Special Prosecutor Helen Garlick booed and heckled By Vivian Tyson Demonstrators protesting the court’s decision to go ahead with the pretrial of former ministers and some local lawyers, hurled insults at Special Prosecutor Helen Garlick as she left the court building on Tuesday (October 21, 2014). The protestors who converged at the new courthouse – formerly the Myrtle Rigby Health Complex - from as early as 8:30 a.m. with placards expressing their grievances with the Special Investigation and Prosecution Team (SIPT), accused the English lawyers of trying to manipulate the legal justice system to secure a conviction against former premier Michael Misick and some of his former ministers. Garlick, who was driving a white Suzuki Vitara in the company of Malclom Bishop the attorney for Chal Misick, attempted to make her way onto the Leeward Highway from the courthouse but was made to wait by a steady flow of traffic. This allowed the protestors to approach her window and unveiled what they thought of her. “You are unfair. You come to crash our country. You want to send Turks and Caicos Islanders to prison, while making deals with your white friends,” one of the protestors shouted. Another protestor remarked: “We are paying you millions of dollars each year for you to imprison our own. It is time for you guys to leave the Turks and Caicos.” One of protestors, Jackie Lightbourne, who were among the first converge on the scene, told The SUN that they congregated at the courthouse to voice their disgust at the British and their operatives, who she said are blatantly trying to railroad the TCI justice system. “We are protesting for justice for all, all those who are accused in the criminal charges brought against our ex-leaders, Michael Misick, and you know the rest of them. Another protestor, Colin Williams, said that it is important for all well-thinking Turks and Caicos Islanders to stand up and lend their voice in disapproval to the trials of the TCI ex-leaders, since their case will serve as a yardstick to future

trials against locals. “I am protesting for justice for our former leaders (who are) good people in this country. I am not working; I am almost too old to work. I am 56. But what about the young people, my kids? There is no future for them, not under this administration, not even with our PNP brothers. They are sitting there letting the whites giving them message to give the blacks, and that is how they are treating us,” Williams said. Williams said that the prosecution being faced by the ex-leaders is a clear sign of racialism, that he said the British has long been masters at. “This is how black people are being treated all over the world. This is not the first time that the Brits are doing it to us. They come to the Turks and Caicos Islands and are doing the same thing. If you are white you are alright, if you are black you stay in the back, and that is what we are facing right now,” he said.

Luxury yacht operators charged for reef damage By Vivian Tyson

Criminal charges have been brought against the captain of a US$63million luxury yacht , Sea of Love, which ran aground off Molasses Reef in early October, causing extensive damage to the coral reefs. Officials from the Department of Environment and Maritime Affairs (DEMA) said it is possible that the owner of the yacht could also be charged. While DEMA has confirmed the incident, a source said investigations are ongoing, and so there was little that they could tell. The source however, confirmed that the boat did damage a section of the Molasses Reef, but unwilling to reveal the magnitude of the destruction. The SUN understands that the operators’ documents and those of the yacht have been confiscated by the authorities, and they were order not the leave the jurisdiction until the matter is resolved. The boat is now being housed at South Dock in Providenciales. In the meantime, the authorities said they are near concluding building their case against the boat operators and charges could be brought against them in a matter of days. “Yes, the boat did run aground and damage a section of the Molasses Reef. This is not the first time in recent years that a luxury yacht has damaged our reefs. On April 1, 2013, approximately 3,000 square feet of coral reef off near Northwest Point off the coast of Providenciales were damaged, after a vessel – the M.Y. White Cloud – had dropped anchor. The damage was described by the authorities “a catastrophic and devastating”. They said at the time that the operators of the yacht were not given the permission to dock in that area. Four charges were brought against the captain and engineer of the vessel under the National Parks Ordinance and the Fisheries Protection Ordinance. Their boat, which was confiscated, was subsequently released to them. The reef damage was so severe that cabinet hurriedly approved a $47,000 disbursement to affect repairs to the area and DEMA feared that a full recovery of the reef may not even take place in our lifetime. The Turks and Caicos Islands reefs are rated as amongst the top three in the world. Fish Fry’s new home to be ready next year

Premier Hon. Dr. Rufus Ewing By Vivian Tyson The new venue for the mega popular Thursday Night Fish Fry may not be ready before the passage of the 2015/2016 budget, according to Premier Hon. Dr. Rufus Ewing. The Premier who was responding to questions during the launch of the launch of the Turks and Caicos Islands Tourism Policy and Strategic Planning launch on Monday (October 20, 2014), said that the land has already been acquired and designated for use by the Tourist Board. But he said that government is waiting to receive funds for amenities to be constructed there. He said that at this time funds are not readily available, and so, government may have to wait until after the passage of the budget next

year. Without private sector funding, the proposed new venue, which it is understood to be located adjacent the Cultural Market in the Bight, will not see a 2014 opening, but the premier is hopeful that it will be commissioned before the passage of the budget. “The land is designated for use by the Tourist Board combined with the different amenities designated to go in at that particular location. And I know that the Attorney General’s Chambers has been working on that particular part of the project. And then we have to find the funding for the development of the facility. But that funding, once it comes from government, will not come until the next financial year. “We always accept persons who are interested in being good corporate citizens to assist us with that initiative. It is more than likely that it will be next year. But if we have an opportunity to do it before, we will do it. But it is likely after the budget,” the Premier said. Earlier this year, the Department of Environment and Maritime Affairs (DEMA), served the Tourist Board with a letter to terminate the Fish Fry from the Bight Park on the grounds that the Board had made a string of breaches that it said the Board had agreed in a document last year February (2013),

We wish you continued success with the Fish Fry and remain available to assist in any capacity to ensure that this transition

is a smooth one,” DEMA said in its letter to the Tourist Board. A reply letter penned by Tourism Director Ralph Higgs, of which The SUN obtained a copy, highlighting level of cooperation by the Board since agreeing to use the park, and expressed dismay of the agency’s decision to kick the event from the venue. He said steps were taken to abate the concerns raised by a few citizens in the area regarding noise pollution, saying that the Tourist Board, since making the adjustments with the sound concerns, had not heard from the complainants. “On the subject of up keep of the Park, you may recall that we have always remained mindful of the importance of keeping the park and in a presentable state. SIPT makes 218 information requests from the FSC

Helen Garlick By Hayden Boyce Publisher & Editor-in-Chief The Helen Garlick-led Special Investigation and Prosecution Team (SIPT) has made in excess of 218 requests for information from the Financial Services Commission. This was revealed in the FSC’s latest annual report, a copy of which was obtained by The SUN. Apart from what was requested from the FSC, the SUN has been reliably informed that the SIPT has made hundreds of requests for information commercial banks under production

orders from the courts. These requests for confidential information are normally made and granted without the permission of individuals. Meantime, according to the FSC report, during the last financial year the institution also processed 102 requests for information from the Integrity Commission, 51 from the Attorney General’s Chambers and 3 requests from the Exchange of Information Unit. There has also been on-going dialogue with the Financial Intelligence Unit on a number of matters. The TCI Financial Services Commission received and responded to 2 requests from Foreign Regulatory Authorities. These were the US Securities and Exchanges Commission (SEC) and the Ontario Securities Commission. In addition, the Commission received 6 other nonregulatory requests. The report also disclosed that during the last financial year there were thirteen (13) Notices issued to licensees advising them of FSC’s intention to take disciplinary action, mostly in relation to the failure to file financial statements or annual returns or to pay the annual license fee. Of that amount, seven (7) were carried to fruition, resulting in the payment of penalties of varying amounts. One insurer was placed into Court

Administration due to a continued breach of the requirements of its licence as regards solvency. That process is continuing. Two (2) Cease and Desist directives were issued to two (2) entities in order to correct breaches that were observed in their operations. The FSC said its Compliance Unit was beefed up during the year by the employment of additional personnel. “The aim is to keep constant watch over the industry and so minimize the possibility of serious breaches of any financial services law,” the FSC noted. “Notwithstanding, situations do arise from time to time. We however strive to move swiftly to reduce any contagion risk. In this regard we had to place one insurer under Court Administration due to its breach of the Insurance Law as it was deemed to be insolvent. It is hoped that the Administrators may be able to sell the long term liabilities to another Insurer in order to protect the policyholders.” In total, twenty three (23) Enforcement Actions were successfully carried out against licensees for various breaches. Actions resulted in revocation, suspension, and issue of directives or the imposition of penalties. The dollar value of penalties imposed amounted to $64,175. In the previous year a total of $175,000 in fines was imposed.

Independence of judge to be heard by Privy Council in U.K.

Mr. Justice Paul Harrison The issue of the impartiality and independence of Jamaican judge Mr. Paul Harrison who was selected to hear the corruption trials in the Turks and Caicos Islands is set to be heard by the Privy Council in London. On Monday October 20th, Court of Appeal judge, His Lordship Elliott Mottley, QC, granted permission to former Premier Michael Misick, former Cabinet ministers and a few local lawyers who are accused of corruption to take their case to Privy Council to determine whether their rights to a fair trail under the Constitution are being infringed by Harrison hearing the case in circumstances where it is alleged that he is not independent or impartial because of the terms and conditions under which he was hired. The 77-year-old Harrison was appointed as the judge for the corruption trials during the Interim Administration when the British imposed Direct

Rule on the Turks and Caicos Islands and following investigations by a Special Investigations and Prosecutions Team (SIPT) which is led by British attorney Helen Garlick and included at least 30 former retired UK police officers who operated on a rotating basis. The SIPT has been paid approximately US$11million a year over the past four years for investigations which have no end in sight and under an arrangement which some observers have regarded as an open-ended legal contract. Many local residents have expressed anger and outrage at the money spent on the SIPT investigations, especially given that the basic needs in the Turks and Caicos Islands are not being met because of budgetary constraints. In an unusual sitting before a single Court of Appeal judge, lead prosecutor Andrew Mitchell QC and Special Prosecutor Helen Garlick joined with some of the defence lawyers in trying to persuade Mottley to put last Tuesday’s case on hold because of the appeal against Harrison. However, Mottley said that in his opinion, a single Court of Appeal judge has no jurisdiction to grant a stay of proceedings pending appeals to the Privy Council. Speaking in a very deliberate tone, the prominent Barbadian jurist told the court: “I am somewhat surprised that it was made known at a very early stage that I was going to deal only with the issue of the application for leave to appeal as a right. Therefore, I had hoped that if it was thought that a single judge had jurisdiction to deal with issues of stay, that (legal) authorities would have been submitted to this court showing that such jurisdiction does in

fact exist. The jurisdiction exists for three judges of the court to deal with that. So while both parties (defence and prosecution) argued that a single judge could have granted a stay, I am not persuaded either by the applicants (lawyers for the accused) or by Mr. (Andrew) Mitchell that as a single judge I have that jurisdiction.” JUDGE HARRISON ADJOURNED THE CASE. The 75-year-old Mottley, who is a former Attorney General of Bermuda and former President of the Belize Court of Appeal and a judge on the Cayman Islands Court of Appeal, stressed that the powers to grant a stay under the Turks and Caicos Appeal Privy Council Order is set out in paragraph 7 and that stay is given to the court itself and not to a single judge. He added: “In the Court of Appeal Ordinance and the rules, the right to stay is expressly stated and not to be inferred. It is not a question as to whether or not the court has the power to stay, I don’t think there is any doubt about that; but the question is whether a single judge has a right to stay and I am not persuaded that a single judge has the power to stay proceedings.” Mottley said he is mindful that the trial is scheduled to start on December 1st, 2014, therefore he will make every effort to ensure that there is a full sitting of the Court of Appeal prior to that date. “I think it is only fair that the applicants have the case dealt with by a full court rather by a single judge,” said Mottley, whose brother judges on the Court of Appeal are Jamaicans, Queen’s Counsel Edward Zacca, the president, and Ian Forte, QC.

Fortis wins case against Islandcom The Privy Council, which is the highest court in the United Kingdom, recently ruled in favour of power company Fortis TCI in a controversial law suit that was brought by telecommunications provider Islandcom. The case was heard before Lady Hale, Lord Kerr, Lord Clarke, Lord Wilson and Lord Reed and the judgment was delivered on October 16th, 2014. Commenting on the Privy Council victory, FortisTCI President and Chief Executive Officer Eddinton Powell said, “We are happy to have this matter behind us.” The background to the case is that Islandcom claimed to have been granted an exclusive licence to use a number of frequencies including frequencies in the 902-928 MHz uplink bandwidth (“the 900 MHz frequencies”). It claimed that Fortis, created such interference with the 900 MHz frequencies that it was impossible for Islandcom to continue to operate, with the consequence that it had to relocate elsewhere at great expense. The alleged interference was caused by the introduction of remote automatic meter reading (“AMR”) devices operating within the same bandwidth. In this action Islandcom sought to recover both that expenditure and compensation for loss of business from Fortis. Fortis admitted that its devices caused interference but denied that Islandcom had an exclusive licence to use the spectrum in which it operated. Fortis’ case is that the 900 MHz frequencies were reserved both internationally and regionally for Industrial Medical and Scientific (“ISM”) devices which anyone could use with appropriate apparatus. Islandcom

TCI to retain Daylight Savings Time next year

But some members of the public were uncertain as to what was the outcome, claiming that they had not heard anything further on the matter,

In Daylight Savings Time, the clock is set one hour forward, while in Standard Time, the clock is set one hour behind. There has been mixed reactions to the changing in time. Some believe that the retention of Daylight Savings Time affords persons much daylight to conduct business after work as opposed to Eastern Time, which does not offer much after-work option to do business. The Eastern Time supporters, for the most part, are claiming that under that time regime they are able to sleep longer in the mornings. “With the other time (Standard Time) I can stay longer in bed. The SUN is up, and it is still six o’clock. That gives me more time to sleep. Under Daylight Savings Time, you go to bed early and have to wake early,” one of the individuals said.

Civil Servants sue Government A group of seven retired senior civil servants has sued the Turks and Caicos Islands Government. The group is led by Eliza Doughty and Carol Durham. The SUN obtained a copy of the Statement of Claim which was filed on the September 3oth, 2014. Each of the seven Plaintiffs stated specifically why the Government owed substantial sums to them.

According to the document they are claiming the following: (1) Breach of contract (2) Conspicuously unfair conduct, in similar terms as determined in legal principle in the Bermudian Court of Appeal of Commissioner of Police v. Romeo Allen and Others [2011] Bda,. L.R. – Civil Appeal number 6 of 2010 in the terms therein ruled:-

Para. 36 “The procedure adopted by the Commissioner of Police was not only in breach of express promise made by his predecessor, it was conspicuously unfair.” (3) Their legitimate expectations were not honoured by the Government. (4) Their vested rights were not honoured by the Government.” The Attorney for the civil servants is

Premier’s rundown Chevy Suburban decommissioned

the procurement process of a new vehicle, the head of the elected government is forced to rent a Ford Expedition SUV. Persons have long complained that they were not pleased with the vehicle assigned to the premier

since its state was not up to the standard to ferry any head of government. Many questioned the reasoning behind assigning the premier’s officer with such unsound vehicle, while assigning the governor’s office with a Land Rover - one of the most high-end of vehicles. The Premier said that he has been driving in the Ford Explorer for the past few weeks because the Suburban has been decommissioned due to its deplorable condition. The SUN understands that lately the vehicle spent more time in the garage than on the road, and so a decision was finally taken to pull the plug on its usage. It is now parked at the government garage at Old Airport Road in Providenciales. “That vehicle has been decommissioned and now I am driving a rental,” the premier explained. The Premier said that as soon as the procurement hurdles are cleared, the new vehicle should arrive in the Turks and Caicos Islands for his office to utilize. “We are still working out some glitches in the procurement of the vehicle for the premier’s office, and hoping that that would be resolved sometime shortly, but there has been much difficulty and much constraints with the whole procurement process in the purchase of the vehicle,” the premier said.

Donna Karan selling her Parrot Cay house for $39 Million

Ms. Karan, who founded her eponymous company in 1984, played a large role in designing and furnishing the homes, which have African and Balinese influences Fashion designer Donna Karan is selling a portion of her longtime family retreat on Parrot Cay in the Turks and Caicos Islands for $39 million, adding to the number of properties to come to market on the small island recently. Ms. Karan is selling 7 acres of the more-than 10-acre beachfront property, which she purchased in 2002, according to co-listing agent Katherine Baryluk of Regency, the exclusive affiliate of Christie’s International Real Estate for Turks and Caicos. Ms. Karan frequently vacations on the island, but is selling because the property is more space than she needs, according to a spokesperson. The property for sale has two guest villas

flanking a center dining pavilion. There are also three swimming pools, a yoga pavilion on the beach, a chef’s kitchen, staff quarters and other buildings. Ms. Karan is keeping the portion of the property with the family home, a spa house and two swimming pools. Each of the two-story guest villas is about 3,850 square feet, with four bedrooms, four bathrooms, a kitchen and a pool, Ms. Baryluk said. The dining pavilion, meant as “a family gathering place,” has seating for more than 20 people, she said. Ms. Karan, who founded her eponymous company in 1984, played a large role in designing and furnishing the homes, which have African and Balinese influences, said Ms. Baryluk. In addition to custom-designed hardwood furniture, the home is filled with decorative carvings from her travels around the world. The property is being sold fully furnished. Lately Parrot Cay has seen several big home listings: “Oliver’s Cove,” a roughly 6½-acre estate, was recently listed for $48 million. In late 2013 model Christie Brinkley listed her Parrot Cay home on 1.6 acres for $10.75 million, recently reducing the price to $9 million. The island is the site of the luxury resort Parrot Cay by COMO, and homeowners there have access to hotel amenities, such as room service and housekeeping. Ms. Baryluk, who is listing the property with Rick Moeser of Christie’s, said the recent spate of pricey listings is a result of the recovery of the luxury home market in the Turks and Caicos. Many buyers come from the U.S., and the 2008 financial crisis “slowed down the market significantly,” she said. National Insurance laws to be changed Cabinet has agreed to make a number of significant changes the National Insurance Board (NIB laws. At its last meeting, Cabinet agreed on the National Insurance (Amendment) Bill 2014, National Insurance (Benefit) (Amendment) Regulations 2014 and the National Insurance (Contributions) (Amendment) Regulations 2014 and for these amendments to be forwarded to the House of Assembly for debate and passage and published in the Gazette respectively and then laid before the House of Assembly. These proposals mostly do the following – •Increase the maximum earnings limit (wage ceiling) on which contributions are paid from $2,600 per month to $4,000 per month in three steps in April 2015, April 2016 and April 2017. •For Retirement pension, use a five-year average of insurable wages instead of only three years of insurable wages and, if the ceiling is increased as recommended above, adjust downwards the average insurable wages for those with earnings in excess of the current $600 per week ceiling when calculating pensions. •Introduce reduction factors that will be applied to Retirement pensions awarded prior to age 65 thus making pensions selected prior to age 65 actuarially equivalent with those awarded at normal retirement age.

•Legislative provision for the NIB to make all of its investments in accordance with the Investment Policy Statement. •Make provision for the Permanent Secretary Finance to be ex officio a member of the Board and for his/her representative to deputize in his/her absence. •Make provision for self-employment to be continuous unless notification of discontinuance of the employment is given to the NIB by the selfemployed person. •Increase the maximum period for payment of maternity allowance from 12 weeks to 14 weeks to bring it in line with the Employment Ordinance; •Introduce a disqualification provision for persons in receipt of invalidity pension who perform remunerative work whilst receiving the pension. •Reduce the amount of hours from 10 to 5 for the purpose of determining liability to pay contributions as a self employed person. •Introduce a provision to protect contributions in cases where warrants or distress is executed against the property of delinquent contributors; •Amend the Ordinance to state that corporate bodies and the officers of those bodies can be proceeded against at the same time in cases where offences against the Ordinance have been committed and widen the provision to include other unincorporated bodies of persons. •Require all employers to submit monthly to NIB a statement of contributions. •Make provision for the Minister to consult the Board

prior to appointing the Director/CEO and to ensure that the Director has the necessary qualifications and experience. •Make the Investment Committee and the Audit Committee statutory committees. •Make provision for surplus funds in the short term branch of the Fund to be transferred to the long term branch in accordance with the Actuarial reviews. •Amend the provision requiring the NIB to pay medical reimbursement to TCIG to make the amounts payable to NHIB based on actuarial assessments to bring the law in line with the NHIP Ordinance. •Amend the Ordinance to expressly state that investments and loans can be paid or met out of the Fund. •Consistent with legislation governing other statutory bodies, introduce sanctions for Board members who are present and fail to disclose their personal or pecuniary interest in a matter being discussed and determined by the Board. •Consistent with legislation governing other statutory bodies, introduce a confidentiality provision where officers, employees or agents of the Board acquire information in their official duties. •Make provision for the Minister to act in circumstances where the operation of the Board is not being conducted in the best interest of the subscribers. • Make provision for contributions to be paid by means other than by cash or cheque and at designated places other than NIB offices.

A Panoramic Culture

By Marguerite Anderson North and Middle Caicos’s Heritage celebration was an exciting festival over the weekend of October 18th to 19th. Director of Culture, David Bowen was the Chairperson at the Cotton, Sisal & Sponge Festival which was held in North Caicos at the Horse Stable Beach Complex on Saturday October 18th. The celebration was based around a number of cultural activities: music, drama, poetry, comedy, culture, heritage and education. The show was opened by DC for North & Middle Caicos, Donna Gardiner and opening prayer was done by Mrs. Agnes Swann. Singer/Musician, Mr. Lovey Forbes and his band were the opening act and they set the tone for the panoramic cultural performances which followed. Among these was a skit from the Performing Arts Club of Raymond Gardiner High School. The skit showcased the differences between the old and the young and how using a traditional way of life (shelling peas) which served to bring a community together, helped young people to resolve their conflicts. Other items included those from students

of the Adelaide Oemler Primary School in the form of a dance, a solo rip-saw performance and a poem titled, “My Turks & Caicos” which was beautifully executed by Mini Miss Adelaid Oemler, Panthea Lightbourn. Charles Hubert James Primary School did a cultural number with boys playing drums and singing “Bone Fish Biting”. There were a number of elders such as Miss Pat and Miss Marian. Miss Pat did a monologue about growing up, going to the well and having to carry and tote water, carrying kindle and wood for the fire while Miss Marian did a talk on plaiting sisal and on the craft industry. A presentation was also done by History teacher of the Raymond Gardiner High School, Mr. Jasin Walkin who educated the young ones about the Cotton Industry. Director of Culture, David Bowen did a presentation on the Amazing Queen Conch and how important the conch shell and conch itself was to TCI’s culture and heritage. Bowen also conducted a cultural and heritage quiz for students from primary to college level age groups. Premier, the Honorable Rufus Ewing and the First Lady were also in attendance at the event. explained that the event was the 3rd zone in a 4 zone sequence for National Heritage Month. Bowen reported that the line-up of Heritage events sees every weekend as a celebration across the islands. Zone 1 was Salt Cay and Grand Turk as the Salt Festival. Zone 2 was South Caicos as the Seafood Festival , Zone 3 is Middle and North Caicos as the Sponge, Sisal and Cotton Festival and Zone 4 is Providenciales as the Maritime Festival which will take place on Saturday October 25th. Each island has a small committee headed by the DC of Salt Cay, Middle Caicos, North Caicos and a community committee in Grand Turk and Providenciales. The festival is led by the Department of Culture, however, Bowen explained that due to the nuances of each island and their sub-culture, the committee decided to let each island showcase what they wish of their island home. The Department of Culture provided the funds for all the activities which required funding. Additionally, the Department also provided a ferry from Providenciales to North Caicos to transport students and teachers, many of whom had never been to North Caicos before, so that they may be exposed to the sub-cultures of the islands.

Cuba sends 91 more doctors to fight Ebola

HAVANA - Every few years Dr. Leonardo Fernandez flies to a nation shaken by natural disaster, political turmoil or disease, leaving his hospital in eastern Cuba for countries that have included Pakistan, Nicaragua and East Timor. On Tuesday, the intensive care specialist was headed to the epicenter of the Ebola epidemic along with 90 other Cuban medical workers as part of a half-century-old strategy that puts doctors on the front lines of the country’s foreign policy. The 91 nurses and doctors going to Guinea and Liberia join 165 already in Sierra Leone - making this island of 11 million people one of the largest global contributors of medical workers to the fight against Ebola. The commitment has drawn rare praise from the U.S. and focused worldwide attention on Cuba’s unique program of medical diplomacy, which deploys armies of doctors to win friends abroad and earn more than $6 billion a year in desperately needed foreign exchange. Cuba has more than 50,000 medical workers in more than 60 countries, many in nations like Brazil that pay hundreds of millions a year for their services. Others are on humanitarian missions that generate good will abroad and bolster Cuba’s efforts to portray its medical system as one of the most important successes of a socialist economy wracked by slow growth, shortages and chronic underinvestment. “Cuba is a lightweight boxer which boxes in the superheavyweight classes precisely because of its foreign policy and its international cooperation,” said John Kirk, chair of Latin American studies at Canada’s Dalhouse University and an expert on Cuban medical missions. “This is part of the Cuban political DNA ... this is altruism as well as burnishing its international credentials.” Despite a recent set of pay raises, most Cuban doctors ‘ salaries don’t top $75 a month, less than many workers who work in tourism or other sectors that bring in money from abroad. The foreign missions almost uniformly offer the chance to earn extra pay, in many cases enough to buy a bigger home or new car. Critics of Cuba’s communist

government have accused it in the past of exploiting the doctors by giving them only a meager portion of the money paid for their services and keeping the lion’s share for the national treasury. But those who believe strongly in Cuba’s communist revolutionary ideology say a mission abroad is fundamental to the health workers’ self-identity. “This is part of our training as Cuban doctors . When they ask for volunteers, whatever the situation, most of us raise our hands,” Fernandez said. “This is a commitment to Africa, and it’s a commitment to this nation that has shaped us with the ideals of altruism, self-sacrifice and humility.” Doctors in the small group who gave interviews to the foreign press in Cuba on Tuesday declined to discuss the details of their compensation. The head of the tropical medicine institute that trained them said Friday that they would be receiving their normal salaries from the Cuban government and an unspecified “per diem” from the World Health Organization. All men, most of the volunteers have at least 20 years of experience, have completed several missions overseas and are married with children, who are often adults who themselves work in the Cuban medical system. Cuba’s first medical mission was dispatched in 1960 in response to an earthquake in Chile. Cuba offered to send thousands of doctors to the U.S. to help after Hurricane Katrina but Washington rejected the offer. In Washington on Friday, Secretary of State John Kerry cited the Cuban doctors as a global example of contribution to the Ebola battle. Cuban officials initially announced they would send 461 doctors to Africa. Iliana Gonzalez, head of training at Cuba’s Central Medical Cooperation Unit that helped prepare the antiEbola contingent, said Tuesday the number actually sent to Africa will remain at 256 until there is sufficient infrastructure to accommodate the rest. She said many of the doctors received weeks of instruction in protective measures and equipment. Once in Africa, the Cubans will get two to three weeks additional training before heading into the field. They will be quarantined in Africa for weeks at the end of their mission before returning to Cuba.

Dominican Republic establishes Ebola travel ban SANTO DOMINGO, Dominican Republic - The Dominican Republic has joined a group of Caribbean countries in restricting travelers from West African nations dealing with Ebola outbreaks. Dominican Health Minister Altagracia Guzman says the ban applies to travelers who have been in those countries in the past 30 days. She announced Tuesday that authorities will remain vigilant at airports, seaports and the border it shares with

Haiti. There are no direct flights between the Dominican Republic and any African country. Jamaica, Guyana, St. Lucia and Trinidad & Tobago have announced similar travel restrictions. The Ebola outbreak in West Africa has already killed more than 4,500 people, mostly in Liberia, Guinea and Sierra Leone since it emerged 10 months ago.

The agreement was reached last month and approved on Tuesday by the Birmingham City Council. The city settled to avoid further litigation and the risk of a higher payout, Choy said. Canadian PM pledges tougher security laws after attack

Canadian Prime Minister Stephen Harper pledged more surveillance and detention powers for security forces in Canada on Thursday after a gunman killed a soldier and raced through parliament before being shot dead. Addressing the House of Commons just meters from the spot where the gunman, a reported convert to Islam, was shot dead on Wednesday, Harper said lawmakers would expedite new powers to counter the threat of radicals. “The objective of these attacks was to instill fear and panic in our country,” Harper said. “Canadians will not be intimidated. We will be vigilant, but we will not run scared. We will be prudent but we will not panic.” Harper pledged to speed up a plan already under way to bolster Canadian laws and police powers in the areas of “surveillance, detention and arrest.” Harper said the attack - following an incident on Monday when a convert to Islam ran over two Canadian soldiers with his car, killing one would strengthen Canada’s response to “terrorist organizations.” The attacks in Ottawa and Quebec took place as the Canadian government prepared to boost the powers of its spy agency, the Canadian Security Intelligence Service. Thousands of Europeans ask Google to scrub Web

SAN FRANCISCO - Google is being swamped with demands from Europeans trying to erase humiliating links to their past from the world’s dominant Internet search engine. Nearly 145,000 requests have been made in the European Union and four other countries by people looking to polish their online reputations, according to numbers the company released Friday. That’s an average of more than 1,000 requests a day since late May, when Google began accepting submissions in order to comply with a European court that ruled some embarrassing information about people’s lives can be scrubbed from search results. Europe’s insistence that its citizens have the “right to be forgotten” in certain instances has thrust Google into an uncomfortable position that it sought to avoid. The company has been trying to define what kind of material merits deletion while also striving to

stand by its belief that all of the world’s information should be universally accessible. Requests can be made by more than 500 million people living in the European Union’s 28 countries, as well as Iceland, Liechtenstein, Norway and Switzerland. GM posts higher-thanexpected profit

General Motors Co (GM.N) on Thursday reported a higher-than-expected profit in the third quarter on strong demand for its redesigned full-size pickup trucks in North America. “Clearly, high transaction prices - the new trucks and SUVs are more profitable than the ones they replace - that certainly helps,” GM Chief Financial Officer Chuck Stevens said at the company’s Detroit headquarters. However, he added investors should consider exiting the stock, citing a dial-down of European growth and increased pressures on the key U.S. market. “We believe no (automaker) with global exposure can confidently offer guidance for the 2015 period,” he said. “This is not just a GM issue.” Higher pricing on GM’s vehicles resulted in a $600 million profit gain in the quarter. It launched new versions of its full-size Chevrolet Silverado and GMC Sierra pickup trucks last year and followed those with other updated SUVs on the same vehicle platform earlier this year. Stevens said GM remained on or ahead of its financial forecast from January, when it said it would see a slight increase in pretax profit this year. The quarter did not include any charges for costs related to the record number of recalls this year as GM has already booked them. Chief Executive Officer Mary Barra said GM has repaired more than 1.2 million of the cars recalled for the defective switch, and had enough replacement parts to service the rest. Net income rose to $1.38 billion, or 81 cents a share, from $698 million, or 45 cents a share, a year earlier. Excluding one-time items, GM earned 97 cents a share, 2 cents above what analysts expected, according to Thomson Reuters I/B/E/S. The quarter included $300 million in special items for flood damage sustained at GM’s Michigan technical center and the writedown of Russian assets. Revenue rose slightly to about $39.3 billion from $39 billion. Analysts expected $39.8 billion. GM reported a profit margin of 9.5 percent in North America, the fifth consecutive quarter of yearover-year growth. GM said average transaction prices in the U.S. market and vehicle sales in China reached record highs in the quarter. Sears to close stores, lay off about 5,500

Sears plans to close a total of 130 underperforming stores during the full fiscal year Sears Holdings Corp is shuttering more than 100 stores and laying off at least 5,457 employees, investor website Seeking Alpha reported on Thursday, indicating the struggling retailer may be stepping up store closures. Sears said in August it

Samsung phones cleared for US government use SEOUL, South Korea Samsung Electronics Co. said Tuesday some of its Galaxy mobile devices were approved by the National Security Agency for use with classified U.S. government networks and data, a boost to the company’s efforts to expand in the security-conscious business market . The South Korean company said the Galaxy S5, the Galaxy Note 4 and seven other smartphones or tablets became the first consumer devices validated by a partnership between the National Security Agency and the National Institute of Standards and Technology. The validation clears Samsung devices to be considered by U.S. government departments to handle all range of classified information . The approval comes as Samsung tries to expand in the business market. The company developed KNOX, software for security-conscious business clients.

Nike CEO hints at wearables development with Apple Nike still appears to be staying in the wearable business , as CEO Mark Parker hinted that the company will continue its partnership with Apple that will focus on fitness wearable devices. Parker discussed his interest in working with the tech giant in a recent interview with Bloomberg News, saying he is “bullish” on the company’s relationship with Apple, according to The Verge.

With Nike and Apple having a long history together, Parker added that the two companies can accomplish things together that they wouldn’t be able to on their own. Nike has supported iPods and iPhones with Nike+ and the Apple Watch, and Parker’s interview follows a year after Apple hired the sports and fitness company’s former design director to develop wearables. “As I look ahead at what’s

possible with Nike and Apple ... technologically we can do things together that we couldn’t do independently,” he explained. “So yeah, that’s part of our plan, is to expand the whole digital frontier in terms of wearables and go from...25 million Nike+ users to hundreds of millions.” While Nike has stopped developing FuelBand activity trackers, the company believes it can still take

advantage of the wearable market if it begins to release devices that are less geeky, Mac Rumors reported . Corporate Charity Challenge Golf Challenge raises $25,000

On Sunday October 12th Provo Golf Club hosted the 1st Annual “Corporate Charity Challenge”, a fun weekend of golf and camaraderie among the business community of Providenciales. In total, $25,000 was raised, of which $22,500 will go towards new kitchen equipment for the Culinary Arts Program at the Turks & Caicos Community College, and $2,500 was donated to the National Cancer Society. The opening party on Friday night set the stage for a fun weekend, with the highlight being the spirited unveiling of colorful Championship Sports coats for the organizing committee and T&C Community College staff. Students

of the Community College were also involved in the catering for the event, which was gratefully received by the participants. A glorious Sunday then saw 13 teams participate in a competitive net scramble golf format. After a fun 4 hours, a three way playoff was needed to declare the eventual champions between Turks & Caicos Water Company, Royal Bank of Canada/Coast Architects and Mac Motors/Dickenson Insurance. All 12 golfers in the playoff hit a pressure packed approach shot to the 18th green in front of the full clubhouse gallery, before the mixed team comprising of Royal Bank of

Sponsored by the World Olympians Association (WOA), the project aims to raise money to combat Ebola in Sierra Leone and

other hard-hit West African countries. According to WOA officials, the group has partnered with charities Oxfam and Medisend International, a non-governmental organization known for building health care systems in the developing world, to launch the campaign, headed up by Sierra Leone native and two-time Olympian Dr. Francis Dove Erwin. Oxfam teams are working with local communities to

stop the spread of Ebola by conducting public education campaigns andproviding treatment centers and communities with critically needed safe water and sanitation facilities. Only losers afraid Bowlers pause can now be deemed unfair to play with Kobe

Kobe Bryant Lakers president Jeanie Buss has a message for any player who doesn’t want to play with Kobe Bryant: good riddance. “Any free agent that would be afraid to play with Kobe Bryant is probably a loser, and I’m glad they wouldn’t come to the team,” Buss said during a “SportsCenter” interview Thursday. Buss was asked to comment on an ESPN The Magazine feature published earlier in the week, in which several agents and NBA personnel -- including Lakers insiders -- said that L.A. has been unable to attract top talent in free agency because players don’t want to work with Bryant. “ I read the story,” Buss said Thursday. “I don’t agree with any of it. If there is somebody that’s on our payroll who is saying things like that, I’ll soon get to the bottom of it, and they won’t be working for us anymore.” In fact, Buss has a warning for all of Bryant’s detractors: “I have no doubt that Kobe will make people regret ever saying” those comments, she said.

The Lakers have won five championships with Bryant, though they haven’t made a trip to The Finals since 2010 and missed the playoffs entirely last season as Bryant appeared in just six games because of injuries. Bryant, now 36, signed a two-year extension with the Lakers last year worth $48.5 million. He is the league’s highest-paid player. In recent offseasons, the Lakers have courted and failed to sign freeagent stars including Dwight Howard, Chris Bosh, Paul George and Carmelo Anthony. The Lakers were particularly interested in Anthony, offering him a maximum four-year, $95 million deal to come to L.A. last summer. Bryant, however, did not make the Lakers’ meeting with Anthony as planned, and Anthony ending up re-signing with the New York Knicks. “We made a very good case for [Carmelo] coming to Los Angeles,” Buss said. “But he’s from New York, he sees a mission. The ICC has asked match officials to use their discretion to decide if the pause is unfair play under Law 42.2. This is a clarification in the latest, and unpublished, match officials almanac. It was the same document that allowed Steve Smith’s catch of Fawad Alam in an ODI earlier this month. Smith had begun to move from slip towards leg slip even before Alam had had a chance to strike the ball, which under existing playing conditions is considered unfair and significant movement, but is being encouraged by the ICC as the fielders’ anticipation. The ICC has chosen to not publish these clarifications because it believes they are not changes to playing conditions per se, just clarifications for better and more relevant interpretations of the law. Both the fielder movement as a response to switch hits and reverse-sweeps and other premeditations, and the bowlers’ pause are developments that have crept into the game without being covered by specific laws and playing conditions,

There is greater autonomy to the on-field umpire in these instances now. “There is no stopwatch being used to measure the length of the pause,” an ICC spokesperson told ESPNcricinfo. “This is one issue where the umpires on the day need to judge what is unfair. “The pause before delivery has not been specifically outlawed but each incident of this nature will be judged on its merits and will be dealt with under Law 42.2. When the umpires feel that a bowler is deliberately using this tactic unfairly to distract a batsman they can rule dead ball.” There can be an endless debate on what significant and unfair movement is, or what constitutes a significant and long pause, which will only be accentuated by its relying on how the umpire on the day sees it. Moreover the fact that the ICC hasn’t publicised these has potential to create controversy, as was evident in Alam’s case. Plans to reform NBA draft lottery fail to pass Proposed changes to the NBA’s draft lottery format designed to distribute the odds more evenly among the non-playoff teams failed to pass at the league’s board of governors meeting on Wednesday, Commissioner Adam Silver said. Silver said the final vote was 17-13 in favor of the reform but that fell short of the required 23 votes -- three-quarters of the league’s teams -- needed to change the lottery. The reform plan was to discourage the idea of losing on purpose, known as “tanking”, to increase a team’s odds in the lottery. Silver said the league has to “find the right balance” in creating incentives for teams to win and allowing what is appropriate re-building through the draft. “We’ve tinkered with the draft lottery several times over the years,” Silver told a news conference. “I don’t necessarily disagree with the way it works now. “From a personal standpoint, what I’m most concerned about is the perception out there right now. Frankly, (there is pressure on a lot of our teams, even from their very fans, to somehow underperform because in some people’s view (that’s) the most efficient and quickest way to get better. “That’s a corrosive perception out there.” The reforms would have given the league’s four worst teams identical odds (around 11 percent) of winning the number one draft pick, with the fifth team having about a 10 percent chance and the rest of the teams declining odds, ESPN reported. Under the current system, the team with the worst record has a 25 percent chance at the top pick and the second-worst team has a 19.9 percent chance. Each subsequent team’s odds decline slightly. The board unanimously agreed to send the issue back to the NBA’s Competition Committee for additional study, Silver said.
