P

remier Hon. Sharlene Robinson and Deputy Premier Hon. Sean Astwood have issued a strong warning to hoteliers to refrain from retaliating or victimizing hotel workers because of the controversial service charge issue. The warning followed a leaked letter from the management of Gansevoort hotel to staff about service charge that went viral on social media. The Premier, who is also the Minister of Finance, said the letter created a “very disappointing atmosphere”, while her deputy, who is the Minister of Immigration and Labour, said retaliating against hotel staff will be “a big mistake” which “will not be taken lightly”. During a press conference on Tuesday, December 11th, 2018, Astwood said he immediately contacted the Gansevoort to confirm the authenticity of the letter because he thought someone was “actually playing mischief” with the company. The letter indicated that staff would now see salary deductions to pay for uniforms, and would have buy their own lunch meals because

Supreme Court delivers landmark ruling for strata corporations by Hayden Boyce Publisher & Editor-in-Chief

T

he Turks and Caicos Islands Supreme Court has delivered a landmark ruling approving strata corporations operating with a single rental manger. The ruling by Chief Justice Margaret Ramsay-Hale, which resulted from a case between Ocean Club West in Grace Bay and the owners of seven strata units in Ocean Club West, has major implications for the commercial operations of resorts in Turks and Caicos under the provisions of the Strata Titles Ordinance. It also has major implications for strata unit owners who seek to operate commercial short-term holiday rentals through popular direct rental

platforms such as ‘VRBO’ and ‘Airbnb’, paving the way for strata by-laws and polices which may lawfully prohibit these commercial rentals and impose financial sanctions on direct renters who rent their units short-term for commercial purposes in contravention of such prohibitions by strata corporations. Ocean Club was represented by Conrad Griffiths QC and David Cadman of Griffiths & Partners, while Ruth Jordan and Neale Coleman appeared for the owners of 7 strata units. In delivering her ruling, Chief Justice Hon. Margaret Ramsay-Hale quoted from a ruling of the Privy Council that strata by-laws “are to be construed benevolently, having regard to their purpose in assisting the good management of the development for the

benefit of its residents as a whole”. Following the Privy Council’s ruling in O’Connor and others v The Proprietors, Strata Plan No. 51 in 2017 (“the Pinnacle Case”), the Chief Justice handed down a judgment in Dodds et al. v The Proprietors, Strata Plan No. 27 on 7th December 2018 approving the strata corporation’s policy at Ocean Club West, which restricts short-term rentals to rental only through the resort’s single designated rental manager, Ocean Club Management Ltd, appointed by the strata corporation. The policy was approved by a majority of owners at Ocean Club West. The Privy Council confirmed in the Pinnacle Case that short-term holiday rental does not amount to private residential use and that legitimate

restrictions on the use of a strata lot are permissible. Julianne Dodds and her husband, Kevin Dodds, were among a number of owners of strata units at Ocean Club West who continued to rent their apartments directly online without using the designated rental manager appointed by the strata corporation in accordance with the policy. Dodds and the other owners, Blue Grass Holdings Ltd, Grace Holdings Ltd, Valerie Anne Beattie, Howard Grant Beattie, Litlan ltd, Michael William Craig and Sara Ayres Craig, who continued to rent in defiance of the policy contended that it was an unlawful restriction prohibited by the Strata Titles Ordinance.

the complimentary cafeteria would no longer be offered and that areas like the spa and restaurant would opt out of levying the service charge altogether. He said the company confirmed that it is a letter that they had issued out to their employees with the intention that the Ordinance would have come into play December 1st. He added: “I have already scheduled a meeting with the owner of the Gansevoort and already verbally expressed my concerns about the content of that letter. Not just for the simple things of uniforms and food, but the implications on transference of work permits. I can say to you that it is not something that I intend to take lightly and actually I will take this opportunity to caution companies, to make sure that any type of what seems to be retaliation or harm that would come unto staff would not be taken lightly and they should refrain from it.” The law makes it mandatory for

hospitality workers to receive 100 percent of service charges on guests’ bills. Astwood stated that the PDM Administration anticipates that there would be some amendments and clarity that also required legislative changes. He continued: “We have taken this moment to pause and to make sure that when we implement the service charge bill in February 1st that we take all of their concerns into consideration and it would be a big mistake for them to try to retaliate against their staff while we go through this process.” The two page letter says: Whilst we are sure you will understand as your share of service charge has increased, the Management Companies share has been completely taken away and as a result of this, we have regrettably had to reduce some of the benefits we have been able to offer to you over the past 10 years. As of December 1st, we will no longer provide complimentary uniforms for employees. The cost of your uniform will be deducted

from your pay check over 26 biweekly pay cycles. For example, if your uniform costs $750 for the year, $28 will be deducted from your paycheck each biweekly pay cycle. ” “There is an option for Stelle Ltd employees, should you wish to move over to become Wymara Ltd employees and share in the service charge pool. These employees will be reissued new employment contracts (still employed in their restaurant positions). Work permit employees will be given the option to move over to become Wymara Ltd employees when their existing work permit expire(s) and applications will be treated as first time application(s), thus providing a risk of not being approved,” it added. Premier Hon. Sharlene Robinson also shared her views on service charge and stated that she is disappointed in the atmosphere that it has created. “It is very disappointing, the atmosphere that has been created. This

They brought court proceedings against the strata corporation. The Supreme Court has now rejected their arguments. Larry Marshall, spokesman for the Executive Committee of Ocean Club West, commented: “We repeatedly urged a minority of strata unit owners more than two years ago to work with the elected representatives of the corporation, the Executive Committee, for the good management of the strata corporation in the interests of all owners.” He added: “We particularly urged them not to instigate court proceedings seeking to bar the democratic policy of the majority of owners to regulate the use and enjoyment of the resort in our common interest. Sadly, our requests were not heeded and as a result very significant costs have been incurred in court proceedings which the strata corporation did not invite or encourage. We are pleased that the Supreme Court has endorsed the democratic decision of the strata owners collectively in choosing to operate the resort with a single rental manager which was judged to be in all our interests. We look forward to working with all strata owners in future in working with our single rental manager, Ocean Club Management Ltd which has done a tremendous job in managing our property for many years.” Strata unit owners have an obligation to comply with the communal decisions of all owners. This is the necessary implication of democratic majority management of strata corporations. The owners of the units all rent their units to holiday guests from time to time as well as using them for their own private use. When the Developer sold the units to owners in 2002, it retained ownership of the reception building, the maintenance building, the restaurant building and the brand Ocean Club West Resort. These are now all owned by Ocean Club Management (OCM). As well as, but separate to, managing the resort on behalf of the Defendant, OCM runs a rental program at OCW (and also at the nearby resort known as Ocean Club Resort (informally known as ‘Ocean Club East’) whereby it manages rentals for owners who chose to join the program and sign up to a bilateral Rental Management Agreement (“RMA”) with OCM. OCM provides and manages marketing services, booking enquiries, reservations, payment, maintenance and décor of units, reception and concierge services, housekeeping, bedlinen, welcome baskets and airport transfers

(“Rental Services”). To this end and for these purposes OCM hires its own staff. OCM is directly reimbursed (with an additional 10% uplift) by the owners in its programme for many of the Rental Services such as maintenance and decoration, welcome baskets, housekeeping and airport transfers and is reimbursed for the other Rental Services it provides via an overall commission of 40% on owners’ gross adjusted rental revenue. According to the 40-page judgment, on August 2016, the OCM introduced a new policy that banned all owners from directly renting their units to holiday guests and approved only OCM to rent units to holiday guests. The unit owners assert that OCM introduced the policy to avert higher fees which would ostensibly become necessary if direct renting continued, as OCM indicated its intention to withdraw an alleged subsidy that was off-setting expenses that would otherwise have to paid by the owners if direct renting continued. This, the judgment continued, was communicated by the Defendant in the covering email to owners that attached the ‘Notice to Owners Regarding Rental, Trade or Business Activities at Ocean Club West’. The owners were faced with “a simple question: “Do I want to pay, or cause others to pay, higher strata fees?” The Chief Justice stated: “The Defendant (OCM) does not resile from that position but says, in addition, that the Policy was introduced after careful consideration by the EC which concluded that direct renting by individual proprietors was proving an obstacle to operating a wellrun full-service rB1esort and assisting the good management of the development as a whole, including the common property, in the interests of the owners as a whole. This, the Defendant asserts, was because the direct renters do not use on-site management and guest services but operate with off-site management services which has destabilized the operations of the resort overall which was intended to be operated as a full-service resort.” She added: “In essence, direct renting gave rise to non-full service resort rental operations within a 4-star full service resort as the guests of direct renters were excluded from services provided by OCM to their resort guests, on the grounds that the owners engaged in direct renting made no contribution to them. That said, the Policy is what it is and the merits of it are not for consideration by the Court but

rather the basis upon which the Policy was introduced.” The judgment noted that OCM contends that By-law 10(k) restricts the owners use of their strata lot to use as a private residence by the owners, their tenants and the owner’s visitor and guests and that use for holiday lets is a commercial use of the units for which purpose they require approval from the EC. The unit owners challenge this construction of the By-laws and assert that, as a matter of construction, By-law 10 (k) permits vacation rentals by owners and that owners can rent without EC permission. This issue is identified by the Plaintiffs as the “Construction issue”.

The judgment concluded: “The Plaintiffs’ breach of the restriction on use of the strata lots has not caused the Defendant any loss. The Defendant does not rent the units at OCW. It does not make profits from engaging in rental activity of which it has been deprived of profits by the Plaintiffs activity. The by-law is not intended to preserve such right for the benefit of the Defendant. In my judgment, it cannot be said that the Plaintiffs have taken something for nothing for which the Defendant is entitled to require payment and the Defendant would not be entitled to negotiating damages.”

SIPT cost nears $100million as of 2018

After almost three years and calling more than 200 witnesses, the Special Investigation and Prosecution Team (SIPT) corruption trial cost has extremely increased and it now nearing $100million. This was revealed by Premier Hon. Sharlene Cartwright-Robinson during a press conference on Tuesday December 11th, 2018. “As the Minister of Finance, it is my responsibility to say how burdensome the cost is becoming and looking back it has been almost $100million. Last year we budgeted $9.1million for the operation. This year we have to do the same and who knows if there are appeals and convictions. We continue to budget $10million that can go towards

rebuilding,” she said. Robinson added: “At the end of the day when we’re saying ok fine and you want to say things went wrong, that is for the court to determine, but if things went wrong there are two bodies that had to play that game and they must also bear some responsibility.” Although The Premier did not want to give further comments on the trial, she stressed that those monies being spent can go towards rebuilding efforts. “I rather not say much more than that other than I would like for them to foot the bill or at least share the cost so we can put some of those monies to rebuilding efforts” she added. She also noted that she has not been receiving status reports on

the case and she is not supposed to. “The Attorney General (AG) is not so much involved as well. This investigation is headed by the Director of Public Prosecutions (DPP’s) office, no we are not involved at all as we should not be and it is a separate of government.” The trial of former Premier Michael Misick and co-defendants began on Tuesday December, 8th, 2015 and the Crown’s opening was on Monday 18th January, 2016. Andrew Mitchell, QC, is the lead prosecutor in the Special Investigation and Prosecution Team (SIPT) corruption trial. The case is being heard by former President of the Jamaica Court of Appeal, His Lordship Mr. Justice Paul Harrison, who is judge Premier Hon. Sharlene Cartwright Robinson and jury.

UK stalls TCI constitutional talks and rejects new Crown land proposals

The British Government has indicated that it cannot proceed with discussions to advance the Turks and Caicos Islands Constitution unless there is agreement between the Progressive National Party (PNP) and the People’s Democratic Movement (PDM). And, according to Premier Hon. Sharlene Cartwright- Robinson, the British Government has also rejected proposals advanced by TCIG to enhance the Crown land policy. Speaking during a press conference on Tuesday December 11th, Premier Robinson blamed the Progressive National Party (PNP) for harming TCI’s constitutional advancement efforts. The premier, who traveled to London and attended the Joint Ministerial Council (JMC) alongside other leaders from the United Kingdom Overseas Territories (UKOTs) from the 3rd through 7th December 2018, responded to the Leader of the Opposition Hon. Washington Misick who issued a press statement distancing himself and his party from this exercise. She said: “And that is the case

This made the actions of the Progressive National Party (PNP) abundantly clear that while we know that their actions are political. They knew full well that their proposals were not even under consideration and in fact had misled the entire country.” In addition, the Premier stated that HMG has made sure to cast blame back on TCI and have refused to progress the other proposals submitted because the PNP had distanced themselves from the discussions. The Premier emphasized that the PNP’s actions have once again harmed constitutional efforts with them distancing themselves from the discussions that the PDM administration have had with them and from wasted time on proposals that they knew that were not under consideration. She continued: “Nevertheless, we have made an argument that these proposals are the people’s and we will forward those contained in the Chairman’s report and endorsed by the House of Assembly. We know the

We are again disappointed to likewise report to this country that they have also received the response on the crown land submission of 2015 and these were likewise rejected. We were advised by the UK government under similar circumstances. We are however committed to engaging the UK on both matters of the constitution and the crown land,” she explained. Robinson stressed that the constitution is a matter of urgency as there are provisions that must come into force before the next election in two years time. Having now fallen into post Brexit final quarter, the Premier

expects a delay but will finalize their submissions this month and engage again early next year. “We have received a commitment from the Minister in the UK to receive these proposals.” She added: “We believe that the people have spoken and their voices must be respected. We believe that the constitutions are the people’s document and not that of political parties, their leaders or government’s positions; we are the vehicles that we are supposed to be. We believe that this is not time now to play politics as the UK are inviting submissions from all of its overseas territories and we can ill afford to miss this opportunity.” Robinson assured that her Government will continue to do the responsible thing and invite the Progressive National Party (PNP) to do likewise. “My party has never rejected working with the PNP on constitutional proposals and to say otherwise this is a lie and fact will bear it out, we will push forward and can only hope that all of the people elected by the people will be willing to carry the people’s voice to the United Kingdom,” she concluded.

CRIME REPORT Police investigate shooting incident, one injured Police on Providenciales are investigating a shooting incident overnight that left one man injured. According to 911 central, at 10:04 p.m., Monday, December 10th, 2018, a man was shot and taken to hospital. Reports are that the victim was walking along a road in Five Cays when armed men in a grey car fired two rounds of ammunition in his direction. The victim received one gun-shot wound. Robbery in Grand Turk

Police seeks public help

Police on Grand Turk are investigating an armed robbery, which occurred Friday, December 7th, 2018. According to 911 Central, around 8:00 p.m., armed masked men robbed the Quality Supermarket. The masked men escaped on foot, leaving with an undisclosed amount of cash. There were no reports of shots fired or injuries. Investigations are ongoing. We just want to thank God that we didn’t have any storms this year because after all of that investment, but we are happy that everything went smooth and our

customers are all connected which is our number one pride to make sure that we give our customers a very good customer experience.” Although Hall did not want to comment on the cost of restoring their network, she emphasized that the company’s pride and joy is its customers and they are thankful for all. Seven Stars hosts annual SNAP Center Children’s Christmas Party By Todeline Defralien The Seven Stars Community Foundation hosted its annual SNAP Center Children’s Christmas Party in effort to bring joy to the kids faces. The event was held on Tuesday December 4th, 2018 at The Snap Center, located across from the Kewtown round-about. The children enjoyed a festive day of lots of music, food, refreshments, face painting, and bouncing castle and of course gifs and more. During the activities, Yolander Forbes, Human Resources Director told The SUN, “Every year

we have a Christmas Party for the children of the SNAP Center, this is one of the programs we’ve done over the years for giving back to the community. We’ve adopted the SNAP Center and want persons on the committee to be interactive with the children and this is one of the times that we do that.” She added: “We feel like this is a great way to give back and as citizens of the Turks and Caicos Islands, it is our duty to give back and we feel very proud for what we have been doing. Report from December 12th Cabinet meeting Her Excellency the Acting Governor, Mrs Rhondalee BraithwaiteKnowles, chaired the 28th meeting of Cabinet on Wednesday, 12 December 2018, at the Government Office Compound on Grand Turk. All Ministers were present except the Hon. Deputy Premier and the Hon. Minister of Tourism, Environment, Heritage and Gaming. At this meeting Cabinet: •Approved the revised Fiscal Strategic Policy Statement (FSPS) 2019/2023 for forwarding to the UK Government for approval; •Approved the reorganisation of the TCI Airports Authority budget for FY 2018/19 to reallocate funds within their capital budget and insurance pay outs to cover the Grand Turk and South Caicos airport fence works; •Advised Her Excellency the Acting Governor to approve, subject to further consultation and possible amendments being made, the draft TCI Companies (Economic Substance) Bill 2018 for forwarding to the House of Assembly for approval; • Approved the appointment of Mr Deveraux Malcolm as the Leader of the Opposition’s nominee to serve on the National Assessment Team for the TCI Country Poverty Assessment; • Approved the final Post Hurricanes Customs Exemption Policy for specified building materials furniture and appliances to run from 1

Ianthe Pratt Primary School gets major facelift from Sandals Foundation and Top Influencers Sandals Foundation partnered with over 100 elite digital influencers and celebrities recently to give the Ianthe Pratt Primary School a major facelift. The volunteers, including designer Rebecca Minkoff, stylist Alli Webb, and Emmy Awardwinning journalist Sam Champion, were at Beaches Turks and Caicos Resorts for the annual ‘Social Media on the Sand’ conference. They beautified the school grounds, painted several classrooms and play areas for the pupils as part of the foundation’s continued outreach programs. The ‘mommy bloggers,’ some accompanied by their children, painted school murals and the courtyard with positive and educational messages. The works are a continuation of ongoing post-hurricane repairs to the school which includes repairing damaged ceilings, installing missing handrails, new guttering to the school’s administration block, fixing leaks, repairing damaged walls and

United Way Turks and Caicos officially launched By Todeline Defralien Over the past few weeks, United Way Turks and Caicos have hosted a number of events to make themselves known throughout the community. After two years of ground work the organization has finally launched with three main focus areas which include, Education, Youth Development and Crime Prevention. This organization was founded by the strong leadership of a single donor and his family foundation who have a home here in Turks and Caicos. Mr. Waugh and the Waugh Family Foundation were instrumental in asking United Way Worldwide to visit the Turks and Caicos to see if there was a need for such a Nonprofit. The United Way Worldwide came in Turks and Caicos Islands in 2016 to conduct community conversation to create the focus of the organization. Last week Thursday December 6th saw the official launch and Gala Dinner Fundraiser with visiting delegates from United Way Worldwide International, President Mr. Jose Ferrao along with Mr. Rick and Lynn Waugh from the Waugh Family Foundation. In an interview with The SUN, Executive Director Ms. Claudine Ewing stated that the organization will be collaborating with other entities to strengthen programs within those three focus areas. The week of activities began with the launching of our “Yes I Can Read” Intervention Program. This launch took place on the Downtown

Ballpark where a Reading Fair was hosted under the theme “Desserts with Dr. Seuss”. “We had over 700 children present and 21 companies and schools hosting reading booths. This was an exciting time for the children as they visited the various booths to read a book and then headed off to the dessert stations for treats and pictures with Cat In The Hat,” Ewing said. “The week continued with a powerful networking session for corporate companies and the United Way Worldwide team. This session was a casual cocktail that created the atmosphere for conversation about how United Way works and how important the corporate sector is to the survival of the organization.” According to Ewing, to date the organization has already embarked on a few collaborative initiatives, such as partnering with the Education Department to sponsor the Special Needs Symposium that was held last month. There is also a huge restoration project going on in South Caicos where they are repairing the roofs of 15 elderly citizens homes in the Island of South Caicos, which was damaged by hurricanes Irma and Maria, eight (8) of which are completed, with a hope to finish the other seven (7) in early January. United Way hopes to change lives for the better in the local communities with a strong programs aligned with their focus areas. “The first program which is the reading program which is now running in the Enid Capron Primary School is a collaborative effort of United Way

This program is being facilitated by our volunteer teacher Mrs. Marjorie Bassett and the Enid Capron Special Education Teacher Mrs. Lashaunda Skippings. United Way hopes to duplicate this program to all government primary schools over the next year and also hope to start the after school tutoring for the older children that are struggling with reading. The aim of this program is to get every primary school age child reading at their grade level. This is a big initiative and we encourage companies and individual volunteers to come onboard and join forces as we jointly address the ills of our communities,” she explained. United Way’s future programs include school-based crime prevention programs as well as programs to address the youth employment set backs. “We want to give our young

people the tools to become the best that they can be in order to find their rightful place in society,” the executive director continued. “As Executive Director I am excited about this organization and the support that it is receiving this early in the start up. This means that our community is ready to pull together to make a difference. There are lots of exciting ventures lined up for the communities of the Turks and Caicos and we look forward to spreading our wings to all of our sister islands on the very near future.” United Way’s office is located downstairs Emily House on the Leeward Highway. Civil Service mourns the loss of colleague Tisa Joy Lightbourne The Turks and Caicos Islands Civil Service mourns the loss our dear colleague and friend Tisa Joy Lightbourne. Joy as most persons affectionately knew her, joined the civil service officially on 1st January 2000 as a Data Entry Clerk within the Department of Economics Planning and Statistics, she was upgraded to the post of Mapping Technician on 1st April 2003; a post she held for nine years in the Ministry of Finance, before being promoted in December 2012 to the role of Executive/Personal Assistant to the Leader of the Opposition in the House of Assembly and further to the Office of Premier in December 2016. During her eighteen

years of service she had the opportunity to work with a number of departments and persons including numerous elected officials in the House of Assembly. She participated in a number of training programs during her years with the Statistical Department and had the opportunity to travel representing the country and assisting the Premier on countless occasions. Persons in the various departments that she engaged with can attest that Joy was an ardent and devoted worker. She was very caring, professional and always willing to assist in whatever way that she could. Her passing will be a major loss to the service and

we will miss her hard work and dedication, but most especially her infectious smile and zeal for life. We extend our deepest sympathies to her entire family at this time, most especially her daughter Kendrea Wilson, her parents Eric and Jean Lightbourne, her siblings and love ones, including the Director of the Deputy Governor’s Office, Mr. Tito Lightbourne and pray that God will grant them strength at this difficult time and will comfort them in the days and year ahead. Keeping the weight off during the Christmas season By Dr. Marsha Barnett We are quickly going through the month of December and right into the swing of the Christmas season. This means staff parties, work functions, outings with friends and family and of course large dinner parties with a plethora of goodies and alcohol for our indulgence. It seems as if overeating and gaining weight is an imperative during this season. And in fact, a study by a nutritional supplement company found that only 3% of people don’t overdo it at all between Christmas and New Year, while 18% let themselves indulge only on the big days like Christmas day and New Year’s Day. That means that over 75% of us go mad for the whole festive season, gaining weight we desperately try to lose to in the New Year. Although weight gain may seem inevitable during the season, there are a few things you can adopt to balance the tilting scale. Keep up the exercise Exercise is many times neglected during the season as we have events to attend in the evenings, or need to meet friends and family visiting for the Christmas for drinks or a quick bite. But this is the time that sticking to some kind of exercise plan is

necessary. Even if you can’t maintain your regular schedule, find ways to get in your training. Make the date for drinks an hour later so that you can go for a run or hit the gym right after work and then head home to prepare for a night on the town. If you work out in the morning, don’t stay out late every night. Get in early sometimes so that you will be rested for your morning workout. Not only will exercise help you burn those extra calories you have been consuming, but it will also help you stay focused on your health and your healthy lifestyle, making you less likely to binge on that mac and cheese or pastry you love so much. Make healthy food choices at routine meals Because we know that you will face unhealthy food options at social events, when eating regularly, it is important to make the right food choices. Feed on low fat, high protein options like baked chicken breast, turkey and grilled fish. Limit your sugary treats and pastries and stock up on vegetables especially the green, leafy ones which will help you feel full. Try to avoid alcohol throughout the day and have water when possible with your meals instead of sodas, fruit juices or alcohol.

Tackle dinner parties like a pro

The aim of these events is to have fun with colleagues, friends and family. It is not to eat or drink yourself into a state where you need to attempt to undo the effects of the event the morning after or lose additional pounds in 2018. If you are going to a dinner, have your breakfast and lunch that day as you usually would. There is a tendency to starve oneself on the day of a big party because we want to “save our calories” so that we can eat all we want at the event thinking it will all balance out and we won’t gain weight. However, when you go to an event ravishingly hungry, you are much more likely to overeat and make unhealthy food choices. This is partly because your blood sugar, and even hormones that affect your mood will fall when you have been starving yourself and you will opt for fatty, and sugary treats to quickly get your sugars back into equilibrium. Remember, all things in moderation when you hit that buffet or dinner table. Have the treats you like but have small servings of the less the healthy options. Of course, parties are also about the booze. Starting off with water or club soda is a good way of hydrating first. Another thing to do is to alternate between alcoholic beverages and water.

Remember too, that alcohol is packed with calories and when mixed with sugary drinks, the calorie count can rival your meal. So, keep it simple when ordering. Stick with wines, wine spritzers, vodka tonic and so on and only order your sweet mixed drinks if you must. Remember if you slip up on occasion, all is not lost, get back on track. Crime and Punishment (Part II) By Ed Forbes It appears our once peaceful paradise is turning into the Wild, Wild West these days with gun shots ringing out way too often. This is something you only saw on television or crime-ridden cities like Chicago Westside. How do we get a handle of this deadly trend before it ruins our image, deter potential investors and dampens our robust tourism sector? If not controlled, law abiding citizens would be more inclined to purchase their own guns in order to protect their families, which inadvertently create a weapons demand. The other down side to this is that it will create other challenges such as guns not being properly secured and then ends up in the wrong hands like children and criminals. A gun buyback program is something worth exploring. It’s a program that is frequently used in metropolitan cities across the world. It was instituted to purchase back privately owned firearms. The purchasing is done by the police and the goal is to reduce the number of legal or illegal firearms owned by civilians, and provide a

process whereby civilians can sell their privately owned firearms to the government without risk of prosecution. At this juncture in our quest to reduce the number of gun-related crimes in some of our communities, it’s also a great opportunity to remove illegal guns from the street and out of the hands of criminals who might otherwise use them for the wrong purpose. There is no silver bullet to solving these complex issues but our leaders and law enforcement must, and I repeat, “MUST” continue to explore other measures to see what are the most effective ways to reduce crime. Crime and punishment goes hand in hand, which should include taking a closer look into our prison system. Are we creating a Ritz-Carlton service for prisoners or an inconvenience? This is why they are called prisoners. I have had the opportunity to visit our prison system on a number of occasions and although we have improved in some areas in terms of tighter security, what I saw was repugnant. Prisoners wearing the most expensive sneakers, clothing of the latest style, having groceries delivered

that can fill a small convenient store, families bringing in cooked meals etc. Is this prison to you? I’m all about human rights but we must reevaluate the true purpose of the prison system and its intended purpose. It was not design for luxury but as a punishment for crimes committed. Here is some food for thought. 1.Why aren’t the Prisoners in uniform? During my visits, most times you can not differentiate the prisoners from the visitors. 2.Why are we allowing cooked food and groceries to be brought in? It almost impossible to do a proper search of these items. 3.The prison should have their own commissary which is more controlled in addition to providing a source of revenue. 4.Chain gang, what happened to those days? While growing up in Grand Turk, low risk prisoners were required to clean the streets, why not return to those bygone days. Back then, it was a shame to be seen in prison clothes on the street.

5.A more robust border patrol operation, search and seizure of illegal cargo is how we keep the guns out. A holistic approach to crime control is what’s needed. Inclusive of the role mental health counseling and anger management classes can have. All are areas needing attention in this developing country. Mental health has been a taboo for far too long and can no longer be ignored. If left untreated, it could have wide reaching impact such as what we are seeing today in relation to the recidivism rate and growing violent crimes among teens. If you look at the profile of the individuals committing crimes, they are primary older teens or young adults. In my opinion, they are not inherently bad kids, just are impressionable, conflicted young people wrestling with emotions and impulses. They are trying to communicate their feelings and needs the only way they know how. Therefore, it’s imperative that we keep these matters at the forefront and hold our elected Ministers, the Governor and Law Enforcement more accountable.

Communication I believe before and after the passage of any bill, there should be a clear communication of the bill with the relevant stakeholders and the community at large. I know there is a House of Assembly where the bills are debated. However, it does not hurt by explaining to the public prior to and after the bills are passed. In fact, the communication should come from both the Government and Opposition. Legality and Timing of the Notice I don’t know about you but I was questioning the legality of the first press release as I am not aware of anyone seeing the gazette on November 30th revoking the December 1st implementation date. Fortunately, on December 5, 2018, I was able to get a sight of the Gazette dated November 30th. Most of us acted on the press release. The lesson we need to learn from this is TCIG needs to ensure that the press release and gazettes are done simultaneously to avoid any confusion on the legality of the press release. Of course, I know that the Minister would not do a press release if it was not legal. However, I would imagine the gazette was published before working hours ended on November 30 and so the press release should have come out then earlier than the time it came out. I stand to be corrected. On second thoughts, the gazette was probably published on the evening of November 30th the same time as the press release. Be Specific There are still a lot of speculation on what areas of the Ordinance needs clarification. I think the press release should be specific on the areas that need clarification. Too many people are guessing. In this article, I have addressed the areas I think need clarification but I don’t know if they are the same areas that the Government is talking about.

Drexwell Seymour Conclusion I know employees are disappointed but to give you some comfort, the Minister is correct in saying if the service charge was implemented on December 1st, the employees would not get a significant increase in pay slips because most guests would have already book for this season prior to December 1st. On the other hand, however, there are some guests that do book last minute reservations and so the employees would have received something in January. Furthermore, there are some villas that were not never charging service charge and with the new law, they were required to start on December 1st so those employees in the industry would have receive an increase in compensation from the last-minute bookings. It should also be noted that many people are living from paycheck to paycheck and so any amount of money make a difference even if it is $5. The point is what some of us consider insignificant may be very well be significant to others. Finally, I can understand the Government’s decision to delay because there are a few areas that require more clarification. However, given that the first payment based on the revised law would not have taken place until January 21st, 2019, I want to end with a question for us to consider. Do you think that the Government should have proceeded with the implementation on December 1st and make the amendments and public education during the month of December?

TCAAF World AIDS Day Cocktail Party T

he Turks & Caicos AIDS Awareness Foundation (TCAAF) in celebrating World Aids Day, hosted their annual cocktail party to honour those in our community who help to improve the lives of people living with HIV/AIDS in TCI, and to remember loved ones no longer with us. Persons were all dressed up in Red & White for a great cause at the luxury Gansevoort Resort on Saturday, 1st December 2018. Patrons attending the event were entertained by the beautiful singing of students from the Edward C Gartland

Youth Centre and gained more knowledge about HIV/AIDS. The event included a cash bar and free hors d’oeuvres. Fundraising efforts strive to also elevate awareness and increase education. The annual events such as the Jadot Cup and World Aids Day Cocktail Party, we are able to secure funds to support a range of educational programs and The Edward C Gartland Youth Centre. Turks & Caicos AIDS Awareness Foundation (TCAAF) is a non-profit organization formed in 2003 as a way to combat the spread of HIV/AIDS in Turks

& Caicos. Mr. Galmo Williams founded the TCAAF on World AIDS Day in 2003 with other concerned citizens who wanted to take proactive measures to raise awareness, compassion and consciousness for HIV/ AIDS in our community. AIDS has become the worst medical and social crisis in human history and the Turks and Caicos Islands is seeking to decrease the numbers throughout the Islands. Highlights of United Way TCI launch Gala Dinner

fter 2 years of ground work, United Way Turks and Caicos has finally launched in collaborating with other entities to strengthen programs with their three main focus areas: Education, Youth Development and Crime Prevention. On Thursday December 6th, the organization hosted an official launch and Gala Dinner Fundraiser which took place at the luxurious Shore Club in

Providenciales. The sold out event was attended by over 180 persons present at the dinner, with a food mixture of corporate, private and Government sector. Present from the Government was the Hon. Karen Malcolm, Minister of Education, Her Excellency Acting Governor Anya Williams, United Way Worldwide International President Mr. Jose Ferrao

along with Mr. Rick and Lynn Waugh from the Waugh Family Foundation. The entertainment was brought by Provo Performing Arts School which is a dance school for children. Also entertaining was Mr. David Bowen and his dance team. There was live auction and lots of congratulatory remarks. According to organizers of the event, it was a huge success as the

Many older adults don’t take prescribed antidepressants Older adults who are prescribed medication for depression by primary care physicians often fail to start taking these drugs or to continue using them as directed, a Dutch study suggests. While people with severe and chronic mental illness may see a psychiatrist for medications, many patients with depression may not see a mental health professional and instead get care from a primary care provider. The new study findings are drawn from data on roughly 1,500 people who were at least 60 years old and diagnosed with depression in 2012 by primary care providers. Overall, about 14 percent of the patients with depression who were prescribed antidepressants failed to start taking the drugs within two weeks, researchers report in Family Practice. When they did start taking drugs on time, about 15 percent of patients missed doses at least 20 percent of the time and 37 percent stopped altogether within a year. “Antidepressant adherence is challenging for patients of any age, but older age is a characteristic that is associated with worse adherence,” said Dr. Donovan Maust, a psychiatry researcher at the University of Michigan in Ann Arbor who wasn’t involved in the study. Patients in the study tended to do a better job of starting and continuing on medication as prescribed when they were already accustomed to taking multiple daily pills for a variety of other chronic health issues, the study found. Guyanese sailors plead guilty to possession of 4-tonne cocaine shipment -facing possible life sentence for crime

The four Guyanese men who were intercepted in a trawler in international waters last year with over four tonnes of cocaine, with an estimated street value of US$71.7 million, have pleaded guilty in a United States federal court and now face up to life in prison, United States Attorney Gretchen Shappert announced on Thursday. According to a press release, Shappert announced that Mohamed Hoseain, 70, and Richard La Cruz, 51, both of Guyana, pleaded guilty in federal court on November 28th to possession of cocaine on board a vessel. Shappert also further announced that Neville Jeffrey, 66, and Mark Anthony Williams, 32, also of Guyana, pleaded guilty in federal court on November 29th, 2018 and December 3rd, 2018, respectively, to the same offence. The release said that the plea agreements filed with the court state that the United States Coast Guard Cutter Napier on February 16th, 2017, intercepted a suspicious vessel in a joint operation with the Trinidad and Tobago Coast Guard, approximately 70 nautical miles north of Paramaribo, Suriname, in international waters. The vessel, later identified as the Lady Michelle, was located in a “known drug trafficking route

La Cruz was identified as the engineer and Jeffrey and Williams as crew members,” the release further stated. Apart from facing life in prison, the four also face a fine of up to US$10,000,000. Hoseain and La Cruz will

be sentenced on March 28th, 2019 and March 29th, 2019 respectively while Jeffrey and Williams will be sentenced on April 3rd, 2019. The cocaine shipment was recently linked to Colombian national Ricardo Ramirez, who was arrested with Guyanese associate Shervington Lovell in Jamaica in October. Former Customs AntiNarcotic Unit (CANU) head James Singh recently told Stabroek News that on February 14th, 2017, a wooden vessel, owned by Ramirez, was brought into port at Charity, Essequibo, by CANU to be searched on suspicion that it was believed to be smuggling fuel and drugs. United States Drug Enforcement Authority (DEA) personnel, the police and CANU were present during the search and the vessel was released.

Drilling contract signed for geothermal project on St. Vincent and the Grenadines St. Vincent Geothermal Company Limited (SVGCL) and the Icelandic Drilling Company (IDC) on Thursday signed a contract that will lead to drilling of four wells for a geothermal power project in St. Vincent.. According to IDC’s cheif executive officer, Sigurdur Sigurdsson the wells are intended to supply steam for the geothermal power plant to be constructed by SVGCL . The project aims to deliver a 10 megawatt geothermal power plant to the island, transforming its energy sector, reducing its dependency on imported diesel, and providing a new sustainable and affordable source of energy based on an indigenous resource. IDC notes that once operational, the plant will supply substantially all of the country’s baseload power and bring renewable energy sources to ~73 per cent of total power generation, well in excess of SVG’s Energy Action Plan target of 60 per cent by 2020. The commissioning of the plant is expected to be in approximately two years. The development of the plant has been ongoing for some time with Civil Works starting in 2018 and turbines are scheduled to be tendered out in 2019. SVGCL is a public-private partnership owned by the Government of St. Vincent and Reykjavik Geothermal, an Icelandic company focusing on geothermal power development with projects in East Africa, Mexico and the Caribbean. Sigurdsson said this is the fifth drilling contract in the Caribbean, but Iceland Drilling have been working in the area since the year 2011, both in Dominica and in Montserrat. The project is being supported by several international organizations with the Caribbean Development Bank (CDB) being the lead financier.

Former legislator warns of dire consequences following Scotiabank sale Former government minister, Peter Josie, has warned of potential dire consequences from a decision by Scotiabank to exit nine Caribbean countries, including St Lucia. Earlier this week, Scotiabank announced plans to sell the Caribbean businesses to Trinidad and Tobagobased Republic Financial Holdings Ltd., subject to regulatory approvals and closing conditions. However, Josie has expressed concern that the reserve currencies of the countries of the Organisation of Eastern Caribbean States (OECS) in US dollars could be put at the mercy and in the hands of Republic Bank or its agents in Trinidad and Tobago.

“It means that the Trinidad merchants, these avaricious people, in no time at all will find their hands on the OECS reserve currencies and very soon if that happens, the people and businesses in St Lucia and the rest of the OECS will have to line up to get a few dollars to do business,” the former St Lucia Labour Party (SLP) leader told a radio audience Thursday. He also called on Prime Minister and others to look into the matter and try to summon a meeting of all OECS leaders and Finance Ministers to see if they can halt what is going on. “It will not be in the interest of these Islands and the inhabitants of the OECS,” Josie declared.

He noted that Republic Financial Holdings Ltd. was not buying Scotiabank in Barbados, Trinidad and Tobago, Jamaica or anywhere else in the Caribbean. “One of the things we have to look at very carefully, especially in relation to Jamaica and Trinidad, is that these countries do not have the kind of foreign exchange reserves that the OECS has,” the former foreign minister explained. PAHO launches campaign to prevent cervical cancer The Pan American Health Organization (PAHO) has launched a communication campaign aimed at preventing cervical cancer, which kills more than 34,000 women annually in the Americas, including the Caribbean. PAHO describes the disease as being among the leading causes of cancer death in women in 23 countries of the region. It said the campaign titled “It is Time to End Cervical Cancer” is a designed to inform health providers and empower women and girls with health information on how to prevent this disease, which is diagnosed in some 72,000 women each year. With the slogan, “Don’t let cervical cancer stop you,” the campaign provides materials, information and stories about the vaccine against human papillomavirus (HPV), the cause of cervical cancer and about cervical cancer screening methods, to encourage women to have regular examinations for the early detection of precancerous lesions. PAHO said the ultimate goal is to mobilize health providers, women and girls to seek preventive care and stop cervical cancer from keeping women from reaching their maximum potential in life. “By being informed about cervical cancer and how to prevent it, we can help to ensure that women lead healthy, productive lives,” said Dr. Anselm Hennis, Director of the PAHO Department of Non-communicable Diseases and Mental Health. “We have the tools to prevent cervical cancer from being a threat to the health and wellbeing of women, their families, and communities.” PAHO said cervical cancer can be prevented with HPV vaccination and with screening. The HPV vaccine is recommended for girls ages nine to 14 and is available in 35 countries and territories of the region. However, in the majority of countries, the HPV vaccine coverage rate with the recommended two doses, has not yet reached 80 per cent of the target population. In addition to providing information about cervical cancer vaccination, the campaign also aims to raise awareness about cervical cancer screening, which is recommended primarily for women aged 30 to 49 years. An estimated 32 million women in the region are eligible for cervical cancer screening, which, when coupled with treatment, can save lives. The web-based campaign has a section for health professionals that contains guides, factsheets, answers to frequently asked questions, and a free online course, all aimed at building knowledge of the issue and improving HPV vaccination and cervical cancer screening.

LONDON — British Prime Minister Theresa May survived a political crisis over her Brexit deal Wednesday, winning a no-confidence vote by Conservative lawmakers that would have ended her leadership of party and country. Cohen is the first and, so far, only member of Trump’s circle during two years of investigations to go into open court and implicate him in a crime, though whether a president can be prosecuted under the Constitution is an open question. In a possible sign of further trouble for the president, Cohen said he will continue cooperating with prosecutors, and one of his legal advisers said Cohen is also prepared to tell “all he knows” to Congress if asked. At the sentencing, defense attorney Guy Petrillo pleaded for leniency for Cohen, saying, “He came forward to offer evidence against the most powerful person in our country.” U.S. District Judge William H. Woman who accused man of rape outraged he got no jail time DALLAS — A Texas judge on Monday accepted a plea bargain allowing a former Baylor University student accused of raping a woman at a fraternity party to avoid serving jail time, marking at least the third time the judge has approved probation for men accused of sexually assaulting Baylor students. Judge Ralph Strother’s decision to accept the plea deal sparked outrage from the woman who accused Jacob Walter Anderson of repeatedly raping her. The woman says she was plied with a drink of punch at the party in 2016 and became disoriented. Anderson, the woman said, led her behind a tent and assaulted her while she was gagged and choked. “He stole my body, virginity and power over my body,” the woman said in court, according to a family spokesman. Anderson had been indicted on sexual assault charges and the deal allowed him to plead no contest to a

McLennan County District Attorney Abel Reyna defended the plea deal in October. “This office stands by the plea

Judge Strother said Monday that in making the decision he had the benefit of arguments filed by attorneys on both sides and a background report assembled by a probation department. He said much of the comments he saw on social media or in emails were “not fully informed, misinformed or totally uninformed.” The decision Monday was not the first time that Strother has sentenced men accused of sex crimes to probation. Last year, he sentenced a man to deferred probation after he pleaded guilty in the 2013 rape of a former Baylor student. The judge ordered the man to pay for the woman’s counseling. The man told police the woman had been drunk, according to an affidavit.

The cost of France’s protests running into billions PARIS — France’s wave of protests and violence over the past month or so has already cost the eurozone’s second-largest economy a fortune. Road blockades, demonstrations and successive weekends of rioting in Paris and other towns have left supermarket shelves empty, stopped shoppers from buying Christmas gifts and scared away tourists. The government stands to lose out too, with tax receipts set to be lower than anticipated. Government coffers will be tapped into next year to finance tax relief and other fiscal measures announced Monday by President Emmanuel Macron to placate the “yellow vest” movement, which started as a show of anger against fuel taxes but snowballed into a grab-bag of grievances. Finance Minister Bruno Le Maire says the fallout from the protests, which have seen hundreds of arrests, 1,400 injured and five deaths in protest-related accidents, will shave 0.1 percent off French economic growth in the last quarter of 2018 and is “not good for the attractiveness of our country.” The forecast costs emanating from one of France’s most acute crises in over a decade are already running into the billions. The president’s new steps to boost the spending power of retirees and low-paid workers, a shared demand of many yellow vests, include a 100-euro ($110) hike in the minimum

With the protests having closed down city centers and yellow-vest blockades of shopping malls, many have opted to buy gifts online rather than run the gauntlet of demonstrations. The Federation of Commerce and Distribution, an industry group representing many of France’s largest chains, estimates retailers have suffered more than 1 billion euros ($1.1 billion) in lost revenues, with toy, clothing and food sales among the sectors hit. Lost revenues also mean lost sales tax receipts for the government. “People are afraid to go shopping. They are not in a shopping mood right now,” said Gontran Thuring, chief executive of the National Council

of Shopping Malls, another industry group. “It’s a disaster if this holiday season is not successful.” Tourists brave enough to venture into the center of Paris last weekend found many sites shut and boutiques closed and barricaded behind plywood. Hardly an enticing advertisement for France’s capital of art, fashion, gastronomy and romance. The protests and associated violence are taking the shine off what was shaping up as a great year for Parisian hoteliers — visitor numbers were back to levels enjoyed before terror attacks that killed 130 people in 2015. Reservations in Paris hotels are down for December, with an estimated 35,000 nights cancelled so far, market research consultancy MKG says. Storeowners are replacing shattered windows while city workers have been towing away the hulks of burned-out cars and cleaning antigovernment and anti-capitalist graffiti off shops, buildings and world-famous sites like the Arc de Triomphe, which reopens on Wednesday, more than a week after it was vandalized. Also costly are repairs to traffic radars, another target of protests. They cost tens of thousands of euros each to replace. Less quantifiable is the damage done to France’s image and to Macron’s efforts to project the country as a business-friendly country and open for investment.

Each of them, especially Trump, interrupted the others to question facts, quibble over election results and lob insults. Trump questioned Pelosi’s ability to count votes in her own House. The public clash marked Trump’s first meeting with the newly empowered Democrats since their midterm victories that put them in control of the House, laying bare the tensions on both sides and suggesting how divided government might work — or not — as the 2020 presidential election nears. Neither the public nor the private face-to-face portion of the meeting appeared to resolve the wall-funding dispute with a partial shutdown looming on Dec. 21. However, Pelosi said Trump called her later in

The wall remains the main sticking point in talks. Republican House Speaker Paul Ryan acknowledged Tuesday that the GOPled House has yet to pass legislation that includes the $5 billion in border wall funds that Trump has been requesting. Ryan likely lacks sufficient votes from Republicans who will lose their majority at the end of the month. Trump is seeking far more for his long-stalled border wall than the $1.6 billion the Senate has agreed to for border security, including physical barriers and technology along the U.S. southern border. Should the two sides not make a deal by Dec. 21, about three-quarters of the government would continue to have enough money to operate. Apple plans new $1 billion campus for Austin, Texas Apple Inc (AAPL.O) said on Thursday it would spend $1 billion to build a second campus in Austin, Texas, that will house up to 15,000 workers as part of a broader push by U.S. companies to create more domestic jobs. The iPhone maker also said it plans to expand in Seattle, San Diego and Culver City, California, and add hundreds of jobs in Pittsburgh, New York and Boulder, Colorado, over the next three years. Apple said at the start of the year it would invest $30 billion in the United States, taking advantage of a windfall from U.S. President Donald Trump’s sweeping tax code overhaul. The 133-acre campus in Austin will be less than a mile from Apple’s existing facilities and initially have 5,000 employees. Advocacy group drafts U.S. privacy bill as effort grows to make law next year WASHINGTON - A consumer advocacy group backed by large American technology companies on Thursday unveiled a U.S. privacy bill that strictly limits collection of biometric and location information and calls for punishment by fines, as Congress weighs nationwide regulation to supersede new California rules. The Washington-based Center for Democracy and Technology (CDT) said it hopes members of Congress incorporate its proposal into a number of draft privacy bills they have begun to discuss in recent weeks. Many business groups, along with individual companies such as big CDT donors Alphabet Inc and Apple Inc, are pushing for a national privacy law before the California Consumer

Privacy Act goes into effect Jan. 1, 2020. Businesses have raised concerns about their ability to comply with California’s law, which enables fines of up to $7,500 for intentional failure to disclose data collection or selling others’ data without permission. The CDT draft contains similar provisions, though it does not give consumers the right to opt out of a sale of data. Under the proposal, any company not currently regulated by industry-specific privacy laws would have to publish annual reports about how they use and secure data. Biometric information such as fingerprints and precise location could not be collected unless required for the specific service being provided.

The Federal Trade Commission would be the law’s enforcer, with fines tied to the regulator’s inflation-adjusted maximum, currently set at about $41,500. CDT Chief Executive Nuala O’Connor, who once ran the privacy operations at Amazon.com Inc and General Electric Co, said her organization began meeting with businesses and other privacy advocates a year ago to craft the bill. Oil prices edge up on hopes global supplies will tighten NEW YORK - Oil prices climbed 1 percent on Thursday, after data showed inventory declines in the United States and as investors began to expect that the global oil market could have a deficit sooner than they had previously thought. OPEC’s output agreement with Russia and Canada’s decision to mandate production cuts could create an oil market supply deficit by the second quarter of next year, if top producers stick to the deal, the International Energy Agency said in its monthly Oil Market Report.
