JUDGE WRONG ON GUN SENTENCES

T

by Hayden Boyce Publisher & Editor-in-Chief

he Court of Appeal strongly criticised a High Court judge who was known to reduce the mandatory minimum prison sentence of five years for gun crimes, saying that he was acting beyond his legal power or authority. Elliott Mottley, QC, President of the Court of Appeal, said it is “not possible for a trial judge to suspend a portion” of the mandatory minimum sentence prescribed by the Firearm Ordinance. “A judge has no power to suspend a portion of a mandatory minimum sentence prescribed by sections 3(3) and 22(1) of the Firearm Ordinance. Further, the Court certifies that there are no circumstances under which a judge could suspend any portion of a mandatory minimum sentence,” the Court of Appeal President stressed. “Any judge purporting to suspend any portion of mandatory minimum sentence would be acting ultra vires (beyond his legal powers) to the provisions of the Ordinance.” Mottley made the ruling following a Reference by the Attorney General who sought answers relating to the mandatory sentences imposed by Mr. Justice Robert Shuster on Anthony Clarke, Lavardo Outten and Ernst Dolce who were convicted for serious gun offences. vehicle and charging Station to TCI

FortisTCI recently introduced the first electric car in the Turks and Caicos Islands (TCI) as part of the company’s electric vehicle (EV) and charging station pilot program. The program includes a sixto-12 month feasibility study that

will provide insight into this new technology for interested customers in the TCI. This Electric Vehicle (EV) is a Nissan Leaf Acenta that is 100% electric. It features a 30kWh battery which when fully charged can drive up

to approximately 100 miles. In this photograph, FortisTCI President & CEO Eddinton Powell stands alongside FortisTCI senior executives and staff to showcase the company’s Nissan Leaf electric vehicle.

Governor John Freeman praises deputy Hon. Anya Williams

urks and Caicos Islands Governor His Excellency Dr. John Freeman has showered praise on his deputy Hon. Anya Williams, saying she is one of the best civil servants he has ever seen and that she can hold her own among the best civil servants in England. Speaking during a media breakfast at his

Providenciales office on Thursday, April 12th, 2018, Governor Freeman said he is very happy to go on record as saying the Turks and Caicos Islands is very fortunate to have many good senior and other public servants. “For example, the Deputy Governor is a very fine public servant, and I’ve

seen public servants all over the world. I am, myself, a civil servant and I’ve therefore seen the best that the British Civil service can produce, and the deputy governor can hold her head amongst any of them,” said Governor Freeman, who was a former British ambassador to Argentina and Geneva, and held top diplomatic posts in

Brussels, Vienna, Singapore and Germany. “So the TCI is very fortunate to have people of that quality. I could mention others who I think exercise excellent senior roles. In a territory this size, you are constantly having to produce people of quality to do all sorts of things, and there are never enough people, really.” Continued on page 2
