aritime and law enforcement officials in the Turks and Caicos Islands (TCI) netted one of their biggest catches in recent times when they hauled in 28 poachers from the neighbouring Dominican Republic with more than 2000 pounds of sea food from TCI’s banks.
The men, who were caught in Turks and Caicos Islands waters last Thursday July 23rd, were each fined $5,400 forthwith, or six months in Grand Turk prison, when they appeared before Chief Magistrate Clifton Warner in Court # 1, on Tuesday July 28th and pleaded guilty. Their names are: Ewar Santos, Gencis Martinez, Yoel Polanco,
Pedro Vasquez, Yonatan Germam, Elexi Martine, Belnando Vargas, Framkli Mejiabatista, Josemanuel Garcia, Alex Vasquez Marolo Garlcia, Mario Ulloa, Victor Alfonso, Jose Vasquez, Andres Gonzalez, Rodolfo Felix, Jorge Sisnero, Julio Vazquez, Jose Mendez, Cersa Vasquez, Sedatian Diaz, Miguel Peiva, Yordis Morales, Pedro Medina, Danney Ferrcira, Rafael
Bentura, Wilber Gil and Dionis Morel. They were charged with possession of Parrot Fish, possession of egg-bearing Crawfish, using unlicensed vessel to fish in TCI waters, taking marine product without license, using artificial breathing devices to fish in TCI waters and possession of spear gun while on a vessel. For many years, fishermen from the Dominican Republic have been known to fish illegally in TCI waters. Magistrate Warner also ordered that fishing boats and gear belonging to the men be confiscated and hand over to the state for disposal. The items include 14 small vessels, 14 Yahmaha 15-hoursepower outboard engines with fuel tanks, 14 spear guns, 14 lobster hooks, 15 pair of masks, 14 air compressors and 14 rolls of breathing tubes. The court was told that Department of Environment
and Maritime Affairs (DEMA) officers received information that a number of small boats were seen fishing in several miles off Bush Cay, which is well within the boundaries of the Turks and Caicos Islands. DEMA, officers responded with the Royal Turks and Caicos Islands Police Force Marine Branch, and later apprehended the men. The boats, fishing equipment and the catch, were seized. In their defence, the men told the court that their captain brought them to the spot and released them before sailing away. They further told the court had they known that the spot was TCI waters, they would have urged the captain to take them elsewhere. Prosecutor Clement Joseph said he was pleased with the way the case turned out because he wanted the court to fine the men with the money to be paid forthwith or they go to prison. Senior Sun Editor Some Dominican voices in the Turks and Caicos Islands are nudging the local government to liaise with their Dominican counterpart to catch and prosecute head honcho poachers who dispatch peasant fishermen in our waters to steal TCI’s fish stock. The call came from Jose Perez, a Dominican native who lives in TCI, who told reporters that he is fed up with the prominence with which persons of his extraction are either being caught or escaped after seen poaching in TCI waters. Tensions build between youth from Overback, Back Salina By Vivian Tyson
Senior Sun Editor The Grand Turk police are working to calm simmering tensions between youths of two of that island’s settlements, who have been at each other’s jugular in recent time, and has escalated since Kevino Smith’s murder. The police on the capital island confirmed the brewing hostilities, but threatened to nip it in the bud, while calling on parents and guardians to take control of the children, who are involved. Senior Superintendent Clifford Henry, Divisional Commander for Grand Turk made the appeal in the wake of confirmation that human remains found in the Breezy Brae area of Grand Turk in April, 2015, belong to the missing Kevino Smith. To that end, Henry has dispatched an appeal the community to allow the police do their job rather than taking matters into their home hands.
“We are appealing to the citizens of the community of Grand Turk to let us, as an organization, carry out the investigation. And there are a lot of issues that are going on here in this division. We must take heed as it relates to law and order. “We cannot go out on a daily basis and commit acts of crime and expect nothing to be done. The police department will be taking a serious look at the issues that are currently going on here in the division between the Overback community and the Back Salina Community,” Henry said. He added: “Parents, speak to your kids. Assist them, direct them. We do not want it to escalate into any serious situation, as that is likely to happen, and as a divisional commander, we, as an organization, would not tolerate any kind of infraction as it relates to disobedience of the law, because we are a law-abiding community, and we want everyone to live in peace and harmony on the island of Grand Turk. “Those persons out there, who have in mind or thinking about
committing any offenses as it relates to breaking the law, take heed to these words. We, as an organization and as a police force will not tolerate any kind of disrespect from for law and order in the community of Grand Turk.” For his part, Deputy Commissioner of Police, Rodney Adams pleaded to the community to not allow themselves to be overtaken by emotion, but rather assist the police into telling what they know so that they could be able to solve the Kevino Smith murder. “You would have heard folks making various comments across the community at the beginning of this matter back in March. Some of the comments are based on emotions, and I think we don’t want a police that also operates on emotions. We have to deal the matters based on evidence. “Assumptions and speculations, as far as we are concerned in the Royal Turks and Caicos Islanders Police Force, do not equate to evidence. Facts are what
evidence is all about. And, I want to reassure the community of Grand Turk, as I have earlier this afternoon, reassure the family of the late Kevino Smith, that we will leave no stone unturned, and we will ensure that there is justice for Kevino Smith,” Adams said. Pastor Chad Archibald, who was part of the news conference, urged the community not to take on a vigilante role, but forward the necessary information to the police so they could nab Smith’s killers, Kevino Smith could get justice and his family gets closure. “The assistance that the police require from you is important, in that, it not only need you to restrain yourself, but whatever resources or whatever information you can bring forth to the police, would be very, very important,” he said. In the meantime, Adams said Kevino Smith’s remains were sent off in April and the results came back from the overseas lab last Friday, July 24, 2015. He was not prepared to say what was the cause of death.

Two Bahamians among seven sentenced for illegal entry
Vernon Roosevelt Pinder, the Bahamian, who police suspected to be the mastermind behind the illegal entry of five Haitians and another Bahamian into the Turks and Caicos Islands, makes his way to the Providenciales Magistrate’s Court 1, under the watchful eyes of an immigration officer. By Vivian Tyson
Senior Sun Editor Five Haitians and two Bahamians were sentenced to three months in prison after pleading guilty to unlawful entry into the Turks and Caicos Islands on. The individuals, which included four men and three women, are identified as Vernon Roosevelt Pinder and Rory Jean Charles of the Bahamas, and Marie Anelle Azemar, Faustin Woodline , Elimar St. Martin,
Some of the Illegal Haitian nationals being ushered by immigration officials shortly after they were sentenced in the Providenciales Magistrate’s Court Solange Pierre and Wesley Orilus of Haiti. The seven arrived in the TCI on a go-fast boat on July 20, 2015. Pinder, who was suspected as the captain of the vessel, was also charged with assisting in illegal immigration, but the Crown later dropped the charges for lack of evidence, as Pinder had pleaded innocent to that rap. The court was told that at about 10:30a.m., on July 20, 2015, immigration officials, acting on information, went to Cooper Jack area of Providenciales and saw a speedboat, with Pinder and Charles in the custody of police officers. They later learned that they arrived in the
TCI illegally. At about 8p.m. that day, immigration officials responded to a call that suspicious persons were seen in the Cooper Jack area, and upon arrival, saw three females, who, on seeing the immigration officers, began to run. They were pursued, apprehended and taken to the detention centre in Providenciales. On July 21, 2015, immigration officials went back to Cooper Jack and apprehended two Haitian males. All were later interviewed, processed and charged. All were given a chance to explain why they came to the TCI. Charles said that he did not know any
of the Haitian nationals. St. Martin said told the court that life back home was rough, and so he came here to seek a better living. Orilus told the court that life back home was treating him rough, and so, he came here to eke out a living for his wife and child back home. Pinder did not give a clear indication as to why he came here. In addition to the threemonth sentence, Chief Magistrate Clifton Warner recommended that all be deported after serving their prison time. Asked sometime later as to why he decided to drop the assisting in illegal immigration charge against Pinder, Prosecutor Clement Joseph said that none of the other detainees wanted to testify against him. “Pinder was charged with illegal immigration and secondly assisting in illegal immigration. To assisting in illegal immigration, to prove that charge, we must have an illegal immigrant that said ‘he assisted me’. but none of them was willing to testify against him, so we couldn’t sustain that charge. “They (Haitians)were not caught with him, they came of the boat and were caught in the general area, so there was no direct evidence. So he will just serve his three his three months and will be deported back to the Bahamas,” Joseph said.

Thorne, QC from Barbados and Beryn Duncanson are challenging the constitutionality of the court headed by retired Jamaican judge Paul Harrison. The lawyers are also challenging the power of the court to order a trial without a jury. “The challenge springs from fundamental breaches of law that have been legislated specially for this trial,” the lawyers said in a press statement. “We are contending that the government has established a special court akin to those of other countries that have experienced severe, social, political and military unrest. Unless it can be demonstrated that this kind of upheaval has taken place in Turks & Caicos, every citizen of this country remains equally entitled to the protection of the constitution.” The statement added: “Apart from

challenging the constitutionality of what appears to be an undue special court, we are challenging the law that gives to that court the power to order that our client must be tried without a jury. We are contending that this order tramples on ancient and sacred principles that stipulate that in matters of trial a man is entitled to be ultimately judged by his fellow citizens.” “It has not escaped our attention that our client is being denied this right while all around him others have been given the same right. We strenuously contend that jury trial is not a luxury nor a privilege. It is a right that is not easily whittled away.” “We are arguing that there is no option other than fair trial. You either have a fair trial or none at all! We are concerned that in the prevailing legal circumstances the prospect for fairness seems to have lost its constitutional guarantee.” “We are prepared to argue that the report of the Commission of Inquiry into possible corruption

Hon. Amanda Misick attends IRENA energy conference in Martinique
The Minister responsible for Infrastructure, Housing and Planning, the Hon. Amanda Misick recently lead a delegation to the International Renewable Energy Agency (IRENA) -Martinique Conference on Island Energy Transitions: Pathways for Accelerated Uptake of Renewables, held last month in Fort-de-France, Martinique. The event was based on the Small Island Developing States (SIDS) Lighthouses Initiative, which aims to mobilize $500 million USD, deploy 100 MegaWatts(MW) of new solar photovoltaic power, deploy 20 MW of new wind power and ensure that all participating SIDS create renewable energy roadmaps within the initial 5-year timeframe. Under this initiative, the Martinique Island Energy Conference set forth a Martinique Action Plan (MAP) which proposed a concrete set of actions to accelerate the uptake of renewables, in particular wind, geothermal and marine technologies. Actions included the development of
a Grid Integration Framework for islands as well as the creation of a network for islands to share resources, knowledge, experiences and strategies for expanding the use of renewables. “Given the initiatives currently being undertaken, I welcome the exposure and networking opportunities as well as being able to get a better understanding of the development as well as the benefits of renewables within the region” noted Hon. Missick. “The exposure gives us the opportunity to see how similar countries are tapping into available resources to implement alternative energy options and curb rising energy cost for its population.” The Minister was accompanied by Ms. Sparkle Prentice, Energy Analyst in the Department of Energy and Utilities and Ms. Kathy Walkin, Head of Secretariat for the Ministry. Among the models showcased at the conference from which the Turks and Caicos can benefit were grid integration examples in Seychelles, São Tomé, King Island and Mauritius,

The conference, which highlighted the need for enabling frameworks for renewables
investments and advancement through renewable energy project partnerships, was a milestone in the implementation of the Lighthouses goals for the UNFCCC 21st session of the Conference of the Parties (COP21). The progress of the Martinique Action Plan will be showcased at COP21 in November and December.

Jack Nasty wants to fight crime with music
By Vivian Tyson
Senior Sun Editor International recording Artiste Jack Nasty want to curb the crime and violence in the Turks and Caicos Islands among young people through music. In fact, he is seeking the blessing of the government to have sounding engineering and music recording become part of schools curriculum. “What I want to do is to incorporate a music programme into our curriculum, where as oppose to your traditional music programme, we can do audio engineering, studio recording and incorporate that into the education curriculum and tie in that with the usage of music as a tool to try and prevent violence. “We have got a lot of troubled teens and a lot of crimes, as you know, and it has been increasing over the years. And a lot of these guys have hidden talents that we don’t see. So, I am trying to bridge the gap between law enforcement, our leaders and our young people,” he explained. “It seems like everybody is not speaking the same language, but if there is one language that everybody
can speak its music. These young kinds that are talented, it seems there is no hope. Some of them have never seen a studio before in their lives, and something that is as simple as music and a recording studio may change their lives and shift their direction,” he added. In addition to the introducing music engineering and recording in school, Jack Nasty, whose given name David Lightbourne, also wants to start a “Nomore violence Campaign”, which he said would involved all stakeholders. “The focus would be to take back our communities – know who are your neighbors. That culture has been fading away. Before, you would know who live next door to you, today, you don’t know. We need to know what’s going on in our communities, we need people to get comfortable to communicate that with us, and we need to reach out to the young people and speak; music is extremely powerful in doing so. I think it needs to be approached with a sense of urgency. I don’t think most people realize how serious it (the crime situation) is, and we become more and more desensitize to it. Somebody got killed, okay, couple of days later we don’t even talk about it anymore. And before, years ago,
when somebody got into a fight, that was a big conversation for months. “So that culture has changed, and that’s scary in itself, because somebody can come to my house and your house and kill me, kill you, kill your family, and what happen, they stopped talking about two weeks, and it goes on unsolved. So how do we bridge that cap and start get people start communicating? Because people are seeing these stuff, people know who is doing what, but people are not communicating that,” he said. The entertainer is also calling on the police to establish a closer relationship with the communities’ young in order to build trust, since young people are most likely the ones to know what is taking place in their communities. “This is not a criticism of our local police, I love them, but I think sometimes they should use discretion and also get some training as it relates to customer service. Most of our police are good police, but for the most part, you hear a lot of young people saying that, ‘when they stopped me they disrespect me, they shout at me’, and it may be a simple traffic stop. There is no need to should and scream at someone.
Jack Nasty “And you should understand how to communicate with these people because you can easily generate hatred. Even as a mature adult, they maysee something happening and may not want to tell you because they have a bad experience with you. So the police need to build up their trust again. Music is a very powerful tool that law enforcement could even use to bridge that gap,” he advised.

Baha Mar mega resort in The Bahamas needs $400M for completion
A $400 million funding gap has emerged in the effort to finish a $3.5 billion mega-resort project in the Bahamas, according to a letter from the developer viewed by Reuters. Sarkis Izmirlian, developer of the Baha Mar resort, outlined the shortfall in a July 23 letter to China’s Export-Import Bank, the main lender on the project. He proposed funding half of the shortfall, with the rest coming from China’s Export-Import Bank. “We will lend $200 million alongside (China Export Import Bank) on a 50-50 basis into a new senior facility totaling $400 million that will fund the completion, opening and stabilization of Baha Mar,” Izmirlian wrote to Liu Lange, president of the Chinese bank. Bahamas Prime Minister Perry Christie was copied on the letter. He has said the completion of Baha Mar is a matter of national importance. The fragile economy of the Bahamas is counting on the resort to provide 5,000 jobs and a 12 percent boost to its gross domestic product. Construction of Baha Mar, which will feature a Las Vegas-style casino and more than 2,000 hotel
rooms, has been stalled for months as the project missed a March deadline to open after running out of money. That forced Izmirlian’s Baha Mar Ltd to file for Chapter 11 bankruptcy protection on June 29 in a Delaware court. Since then, Baha Mar Ltd and the project’s main contractor, China Construction America (CCA), have issued several dueling press releases blaming each other for the resort’s problems. China Ex-Im Bank has financed much of the project with a $2.45 billion loan and CCA made a minority equity investment of $150 million, in addition to being the main contractor. Izmirlian’s family has invested more than $900 million. CCA is trying to block Izmirlian from reorganizing in U.S. bankruptcy court. The Bahamian government wants to assign liquidators, saying that process would be faster than moving through the U.S. bankruptcy process. In his letter to the Chinese bank, Izmirlian expressed fear he would lose his hotel partners if the project goes through liquidation in the Bahamas. “Appointing a liquidator at
this point is likely to substantially negatively impact or lead to the extinguishment of those relationships, will lead to management upheaval, and will make it impossible to operate the resort in a short time frame even if completed,” Izmirlian wrote in the letter. Meantime, four-party talks in Beijing on Monday and Tuesday yielded ‘considerable progress’ in resolving the dispute over the unfinished Baha Mar Resort but ended without a deal, according to the Bahamian government. “The remaining major point of difference between the parties is Baha Mar’s refusal to provide their part of a guarantee required by [ExportImport Bank of China] to secure a commitment of additional lending to enable completion of the project,” a government spokeswoman wrote in statement Tuesday night. Representatives from developer Baha Mar Ltd., contractor CCA Bahamas and Export-Import Bank of China joined the five person Bahamian government delegation led by Attorney General Allyson Gibson in the negotiations. The Bahamian delegation was on its way back to the Bahamas Tuesday night, according to
the spokeswoman. She said that Export-Import Bank of China is proposing $200 million in new lending to go toward completion of the $3.5 billion Baha Mar resort, but the bank has insisted that such a loan be guaranteed by either Baha Mar Ltd. or CCA Bahamas, which is a unit of China State Construction Engineering Corp. In Beijing, the spokeswoman said, Baha Mar Ltd. offered to provide a standby letter of credit of $25 million. CCA, meanwhile, offered to guarantee the remaining $175 million on the condition that it receives a corresponding guarantee of $100 million from Baha Mar Ltd. But the developer has declined to make such a guarantee, she said, and has proposed as an alternative that the Bahamian government provide the bank with a sovereign guarantee of up to $175 million. Late Tuesday night, CCA issued a statement that largely mirrored the government’s report on the negotiations. The statement blamed Baha Mar CEO Sarkis Izmirlian for not agreeing to the $100 million guaranteed.
Guyanese pilot busted again in cocaine distribution
As if losing his planes and bank accounts and facing jail time were not enough, a Guyana-born pilot charged with smuggling bulk cash is now in deeper trouble in the US. Prosecutors said he was plotting to bring five kilos of cocaine aboard his plane from Guyana to the US, even while he was facing court for the cash-smuggling charges. Captain Khamraj Lall last month pleaded guilty in a deal with US prosecutors and was out on bail awaiting sentencing on October 27th. However, on Wednesday, US Marshals arrested him in New Jersey, a state near New York, and charged him with conspiracy to distribute cocaine. Yesterday, United States Attorney William Hochul, Jr announced a federal grand jury has returned a two-count indictment charging Lall, of New Jersey, with possession with intent to distribute, and to distribute, five kilograms or more of cocaine and importation of five kilograms or more of cocaine into the United States. According to 7thspace.com online news, the charges carry a minimum penalty of 10 years in prison, a maximum of life and a US$10,000,000

Assistant United States Attorney Robert Marangola, who is handling the case, stated that according to the indictment, between December 2013 and February 10, 2015, the defendant conspired to possess and import from Guyana into the United States, five kilograms or more of cocaine. Lall is accused of transporting the cocaine on his flights from Guyana to the United States. Following his arrest Wednesday in New Jersey, he made an initial appearance in federal court in the District of New Jersey and was detained. The defendant will be returned to the Western District of New York at a later date. Lall’s arrest is connected to that of nine other defendants in February 2015. Edward Mighty, Seymour Brown, Andre Taylor, Ricardo Bailey, Robert Wilson, Kenneth Harper, Desmond Bice, and Christopher Samuels, all of Rochester, New York, were charged by criminal complaint with conspiracy to distribute five kilograms or more of cocaine and 280 grams or more of cocaine base. Defendants Mighty, Brown, Taylor, Wilson, Harper, Bice, and Samuels were also charged with possession of a firearm in furtherance of a drug trafficking crime and conspiracy to possess firearms in furtherance of drug trafficking. According to the complaint, Mighty is one of the leaders of a Rochester-based drug trafficking organization and would obtain kilogram quantities of cocaine from Winifredo Gonzales. The cocaine was transported to Rochester and processed, re-packaged, and distributed in various quantities of both powder and crack cocaine through multiple sellers in the Rochester area. On February 10, 2015, officers executed a search warrant and arrested Gonzales at a residence in Brooklyn. Officers recovered 17 kilograms of cocaine and two handguns, including an UZI 9mm pistol. Officers also seized approximately $70,000 in United States currency. The Bahamas Junkanoo Carnival’s “Junkamania”
Junkanoo Carnival made $50Million impact on The Bahamas GDP Bahamas Junkanoo Carnival’s chairman stood by his projection that the inaugural festival increased Bahamian gross domestic product (GDP) more than $50 million, with the event having a direct economic impact of $19 million. According to the Nassau Tribune, Paul Major, the Bahamas National Festival Commission’s chief, said: “The GDP impact that I said will be over $50 million, I stand by that number, but I don’t want to talk to that yet because we have Deloitte and Touche doing an economic/ GDP impact study which will be ready in a few weeks. “I stand by that number because whatever is spent directly there is some multi-plier effect that translates that into a GDP impact. It’s somewhere between 3 and 7 per cent as a multiplier effect. “Whatever the foreign input is is multiplied by as much as seven times, and for things that are local, input could be anywhere from one to four and that’s all about money being recycled in the economy.” A Commission report dsaid Junkanoo Carnival generated $19 million in direct economic activity - $13.5 million on New Providence and $5.5 million in Grand Bahama. Total government (taxpayer) subsidies amounted to $12.9 million, 86 per cent of which was spent with Bahamian companies. Mr Major said the inaugural event had provided a solid foundation for the Festival’s future, and the net cost to Government will be less going forward. He added that participating companies having already been advised they would not receive the same level of subsidy as seen in 2014. “The net cost to the Government will be less to the extent that we have no doubt now that we have got the firepower to be able to go to major international sponsors to be able to raise a lot more money,” said Mr Major. The Commission’s report said the Government earned $1.5million in direct revenue, and $6.6 million in tax revenue.

New York City mayor calls for Puerto Rico to access US bankruptcy laws New York City Mayor Bill de Blasio on Tuesday joined calls urging the U.S government to allow Puerto Rico’s public entities to file for bankruptcy protection. A bill was introduced last year by Puerto Rico’s representative in Congress Pedro Pierluisi to allow the U.S. territory to use federal bankruptcy laws to restructure the debt of its public agencies, but it has not won Republican support. A companion bill was introduced by Democratic Senators Richard Blumenthal and Charles Schumer earlier in July. “If we don’t do it, Puerto
Rico simply can’t get back on its feet,” de Blasio said at a City Hall press conference. “We’re obligated because we as Americans believe we’re supposed to help our fellow Americans in times of trouble.” Similar events were held on Tuesday in Washington, D.C., and Orlando, Florida, home to another large Puerto Rican population. More Puerto Ricans live in New York City than any place other than the U.S. territory itself, said de Blasio, who also gave a short address in Spanish. Puerto Rico is looking to
restructure $72 billion in debt. On Monday, Puerto Rico’s Governor Alejandro Garcia Padilla was in Washington, D.C., to plead the island’s case. New York City Council Speaker Melissa Mark-Viverito, who is Puerto Rican, called for the federal government to invest in the island and eliminate policies that put it at an economic disadvantage. “Austerity is not the solution,” she said. “The solution to this crisis cannot be at the expense of the working class and the most vulnerable.” New York City Mayor Bill de Blasio
Hemingways Havana home to get $900K upgrade HAVANA -- A U.S. foundation will ship nearly $900,000 in supplies to build a state-of-the-art facility to preserve Ernest Hemingway’s books, letters and photos - the first major export of construction materials to Cuba since President Barack Obama loosened the trade embargo on the island. The Boston-based Finca Vigia Foundation has been trying for years to help Cuba stop thousands of pages of documents from slowly disintegrating in the baking heat and dripping humidity of the sprawling home where the American writer lived and worked outside Havana from 1939 to 1960. Officials with Cuba’s National Cultural Heritage Council, which runs the Finca Vigia, have been enthusiastic about building a conservation laboratory but said they didn’t have the funds or supplies to do it. High-quality building materials are virtually impossible to find throughout much of Cuba, with homeowners forced to buy paint and water pumps stolen from government agencies and pay overseas travelers to bring items as large as sinks and kitchen cabinets in their checked luggage. In state-run hardware stores, a request for an item as mundane as a box of screws can provoke peals of laughter from sales clerks. The foundation’s proposal to send four shipping containers with as much as $862,000 of materials ranging from nuts and bolts to tools and roofing was approved by the U.S. government in May, after Obama created a series of exemptions to the embargo. The exceptions include permission for Americans to export supplies donated for the purpose of supporting the Cuban people in fields such as science, archaeology and historical preservation.
Novelist Ernest Hemingway’s Cuban hideaway is the first site outside the United States to make the National Trust’s list. Hemingway spent more than 20 years at the home near Havana, where he wrote “The Old Man and the Sea.” But now time and the elements have severely damaged the hacienda, called Finca Vigia, or Lookout Farm. The trust has gained permission to go to the communist-run island and begin emergency preservation work on the structure. Venezuela president in US to seek UN help with Guyana
Venezuelan President Nicolas Maduro speaks to reporters at United Nations headquarters, Tuesday, July 28, 2015. UNITED NATIONS — Venezuelan President Nicolas Maduro met with U.N. Secretary-General Ban Ki-Moon on Tuesday to ask for support in finding a solution to a territorial dispute with neighboring Guyana. Maduro told reporters he had discussed ways Ban might help resolve the border dispute with the much smaller Guyana over an area where a new oil discovery has been made. He called the meeting fruitful and said Ban was willing to send a U.N. commission to the two South American countries to mediate. Maduro also raised the possibility of him meeting with Guyana’s president. In a statement, Ban said the U.N. was ready to “discuss the way forward with both governments.” Venezuela long has claimed most of Guyana, including an offshore area where the Exxon Mobil Corp. recently announced it made a significant oil discovery. The Maduro administration issued a decree soon after that announcement extending Venezuela’s territorial claims farther out into the Atlantic to encompass the area where the discovery was made. Guyana President David Granger responded that his country would seek to resolve the border issue with an international judicial settlement. Both presidents have affirmed that the conflict will be settled without violence. The dispute stems from an 1899 court ruling that required Venezuela to relinquish an undeveloped but resource-rich jungle territory called the Essequibo that constitutes about two-thirds of Guyanese territory. Venezuela contends the ruling was invalid, and many official maps still describe the Essequibo as Venezuelan territory. Guyana says Venezuela pledged to abide by the ruling, but later reneged.

Indian Ocean debris almost certainly from Boeing 777
Malaysia is “almost certain” plane debris washed up on the Indian Ocean island of Reunion is part of a Boeing 777, its deputy transport minister said, heightening the possibility it could be wreckage from missing Flight MH370. Prison worker explains how she helped 2 murderers escape Joyce Mitchell
The prisoners stuck a smiley-face note on the pipe they cut open to break out of the prison. The prison worker who just pleaded guilty to helping two inmates escape their cells in upstate New York has detailed her relationship with the convicts to police, according to documents obtained by NBC News. “I believe I helped Inmate Matt and Inmate Sweat escape because I was caught up in the fantasy,” Joyce Mitchell, a 51-year-old who worked as a seamstress at the Clinton Correctional Facility, reportedly said. “I enjoyed the attention, the feeling both of them gave me and the thought of a different life.” Mitchell eventually got cold feet once the prisoners broke out of the maximum-security facility, but she appears to have been very much involved in the planning of the escape.
She then failed to show up to be the duo’s getaway driver. Mitchell reportedly told police that she knew convicted murderers Richard Matt and David Sweat planned to kill her husband and make their getaway with her. She reportedly had a sexual relationship with both of them, sending nude photos to one and performing sex acts on the other. Mitchell told police that the prisoners told her to drug her husband, who they called “the glitch,” so that they could carry out their plot to kill him. Mitchell detailed the plan to investigators: “These two pills were intended to knock Lyle out so I could leave the house. After Lyle was asleep, I was supposed to drive to Dannemora

Cincinnati police officer indicted in shooting death of black man A University of Cincinnati police officer was indicted Wednesday on murder charges in the fatal shooting last week of an unarmed black motorist who was stopped because of a missing front license plate. Hamilton County prosecutor Joseph Deters called the July 19 death of Samuel Dubose, 43, “senseless” and “totally unwarranted.” Ray Tensing, the 25-year-old white officer who shot Dubose in the head, “wasn’t dealing with someone who was wanted for murder,” Deters told a news conference. “He was dealing with someone who didn’t have a front license plate. This is, in the vernacular, a pretty chicken crap stop.” The incident was the latest in a series of fatal police confrontations across the United States that have raised questions about police use of force against minorities. Tensing will be arraigned at 10 a.m. EDT on Thursday in the Hamilton County Court of Common Pleas and could face the possibility of life in prison if convicted. Cincinnati officials braced for possible unrest after the announcement of the grand jury’s decision and the university shut in case of protests. A body camera video that Deters played for reporters showed Tensing stopped Dubose for a missing front license plate. Dubose failed to provide a driver’s license as Tensing requested then tried to prevent Tensing, who told Dubose to take his seat belt off, from opening the car door.
office was investigating that. Tensing’s attorney, Stew Mathews, told Fox 19 television in Cincinnati that his client was being “thrown under the bus” by the prosecutor and the school. A second video will show more of the incident, he said, according to Fox 19. Tensing was fired by the university police on Wednesday, and school officials said they were discussing providing educational support for Dubose’s children. RIOTS AFTER 2001 SHOOTING
Prosecutor called the July 19 death of Samuel Dubose (right) by Ray Tensing, the 25-year-old white officer, “senseless” and “totally unwarranted”. The car started slowly rolling forward as Tensing reached in and yelled for him to stop. The officer then pulled his gun and fired once, killing Dubose. Deters said Tensing was not dragged by the car, as the officer had reported, but instead he fell backwards after shooting Dubose in the head. Deters said Tensing should have let Dubose drive away as he had his license plate number already. “I’ve been doing this for 30 years,” Deters said after meeting with Dubose’s family. “This is the most asinine act I’ve ever seen a police
officer make, totally unwarranted.” Tensing “should never have been a police officer,” he said without elaborating. Audrey Dubose, the victim’s mother, praised the indictment. “I’m so thankful that everything was uncovered,” she told reporters. “I thought it was going to be covered up.” She said she could forgive Tensing for her son’s death. Asked about a second police officer who supported Tensing’s account of the incident, Deters said his
The incident was the latest in a string of deaths of black men at the hands of police in the past year, including Michael Brown in Ferguson, Missouri, Eric Garner in New York City, Freddie Gray in Baltimore and Walter Scott in North Charleston, South Carolina. Prosecutors brought charges against officers in Baltimore and North Charleston. Cincinnati was convulsed with riots in 2001 after police shot an unarmed 19-year-old black man who was wanted for traffic violations. The Cincinnati police went through extensive reform after that incident, and an independent agency was set up to handle complaints against the police. Dubose’s family saw the body camera video on Wednesday for the first time and met with Cincinnati Mayor John Cranley. The family urged calm in the community, according to Cranley spokesman Kevin Osborne.

Online symptom-checkers are often wrong
Online symptom checkers often misdiagnose patients’ problems, often encouraging people to seek care for minor issues that don’t need immediate attention and other times incorrectly telling people with true emergencies that treatment can wait, a U.K. study suggests. Researchers tested 23 online and mobile apps used by millions of people who are trying to find out if their symptoms are serious and what might make them feel better. The apps were imperfect at best, offering the correct diagnosis on the first try only about a third of the time. For triage - assessing the urgency of the problem - the apps were too cautious in situations requiring only self-care: only 33 percent of the time, on average, were patients appropriately advised not to go to the doctor. At the other extreme, symptom checkers typically missed the severity of the situation in one of every five cases requiring emergency treatment. Overall, the computer programs offered accurate triage advice for 57 percent of the standardized scenarios that were used in the researchers’ tests. “The risk is that people will be told to get care when they didn’t need it and bear the costs and inconvenience, or they will be told not to seek care when they have a life-threatening problem,” senior author Dr. Ateev Mehrotra, a health policy researcher at Harvard Medical School in Boston, said by email. Because patients may not get much useful information from a long list of possible diagnoses, the researchers rated the symptom-checkers based on whether the programs spit out the right answer first, or somewhere lower down on a list of up to 20 possible alternative diagnoses. The software listed the right diagnosis first in 24 percent of emergencies on average, and for 40 percent of non-urgent cases. Accuracy was better for common than for rare diagnoses. The app that did best at giving the correct diagnosis on the first try was DocResponse.com, at 50 percent. Accuracy was better for the systems that used Schmitt or Thompson nurse triage protocols, standard diagnostic tools used by clinicians to provide advice over the phone. With these nurse triage protocols, 72 percent of patients got the appropriate guidance on the urgency of their situation, compared with 55 percent without the protocols. One limitation of the study is that it used specific clinical language to describe medical conditions in the test vignettes, which may not provide an accurate reflection of how the symptom checkers would perform for patients using nonclinical terms to describe their conditions, the authors acknowledge in the British Medical Journal.
8 Australian men charged with 500 sex offenses against girl PERTH, Australia — An Australian man was accused Wednesday of allowing seven men to sexually abuse his 13-year-old daughter over the past two years, with police charging all eight men with more than 500 child sex offenses. Western Australia police arrested the men after receiving a tip-off from the public. Police say the father knew all of the men, and arranged for them to meet his daughter and subsequently assault her when she was between the ages of 11 and 13. The father is also accused of assaulting the girl. The father and the other men, who range in age from 35 to 47, are facing 503 charges, including sexual penetration of a child under 13, stupefying with intent to commit a criminal offense and sexual servitude of a child. Police Detective Superintendent Glenn Feeney, who described the abuse the girl suffered as “horrific,” said one of the men had 200,000 videos and 4 million child pornography images. The victim was featured in 149 images, he said. “It’s disgusting material — there are no words to describe it,” Feeney said. “Any sex offense against a child is just beyond words.” The girl is now safe and receiving treatment, he said.

Trump adviser apologizes for comments on marital rape
A top adviser to Donald Trump apologized on Tuesday for making “inarticulate” comments on the subject of marital rape that have ignited the latest in a series of political controversies involving the Republican presidential candidate. The comments by Michael Cohen, special counsel to the Trump Organization, were included in a Daily Beast report that said Trump’s exwife Ivana once used the word “rape” to describe a 1989 encounter with him. Cohen responded to the report by saying “by the very definition, you can’t rape your spouse,” the Daily Beast said. Marital rape is illegal in every U.S. state. Cohen also threatened legal action against the news outlet, saying “I will take you for every penny you still don’t
have.” On Tuesday, Cohen said in a statement he was incensed by the story and made comments he did not believe. “As an attorney, husband and father there are many injustices that offend me but nothing more than charges of rape or racism. They hit me at my core,” Cohen said. “In my moment of shock and anger, I made an inarticulate comment - which I do not believe – and which I apologize for entirely.” A spokeswoman for the Trump campaign said Trump “didn’t know of Mr. Cohen’s comments, but disagrees with him.” Trump, who leads or ranks near the top of the Republican presidential field in recent polls, has courted controversy during the campaign by mocking

Skipping breakfast may be bad for diabetics
People with type 2 diabetes who skip breakfast and fast until noon may have blood sugar spikes throughout the day, a small study suggests. When 22 patients with type 2 diabetes missed their morning meal, they had higher-than-usual surges in blood sugar after lunch and dinner, the study found. Skipping breakfast was also linked to less efficient processing of glucose by the body, or a reduced ability to convert blood sugar into energy. The researchers had expected that skipping breakfast wouldn’t be healthy. But they were surprised at the extent to which glucose metabolism suffered, simply because participants hadn’t eaten breakfast, said lead author Daniela Jakubowicz of Tel Aviv University. “This means reducing the amount of starch and sugars in lunch and dinner will have no effect on reducing elevated glucose levels if patients also skip breakfast,” she said by email. Globally, about one in 10 adults have diabetes, according to the World Health Organization. Like the patients in this study, most have type 2 diabetes, which is associated with obesity and aging and occurs when the body can’t make or process enough of the hormone insulin. Previous research has linked skipping breakfast to an increased risk for weight gain and diabetes, Jakubowicz and colleagues note in the journal Diabetes Care. The current study involved 12 men and 10 women who were about 57 years old on average, and overweight. On test days, patients were asked to fast overnight, then come to the clinic for blood tests and either two or three meals, depending on which part of the experiment they were completing. Participants consumed the
same balanced meal with the same number of calories for lunch and dinner. Two to four weeks later, they repeated the process, but switching to either eat or skip breakfast – whatever they hadn’t done in the first phase. On test days when patients skipped breakfast, their blood sugar was 40 percent higher after lunch and 25 percent higher after dinner than on the days when they had three meals. Skipping breakfast may have made it difficult for the pancreas to produce the right amount of insulin to properly control blood sugar, Jakubowicz said. Normally, beta cells in the pancreas release insulin in response to elevated levels of sugar in the blood. Missing the morning meal may cause the beta cells to “forget their vital role,” she said, delaying the release of insulin and allowing blood sugar levels to remain high for longer periods of time after lunch and dinner. Because the study only included people with diabetes, it’s not clear whether healthy people would experience similar blood sugar spikes after skipping breakfast, the researchers acknowledge. It’s also unclear how long the blood sugar spikes might last. It’s also possible that the last meal the night before might influence blood sugar the following day regardless of whether or not they ate breakfast, said Tanya Zilberter, a researcher in metabolic diseases with the Institut de Neurosciences des Systèmes in Marseille, France. A late dinner might lead to high blood sugar the next day, Zilberter, who wasn’t involved in the study, said by email. “It might be that the duration of the overnight fast matters more than the timing of the first meal of the day,” Zilberter said.
Seif al-Islam has been sentenced to death in his absence by a Tripoli court
Libya court sentences Kadhafi son Seif al-Islam to death
Tripoli - A Libyan court Tuesday sentenced a son and eight aides of slain dictator Moamer Kadhafi to death for crimes during the 2011 uprising, in a verdict denounced by rights campaigners. The United Nations also said it was “deeply disturbed” by the outcome and criticised the trial for failing to meet international standards. Seif al-Islam, the strongman’s one-time heir apparent who is also wanted by the International Criminal Court (ICC), was tried in his absence because he is held by militia opposed to the Tripoli authorities. Former intelligence chief Abdullah Senussi and Kadhafi’s last prime minister Al-Baghdadi alMahmudi were also sentenced to death, although they can appeal to the supreme court. The 37 defendants were charged with crimes including murder and complicity in incitement to rape during the revolution. Libya has been wracked by conflict since Kadhafi’s overthrow, with rival governments and powerful militias battling to control key cities and the country’s oil riches. The trial, which opened in the capital in April last year, has
been dogged by criticism from rights watchdogs and an unresolved dispute with the ICC in The Hague over jurisdiction in the case of Kadhafi’s son. The UN’s Office of the High Commissioner for Human Rights said Tuesday that there were “serious issues relating to access to lawyers, claims of ill-treatment, and trials conducted in absentia”. Rights groups say the trial missed an opportunity to expose the crimes of the Kadhafi regime. Amnesty International called the death sentences “appalling”. “Instead of helping to establish the truth and ensuring accountability for serious violations during the 2011 armed conflict, this trial exposes the weakness of a criminal justice system which is hanging on by a thread in a war-torn country with no central authority,” Amnesty’s Philip Luther said. Human Rights Watch’s Joe Stork said the trial was “plagued by persistent, credible allegations of fair trial breaches that warrant independent and impartial judicial review”. Seif al-Islam is wanted by the ICC on charges of war crimes and crimes against humanity.

decisions to keep the app narrowly focused on personal interaction and in-the-moment conversation, Yahoo executives said. The combination of video and text makes it hard to compare it directly to any other popular messaging service out there. Think of it as a an update on the silent movie. Or, if you prefer, a live gif. Including audio chat can sometimes discourage people from firing up an app, said Adam Cahan, the company’s senior vice president of video, design and emerging products. In a New York presentation streamed online Wednesday, Cahan said that Livetext is designed to be used for when you may not want to talk to someone -- maybe you’re at work, in line somewhere or in a crowded place -- but you want to show off your surroundings. Cahan said Yahoo looks at Livetext as a complement to other messaging programs, and as a product
that can carve out its own niche. “People use lots of different kinds of communications tools,” Cahan said. “And they’re using them in lots of different kinds of ways.” Cluttering up an app with too many features can be a big design mistake, said Arjun Sethi, Yahoo senior direct of product management and growth. Sethi came to Yahoo after his company, MessageMe, was acquired in October. Sethi said that MessageMe got a bit too bloated, and that his team took lessons from that app’s development while building Livetext at Yahoo. Yahoo’s mobile focus to date has been more about providing news, video and other information to users in a clean way, finding success with its weather and News Digest apps. Yet apart from its acquisition of the blogging platform Tumblr, Yahoo hasn’t shown a lot of interest in creating its own social service.

Apple Watch to be sold at Best Buy stores from August
Apple Watches are seen on display at the Apple store on 5th Avenue in the Manhattan borough of New York City The Apple Watch will be available at stores of Best Buy Co Inc , the largest U.S. consumer electronics chain, starting Aug. 7. important addition to an emerging product category, and we know our customers want it,” Jason Bonfig, senior category officer, said on the Best Buy website. The company said the product will also be available on its online store BestBuy.com. The Wall Street Journal first reported that the Apple watch was coming to Best Buy. Apple Chief Financial Officer Luca Maestri told Reuters earlier this month that sales of the Apple Watch had beat the company’s expectations. He said in the nine weeks since its launch in late April, the device had sold better than either iPhones or iPads over a similar period after their launch.
Twitter shares fall as growth of monthly users slows
Twitter Inc’s shares fell more than 11 percent in extended trade on Tuesday after the microblogging company said its number of monthly average users grew at the slowest pace since it went public in 2013. “This is unacceptable and we’re not happy about it,” Jack Dorsey, who stepped in as interim chief executive on July 1, said on a call with analysts. Twitter said it had 304 million core users in the second quarter, up from 302 million in the prior quarter. Twitter’s struggles to increase its audience worries investors, who are focused on the company’s growth potential, and the latest figures did little to reassure them. The data on users overshadowed the company’s second-quarter earnings and revenue, which exceeded expectations, and its bullish projections for future revenue. Executives also made clear it would be a long process, and were candid about problems with the service.
US auto safety regulators fine Fiat Chrysler record $105 million The U.S. auto safety watchdog, toughening its stance against manufacturer defects, announced on Sunday a record $105 million in fines against Fiat Chrysler Automobiles NV over lapses in safety recalls involving millions of vehicles. The Italian-U.S. automaker’s consent agreement with the National Highway Traffic Safety Administration contains an unprecedented buyback option covering hundreds of thousands of vehicles, including more than 1 million Jeep sport utility vehicles, whose owners can receive a trade-in or a financial incentive to get their vehicles repaired. Fiat Chrysler also agreed to submit to an independent monitor’s audit of its recall performance over a three-year period. The $105 million in fines sets a new standard for NHTSA’s dealings with car manufacturers, eclipsing the previous record fine of $70 million imposed against Honda Motor Co in January for failing to report death, injury and other claims.

Puerto Rico tourism industry lags rivals
Puerto Rico may sport palm trees, pristine beaches and glorious weather but its tourism industry is losing out to rival Caribbean islands and that is holding the U.S. territory back at a time when its deeply troubled economy most needs a fillip. Hoteliers blame a variety of issues for Puerto Rico lagging in both the growth of visitors and hotel rooms: mandatory staff perks, high construction and electricity costs, as well as plenty of red tape. And those problems may increase as the island’s government and the agencies it controls are struggling with a massive debt burden that could lead to default as early as this week. The Puerto Rico Tourism Company is seeking to fight back with a plan to add 5,000 hotel rooms by 2020, Laborde said. Officials also say that a marketing campaign launched in late 2013 - based on the description of Puerto Rico as “The All-Star Island” showed some signs of success with an increase in tourism spending recorded since then. Puerto Rico’s luxury hospitality sector has also recently attracted some investment. Newman is building a new Four Seasons resort, and a Ritz-Carlton Reserve opened recently. Hedge fund manager John Paulson has also been investing in opulent hotels. And one bright spot in tourism development has been Puerto Rico’s pursuit of cruise ship visitors. Their numbers have been rising, reaching 1.5 million in the last fiscal year, up from 1.2 million in the previous year, said Ingrid Rivera Rocafort, executive director of the Puerto Rico Tourism Company. While they aren’t as lucrative for the island as holiday makers who stay in a hotel, Rivera Rocafort says that once they get a taste for Puerto Rico they do return. Still, it isn’t only more cost-efficient competition from the Caribbean that Puerto Rico has to worry about. Electricity rates in Puerto Rico are among the highest in the U.S., putting the island at a disadvantage to a place like Florida, where they are much lower. That is largely because the government-controlled Puerto Rico Electric Power Authority is reliant on imported oil. When oil spikes, “you basically operate in negative numbers,” the hotel owner and operator Newman said, forcing him to cut costs, including staff, whose ranks have fallen to about 130 from 165 in the past five-to-six years. To be sure, as the oil price has plunged in the past year, Newman has enjoyed a partial reprieve from punishing electricity bills, and he is using the extra cash to make upgrades at the Verdanza. But he still faces other high charges – his water bill has climbed to about $20,000 a month.

The Justice Department gave its nod to the merger on Tuesday, saying that its antitrust review found no significant risks to competition. “The conditions imposed by the Commission address potential harms presented by the combination,” the FCC said in a statement. “The conditions also ensure that the benefits of the merger will be realized.” With the merger, DirecTV gets the broadband product it
previously lacked, and AT&T gets new avenues of growth beyond the maturing wireless service. AT&T shares were up 1.1 percent at $34.29 and DirecTV shares were up 1.5 percent at $93.55 at the market close. “We’ll now be able to meet consumers’ future entertainment preferences, whether they want traditional TV service with premier programming, their favorite content on a mobile device, or video streamed over the Internet to any screen,” AT&T Chairman and CEO Randall Stephenson said in a statement. As the U.S. wireless market reaches saturation, AT&T hopes to tap into DirecTV’s business and has been expanding its footprint in Mexico after buying the third and fourth largest wireless carriers in that country
recently. When the deal was first announced, analysts questioned the move. DirecTV’s satellite TV business was hit by stagnation affecting the broad pay-TV market as viewers increasingly shift to watching videos on mobile devices. Since then, they have warmed to the idea that AT&T could benefit from DirecTV’s robust cash flow and customer base of 20.4 million. The company has said it expects annual cost savings from the deal of at least $2.5 billion by the third year. The success of the deal in passing regulatory muster is in sharp contrast to rival telecom mega-merger of Comcast and Time Warner Cable Inc, which was rejected in April largely over the combined companies’ reach into the broadband market.

Mexico wins 7th Gold Cup title with 3-1 victory over Jamaica
PHILADELPHIA — Andres Guardado scored again, with no penalty kick needed this time, and his teammates finally managed some goals, too. Mexico ensured the final wouldn’t come down to any calls in the last minutes with a 3-1 victory over upstart Jamaica for the CONCACAF Gold Cup title Sunday. Guardado had his fourth goal of the knockout rounds, and Jesus Corona and Oribe Peralta also scored as El Tri won its seventh Gold Cup. It was a convincing performance for coach Miguel Herrera and his team after some shaky play and contentious moments in the previous two games. Jamaica had made a rousing run to the final, stunning the U.S. in the semis to become the first Caribbean nation to reach the Gold Cup’s championship match. And the Reggae Boyz looked as though they belonged in the opening minutes, keeping the pressure on Mexico with several promising scoring chances but never putting a shot on goal. But then El Tri started to find the gaps in the defense, and a yellow card for Jamaica helped lead to Mexico’s first goal. The Reggae Boyz hadn’t trailed since early in the second half of their Gold Cup opener. Mexico, which already held the record for most Gold Cup titles, is 7-1 in finals. El Tri will face the U.S., the 2013 Gold Cup champ, on Oct. 9 at the Rose Bowl in Pasadena, California, for CONCACAF’S spot in the 2017 Confederations Cup in Russia. “We won a game today, but we don’t accomplish our goal yet,” Herrera said. The only way Mexico had

And two of those came on late, questionable calls. Against Costa Rica in the quarterfinals, a scoreless game was moments from going to a shootout when Guardado converted his penalty

Down to 10 men, Panama was on the verge of victory when a disputed hand ball set up a penalty for Guardado in second-half stoppage time, and he scored on another for the winner in extra time.
Mexico had gone 272 minutes since one of its players scored on anything other than a penalty when Guardado put El Tri ahead for good Sunday. Jonathan dos Santos found Paul Aguilar out wide on a free kick, and Aguilar crossed it to Guardado, whose left-footed volley made it 1-0 in the 31st minute. It was his sixth goal of the tournament, one behind Clint Dempsey of the U.S. Guardado, voted top player of the tournament, had also been the last Mexico player to score on anything other than a penalty with his goal in the 88th minute against Trinidad and Tobago in the final group stage match. Any chance of a Jamaica comeback quickly evaporated after halftime. Just over a minute in, Corona, who had failed to convert two good chances in the first half, stole the ball from Michael Hector and pushed forward. The 22-year-old forward slid his left-footed shot from the edge of the area under the legs of Wes Morgan for a 2-0 lead in the 47th minute. Corona was selected top young player of the tournament. Another mistake by Hector in the 61st minute put Mexico up 3-0. He whiffed on an attempted clearance, and the ball went right to Peralta for an easy goal. Shortly after, Guardado came off to a thunderous ovation from the pro-Mexico crowd of 68,930 at Lincoln Financial Field, home of the NFL’s Philadelphia Eagles. “We really managed the game in the correct way,” Herrera said. Darren Mattocks scored in the 80th minute to pull the Reggae Boyz within 3-1.

Tom Brady’s suspension appeal is in federal court
contained evidence Brady was asked to provide. Now the case is in federal court. The NFL players union filed a petition Wednesday on Brady’s behalf to have the suspension lifted. The petition was filed in the U.S. District Court in Minnesota, which has ruled in favor of the union in a number of landmark cases over the years, CBS News correspondent Anna Werner points out. Brady is hoping the petition will lead to an injunction in time to get him on the field for Week One of the regular season, and eventually a full reversal of his suspension. On Tuesday, the NFL filed a lawsuit in New York, asking the judge to uphold the suspension -- and to keep the lawsuit in New York. A court official for Judge Richard Kyle in Minnesota confirmed to CBS News that an order was filed Thursday morning to transfer the union’s petition to New York. Brady’s agent, Don Yee, talked

Roger Federer pulls out of Rogers Cup tournament in Montreal MONTREAL -- Roger Federer pulled out of next month’s Rogers Cup hard-court tournament on Wednesday. A spokeswoman for Tennis Canada, Valerie Tetreault, wrote in an email to The Associated Press that Federer “wants to make sure he will be (in) top shape for” the U.S. Open, the year’s last Grand Slam tournament, which begins Aug. 31. “I am disappointed that I won’t be playing in Montreal, because it’s a tournament and a
city that I really enjoy and has incredible fans,” Federer said in a statement released by Tennis Canada. “I hope to be back in the future.” Federer, owner of a record 17 major championships, has not competed since losing to Novak Djokovic in the Wimbledon final on July 12. Federer, who turns 34 on Aug. 8, won the Rogers Cup twice, in 2004 and 2006, and he was the runner-up a year ago. “We are obviously
disappointed to have Roger withdraw as it is always a privilege to watch him play,” tournament director Eugene Lapierre said in a statement. “We also understand his decision because, above all, he has always been very loyal to our event, and we would love to see him play tennis for many more years to come.” Play begins Aug. 10 in Montreal. Federer will be replaced in the main draw by Jerzy Janowicz, a semifinalist at Wimbledon in 2013. Roger Federer
Rugby study reveals concussion impact on the brain A major study of rugby union players points to a possible connection between frequent concussion and brain function. The long-term study - the largest of its type to focus purely on rugby union - released its initial findings and researcher Patria Hume wants players to become more aware of the risks that come with high impact tackles and other aspects of the sport. “If you have a concussion you need to report it and get it medically assessed,” Professor Hume told AFP on Tuesday. “You also need to consider that potentially there may be some long-term health effects. Ninety four percent of elite level rugby players
experienced one or more concussions, that’s a lot.” World Rugby commissioned the study back in 2012 amid growing fears about the potential long-term brain injuries caused by concussion, which have become even more prominent with All Blacks stars Richie McCaw, Kieran Read and Brodie Retallick all recently being involved in concussion incidents. Wales wing George North was also twice knocked unconscious during a Six Nations defeat to England in February, which intensified debate in Britain over the issue, The study itself is examining the health of 485 men, with 131 of these falling into the category of
former professional rugby players while a further 281 amateur rugby players were also included. Athletes from non-contact sports made up the remaining 73 places. Hume said the currently unreleased study displays a statistically significant link between repeated concussion and brain damage, with rugby players who have been on the wrong end of more than four cases of concussion performing far worse in tests measuring mental and physical coordination, motor speed and multi-tasking. “We’ve got to go through that scientific process, but what I’m saying is that, as a scientist, it’s irresponsible for people to say there are no long-
term brain health issues,” she said. “Because all indications so far from the analysis we have done indicates that there possibly are for the rugby players and for people who have been concussed more than four times.” World Rugby chief executive Brett Gosper has set player health as his top priority, announcing he wanted more research into the overall effects of concussion to try and reduce future incidents. “While the study does not provide any definitive conclusions, we are alive to all potential risks and, as such, we will continue to prioritise research in this very important area,” he said.
