yet again at the Jamaica meeting only to appoint a fifth group to consider the matter and report in February of next year. This new group consists of seven Heads of Government – all of whom are busy with the demands of their domestic constituencies. They are to be advised by a technical group who will have to be miraculously inspired to generate anything more sound than the numerous studies already produced on this matter. What is certain is that the leaders do not want a Caribbean Commission similar to the European Commission. They have said so. It is reported that they are toying with the idea of a Council of Ambassadors similar to the weak mechanism adopted by the members of the OECS in their yet to be operationalised Economic Union Treaty. Such a mechanism – nationalistic in its composition and representation – would be nothing more than a further layer of delay in decision-making. It would have to await the consent of the most reluctant country to proceed. The second issue on which urgent action was reasonably expected from the Jamaica summit was a plan to recover from the global financial and economic crisis. A flame of hope flickered momentarily when the Managing Director of the International Monetary Fund (IMF), Mr Dominique Strauss-Kahn, “agreed to review the issue of special and differential treatment” for Caribbean’s small states. But, no CARICOM government alone and not all of them collectively can turn Strauss-Khan’s “review” to “commitment”. CARICOM requires the best brains in government, the private sector, the trade union movement and the academic community from throughout the region to devise a plan that could command international respect and action. It would have been hugely beneficial if the Conference had mandated the assembly of such a Caribbean team under a High Representative (otherwise known as a Commissioner) tasked to produce a plan using as a basis the work of three separate task forces that governments commissioned over the last year. Alas, this did not happen. The people of the Caribbean remain caught in a long tunnel of stagnation with no end in sight. They should not be blamed for the region’s failures.


Interim Government getting tough on female bar employees

THE TURKS AND Caicos Islands Government will be reviewing its licensing system as to how it grants licenses to bar workers in the country, since there has been several concerns being raised in the last couple of years. His Excellency Governor Gordon Wetherell made the disclosure during an Advisory Council news conference held at the Hilly Ewing Building in Providenciales on Thursday, September 2, while updating the media as to some of the matters discussed in the meeting. According to the Governor, the matter first came up in the Advisory Council in November last year, saying that as a result of the discussion, decisions were made on the number of people who could get licenses to work, depending on the size of the bar, and for how long that could happen. “What we wanted to do today was to review the operations of those concessions and to see how well they were working or not working. We had an initial briefing on that from the Department of Immigration and we will continue with that discussion at our next meeting in light of more data that we have asked for on the matter,” Governor Wetherell said.

AN ALLEGED MASKED gunman, who allegedly held up a Five Cays establishment on Saturday, August 28, and then attempted to stage a car jack with children aboard, is now nursing gunshot wounds after he was shot by the owner of the vehicle, who is a licensed firearm holder. Police spokesman Sergeant Calvin Chase said the incident took place at Faltinto’s Store on Five Cays Road, in the early afternoon period. The police have not officially released the name of the man, but residents said he is a well known figure especially in an around the Five Cays area. “On Saturday 28th August 2010 about 1:36pm the Police in Providenciales responded to a robbery at Faltinto's Store on Five Cays Road Providenciales where a male masked gunman robbed the business place of a quantity of cash and tried to car-jack a vehicle from its owner outside the said business place,” Chase noted via press statement. According to the police, during the process of the robbery, the robber discharged his firearm several times in a bid to intimidate the operators of the store in handing him cash. Following the robbery, he

attempted to steal a car, which was parked in the vicinity of the premises. However, the owner was adamant that the alleged thug would not have his automobile and as a result challenged him. According to the police, the alleged criminal was shot during the incident by the licensed firearm holder, who crime sleuths, said the alleged criminal tried to shoot while in the process of stealing his motor vehicle. “The robber sustained multiple gun shot wounds and is presently undergoing medical attention,” Chase said. In recent months there has been an uptick in armed robberies across Providenciales, and according to business owners, what makes the robberies so frightening is that the robbers are carrying out the heists in broad daylight, and are firing at their victims in the process. One death, so far this year has resulted from those armed robberies. In the meantime, the police in Providenciales have charged Lorenzo Ceasar, listed as a 25 year old Turks Islander for robbery in connection with a robbery which occurred on Sunday, August 22 at Sea-View Provo Business located in Rock Plaza on Blue Hills Road Providenciales.

But, it has been revealed that the situation was being abused by unscrupulous bar operators, who, for the sake of attracting greater clientele, crammed their bars with the women, who are mainly nationals of the Dominican Republic. However, after an initial review, the Advisory Council cut the number of girls allowed to work in these bars at one given time, reducing the number of females to the square

footage of the bars. Under the initial review, bars with square footage of more than a thousand feet were allowed to have five girls working in them, while others with square footage of between five hundred and a thousand were allowed to have three girls employed in them. The SUN also understands Turks and Caicos Islanders shun these jobs because the salaries are below the minimum wage. As a matter of fact, an authority figure said the salaries that the women get were alarming, and such, many of them subsidized those small incomes by selling their bodies to the bars’ amorous clients. As a result of some of the concerns the Advisory Council has taken to decision to review the process of, among other things, to review the work permit procedures for these women and to have the bars streamline to see how best they can operate to accommodate Turks and Caicos Islanders who want to work in them. The Governor said a greater study would be conducted on that matter with a view to see its feasibility.

Shareholders, depositors vote to save TCI Bank

FROM ALL INDICATIONS, it appeared that shareholders and depositors on Providenciales have given the nod to the ECIC Banks from the Eastern Caribbean states of Dominica and St. Kitts, to bail out the ailing TCI Bank, which was put in the hands of provisional liquidators earlier this year. The meeting, which was held at the Tropicana Entertainment Centre in the Bight on Thursday, September 2, was the latest in a serious of meetings across the islands to determine whether or not shareholders and depositors were in favour of saving the entity or opt for full liquidation. Recently, High Court Judge, His Honour Richard Williams directed the provisional liquidators to hold shareholders and depositors meetings to see if they would accept the offer put on the table by the ECIC Bank. Acceptance of the bank’s proposal will hinge a seventy percent of the depositors as well as shareholders voting in favour. Co-chairmen Anthony Kikivarakis, who is the lead provisional liquidator and Norman Hamilton, will report to the Supreme Court on September 9, with relation to how the meeting went and for the court to make a decision as to whether the bank should be rescued or liquidated. However, such process may be held up as a result of the impending appeal by the Attorney General’s Chambers, who want the Olint funds to be exempt from liquidation in the event that such a decision is made. The Attorney General’s Office mounted the

argument about two weeks ago in the Supreme Court, asking that the funds be set aside in a firewall account so as to protect it against being affected by the bank’s demise, on its behalf. But the bid was rejected by the judge. Additionally, the other hurdles to get by are that the board of directors of the two investor banks will be required to formally approve the scheme and that the central bank of the investor entities approves the investment, and that the ministers of finance of the

two countries in which the bank operates give the scheme their stamps of approval. Additionally, personnel at the TCI Bank would have to be approved. The ballots cast at Tropicana Meeting Hall were done in secret, making it difficult to readily determine whether or not seventy percent was in favour of the ECIC Bank. Norman Saunders Jr., represented TCI Bank (not provision liquidators), while Stanfield Greene Attorney-at-law represents TCI Bank in Liquidation.

RECENTLY ELECTED PROGRESSIVE National Party (PNP) Leader, Clayton Greene said he is determined to change the face of politics in the Turks and Caicos by making his party an ultra inclusive entity to include his critics, loyalists and those on the fence. Greene, an attorney-at-law, was giving his first news conference on August 31, since being elected on August 7, at the PNP headquarters in Providenciales, where he also officially presented his deputy, Albray Butterfield Jr. The new leader was made to defend his choice of deputy leader, by sections of the media, which accused Butterfield of having a hand in bringing down the Mike Misick administration and ultimately the imposition of direct British rule in the TCI. Greene, who hinted that he was bracing for harsh criticisms in his choice of deputy, said whatever choice he made there was going to be vicious backlash. “I made the choice as the party’s constitution requires me to do. I made the choice that I thought for various reasons, was in the best interest, not only for this party, but also for this country. Change is something that is always going to be resisted. But what bold leaders do is go out front and lead.” However, Greene made it quite clear that even though the process was an arduous one, he chose Butterfield for among other things, his boldness in speaking out in the interest of the Turks and Caicos Islands. He said once voters realized that the PNP was all about country, they would again board the party train and ride with it into the winner’s circle.

NEWLY-ELECTED DEPUTY Leader of the Progressive National Party (PNP) Albray Butterfield Jr., said he wanted to enter elective politics while in his 50’s, but it appears that God has a divine purpose for him to enter the arena at this time, hence him being chosen by leader Clayton Greene. The 44-year-old businessman, who was speaking at the party’s first news conference on August 31, since it ushered in new leadership on August 7, said it was his passion to speak out on behalf of the common man and to express views which he said could be interpreted as either popular or unpopular. Butterfield noted that the current course on which the country is progressing, in terms of joblessness in the economy and crime being at an all time high, made it opportune for him to offer his knowledge to effect change at this time. “I never intend to come to public service until I was about 55 years old; finished with entrepreneurial business practices and then provide service, to give back to my fellow citizens. But I guess that this is one of the times when you do not dictate what your future holds for you – destiny does. And so, therefore, I accept this position with humility. I intend to serve this party to the best of my ability, and more importantly, serve

Butterfield also noted that he spoke with persons from both sides of the political fence, to get their views on the decision. “At the end of the day, all of the decisions that were given to me, were that I should seriously consider it (deputy leadership) because at the end of the day, the mere fact that the leader asked me to be his deputy, meant that the leader was serious about taking the country forward and effecting change within this country. I look forward to serving this country with the best and most honest intentions that God has given me,” Butterfield said.

Hurricane Earl misses Turks and Caicos Islands

THE TURKS AND Caicos Islands were spared the effects of Hurricane Earle, as the huge and powerful weather system veered, and stayed, east of the island-chain, producing only moderate winds and light, sporadic showers between last Tuesday evening and Wednesday morning. According to Director of the National Disaster Centre, Dorothy Clarke, the Turks and Caicos Islands received the all-clear at 6 a.m. on Wednesday, September 1st. “There were no reports of any effects from the hurricane,” she said, contrary to reports in some international media which said that the Turks and Caicos Islands were “pounded” by Hurricane Earle. “We were spared, thank God.”

On Wednesday September 1st, the country fully opened for business, after airports, businesses and schools were closed early the day before, as residents of this British overseas territory located 500 miles from Miami hunkered down in preparation for, at least, tropical storm conditions. During the course of the day last Tuesday, there were occasional gusty winds and choppy seas and extra humidity. As evening approached, it became slightly overcast and wind speeds intensified, accompanied by a few drizzles. MICHAEL MISICK, THE first Premier of the Turks and Caicos Islands, former long-standing and respected Clerk of Parliament Ruth Blackman and this country’s first female Cabinet Minister Arabella Smith, have all spoken out against the appointment of Albray Butterfield Jnr., as deputy leader of the Progressive National Party (PNP). Misick, who was a former leader of the PNP, said Butterfield’s appoint will further divide the party. He told The SUN: “I personally know Art and Rosita Butterfield and they have made a significant contribution to the country and they have always been ardent supporters of the PNP, and I respect them for that. Albray, on the other hand, has been an ardent supporter of the People’s Democratic Movement (PDM) and I can remember him campaigning very hard against the PNP in many elections. In addition to that, he was one of those persons who called for, and was very supportive of, the British intervention and even as recent as when Colin Roberts (from the Foreign and Commonwealth Office) was here, he (Albray) was very critical of the PNP and very supportive of the British occupation of the TCI.” Misick added: “I therefore cannot, and do not, in any circumstances, support Albray being deputy leader, because I do not believe that in his heart he is a PNP and shares the vision of the PNP. I cannot support any leader who supports the British occupation of the TCI and who is not proIndependence. In the meantime, the Turks and Caicos Hotel and Tourism Association, Karen Whitt, said the group wanted to exploit the good news by taking a proactive posture in the fight against all the recent negatives which have been dogging the local industry. “We want to see more positive messages coming out in the media, and we want to include the media as part of the process, that would help the media understands the process and the behind the scenes works that are taking place in the efforts and the initiatives that we are taking on. “We feel strongly that we can generate some more positives. There are a lot of positive things that are happening every day, its just that those things tend to get overlooked and take a back seat to the sensational,” Whitt argued. Assistant Commissioner Adams, who sat in the meeting, endorsed the move, saying that it would assist the police in their crime-fighting initiative. The group said it would update the community of its progress as to every progress made.

Keep criminals in jail, says business community LOCAL NEWS

THERE IS INCREASED frustration among not only the police but the wider Turks and Caicos regarding what some expressed as the relative ease with which alleged perpetrators of serious crimes are allowed to return to the streets after being charged and taken to the court. The latest bloc to be in coalescing against such idea is the business community, and according to one businessman, we should not wait until something more serious happens before changing the law. The businessman was speaking specifically to the Jai’s Jewelry Store robbery which took place about six weeks ago, where four armed men with guns and a machete, and who appeared to have been assisted by a women, forced their way in the jewelry store to pull off a daring daylight robbery. A security guard at the store missed being killed when one of the gunmen fired a shot through the glass from outside, as the guard tried to keep them out. But luckily for him, the glass was bulletproof. The men, who were, said to have carried out the heist were apprehended by law enforcers, and according to the crime sleuths,

based on circumstantial evidence, they were sure they had their men. However, they expressed disappointment that they men were able to secure bail when they appeared in court. And according to the police, at least one of the men, who were released on bail on the jewelry store robbery, was said to have been implicated in another robbery while he was out. The police have long expressed their dissatisfaction that after relentless efforts to capture and jail some of the country’s most dangerous criminals, when they appear in court, they are allowed to take up relatively easy bonds, and soon thereafter are back in jail again after committing similar crimes, while awaiting court dates for the first crime. And with the seemingly increasing criminal activities, such as burglary and armed robbery, of the business members community have added crescendo to the police’s frustration, saying that time and time again, persons associated with some of, especially Providenciales’ most telling crimes are being released on bond at the

I can’t understand how these guys, who have been implicated in these crimes, are allowed to be back on the streets in

such a short space of time,” the businessman charged. A police source told this newspaper that there is compelling evidence that a number of the persons that were given bail by the court go on to commit additional crimes even while their cases are pending. The source said on a number of occasions, officers can be heard openly expressing their frustration to their colleagues on some court rulings. He said some of the police officers said some of the offenders have been released even after they presented compelling evidence.

Police Inspectors transferred

THREE POLICE INSPECTORS have been transferred, effective September 1st, as part of a routine exercise in the Royal Turks and Caicos Islands Police Force. Sources told The SUN that Inspector Mary Durham will be going to Grand Turk, while Inspector Clifford Henry will be moving to Providenciales from the capital. Inspector Bennett Spring will be transferred from Providenciales to North Caicos.

Meantime, it is reported that Assistant Commissioner of Police Sherman Clarke will assume responsibility for the Marine Branch, following the resignation of Assistant Commissioner Neil Hall, who is from Britain. The public is still awaiting the report on the restructuring of the Police Force which was done by a team of experts and which was submitted to the Governor a few months ago.

LIME going mobile TV

OVER US$100 MILLION went into developing the Digital Video Broadcast (DVB) system that powers the LIME Mobile TV service that was launched on Thursday by the telecommunications provider. LIME chairman and chief marketing officer Chris Dehring said the substantial investment was made into upgrading the mobile network, 3G coverage and undersea cables used in the transmission. Jamaica is the first country in the Caribbean to have the service, which was developed through a partnership with DC Digital, a Jamaican company. It is expected that other Caribbean Countries in which LIME operates, including the Turks and Caicos Islands, will receive the technology in the short future. "This solidifies our position as the largest telecommunications network provider in Jamaica and the Caribbean," said Dehring at the launch held at the SportsMax Zone in New Kingston. In reference to the launch of 4G internet by competitors Digicel last week, Dehring said the introduction of LIME Mobile is better than 4G. "This is more G," he said. "They (Digicel) can't do this on their (4G) mobile network."

Dehring said the introduction of the service represents a 'paradigm shift' for telecommunications in Jamaica and a new avenue through which other business lines could be developed including opportunities for television broadcast, for local content development including educational and entertainment related programmes and advertising. Referring to the cellphone as the 'third screen' after the television and the computer, Dehring said that the addition of Mobile TV will "provide information in the palm of your hand at every second". "This revolution will be televised," quipped Dehring. LIME Mobile TV project manager Akil Strachan said the service will be available on Nokia phones: the 5530, N77, N96 and N97; the ZTE N290 along with other models that will be available from LIME. The company is also working on bringing mobile TV to smartphones, including the Blackberry. Robert Whitehorne, project manager of DC Digital, the Jamaican company which developed the technology for the Mobile TV service said the deployment was about four years in the making.

Greene charged that there is a thick overhanging of uncertainty in the country due to the suspension of the Constitution and the Interim Administration’s lack of information to the population regarding its plans to resuscitate the economy, which he said has made it difficult for the country to regain sprout. “This state of uncertainty and confusion cannot be allowed to continue. I agree that the global economic downturn has affected the Turks and Caicos as it has other regional and international countries. Governor Gordon Wetherell-led administration has made the politics of the day and the speculation of the Special Investigations and Prosecution Team (SIPT) to influence the position that they take on developmental proposals, saying that a number of developments, some at advanced stages, have been halted. According to the PNP Leader, the Special Investigations and Prosecution Team along with the Civil Recovery Team have not earned their salaries, saying they have yet to prove that the collective $500,000 a month being paid to them was worth it. He said there been no prosecution nor recoveries made after one year of takeover by the UK. “Actions on behalf of the Special Investigations and Prosecution Team and, for that matter, the Civil Recovery Team, we must hold on to the view that they are the largest gravy train that this country has ever seen. THE FOLLOWING IS A TRANSCRIPT OF THE ORAL RULING OF HIS LORDSHIP MR. JUSTICE RICHARD N. WILLIAMS IN THE SUPREME COURT OF THE TURKS AND CAICOS ISLANDS ON TUESDAY, 10TH AUGUST 2010 IN THE CASE OF TCI FINANCIAL SERVICES COMMISSION V TCI BANK JUDGE'S EX-TEMPORE RULING

category, so that on the face of it, Hallmark is entitled to receive notice of a creditors' meeting and to vote for or against the proposed- scheme of arrangements.

This is a matter that requires an urgent decision and ruling. Unfortunately, I will soon be out of the jurisdiction for what in reality will (save for 4 days in the middle) be almost 6 weeks and therefore I feel compelled to give an ex-tempore ruling, rather than reserving to give a more detailed and refined written ruling. This ruling will therefore read a little `rough at the edges.'

The Scheme of Arrangements proposed by the ‘ECIC Banks’ includes what appears to be a sensible and necessary compromise by depositors to postpone the withdrawal of deposits in excess of $50,000 during a period of 5 years in return for injection of new capital in the Bank. This is designed to prevent a run on the Bank's capital. A probable scenario that worryingly existed at the time of the ex-parte hearing at which the appointment of the Provisional Liquidator was made by the Court, as some very large withdrawals had around that time been made.

At the request of the interested parties which made last Friday, I have listed this today as a hearing to determine two preliminary issues in relation to an application by St Kitts Nevis and Anguilla National Bank Ltd and National Bank of Dominica Ltd for an order directing the holding of a creditors meeting to consider a scheme of arrangements in relation to TCI Bank Ltd. These two issues must be determined before I can go on to consider matters surrounding the holding of a creditor's meeting. The 1st issue is "Is the effect of a restraint order under the Proceeds of Crime Ordinance such that it confers on the Crown a preferential right to payment out of the assets of the Bank in this case in priority to all other creditors secured or unsecured." The 2nd issue was; "Can a scheme of arrangement under Section 84 of the Companies Ordinance, which would postpone the payment out of the funds subject to a restraint order under PCO, be sanctioned by the Court without the need to vary the restraint order or must any variation of the restraint order be ordered at or before the time of the sanction of the scheme of arrangement."

Mr Misick contends that the 2nd issue should be reframed to read; a) can the proposed scheme of arrangement be imposed on Hallmark/Olint? b) If so, is the variation of the restraint order necessary to impose the scheme of arrangement of Hallmark/Olint

Background to Restraint Order On July 10th 2006 the Attorney General applied and was granted a restraint order pursuant to S43 Proceeds of Crime Ordinance (“POCO”) in relation to David and Tracy Smith which prevented them from dealing with or diminishing the value of their assets. Persons named in the order as holding assets of the Smiths included Hallmark Bank &Trust Ltd and Olint TCI Ltd. Olint is a company owned and controlled by the Smiths. Under paragraph 5 of the restraint order the Defendant's assets included assets over which they had the power directly or indirectly to dispose of or deal with as if they were their own. Under paragraph 6 of the restraint order the property and assets of Olint were expressly covered. This meant that all accounts and other funds held in the name of or connected to the Smiths and held by or in the name of Olint at the Bank were caught by the restraint order. There is no issue about this background. Hallmark holds a number of accounts at the TCI Bank as bare trustee on behalf of Olint.

For completeness sake, I should say that there are ongoing criminal proceedings in relation to the Smiths. There is to date no conviction and no guilty pleas entered. It appears that Ms Benjamin wrongly believed that guilty pleas had been entered.

Background to Winding Up Proceedings TCI Bank On 7th April 2010 the FSC filed a public interest petition for the winding up of the Bank and on 9th April TCI Bank was put into provisional liquidation. There appears to be no issue between the parties that the Bank is also insolvent.

In my fuller oral rulings of 9th April 2010 and 28th April 2010, in great detail, I set out the sorry state of affairs that led to this Court feeling compelled to place the Bank into provisional liquidation. I have regard to the contents of those rulings but I need not now set them out again for the purpose of this ruling This are clearly not a straight forward liquidation proceedings, unnecessarily made even more complex by the regrettably still inadequate and outdated local legislation is relation to the windingup of companies.

The proceedings have dragged on for longer than one might ordinarily expect or wish. The Court has allowed this approach, as I have throughout this troubling process been extremely anxious for the parties to explore all reasonable avenues for the possible rescue of the Bank; for the sake of the contributories, creditor's and, without wishing to over-exaggerate, for the sake of the whole economy of the TCI.

There have been problems and hurdles during this process, but `at the eleventh hour' it does appear that there may be an acceptable offer from a group, who have been referred to as the ECIC Banks. It is this offer that the parties wish the Bank's creditors to consider at a meeting to be arranged. The bank accounts held in the name of Hallmark fall into this

Ms Benjamin's submissions were initially primarily based on the Proceeds of Crime legislation in England and Wales. It is also contended that the assets captured under the July 10th restraint order never formed a part of the liquidation estate of TCI Bank and as the restraint order predated the liquidation the restraint order takes priority over the creditors in the TCI Bank Liquidation.

Ms Benjamin initially relied upon S426 (2) (a) Proceeds Crime Act 2002 ("PCA"), England and Wales and contended that the general approach is that priority between the restraint powers and a trustee in bankruptcy or liquidator is determined by whether the liquidation or restraint order predates the other. Of course, we have a similar section, Section 52 of POCO. I respectfully suggest that it is this section that Mrs Benjamin should have referred to. The two sections are similar and serve the same purpose.

By S426 (2) (a) PCA, where a court has made a winding up order or the company passes a resolution for its voluntary winding up, the functions of the liquidator (or any provisional liquidator) may not be exercised in relation to property subject to a restraint order made before the relevant time. S426(9) PCA defines the relevant time. I need not for purposes of today outline those. In other words where any order capable of being made under the PCA has been made against the property of a company or an insolvent partnership any order subsequently made for its winding up, or for the appointment of a provisional liquidator, or for the subsequent passage of a resolution for its voluntary winding up, the functions of the liquidator, or the provisional liquidator, shall not be exercisable with respect to any of the property already subject to those orders under the Act.

However, as the parties' submissions progressed, Ms Benjamin accepted that S426 (2) (a) PCA and our S52 did not apply to the situation we face in this matter, as no winding up order has to date been made. It is also accepted that, even if a winding up order had already been made, that the Company the section applies to would be Olint and the relevant liquidator would be Olint's Liquidator rather than TCI Bank and its Provisional liquidator. Ms Benjamin commendably indicated that she no longer wished to pursue this part of her submissions. If she had, I can indicate that I do not accept that the English provision applies in TCI and in fact similarly neither does S52 to the winding up of TCI Bank in these proceedings. S52 may, of course, possibly apply to the Liquidator in the Olint Winding up.

In light of Ms Benjamin's concession, I therefore need to concentrate on the 2nd part of her submissions. These had been touched on in the earlier part of her presentation but were elaborated upon further after the court had heard from Mr Misick QC. It is submitted that the effect of the restraint order was to make TCI Bank the trustee/custodian of the assets held by the bank on behalf of Olint, Hallmark and the Smiths. Reliance is placed on Re M 1992 1 AER 537 where Otton J stated;

"The property to which the restraint order applies is no longer to be considered a part of the defendant's estate. He holds only a notional title to such a property. All dealings with the property are to be held in abeyance until such time as the defendant is acquitted or a confiscation order is made and satisfied........”

Outten J then continued; “The purpose then is in short to make the value of the realizable property and, by its realization, to satisfy the confiscation order.”

Ms Benjamin elevates this extract from the judgment to support a contention that the property has become that of the Crown. I do not accept that contention.

Ms Benjamin concludes by stating the Crown do not intend to apply for a variation of the Restraint order. It is contended by Ms Benjamin that if any step is to be taken in respect to the restrained property that an application for a variation order needs to be made.

Before I move onto comment upon the Position of the NIB, I would just like to add a general comment. This is an extremely important case, not only for the Bank and its creditors but potentially for the whole economy of TCI. If the Crown's position is correct and upheld, then a proposed Scheme of Arrangements will most likely not be able to be put in place, resulting in no viable rescue package and the stripping of the security from the debenture held in favor of NIB and dire consequences for the bank's creditors. These are not factors for me when considering how I must rule on the issues before me today, but they may be factors for the crown to consider when it takes the position it does.

As Ms Benjamin has oft reminded me, her resources for research at Chambers are very limited. I am extremely sympathetic to the difficulty that has given her when preparing for a matter such as this. I only note in passing that this is a novel point of law in this jurisdiction where, as I have already mentioned, the Companies Ordinance has not kept pace with the requirements caused by the downfall in the economy and the resultant explosion of winding up proceedings and by its relationship with the advent of the Proceeds of Crime legislation. I am aware that the SIPT team have taken over the Criminal investigation involving the Smiths. It will be, of course, the hitherto unknown outcome of those proceedings that will determine whether the restraint order will be a procedural stepping stone to a confiscation

order. I have noticed the presence of a member of the SIPT team in Court. With the limited resources that Ms Benjamin has frequently told me have hindered her preparation for this application, I do hope that SIPT have been able to assist her with this application by imparting their highly specialised knowledge of Proceeds of Crime legislation and its application to the situation we find ourselves in. The Court may have been greatly assisted by such informed submissions when reaching a decision, the consequences of which could potentially lead this Bank being placed into liquidation and thereby possibly seriously diminishing these restrained assets, risking the NIB debenture and leaving the creditors with little to hope for. What is clear, is that when determining issues such as those before me, the Court must not run off on a frolic of its own and, in the absence of clear statute or case law, the Court must make its ruling based on the submissions received from Counsel. Interestingly, the proposed `rescue package' in this matter far from diminishing the restrained funds may arguably better secure them.

The position of NIB NIB are creditors and contributory of TCI Bank. Mr Misick QC makes submissions today on their behalf and on the behalf of a number of the interested parties in this matter. They, save for the FSC and Provisional Liquidator (who both take neutral stances), all oppose the Crown's position. They are all of the view that the debt owed to Hallmark is to rank the same as all other unsecured debt of the Bank and is behind that of the NIB who is a secured creditor. They all reject the proposition that the restraint order confers on the Crown any priority over the Bank's assets. I should say that today I have also heard very briefly from Mr M. Green and Mr G. Chapman Mr Misick QC rightly contends that the relationship between the Bank and Hallmark is the traditional one is such circumstances, namely one of debtor and creditor. TCI Bank was free to use the deposits as they wished and Hallmark had no interest in the assets of the Bank. It is rightly submitted that it is immaterial that Hallmark held the deposits as trustee.

Mr Misick QC invited the Ct to look closely at the provisions of POCO. The lack of time does not permit me to repeat the same herein. However, his review of the relevant statutory provisions set out in paragraphs 15 to 20 of his helpful skeleton argument is correct. Mr Misick QC then went on to apply the principles set out in his review to the current matter and he submitted;

i) Given that none of the assets of the bank are beneficially owned by Hallmark, Olint or the Defendants the assets of the Bank are not capable of being restrained by the restraint order. The assets of the Bank are not realizable property of the Defendants or that of any recipient of a tainted gift. The Bank is not a defendant in the Criminal proceedings. I agree with these submissions

ii) The Bank does not hold any interest in any assets of Hallmark, Olint or the Defendants caught by the restraint order. I agree with this submission

iii) As the Bank is not a defendant in the criminal proceedings there is no possibility of a confiscation order may be made against the Bank - I also agree with this submission. iv) The Bank's obligation under the order is not to assist the Hallmark, Olint or the Defendants to breach the restraint order. Save for that the Bank that is entitled to deal with its creditors in the

normal way. I agree with this submission.

I accept that if there had been no POCO proceedings Hallmark, Olint and the Defendants would only be able to make a claim as an unsecured creditor. The restraint order does place the Crown in a more advantageous position than that. However, it does enable the Crown to step in, to use Ms Benjamin's phrase as "caretaker", if they feel that the Bank is not acting in compliance with the order, for example namely by facilitating a breach by the restrained entity.

With the debt/creditor relationship that a bank has with its clients — the monies paid into the bank go into to mixed finds. This is the way that banks ordinarily operate. If a restraint order is made restraining a person's accounts containing any amount, but say for the purposes of today $9.5 million, a Bank cannot be expected, immediately upon service of the order, to be able to place that sum in a separate untouchable account. It is unlikely having regard to the fluid way that banks utilise their available capital, especially a small bank in a small jurisdiction, that a bank would immediately be able to do segregate such a sum. If the Crown are right in their contention then a bank, once a restraint order has been made, would invariably then be in breach of an order if it did not segregate the relevant amount. As such on submissions before me, I find that the restraint order does not confer on the Crown a preferential right to payment out of the assets of the Bank in priority to all other creditors secured or unsecured. There is nothing in the submission put forward by Ms Benjamin that take away from the general principles accurately outlined by Mr Misick QC.

I apologise for not reserving and later handing down a polished written ruling, but you will understand why I have had to make a quick decision and to let you know why I have reached the same. However, I trust that this extempore ruling, made in this form having regard in the limited time that is available to us, with a hearing dealing with the creditor's meeting to immediately follow, are sufficient to enable the parties to see my reasoning.

Having made the above findings, I go on to find that under S84 Companies Ordinance I do have the jurisdiction to impose the Scheme on Hallmark. Hallmark is not a secured or preferential creditor.

On the submission made before me I do feel that an application to vary the restraint order should be made. At this stage, I do not know whether that would result in a fully contested hearing or not. The Crown say they will review their position depending on what course they seek to take after having a chance to review the decision I have made today. At the hearing scheduled for September, I may consider the variation issue again and parties may make further submissions concerning the same if they wish. This ruling will appear in my notes, forming part of the Court record. If requested this part of my notes can be made available. It will be in note form and therefore will not have the grammatical and written refinement one would expect to see in a handed down written ruling. Time has not permitted me to take that course. We will deal with issue surrounding the proposed creditor's meeting at the hearing scheduled for this Friday.

LE REVE presents “MARDI GRAS

Organizers of the Le Reve Gala Ball, a charitable event will be hosting their fourth annual prestigious gala event in Providenciales, the jewel of the Turks and Caicos Islands. Preparations are well under way, and the theme for this year’s event is “Mardi Gras”. With the masquerades, parade and theatrics of a carnival, guests will be transported to the drama, richness and grandeur that is Bourbon Street in New Orleans’ French Quarter. The residents of Grand Turk celebrated Emancipation Day with a grand parade, an Ecumenical service and cultural show. Organized by Director of Culture, David Bowen and the Staff of the Cultural & Arts Commission, Angela Freites & Barbara Johnson, the event is part of CAC's ongoing effort to highlight the cultural heritage of the Turks & Caicos Islands.

A group of 25 young persons ranging from 5 years to 14 dressed in hand made masquerade costumes lead by Cultural Officer Angela Freites clad in her National dress, gathered at the West Gate of the Parade Grounds. Along with Governor Wetherrell, Consultative Forum Chairman Lillian Missick and a number of residents on foot and in cars waving flags, singing and dancing to the rhythm of Grand Turk Ripsaw musicians, they all paraded down Mission Folly then along historic Front Street to the Odd Fellow Lodge where the original Emancipation Proclamation was read on August 1. 1834. Beaches TCI goes green

Beaches Solar Energy

Once you open the sliding doors to the patio overlooking the Caribbean Sea, the faint hum of the air-conditioning unit stops. It's barely audible, but if you stay outside a while you'll notice the change in temperature in the room when you get back. The automatic NC switch-off feature is one of a raft of environmentally friendly ones practiced in all three villages -French, Caribbean and Italian -at the luxury Beaches Turks and Caicos on Providenciales. That, along with partial solar energy use, a keycard light control system and a tap-installed aerator, forms part of the hotel's utility plan which it hopes will result in savings of up to 20 per cent of its hefty US$750,000 energy bill. There are two sets of photovoltaic panels at the hotel. They provide energy for the pools, the NC system, and the back of the house which includes staff locker rooms, storerooms, laundry and housekeeping. The light control system allows you to switch the lights on and off once the room

entry keycard is inserted into a magnetic slot by the door. Pulling the card out turns the lights off all at once. "As a result (of these measures), we have been able to save 8.5 per cent from total energy costs and the aim is to achieve another 12 per cent," former executive assistant manager Florian Seifert told Environment Watch. Seifert, who now operates from another Beaches property, was in charge of environmental health and safety, security, transportation, among other things, at Beaches Turks and Caicos. But the money to be saved, though it cannot be understated, is not the only benefit of the green practices. "Our aim and our promise to our guests and team members is to deliver a safe, clean environment and to ensure that they are not getting hurt and that they can enjoy their jobs," Seifert said. "At every staff meeting we have we try to encourage people to become environmentally friendly. If the company is

environmentally successful, we can have more jobs (because) everything you do in saving money for your company secures jobs in the area or village." Other measures the hotel uses to ultimately decrease costs and do a good turn for the environment, are recycling, paper shredding, composting and using locally produced fish fertilizer. "It smells terrible," Seifert admitted. Beaches Turks and Caicos also has its own desalination plant -since there is no fresh water source in the TCI -and uses the waste/grey water for irrigation. "And we only use approved and certified Green Glob e 21 products to ensure the environment stays clean," Seifert said. The resort also takes its environmental programme into the water. Fourteen miles of Providenciales' north coast, close to where the hotel is located, is a marine park. That means guests aren't allowed to interfere with the underwater flora or fauna, especially not the coral reef. To give its guests an alternative, the hotel's water sports team implemented an artificial reef using shells, rocks and concrete, through the nonprofit Reef Ball Foundation. The reef units, called reef balls, have a rough surface to encourage settling by marine organisms such as corals, algae and sponges. "It gives guests an alternative as they won't have to walk 10 minutes down the coast to the marine park and it's a way to protect the endangered coral reef:" director of water sports Michael Clarke said. Clarke, a Jamaican, is confident reef balls could be used in a similar fashion in Jamaica. "It could work tremendously in Jamaica. I think we could have one of these in every hotel in Jamaica. Guests go to Jamaica not only for the ocean; they go for the vegetation and tropical fish .But unfortunately, when in Jamaica we don't see any tropical fish. If Government had put stringent rules and policies are in place, this wouldn't have happened," he said.

The beloved 8-foot tall yellow-feathered bird joined his furry friends – Elmo, Zoe, Grover, Cookie Monster, Abby Cadabby, The Count and Bert & Ernie at Beaches Resorts to join in the fun with brand new stage shows, weekly parades, character breakfasts and exciting activities throughout the resorts. The iconic Sesame Street character has flown into Beaches where he is thrilling thousands of visitors to the island's premier resort. Fans young and old have been queuing up to meet, greet, high-five and have photographs taken with their television hero. Animation Manager, Lucy Contreras, said: "It's fantastic to have Big Bird at Beaches and he has received such a warm welcome from everyone he has met. "People love Sesame Street and Big Bird is the character that everybody loves the most." Big Bird has been given the coveted job of leading the famous Beaches Parade, which takes place in the resort grounds, every Tuesday night. "The parade is one of our most popular events", added Lucy," and who better to lead it than Big Bird? "He also has a very busy schedule during the rest of the week and will be appearing at character breakfasts, stage shows and lots of other exciting activities, including the all new Bird Bird's Beach party." After making his Beaches Parade debut, there was no doubt that the huge yellow bird was proving a popular addition to the line-up. Six-year-old Holly Delrose from Texas said: "Big Bird is so enormous and so friendly. He's really cute and I had my picture taken with him." Meanwhile Jake Thompson, 9, from Scotland, added: "My dad bought me some Sesame Street DVDs last year and my sister and I are now big fans of the show. It's one of the reasons we came to Beaches, to see all the characters. "But we didn't know Big Bird would be here and so we were really happy to see him because it was a big surprise."

STALLONE TURNED DOWN DWTS INVITE

Sylvester Stallone turned down an invite to appear on Dancing With The Stars, according to reports. The Expendables star was approached to take part in the 11th series of the dance show - the US version of Strictly Come Dancing - but decided not to strut his stuff, an unnamed source told The Hollywood Reporter. Other celebrities who passed on their invitations include entrepreneur Richard Branson, actor Tim Allen, former US Secretary Of State Condoleezza Rice, actress Kirstie Alley and Community actor Joel McHale. Among the names participating in the upcoming season are David Hasselhoff, The Hills' Audrina Patridge, Michael Bolton, Brandy and Dirty Dancing actress Jennifer Grey. Michael Douglas reveals throat cancer at stage 4

LOS ANGELES — Michael Douglas said he felt optimistic about recovering from throat cancer but drew gasps when he told a television audience he had the most advanced stage. The 65-year-old "Wall Street" actor told talk-show host David Letterman that a biopsy indicated that his cancer was at stage 4, which he described as "intense, and so they've got to go at it ..." Letterman asked whether stage 4 was a good diagnosis. "Um no," Douglas replied, according to a transcript provided by CBS' "Late Show with David Letterman." "You like to be down at stage one ... but it has not — the big thing you're always worried about is it spreading." Stage 4 cancer has spread far beyond the original tumor and is usually impossible to cure. Douglas said he has at least an 80 percent chance of recovery. "And with certain hospitals and everything, it does improve." "You've never looked better to me,

Paris Hilton’s need to have moisturized lips over the weekend directly led to the cocaine in the purse she was carrying literally dropping into a Las Vegas Police Officer’s hands, according to the newly released police report. In the document, obtained by Access Hollywood, an LVPD officer detailed how the cocaine discovery happened in the Wynn Hotel security holding room where the heiress was waiting for a female officer to arrive to take her to the bathroom. “… Hilton said she needed to put some lip balm on, and I handed her the purse from the table. As she began to open it, I saw a small bundle of what I believed to be cocaine in a clear baggy begin to fall from the purse and into my hand,” an officer wrote in his arrest report. The officer then took the purse away from Hilton and waited for backup to arrive before searching it with another officer as a witness. As previously reported on AccessHollywood.com, Hilton and her boyfriend, Cy Waits, were pulled over in Las Vegas on Friday night after a police officer allegedly noticed a strong smell

of marijuana coming from the car Waits was driving. According to the report, the officer claimed Waits failed a number of field sobriety tests after the couple was pulled over. The officer claimed in his report that the gathering of a crowd of onlookers prompted Hilton to ask to go somewhere more private to “prevent her from being molested by the growing crowd.” After discovering the cocaine, the officer placed Hilton under arrest. Following her arrest, the officer claimed Hilton told him the purse was not hers and “she had borrowed it from a friend.” As the officer searched the rest of the bag, he discovered $1,300 in cash, credit cards and a broken Albuterol tablet (used to treat breathing and chest tightness) and Zig Zag wrappers, all of which Hilton reportedly claimed to the officer were hers. She reportedly told the officer, however, that “several cosmetic items inside the purse were not hers “and that she thought the cocaine he found was “gum.” The Clark County DA's Office confirmed to Access on Monday that Hilton has now been charged with

T.I. AND WIFE ARRESTED ON DRUG CHARGES

Rapper T.I. (né Clifford Harris Jr.), 29, and his wife, Tameka Cottle, 36, were arrested last night in L.A. after police detected marijuana coming from their car at a traffic stop in West Hollywood, confirms Deputy Luis Castro of the L.A. County Sheriff’s Headquarters Bureau. Authorities subsequently searched T.I.’s car and arrested the couple for possession of a controlled substance. (Officials have so far declined to specify the drug involved.) T.I. and Cottle, who were married July 30, posted $10,000 bail and were released this morning. T.I.’s label rep is not offering a statement at this time. Less illegal Caribbean immigrants in US

WASHINGTON, United States – A new report has found that the number of Caribbean and other illegal immigrants living in the United States has declined for the first time in two decades. The report, issued yesterday by the Pew Hispanic Center, a Washingtonbased independent research group, is based on an analysis of 2009 census data. It attributes much of the decline to a sharp drop-off in illegal immigrants from the Caribbean, Central America and South America. It said that illegal immigrants decreased by eight per cent as jobs declined in America because of the

For two pesos, the equivalent of nine U.S. cents, the state-owned Yara movie theater in the heart of Havana offered Cubans a washed out and pixilated copy of Kutcher's adventures as a CIA assassin who is himself targeted for a hit. "It's a very good flick. We just got it on DVD," says a woman in the ticket office. The problem is that "Killers" will not be officially released on DVD in the United States until September 7 and even then Cuba will be off limits due to the 48-year-old U.S. trade embargo against the Caribbean island. But half a century of U.S. sanctions have turned Cuba into a piracy haven and a missed opportunity for U.S. businesses. Even though the embargo forbids U.S. companies like Microsoft from exporting software to Cuba, most personal computers on the island run unlicensed copies of its Windows operating system. GEORGETOWN, Guyana — Thousands of Amerindians living with few amenities deep in Guyana's Amazon jungle will soon have free access to computers and the Internet, officials say. Guyana President Bharrat Jagdeo said government-built computer centres will serve an estimated 65,000 Amerindians and help improve medical services for doctors in remote regions by allowing them to communicate via e-mail with staff in urban hospitals. Solar panels also will be installed to ensure villages have an alternate power source, Jagdeo said late Wednesday as he celebrated the start of Amerindian Heritage Month. The computers will be installed by next year, he said. Jean LaRose, spokeswoman for the Guyana President Bharrat Jagdeo Amerindian People's Association, said the computers will improve living standards but she warned of political motives. "It is an essential service that everybody needs, but we are well aware that gifts to Amerindians in heritage month" will be used to sway prospective voters, she said. Some of Guyana's nine Amerindian tribes already have access to the Internet, especially those living in border areas near Brazil, Venezuela and Suriname. Those who live in central Guyana and along river banks do not, and are expected to benefit from the centers, which are part of a previously announced program that aims to distribute 90,000 computers to the poor. A new fibre-optic cable network that was installed in January and runs from Suriname to Guyana will help provide high-speed Internet service, the president said. Oil spill seen in Gulf platform explosion

An oil and gas platform in the Gulf of Mexico exploded on Thursday, setting off a blaze and a small oil spill, but the accident does not appear to be as serious as BP's deadly rig explosion and oil spill in April. The U.S. Coast Guard said an oil sheen of 100 feet by 1 nautical mile has been reported at the site. All 13 crew members on the burning platform were evacuated to another offshore platform, the U.S. Coast Guard said. The fire has been contained but is not yet extinguished, the Coast Guard said. The crew did not suffer any injuries, said platform and field operator Mariner Energy. The platform is located more than 90 miles south of Louisiana's Vermilion Bay, west of BP Plc's ruptured Macondo well that killed 11 people and caused the world's worst offshore oil spill. At the moment, the accident does not appear to be another BP-style disaster, said Raoul LeBlanc, a senior director at PFC Energy in Houston. "If it's an industrial accident and doesn't involve a well it's obviously still bad, and we hope that no one has been hurt, but it's unlikely to have long-term implications for production in the Gulf of Mexico," LeBlanc said. The platform, located in 340 feet of water, was undergoing maintenance and was not in active production, the U.S. Interior Department said. The platform was authorized to produce oil and natural gas. The cause of the explosion was not known. The facility averaged 9.2 million cubic feet of natural gas per day and 1,400 barrels of oil and condensate per day during the last week of August, Mariner said. He stands before a cheering Elkhart high school gymnasium in August 2008, tireless, aspirational, promising a new America of jobs and hope. "We can choose another future," says the newcomer with the funny name. "So I ask you to join me." Today that view of Obama is harder to find in Indiana. A couple of weeks back and a dozen miles west of Elkhart, hundreds gathered in another school gym - except this time it was for a job fair. With the local unemployment rate above 12% and rising again this summer, about a third of the employer display tables stood empty. Julie Griffin, who voted for Obama in '08, sat down at the room's edge, well dressed and discouraged. After 23 years as a payroll administrator at a local RV plant, she got laid off 18 months ago. "Really, what has he been doing?" she said when I asked about Obama's efforts to help people like her. "I guess I don't know what he is doing." Across the gym floor, Joe Donnelly, Elkhart's pro-life, pro-gun Democratic Congressman, worked the crowd. He was part of the moderate wave that won Congress for Nancy Pelosi in '06, and he was reelected with 67% of the vote while campaigning for Obama in '08. The President has since returned to the region three times, but Donnelly is nonetheless fighting for his political life. In a recent television ad, an unflattering photo of Obama and Pelosi flashes while Donnelly condemns "the Washington crowd." This is basically a Democratic campaign slogan now: Don't blame me for Obama and Pelosi. "I'm not one of them," Donnelly told me when I caught up with him. "I'm one of us." This shift in perception - from Obama as political savior to Obama as creature of Washington - can be seen elsewhere. When Obama arrived in office in January '09, his Gallup approval rating stood at 68%, a high for a newly elected leader not seen since John Kennedy in 1961. Today Obama's job approval has been hovering in the mid-40s, which means that at least 1 in 4 Americans has changed his or her mind. The plunge has been particularly dramatic among independents, whites and those under age 30. With midterm elections just nine weeks off, instead of the generational transformation some Democrats predicted after 2008, the President's party teeters on the brink of a broad setback in November, including the possible loss of both houses of Congress. By a 10-point margin, people say they will vote for Republicans over Democrats in Congress, the largest such gap ever recorded by Gallup. White House aides explain this change as a largely inevitable reflection of the cycles of history. Midterms are almost always bad for first-term Presidents, and worse in hard times. "The public is rightly frustrated and angry with the economy," says Dan Pfeiffer, Obama's communications director, explaining the White House line. "There is no small tactical shift we could have made at any point that would have solved that problem." In more confiding moments, aides admit that the peak of Obama's popularity may have been inflated, a fleeting result of elation at the prospect of change and national pride in electing the first African-American President. As one White House aide puts it, "It was sort of fake." But while these explanations may be valid, they are also incomplete. A sense of disappointment, bordering on betrayal, has been growing across the country, especially in moderate states like Indiana, where people now openly say they didn't quite understand the President they voted for in 2008. The fear most often expressed is that Obama is taking the country somewhere they don't want to go. "We bought what he said. He offered a lot of hope," says Fred Ferlic, an Obama voter and orthopedic surgeon in South Bend who has since soured on his choice. "He's trying to Europeanize us, and the Europeans are going the other way," continues Ferlic, a former Democratic campaign donor who plans to vote Republican this year. "The entire American spirit is being broken."

One explanation for Obama's steep decline is that his presidency rests on what Gallup's Frank Newport calls a "paradox" between Obama and the electorate. In 2008, Newport notes, trust in the federal government was at a historic low, dropping to around 25%, where it still remains. Yet Obama has offered government as the primary solution to most of the nation's woes, calling for big new investments in health care, education, infrastructure and energy. Some voters bucked at the incongruity, repeatedly telling pollsters that even programs that have clearly helped the economy, like the $787 billion stimulus, did no such thing. Meanwhile, the resulting spike in deficits, which has been greatly magnified by tax revenue lost to the economic downturn, has spooked a broad sweep of the country, which simply does not trust Washington to responsibly handle such a massive liability.

THE OVERREACH Rather than address these concerns as the economic crisis grew, Obama made a conscious choice to go big with government reforms of health care and energy. The bailouts of the auto companies, the rescue of Wall Street and the new regulation of banks and the financial industry only deepened the public's skepticism, especially among independent voters. Rather than dwell on the political problems, the President pushed his team forward, believing, in the words of top adviser David Axelrod, that "ultimately the best politics was to do that which he thought was right." It wasn't long before deep cracks in Obama's coalition began to appear. This past June, Peter Brodnitz of the Benenson Strategy Group, a firm that also polls for the White House, asked voters which they preferred: "new government investments" or "cutting taxes for business" as the better approach to jump-start job creation. Even among those who voted for Obama, nearly 38% preferred tax cuts. When Brodnitz offered a choice between tax cuts to reduce the deficit and investments in "research, innovation and new technologies," one-third of Obama voters chose the cuts. It's not as if the White House didn't see this coming. After a meeting in December 2008 about the severity of the economic crisis, Axelrod pulled Obama aside. He recalls saying, "Enjoy these great poll numbers you have, because two years from now, they are not going to look anything like this." But even as Obama aides were aware of a growing disconnect, it didn't seem to worry their boss. Instead, the ambitious legislative goals usually trumped other priorities. Both in the original stimulus package and

then in the health care and energy measures, the White House ceded most of its clout to the liberal lions who controlled the Democratic majorities in the House and Senate. That maneuver helped assure passage of reforms, but it also confirmed some of the worst fears about how Washington works. "I'd rather be a one-term President and do big things than a twoterm President and just do small things," he told his team after Republican Scott Brown was elected Senator in liberal Massachusetts and some in the Administration suggested pulling back on health reform. For someone who so carefully read the political mood as a candidate, Obama has been unexpectedly passive at moments as President. Whereas other Democrats had hoped to spend the late summer talking about two things - jobs and the unpopularity of many Republican policies - the White House has been distracted by a string of unrelated issues, from immigration reform to a mishandled dismissal of a longtime USDA official to the furor over the proposed Islamic cultural center and mosque near Ground Zero. On Aug. 31, Obama gave a prime-time speech about the partial troop pullout from Iraq, touching on jobs only tangentially, before spending the following day in an intensive effort to restart the Middle East peace process. "It is inconceivable that a team so disciplined during the presidential campaign can't carry a message with the bully pulpit of the White House," says one Democratic strategist working on the midterm elections. "It's politically irresponsible, and Americans have little patience for it." As his poll numbers fell, Obama responded with his perpetual cool. His appeals to the grass-roots army that he started, through online videos for Organizing for America, took on a formal, emotionless tone. He acted less like an action-oriented President than a Prime Minister overseeing some vast but balky legislative machinery. When challenged about his declining popularity, the President tended to deflect the blame - to the state of the economy, the ferocity of the news cycle and right-wing misinformation campaigns. Aides treated the problem as a communications concern more than a policy matter. They increased his travel schedule to key states and limited his prime-time addresses. They struggled to explain large, unpopular legislative packages to the American people, who opposed the measures despite supporting many of the component parts, like extending health insurance to patients with preexisting conditions or preventing teacher layoffs. "When you package it all together, it can be too big to succeed as a public-relations matter," says Axelrod. Continued on Next Page

Instead of shifting course, Obama spoke dismissively about Republican efforts to play "shortterm politics." He continued the near weekly visits to new green energy manufacturing plants, repeating promises of an economic rebirth that remains, for many, months or years away. And he missed opportunities to strengthen his connections with his supporters: local political capos complained privately that Obama had a tendency to touch down in their backyards, give a speech and scoot after less than an hour. By the end of the summer, the disconnect had grown so severe that only 1 in 3 Americans in a Pew poll accurately identified him as a Christian, down from 51% in October 2008. At the same time, the base voters Obama had energized so well in '08 went back into hibernation. They were nowhere to be found in the '09 gubernatorial elections in New Jersey and Virginia, tracking instead with pre-Obama historical patterns. CAN HE REBALANCE? At the White House, advisers take comfort in the fact that at this point in their presidencies, both Ronald Reagan and Bill Clinton scored slightly lower approval ratings than Obama. And the dominant analogy for the past few months has focused not on 1994, when Clinton lost a Democratic Congress in a huge Republican wave, but on '82, when Reagan lost just 26 seats in the House. Like Obama, Reagan was facing rising discontent at the midterm, driven by huge unemployment numbers that peaked at 10.8% at year's end. But as the economy rebounded, Reagan's governing philosophy, "Stay the course," was vindicated. He won re-election by an enormous

margin. Outside the White House, only a few of the President's Democratic allies take much solace in this history, in part because the current economic slump appears far more lasting than the one Reagan faced. Most experts from both parties say Obama will have to rebalance his politics in 2011 to be re-elected in '12. That's partly because of the growing belief that the Republicans will win the House in November and, if their stars align, have a good shot at taking the Senate as well. Elsewhere, in state houses and in governors' races, Republicans are poised for a broad comeback. Regardless of the exact outcome, it is clear that Obama's brief window of one-party rule has closed. But two years is the equivalent of multiple lifetimes in politics, and there are signs that Obama is already pivoting away from plans to engineer massive reforms in energy policy, global-warming response and immigration law to less-stirring, more-popular challenges like reducing the deficit and reforming taxation and entitlements. What little margins Obama does have to push major reforms through are sure to shrink away in the coming months. "I think the next couple of years, we've got to focus on debt and deficits," Obama told NBC News after his summer vacation. "We've got to focus on making sure that we make the recovery stronger. And a lot of that is attracting private investment." Back in Indiana, the evidence of Obama's political failure is particularly glaring. During his early, heady days in office, the President decided to make Elkhart a personal cause. A once thriving manufacturing center of 50,000 on the Michigan-Indiana border, famous for its musical instruments and recreational vehicles, the Elkhart region saw the steepest jump in

unemployment of any metropolitan area in the nation during the economic crisis. That helped Obama win Donnelly's district by 9 points, nearly George W. Bush's margin in 2004, and Obama returned to Elkhart just weeks after taking office. "I promised you back then that if elected President, I would do everything I could to help this community recover," he announced. "And that's why I've come back today." Since then, he has been back twice more, once to speak at Notre Dame and once to herald a new electric-vehicle plant that would be built with federal support. In the southern end of the district, thousands of jobs at parts plants were saved when Obama decided to bail out the auto companies. Yet all of Obama's personal and financial appeals have been swamped by the depth of the recession and have had little visible effect. Donnelly, who flies home every weekend to work in his district, felt obliged to run against Obama to save his job. And his Republican opponent, Jackie Walorski, says she is often approached by Obama voters who want to vent. "This has burned people," she says. "Their words, not mine: 'Betrayed by the health care vote.' 'What are they thinking when it comes to spending?' 'Broken promises when it comes to jobs.'" For now, Obama's aides hope that the controversial reforms in health care and financial rules will produce benefits felt by voters, if not by November 2010, then two years later. That would vindicate the President's vision of government as a solution and not just a problem. Even in Indiana, the disappointment is matched by a real yearning for a leader who can make a difference. "I think he's trying," says Griffin, the laidoff payroll administrator who said she didn't know what Obama had done for her. "Nobody can turn it around overnight."

Hamburger chain being offered $24 a share by private equity firm 3G Burger King Holdings Inc., America's perennially No. 2 hamburger chain, said that it is selling itself to littleknown private equity firm 3G Capital in a deal valued at $3.26 billion. Its shares soared to an 18-month high. The $24-a-share agreement is 46% more than Burger King shares closed at on 31 August, the day before rumours of a deal surfaced and sent the shares soaring by 15%. Alex Behring, managing partner of 3G Capital, said: "We have great respect for the Burger King brand and the strong business that management, the employees and the franchisees have built. The brand, its solid franchisee network and great product offerings make this a perfect fit for 3G Capital, which has a strong track record of long-term investments in global consumer brands and retail companies." 3G Capital has raised debt from JPMorgan Chase Bank and Barclays Capital to acquire the fast food chain,

which has been hit hard by the global financial slowdown, with sales under pressure in the US from rising jobless numbers and declining consumer confidence. Last week the company said worldwide sales this year were down 2.3%, compared with an increase of 1.2% last year. Sales in North America

were down 3.9%. Bitter rival McDonald's, however, has fared better: its global sales in the second quarter were up 4.8%, with US sales up 3.7%. BK's chairman and chief executive, John Chidsey, who will stay in his role during a transition period before becoming co-chairman with Behring, added: "We are committed to

maintaining the superior guest experience the Burger King system is known for around the world as we transition ownership." The deal represents the second time the 55-year-old chain has been owned by buyout specialists after it was spun out of then owner Diageo in 2002 by Texas Pacific, Bain Capital and Goldman Sachs in a $1.5bn deal ( worth ÂŁ950m at the time). They floated the company four years later but retained just under a third of the shares. The deal also marks another example of Brazil's increasing power as a corporate player. Behring is the right-hand man of fellow Brazilian Jorge Paulo Lemann, having previously worked at the buyout firm the 71-year-old billionaire founded. Lemann and three of his fellow directors at Anheuser-Busch InBev, the world's largest brewer, are also directors of 3G. Under the terms of the agreement, Burger King can solicit superior bids until 12 October.

IMF, World Bank step up aid to Pakistan

WASHINGTON – The IMF and the World Bank have stepped up aid to flood-hit Pakistan to help the country cope with its worst-ever humanitarian disaster, officials said Thursday. IMF chief Dominique Strauss-Kahn said the fund "will provide around 450 million dollars in immediate emergency financing" to Pakistan to help manage the aftermath of devastating floods that have affected 18 million people. Pakistani and IMF officials have been holding talks in Washington for more than a week after Islamabad warned they would not be able to meet key IMF targets on inflation and budget deficit levels. Pakistan agreed to the terms in 2008 in return for a 11-billion-dollar "stand-by" loan, 7.3 billion dollars of which had already been pledged. "Our dialogue with Pakistan on the current stand-by arrangement is progressing and the authorities have expressed their intention to implement measures for the completion of the fifth review of the program later this year," Strauss-Kahn said. "Completion of the fifth review will allow the fund to disburse an additional 1.7 billion dollars, bringing total IMF disbursements (including emergency assistance) to 2.2 billion dollars in the second half of 2010," Strauss-Kahn said. He made the aid announcement after meeting with Pakistan's finance minister Abdul Hafeez Shaikh. "Pakistan remains committed to the reform efforts that will put public finances on a sustainable basis and lay the foundations for growth," Shaikh said.

Unprecedented floods have affected more than 18 million people

The World Bank said separately it would raise its flood-related support to one billion dollars from 900 million dollars. The money will come from the bank's fund for the poorest countries and the loans are concessional and carry no interest payments. "As the surging Indus River devastates Pakistan, the country needs the world's support to meet urgent humanitarian needs: food, clean water, sanitation facilities, medical and nutritional supplies, and vaccines," bank president Robert Zoellick said. "At the same time, Pakistan's reconstruction and recovery also require long-term support. The World Bank is committed to helping the people of Pakistan during this time of need and has made one billion dollars available to finance immediate recovery

needs and longer-term reconstruction," he said after talks with Shaikh. The unprecedented floods in Pakistan have engulfed an area the size of England, affecting more than 18 million people, including eight million who are dependent on aid handouts to survive. The scale of the disaster is so large that a month after the deluge, many are complaining of going without food or water for days. Pakistan's Prime Minister Yousuf Raza Gilani, whose government has come under fire for its handling of the crisis, said Wednesday the flooding had caused economic losses of 43 billion dollars. He said Pakistan faced inflation of up to 20 percent and slower economic growth, warning of job losses and social unrest.

WASHINGTON — Federal Reserve Chairman Ben Bernanke told a panel investigating the financial crisis that regulators must be ready to shutter the largest institutions if they threaten to bring down the financial system. "If the crisis has a single lesson, it is that the too-big-to-fail problem must be solved," Bernanke said Thursday while testifying before the Financial Crisis Inquiry Commission on the second day of the hearing. Bernanke is presenting his analysis of the crisis and views on potential systemwide risks as the panel approaches the end of its yearlong investigation into the Wall Street meltdown. The Fed chief said bailing out these institutions is not a healthy solution and that great improvement will come from the new financial overhaul law. It empowers regulators to shut down firms whose collapse pose a broader threat to the system. "Too-big-to-fail financial institutions were both a source ... of the crisis and among the primary

impediments to policymakers' efforts to contain it," Bernanke told the bipartisan panel. "We should not imagine ... that it is possible to prevent all crises," he said. "To achieve both sustained growth and stability, we need to provide a framework which promotes the appropriate mix of prudence, risktaking and innovation in our financial system." Bernanke also told the panel he could not have legally saved Lehman Brothers from bankruptcy and the firm's catastrophic failure in 2008 was a source of sadness. “It was with great reluctance and sadness I conceded that there was no other option” to save Lehman, Bernanke said. “There was never any discussion that says ‘here’s how we can save Lehman, should we do it or not?’ The discussion was ‘there is no way’ and that was my belief and that’s how I proceeded, because, as I said, if I could have done anything to save it, I would have saved it.” On Wednesday, commission

Chairman Phil Angelides questioned whether politics had played a role in the September 2008 decision not to bail out Lehman Brothers. Its bankruptcy triggered widespread panic, hastening the worst global recession since World War Two.

The Fed has insisted it had no authority to rescue Lehman because the firm lacked sufficient capital to borrow enough to stave off collapse. “Any attempt to lend to Lehman within the law would be futile and would only result in loss of cash,” Bernanke said. Bernanke led the economy through the financial crisis and the worst recession since the 1930s. The Federal Reserve took extraordinary measures to inject hundreds of billions into the battered financial system. Last week he said the central bank is prepared to make a major new investment in government debt or mortgage securities if the economy worsened significantly. Sheila Bair, the chairman of the Federal Deposit Insurance Corp., also is testifying at Thursday's hearing. She says in prepared testimony "the stakes are high" for regulators to effectively exercise their new powers under the financial overhaul law. If not, "we will have forfeited this historic chance to put our financial system on a sounder and safer path in the future," she says.

Team TCI prepares to play USVI in CFU U20 Men's Competition Wednesday, September 8th - the Turks and Caicos Men’s National Football Team and a United States Virgin Islands (USVI) team will go head to head in the first phase play off of the Caribbean Football Union (CFU) U-20 Men’s Qualifying Competition in a “home and away” format, where the winner of the group will go on to join Jamaica, Guyana and Grenada in the second phase preliminary group stage. This first game will take place at the TCI National Stadium in Providenciales, with a kick-off time of 4pm; and ticket prices are $5 in advance and $10 at the gate. The second leg will be held in the USVI on September 14th, and to take place at The St. Croix Educational Complex Grounds, Rural Route No. 2 Kingshill. In the run-up to match, the Turks and Caicos Islands Football Association (TCIFA) Technical Director Matthew Green said: “We are very excited about these games as it gives further opportunities for our young players to test themselves against international teams. BarbadosBRIDGETOWN, Marquee West Indies batsman Ramnaresh Sarwan is among three high profile players snubbed by the West Indies Cricket Board (WICB) for central retainer contracts. When the 14-man list was announced on Tuesday, neither Sarwan, Denesh Ramdin, nor Jerome Taylor were included for the new period running from October 1, 2010 to September 30, 2011. Bolt won both the 100 and 200-metre titles at the 2008 Olympics in world-record times, and helped Jamaica win gold and set another world record in the 4x100-metre relay. A year later, he again set world records in the 100 and 200 at the World Championships in Berlin. "I think Tyson sits at home and cusses me," Bolt told BBC radio yesterday. Barath, Bravo, Shillingford, Miller and Pascal are all emerging Test players and have already been tipped to lead the next generation. Left-handed opener Devon Smith, who has not played for West Indies in a year, has been upgraded from a development contract to a retainer contract. Meanwhile, the WICB ave offered developmental contracts to Kirk Edwards, Andre Russell, David Bernard Jr, Gavin Tonge, Andre Fletcher, Chadwick Walton, Devendra Bishoo, Assad Fudadin, Imran Khan and Kevin Stoute. London, England- The three Pakistani cricket players at the center of an alleged betting scandal say they're innocent -- and the Pakistani high commissioner said Thursday he believes them. The players met their country's cricket authorities on September 2, at the Pakistani High Commission in London to discuss the allegations, which have rocked the cricket world. "They have not been proven guilty," Wajid Shamsul Hassan told a throng of reporters afterward. "And until you are proven guilty, you are innocent." A police investigation into the alleged scandal is continuing, but no further meeting with police or questioning of the men is scheduled, he said. Hassan did, however, vow to take legal action to defend the players if necessary. "I think we will go to the court of law to defend them," he said.

Though no disciplinary action has been taken against the three players, they will not be playing on the rest of

the team's tour in Britain, team manager Yawar Saeed said Thursday. "We'll ask for a replacement to make up the squad of 16," Saeed told reporters at the team's game in Taunton, England, where the squad was playing a "friendly" or exhibition match against local team Somerset. "The team is today 13 (and) will become 16 again with replacement." Saeed said the three players -- team captain Salman Butt, Mohammed Asif, and Mohammed Amir -- have not been suspended. Hassan indicated the players themselves may have requested to stay off the team for the upcoming tour. The players said "that on account of the mental torture which has deeply affected all of them, they are not in the right frame of mind to play the remaining matches," Hassan said. "Therefore, they have requested the Pakistan Cricket Board not to consider them for the remaining matches until their names are cleared." Eighteen-year-old Amir is the youngest-ever bowler to reach 50 Test wickets. He took six wickets -considered an impressive feat -- against England in the Test on which the betting allegations are centered. For such an exciting prospect, already hugely popular in his homeland, to be tarnished by a scandal like this has depressed many cricket fans in Pakistan. Asif has already courted controversy in his career. He has tested positive for steroids twice, and soon after the second offense, he was caught with a recreational drug in his wallet at the Dubai airport and kept in detention for three weeks. The betting allegations emerged Sunday in the British tabloid News of the World, which reported that two Pakistan players deliberately bowled "no balls," or fouls, during their Test series with England in London last week. The head of cricket's world governing body said Tuesday he wants prompt disciplinary action if anyone on the Pakistan team was involved in the alleged betting scheme. "The integrity of the game is of paramount importance," said Haroon Lorgat, chief executive of the International Cricket Council. "Prompt and decisive action will be taken against those who seek to harm it. However, the facts must first be established through a thorough investigation and it is important to respect the right of due process when addressing serious allegations of this sort." Investigators from the cricket council are in the United Kingdom making inquiries into the allegations, the council said Tuesday. Report finds Dodgers $433 million in debt as of last year

According to the Los Angeles Times, the Dodgers were $433 million in debt as of last year, which is $3 million more than what owner Frank McCourt paid for team in 2004. McCourt, who is the middle of bitter divorce proceedings with his wife, Jamie, the former team CEO, is so leveraged that he has had trouble finding additional financing, the report found. The Times says Citibank, a Chinese investment group and Bill Guthy of GuthyRanker infomercial fame turned down the Dodgers' financing requests last year. The paper cites a deposition in which Dodgers Chief Financial officer Peter Wilhelm said Citibank "did not feel that the Dodger

organization had the capacity to take on more debt." The Times and the HCVT accounting firm analyzed documents available in court files. The firm concluded that, if the Dodgers were sold today and the McCourts were to split the proceeds, the debt and tax burdens would be so great that each of the McCourts might walk away with about 10 cents on the dollar. The paper ran this statement from McCourt spokesman Steve Sugerman, whom it says it presented with the findings about the lack of available cash and the struggle to find new financing and asked how the Dodgers could continue to field a top-tier team: "The Dodgers have consistently
