JUDGE WRONG ON GUN SENTENCES

he Court of Appeal strongly criticised a High Court judge who was known to reduce the mandatory minimum prison sentence of five years for gun crimes, saying that he was acting beyond his legal power or authority. Elliott Mottley, QC, President of the Court of Appeal, said it is “not possible for a trial judge to suspend a portion” of the mandatory minimum sentence prescribed by the Firearm Ordinance. “A judge has no power to suspend a portion of a mandatory minimum sentence prescribed by sections 3(3) and 22(1) of the Firearm Ordinance. Further, the Court certifies that there are no circumstances under which a judge could suspend any portion of a mandatory minimum sentence,” the Court of Appeal President stressed. “Any judge purporting to suspend any portion of mandatory minimum sentence would be acting ultra vires (beyond his legal powers) to the provisions of the Ordinance.” Mottley made the ruling following a Reference by the Attorney General who sought answers relating to the mandatory sentences imposed by Mr. Justice Robert Shuster on Anthony Clarke, Lavardo Outten and Ernst Dolce who were convicted for serious gun offences. seen public servants all over the world. I am, myself, a civil servant and I’ve therefore seen the best that the British Civil service can produce, and the deputy governor can hold her head amongst any of them,” said Governor Freeman, who was a former British ambassador to Argentina and Geneva, and held top diplomatic posts in

Brussels, Vienna, Singapore and Germany. “So the TCI is very fortunate to have people of that quality. I could mention others who I think exercise excellent senior roles. LOCAL NEWS JUDGE WRONG ON GUN SENTENCES continued from page 1 Mottley said that under section 22(1) of the Firearms Ordinance, the Court is required to impose a mandatory minimum sentence of imprisonment of not less than 5 years. The section does not contain any power under which a judge is empowered to suspend the mandatory term of imprisonment. The provision of section 3(3) of the Suspended Sentences Ordinance are inconsistent with the provisions of section 22(1) of the Firearms Ordinance under which the Court is required to impose a mandatory sentence of 5 years. “(Judge)Shuster seems not to have been mindful of the separation of powers as enshrined in the Constitution. Under the Constitution, it is the function of the Legislature to enact laws; it is for the Executive to administer those laws and it is for the Judiciary to apply the laws as enacted. The judge’s function is to interpret the Ordinance as enacted by the Legislature and to apply it. A judge should not provide an interpretation of an Ordinance which has the effect of amending the provision of the Order. This is the function of the Legislature. Anthony Clarke, who had been charged on information containing four counts, pleaded guilty to one count of possession of an imitation firearm with intent to put another person in fear contrary to section 22(1) of the Firearms Ordinance. The judge sentenced him to a term of imprisonment of 5 years, the last 2 of which were suspended. He ordered that all the time the accused spent in custody on remand is to be counted towards his three year sentence. Lavarod Outten pleaded guilty to 3 gun offences and was sentenced to a term of imprisonment for 5 years on each count to run concurrently with each other. The judge went on to indicate that for the avoidance of doubt, the accused will serve 3 years in

prison followed by consecutive 2 years suspended period of imprisonment. Ernst Dolce was convicted for possession of a firearm and was sentenced to a term of imprisonment of 3 years and a further 2 years to be suspended. In relation to Anthony Clarke, the court said the judge did not correctly apply the provisions of section 22(1) of the Firearm Ordinance when imposing the mandatory minimum term of imprisonment of not less than 5 years. “The judge was wrong to take the provision of section 3 of the Suspended Sentences Ordinance into consideration,” Mottley added. “ A court has no discretion to apply the Suspended Sentences Ordinance where a mandatory minimum term of imprisonment is prescribed in another Ordinance. There is no scope for a discount for a plea of guilty to an offence under the Firearm Ordinance which carries a mandatory minimum term of imprisonment of 5 years. The Court may order that the mandatory sentence should commence from the date of arrest provided that the defendant has been in custody.” In relation to Lavardo Outten, the Court also said there is no scope for a discount where a person enters a guilty plea in relation to the mandatory minimum term of 5 years imprisonment under the provisions of section 3(3) of the Firearm Ordinance. Mottley said the provisions of section 3 of the Suspended Sentences Ordinance is limited in its scope. “It only applies to a situation where a court imposes a sentence for a term of imprisonment of not more than two years. In imposing the suspended sentence, the court may order that the sentence shall not take effect unless during any period specified in the Order, the accused commits another offence punishable with imprisonment.

The court is restricted from passing a suspended sentence unless the court is of the opinion that the nature of the case is such that a sentence of imprisonment would have been appropriate even without the power to suspend the sentence. In addition, the court in exercising the power to suspend the sentence must be satisfied that the sentence can be justified by the exceptional circumstances of the case,” the Barbadian jurist added. “It should be noted that a suspended sentence is not an alternative to imprisonment but it is in fact a form of imprisonment. A sentence cannot be suspended until it has actually been imposed. It is only the execution of the sentence which is suspended. Section 3(2) of the Suspended Sentences Ordinance expressly provides that the period specified in any order made under sub-section (1) must be for a period of not less than one year and not more than two years from the date of the making of the order. Judge Shuster purported to order that the suspended sentence which he imposed should commences after Clarke had completed serving three years imprisonment. In any event, such an order would be clearly outside the power given to the court under section 3(2) of the Suspended Sentences Ordinance which required a court to specify in the order it is making that the suspended sentence should begin at the date of the making of the order.” Mottley said the concept of suspended sentence is that the court is of the opinion that a term of imprisonment is merited for the offence but the exceptional circumstances are such that the sentence may be suspended. “The effect of this is that the person does not go to prison immediately. Under the provisions of the Firearm Ordinance, once convicted the person has to be sent to prison for a mandatory minimum of

5 years. The imposition of suspended sentences and the imposition of a minimum mandatory sentence of 5 years are inconsistent with each other. For the reasons stated above, the provisions of section 3(3) of the Suspended Sentences Ordinance do not and cannot apply to a sentence under section 22(1) of the Firearms Ordinance,” he continued. “In the opinion of the Court it was not open to the judge to pass the sentence in which he ordered that Clarke serve 3 years in prison and that two years of his sentence be suspended. The sentence was ultra vires the power granted to the court under section 3(3) of the Suspended Sentences Ordinances. It was also contrary to the mandatory terms of imprisonment which the judge is required to impose under section 22(1) of the Firearms Ordinance. By section 22(1) of the Firearms Ordinance, the judge is mandated to impose a minimum sentence of not less than 5 years. As stated previously, section 3(1) of the Suspended Sentencing Ordinance limits the application of the Ordinance to circumstances where the court considers that the appropriate sentence which ought to be imposed on an accused is not more than 2 years. In view of the limitation contained in section 3 of the Suspended Sentences Ordinance, it is clear that this provision has absolutely no application to the mandatory minimum sentence of 5 years under the Firearms Ordinance. As stated previously, the intent behind the suspended sentence is that, while the suspended sentence is a term of imprisonment, the court has decided to suspend the sentence due to exceptional circumstances of the case the result is that the defendant does not go to prison immediately. The provisions of the Firearm Ordinance require a mandatory minimum term of imprisonment so that the defendant goes to prison immediately.”

Anya Williams continued from page 1 In a population size like this, the number of roles that need to be filled by politicians and non-politicians and by people like you (journalists)... it’s not (meant) to comment on the talent pool anywhere, but it’s miraculous that such a small pool can produce so many good people.” The Governor stressed that permanent secretaries and accounting officers are “absolutely critical” for governments and the “proper use of monies”. He added: “Of course the public service here isn’t perfect. I mean, I don’t know one that is. There have been criticisms about its interface with the public. Of course you have to train and equip public servants adequately if they are going to discharge their duties properly, and governments have to make sure that they are adequately housed and equipped.” When asked about the recent issues and complaints from, and involving, TCI civil servants, Governor Freeman responded: “I can’t give a specific update on every individual incident, not because i don’t want to but because I don’t pretend to know everything that’s happening here in every detail. For example, dealing with the immigration (and) queues at the airport is important to deal with and I know the Deputy Governor and others have all been very involved, but of course, it is the Ministry (of Immigration) that is responsible and who has the primary responsibility in constitutional terms, to address that.” He continued: “Take the Community College, which is not a part of the public

service. The responsibility for arrangements there falls principally upon the board of the community college and of course the Ministry of Education can’t be indifferent to it. I mean, over 90 percent of all funding to the Community College comes directly from the public purse, therefore no ministry can pretend it has nothing to do with it. One can go on about this, and there may well be other instances you can cite. I’m not claiming everyone is perfect, but when issues are identified they should be dealt with and I don’t think you will find any member of the government disagreeing with that either.” The Governor said Government ministers and Permanent Secretaries must know and understand their respective roles. “I’m not wishing to sound as if I’m giving a constitutional lesson,” he said, “but sometimes it helps to clarify where these responsibilities rest. The Permanent Secretary should run the department in a way that is serviceable to the minister or the elected representative’s objectives. They (Permanent Secretaries) should run it also in a way that is serviceable to the Governor’s objective. Integrity is required in an independent public service. They should run it in a manner that is efficient in the discharge of public monies, and it’s not an accident that the expression ‘the buck stops here’ refers to money. I don’t actually think it is that complicated to define that. The accounting officer, the Permanent Secretary, has very particular responsibilities which are absolutely theirs and they can answer before the Public Accounts Committee (PAC).”

Two high-powered smuggling boats intercepted in one day By Todeline Defralien The smuggling of illegal Haitians into the Turks and Caicos Islands has gone to a more sophisticated level, as two highpowered boats instead of the regular wooded sloops were intercepted in less than eight hours on Thursday, April 26th 2018. The first boat named Bay Liner, a blue and white 20-foot fibre glass boat with two inboard engines, was intercepted four miles off Providenciales around 1 a.m. on that date, with a total of 40 Haitian nationals (32 males and 8 females) onboard. At 8 p.m. on the same day, the Royal Turks and Caicos Islands Police Force Marine Branch Sea Guardian Boat, intercepted an illegal 30-foot, blue and white vessel with two outboard engines near West Caicos. A total of 50 Haitian nationals (36 males and 14 females) were apprehended and taken into custody and transported to Providenciales to be processed by Immigration Officials. The Royal Turks and Caicos Islands Police Force continue to appeal to the general public who may have any information on this or any possible illegal boat entry, no matter how small is asked to contact 911 or Crime

At a recent media breakfast, Governor Dr. John Freeman indicated that the ship will not be here permanently. When asked by media when will the ship leave the TCI and what

are the plans for the royal navy ship, the Governor added: “I am not going to discuss about what security deployments we make.... I don’t think it is appropriate to comment on it and I won’t comment on therefore exactly where RFA Mounts Bay is. In terms of the U.K’s support I think the important thing is, they came when the surge appeared and when we asked for assistance. They will be alert to our interest if we are faced with similar problems again.” The Governor also refused to comment on the capability of the Radar and where RFA may be. “I don’t want to say whether exactly if a boat is here or not here, but clearly it is not here all the time. It has other duties which it has to do, but I don’t think that it is conducive to the objective we all have in mind. What is the objective about having and making sure that we have a whole of Government approach including radar, a necessary ship, Police and all the rest of them? Our objective is to deter and prevent, but deterrence means they must believe those who might which to engage in actions which are illegal that they can’t make assumptions that actually this time is a good thing. I think that it is not in the interest of the objective to talk more than necessary about specifics.”

The Bahamas still accepting patients from TCI, says NHIB By Todeline Defralien National Health Insurance Board (NHIB) wants to make it publicly clear that The Bahamas continues to accept patients from the Turks and Caicos Islands, contrary to reports circulating in the community. In a statement issued to The SUN, the NHIB said that assertions being made about beneficiaries being denied access to care in the Bahamas due to the delay or non-payment of outstanding bills are “baseless and false”. “We have long standing arrangements with over eighty 80 National Health Insurance Plan (NHIP) network providers in the Bahamas who provide services to NHIP beneficiaries,” NHIB said,

adding that they will be investigating the genesis of these false and baseless rumors, which seek to tarnish the good name and reputation of the NHIB. NHIB said it has been in touch with the majority of these providers including the major facilities who accept their patients. These major facilities are; Doctors Hospital, Princess Margaret/ Physician Alliance, The Bahamas Heart Centre and The Bahamas Cancer Centre. The statement further noted that as of Monday April 25th, 2018, NHIB has five (5) patients admitted to hospitals in the Bahamas as well as two (2) patients who are outpatients receiving care. “All major providers and facilities in the Bahamas are ready and willing to accept our patients without

consternation. In fact, the NHIB will be hosting a delegation from Doctors Hospital, May 14th-15th, 2018 to discuss our existing relationship and explore additional options for NHIP beneficiaries.” The NHIP continues to maintain a diverse network of providers in the Bahamas, Cayman Islands, Dominican Republic, Jamaica, etc. who are ready and willing to respond to the service needs of their beneficiaries. NHIB stressed that they wish to reassure the public that they will continue to provide all beneficiaries with the required services locally and overseas in accordance with the provisions of the Plan. Over 1,700 illegal’s repatriated over 15 months By Todeline Defralien Just over 1,700 persons were repatriated over the past 15 months in the Turks and Caicos Islands, according to Deputy Premier and Minister of Border Control and Employment, Hon. Sean Astwood. In the Ministry of Border Control first quarter report 2018 on enforcement activities it revealed that 1,335 persons were repatriated in 2017 and during the first quarter of 2018, 432 persons have been repatriated to several counties in the region and elsewhere. Addressing a press conference with Premier Hon. Sharlene CartwrightRobinson at the Premier’s Officer on Friday April 20th, 2018, Hon. Astwood said, “Despite reduced operations and apprehension due to nature, 1,335 persons were repatriated in 2017 compared to 491 persons repatriated in 2016. During the first quarter of 2018, 432 persons have been repatriated to several countries in the region and elsewhere. During the Month of January, a total of four (4) sloops landed in Providenciales from Haiti, one in Five Cays area and three (3) in the North West Point Area.” After the hurricanes, operations ceased for a period of time for humanitarian reasons. The resumption of both apprehension and repatriation exercises were critical elements in the Government’s comprehensive immigration policy. Astwood noted that the business places inspected by Immigration and Labour Commission were: Somewhere café, Provo stevedoring, Delicious Dishes, Proverce Restaurant, Shay Café and Danny Bouys. According to the report, during the Month of January 2018, the Immigration Enforcement Unit and Royal Turks and Caicos Islands Police (RTCIPF) apprehended seventy (70)

persons and repatriated sixty-six (66). Apprehended nationals and genders were: Haitian – 55 (44males and 11 females), Dominican – 7 (5males and 2 females), Venezuelan – 2 (2 females), Jamaican – 5 (5 males) and Indian – 1 (1 male). During the Month of February 2018, Immigration Enforcement Unit apprehended 30 persons and repatriated 26 persons. Apprehended nationals and genders were: Haitian – 14 (11 males and 3 females), Dominicans – 9 (7 males and 2 females), Vietnamese – 4 (4 males), Colombian – 1 (1 female) and Napoleon – 2 (2 males). Repatriated nationals and genders were: Haitian - 15 (12 males and 3 females), Dominican - 8 (7 males and 1 female), Vietnamese - 1 (One male), Colombian - 1 (Female) and Napolen - 1 (One male). During the Month of March 2018, the Immigration Enforcement Unit apprehended343 persons and repatriated three hundred and two (302) persons to six (6) countries. fifteen (15) females being repatriated to Haiti. Persons repatriated age ranged from 17 years to 43 years. “Noteworthy is that, Operation Guardian began on February 5, 2018. This joint operation included the Royal Turks and Caicos Islands Police Force, Labour Officers, Planning, Business License, Environmental Health and the Immigration Department. Almost ten (10) business establishments were visited and inspections of employees undertaken. These actions resulted in several employees being removed from jobs as their working was contrary to the conditions on their status in the country,” Astwood explained. In addition, District Inspections were conducted in the Five Cays Area, Blue Hills Area, Leeward Area, and Downtown Providenciales. These operations resulted in thirty-three (33) apprehension of persons residing in the Islands illegally. The report also revealed that during the month of February 2018, nine (9) persons were placed before the courts on charges such as unlawful entry, remaining in Islands beyond the permitted time, employing persons contrary to Immigration Ordinance and failing to comply with directions contrary to the Immigration Ordinance. During February 2018, seven (7) persons were apprehended on Grand Turk and one (1) on North Caicos. They were all repatriated. Operation Guardian continues and during the month of April two (2) significant operations were conducted. As a result, seventy-seven (77) persons have been apprehended and are being processed. Apprehended nationals and genders were: Haitian – 69 (sex was not determined as yet), Dominican – 6 (sex was not determined as yet) and Jamaican – 2 (sex was not determined as

During the first two weeks of the month, there were five (5) illegal vessel landings. He noted that to mitigate against the number of undetected landings, special night patrols were conducted by Immigration and Police Officers. The laws of the Turks and Caicos Islands mandate that persons holding Work Permits must always be in possession of the same. Citizens are encouraged to carry, where possible, a Government issued identification as is done in many developed countries as there may be occasions when operations extend to the highway or transport systems.

TCIG committed to a strong and reliable Telecommunications Industry

The Ministry of Telecommunications is committed to a having a robust and reliable telecommunications infrastructure in the Turks and Caicos Islands. This was the assurance given by Minister of Home Affairs, Transportation and Communications Hon. Vaden Delroy Williams after recently meeting with the country’s two telecommunications providers Flow and Digicel during which he was updated on their achievements and future plans, including work being done to upgrade networks following hurricanes Irma and Maria in September 2017. Hon. Williams stated: “I was quite pleased with the wealth of detailed information provided by Digicel and Flow and I was also impressed by the significant investment they continue to make in upgrading their networks and in other important areas. A robust and reliable telecommunications infrastructure is an integral component in the functioning and development of any modern society. It is within that context that my ministry and my government intends to work closely with the service providers to make certain that the Turks and Caicos Islands is adequately equipped with the latest and best technology.” He continued: “We are one of the most stable and fastest growing economies in the Caribbean and we

pride ourselves in being a high-end tourist destination. In addition, we have a very diverse and vibrant population that relies heavily on telecommunications as a function of their daily lives, so we have to remain on the cutting edge of technology.” The Minister said he was particularly satisfied that both companies reaffirmed their commitment to providing free WiFi in certain areas, including at the airports in Providenciales and Grand Turk. “In our Change Document we made a promise to create pubic zones for free Wi-Fi and my ministry and my government will ensure that this goal is achieved. The Turks and Caicos Islands is too small for there to be a digital divide in this country. While of course the providers have to make a return on their investments, I think they must also strike a balance and give consideration to the critical role that they must play in the area of social advancement, and by that I simply mean that there should be no area or person in this country that cannot enjoy the benefits and privileges of having access to telecommunications technology.” Flow has been providing free Wi-Fi at their local stores throughout the island and at all the public schools throughout the country in all administration buildings and computer labs.

Vaden Delroy Williams In terms of specific updates provided to the Minister, Digicel said it is re-building better, with Fiber to the homes (FTTH) and Fiber to the business (FTTB) in Providenciales and Grand Turk. Providenciales is three months to completion of underground fiber project and service to homes in Blue Hills will begin within three weeks. Digicel also told the Minister that Grand Turk rebuild

work has commenced. Flow indicated that it has accelerated the restoration work and upgrades, and they are making great progress, as the restoration work nears completion. Delleriece Hall, Country Manager, Flow TCI informed that they have significantly upgraded their distribution network in Providenciales, making it possible for most customers to access Superfast Broadband and Flow TV. The community of Five Cays had full access by April 15th. The Country Manager also noted that optimization work, or the final fine-tuning process is ongoing and customers will experience an increase in speeds on both mobile and fixed services. She also reported that customers in Grand Turk will soon experience the superfast and reliable speeds as we roll out Fiber to the Home (FTTH), the latest generation ultrahigh speed broadband connection. In addition, Flow has launched a study program for all CXC students which allows students to access a learning/study database at no charge or Wi-Fi cost to them. Digicel has provided community Wi-Fi at the Princess Alexandra Park in Providenciales, the Digicel Store and Police A Division in Grand Turk and the Digicel store in South Caicos. More locations will be added.

Mobile Clinic coming to Providenciales By Todeline Defralien A Mobile Clinic is coming to Providenciales soon with the aim of making services more accessible to the communities. This was revealed by Hon. Edwin A. Astwood, Minister of Health, Agriculture, Sports, & Human Services during a press briefing held on Monday April, 23rd, 2018 at the Premier’s Office in Providenciales. He said, “A strong primary Health Care system is an essential component to any health care system. Investment in this area has been lacking in the past, however my government has seen fit to prioritize primary health once again, in order to improve universal access to quality health care for all residents of the TCI. Other initiatives which are coming on stream include investment in upgrading of Primary Health infrastructure;

including the new Primary Health Clinic in Kew, North Caicos, which will be ready for handover soon, the new clinic in Bottle Creek, on which construction is expected to begin momentarily, completion of a model of Primary Health Care, to be implemented with technical assistance from the Pan American Health Organization and the operationalizing of the mobile clinic in Providenciales, which will be the first of its kind in the TCI.” In addition to this, Astwood noted stated that his Government is prioritizing the strengthening of Primary Health Care through a number of initiatives, including increased budgetary provisions being made to recruit additional staff in the new financial year, which will include two additional Medical Officers, Registered Nurses and physiotherapists. The Ministry of Health, Agriculture, Sports,

and Human Services is now placing greater focus on healthy lifestyles initiatives. To this end, a number of events are planned annually and the Ministry is partnering with local NonGovernmental Organizations in order to educate the general public about health lifestyle practices, including the importance of a well-balanced diet and regular exercise. Astwood added: “A greater need to focus on disease prevention and early detection is required in order to reduce the burden on secondary care. It is hoped that with an emphasis on healthy lifestyles and prevention and control of non-communicable diseases such as hypertension, diabetes, heart disease and cancer, that we can realize a reduction in premature deaths and disability which may result from these conditions.” “With the addition of the Sports Department to the Ministry of Health’s

portfolio, we look forward to greater synergies in promoting physical activity in schools and throughout the country. The School Nutrition Policy has been approved, in principle, by Cabinet and focuses on the health, nutrition and wellbeing of our children. In addition, the Department of Agriculture has been promoting its ‘Eat What You Grow, Grow What You Eat’ initiatives in our schools and communities. As a country, we need to focus on what our children are being fed, in addition to providing opportunities for them to engage in regular physical activity,” The Minister of Health explained. Old Police canteen being extended for office space By Todeline Defralien The old Police Canteen on Airport Road, Providenciales to include additional office spaces, said Minister of Infrastructure, Housing and Planning, Hon. Goldray Ewing. He told The SUN the works were sponsored by the National Crime Agency of the United Kingdom who also paid for equipment and training for Police Departments over all the Overseas Territories. Ewing said work on the canteen

started in June 2017 but stopped due to both storms and resumed in March 2018. It is expected to be completed by the end of July 2018. He noted that the National Crime Agency used their own tendering and procurement procedures with this project and that the project was not funded by Turks and Caicos Islands Government (TCIG). FortisTCI announces staff promotions FortisTCI has announced a series of promotions of executives, technical and support staff across its Corporate Services and Operations divisions to support the Company’s management team and to help develop employees in various departments. In the Corporate Services Division, Shernelle Capron has been promoted to Director of Financial Services and Supply Chain Management. In this new role, Mrs. Capron will oversee the company’s financial operations and direct corporate financial planning and analysis and has responsibility for the supply chain management function. Prior to this, she served as Manager of Financial Services. Shatel Williams-Wilson, former Senior Internal Auditor, has been promoted to Manager of Internal Audit. As Plant Operator Level I, Mr. Lightbourne works under the direction of the Senior Operator to carry out all necessary tasks to ensure the functional operations of generation units and response to system abnormalities that may occur during shift duty. Messrs. Higgs and Cox will

assist the Senior Operator with effective systems controls, continuous system condition monitoring, efficient generation unit dispatch and timely response to system contingencies. Trees planted at Cheshire Hall Plantation for Earth Day Members of the community from various sectors converged at Cheshire Hall Plantation on Friday, April 20th, 2018, to plant trees and support environmental goals that address our planet’s environmental challenges. The tree-planting event was sponsored by Beaches Turks & Caicos and was hosted by the Turks & Caicos National Trust, in collaboration with students and teachers of Clement

Howell High School’s Environmental Club, and DECR’s Pine Recovery Project Manager Bryan Manco. The above-mentioned activity was a follow-up to an Earth Day 100 Trees Initiative which started in 2016, initiated by Beaches Turks & Caicos, through Public Relations Manager, Elanor Finfin Krysnowski and TCNT’s Executive Director, Ethlyn Gibbs-Williams. The National Trust was grateful to receive the

gift of trees as the site has lost 30% of its trees as a result of the devastating effects of hurricanes Irma and Maria in September 2017. Approximately two dozen native trees were added to the Cheshire Hall Plantation landscape, including four (4) Caribbean Caicos Pine saplings. Caicos Pine is an endemic tree, regarded as the National Tree of the Turks & Caicos Islands, and is an important part of

the country’s ecosystem. A recovery project is currently underway. The Turks & Caicos National Trust is an ardent supporter of environmental protection and advocates for safeguarding the country’s natural heritage. This Earth Day tree planting exercise will certainly encourage the efforts of the National Trust in propagating native plants in the nursery at the historical site. Earth Day, or the

International Day for Mother Earth, is the largest civic day in the world that promotes the importance of trees and keeping the earth clean and green. Trees have a very important role in absorbing carbon, cleaning and cooling the air; stabilizing soils; recycling nutrients for agriculture and supporting habitats for wildlife - just a few of their gifts to humanity. Man 23, charged following deadly shooting in March A 23-year-old man is now charged with Murder, Causing Grievous Bodily Harm, Discharging of a Firearm and Discharging Ammunition, following the deadly shooting incident on Friday, March 23rd, 2018 that

Sailrock partners with community to clean-up South Caicos on Earth Day Employees from Sailrock Resort kicked off their Earth Day celebration with an island-wide effort to rid South Caicos of all litter that failed to find its way to a nearby trash can. Earth Day, which is aimed at supporting environmental protection and promoting sustainability, is celebrated annually by the Turks and Caicos Hotel Associations who, in conjunction with resorts throughout Turks and Caicos, host the annual TCI Shines event where volunteers go throughout the islands cleaning up litter to preserve the natural

beauty of the islands. The Sailrock volunteers, led by Reservations Manager Eka Arsani and Cost Controller Paul Elliott, spent their time in South Caicos leading the efforts to pick up litter along roads, pathways, the marina, community gathering spots like Queen’s Parade Grounds and local residences. Volunteers from Sailrock were thrilled to participate in the Earth Day celebration because they understand the importance of sustainability and supporting a clean environment in a small community.

“As a local South Caicos resident and past student of Marjorie Basden High School, it was indeed my pleasure to participate and work alongside some of the students and volunteers. I was thrilled to hear about the opportunity to participate in a clean-up campaign and I look forward to many more,” Elliott said. To help support the effort, Sailrock Resort donated supplies such as garbage bags, gloves for protection, drinking water and provided equipment for the volunteers. Sailrock Resort, which previously founded the South Caicos

Heritage Foundation to support the South Caicos community following Hurricane Irma, remains committed to continuing their efforts of preserving and supporting the rich history and culture of South Caicos. FortisTCI Introduces 1st electric vehicle and charging Station to TCI FortisTCI recently introduced the first electric car in the Turks and Caicos Islands (TCI) as part of the company’s electric vehicle (EV) and charging station pilot program. The program includes a sixto-12 month feasibility study that will provide insight into this new technology for interested customers in the TCI. This Electric Vehicle (EV) is a Nissan Leaf Acenta that is 100% electric. It features a 30kWh battery which when fully charged can drive up to approximately 100 miles. In a release issued on their website on Thursday, April 19th, 2018, FortisTCI President & CEO Eddinton Powell said, “While the EV market has yet to evolve in the TCI, EVs are now being adopted globally and across the Caribbean as an alternative to gasoline and diesel engines. These cost-effective ‘greener’ zero emission vehicles are poised to transform the transportation industry and the energy sector. FortisTCI is preparing to meet the future energy demands of our customers in both traditional and nontraditional ways. This strategic approach is in line with FortisTCI’s commitment to offering environmentally sustainable energy solutions to the TCI and we’re very excited to launch this project.” As a first step in introducing

the vehicle, the vehicle services team at FortisTCI participated in an EV repair and replacement training from April 9th to 12th. The training was facilitated by Megapower Ltd., a Barbados based company that offers EV sales and services across the Caribbean. On Friday April 13th, FortisTCI also hosted a training session for emergency responders that covered topics such as an introduction to EVs and response to accidents involving these types of vehicles. “By the end of this year, FortisTCI will launch its one megawatt (1MW) large-scale, utilityled solar project. This development is planned in conjunction with the Rocky Mountain Institute-Carbon War Room (RMI-CWR), a global leader in creating clean, resilient, and affordable energy solutions by working with utilities and governments. The 1MW project will encompass several sites across the islands,” The released added. The EV and charging station pilot program is the latest environmentally sustainable energy solution in which FortisTCI is investing. In 2017, the company installed and commissioned its first grid-tied solar energy systems on two commercial properties on Providenciales. FortisTCI offers gridtied solar programs to both commercial and residential customers across the

Time to reduce electricity costs By Oswald Skippings A blessing in disguise has been presented to TCIG government in the interest of Fortis customers. In applying to government for ratification of increased rates on electricity, the company has paved the way for much needed negotiations that would allow for an overdue assessment and perhaps a revamping of the present agreement. Whilst government didn’t have to wait on any such request by Fortis, it presents a timely and justifiable opportunity for government to take a number of prudent steps in an effort to bring down the high cost of electricity as opposed to increase the already exorbitantly high rates. Government should seize this opportunity to bring in a recognized and qualified independent electricity auditor that would determine the true cost of electricity per kilowatt hour. Coupled with an assent of fuel costs from the supplier, government would then know if consumers are not paying two times over for fuel considering the additional fuel surcharge that is levied on top of the power bill. Government should also establish a fool proof checking system that ensures that fuel surcharge does not automatically increase when the cost of fuel is increased by their suppliers, but rather to kick in only when all on Island supplies at that time, are depleted. On a slightly different note, this principle should also be applied

to on Island wholesale and retail suppliers. Turks and Caicos government should not even consider such a request for increase in electricity rates without closely examining that portion of the agreement that allegedly allows for a 17% guaranteed profit by the company. In so doing government should ensure that the profit is restricted to operational costs only and not the massive housing and building infrastructure and other unnecessary frivolities that are being undertaken by Fortis, which in turn would dramatically effect the demand for increase in fuel prices if it embedded in that guaranteed 17% profit. There has to be some kind of reconciliation with the guaranteed profit, infrastructure, actual cost per kilowatt hour, price increases and the infrastructure that is financed by customers who pay to have poles planted and wires installed to their homes and never get any kind of compensation whatsoever, not even a reduced power bill to offset their arbitrary investment in the company by financing the infrastructure to their homes which Fortis subsequently owns and proceeds to benefit from. TCIG should also check to see if Fortis has insurance coverage which incidentally, may be included in their guaranteed profit margin and as such would be a miscarriage of justice to say the least, if the company is now requesting an increase in rates to offset expenses incurred as a result of the damage done to their infrastructure by

Furthermore, having made their guaranteed profit and more, why isn’t insurance considered important enough to be covered from your excess profit gained over and above the guaranteed 17% profit ? Or, is there insurance but Fortis is testing the government’s alertness and is using this disaster to further price gorge the already overcharged consumers? Before any such increases are considered and even if they are denied, there has to be some reconciliation

with this profit guarantee issue. The issue of potential customers having to pay high charges to Fortis for installation of poles and wiring, must be examined with a view to regularizing this issue where the customer is repaid in some manner for an investment where the returns go only to Fortis and not to the investor customer who still has to pay his power bills. Is Fortis an accomplice to illegal immigration, illegal squatting and illegal building by allegedly supplying electricity to numerous illegal customers and illegal shacks that cannot pass planning inspection and pose health and safety threats in our communities? If this is proven to be true, Fortis should be held responsible for such illegal and irresponsible actions and dealt with according to law. The recent past practices of the governor and or government arbitrarily approving electricity rates proposed by Fortis without any serious checks and balances whatsoever, should no longer be the order of the day. No responsible government should allow that to continue. There are so many areas where Turks and Caicos people are being exploited and shortchanged because of a lack of conscious, caring and daring governance. It is about time our political representatives take the initiative and represent like real governments do. I have all hopes that these measures are being taken now in this case.

There are over 91 nationalities in TCI - Can we assimilate and make TCI the best place? (Part 1) By Drexwell Seymour In TCI, there are over 91 nationalities, over 31,000 legal residents and only 12,000 are locals. In the workforce, there are over 25,000 persons and of that, an estimate of less than 8,000 are locals. It is really important that we find the means and ways for the locals and the other nationalities to love each other and blend and live together in harmony in TCI because “United We Stand, Divided We Fall”. In my opinion it should not be about US (locals) vs THEM (expatriates) or THEM vs US. I am conscious of the fact that there is some division among us as locals and some may say we need to be united first as locals before we can unite with others. As long as TCI continues to develop, the population landscape of the TCI will continue to change dramatically and so let all of us use this change as an opportunity to make the TCI one of the best places in the world to live by assimilating with each other. Sometimes the very words spoken among us drift us apart. For example; 1) “The locals are lazy” 2) “The locals do not like foreigners” 3) “Foreigners do not like locals” 4) “I belong here, you are not from here” 5) “This place so backward, back home we did it like

this” 6) “We cook the best” 7) “WE dress the best” 8) “You foreigner” Go back where you come from” 9) You are not from here. Keep your mouth shut 10) “You’ll come here and want to take over” 11) “You’ll TI people too passive” 12) ‘”My country is independent and so we think independently” 13) “ You’ll have a colonial state of mind” 14) “I don’t understand you”ll people” 15) One thing we don’t play where we come from. 16) Are you from here? Believe it or not, skin cancer is actually the most commonly diagnosed cancer worldwide! Luckily, in many cases, early detection and removal of the abnormal growth in an office setting is all that is required to achieve a cure. In a few cases however, whether because of late detection or the type of skin cancer, extensive surgery and even chemotherapy may be required. And whilst most skin cancers do not metastasize or spread to distant areas in the body, melanomas do! This makes quick diagnosis and management essential. Skin surveillance in a doctor’s office is advisable for most person but it is especially true if you have risk factors for skin cancer such as a history of sunburns, a lifestyle where you are repeatedly in a sunny environment, a light complexion that rarely tans but instead gets red on sun exposure and a personal or family history of skin cancer. However, it’s not good enough to go into your doctor every year to get your moles checked. You must also be familiar with what to look for in case something presents on your skin that you need to get checked before your next scheduled visit. Highlights from the 10th annual TCI Shines Cleanup Campaign By Todeline Defralien

T

he Annual TCI Shines, a spruce-up initiative of the Turks and Caicos Hotel and Tourism Association, in collaboration with the Tourist Board and DECR, took place on Saturday, April 21st, 2018. Now in its 10th year, the cleanup was a huge success and well supported by the TCI community. Areas that were cleaned up were, Leeward Highway (Children’s Park) in Providenciales as well as areas in North Caicos, South Caicos and Salt Cay. Taking a keen interest in TCI Shines on Earth Day, the Clement Howell Tourism Club, led by Junior Minister of Tourism, Zoe Butler joined this year in the efforts and cleaning up the Blue Hills area. All schools, companies and communities jumped on board and form groups in assisting with the cleanup efforts. The following are photographs from this year’s clean up exercise.

UK offers free citizenship for the Windrush generation including the Caribbean

Members of the Windrush generation who arrived in the UK before 1973 will be eligible for free citizenship, the Home Secretary Amber Rudd announced. The offer, which will be available to people from all Commonwealth countries, not just Caribbean nationals, will extend to individuals who have no current documentation, those who already have leave to remain and want to advance their status, and children of the Windrush generation. In addition, the Home Secretary confirmed that a compensation scheme will be set up for individuals who have suffered loss or damage because of their inability to evidence their right to be in the UK and to access services. The Home Office will be engaging with stakeholders

on the scope of the compensation on offer and appointing an independent adviser to oversee the scheme. A new customer contact centre will be set up to make sure that anyone struggling to navigate the many different immigration routes can speak to a person and get appropriate advice. The centre will be staffed by experienced caseworkers who will offer expert advice and identify a systemic problem much more quickly in the future. Prostitutes bow out of 2018 general election The newly formed Political Prostitutes Party (PPP) says it will not be contesting the upcoming general elections after all as Barbadians still await the date to be announced by Prime Minister Freundel Stuart. The PPP, which had originally indicated its intention to contest the polls that must be held no later than June, says it has not been able to get candidates to contest all the 30 seats in the election. “We are going to miss this election simply because the recruitment process is not complete as yet. I am still searching for candidates to represent us throughout most of the constituencies, so it won’t be happening this election for sure,” said PPP leader and founder, Charles “Spice” Lewis.

He told the online publication, Barbados TODAY that while several people had expressed an interest in representing the party at the election, the majority had failed to meet the required standard. “Persons who wish to join the PPP must have a genuine interest in improving Barbados’ social and economics; be willing to change the political status quo; have a business and entrepreneurial mindset; and must be in favour of legalizing, decriminalizing or regulating prostitution and other adult industry activities,” he told the Barbados TODAY. Lewis, a well-known player in the adult entertainment industry here, had in March this year, emerged as the campaign manager for retired prostitute, Natlee Harewood, who

said she would be contesting the City of Bridgetown constituency as an independent candidate. However the two parted ways and Lewis launched the PPP to contest the election against the ruling Democratic Labour Party (DLP) and the main opposition Barbados Labour Party (BLP). “I announced that I was forming a party and I am still forming it, nothing has changed. The process takes time, I had a feeling that it won’t happen right away,” Lewis said, adding that despite the party’s withdrawal from this year’s campaign, it should be ready by 2023. “Since we will not be contesting this 2018 election it means that we will have to wait for the next one and that is a long process. Respondents were asked about their perceptions of the scale of corruption, first-hand experiences of bribery in public services, and questions relating to corruption in elections. When asked how often they believe voters are bribed in The Bahamas’ elections, 41.1 percent of respondents said always, 29.2 percent said sometimes, 16.1 percent said often and 4.3 percent said never. Nine point three percent of respondents said they don’t know. The survey, which was made public yesterday, during a press conference at the Harry C. Moore Library auditorium at The University of The Bahamas, was commissioned by the civil society group Citizens for a Better Bahamas. The polling was conducted between October 4 and October 17, 2017, just five months after the May 10 general election, with 1,000 Bahamians across the country. When asked how often they believe votes are counted fairly in Bahamian elections, 32 percent of respondents said always, 15.7 percent said often, 26.5 percent said sometimes and 10.3 percent said never, 15.5 percent said they don’t know. Respondents were also asked how often voters are offered genuine choices for candidates. Twenty-six percent

said always, 15 percent said often, 35 percent said sometimes, and 11 percent said never. The survey further asked respondents to give their perception on campaign financing for elections. One question asked how often respondents believe that candidates offer rich people and businesses favors once they take office in exchange for compensation in the country’s elections. Thirty-four percent of respondents said always, 29 percent said sometimes, 19 percent said often and four percent said never. Fourteen percent of respondents said that they didn’t know. Respondents were then asked to agree or disagree to the statement, “Wealthy individuals often use their influence on government for their own interest and there needs to be stricter rules to prevent this.” Seventy-six percent of respondents agreed with the statement, 14 percent disagreed and 10 percent said they didn’t know. Finally, respondents were asked to agree or disagree, on a scale from one to 10, one being completely agree and 10 being completely disagree, whether they believe financial support by companies to political parties and candidates should be banned completely. Forty-three point eight percent of respondents said they agreed to this statement, 31.3 percent disagreed, 14.8 percent opted to remain neutral and 10.1 percent said they didn’t know. Following the 2012 general election, the Organization of American States’ recommended that the government implement a financial framework for financing political parties. Despite repeated pronouncements that his administration would address the issue of money and elections,

former Prime Minister Perry Christie never did. The matter of campaign finance reform has been a revolving issue, from allegations that Canadian fashion mogul Peter Nygard provided millions of dollars to help the Progressive Liberal Party gain office in 2012, to claims that Nygard’s Lyford Cay neighbor Louis Bacon indirectly funded the Free National Movement to destabilize the Christie administration. The OAS team also recommended that the government prohibit anonymous donations or international donors from giving money to campaigns and to create a mechanism to oversee the flow of money within campaigns. In 1980, the then Pindling administration drafted a bill to govern money in politics. The bill, which was never tabled in Parliament, proposed to “make provision for the registration of political parties; for the regulation and control of political contributions; for the public funding of elections and for other purposes incidental thereto and connected therewith”. Under that bill, a registrar of political parties would have been appointed. That person would have been able to, at any reasonable time, enter the premises of a political party, party branch or candidate registered under the act to examine its books, papers and documents and would have been able to request such information as he may reasonably require to discharge his responsibilities. The bill would have also mandated that all political parties have a chief financial officer responsible for proper records, ensuring that contributions are placed in the appropriate depository and financial statements are filed with the registrar of political parties.

Massive irregularities uncovered in learner driver’s examination in Guyana A complete breach of the standard operation procedures surrounding the administration and conduct of an examination for learner driver’s license, has been uncovered by the police. According to the police , preliminary investigations found that there were “massive irregularities” as invigilators received more answer sheets than the number of persons who sat the exam on April 12. The examination is conducted by the Guyana Police Force and invigilated by pastors who are a part of the force’s faith organisation. It’s reported that during the recent examination, the invigilators found that 174 persons were registered but only 106 showed up. However when the answer sheets were turned in, the invigilators found over 200 answer sheets including those for candidates who did not sit the examination. It was also revealed that during the examination, several junior officers presented themselves in the room, although they were not required to be there. Due to the irregularities, several persons will now be required to resit the examination. The police say legal advice will be sought based on the completed investigation .

Puerto Rico’s governor says power should return within a month Puerto Rican Governor Ricardo Rossello on Wednesday said he expects electricity to be restored across the U.S. territory within a month, but warned that the island’s infrastructure needed to be strengthened ahead of the upcoming hurricane season. “The expectation is that ... within the next month we’ll be able to reach that normalcy,” he told CBS News. “The important thing to recognize, hurricane season is coming back in a month and we need to see how we can harden” the island’s current grid, he added, speaking on “CBS This Morning.” Puerto Rico has struggled to recover after Hurricane Maria wiped out power across the territory about seven months ago. Officials had been working since then to restore electricity, but the island was hit with another blackout last week after a transmission line failure. About 40,000 Puerto Ricans remain without power since Maria hit the territory, home to 3.4 million U.S. citizen residents. Hurricane season for the Atlantic starts June 1, and meteorologists have said the number of potential U.S. storms is above-average this year. Rossello told CBS he was concerned that a possibly even bigger storm could hit in the near future and said officials were trying to prepare for the worst.

Police make multiple drug busts at Antigua airport

Cannabis Law enforcement and security officials seized an estimated $256,000 worth of cannabis at the V.C. Bird International Airport on Tuesday. Police officers attached to Narcotics and K-9 Unit, along with customs and airport security officers conducted two separate operations at Customs Bonded Warehouse with the aid of the sniffer dogs, and found a combined total of 64 pounds of cannabis. In one incident, the dogs alerted the officers to a barrel with laundry detergent which arrived aboard Air Canada from Canada. The shipment was searched and four buckets with 21 vacuum sealed packages of cannabis were found hidden inside each bucket. The substance weighed 14 ¾ pounds and carries an estimated wholesale value of $59,000. In the other incident, two barrels, coming out of the United States aboard Amerijet Cargo Airlines were found, an overall total of 49 ½ pounds of compressed cannabis. The illegal drugs were found hidden among four buckets of food items. The substance carries a wholesale value of $197,000. All the items were seized and taken to Police Headquarters, pending further investigations. Less than 48 hours prior, a similar operation was conducted by Narcotics and K-9 officers at the airport and a total of 7 ¾ pounds of cannabis with an estimated wholesale value of $31,000 were seized. Earlier in the month of April, more than 1.6 million dollars’ worth of drugs were destroyed at Burma Quarry. This came as a result of cases that were disposed of in both the High and Magistrate’s Courts; as well as seizures, where no arrests were made.

In addition, the Home Secretary confirmed that a compensation scheme will be set up for individuals who have suffered loss or damage because of their inability to evidence their right to be in the UK and to access services. The Home Office will be engaging with stakeholders on the scope of the compensation on offer and appointing an independent adviser to oversee the scheme. A new customer contact

centre will be set up to make sure that anyone struggling to navigate the many different immigration routes can speak to a person and get appropriate advice. The centre will be staffed by experienced caseworkers who will offer expert advice and identify a systemic problem much more quickly in the future. Home Secretary Amber Rudd said: The contribution of the Windrush generation and their right to be in the UK is in no doubt and I deeply regret the situation that has arisen. It is only right that the significant contribution the Windrush generation have made to the UK is recognised. That is why I want to ensure they can acquire the status

they deserve – British citizenship – quickly, at no cost and with proactive assistance through the process. It is also why I want to make sure we set up a compensation scheme that works in the best interests of those affected. I hope that the measures I announced today will begin to reassure people as to their position and their valued status in this country. As well as not having to pay the fees associated with a citizenship application, people in these circumstances will not be required to pass the normal Knowledge of Language and Life in the UK test. People who arrived in the country between 1973 and 1988 will also be supported to access the most suitable route to regularise their status. In order to establish which

route is most suitable, people in this group will be able to take advantage of the new dedicated team which has been set up to help people confirm their status and will be given a decision on their application within 2 weeks of the necessary evidence being collected. The new team has already successfully resolved 9 cases and made 84 appointments to issue documents to individuals who have been in touch with the team through the freephone helpline. In addition, extra measures will be introduced to help those who arrived before 1973, spent their life in the UK and are now having difficulty returning either for a visit or to reside. The Home Office will help to facilitate their return on the most suitable route and waive any associated fees.

Chilean clerical sex abuse victim urges pope to fire ‘toxic’ bishops

In that letter, Francis said there had been a “lack of truthful and balanced information” about the situation in Chile. He invited the victims whose words he had once dismissed as “slander” to the Vatican to seek their forgiveness and ordered all of Chile’s bishops to a summit with him next month. “I hope the Holy Father realizes that he is surrounded by some toxic people who need to leave ...,” Cruz said, adding that some Chilean bishops were “guilty of misinforming the pope”. Cruz, who now lives in the United States, was a victims of the Rev. Fernando Karadima who was found guilty in a Vatican investigation in 2011 of abusing boys in Santiago in the 1970s and 1980s. Cruz and other victims have accused Bishop Juan Barros of the diocese of Osorno of having witnessed the abuse by Karadima, who was Barros’ mentor in Santiago. Karadima, now 87 and still living in Chile, has always denied the allegations and Barros said he was unaware of any wrongdoing. But Barros and other bishops were put under the spotlight in January when the pope sent one of the Vatican’s most experienced sexual abuse investigators, Archbishop Charles Scicluna of Malta, to New York and Chile to talk to victims and bishops. Scicluna produced a 2,300 report, which prompted the pope to call next month’s meeting. Cruz said he hoped the pope would take decisive action in order to “send a message to the world that Chile is an example of what’s going to happen all over if this culture of abuse and cover up continues”.

Prosecutors countered that the real scam artist was Cosby, who hid behind his kindly TV persona to win the trust of women he then drugged and sexually assaulted. The jury sided with Constand, who testified that she went to Cosby’s house to discuss a potential career change when he gave her three blue pills he said would relax her. She said the pills made her feel woozy, and that Cosby walked her to a sofa and laid her down. “The next thing I recall, I was kind of jolted awake,” Constand said from the witness stand. “My vagina was being penetrated quite forcefully. I felt my breasts being touched. He put my hand on his penis and masturbated himself with my hand. I was not able to do a thing.” The prosecution case was bolstered by the five additional accusers who were allowed to testify. In the first trial, O’Neill allowed only one accuser besides Constand to take the witness stand. The judge also allowed the second jury to hear another piece of evidence stricken from the first trial, that Cosby agreed to pay Constand $3.38 million to settle a civil lawsuit after prosecutors in 2005 initially declined to bring criminal charges. The settlement barred Constand from discussing publicly either the lawsuit or the underlying allegations. The defense team portrayed the settlement as evidence of a scheme by Constand to falsely accuse a celebrity of sexual assault to reap millions of dollars. The prosecution pointed to that same $3.38 million as evidence of Cosby’s need to silence Constand about the attack. In a victory for the defense, the judge allowed the testimony of Margo Jackson, who said Constand once told her “it would be easy” to fabricate an accusation of sexual assault against a celebrity to make money.

Russell Simmons and accuser agree to dismiss rape lawsuit Hip hop producer Russell Simmons and an aspiring documentary filmmaker have agreed to dismiss her civil lawsuit claiming that Simmons raped her at his Los Angeles home in 2016, court documents filed on Wednesday showed. The case, filed in January in U.S. Court in Los Angeles, was dismissed with prejudice, meaning it cannot be filed again. The filmmaker, Jennifer Jarosik, had accused Simmons of forcing her to have

sex with him after she refused his advance. She had sought $5 million in damages. Simmons has denied the accusation. Simmons’ attorney Patricia Glaser declined comment. An attorney for Jarosik did not immediately respond to a request for comment. A woman, who was not identified, was also taken into custody with Juarez, Hall said. Local media reported she was a passenger in the pickup truck.
